held on 26/03/2011 were circulated to all the members vide letter no. 1106-15 dated

04.04.2011.

No observation has been received from any of the members. As

such, SEAC may confirm the proceedings.

The minutes of 43rd meeting of State Expert Appraisal Committee held on 19/03/2011 were circulated to all the members vide letter no. 952-61 dated 25.3.2011.

The Committee confirmed the proceedings with minor amendment in item no. 43.20.

The project proponent of item No. 43.20 has been conveyed the decision of SEAC vide letter No.1103 dated 4.4.2011.

44.02 Action taken on the proceedings on the 43rd meeting of SEAC held on 19.3.2011.

The Committee desired that letters to all the project proponents be issued apprising them regarding decision taken on their project proposal by the SEAC in its 43rd meeting held on 19.3.2011.

Letters to all the project proponents have been issued.

44.03 Application for environmental clearance under EIA Notification for expansion of its existing unit M/s Sharu Steels Pvt. Ltd. at Plot No. B-48, Focal Point, Phase-VII, Ludhiana.

The Committee was of the opinion that though moratorium had been lifted but the MoEF letter did not explicitly speak that Ludhiana ceased to be critical polluted area. The Committee, hence, felt that in view of the MoEF letter dated 16.3.2011, there is a need to obtain clarification / advice from the MoEF / SEIAA.

After detailed deliberations, the Committee authorized the Chairperson of the SEAC to seek clarification from MoEF regarding the above issue and further decided that the case may be placed in the meeting of SEAC as soon as the clarification is received from the

44.04 Application for environmental clearance for expansion of its existing unit by M/s Sharu Special Alloys Pvt. Ltd. at Village Gobindgarh, adjoining Phase-VII, Ludhiana.

44.05 Application for environmental clearance as required under EIA Notification for cement grinding unit of capacity 30 TPD to be developed by M/s New Tech Cement Industries, in the revenue estate of Village Gholia Kalan, Tehsil Bagha Purana, Distt. Moga.

It was decided by the SEAC to call the project proponent in the next meeting of SEAC, so as to make him aware regarding the proceedings of the public hearing and to take his view point. It was also decided that Punjab Pollution Control Board be requested to intimate the status of the construction and installation of proposed industrial plant, within one week, to enable the Committee to proceed further in the matter.

1. The project proponent will be called to make him aware regarding the proceedings of the public hearing and to take his view point in the 46th meeting of SEAC.

2. M.S., PPCB, has been requested vide letter no. 1105 dated 4.4.2011 to send the report as desired by the SEAC.

44.06 Application for environmental clearance under EIA Notification for increase in the production capacity of existing cement grinding unit from 75 TPD to 150 TPD of M/s Shri Bala Ji Cement Industries, in the revenue estate of Village Jai Singh Wala, Bagha Purana, Distt.

The Committee decided as under:-

1. Punjab Pollution Control Board be requested to intimate the status of the construction and installation of the industrial plant for which the project proposal is pending for environmental clearance including the pollution control status of the existing unit, within one week, to enable the Committee to proceed

44.09 Application for environmental clearance for Residential Group Housing Project namely “Rosewood Green Housing” to be developed by M/s Virat Infra Projects Pvt. Ltd. at Vill. Sadhe Majra, Habitpur Road, Dera Bassi, Distt. Mohali.

The Committee decided as under: 1. The project proponent be requested not to carry out any further construction activity at site till he obtains environmental clearance as required under EIA Notification dated 14.9.2006. The project proponent be also requested to submit the latest photographs from all the four sides showing the status of construction. 2. The project proponent be requested to get information regarding classification of the area from the Department of Town & Country Planning, Punjab, in which the site of the project is located, as per Master Plan, within 7 days.

The decision of the Committee has been conveyed to the project proponent vide letter no. 1101 dated 4.4.2011.

44.10 Application for environmental clearance for construction of emerging technologies complex for Sri Guru Granth Sahib World University, Fatehgarh Sahib.

The Committee decided to request the project proponent to carry out representative ambient air sampling of the site area at 3-4 locations for atleast 7 days from the NABL accredited/MoEF approved Laboratory. Meanwhile the project proponent also submit the layout/ building plan duly approved by the Competent Authority of the State.

The decision of the Committee has been conveyed to the project proponent vide letter no. 1103 dated 4.4.2011.

44.12 Application for obtaining environmental clearance for developing Urban Estate at Mullanpur, District S.A.S. Nagar, (Mohali) by the Divisional Engineer, Greater Mohali Area Development Authority (GMADA)

Item No. 45.03: Regarding issuance of TOR to M.C. Bathinda for establishment of Integrated Municipal Solid Waste Facility at Bathinda.

The Municipal Corporation, Bathinda has applied for obtaining

Environmental Clearance to establish an "Integrated Municipal Solid Waste

Management Facility" as required under EIA notification dated 14/9/2006. The

municipal solid waste processing facility will be installed in 20 acres at Bathinda having

capacity to handle 350 Ton /day of municipal solid waste. The sanitary landfill facility

will also be developed in an area of 36.8 acres in the revenue estate Village Mandi

Khurd, Distt. Bathinda. The project of the promoter is covered under Category 7 (I) of

the schedule appended to the said notification.

