3. Chairperson’s Report (Alan Patashnick, Metro) Mr. Patashnick reported that at its March meeting, the Board: • Approved on Consent Calendar:

o $14.7 million in supplemental Congestion Mitigation and Air Quality (CMAQ) funds for the I-5/SR-14 High Occupancy Vehicle (HOV) Direct

Connector construction project to resolve soil contamination problems and settle delay claims due to conflicts between the HOV Direct Connector pile shaft and the Metrolink tunnel, increasing the total programmed budget from $161.1 million to $175.8 million.

o The Strategic Plan projects as a supplement to the 2009 Long Range

Transportation Plan.

o Program $19.7 million in Fiscal Year (FY) 2010 Department of Homeland Security Transit Security Grant Program (TSGP) and State Proposition 1B Transit Security Grant Program funds for eligible transit projects.

o Authorized the Chief Executive Officer (CEO) to:

Establish a life-of-project budget of $7 million for Phase 1 construction of four-quadrant crossing gates at an initial five intersections of the Metro Gold Line Eastside Extension;

Negotiate with the Exposition Metro Line Construction Authority for the Exposition Light Rail Project-Phase 1 additional Safety Enhancement Program;

Execute the annual agreement with California Highway Patrol (CHP) to provide field officer and dispatch support for the Metro Freeway and Big Rig Service Patrol programs during FY 2011; and

Directors Molina, Fasana, Antonovich motion to have staff participate with the City of El Monte in meetings with State representatives to extend the timeline for spending California Department of Housing and Community Development (HUD) grant funds allocated to the El Monte Gateway Transit Oriented Development Project Housing Element.

o Approve the following nominees for membership on the Governance

appropriate environmental documents to determine the full range of new transportation options: (1) improve mobility, safety and congestion, (2) address community concerns and (3) augment planning efforts;

o Motions:

Board direct the CEO to: − Meet with the municipal operators and Metrolink to

develop a weekly and daily EZ Pass usable on all transit services operated within Los Angeles County

identify service duplication and − Analysis of distance/time-based fare policies

Mr. Patashnick added that June 1st marked the 70th year of service by Torrance Transit.

4. FY 2007-09 Triennial Performance Review (Armineh Saint, Metro) Ms. Saint introduced Jim Moore of Moore and Associates to present the FY 2007-09 audit report. Mr. Moore stated that his team was selected to conduct the annual State audit for agencies such as Metro, as the Regional Transportation Planning Agency (RTPA), municipal operators, and the EZ Pass Program, that receive Transportation Development Act (TDA) funds. He distributed a handout and reported the following: • Cornerstone Goals - to assess efficiency, effectiveness, and economy for the

various agencies; ensure compliance with TDA regulations; and present strategies for addressing potential findings;

• Project Methodology – review RTPA and other transit operators’ progress on prior recommendations, program compliance, data reporting and performance and function reviews and the EZ Pass’s boarding count compliance, reimbursement rate calculation, and invoicing;

• Project Timeline – the Audit team conducted project initiation and initial site visits/interviews from October 2009 to January 2010; provided draft reports and held a review period March - May 2010; and on-going BOS Subcommittee presentations from March to June 2010. Mr. Moore anticipates presenting to the Metro Board in July or August 2010, with the final report completed by September;

• Findings include: o Initial Operator’s shortage of operating revenues, difficulty with consistent

reporting, Transit Access Pass (TAP) implementation, farebox recovery, and service coordination/duplication

o RTPA – clarifying role/core functions, regional coordination, improve Short Range Transit planning, TAP implementation, and role of the BOS Subcommittee

o Notable Accomplishments are as follows: − Operators resilience in dramatic funding shortfall through

innovative approaches to avoiding service cuts − “Green” Transit facility boom − Movement to alternative-fuel fleets − Coordination among operators: Southern California

Regional Transit Training Consortium (SCRTTC) and Procurement

Mr. Patashnick inquired of the innovative approaches that the municipal operators identified to avoid service cuts. Mr. Moore replied that operators identified operating cost savings through overhead reduction within their department’s transit budget. 5. Metrolink Annual Work Program FY 2010-11 (Jay Fuhrman, Metro) Mr. Fuhrman stated that the Fiscal Year (FY) 2010-11 budget has been a challenge as unemployment in Los Angeles County is up 12.3%, Metrolink ridership is down 11% from the FY 2008-09 levels, and Proposition C revenues for Southern California Regional Rail Authority (SCRRA) are also down.

