Respected Sir,
Ref : Aspirations of Senior Citizens regarding the National Budget for 2012-13
Respectfully, Bharat Pensioners Samaj, one of the oldest & largest representative Federations ofIndian Pensioners, wish to place the following suggestions and aspirations of Senior Citizens, in
respect of the ensuing Union Budget. Sr Citizens are today around 10% of the National Population,mostly consisting the community of Aam Adami.
Sir, financial problems of Sr. Citizens largely arise because, most of them are products of the lowcost economy era in our Country, when the earnings and the savings were meager compared to
present levels. Now, surviving with the dwindling returns on the already meager savings and gallopinginflation has become a challenge. Moreover, most of the Sr Citizens suffer with age related health
problems and health care has become so costly that Sr Citizens can not afford it. These are twosituations on which Sr citizen have no control. Therefore, to merely survive in the present high cost
economy we have to ask for some financial concessions and we earnestly request you to pleaseconsider them favourably.
1] Increase the Tax exemption limit to 5.0 & 7.0 lac At present Income Tax exemption limit forSr. Citizens (60+ / -80) is `2.50 lakhs and it is proposed to be continued after implementation of DTC.
Sir, income tax exemption for individuals is related to the cost of living which is directly linked withinflation which has been rising year by year. While in case of other citizens with similar taxable
income, basic income tax exemption has been relaxed & raised over the years since the financial year2004-2005, in case of Sr. Citizens the effective basic exemption has been progressively reduced.
For & upto F.Y.2004-2005, Sr. Citizens were getting concession in income tax payable (under
section 80CC) to the tune of ` 20,000/-as compared to other citizens with similar taxable income. In2005-2006 this was changed, basic exception for other citizens was raised to ` 1,00,000/- & that for
the Sr Citizens it was made ` 1,85,000/- abolishing the ` 20,000/- deduction from Tax payable. Thischange resulted in reduction of effective concession to Sr Citizens from ` 20,000/- to 12,000/ thereby
causing a loss of ` 8,000/ to them. This concession was further reduced in subsequent years & willnow come down to jus ` 5,000/- on implementation of DTC.
Sir, Income of Senior Citizens gets reduced day by day due to deteriorating interest rates andunbearable dearness of food items and medical facilities. They do not enjoy fully Public Goods and
Services provided by Government for citizens due to immobility and many other factors. Their ability topay Tax gets reduced after retirement and from year to year due to less income, more expenditure on

food & medicines. Their Net worth gets reduced considerably as at the beginning of the year. There are
many other factors, which also require to be considered. Thus all Senior Citizens deserve to be completelyexempted from paying Income Tax. They have paid a lot of Tax for 30-40 years during their earning period
and worked hard after achieving Independence as well as during the present Economic Growth.
However, if complete exemption cannot be allowed, exemption up to 5 lakhs instead of only 2.50
lac for 60+ and 7.0 lac for 80+ group of Sr Citizens may be considered sympathetically.
2] Tax deduction at source [TDS] It is a fact that Sr. Citizens are often put to lot of mental stressand confusion as they are required to approach, often repeatedly, the Income Tax offices for refund of
tax deducted at source despite their furnishing “H” form to the concerned authorities / Banks who stilldeduct that through inadvertence and oversight. It is therefore requested that Senior.Citizens Community
may be excluded from the purview of TAX Deduction at Source.
3] In the new Tax code , you have proposed to give some incentives for savings with the hope that
people will be encouraged to save. In view of EET proposal and permitting the savings in only 4 SavingsIntermediaries which does not suit Sr. Citizens. They will be discouraged to save anything due to long
term scheme & EET and thus will lose the present incentive of getting rebate for saving of ̀ 1 lakh and willhave to pay more tax to the extent of not saving. Keeping in view their deteriorating financial and physical
condition from year to year and their capability to pay tax and to ensure that their Net Worth does not getreduced disproportionately, the rule of EET may not be applied to Senior Citizens & they be allowed to
save in the existing schemes like Senior Citizens Saving Scheme 2004, NSCs, etc.
4] The plight of Central and State Government and PSU Pensioners The above categories of
Pensioners are also badly hit by inflation which has eroded considerably their already inadequatepension. Pension should, therefore, be paid net of taxes as was recommended by the 5th CPC vide
Para 167.11 of their report. Moreover, pensioners are a homogenous class which cannot be divided onthe basis of their date of retirement and pension is not a bounty. It is a statutory, inalienable, legally
enforceable right( S.C.Judgement D.S.Nakara & others vs UOI (AIR 1983, SC 130) & Vth CPC reportPara 127.3 to 127.6 .Therefore, the Government is urged to honour the S.C. judgement in letter &
spirit to bring all pensioners at par .
5] Implementation of the National Policy on Older Persons, The National Policy on Older
Persons (NPOP) although announced almost 12 years ago has witnessed very slow momentum inrespect of implementation of various Welfare Programmes for senior citizens, largely due to lack of
specific Budgetary provisions. We request that this aspect may kindly be taken care of in your next b

7] Specific Saving Scheme for Senior Citizens For financial protection to Elderly Community,9% Senior Citizens’ Savings Scheme was introduced in August. 2004 through the Budget
announcements. During the intervening periods, there has been huge increase in cost of living with theresult that 90% of Sr. Citizens, who get pension benefits, but have to survive on interest returns on their
investments of meager savings, have been experiencing innumerable difficulties in the maintenance oftheir very livelihood.

HUNDRED AND FORTY-SECOND REPORTon the petition praying for grant of one rankone pension to the armed forces personnel
The Committee on Petitions of Rajya Sabha
under the Chairmanship of Shri Bhagat SinghKoshyari, MP, presented its Hundred and Forty-
second Report to the Rajya Sabha on 19thDecember, 2011 on the petition praying for grant of
one rank one pension to the armed forces personnel.
2. The Petition was submitted by Shri Sanjay
Prabhu and others, resident of Bangalore andcountersigned by Rajeev Chandrasekhar, MP,
Rajya Sabha.
3. The Committee during the course of its
deliberations interacted with the petitioners,representatives of Departments of Ex-servicemen
Welfare (M/o Defence), Expenditure (M/oFinance) and Pensions and Pensioner's Welfare
(M/o Personnel, Public Grievances and Pensions)and some organizations/individuals.
4. Following are the important
recommendations of the Committee:-
4.1 The Committee has taken note of the fact
that a sum of `1300 crores is the total financialliability for the year 2011-12 in case OROP is
implemented fully for all the defence personnel inthe country across the board. The Committee was
informed that out of this, 1065 crores would go toretirees belonging to Post Below Officer Ranks
(PBOR) while the Commissioned Officers wouldbe getting the remaining i.e. 235 crores. The
Committee felt that 1300 crores is not a very bigamount for a country of our size and economy for
meeting the long pending demand of the armedforces of the country. The Committee understand
that this 1300 crores is the expenditure for oneyear which might increase at the rate of 10 percent
annually. Even if it is so, the Committee does notconsider this amount to be high, keeping in view
the objective for which it would be spent.

4.2 The Committee was not convinced with
the version of the Ministry of Finance that the grantof OROP to the defence personnel would eventually
generate similar requests from the civilian workforce of the country under the Central Government
and the State Governments. The Committee feelsso because of the quite different terms and
conditions of service of the two different categoriesof employments. The terms and conditions of
armed forces are tougher and harsher than thecivilian Government employee. On the issue of
returning of service medals by the defencepersonnel of our country to the President of India
in view of the Governments' apathetic attitudetowards their demand of grant of OROP, the
Committee was of the view that our defencepersonnel should not feel alienated to this extent
again and they are not forced to surrender theirhard earned service medals in this manner to exhibit
their discontent with the government policies.