The case was considered by the SEAC in its 43rd meeting held on

19.3.2011 and approved the "Terms of Reference" (TOR), for preparation of detailed

draft EIA/EMP for further appraising the project. The said TOR was conveyed to the

M.C., Bathinda vide letter no. 14494 dated 28.3.2011 after getting approval of

Member Secretary, SEIAA. However, some amendments have been made by the

Member Secretary, SEIAA in following two SEAC conditions.

1. No Objection Certificate from pollution angle of the Punjab Pollution Control

Board.

2. NOC from the nearest Airport Authority for both sites.

The above noted conditions have been amended by the Member

Secretary, SEIAA as under:

i) No Objection Certificate from pollution angle / Authorization of the Punjab

Pollution Control Board under Municipal Solid Waste (Management &

Handling) Rules, 2000.

ii) NOC from the nearest Airport Authority for the site, which is located within

20 kms.

This is for the information of the SEAC.

Item No. 45.04 Application for obtaining Environmental Clearance for developing Shopping Complex namely „The Celebration Mall" at Village Paragpur, Jalandhar, M/s Francolin Infrastructure Pvt. Ltd.

M/s Francolin Infrastructure Pvt. Ltd. has submitted application

for obtaining environmental clearance for developing Shopping Complex namely „The

Celebration Mall" at Village Paragpur, Jalandhar, on Form 1 & 1A alongwith basic

information and the project promoter is covered under category 8 (a) of the Schedule

appended to EIA notification dated 14/9/2006 as amended from time to time. The

detail of the project is as under:-

The case was considered in the 43rd meeting of SEAC, which was

attended by the following were present on behalf of the project promoter:

1. Col. Kuldip Sandhu, Senior General Manager

2. Dr. Koyal Kumar, Environmental Consultant, M/s EQMS India (P) Ltd., Delhi

Dr. Koyal Kumar of M/s EQMS India (P) Ltd., Delhi who is the

Environmental Consultant of the project proponent and the name of his consultancy

firm figures at Sr. no. 7 of the list uploaded by the MoEF at its official website,

presented the case before the SEAC as under:-

1. The promoter has proposal to develop Shopping Complex namely "The Celebration Mall" at Village Paragpur, Jalandhar having retail shops, restaurants, cafeteria, food court and Cinema Hall etc.

2. The project is covered under category 8 (a) of the Schedule appended to EIA notification dated 14/9/2006.

3. The total plot area of the proposed project is 23744.37 sq. m and total built up area is 1,00,924 Sq. m.

4. The site of the project falls within M.C. limits Jalandhar.

5. The total water requirement for the project will be 744 KLD, out of which 448 KLD will be met through fresh water by using borewells and 296 KLD will be met with re-circulation of treated wastewater.

6. The total wastewater generation from the proposed project will be about 296 KLD out of which 151 KLD treated sewage will be utilized for flushing, 56 KLD for DG cooling, 44 KLD for horticulture.

7. The project proponent has proposed to install STP having capacity of 375 KLD consisting of bar screen, oil & grease trap, equalization tank, primary treatment, SAFF, secondary treatment, filtration, activated carbon filter, softener and treated water storage.

8. 6 no. of rainwater harvesting pits of capacity 43.27 m3 each will be provided for rainwater harvesting in which the run-off collected from roof top, green area and paved area will be discharged.

9. The total quantity of MSW has been estimated 1.62 MT/day which will be segregated at source. The bio-degradable waste will be treated in an mechanized compostor and recyclable waste will be sold out to the authorized vendors and the remaining solid waste will be disposed off to the common municipal solid waste landfill site.

10. The total power requirement is 3500 KW will be supplied by Punjab State Power Corporation Ltd. The project has provision to provide 8 No. DG sets of capacity 1500 KVA each and 1 no. DG set of 500 KVA to supply electricity during failure of power supply of PSPCL. These DG sets will be provided with acoustic enclosures and proper foundations.

11. The total parking area will be for 1354 ECS.

12. Fly ash based products will be used as far as possible and energy efficient glass will be used for minimizing ingress of light and maximizing heat cut offs.

The committee observed that it will not be advisable to discharge the

surface run-off to be collected from green area into the rainwater harvesting system

since the water of this area may contain pollutants, which may contaminate the

ground water. The committee further observed that the project proponent is required

to submit the following documents/data for carrying out appraisal of the project

proposal.

1. Proof of ownership of land.

2. Layout and building plan duly approved by the Competent Authority

2. Permission for CLU issued by the Competent Authority of the State.

3. Status of construction if any, alongwith photographs from all the four sides.

4. A map showing various features and Red Category industries within a radius of 500 m from the project site.

5. Site plan showing location of fire fighting equipment layout, first aid room and location of tubewells.

6. Analysis reports of ambient air, ground water and noise level from NABL Accredited laboratories/MoEF authorize laboratory.

c) Use of Ground Water.

8. Availability of adequate land for use of treated sewage and plantation.

9. Quantification of energy saved and renewable energy devices used and permission of PSPCL for power connection.

10. Drawing showing plumbing systems for use of fresh, treated and hot water.

11. Affidavits for:-

a) Constitution of Environment Monitoring Cell.

b) Use of ready mix concrete or use of fly ash during construction.

c) To provide fire Fighting System.

d) To provide wind breaking curtains and water sprinkling system to minimize dust emissions.

e) To provide adequate safety measures for the construction workers during the construction phase.

