Approve Temporary Exemption to Section II of the Pilot Board’s Rules and Regulations Governing Pilots and Pilotage on the Corpus Christ Ship
Channel for Suezmax Vessels
SUMMARY: Staff requests approval of a temporary exemption to Section II of the Pilot Board’s Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel regarding a trial period for Suezmax Vessels effective September 1, 2019.
BACKGROUND: Section II of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel (“Pilot Rules”), adopted August 1, 2013, defines certain limitations and restrictions for vessels transiting the Corpus Christi Ship Channel. The Aransas-Corpus Christi Pilots are diligently working to establish guidelines that will allow maximum channel utilization without compromising safety. The proposed rule change temporarily exempts Suezmax vessels from the requirements of Section II, including Daylight Only Passage Restrictions. The temporary exemption period shall last for a term of six (6) months and may be extended an additional six (6) months if necessary. On or before the expiration of the temporary exemption period, the Pilots will recommend rules and regulations affecting Suezmax class vessels for Pilot Board Consideration.
On July 18, 2019, the South Texas Waterway Advisory Committee (“STWAC”) held a meeting and agreed by majority vote to recommend a Suezmax trial period. Notice of this proposed rule change was posted in accordance with the requirements of Section 70.021 of the Texas Transportation Code.

AN ORDER OF THE BOARD OF PILOT COMMISSIONERS
FOR THE PORT OF CORPUS CHRISTI AUTHORITYREGARDING LIQUEFIED NATURAL GAS CARRIERS
Whereas, the current Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel (“Pilotage Rules and Regulations”), approved and adopted by the Board of Pilot Commissioners for the Port of Corpus Christi Authority (“Pilot Board”) in accordance with Chapter 70, Texas Transportation Code, are attached hereto as Attachment One; and
Whereas, on August 21, 2018, the Pilot Board adopted an order authorizing a temporary exemption for Liquified Natural Gas Carrier (“LNGC”) class vessels from the restrictions in Section II of the Pilotage Rules and Regulations, including Daylight Only Passage Restrictions (the “2018 Order”); and
Whereas, the 2018 Order authorized the temporary exemption for a period of one (1) year which may be extended if necessary until the Aransas-Corpus Christi Pilots (“ACC Pilots”) recommend rules and regulations to the Pilot Board for LNGC class vessels; and
Whereas, by letter dated July 31, 2019, Corpus Christi Liquefaction requested an extension of the temporary exemption until December 1, 2020; and
Whereas, by letter dated August 2, 2019, the ACC Pilots requested the Pilot Board adopt an additional order authorizing a partial temporary exemption for Suezmas class vessels from the restrictions in Section II of the Pilotage Rules and Regulations, including Daylight Only Passage Restrictions, for a period of six months with the option to extend the trial period for an additional six months if necessary; and
Whereas, notice of the proposed rule change was posted in accordance with the requirements of Section 70.021 of the Texas Transportation Code;
NOW, THEREFORE, BE IT RESOLVED by the Pilot Board that:
Section 1. The Pilot Board hereby amends the Pilotage Rules and Regulations by revising Section II of the Pilotage Rules and Regulations.
Section 2. Pursuant to the power and authority granted to the Pilot Board in Section 70.016 of the Texas Transportation Code, the Pilot Board hereby amends the Pilotage Rules and Regulations by revising Section II thereto to read as follows:
II LIMITATIONS AND RESTRICTIONS
Draft Restrictions
The Maximum Draft for any Vessel transiting the CCSC will be 45 feet (13.72 meters), and with a positive tide reading.

Combined Beam Restrictions
The following Combined Beam Restrictions will apply to all Vessels:
Within Cut A, the permissible combined beam for passing Vessels is 265 feet (80.77 meters).
Within Cut B, the permissible combined beam for passing Vessels is 215 feet (65.53 meters).
Within the Inner Harbor, at the location of the ADM and Citgo Docks, the permissible combined beam for passing Vessels (including combined beam of Vessels berthed at ADM and Citgo Docks) is 357 feet (108.81 meters).
Daylight Only Passage Restrictions
The following vessels are subject to Daylight Only Passage Restrictions:
All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)
All Vessels greater than 130,000 Deadweight Tonnage (DWT)
All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”
All Vessels subject to USCG Letter of Deviation requiring Tug Escort
All Vessels with greater than 26 feet (7.92 meters) trim, when passing under the Harbor Bridge
All Category One Tankers
The following applies to all Vessels subject to Daylight Only Passage Restrictions as per these Rules:
Inbound Passages are restricted to Pilot boarding no earlier than ½ hour before Sunrise, and no later than the times detailed below for the various locations.
Outbound Passages are restricted to Pilot boarding no earlier than Sunrise, and no later than the times detailed below for the various locations.