4.3 The Committee also felt that the decision
of the Government to bring our defence personnelon the pattern of the civilians with regard to their
pay, pension, etc. (from Third Central PayCommission onwards) is not a considered
decision which has caused hardship to thedefence personnel and has given birth to their
demand for OROP. The Committee understandthat before the Third Central Pay Commission,
the defence personnel were getting their pay /pension on the basis of separate criteria
unconnected with the criteria devised for thecivilian work force. That criteria acknowledged and
covered the concept of OROP which has beengiven up after the Third Central Pay Commission.

Sir, there is an imperative need to extend them adequate financial protection by modifying the
Scheme as “11% Senior. Citizens’ Savings Scheme” & raising the max. deposit limit to Rs 20 lac.We, therefore, reiterate that the interest rate of the Scheme should be increased to 11% and it be
continued with new arrangements for payment before maturity within one year.
8] Higher 2% rate of interest on Term Deposits Although all Banks were advised by R.B.I. in
April 2001, to pay half to one percent additional interest on term deposits, no Bank is paying onepercent additional interest and trying to comply with R.B.I. directives within the range of half percent
additional interest. In fact, even 1% higher interest is not adequate to provide the desired protection toSenior Citizens. It is requested that there should be provision of additional 2% interest on their term
deposits The benefit of additional interests should be on all types of deposits to fulfil the requirementsof financial protection to Senior Citizens. the R.B.I., therefore, needs to be advised suitably.
Sir, we have placed before you in brief our major financial aspirations . Considering the increasing
span of life and limited resources at the disposal of Senior Citizens, we feel confident that as abenevolent progressive economist, you will positively consider to translate the above siggestions and
aspirations into reality.
Sir, it is observed that before the Budget you arrange meetings with different sections of society to
hear their views. We shall be thankful if you would consider us similarly so that there would bemeaningful interaction to understand one another with relevant perspectives. We ardently look forward

the latest orders and how a few availed of thesebenefits on his specific guidance to them.
Shri Dutta praised the services of BPS and
particularly our octogenarian Secy Gl, Shri ShyamSunder. He continued that even at this advanced
age, Shri Shyam Sunder has been spending morethan 16 hours on many days in the cause of
pensioners. He suggested that volunteersavailable at Delhi should come forward and render
requisite assistance to lessen the burden of ourSecy Genl. At this juncture, Shri O P Verma, a
dedicated member of BPS from Dwarka (NewDelhi) came forward to render the requisite
assistance to the BPS. On a suggestion madeby the Secy Gl, it was decided to include him as
a ‘Special Invitee’ to the MC.
Other speakers lauded the services of BPSand stressed that the unity among pensioners
should be further strengthened. The other issuesraised by them were non-implementation of parity
principle/modified parity for the existing pensioners(both pre-1996 retirees and pre-2006 retirees) and
other long-pending demands of pensioners.
Regarding the merger of AICCPA with BPS,
the proposal for formation of a Jt Committeereceived from Shri S S Ramachandran, Secy Gl,
AICCPA was approved. However, the House feltthat BPS being the older organization (established
in 1955) it may not be advisable to change thename of the organization.
The AGM ended with a Vote of Thanks to the
Chair proposed by R N Tripathi, Sr VP.

PROCEEDINGS: AGM - 2011The House assembled on 04.11.11 at 10:00
hours. The Chief Guest was Shri K R
Gangadharan, Vice President, IFA, Toronto @Secunderabad, (AP). He was received with
warmth and affection by the President, Sr VicePresident, Secy Genl and Secy (Railways) of
BPS. After a brief welcome remarks both by thePresident and Secy Genl, the proceedings started
with collective singing of the National Anthem.Shri R N Tripathi, Sr VP anchored the proceedings
of the meeting.
Shri K C Pipal, President, thanked the ChiefGuest for his acceptance of the invitation from
the BPS and also sparing his valuable time to bewith the delegates from across the country. He
also thanked each member and office bearers ofthe Management Committee, BPS, for their co-
operation. He praised Shri Shyam Sunder, ouroctogenarian Secy Genl for his untiring services
to the BPS even at this advanced age. Heexpressed his happiness that during his tenure
in BPS, he could see this age-old Federationachieve still further heights by two holding National
Conventions of Railway Pensioners at Delhi andSecunderabad respectively and now planning a
March to Parliament alongwith other federationsand serving Central Govt employees to present a
memorandum on our long-pending demands.
Thereafter, the President requested the Chief
Guest to honour the Members of the PlatinumAge Brotherhood 2011. Thirty-one Members were
invited to attend the function. 22 of them whograced the occasion were honoured with garlands
and presented with a citation and a shawl. One ofthe members of Platinum Age Brotherhood
thanked the BPS for this honour. A GroupPhotograph of this Brotherhood was also taken.
Before taking up the next item of the agenda,
‘Awards for Outstanding Affiliates’ Sr VP madean announcement of a contribution of Rs 5,000/-
by Shri S C Maheswari, Secy, Railways in thename of his wife Smt. Daya Maheswari (who
passed away on 01.08.11) to be utilized forpresentation of an award in her name, along with
a Trophy, each year for the most Outstanding
Affiliate of BPS. One Award of ` 5,000/- alongwitha Trophy each year is already donated, in honour
of Late Shri S P Vatta, by his family, for the samenoble cause of awarding a most Outstanding
Affiliated Association. Thereafter, Shri Maheswariannounced that the BSNL Assn at Ahmedabad
was adjudged as the most Outstanding Affiliatefollowed by AICGPA, Pune as the second one. 2
other affiliates of BPS at Mohali and Chandigarhwere selected as the third and fourth winner. The
Chief Guest and the President presented thetrophy, cash awards and certificates to the
representatives of these winners.
The Chief Guest, Shri K R Gangadharan, inhis address thanked the BPS for the warm
reception accorded to him. He narrated an incidentwhen Hon’ble CM of Haryana declined to meet
him initially as a representative of Sr Citizens justlooking at his appearance ( in view of his
considerably younger age, the Hon’ble CM tookit for granted that he could not be a representative
of Sr Citizens. Thereafter, he was finally given aninterview by the CM when others explained in detailhis position and status in a leading International
Organization connected with Sr Citizens). ShriGangadharan narrated that, while some of the
International cities do have friendly dispositionsand facilities for Sr Citizens at Railway Stations
and other public places, more number of citiesdo not have such friendly approach whereas the
position in Indian cities is far from satisfactory. Insome countries of the world, there is a national
policy for senior citizens whereas, in India, abeginning is yet to be made in framing a National
Policy for Sr Citizens. Though recommendationshave been made for laying down a National Policy,
it is yet to be framed in the absence of a powerfullobby for Sr Citizens.
It is ironical that the concerned Minister and
the Deptt received sufficient funds to initiate variousmeasures for the welfare and benefit of Sr Citizens
but the allocation could not be used and fundslapsed in the absence of suitable policy and
guidelines. (Both the concerned ministers andbureaucrats – Centre and States – were working
at cross purposes and raising queries.) Various