13. An undertaking to the effect that the surface run-off to be collected from green area will not be discharged into the rainwater harvesting system.

The Committee also brought out that all these observations have been

mentioned in the agenda of the 43rd meeting of SEAC uploaded on the official website

www.seiaapunjab.co.in.

Col. Sandhu informed that the said documents/data will be submitted within 15 days.

The Committee agreed to accept the request made by Col. Sandhu and

decided to defer the case till the reply of above noted observations, is received. The

decision of the Committee was conveyed to the project proponent vide letter no.

15420 dated 31.3.2011.

Now, the project proponent vide letter dated 1.4.2011 has submitted

documents/data.

The case is placed before the State Expert Appraisal Committee for consideration.

Item No. 45.05 Application for obtaining environmental clearance for residential colony namely “AKME Polis” to be developed by M/s AKME Projects Ltd. at Vill. Jandiali, Ludhiana-Chandigarh Road, Distt. Ludhiana.

The project proponent has applied for obtaining environmental

clearance as required under EIA Notification for developing a township containing

plots, group housing, commercial, EWS and convenient shopping namely „AKME Polis‟

in the revenue estate of Village Jandiali, Ludhiana-Chandigarh Road, Distt. Ludhiana.

As per the application, the plot area of the proposed site is 77.169 acres and the

expected cost of the project is Rs. 226 crore. The built-up area of the project is

2,72,962 sq. m, as such, the project of promoter is covered under category 8 (b) of

the Schedule appended to EIA notification dated 14/9/2006.

The case of the project was considered in the 12th meeting of State

Expert Appraisal Committee held on 27/9/2008. During the meeting, all construction

ingredients of the project as fixed in the criteria for Environmental Grading prescribed

by Ministry of Environment & Forests, Govt. of India, New Delhi were discussed and

evaluated. The Committee awarded „Silver Grading‟ to the project. However, it was

pointed out that the mean value of SPM level at the project site, as per the ambient

air quality data provided by the promoter is 216.57 µg/Nm3, which is higher than the

prescribed limit specified in Manual on “Norms and Standards for Environment

Clearance of Large Construction projects”, Ministry of Environment and Forest,

Government of India (Table 1.1 National ambient air quality standards for different

building typologies as per CPCB). The case file of the project was forwarded to State

Environment Impact Assessment Authority for consideration for grant of

environmental clearance.

Accordingly, the case was considered by SEIAA in its 11th meeting held on

17.10.2008, and after detailed deliberation on the matter the authority observed that:-

1. The project site is located very near to Focal Point, as such, the effect of

various type of industries located in this Focal Point need to be assessed.

2. The commercial part of the project is shown an un-determined plan in the plans

approved by the competent authority, which can not be considered for grant of

environmental clearance at this stage.

3. The project has been granted change of land use for establishment of

residential/commercial project, whereas as per the master plan of the Ludhiana

city, this area has now been earmarked for light industries.

4. The four acre land earmarked for disposal of treated effluent is not included in

CLU.

In view of the above, it was decided by the Authority that the case may

be referred back to the State Level Expert Appraisal Committee for re-consideration of

the same in light of above mentioned points and give its revised recommendations.

The case was reconsidered in 16th meeting of SEAC held on 6/12/2008.

Sh. Deepak Gupta, Environmental Consultant for the project submitted pointwise reply

to the observations of State Environment Impact Assessment Authority as under :-

1. The promoter has already planned to provide minimum buffer of 15 m green

belt of broad leaf trees towards the air polluting industries as per the

notification no. 2274 dated 25/7/2008 issued by Govt. of Punjab, Deptt. of

Science, Technology and Environment. Thus, the effect of various types of

industries located in the Focal Point or in the surrounding area will be

minimized and taken care of.

2. The promoter has not planned the layout of commercial part of the project at

this stage. Therefore, the environmental clearance may be given by the

Authority excluding commercial part of the project. The environmental

clearance for the commercial part of the project will be obtained by the

promoter as and when the layout of this part of the project is planned and

before starting construction activity of the commercial part of the project.

3. Although, as per the Master Plan of the Ludhiana City, this area has now been

earmarked for light industries, but it has been clearly specified on page 189 of

Master Plan, Ludhiana that the sites on which various projects have been

approved or whose change of land use has already been permitted by

competent authority / Govt., such sites shall be deemed to be adjusted as

sanctioned / permitted.

4. The promoter has four acre land adjoining the project area where it is proposed

to use treated effluent onto land for irrigation / plantation. As this land is

outside the project area and there will be no residential / commercial activity on

this piece of land and the land will be used only for use of treated sewage onto

land for irrigation / plantation, therefore, change of land use may not be

insisted upon for this site.

The reply given by the project proponent was discussed and it was

decided that a committee of officers from Punjab Pollution Control Board, Regional

Office, Ludhiana should visit the project site to verify the submissions made by the

promoter, check feasibility of land for disposal of treated sewage and send their

recommendations to decide the application of the promoter for grant of environmental

clearance.

