Dear Mr. Welch and Mr. Comorre:

Environmental Intelligence, LLC (EI) has been retained by the City of Beverly Hills (COBH) and the Los

Angeles County Metropolitan Transportation Authority (Metro) to serve as the independent compliance

monitor (ICM) during construction of the Purple Line Extension Project. Monitoring is required to ensure

that construction is in compliance with (1) the Permit titled "Demolition and Public Right-of-Way Use

Permit for the Los Angeles County Metropolitan Transportation Authority and its Contractor to Clear All

Buildings and Existing Improvements at 9430 Wilshire Boulevard, Install Noise Monitoring Equipment

and Sound Walls for Future Construction and a Laydown Area for the Wilshire/Rodeo Station of Section

Two of the Purple Line Extension Project" (Dated June 5th, 2018); (2) the Permit titled "The Demolition

and Clearing of all Buildings and Existing Improvements at 9383-9393 and 9395-9399 Wilshire Boulevard,

Installation of Sound Walls, and Relocation of City Owned Utilities in Preparation for Construction and

Staging for Section Two of the Purple Line Extension Project" (Dated November 6th, 2018); and (3) the

"Memorandum of Agreement for Contract C1120 of the Purple Line Extension Project - Between the City

of Beverly Hills and the Los Angeles County Metropolitan Transportation Authority" (Final Version 62).

The following information summarizes the ICM monitoring activities that occurred at the Segment 2 site

(Rodeo Station site) during the week of August 18, 2019 – August 24, 2019. Construction activities were

not conducted on August 24, 2019.

Construction activities during the week included setting up lane closures, installing water line pipe,

breaking pavement and hauling debris, laying steel plates, cold patching and welding, excavating and back-

filling trenches, installation of water lines, manhole installation, excavating for installation of bollards

around electrical equipment in the N. Canon yard, delivery of trailers to the N. Canon yard, potholing, UMP

installation, material deliveries within Reeves yard, geotechnical instrumentation boring, gravel and sand

deliveries, and transporting equipment. In addition, EI ICMs conducted sound monitoring near the back

alley of the Beverly Hills High School bungalows adjacent to the project site. EI ICMs were present during

all construction activities and conducted routine noise measurements at selected noise monitoring locations

as well as compliance checks in accordance with the MOAs and associated attachments, exhibits, traffic

closure notifications, and traffic management plans. At the conclusion of each work shift, daily monitoring

reports were prepared by each ICM. Attachment B (Daily Monitoring Reports) provides detailed daily

monitoring reports and photographs of construction activities.

VIOLATION SUMMARY

During the week, EI ICMs identified three (3) violations during construction activities. Table I provides a

summary of the violations identified during the week of August 18, 2019 to August 24, 2019 and Exhibit 1

provides a location map for the submitted violations. Details for the violations are included as Attachment

A. Daily monitoring reports and photographs of construction activities are provided as Attachment B (Daily

Monitoring Reports). Daily noise monitoring data are provided in Attachment C (Noise Monitoring Data

Log).

CONCLUSION

To date, 85 violations have been issued, four (4) of which have been rescinded since the beginning of

construction of the Purple Line Extension Project – Segment 2. Please note, no violation 77 was ever issued,

therefore it is skipped in the numbering sequence and is omitted from this count. Project construction

activities are ongoing and EI ICMs continue to monitor all construction activities applicable to the MOA

on a daily basis.

At 11:15 hours ICM Jorge Guzman recorded an exceedance of 3.3 dB adjacent to receptor RD-15 in the AKA alley. The noise threshold for RD-15 at this time of day is 74 LAeq. The measured noise level was 77.3 LAeq, ambient noise was negligible at the time. RD-15 EL also experienced an overage during the same sampling period. Construction noise resulted from saw cutting in the AKA alley approximately 100 feet from the intersection of Wilshire Blvd. and the alley. Violation ID #84

At 10:00 hours, ICM Benjamin Rosenkoetter observed several missing or incorrect signs for the detour associated with C1120 LCN 25.1.1 Geotech Stage 8 Lane Closure. The ICM notified the Metro inspectors of the deficiencies so that they could be corrected. At 11:38 hours, the ICM observed that the missing detour signs had not been replaced and incorrect detour signs had been installed at the intersection of S. Reeves Dr. and Charleville Blvd. The signage was not implemented in accordance with the COBH traffic control plan and is therefore a violation of Article XII of the Memorandum of Agreement for contract C1120 of the Purple Line Extension Project - Section 2. The ICM notified Inspectors Luis Garcia and Jason Johnson (Metro) of the violation. This is the first incidence of this violation at this location within the last 14 days.

Violation ID # 85

At 1115 hours ICM Jorge Guzman recorded an exceedance of 3.3 dB adjacent to receptor RD-15 in the AKA alley. The noise threshold for RD-15 at this time of day is 74 LAeq. The measured noise level was 77.3 LAeq, ambient noise was negligible at the time. RD-15 EL also experienced an overage during the same sampling period. Construction noise resulted from saw cutting in the AKA alley approximately 100 feet from the intersection of Wilshire Blvd. and the alley. Positioning of sound wall enclosure was insufficient to mitigate for noise in the direction of the sensitive receptor. The activity is in violation of Article XIV of the MOA. Mr. Guzman notified Metro inspector Luis Garcia of the violation. This is the second incidence of the violation at this location in the last 14 days.