committees and sub-committees were formed,
issues discussed but eventually no decision wastaken. He suggested that in view of very large number
of senior citizens in India, a powerful lobby shouldbe created and should focus on their demands for
the general welfare of all senior citizens.
He felt that an advocacy effort would be veryimportant in getting things done in this field. He
said that the Ministry of Social Justice at thecentre should take the initiative and should follow
with the concerned departments in various Statesin framing the guidelines and utilizing the funds
for senior citizens. He advised that all federations/confederations of pensioners should move
together with other forums of senior citizens ingetting these general benefits / welfare measures
for all senior citizens in addition to projectinggenuine long pending demands of pensioners.
First session before Tea-Break came to anend after Sr VP conveyed ‘Vote of Thanks’ to the
Chief Guest, distinguished members on the dais,members of the Platinum Age Brotherhood and
all members of the BPS present in the house.
When members assembled after Tea-break,R N Tripathi made a reference to members who
left for their heavenly abode since the last AGM.The House stood in silence for 2 minutes as a
mark of respect to them.
Thereafter, Secretary General’s Report was
taken up for discussion. In the absence of anyformal report of Secy Genl, Shri Shyam Sunder
recalled that most of our activities are being coveredregularly in our monthly magazine – ‘BHARAT
PENSIONER’. He mentioned that full parity/modified parity codified by the 5th Pay Commission,
carried forward by the SCPC and accepted by theGovt for the benefit of the existing pensioners has
not been implemented by the Govt. This issue hasbeen taken up with the Deptt of Pension, but the
Govt is yet to act upon this demand. He listedother achievements including holding of National
Conventions of Rly Pensioners at Delhi andSecundrabad and various campaigns undertaken
by the BPS during this year. He also mentionedthat a big rally of pensioners with active participation
of serving Central Govt employees would be heldon 25.11.11 and that a memorandum listing our
long-pending demands would be personally handed
over to the Hon’ble PM by a team of top officebearers of various associations/federations/
confiderations of pensioners and servingemployees. After brief discussions and
clarifications made by the Secy Genl on a fewpoints raised by the members, the House approved
the report of the Secy Gl unanimously.
Accounts for 2010-11 and Budget Estimatesfor 2011-12 which were already circulated among
the members were taken up for discussion. Afterbrief discussions, the Accounts were also passed
with voice vote. It was also unanimously decidedto continue the services of the present auditor
Garg Bros & Associates for the FY 2011-12.
The next item of the agenda – ‘Open House
Discussion’ and ‘Resolutions’ – was taken up. Textof resolutions unanimously passed has already been
published – vide pp 11-12 of ‘Bharat Pensioner’ (Nov2011). This was followed by free and frank views
expressed by participants/accredited delegates ofaffiliated associations. The main speakers were S/

Somasekhar Rao dwelt at length on the long-pending demands of the pensioners. He mentioned
that the Govt is aware of our genuine demands butdeliberately is not coming forward to favourably
consider them. He stressed that unity among thepensioners is of paramount importance and that we
should keep constant pressure upon the Govt toget our demands conceded. He also narrated that
on persistent efforts made by the BPS, Govt haveissued favourable orders like grant of pension to
widowed daughters, unmarried daughters etc. Butthese concessions are not known to large number
of pensioners and other beneficiaries. He listed outone or two cases where they were informed about

MINUTES OF THE MEETING HELD ON 3rd Nov,2011 AT NEW DELHI WITH THE OFFICERS OFTHE GOVT DEPTTS/ MINISTRIES REG ISSUEOF REVISED PPOs IN RESPECT OF PRE-2006PENSIONERS / FAMILY PENSIONERS
A meeting was held on 3rd Nov, 2011 at 3:30PM in ICAR Committee Room, Krishi Bhavan,
New Delhi under the Chairmanship of Shri RameshC. Misra, Secretary (Pension, AR&PG) with the
officials of 16 Deptts/Ministries having maximumnumber of pre-2006 pensioners/family pensioners
and the 4 Ministries/Deptts outside the domainof CPAO, viz., Ministries of Defence and Railways
and the Deptts of Telecom and Posts. TheController General of Accounts (CGA), Shri C.R.
Sundaramurati was also available for the meeting.The objective of this meeting was to review the
progress made by various civil and non-civilMinistries and to identify and avoid the bottlenecks
in the process of revision of PPOs in respect ofpre-2006 pensioners.
2. The list* of participants is at Annexure - I.
3. At the outset, the Chairperson welcomed
all the participants and briefed them about thebackground and objective behind convening of this
meeting. The Chairperson expressed concern overthe slow progress made by the Ministries/Deptts
in this regard resulting in delay in the revision ofPPOs. He informed that the matter was last
discussed in the Standing Committee of VoluntaryAgencies (SCOVA) meeting held on 21.9.11. At
that time, the number of revised PPOs issuedfinally by the CPAO was 73,050 as on 5th Sep,
11. In their latest report, the number shown as on20th Oct, 11 is 85,727. The issue of 12,677 revised
authorities during a period of one and a half monthsuggests that there is some improvement.
However, there is scope for improvement.
4. The Chairperson pointed out that out of6,46,872 (total pre-2006 pensioners), there are
1,58,970 pre-1990 pensioners, of which 1,13,029
are from the Ministries/Deptts of the Gol. As perCPAO, there was a pendency of 99.5% in these
cases as on 5th Sep, 2011. A difficulty in respectof pre-1990 cases that has come to the notice is
that for the purpose of determining the quantumof the qualifying service, the date of joining of the
Government servant has been made a mandatoryfield in the CPAO’s software and a revised PPO
cannot be issued if this field is kept blank. Itappears that in the absence of any record, the
pensioners are being asked to supplydocumentary proof in support of the date of joining
declared by them, which some of them are perhapsnot in a position to provide.
5. The Chairperson observed, which was alsoagreed to by the CGA, that the date of joining is
not an important information for calculating thequalifying service as it may be reduced by the
interveninq periods of absence from duty and inany case it has no effect on the determination of
family pension. Therefore, it was decided that dateof joining should not be kept as a mandatory field
in the software. He further added that assuggested in the SCOVA meeting, the Ministries/
Deptts may like to consider augmenting theirmanpower for expeditiously completing this
exercise within a time-frame.
6. The CGA pointed out that the authoritiesconcerned in the administrative Ministries/Deptts
are required to send the updated pension papersto concerned PAOs so that the revised authority
could be forwarded by the PAOs to the CPAO forexpeditious action. He further mentioned that the
role of the CPAO starts only when PAO of theconcerned Ministry/Deptt submits the revised
pension payment authority of the pre-2006Pensioners to the CPAO for onward transmission
to the Banks with the special seal of authority.
7. Thereafter, the status of revision of PPOs
by the Ministries/Deptts was reviewed on thebasis of inputs received from them as well as the
CPAO. A statement received from the CPAO onthe status of revision of pension cases of pre-
2006 pensioners and family pensioners (positionas on 20/10/2011) of the 16 largest Ministries/
Deptts is placed at Annexure A*.