Accordingly, a committee of the following officers of the Board was

constituted for inspection of the project site, as per decision taken in 16th meeting of

SEAC.

1. Sh. R.K. Gupta, Environmental Engineer

2. Sh. S.P. Garg, Environmental Engineer

3. Sh. Shiv Kumar, Assistant Environmental Engineer

The said Committee has submitted its report and intimated that the site

M/s AKME Polis to be developed by AKME Projects Ltd. at Jandiali, Ludhiana-

Chandigarh Road has been visited by the team on 14/1/2009. The team observed that

on east and north side, the red category industries are situated along the boundary.

One induction furnace exists on west side which is more than 100 m from the

boundary and one poultry farm also exists which is less than 100 m from the boundary

of the project.

1. The air pollution from induction furnace may be significant and smell problem

from poultry farm is also expected. As per policy of the Board, the project

proponent has to develop 15 m wide green belt of wide leaf trees on east side /

north side and also on west side to reduce the pollution expected from

induction furnace and poultry farm. This can be allowed as per Ludhiana Master

Plan Clause “The sites on which various projects have already been approved

or whose change of land use has already been permitted by competent / Govt.,

such sites shall be deemed to be adjusted as sanctioned / permitted.” The

project proponent has already land use change of 77.1687 acres land issued by

Deptt. of Housing and Urban Development, Govt. of Punjab vide no. 6726-27

dated 24/7/2006 well before the final approval of Master Plan of Ludhiana.

2. Layout plan of commercial part of the project has not been planned by the

promoter, so it may be excluded from the environmental clearance and

promoter will get environmental clearance separately before starting any

construction of Commercial part of the project.

3. The promoter has given registered deed of four acres of land adjoining to the

project where it proposes to discharge treated sewage. The total water to be

used for various uses will be 815 Kl/day and expected sewage will be 80%

which comes out to be 652 Kl/day. Out of this 652 Kl/day, 271 Kl/day will be

used for flushing system in the houses and 381 Kl/day will be used for irrigation

of green belt developed along the boundary, lawns and for plantation of trees

planted along the internal roads. The promoter will lay the piping network for

irrigation of these areas. For excessive sewage, the colonizer will develop the 4

acres land as per Karnal Technology. The committee has observed that the

land is sufficient to take care of the excessive sewage and reported that this

four acre land is already in use for agriculture purpose. Thus the committee is

of the view that this change of land use for this land is not required.

The Committee has recommended that the case of the colony may be

considered for grant of environmental clearance.

The case was reconsidered in the 19th meeting of State Expert Appraisal

Committee held on 7/3/2009 in light of the report of the team. After detailed

deliberations on the reply submitted by officers of the Punjab Pollution Control Board,

the Committee decided to forward the project to State Environment Impact

Assessment Authority for grant of environmental clearance subject to the condition

already recommended (12th meeting of State Expert Appraisal Committee held on

27/9/2008), to Authority alongwith the following special conditions :

1. That the project proponent will provide a green belt of broadleaf trees of

minimum 15 metres width around its project site.

2. The project proponent will not get the land use of four acre land (which is

adjoining to the project and is proposed by the project proponent for discharge

of treated sewage of the colony) changed from the Town and Country Planning

Deptt., Punjab until the sewer line is laid in the area by M.C. The copy of the

proceedings be sent to CTP, Punjab with request not to change the land use of

remaining four acres of the project for any activity.

Subsequently, the case was discussed by the SEIAA in its 18th meeting

held on 15.6.2009 and it was decided that the MoEF may be requested to give

guidelines/advise to process such cases where there are red category industries within

100 metres / 500 metres from the boundary of the project. Accordingly, the MoEF

was requested vide letter no. 23414 dated 13.7.2009 to give the desired clarification,

which was received from MoEF vide letter dated 3.9.2009. The matter was considered

by the Authority in its 21st meeting held on 19.9.2009 and it was decided that the case

may be forwarded to SEAC alongwith the clarification received from MoEF vide letter

no. 19-78/2009-IA.III dated 3.9.2009 for appropriate consideration.

The case of the project proponent was placed in the 31st meeting of

State Expert Appraisal Committee held on 24/10/2009. During meeting the Committee

observed that the conc. of SPM in the ambient air varies in the range of 196 µg/m3 to

216 µg/m3 and the variation at some point of time are more than the permissible limit

of 200 µg/m3 prescribed in the National Ambient Air Quality Standards by Central

Pollution Control Board. The Committee noted with concern that as there are number

of red category industries situated along the boundary of the project, therefore,

decided that the proposed site be visited by SEAC to visualize the status of industries

falling in the radius of 100 m / 500 m from the periphery of proposed project.

Accordingly, the case was deferred.

Accordingly, the Committee members visited the site of „AKME Polis‟ to

be developed by M/s Akme Projects Ltd., Vill. Jandiali, Ludhiana-Chandigarh Road,

Distt. Ludhiana on 28/11/2009. During visit, it was observed that ;

1. The project proponent has constructed office complex only. No other

construction activities were going on at site.

2. On the front side of the project site i.e. on southern, there is a flour mill namely

M/s Jindal Agro Industries.