Mr. Fuhrman stated that on June 25th, Metrolink will begin transitioning operations from Connex Railroad, LLC to Amtrak. Metrolink’s costs will increase in FY 2010-11, beginning July 2010, due to the transition to Amtrak train and engine crews, increased cost of insurance, and equipment/maintenance (rolling stock). Metrolink’s total operating cost for FY 2010-11 is $173.3 million or 3.4 % increase over FY 2009-10. Mr. Fuhrman stated that 53% of Metrolink’s costs are offset through passenger fares and revenues. The agency will need an additional 47% for operating cost and Metro’s share is 23.5% or $39 million. Staff reviewed Prop C 10% Funds and concluded that Metro has sufficient funds for Metrolink’s operation budget for FY 2010-11, but tat FY 2011-12 is likely to be very challenging unless the economy recovers and sales taxes increase. Staff developed the following strategic plan to get through the FY 2010-11:

• Exhaust all prior year operating, capital rehabilitation/renovation surplus ($6.8 million);

• Reduce contribution to rehabilitation/renovation program from $16 million to $8 million;

• Defer funding for new capital; • Increase fare by 6% including some service reductions and fare policy changes,

approved by SCRRA Board. Metrolink plans to make changes in their Fare policy by reducing the discount trip tickets for all riders, eliminate the mileage caps for one-way and round trip tickets and adult weekend discounts, and also reduce services on two San Bernardino and Ventura lines. Mr. Fuhrman reported that Metrolink will defer the Vincent Acton Second Platform project currently in design due to a lack of funding and reprogram the $1.9 million to complete the Lang/Ravenna siding project. Contingent upon State bonds being sold by fall or winter, the project would begin in early to mid 2011. Positive Train Control (PTC) is Metrolink’s highest priority project and staff is working diligently to complete the project by 2014. Mr. Fuhrman noted PTC program costs of $202 million with approximately $195 million identified and $7 million still needed. Metrolink/Caltrans have applied for additional High Speed Rail Interconnectivity funds and anticipate an answer by Fall 2010. If successful, the Interconnectivity funds could free-up Measure R 3% funds that are programmed to fund PTC to be used towards other projects. 3% cost increase. Mr. Fuhrman replied that the cost increase was due to changes in contractors, increased insurance rates, and new equipment/maintenance cost. Larry Stevens (League of Cities, San Gabriel Valley) asked when Metrolink will begin reducing their service? Mr. Fuhrman replied June 28, 2010. Mike Behen (League of Cities, North Los Angeles County) asked when the Vincent Acton Second Platform project will be reconsidered for construction? Mr. Fuhrman

replied that depending on funding, the project could be reconsidered as early as next year. 6. Consent Calendar A motion to approve the May 5, 2010 minutes was made by Mark Yamarone (TDM) and seconded by Lisa Rapp (League of Cities, Gateway Cities). There were no abstentions or objections. 7. Timed Agenda 9:45 A.M. (Fanny Pan, Metro) Mr. Patashnick read the TAC Appeals Protocol Guidelines as follows:

• For projects for which their respective agency is appealing, TAC members and/or Alternates should have someone other than themselves provide oral testimony;

• If TAC members and/or Alternates participate in the Appeals process by presenting a particular project(s), that same TAC member and/or Alternate cannot participate in any TAC discussion, recommendation and/or motion pertaining to the Call for Projects;

• Motion seconds should be made from an agency/jurisdiction/representative other than the agency/jurisdiction that originated the motion;

• TAC members and/or Alternates should not participate in TAC discussions concerning project(s) their agency sponsored so as not to be perceived as taking an advocacy role;

• The Alternate TAC member shall only participate in the meeting when the primary TAC member is not present;

• Any discussion involving the public should be limited to “Public Input Discussion Period” and will only be allowed when acknowledged by the TAC chairperson; and

• TAC discussions and motion development is intended for TAC members’ participation only.