8. As against the figure of total 2,08,511 pre-
2006 pensioners/family pensioners and 38,754number of PPOs shown already revised in the
statement by the CPAO, the representative ofMinistry of Home Affairs (MHA) informed that they
sent 250 PPOs to the concerned PAOs. Therepresentative from the MHA was informed that
they would also have to review the positions ofvarious organizations like BSF, CISF etc. under
them and was asked to come prepared in thenext meeting with all information about all the
units/offices under their administrative control.
9. Ministry of Urban Development pointed out
that response received from the pensioners wasvery poor and they received only 58 applications
from the pensioners/family pensioners so far eventhough CPAO published an advertisement on
3.9.11 across the country. The Chairpersonobserved that the Ministry may put up
advertisement to elicit responses from thepensioners. It was finally decided that the Deptt
of Pension and PW would bring out a model advtnext month which may be used by individual
Ministry/Deptt. The advt may also spell out theutility of the revision of PPO to the individual
pensioner/family pensioner. It was also agreedthat the advt shall also be posted on the web-site
of respective Ministry/Deptt. It is also agreed thatall the Banks may be directed by the Reserve
Bank of India/CPAO to seek details of family fromall pensioners/ family pensioners at the time of
receiving life certificates from them in the monthof November.
10. As against the position indicated in the
statement of the CPAO, Deptt of Atomic Energyinformed that they have completed 55% cases.
They have been writing letters to the pensionersas they have set a target of revising 1000 cases
per month and completing the whole exercisebefore 31st March, 2012. In view of the satisfactory
progress, it was decided not to call the Deptt ofAtomic Energy for review in future.
11. CBEC raised the issue that some of theBanks, especially, PNB is not sending Annexure
III which has been a cause of delay. Age and otherdetails of family pensioners are not available and
therefore the cases cannot be processed further.
CBEC was informed that all the authorities
concerned will accept the attested copies ofdocuments such as Election ID, PAN card,
matriculation certificate, passport, CGHS card,driving licence or the Aadhar card submitted by
the pensioner/family pensioner. However, there maybe cases where the pensioner/family pensioner is
unable to produce any of the above documentsbut has some other documentary evidence. In such
an event, a decision taken by the adrninistrative”Ministry/Department shall be final.
12. Ministry of I & B’s information differed fromthat provided by the CPAO substantially. They
state to have done 1526 cases (16.5%) out of atotal of 9,232 cases as against 1,050 cases (6%)
out of 17,364 shown by the CPAO. It was decidedto review the matter in the next meeting.
13. There was mismatch in figures given by
the Deptt of Economic Affairs, Deptt of Revenue,Ministry of HRD and the Ministry of Agriculture
on the one hand and the CPAO on the other hand.To sort out the matter, it was decided to call all
the Deptts to come with their respective figuresfor more fruitful review in the next meeting.
14. Ministry of Civil Aviation informed that 700cases sent by them to the CPAO were not taken
into account by the CPAO. Further, they areconfident of meeting the deadline of 31st March,
2012 set by them. Keeping the progress madeand the commitment shown, it was decided that
the Ministry of Civil Aviation need not be calledfor the next meeting.
15. Similarly, keeping in the view that morethan 50% cases of the Ministry of Consumer
Affairs, Food and Public Distribution pertain tothe FCI which belong to the IDA pattern, it was
decided that they need not be called for the nextmeeting as their pendency does not need review.
16. Ministry of Rlys informed that they have atotal of 11.81 lakh cases, 8.72 lakh pension cases
and 3.09 lakh family pension cases. They publishedadvertisement in the newspapers and received 3.99
lakh applications out of which 2.68 lakh PPOs havealready been issued. Chairman, Rly Bd has written
to GMs to form teams of welfare workers and Depot

BUDGET IS THE TIME TO BREAK THE SPELL
The forthcoming budget must put asideneo-liberal policies and increase publicspending on infrastructure and employment
On the face of it, UPA 2 govemment appears
beleaguered. The Supreme Court has cancelled
the 2G licences, thus, negating the telecom
minister Kapil Sibal’s claim that there is no scam
as there is “zero loss to the exchequer” and that,
nothing “irregular” happened. New areas of conflict
have arisen over the age controversy of the army
chief, Indian Space Research Organisation (Isro)
scientists, refuting government claims over the
Antrix scam and IAS officers in Andhra Pradesh
protesting against CBI action against them on
charges of corruption while leaving ruling politicals
alone. Price rise continues to burden people,
distress suicides of farmers continue unabated.
The prime minister himself admitted that the
nutritional status of our children is a “national
shame”. He also bemoaned the sorry state of
affairs in developing scientific research in the
country that is bound to adversely affect our future.
Problems with allies in the UPA keep mounting
with the relentless throwing of tantrums by the
Trinamool Congress.
The confidence that the government is
displaying to brazen out these developments
appears to arise from the comfort it seems to be
drawing from the hope that the results of the
current elections in some states would be in its
favour. It hopes to wrest Uttarakhand and Punjab
from the Opposition, succeed in numerical
manipulations in Goa and Manipur and emerge
as a ‘king maker’ in Uttar Pradesh. The visible
discomfort and disarray in the main opposition -
BJP - and the materialisation of these hopes, the
UPA feels will allow it to ‘ride the storm’.
On this basis, the UPA is preparing to launch
a more aggressive offensive of liberalisation in the
current budget. Even otherwise, under the pretext
of containing the burgeoning fiscal deficit, such
an agenda seems to be on the anvil.
This is happening despite the World Bank’s
recent warning that developing countries. India in
particular, should be prepared for a crisis that will
be on a par or worse than the 2008-09 global
economic meltdown. Its forecasts are significantly
lower than those in June 2011. The global economy
is likely to grow by 2.5% in 2012 and 3.1% in 2013
compared with the forecasts of 3.6% for both years.
The euro zone economy is expected to contract
no longer in individual countries but as a whole,
i.e., decline in real terms in 2012.
Almost simultaneously came The Economist
with Lenin on its cover page sporting a Che
Guevera cigar with the caption “The rise of State
capitalism”. This unabashed apologist of
capitalism and neo-liberalism bemoaned this
model of the emerging world. In an 18-page
supplement mainly covering China, Russia and
Brazil, it states that: “States capitalism is on the
march” and concludes unconvincingly that liberal
capitalism would be better for economic growth,
notwithstanding the current experience. The non-
inclusion of India in this survey is significant for
we are increasingly being correctly seen as ait
emerging ‘cheer leader’ of neo-Iiberalism.
UPA 2 appears all set to bring in crucial
financial reforms in the budget, legislations that
Left parties had prevented from being made into
law for the last seven years. Refusing to learn
from our own experience that preventing the
opening up of our financial sector is what helped
India resist the devastating impact of the global
meltdown in the first place, this government
appears to blind itself to this latest warning by
the World Bank.
The hopes in India that further financial liberalisation
will attract an inflow of foreign funds providing an
impetus for our growth also appear remote with the
World Bank warning that the rich countries had little
monetary or fiscal ammunition available to stem any
vicious cycle of continuing recession.
Making capital available more freely and less
expensively alone cannot spur economic growth. This
can bolster profits. However unless the purchasing
power in the hands of the people rises, sustainable
economic growth would not be possible.

We had been suggesting repeatedly that instead
of giving staggering amounts of tax concessions to
the rich (nearly ̀ I5 lakh crore during the last three
years), these amounts should be collected and used
for public investments to build our much needed
social and economic infrastructure while generating
large scale employment. The consequent growth of
domestic demand in India is what can sustain a
healthy economic growth which would be more
inclusive as well.
The New York Review of Books recently said:
“How could we have so misread history and treat
with contempt the teachings of John Maynard
KeynesV Remember that post-1930’s Great
Depression, Keynes had advocated active State
intervention (with the express purpose of saving
capitalism from socialism) as the only manner in
which capitalism could achieve full employment
through public investments.
Despite the growing worldwide struggless
against the ongoing capitalist crisis as seen inthe Occupy Wall Street movement, and the
snowballing strikes and protests in almost all
European countries, capitalism and its apologists
like The Economist have a tendency to ignore
the boldest of writings on the wall. Marx said once
said that capitalism “has conjured up such
gigantic means of production and of exchange, it
is like the sorcerer who is no longer able to control
the powers of the nether world whom he has called
up by his spells.” This global capitalist crisis is
systemic. lt is not because of the greed or avarice
of individuals.
Thus, in India, at this moment, it is necessary
that popular pressures are mounted to change
this neo-liberal policy direction and heavily invest
in public spending for building our much needed
infrastructure and generating large-scale
employment. This is the direction that the
forthcoming budget must give for the sake of India,
that is Bharat.