3. On the right side of the project site i.e. on eastern side, the following industrial

units are existing;

a. M/s General Tools adjoining the site b. M/s Super Tech Agro adjoining the site c. M/s Asian Lacto & M/s Asian Lak Health adjoining the site. d. M/s Batra Poly Fab = 67 m e. M/s Osho Tools = 80 m f. M/s Gangotri Rubber = 105 m

g. Saw Mill adjoining the site

4. On the left side of the project site i.e. on western side, the following industrial

units are existing;

a. M/s NKH Alloys = 158 m away

b. M/s Ashwani Knit Fab = 120 m away

c. Poultry farm = 82 m away

During visit, it has been observed that the project proponent is

developing green belt of 15 m width towards the eastern side of the project side and

planted more than 1000 trees. The representatives of the project proponent present

during visit were suggested to shift the location of the school area proposed on the

eastern side to another suitable location due to its proximity to the industrial units on

the eastern side. They were suggested to submit duly approved revised plan from

competent authority after incorporating above changes i.e. plan indicating green

buffer zone of 15 m width towards the eastern side and alternate location of school.

Thereafter, the project proponent vide letter dated 8/12/2009 has

submitted revised plan showing green area towards eastern side & alternate site of

school towards western side and also enclosed an affidavit to the effect that the

company has left the prescribed minimum area of 15 m on the boundary of the

project as green area and shall plant broad leave trees in the project side. The project

proponent has requested for grant of environmental clearance.

The case was reconsidered in the 35th meeting of State Expert Appraisal

Committee held on 9/1/2010. During meeting, the Committee observed that project

proponent has submitted necessary clarification and satisfactory reply to the queries

and in regard to the application of new AAQM Notification dated 16/11/2009, the

majority decision was taken by the Committee and awarded „Silver Grading‟ and

decided to forward the case to State Environment Impact Assessment Authority for

grant of environmental clearance subject to certain conditions.

The case was again considered by the SEIAA in its 28th meeting held on

21.3.2010 observed that there are some red category industries including an induction

furnace and a poultry farm within 250 m radius of the project site and the air

emissions / odour to be generated from these industries may have ill effects on the

residents of the proposed project. Therefore, the Authority decided that:-

"The project proponent may be requested to carry out Impact

Assessment Study of the effect of the red categories industries located

within 250 m radius of the project site and to submit the mitigation

measures to be taken by the proponent regarding the effects of these

industries".

The SEIAA further decided that the project proponent may be requested

to submit supplementary information as per revised Form- I, in view of amendment

notification dated 1.12.0009 and subsequent circular of MOEF dated 18.01.2010. As

decided, the project proponent was requested vide letter no. 16247 dated 1.4.2010.

But the project proponent failed to respond in connection with said letter, accordingly,

a reminder was issued vide letter no. 25963 dated 8.6.2010.

In the meanwhile, SEIAA/SEAC, Punjab became non-functioning due to

resignation of their Chairmen. The MOEF, New Delhi vide D.O No. J-11013/43/2007-

IA-II (I) dated 8.07.2010 asked the SEIAA/SEAC that the cases of „B‟ category projects

lying pending with SEIAA/SEAC be sent to MoEF for further consideration. The file was

also sent to MoEF, New Delhi. Thereafter, the project proponent vide its letter dated

22.11.2010 (received in the MoEF on 26.11.2010) has submitted revised Form-I, and

EIA report.

The SEIAA/SEAC of Punjab has been reconstituted by the MoEF, New

Delhi, vide order-dated 7.3.2011 and the case file of the project proponent has been

received back from MoEF.

The case was considered in the 29th meeting of SEIAA held on

23.3.2011 and it was observed that the project proponent has submitted

supplementary information as per revised Form-I vide letter dated 22.11.2010 and

Impact Assessment study report and the same have been taken on record.

After detailed deliberations in the matter, it was decided to return the

case to SEAC to critically evaluate the Impact Assessment study report submitted by

the project proponent and to submit the recommendations to the Authority in

accordance with provisions of the EIA Notification dated 14.9.2006.

The case is placed before the Committee for further consideration in the

matter.

Item No. 45.06 Application for obtaining environmental clearance for residential colony namely "Super Mega Mixed Use Integrated Industrial Park Project –Phase-I" to be established in the revenue estate of Village Nagla, Tehsil Zirakpur, Distt. Mohali, Punjab by M/s Shipra Estates Limited.

It is submitted that the project proponent has applied for

obtaining environmental clearance as required under the provisions of EIA notification

dated 14.9.2006 for establishment of a Project namely "Super Mega Mixed Use

Integrated Industrial Park Project –Phase-I" in the revenue estate of Village Nagla,

Tehsil Zirakpur, Distt. Mohali, Punjab by M/s Shipra Estates Limited on Form 1 & 1A.

The details of the project are as under:-

The total area for the proposed project is 445633.616 sq.m (44.5 hectare) and

the builtup area is 5,68,150.02 sqm.

