Justice declared a State of Emergency this week for eight West Virginia counties due to heavy rainfall that has caused significant flooding. Counties included in the State of Emergency at this time are: Jefferson, Berkeley, Morgan, Hampshire, Mineral, Grant, Hardy, and Pendleton. The Governor authorized the use of all state assets needed and directed the West Virginia State Police and West Virginia Army National Guard to assist. In a related issue, Gov. Jim Justice on Thursday announced the awarding of more than $6.6 million in grants from the Hazard Mitigation Grant Program (HMGP) made available statewide in response to the deadly and devastating June 2016 flooding. “We are leaving no stone unturned to find ways to help our people,” Gov. Justice said. “Our fellow West Virginians who endured all that devastation and all that sorrow deserve nothing less.” The money will help nearly two-dozen communities in nine counties provide backup power generators for water and wastewater treatment plants and systems. It will also fund generator purchases for other locations as well as help communities acquire or elevate property. Nearly half the total, $3 million, will be of benefit statewide. That grant will fund a risk assessment process that can pinpoint locations throughout West Virginia in floodplains or otherwise exposed to potential flooding, landslides, and other hazards. May collections of $328.9 million were $20.2 million above estimate, with year-to-date collections of nearly $3.83 billion being equal to 100.4 percent of the year-to-date estimate and more than $124 million higher than last year. The cumulative surplus was $15.5 million. “We need to say, for once in West Virginia, for once, we are really on the move,” Gov. Justice said at the news conference. Deputy Revenue Secretary Mack Muchow said improving employment numbers fueled revenue increases. “While much of the growth is in construction jobs, with booming natural gas pipeline construction and the first wave of the governor’s “Road to Prosperity” road building program, the state is also seeing growth in professional services and leisure and hospitality employment,” Muchow said. • Corporation net income tax collections exceeded the May estimate by $3.8 million. Year-to-date collections were $5.6 million above estimate and 0.8% ahead of last year.

• Severance tax collections exceeded estimate by more than $1.8 million in May. Year-to-date collections of $310.5 million were 13.3% ahead of last year.

• Business and occupation collections were $1.4 million ahead of estimate in May. Cumulative receipts were $0.2 million ahead of estimate.

• Consumer sales tax collections exceeded estimate in May by $0.4 million. Cumulative general revenue fund sales tax collections of more than $1.1 billion were still $26.5 million below estimate and just 1.2% ahead of last year.

• General Revenue Fund collections remain on target to meet or exceed year-end estimates.

• Cumulative State Road Fund collections of nearly $738.5 million were $12.5 million above estimate and 16.5% ($104.7 million) ahead of last year.

U.S. Immigration and Customs Enforcement (ICE) has ramped up workplace inspections, increasing audits and arrests as part of an effort to find illegal workers and deter businesses from hiring them. According to recently released data, ongoing worksite cases have already doubled in fiscal year 2018 in comparison to last year. From Oct. 1, 2017, through May 4, the agency’s Homeland Security Investigations (HSI) opened 3,510 worksite investigations; initiated 2,282 I-9 audits; and made 594 criminal and 610 administrative worksite-related arrests, respectively. In comparison, for fiscal year 2017 – running October 2016 to September 2017 – HSI opened 1,716 worksite investigations; initiated 1,360 I-9 audits; and made 139 criminal arrests and 172 administrative arrests related to worksite enforcement. Derek Benner, the Acting Executive Associate Director for ICE’s Homeland Security Investigation division, has indicated ICE would like to open 15,000 audits per year if possible. As for penalties, ICE calculates them by dividing the number of violations by the total number of employees to reach a “violation percentage”. The penalties, which range from $220 to $2,191 per violation, go up depending on whether it’s a first, second, or third offense. A recent agency fact sheet makes it appear that violation percentages are calculated separately depending on whether you’re talking about an I-9 violation--such as failing to properly complete a section of the form--or to knowingly hiring and/or continuing to employ an unauthorized immigrant. But in practice, it is being reported that ICE is combining the two types of offenses to reach a higher percentage and impose a higher fine. FUNDING FOR NEW CANAAN REFUGE VISITOR CENTER INCLUDED IN FY 2019 INTERIOR BUDGET Canaan Valley National Wildlife Refuge’s headquarters and visitor center, now located in a 43-year-old former restaurant that was remodeled in 2003, will be replaced with a new building, thanks to a $7 million appropriation included in the Department of the Interior’s 2019 budget. The U.S. Fish and Wildlife Service has long been seeking a new visitor center/headquarters building for the 16,500-acre refuge, citing numerous deferred maintenance issues and lack of space for educational programs, administrative work, public presentations and interpretive exhibits. The refuge’s existing visitor center located along W.Va. 32 in has fallen into “undesirable condition,” according to an analysis of the site by federal officials, according to U.S. Sen. Shelley Moore Capito, R-W.Va. Capito began seeking funding for a new visitor center shortly after entering the Senate in 2015. The Tucker County refuge, which includes West Virginia’s largest wetland complex and 13 miles of the Blackwater River, became the nation’s 500th National Wildlife Refuge when it was created in 1994. It attracts more than 30,000 visitors annually. NEAR MISSES - THE WARNING SIGNAL

How many times have you shrugged off a near miss? Never gave it a second thought? Next time

think twice. The difference between a near miss and an accident often is a fraction of a second

or an inch. And when it happens again, that difference may not be there. We never know when

the serious injury is next.