in-charges to visit pensioners for their individual
verification, depute Personnel Inspectors to visitpre-2006 pensioners and get complete information,
create special cells to receive and process theapplications, deputing more staff to complete the
work without further delay. The RBI has also beenrequested to instruct Banks to obtain information
from the pensioners in the month of Nov along withthe life certificates.
17. Ministry of Defence informed that they
were ready with 1 lakh cases out a total of 17lakhs. It was informed that all forms etc. have
been standardized and the process is going topick up speed soon. Deptt of Telecom has revised
15,000 cases out of the total 33,000. Deptt ofPosts has revised 2.21 lakh cases of the total
2,30,743. They expect to clear the 4% pendingcases by 31st Dec, 2011.
18. In view of this, the above-mentioned 4Ministries/Deptt, which are outside the CPAO
network, need not be called for the next meeting.However, they would continue to update the
Department of Pension & Pensioners’ Welfare ofthe progress made from time to time so that
DOP&PW’s data is updated.
19. No one from CBDT, Ministry of Personnel,
Ministry of Mines, the Ministry of Health & FW andthe Deptt of Science & Technology attended the
meeting. The Chairperson instructed that the matterbe taken up with the Chairman, CBDT and the
respective Secretaries of these Ministries/Deptts.
20. In the closing remarks, the Chairperson
re-emphasized the seriousness of the matter anddirected that all the Deptts of the Ministries should
be represented in the next meeting individually.The CPAO will provide the information of each
Deptt separately. The CPAO will also amend thesoftware so that date of joining does not remain a
mandatory field for pre-1990 cases.

O.M dt 27.10.1997. In O.M dt 27.10.1997, theGovt, consequent upon acceptance of the 5th CPC
recommendations, inter-alia, prescribed that 100%DA be added to the pay and on this the retirement/
death gratuity be calculated. This was madeeffective from 01.01.1996. It did not change any
provisions regarding percentage on DA for thosewho retired before 01.01.1996. Vide O.M. dt
04.12.2001, it was clarified that for calculation ofall types of gratuity (retirement/death/service
gratuity), DA admissible (at the time of retirement/death), retiring/dying on or after 01.01.1996 will
be treated as emoluments. Hence prior to01.01.1996 only basic pay was reckoned as
emoluments for computation of gratuity. It hasnot been agreed to extend the benefits to pre-
1996 retirees. Neither the Govt has taken anydecision nor have the DOP&PW issued any
instruction for reckoning of DA as emoluments,for calculating all types of gratuity of railway
Servants, who retired/died prior to 01.01.1996.

of representations have been received seekingconfirmation whether in pursuance of Supreme Court
Judgement, vide this Department’s OM No. 45/86/97-P&PW [A] Pt. I dt 04.12.2004; pre-1996
pensioners have been made eligible for receivingadditional gratuity. They have askes the concerned
pensioners to apply to their respecrive Departmentsby furnishing detail of PPO number, date of
retirement. Bank details etc. It also contains aportion of the OM purported to have been issued by
this Department but does not indicate the name ofOfficer under whose signature it has been issued.
2. In view of the above, the factual position inthe matter is as under:
(i) This Deptt has not issued any OM on4.12.2004 granting additions gratuity to pre-1996
pensioners as there is no such Supreme CourtJudgement in respect; and
(ii) The extracts of OM reproduced by thempurported to have been issued 4.12.2004 is in
fact a portion of this Department’s OM dt4.12.2001 bringing out certain modifications to
OM dt 27.10.1997. In that OM, the Govtconsequent upon acceptance of the 5 th Pay
Commission recommendations, inter-alia,prescribed that 100% of DA be added to the pay
and on this the retirement/death gratuitycalculated. This was made effective from 1.1.1996.
It did not change any provisions regardingpercentage on DA for those who retired before
1.1.1996. Vide OM dt 4.12.2001 the Governmentclarified that the addition to DA for calculation of

Sub : Clarification regarding Freshempanelment of private hospitals and revisionof package rates applicable under CGHS.
The undersigned is directed to invite reference
to this Ministry’s various Office Memoranda issued
for empanelling hospitals under CGHS at new rates
in various CGHS covered cities, vide which revised
package rates payable to private hospitals for
treating CGHS beneficiaries were notified and
hospitals and Diagnostic Laboratories and imaging
centres wore empanelled and to state that in
response to the representations received from various
quarters. It has now been decided to clarify as below:
(1) A consolidated and updated list of hospitals,
which are empanelled under CGHS through tender
process initiated in 2009-10, is enclosed
specifying the procedures, for which they were
empanelled. Clarification is issued in respect of
the hospitals, which were already empanelled
under CGHS prior to their empanelment in 2010-
11 and are approved for the same specialties for
which they were empanelled earlier under the
precious tender/continuous empanelment
scheme.
(2) List of hospitals, which have acquired NABH
status has been updated. The term, – Endoscopic
procedures – under which category Hospitals are
empanelled shall include endoscopic surgery as
well as laparoscopy and laparoscopic surgery for
the purpose of providing treatment facilities.
(3) Treatment in Casualty OPD shall be treated
as treatment under emergency and credit facility
shall be extended to the CGHS beneficiaries.
However, routine OPD consultation shall not be

(4) NABL Accreditation is not prescribed for
imaging centres and therefore, list of Rates
prescribed NABL centres shall be applicable for
Imaging Centres.
(5) Empanelled hospitals, Diagnostic Labs and
Imaging Centres shall send hospital bills (Credit
bills) in respect of Pensioners, ex-MPs. Freedom
Fighters, etc., to CGHS through UTI-TSL where
as hospital bills (credit bills) in respect of serving
employees of Ministry of Health & Family Welfare
shall be sent manually to the officer in the Ministry
of Health & Family Welfare or Dte.GHS, CGHS or
other organisations under the Ministry of Health &
Family Welfare, who referred the beneficiary for
treatment, as the case may be.
2. All other terms and conditions as mentioned
in the earlier Office Memoranda pertaining to new
empanelment remain unchanged.

NEW PENSION SCHEME IN BRIEFInformation given by the Minister of State forFinance, Shri Namo Narain Meena in writtenreply to a question in the Rajya Sabha on NewPension Scheme on December 13, 2011
New Pension Scheme (NPS) is a definedcontribution scheme, its pay out depends upon the
amount of contribution and the growth on theinvestment over a period of time for an individual
while defined benefit schemes pay out is definedand is based on salary and number of years in
service etc. at the time of retirement of an individual.
At the time of normal retirement after attaining60 years, the subscriber can withdraw 60% of the
accumulated wealth and will be required, to investremaining 40% of the accumulated wealth to buy
a life annuity from insurance company approvedby Insurance Regulatory and Development
Authority (IRDA). The mandatory provision ofannuitisation will be invested to buy life annuities
as per various options available to him. The amountof annuity varies depending upon the option
selected by him. Registration of ASPs (AnnuityService Providers) is under process and as soon
as they get registered, other details will be madeavailable. In old pension scheme government pays
pension after retirement as its liability while in NPSgovernment co-contributes to employee during his
service period to build up.a corpus on whichannuities will be paid.