The total area of the project is to be divided into following three components:

IT/ITES Industry : 40.3 %

Residential : 28.42%

Commercial : 1.37%

The total area of the project of Phase-I is 44.5 hectares and no industry of

category A & B falling in the Schedule appended in the notification dated

14/9/2006 is to be housed in the industrial component of the project, as such,

the project is not covered under category 7 (I) of the said Schedule. However,

the builtup area of the project is 568150.02 sqm., as such, the project is

covered under Category 8 (b) of the said Schedule.

The expected cost of the project is 600 crores.

The total water requirement is about 1700 KLD out of which 909 KLD will be

met from ground water extracted through bore wells and remaining will be met

from the treated wastewater.

Total 833 KLD domestic wastewater will be generated from the proposed

project and a STP of capacity 1000 KLD based on Moving Media Reactor

technology will be installed to treat the said wastewater. The treated

wastewater from sewage treatment plant will be utilized for D.G. set cooling,

flushing and horticulture purposes.

Total 4820 Kg/day of solid waste will be generated, which will be segregated at

source. The project proponent has proposed to provide adequate number of

collection bins for segregation of bio-degradable and non-biodegradable waste

as per the MSW Rules, 2000.

The power requirement is 33 MW, which will be provided by Punjab State

Power Corporation Limited. The 8 no. D.G. sets of 1000 KVA capacity each are

proposed for Industrial use. 3 no. D.G. sets of 500 KVA capacity each and 1

no. D.G. set of 380 KVA will be installed for Residential use and for supplying

electricity for Commercial use 4 D.G. sets of 1250 KVA capacity each, 2 D.G.

sets of 1000 KVA capacity each and 1 D.G. set of 500 KVA shall be provided as

power backup during emergency period

The project proponent has applied to the MoEF and the case was placed

considered by the EAC/MoEF in its 93rd meeting held on 9th-10th November, 2010 and

approved the TOR, which was conveyed to the promoter by the MoEF vide letter dated

26/11/2010. In the said letter, the MoEF mentioned as under:

"Public hearing is to be conducted for the project as per provisions of EIA

Notification 2006 and the issues raised by the public should be addressed in the

Environmental Management Plan. A detailed draft EIA/EMP report should be prepared

as per the TOR and submitted to the Ministry in the prescribed form as per said

Notification".

Thereafter, the project proponent vide letter dated 2/12/2010 requested

the MoEF that the project is covered under category 8 (b) of the Schedule of

appended to the EIA notification dated 14/9/2006, as such, public consultation is not

required to be conducted. The said letter of the project proponent has been dealt by

the MoEF and perusal of which indicates that the case was placed in the meeting of

EAC of MoEF held on 18-20 January, 2011. But no extract pertaining to said meeting

has been placed by the Ministry in the record file received from the MoEF. Minutes

placed on the official website of the MoEF pertaining to 95th meeting of EAC held on

18-20 January, 2011 were perused and it was observed that the representation of the

project proponent for exemption from the public hearing has not been considered in

the said meeting.

Now, the project proponent vide letter dated 17/3/2011 addressed to the

Member Secretary SEIAA, again informed that the case was considered by the EAC of

MoEF in its meeting held on 18 January, 2011 for exemption of public hearing and

requested to look into the matter.

The project proponent has also submitted EIA report vide letter dated

10/1/2011 in compliance to TOR issued by the EAC of MoEF.

The case was considered in the 29th meeting of SEIAA held on

23.3.2011 and the Authority critically examined the EIA Notification dated 14.9.2006

as amended on 1.12.2009 and application of the project proponent and noticed as

under:

a) The total area of the project of Phase-I is 44.5 hectares and no industry of

category A & B falling in the Schedule appended in the notification dated

14/9/2006 is to be housed in the industrial component of the project, as such,

the project is not covered under category 7 (c) of the said Schedule. However,

the built-up area of the project is 568150.02 sqm., as such, the project is

covered under Category 8 (b) of the said Schedule.

b) Public consultation is not required for all building and construction projects or

area development projects (which do not contain any category 'A' projects and

activities) and Townships item 8 (a) & (b) in the Schedule appended to EIA

Notification.

After detailed deliberation in the matter, it was decided by the SEIAA to

amend the last two paragraphs, which are reproduced above, of the MoEF letter dated

26.11.2010 as under and to issue corrigendum in this regard.

"The project proponent shall prepare detailed draft EIA/EMP as per

Terms of Reference and shall submit to the SEIAA in the prescribed form

as per EIA Notification dated 14.9.2006".

It was also decided by SEIAA to return the case to SEAC to evaluate the

EIA report submitted by project proponent and process the application as per the

provisions of EIA Notification dated 14.9.2006.

The case is placed before the SEAC for further consideration in the

matter.

Item no. 45.07 Request for waving of Public Hearing for setting up of a CETP in the revenue estate of Tajpur Road, Ludhiana by M/s Punjab Dyers Association.

M/s Punjab Dyers Association, Ludhiana has applied to the MoEF,

New Delhi for obtaining environmental clearance as required under the provisions of

EIA notification dated 14.9.2006 for setting up of a CETP of 117 MLD capacity at

Tajpur Road, Ludhiana in an area of 32 acres since at that time SEIAA/SEAC for the

State of Punjab was not functioning due to resignation of their Chairmen.