Suezmax Temporary Exemption (Effective September 1, 2019)
Effective September 1, 2019, the following vessels (excluding VLCC’s) are temporarily exempt from the Daylight Only Passage Restrictions while transiting Cut A of the Corpus Christi Ship Channel with no cargo onboard in a ballast condition.
• All Vessels greater than 900 feet (274.32meters) Length Over All (LOA)
• All vessels greater than 130,000 Deadweight Tonnage (DWT)
This temporary exemption is contingent upon one-way traffic in Cut A for all ocean-going vessels when transiting at night. The temporary exemption shall last for a term of six (6) months and may be extended for an additional six months if necessary. The temporary exemption shall not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. On or before the expiration of the temporary exemption period, the Pilots will recommend rules and regulations effecting Suezmax class vessels for Pilot Board consideration.
One Way Traffic Restrictions
The following Vessels will be restricted to One Way Traffic within Cut B:
All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)
All Vessels greater than 130,000 Deadweight Tonnage (DWT)
All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”
The following Vessels will be restricted to One Way Traffic within both Cut A and Cut B:
All Category One Tankers when transiting at night
Two Pilot Requirements
The following Vessels are required to retain the services of two Pilots for the transit:
All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)
All Vessels greater than 130,000 Deadweight Tonnage (DWT)
All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”
All Vessels subject to USCG Letter of Deviation requiring Tug Escort
All Vessels with greater than 26 feet (7.92 meters) trim, when passing under Harbor Bridge
All Vessels with a beam of greater than 120 feet (36.58 meters), when transiting the Inner Harbor, at the ADM and Citgo Docks, when both docks are occupied
All Category One and Two Tankers when transiting at night

Additional Requirements
All Vessels greater than 1,600 Gross Tons shall have available a functional AIS Pilot Plug.
All Aransas – Corpus Christ Pilots shall be provided with a Portable Pilot Unit for use during thetransit.
LNGC Temporary Exemption
Liquefied Natural Gas Carriers (LNGC) represent a new class of vessels transiting the CCSC. Effective as of August 21, 2018, LNGCs are temporary exempt from the requirements of this Section II, including Daylight Only Passage Restrictions. The temporary exemption period shall expire on December 1, 2020. The temporary exemption shall not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. On or before the expiration of the temporary exemption period, the Pilots will recommend rules and regulations effecting LNGC class vessels for Pilot Board consideration.
Section 4. The amendment to Section II of the Pilotage Rules and Regulations shall be effective on August 20, 2019.

Dear Mr. Strawbridge,
As stated in my letter on March 18, 2019, the pilots and port staff have been actively engaged in
addressing the challenges associated with the rapid expansion and growth of our waterway. We are
diligently trying to establish guidelines and concepts that will allow maximum channel utilization without
compromising safety. The expectation and goal of everyone is to accomplish this endeavor in a safe and
efficient manner.
In assisting AECOM with the Waterway Planning Study the pilots proposed the idea of one-way
movements at night for the larger vessels that are currently daylight restricted. We felt any relaxation of
the nighttime movement guidelines would provide a substantial benefit to the Port and its users and that
those changes could be done incrementally and on a trial basis. With that said, the Aransas-Corpus Christi
Pilots would like to implement the first trial period on September 1, 2019. We intend to start moving
Suezmax class tankers at night in Cut A in ballast condition. The expectation is that these vessels will have
no cargo onboard. We will conduct this trial period for a period of six months with the option of extending
the trial period for an additional six months if necessary. As I am sure you are aware, our Suezmax tanker
traffic is down on the year compared to 2018 numbers so we anticipate this extension may be required
to get all of the pilots the necessary experience at night on this class of vessels.
While it has been mutually agreed by all parties involved: the pilots, ship owners and operators, the Port,
and industry that there is nothing that can be done to fully mitigate the extra risk of moving these larger
ships at night, the pilots feel an important risk management element is to limit these higher risk vessels
to one-way traffic when transiting at night along with properly functioning range lights. This one-way
traffic restriction will not apply to inland tow traffic, but will apply to all ocean-going vessels. The pilots
feel this added safety consideration is a significant component in mitigating the added hazards associated
with moving these higher risk vessels at night.
The Aransas-Corpus Christi Pilots remain committed to our continued work with your staff, our industry
partners, and the USCG in doing everything we can to expedite vessel traffic without compromising the
stellar safety record we all have come to expect on our ship channel.

SUMMARY: Staff requests a 12-month extension to the LNGC trial period approved on August 21, 2018.
BACKGROUND: Section II of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel (“Pilot Rules”), adopted August 1, 2013, defines certain limitations and restrictions for vessels transiting the Corpus Christi Ship Channel. Liquefied Natural Gas Carriers (“LNGC”) represent a new class of vessels transiting the CCSC. On August 21, 2018, the Pilot Board approved a temporary rule change that exempts LNGCs from the requirements of Section II, including Daylight Only Passage Restrictions. The temporary exemption period was to last for a term of one (1) year and/or a minimum of 60 transits and allowed for a six to twelve-month extension if necessary until the Pilots recommend rules and regulations for LNGCs on the CCSC. The temporary exemption does not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. The Aransas Corpus Christi pilots continue to evaluate the rules and regulations governing LNGC vessels and an extension of the trial period is necessary for the evaluations to continue.

Dear Mr. Strawbridge, The Aransas – Corpus Christi Pilots are in support of extending the LNGC trial period. Currently LNGC vessels are not defined in the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel, nor are any of their passage restrictions. As we have now been handling this new class of vessels for about 9 months, the pilots are getting a better feel for their maneuverability and the challenges involved with these LNGC transits. The pilots remain committed to trying to establish guidelines and concepts that will allow maximum channel utilization on our waterway, and feel that this extension will allow some flexibility to work through the challenges and growing pains associated with the expansion happening on our ship channel.