Pension (Fixation Revision & Disbursement):- Wewant to draw your particular attention to Hon’ble Supreme
Court’s Constitution Bench historic judgement delivered incase of D.S. Nakara on 17-12-1982 and request that it
implemented in letter & spirit. Pensioners should not bedivided on the basis of their date of retirement or otherwise
and a uniform formula be adopted for the revision of all thepension irrespective of Class, Category or Status while in
service, i.e. if a multiplication factor of 3 is given to onesection of pensioners then, by sheer logic, it should be
uniformly adopted for all the Pensioners.
Pension to be net of Income Tax as wasrecommended by the CPC-V vide their Para 167.11-
Inflation is much more than any tax; it erodes the majorpart of already inadequate pension. To enable pensioners,
at the fag end of their lives, to live honourably, they bespared from CPC-V, Pension should be net of income tax.
Merger of DR with pension whenever it goes above50%:- In the case of working personnel, their allowancesautomatically go up by 25% whenever D.A. goes above
50%. As pensioners do not get any allowances, they feelcheated. In order to strike a balance, DR should be merged
with Pension whenever it goes beyond 50%.
Pension to Disabled & sickly pensioners bedisbursed at their residence in accordance withRBI guidelines :- Due to physical/mental disability or onaccount of prolonged sickness, quite a number of
pensioners are unable go to the Pension Disbursing Agency.There are Standing Instructions issued by the Reserve
Bank of India for payment of pension at their residence insuch cases. These Instructions are followed more in breach
than in implementation. However, in actual practice, Bankauthorities avoid doing so causing a lot of inconvenience
and even harassment to the unfortunate disabled or sick.
RAILWAY BD’s REMARKS
Only Department of Pension & Pensioners Welfare(DOP&PW), the nodal department of the Government of
India on pensionary matters is competent to take anydecision on the point raised. This Ministry being an
Administrative Ministry in pensionary matters, is boundby the instructions issued by the DOP&PW.
In all matters relating to Income Tax on the Railwayemployees, the Ministry of Railways are guided by the
provisions of Income Tax Act, 1961, rules madethereunder and various instructions issued by the Ministry
of Finance (Central Board of Direct Taxes) from time totime. The Ministry of Finance is the nodal Ministry.
Railways do not have any powers to doanything contrary
to the instructionsissued by the Ministry of Finance inthis regard.
The matter pertains to Deptt of Pension & Pensioners’Welfare, this being a policy matter applicable to all Govt
employees.
As per extant instructions on the subject sick/incapacitatedhandicapped pensioners may draw pension in the
following manner:-a) Pensioners who are too ill to sign a cheque and cannot
be physically present in the bank to withdraw moneyfrom his account but can put his thumb/toe impression on
the cheque/withdrawal form- In this case, the thumb ortoe impression should be identified by two independent
witnesses known to the Bank. One of whom should be aresponsible Bank official.
b) Pensioner who is not only unable to be physicallypresent in the bank but is also not even able to put his
thumb/toe impression on the cheque/withdrawal form dueto certain physical defect/incapacity:- In this case a mark

Dear Sir, I am directed to refer to your Memorandum dated 21-01-2011 and this office letter No. RB/RTI Cell/
2011/ 7010020695 dated 19-12-2011. Various issues raised by you have been examined in this office and
position is given hereunder:-

Grievances redressal:- The Rly Board, is requested to :(1) Make Pension Adalats functional at the Rly Bd level
also.(2) Widen scope of Pension Adalats to include all groups
i.e. A,B,C & D & all the grievances especially those relatingto the Medical attention/treatment and the post retirement
passes
(3) Invoking the extant guidelines laid down in Para 2.13
of the Master circular 63 on the subject, the Board isrequested to increase the frequency of holding Pension
Adalat at Divisional level to every three months and atZonal level to every six months. The system should be
introduced at Board level forthwith with a frequency ofonce a year.
(4) Formation of a separate Pensioners’ Cell in each
Railway Hqrs /Division
Family pension to Dependents (cases of Secondaryeligible where the event arises post retirement):-Such of the dependent relatives who are entitled to receive
can be obtained on the cheque/withdrawal form in the
same manner as described in sub-para(a) above. Thatmark should be identified by two independent witnesses
one of whom should be a responsible bank official.c) In both the cases mentioned above, the pensioner might
also be asked to indicate to the Bank as to who wouldwithdraw pension amount from the bank on the basis of
cheque/withdrawal form as obtained above and thatperson should be identified by two independent witnesses.
The person who is actually drawing money from theBank should be asked to furnish his signatures to the
Bank.These instructions have also been reiteratedby RBI to all banks vide their reference.
No.DGBA.GAD.No.H3194/45.01.001/200 9-10 dt 14-10-2009. As regards Association’s demand regarding delivery
of pension at the residence of incapacitated pensioners,a reference has been made to RBI.

(2)This Ministry has issued detailed instructions dated
12-10-95 (Copy enclosed) on the conduct of PensionAdalat on Rlys. Based on the guidelines formulated by
the Deptt of Pension & Pensioners’ Welfare (DOP&PW)nodal department for looking after the welfare of Central
Govt. Pensioners’, which are applicable to all groupsirrespective of Group A, B, C & D. The scope of the
instructions can however not be extended to includeissues related to medical facility.
(3) Guidelines issued by DOP&PW have been examined
and detailed instructions have been issued regardingconduct of Pension Adalats and replying to pensioners’
representations in a time bound manner (copy enclosed).On line redressal grievances system in theform of
Pensioners’ Portal has also been introduced additionallyby the Deptt of Pension & PW for expeditions disposal of
pensioners’ grievances. Keeping in view these measuresand that the present system of holding Pension Adalat in
December every year is functioning satisfactorily, it hasbeen decided to maintain status quo in the matter.
(4) Instructions have been issued vide this office letter
dated 20-12-2011 that COP(IR) on Zonal Rly Hqs, a DPOon Divisions and a Dy CPO in Production Units will be the
nodal officer for dealing with Pensinoers’ Associationsfor addressing pensioners’ concerns raised by
Association and individual pensioners and replying totheir representations. (copy enclosed).
Family Pension to Dependents-DOP&PW has not
prescribed any check list or documents to be submittedfor grant of family pension to widow/divorced/unmarried

Family Pension on their turn are facing much hardship,and even harassment, at the hands of the dealing clerical
staff. The reason for this unfortunate situation is therebeing no Standard procedure & Check list to act upon.
There are cases where such dependents have beenrunning from pillar to post for more than a year or even
two to get their Family Pension started. Railway Board isrequested to come to the rescue of these dependent
Unmarried/Widowed/Divorced daughters and the Blind,Physically & Mentally incapacitated Sons of ex. Railway
employees who are no more; it is not only imperative butalso urgent to lay down a standard procedure & the
requisite Check list in respect thereof with a time boundschedule.
Another reason for the delay in such cases often is theinability of the concerned section head to trace the old
records. But we have a simple solution to remedy such aseemingly intractable problem: The same or similar
procedure may be introduced as was adopted in the caseof pre-1986 retirees while revising pension on the basis
of notional fixation of pay as on 1.1.86 in implementationof the Vth CPC recommendation. Thus the RB should issue
definite and specific guidelines as to how to process thecase further when the relevant records are not traceable.
The Administration may in such cases, accept certifiedcopies of relevant documents submitted by the claimants
Harassment Due to delay in issuing revised PPO incase of pre 2006 retirees:- Wef from 1.1.2006, elderlypensioners & family pensioners of age 80 years & above
are entitled to additional pension at ascending rates.
Problems arise in the case of family pensioners wherethere is no mention of age & DOB in the existing PPOs.
The Banks do not entertain their claim to Additional familypension for want of mention of age/DOB in the existing
PPOs. They do not accept Voter I.D. cards etc as proof ofage, on the plea that the Deptt is not providing to them the
subsequent verification & acceptance.
Secondly, in the absence of revised PPOs, Pensioners &Family pensioners are being deprived of the advantage
of the provision that in no case revised Pension shall beless than 50% of the minimum of the Pay Band plus GP,
corresponding to the scale of pay from which thepensioner retired and further that in no case FP shall be
less than 30% of the said corresponding Minimum of PBplus GP. The Railway Board is, therefore, urged to issue
suitable orders prescribing time bound Schedule forissuing revised PPO on revised proforma incorporating
family details & DOB of spouse & dependent familymembers for early issue of revised PPO to all pre 2006
retirees.