The said proposal was considered in the 95th meeting of the EAC of

MoEF held on 18th-20th January 2011 and approved the TOR, which was conveyed to

the promoter by the MoEF vide letter dated 11.2.2011. In the said letter, the MoEF

mentioned as under:

"Public hearing is to be conducted for the project as per provisions of EIA Notification 2006 and the issues raised by the public should be addressed in the Environmental Management Plan. A detailed draft EIA/EMP report should be prepared as per the TOR and submitted to the Ministry in the prescribed form as per said Notification".

Thereafter, MoEF has constituted SEIAA / SEAC for the State vide Order

dated 7.2.2011 and returned the case to the SEIAA/SEAC for further consideration in

the matter.

Now, M/s Punjab Dyers Association vide letter dated 31.3.2011

requested the SEIAA to exempt the project proposal from public hearing as the Govt.

of Punjab, Department of Industries & Commerce, Chandigarh, vide Notification No.

4037-A dated 24th February, 2011 has declared the land belonging to Hadbast No. 177

measuring as 311 kanal 10 Marla in the revenue estate of Tajpura Road, Village

Jamalpur Awana, District Ludhiana as an industrial area for setting up a common

Effluent Treatment Plant by M/s Punjab Dyers Association, Ludhiana (copy enclosed as

Annexure-1).

The case is placed before the SEAC for further consideration in the

matter.

Item No. 45.08 Application for obtaining Environmental Clearance for developing an Information Technology Park including SEZ- "Yellowstone Landmark Info city" to be developed at Sector 66 B, Mohali by M/s Sukham Infrastructures Pvt. Ltd.

M/s Sukham Infrastructures Pvt. Ltd has submitted an application

for obtaining environmental clearance for developing an Information Technology Park

including SEZ namely "Yellowstone Landmark Info city" at Sector 66 B, Mohali on

Form 1 & 1A and the project of the promoter is covered under category 8 (b) of the

Schedule appended to EIA notification dated 14/9/2006 as amended from time to

time. The details of the project are as under:-

The total plot area of the proposed project is 100.064 acres and total built up area

is 3,33,650 Sq. m.

The site of the project falls within M.C. limits of Mohali.

The expected cost of the project is Rs. 952 Crores.

The total water requirement for the project will be 1450 KLD, out of which 950 will

be met with groundwater and balance 500 KLD will be met through recycling of

treated effluent. The project proponent has attached two water balance charts

with the application as Annexure-3 & 12, which are not matching with each other.

The total wastewater generation from the proposed project will be about 910 KLD,

out of which 500 KLD will be used for flushing and remaining 410 KLD will be used

for irrigation of green area (23402.21 sq. m).

The project proponent shall install two identical STPs having capacity of 500 KLD

each consisting of screens, collection tank, clarifier, aeration tank, secondary

clarifier, pressure sand filter ozonation process & sludge drying beds.

The total quantity of MSW has been estimated as 3000 kg/day. The solid waste will

be collected separately as recyclable and non- recyclable at primary source. The

recyclable material will be directly sent for the respective processing industry and

the other component will be sent to composting section.

The total power requirement will be 17 MW, which will be supplied by Punjab

State Power Corporation Ltd. The project promoter has provision to provide 3

M/s Surya Industries has applied for obtaining environmental

clearance as required under EIA Notification for establishment of a cement grinding

plant of capacity 150 TPD in the revenue estate of Sadiq Road, Faridkot, Distt.

Faridkot. The project of the promoter pertains to category 'B' and it falls under

category 3 (b) of the Schedule appended to the said Notification. As per application

submitted by the industry, the details of the project are as under :-

The proposed plant will be established in an area measuring 6212 sq. m which

is presently meant for agricultural use and the same will be got converted for

industrial purpose.

The industry will produce 150 TPD of cement by grinding process only by using

gypsum, clinker and fly ash/ slag. as raw material.

The cost of the project will be Rs.123.1 lacs.

The water 3 KLD will be for domestic use and the same will be met from

ground water by way of providing tubewell.

Only domestic effluent will be discharged after passing through septic tank.

The industry has proposed to install cyclone followed by bag filter house as

APCD to contain the concentration of particulate matter in the emissions within

the standards laid down by the Board.

Total energy requirement of the project is 700 KW and will be met from the

PSPCL.

The Municipal Corporation, Ludhiana has applied for

Environmental Clearance to establish an "Integrated Municipal Solid Waste

Management Facility" by Municipal Corporation, Ludhiana at Village Jainpur and

Jamalpur as required under EIA notification dated 14/9/2006. The project of the

promoter is covered under Category 7 (I) of the schedule appended to the said

notification. As per application submitted by the Municipal Corporation, Ludhiana, the

details of the proposed project are as under:

1. Integrated Municipal Solid Waste Management Facility at Jamalpur:

(i) Total area of the Jamalpur facility : 99 acres.

(ii) Available area for MSW processing: 64 acres

(iii) Tonnage handled at the facility : (a)1077TPD for initial 2 to 3 years

Clearance in the month of December, 2010 to SEIAA/SEAC, Punjab, but the same was

sent to MoEF vide letter no.876 dated 6/1/2011 since the SEAC/SEIAA for the State of

Punjab became non-functional in the State of Punjab.