One study shows that for every 330 incidents of the same type, 300 produce no injuries, 29

produce minor injuries and one produces a major injury. (Of course, these statistics vary with the

job being done.) The problem is we never know which time the major injury will occur. Near misses

are warnings. If we heed these warnings and look for causes, we may be able to prevent injury

or damage.

Here’s an example:

You are going up a walkway into a building. Your foot slips. Being agile and empty handed, you

regain your balance with no harm done.

Another person comes along. He slips, but his reactions are a little slower than yours. To keep

from falling, he jumps off the walkway. Again, no harm done.

Then comes a third person carrying a load. He has the same experience but falls off the walkway

with the load on top of him. He breaks his ankle.

Two warnings were ignored. Finally, someone was hurt. Now the loose cleat, sand, or mud on

the walkway is discovered and the condition corrected. We've locked the barn after the horse has

been stolen. Two of us saw the thief lurking around but failed to take action. Whenever you see

a near miss, ask "Why?"

Suppose you're walking toward a suspended mason's scaffold. You see a brick fall but hear no

warning shout. Ask yourself: "Why did it fall? Was it kicked loose? Is a toe board missing?" Then

correct this condition if possible. If not, report it to someone who can. Don't let your inaction cause

someone else's injury.

MAJOR WATER INFRASTRUCTURE BILL PASSES HOUSE The U.S. House overwhelmingly passed this week (408-2) the 2018 Water Resources Development Act (WRDA). WRDA authorizes billions in funding for U.S. Army Corps of Engineers Civil Works projects, including navigation (dredging, locks), flood control (levees), hydropower (dams), recreation (parks), and water supply. AGC is committed to working with Congress to strengthen the legislation to include the Securing Required Funding for Water Infrastructure Now Act and the reauthorization of the Water Infrastructure Finance and Innovation Act. The Senate is expected to vote on its version of WRDA in the coming weeks. AGC is following both bills closely and advocating for AGC priorities in both the Senate and House WRDA bills. WV PARKWAYS AUTHORITY APPROVES NEW TOLL SCHEDULE

The West Virginia Parkways Authority unanimously adopted a new toll policy and toll rate schedule, paving the way for hundreds of millions of dollars in additional road and bridge work while creating thousands of new jobs and a discounted EZ-Pass program for state motorists. The authority met Thursday morning at the Beckley-Raleigh County Convention Center to vote on the proposal. After a brief discussion about public comments acquired through a serious of hearings across southern West Virginia, the authority voted unanimously to approve the plan. The plan allows the Parkways Authority to sell an initial installment of $172 million in bonds in July that will provide funding for important road and bridge improvements in 10 southern West Virginia counties designated by last year’s turnpike legislation. Phase one will be followed by a second bond issue estimated at $139 million within two years. Some of those projects include improvements to Route 10 through multiple southern counties and completing John Nash Boulevard to Airport Road in Mercer County. Under the plan, tolls will double for those not using the new single-fee transponder. For example, the typical $2 paid at one of the turnpike’s three mainline plazas will go to $4 for passenger vehicles. Larger vehicles such as tractor trailers and motor homes would also be put on a new schedule. Tolls at the North Beckley toll plaza, where the turnpike intersects with U.S. Route 19, are being rounded up to the nearest 25-cent mark. This makes it easier for motorists paying with cash to look for spare change. Current West Virginia EZ Pass holders will not have to get a new transponder if they want to be a part of the single fee program. The authority intends to automatically roll existing plans over to the new one. The Parkways Authority hopes to have the single fee transmitters ready for purchase near the beginning of August. The new toll structure will go into effect on January 1, 2019. Members can view the tolling policy and toll rate schedule by clicking here. SENATE COMMITTEE APPROVES INCREASED TRANSPORTATION FUNDING The Senate Appropriations Committee approved this week its fiscal year 2019 funding bill for transportation infrastructure. The bill includes $48.57 billion in funding for highways by adding $3.3 billion from the general fund to the FAST Act-authorized level of $45.27 billion, to be mostly distributed via formula. Additionally, $800 million will be set aside for bridge grants and $90 million is set aside for grade crossings. As far as transit, the bill provides $9.9 billion for formula grants with an additional $800 million from the general fund for transit infrastructure grants. The bill also provides $2.6 billion for Capital Investment Grants. The bill also includes $1 billion for BUILD Grants (formerly known as TIGER), $250 million more than the House bill provides. For aviation, the bill provides $4.1 billion for the Airport Improvement Program thanks to a general fund supplement of $750 million, in addition to the $3.35 billion in Airport and Airways Trust Fund spending. Unfortunately, the bill does not contain language that was included in last year’s bill increasing the Passenger Facility Charge that can be charged by airport to fund/finance their airport infrastructure. It is unclear when the bill will be considered by the entire

Senate. AGC and ARTBA will continue to weigh-in and ensure that the final funding bill provides the maximum increases for these transportation programs. HIGHWAY FUNDING BILLS RESULT IN INCREASED STATE ROAD FUND REVENUES State Road Fund revenue for eleven months of this fiscal year is $105 million ahead of revenues last year due to the highway funding bills passed last year by the West Virginia Legislature. Total revenue through May 31, 2018 is $738.5 million compared to $633.7 million for the same period last year or up16.5%. Gas Tax revenue is up $41.4 million (11.44% ahead of last year), Registration Fees are up $42.1 million (up 50.34% ahead of last year), and Privilege Tax revenue is up $21.6 million (20.06% ahead of last year). There is one month left in this year’s fiscal year. The $738.5 million is $14,6 million over the Governor’s Estimate.