Procedure for grant of family pension to physicallyhandicapped/mentally retired son/daughter isprovided in rule 75(6) of the Railway Services(Pension) Rules, 1993.
As regards the suggestion to introduce similar procedureas was introduced at the time of revising pension on the
basis of notional fixation of pay on 01.01.1996, it is statedthat this Ministry cannot take any unilateral decision in
the matter. The decision, if any, taken by the DOP&PW inthis regard will be followed by this ministry earnestly
Delay in revision of PPOs on Railways is engagingRailways’ concern. Recently Additional Member (Staff)has directed CPOs vide letter No.2008/AC-II/21/20 dt 18-
07-2011 (Copy enclosed) to complete the task of revisionof PPOs in a time bound manner. For this purpose, they
have been asked to take measures like issue ofadvertisement in national and local newspapers inviting
pensioners to apply for revision of their pension, deputePersonnel Inspectors to visit pre-2006 pensioners to get
complete information required to issue revised PPOs,form special cell to receive and process the applications
from pensioners, deputing more staff in the concernedbranches of Personnel Deptt by reallocating the duties
within the existing staff strength to complete the workwithout further delays.
In fact, the matter has been taken up at the highestlevel by CRB through his D.O. letter to GMs forrevision of all remaining PPOs in a time boundmanner. He has also directed Rlys to form teamsof WLIs and Depot In- charges to visit pensionersfor their individual verification.As regards additional pension to pensioners/family
pensioners on attaining the age of 80 years and above,guidelines have also been issued vide this office letter
No. F(E)2008/PN-1/12 dt 08-09-2008 (copy enclosed).

Income Limit for Dependency be raised to `3500/- +
DR- Income limit for Dependency/ eligibility for SecondaryFP has been raised to Rs.3500/- + DR thereon. As per the
6th CPC recommendations. Clarificatory orders need to beissued urgently as in most of the Divisions the income limit
is being still treated as ̀ 2,550/-.
Ex-gratia for Pre 1986 SRPF beneficiaries & theirfamilies:- Very few (a very small number) of Pre-1986
SRPF(C) beneficiaries are now alive, they are at presentbeing forced to live below poverty line due to meagre ex-
gratia of ` 650 to ` 3000. DR too in the case of familyrecipients is lower by 8% as compared to other pensioners.
Their dependent children i.e. unmarried/widowed/divorceddaughter, mentally, physically & visually disabled sons,
too are being discriminated against by not allowing themthe same entitlement to the meagre ex-gratia on their turn.
Certainly they too are entitled to lead a dignified lifecomparable to their earlier status in younger (working)
days as Rly Employees. Keeping in view the present daycost of living, a highly inflationary regime and humanitarian
factors, they deserve to be considered for another chanceto come over to Pensionary benefits. As the number
involved is very few, it would not cause any appreciablefinancial burden on the Govt.
Payment of enhanced ex-graita to pre 1986 SRPF(C) beneficiaries:-
In Railway Board’s letter No. F(E)III/PN/Ex.Gr./3 dated 15-11-2006
(RBE No. 170/2006) it is laid down that the Head of Office or
Department, which sanctioned the existing ex-gratia payment
authority, shall prepare the revised ex-gratia payment authority at
the enhanced rates, as in, Sub-para l(VII) above suo-motu in lieu of
the said existing authority of Rs.600/-. Revised payment authorities
have not so far been issued by several Divisions with the result a
large number of those beneficiaries are still being paid ex-gratia at the
old rates only. Instructions therefore need to be issued immediately
by the Rly. Bd. For implementation of the above mentioned orders
within a stipulated period and also ask for submission of compliance
report in this regard from concerned authorities.
Revised dependency criteria for grant of familypension has already been communicated to allZonal Railways etc. vide this office letter No.F(E)III/2008/ PN-1 /13 dt 15-09-2008 (Copy enclosed).
In the case of payment of ex-gratia to widows and eligible dependent
children of deceased SRPF (C) optees, this Ministry follows the instructions
issued by the Deptt of Pension and PW, the nodal deptt of the Govt in such
matters and hence, this Ministry cannot take any unilateral decision in the
matter. As regards the demand for giving another chance to the surviving
SRPF beneficiaries to come over to the pension scheme, it is brought out
that the Pension Scheme was introduced on the Rlys on 16-11-1957 with
retrospective effect from 01-04-1957. As per this scheme, the employees
who joined service on and after 16-11-1957 were compulsorily governed
by the Pension Scheme and the employees who were in service
between 01-04-1957 and 16-11-1957 were given an option to come over
to the Pension Scheme. Subsequently, whenever the pension scheme
underwent progression due to recommendations of successive CPC,
etc. the employees who had chosen to remain under SRPF(C) scheme,
were extended further opportunities to come over to the pension scheme.
In all, 12 such options were given, the latest being the one given on the
basis of the recommendations of the 4th CPC, in terms of which, all CPF/
SRPF(C) beneficiaries who where in service on 1.1.1986 were deemed
to have come over to the pension scheme on that date unless they
specifically opted to continue under the CPF/SRPF(C) Scheme. In effect,
the surviving SRPF(C) beneficiaries are, those persons who had
specifically chosen to remain under the SRPF(C) scheme.
The demand of such SRPF(C) beneficiaries for coming over to the Pension
Scheme was considered by the Supreme Court and in their Judgement of
13th July, 1990, it was held that the Govt’s legal obligation in the case of
SRPF(C) retirees ended on their retirement and that SRPF(C) beneficiaries
had received lump sum amount at the time of their retirement. The Vth & Vlth
CPCs did not recommend grant of another option to CPF/SRPF retirees to
switch over to the pension scheme. It may be appreciated that the Ministry
of Rlys being an administrative Ministry is governed by the orders/instructions
issued by the DOP&PW, the nodal deptt of the Government in such matters
and, therefore, cannot take any unilateral decision in the matter.
Details of the cases alongwith the names of the Divisionwho have not issued revised ex-gratia payment authorities
in terms of Board’s letter No.F(E)III/98/PNl/Ex.Gr./3 dated15-11- 2006 (Copy enclosed) need to be furnished to
enable necessary instructions being issued to theconcerned Zonal Railway etc.

Medical attention & treatment:- To issue ‘Smart Card
(on CGHS Pattern) to all RELHS beneficiaries’
It would be necessary to sensitize the Rly Doctors regarding
good behaviour and clinical practices and training forhandling geriatric patients.
In the existing Sr Citizen OPDs in Divisional & Zonal hospitalsthe facility should be strengthened and new OPDs opened
where it does not exist at present. Separate nominated days& time periods be fixed for Specialist consultation so that the
elderly do not have to stand in long queues for long periods &the Doctors are able to pay them adequate attention.
At outstations where H.Us & Lockup Dispensaries exist,
specialized OPD consultations be outsourced with theexisting procedure of dispensing of medicines & referral
through Railway’s Health Units / Lockup Dispensariesthemselves be continued.
In the CGHS, the cost of Smart Card is borne by the Ministry
of Health & FW. Why then should the Rly pensioner bepenalized to pay the cost? The Smart Card would be
immensely popular if the cost thereof Rlys is borne by the Rail
Constitution of multilevel hospital Advisory and GrievancesRedressal Committee with representations of pensioners
representatives on CGHS pattern.
RELHS scheme to be made open-ended for retirees withoutLock-in period and qualifying service of 20 years.
Providing Rest-Room facilities attached to Railway hospitalsfor stay of pensioner and their family members.
A larger number of Hospitals & Diagnostic Centres need to
be recongnized within a radius of 20 Kms from the HealthUnits / Lockup Dispensaries so that elderly patients, for
whom an attendant & even small expenditure is a luxury,are not put to physical & economic strain because of
reference to outstation Hospitals & Diagnostic Centres.
Smart Card scheme for RELHS beneficiaries was
launched as a Pilot Project in NCR Region. The PilotProject was concluded in August, 2011. The result,thereof, and further course of the action on theissue is under detailed study by Rly Bd.
The facilities for both Railway employees andRELHS beneficiaries are under constant review.Wherever the need for upgrading the facilities isfelt, the same is examined on merit andprovisions made. Similarly the days of visit byspecialist in the OPDs are fixed where both theRailway employees and RELHS beneficiaries availthe facilities.