Mike Uyeno (City of Los Angeles) requested that the project sponsors appealing provide a current update of the project, since the last extension, and not report the entire history of the project. Mr. Patashnick stated that he would remind presenters giving a Project Status Report to update TAC on progress made over the last 12 months. Mr. Zelmer announced that each presenter had three minutes to make their presentation followed by a two-minute question and answer period for TAC members. The following matrix summarizes the individual appeals and TAC recommendations:

Appeal: Sponsor reported that the project was delayed due to design issues between Caltrans and the City’s consultants. The City and the consultants are working closely to comply with Caltrans design standards. Design and PS&E are 95% complete and awaiting Caltrans’ approval to begin construction. Sponsor requested two-year extension to complete Bid & Award process and construction.

Two-year extension to June 30, 2012. Sponsor must advertise construction contract by May 31, 2011. If such condition is not met, sponsor needs to provide status report at the June 2011 TAC meeting.

6345 Montebello Beverly Blvd. Widening Phase II

Project Status Report: Sponsor reported that the City worked with Metro to downscope and redesign the project. The City attempted to reassess the ROW needs in order to limit the number of property acquisitions. Currently, the roadway widening plans are 95% complete and the City is preparing to acquire additional ROW needed to widen the street. Sponsor stated that the next step is to complete the ROW Re-certification and final bid documents by October 2011 and construction will be completed in 2012. Sponsor requested to continue with the 2nd year of the three-year extension to complete construction.

Approve 2nd year of three-year extension. Sponsor to provide by August 31, 2010 project milestones anticipated to be completed by May 31, 2011. Sponsor to provide project status report at the January 2011 TAC meeting. If milestones met by May 31, 2011, TAC recommends that the 3rd year of extension be approved. If milestones are not met, sponsor to provide status report at the June 2011 TAC meeting to be considered for extension.

Project Status Report: Sponsor reported that the design was completed in 2008 and that the City received Federal authorization to purchase ROW. The City has acquired five properties that are either in escrow or need the Long Beach City council’s approval for acquisition or to initiate the condemnation process. Q and A on Federal Toll Credits What are toll credits? Under a federal program, toll credits allow project sponsors not to pay local match on federal grants. They are not money, so they do not reduce the amount a project sponsor pays for the whole project, but they allow the project to go forward with 100% federal funding. How many toll credits are available? $5.7 billion in toll credits has accrued to California since 1992 and was recently approved by FHWA for use. This is estimated to be enough to fully support all federally-funded projects statewide for the next 12 years. So the short answer is that there are plenty. And toll credits continue to be generated. What funding sources can toll credits be used with? Toll credits can be used with:

o Congestion, Mitigation/Air Quality (CMAQ) funds o Demonstration projects o Regional Surface Transportation Program (RSTP) o Surface Transportation Program – Local (STPL) o Transportation Enhancement Activities (TEA) o Other federal funds

* Note: Discussions are taking place regarding how to make toll credits available to apply to transit funding programs. A tracking system acceptable to the Federal Highways Administration (FHWA) and Federal Transit Administrations (FTA) is required, and is not yet in place. Do toll credits allow project sponsors to spend less on transportation projects? No. The purpose of toll credits is to provide flexibility and streamlining in project delivery. Non-federal funds that are currently used for transportation should continue to be used for transportation. Can I use toll credits with small grants? There is no project minimum for using toll credits. However, toll credits may be cumbersome to work with as they are just being rolled out for the first time in California. We do not yet know what requirements will apply at federal and state agencies and staff may be unfamiliar with the credits and unable to provide detailed assistance. When can I start using toll credits? For FHWA projects, toll credits can be used for any project that is not already obligated. However, the Caltrans guidelines for toll credits are still in draft form. Please notify one of the following MTA Programming staff so that we can work with you to make any necessary adjustments in the TIP and be ready to proceed with using toll credits:
