Based on our engineering evaluation of appropriate high-altitude emission testing we state as the manufacturer, that all light-duty vehicles and light-duty trucks included in the respective applications comply with the applicable emission standards at high altitude. According to 40 CFR §86.1829-01 (b)(1)(ii)(B) we waive the data submittal on the basis of this statement

8.2. Data submittal waiver for particulate emissions of gasoline fueled light-duty

vehicles or gasoline fueled light duty trucks

We herewith state, that the gasoline fueled vehicles included in the respective applications, comply with the applicable standards for particulate emissions of light-duty vehicles or light duty trucks. According to 40 CFR §86.1829-01 (b)(1)(iii)(B) we waive the data submittal on the basis of this statement.

8.3. Data submittal waiver for CST exhaust emission compliance

Based on our engineering evaluation of appropriate CST testing and I/M testing we state as the manufacturer, that all light-duty vehicles and light-duty trucks included in the respective applications comply with the applicable CST and I/M emission standards. According to 40 CFR §86.1829-01 (b)(4)(ii) we waive the data submittal on the basis of this statement

8.4. Data submittal waiver for Idle CO Testing

Based on our engineering evaluation of appropriate Idle CO emissions we state as the manufacturer, that all light-duty trucks included in the respective applications comply with the applicable idle CO emission standards. According to 40 CFR §86.1829-01 (b)(5)(ii) we waive the data submittal on the basis of this statement

During the 2002/2003 model year and in accordance with Dear Manufacturer letter CCD-02-10, BMW performed a broad-based customer vehicle survey that downloaded select-shift transmission usage data during service at authorized BMW dealers. BMW has determined that 2004 model year BMW vehicles equipped with select-shift transmissions (BMW steptronic models only) will be operated predominantly in the economy mode. Using good engineering judgment, BMW has concluded that it is appropriate to carry-forward and carry-across the results of the earlier survey. Accordingly, BMW will use only economy-mode fuel economy test results when calculating fuel economy label values and Corporate Average Fuel Economy (CAFE) for the 2005 model year vehicles described in the respective application.

8.6. Leak –free exhaust system The exhaust system installed on any current model year BMW vehicle fulfills the requirements of § 86.1844-01(d)(16). In accordance with this regulation the exhaust system is designed:

- to facilitate leak free assembly, installation and operation for the full useful life of the vehicle and

- facilitate repairs to maintain leak-free operation.

The engine is controlled by the Engine Control Module (ECM). The ECM is a microcomputer - controlled system to regulate the fuel injection functions and ignition functions of the engine. 11.2. Effect of listed AECD on Emission Control System

The AECD’s mentioned above , including the respective computer control strategies, do not affect the effectiveness of the emission control system in any conditions expected to be encountered in normal vehicle operation and use and to any point of time of vehicle operation. The AECD’s does not represent Defeat Devices according to 40 CFR § 86.1803-01.

The 2005 model year BMW vehicles do satisfy our customary drivability performance requirements for vehicles sold in the United States.

17.1.2. Label Durability

BMW states that the tune-up labels are designed to be durable for the vehicle's total expected life, under the conditions in the area where the labels are attached. Typical vehicle environmental conditions shall include, but are not limited to, exposure to engine lubricants and coolants, under hood temperatures, steam cleaning, and paints or paint solvents.

17.1.3. Fill Pipe

BMW states that all vehicles meet the requirements of MAC 81-012 and CAC, Section 2290 17.1.4. Production Vehicles versus Test Vehicles

BMW states that in regard to the emission control systems and all related parameters the production vehicles will be identical to the test vehicles which are used for certification testing.

17.1.5. Continuity of Emissions in the temperature range of 20 to 86 Degrees F

BMW states that there is no discontinuity in emissions of NMOG, CO, NOx and HCHO measured on the Federal Test Procedure in the temperature range of 20 to 86 degrees F.

17.1.6. I/M Test Procedure Statement

Based on our engineering evaluation all light-duty vehicles and light-duty trucks comply with the I/M requirements at ambient temperature from 35 to 68 degrees Fahrenheit. (Refer to Common Section, Section 8, Item 8.3)

17.1.7. High Altitude Requirements

The computer-controlled multipoint fuel injection system meters fuel based on air mass flow and is self compensating. Therefore all BMW test groups comply with the high altitude requirements. (see Mail Out 86-23)

All fuels used for emission certification testing ( CARB: Phase II ) or service accumulation comply with applicable regulation.

17.1.9. Lubricants

All lubricants to be used in test vehicles comply with applicable regulations. There are no differences between proposed vehicle lubricants and proposed production vehicle lubricants.

17.1.10. Test Facility and Equipment

The facility and equipment to be used for mileage accumulation and emission testing comply with all applicable regulations.

17.1.11. Unscheduled Maintenance 17.1.11.1. Diagnostic Procedures

In the event that an unscheduled maintenance on one of the certification test vehicles might become necessary, BMW uses the on-board and service diagnostic system.

17.1.11.2. Procedures for Evaluating Drivability

During mileage accumulation of our certification test vehicles, at the various test facilities, all personnel involved are instructed to report any abnormal vehicle performance. Drivability evaluation and diagnosis of drivability problems is being performed by means of an engineering judgment attained through the joint efforts of a certification task force, consisting of highly qualified and experienced members of BMW's certification sections. To assist in the decision making, the "Trouble Shooting Guide" and service manuals for transmission, rear axle, etc. are being used.

17.1.11.3. Blanket Approval List

We do not anticipate any allowable unscheduled maintenance on items, other than those listed in MSAPC Advisory Circular No. 4A - 1.

The deterioration of the evaporative emission of the 7-series vehicle with 12-cylinder engine is identical to the 7 series vehicle with 8-cylinder engine. These models differentiate in the engine and the fuel supply system only. For the evaporative emission deterioration the influence of the engine (12-cylinders, direct fuel injection) is covered by following method in a worst case approach: All fuel leading parts in the engine compartment of the direct ignition are aged separately to 4K and 100K useful life. The fuel leading parts in the engine compartment:

- Fuel line assembly (stainless steel) - High pressure fuel pump - Injection rail - Injection valves

These parts are built in a stabilized 760Li model and evaporative test are carried out. The difference of the vehicle equipped with 100k parts and 4k parts is the deterioration of the 12-cylinder fuel system only. The resulting evaporative deterioration factors of the whole vehicle are the sum of the respective 8-cylinder vehicle deterioration factors and the deterioration factors of the fuel system of the 12-cylinder engine.