Para 3 it is recorded “Pension Adalat is being conductedonce in every year at Zonal level and once in three
months at Divisional level.Para 1 of M.C.63 E9W)95/PA/1 dt 12.10.95 states, “the intention of conducting
Pension Adalat is to examine the grievances ofPensioners so as to redress the same by taking on –
the –spot decisions & to obviate the delays, if any, insettlement of their dues. Such a step would go a long
way in instilling a sense of being cared for and attendedto in the minds of Pensioners and thus dispel their
feeling of neglect & isolation.Settlement of dues against
Reimbursement of Medical expenditure therefore cannotbe excluded from the purview of Pension Adalat. No of
Pensioners/Family Pensioners & their grievances haveconsiderably increased over the past one & a half decade.
In the absence of strict time line & punitive clause,Grievances recorded thru Pensioners Portal “CPENGRAM”
are not being timely resolved by the Rly Admn, quite a noof such grievances are either pending for over two years
or have been unilaterally closed w/o resolving. SCOVAmeetings too are at best once a year. An year is too long
a time for the pensioners who have outlived the normallife expectancy of 67 years.Thus keeping up the spirit of
M.C. 63, scope & periodicity need to be increased urgently.
A Pensioners’ Cell with a Nodal officer at the Boardlevel too needs to be nominated.
DOP &PW has since issued detailed instruction vide their
No1/16/2011-P &PW(E) dtd 8/12/2011. These instructionsneed to be implemented over Indian Railways

Smart Card scheme for RELHS beneficiaries which was
launched as a Pilot Project in NCR region in 2008 remainedoperative for hardly three to four months during
2008,2009,2010 & 2011 & suffered with severaldeficiencies like : (i) Only three Medical Emergencies i.e
cardiac, cancer & dialysis were covered. Genl MedicalEmergencies & Neurology were left out. (ii) Though the
Smart Card was supposed to be covering the NCR regionyet only the hospitals located in Delhi were included. Even
the hospitals on panel for emergency treatment in otherNCR towns were left out. (iii) Poor response from hospitals
was mainly because of hassles in bill payment. As suchcorrect assessment may not be possible.
Matter needs to be reconsidered in the light of National

CHANDIGARH: Customs & Central ExcisePensioners Welfare Assn – Bi-monthly meetingwas held on 10.12.11 with D R Sharma, President
in the Chair, Members from Amritsar, Jalandhar,Ludhiana, Mohali, Panchkula, Chandigarh, Sonipat,
Moga & Hoshiarpur attended. Members who hadnot enrolled themselves with CGHS were advised
to become members of CGHS. Members wereinformed that 6 new members have joined the assn
and that a sum of Rs 7400/- has been received byway of annual subscription, donation and Life
Membership Fee. Birthday Greetings wereextended to members born in January and February.

Body held on 18.12.11, with V Thirunavukkarasu,President in the Chair, was attended by about 380
members. E L N Kubendaran, S Rly AFM and RKannan, APO were the Guests of Honour. P
Chinnasamy, VP, NFRP was the Chief Guest. DKrishnamoorthy, Genl Secy, NFRP read out the
Secy’s Report and detailed the cases with arrearsof Rs 10,80,800/- drawn in 2011. He also briefed
members on the latest orders received from theDept of Pension. Accts were presented by the
Treasurer and unanimously approved by the House.New office bearers were elected for the next 3 years.
New office bearers, Guests of Honour and ChiefGuest were honoured with mementos.
GONDIA: S E C R P A – AGM was held on04.01.12 with ASN Murty, President in the Chair.
Shri R B Jasani was the Chief Guest. J NarayanRao, VP (WZ), BPS was the Guest of Honour. The
President gave a brief account of the activities ofthe Assn. Narayan Rao briefly mentioned about
the functioning of Divisional Personal Branch atNagpur. Accts of 2011 were presented and passed
unanimously by the House. 4 Sr Members werefelicitated. Narayan Singh, was also felicitated for
best performance as Treasurer. Following new officebearers were elected: President – ASN Murty, Secy
– KKV Rao, Treasurer – Narayan Singh. Besidesthis, 2 each VPs and Asst Secy’s and 1 each
Wkg President and Org Secy and 8 EC memberswere also elected.
GUWAHATI: N F R P A – Bulletin for the quarter
ending Dec 2011 was released. There was aneditorial on Lokpal Bill, movement of Anna Hazaare,
controversial response of the Govt, questionableattitude and behavior of politicians etc. After obituary
reference, there was a chapter on Annual PensionAdalat at HQ, 5 Divisions and 2 workshops of NF
Rly on 15.12.11. This was followed by a brief newson IIIrd National Convention of Rly Pensioners, under
the aegis of BPS, to be held at New Jalpaiguri on29.03.12 and the 8th BGM (26th AGM) of NFRPA
on 30th and 31st March 2012. The next chapterdealt with organizational activities of Head quarters
and news from branches. The last chapter was onimportant circulars received from Deptt of Pension
& PW circulated by the Rly Board and others.

NELLORE AP: Govt R E A – Pensioners Day
was celebrated on 17.12.11. The President, NNarayana briefly mentioned the importance of the
day. He also mentioned that DR @ 5.992% duefrom 01.07.11 is required to be released by the
Govt. He also requested the Govt to issue HealthCards to all pensioners and family pensioners.
After felicitating Guests of Honour and otherprominent persons with shawls etc. 25 Sr
Pensioners were honoured with shawls, garlandsand mementos. In another meeting held on
18.01.12, President conveyed New Year andPongal greetings to all pensioners and their family
members. He also mentioned that all memberswould get free medical treatment under Arogyasri
Scheme. The Secy requested the Govt to respondpositively to the demands of pensioners. The Secy
also gave a brief report on the activities of theAssn. President conveyed Birthday Greetings to
all those born in January.
PAKALA (AP): Central and Rly Pensioners’Assn – Pensioners’ Day was celebrated on29.12.11. Shri M Somasekhara Rao, VP (SZ),
BPS cum Gl Secy, CGPF, Secunderabad andShri Subba Rao, Secy of the above Forum

celebrated on 26.12.11. Smt Madhavi Sharma,Banking Lokpal, RBI, Kanpur was the Chief Guest.
The Convenor, K S Awasthi welcomed the guestsand honoured the Chief Guest. Members were briefed
about the importance of the day. The Secy presenteda memorandum to the Chief Guest listing out theproblems of the pensioners with regard to the working
of Nationalised Banks in disbursing pension. TheChief Guest promised to look into the problems and
sort them out within the limitations of her powers.Resolution demanding full parity with past pensioners
was unanimously passed.
KAPURTHALA: P & T Audit & Accts and OtherC G P A – Monthly meeting was held on 29.01.12with V S Sikand, President in the Chair. The Secy
read out the minutes of the previous meeting andgot them approved. Birthday Greetings were

VUYYURU (AP): Pensioners Assn – PensionersDay was celebrated on 17.12.11. Floral Tributes
were paid to Late Shri D S Nakra who wasinstrumental in filing a case and obtaining a
landmark judgement from the Supreme Court infavour of pensioners on 17.12.82 (For the first time,
they have observed Pensioners Day this yearmainly due to the cooperation & effort of Shyam
Sunder, Secy Genl, BPS who sent the relevantinformation on D S Nakra).