Thereafter, the MoEF, vide letter no. F.No. 19-5/2008-IA-III dated

16.3.2011 returned the case to the Secretary to Govt. of Punjab, Deptt. Of Science,

Technology & Environment stating that:

“In continuation to the Ministry‟s letter of even number dated 14.3.2011, I am

directed to return the following Category „B‟ projects for appraisal at State Level

under EIA Notification, 2006 as amended in 2009 since the SEIAA/SEAC for Punjab

have been reconstituted and Moratorium on CEPI for the Ludhiana, Punjab has

been lifted vide OM No. J-11013/5/2010-IA-II(I) dated 15.2.2011.

1. CMSWMF at Jainpur and Jamalpur, Ludhiana

2. CETP at Tajpur Road, Ludhiana

It may kindly be noted that out of six number of CETP/CMSWMF projects

of Punjab, only CMSWMF at Samgouli, Mohali is Category „A‟ project due to the

location of the site within 10 km radius of inter-State boundary and ToR was issued

on 7.3.2011”.

The case was considered by the SEAC in its 44th meeting held on

26.3.2011 and after detailed deliberations, the Committee was of the opinion that

though moratorium had been lifted but the MoEF letter did not explicitly speak that

Ludhiana ceased to be critical polluted area. The Committee, hence, felt that in

view of the MoEF letter dated 16.3.2011, there is a need to obtain clarification /

advice from the MoEF / SEIAA. The Committee authorized the Chairperson of the

SEAC to seek clarification from MoEF regarding the above issue and further

decided that the case may be placed in the meeting of SEAC as soon as the

clarification is received from the MoEF/SEIAA.

Accordingly, a letter has been written to MoEF by the Chairperson of the

SEAC vide no. SEAC/Gen/2011/1958 dated 31.3.2011 for seeking the aforesaid

clarification.The reply is awaited from the MoEF.

It is mentioned here that the Govt. of Punjab, Deptt. of Science,

Technology & Environment vide Memo no. 3/10/2010-STE (4)/709 dated 25.3.2011

has sent a copy of letter no. F.No.19-5/2008-IA-III dated 14.3.2011 of the MoEF

Punjab, Deptt. Of Science, Technology & Environment , which is discussed above, is in

continuation of MoEF letter dated 14.3.2011.The members may peruse both the

letters of MOEF jointly for appropriate decision.

Item No.45.11 Application for environmental clearance under EIA Notification for expansion of its existing unit M/s Sharu Steels Pvt. Ltd. at Plot No. B-48, Focal Point, Phase-VII, Ludhiana.

The industry has applied for obtaining environmental clearance for

carrying out expansion of its existing unit located at Plot No. B-48, Focal Point, Phase-

VII, Ludhiana, as per details given below.

The case of the project proponent was placed in the 31st meeting of

State Expert Appraisal Committee held on 24/10/2009. The Committee observed that

as the proposed site falls in industrial Focal Point, therefore, public consultation is not

required in this case and decided to categorize the project into Category B-1, with

certain Terms of Reference for Rapid Environmental Impact Assessment Study of the

proposed project. Accordingly, the TOR were issued vide letter no. 37335 dated

16.11.2009 to the industry for its project proposal.

Thereafter, Ministry of Environment and Forests, New Delhi vide Office

Memorandum dated 13th January, 2010 declared Ludhiana City as critically polluted

area. Furthermore, as per amendment made by the MoEF in its notification dated

14.9.2006 on 1/12/2009, such type of project are now covered under category 3(a)

and General Condition is applicable for this category. Accordingly, Punjab Pollution

Control Board was requested by the committee vide letter no.19406 dated 22/4/2010

to intimate as to whether the project site falls within the critically polluted area or not

in light of the boundaries defined by the MoEF vide office memorandum dated

15/3/2010, within 7 days positively, so that the guidelines issued by the MoEF may be

complied with.

Subsequently, SEIAA/SEAC for the State of Punjab became non-

functional due to resignation of their Chairmen in July 2010. Accordingly, the case file

was sent to MoEF for further consideration in the matter.

Now, SEIAA / SEAC for the State has been constituted vide order dated

7.2.2011 and the file has been returned by the MoEF to the SEAC/SEIAA.

The project proponent has not yet submitted the draft EIA report and

EMP. No communication has been received from the Punjab Pollution Control Board in

connection with letter dated 22/4/2010.

The case of the industry was considered by the SEAC in its 44th meeting

held on 26.3.2011 and was of the opinion that though moratorium had been lifted by

the MoEF vide Office Memorandum dated 15.2.2011, but it did not explicitly speak that

Ludhiana ceased to be critical polluted area.The Committee authorized the

Chairperson of the SEAC to seek clarification from MoEF regarding the above issue and

further decided that the case may be placed in the meeting of SEAC as soon as the

clarification is received from the MoEF/SEIAA.

Accordingly, a letter has been written to MoEF by the Chairperson of the

SEAC vide no. SEAC/Gen/2011/1958 dated 31.3.2011 for seeking the aforesaid

clarification. The reply is awaited from the MoEF.

The matter regarding critically polluted area of Ludhiana is similar to

item no 45.10 ,as such, uniform appropriate decision may be taken in addition to

industry specific observations.

Item no. 45.12 Application for grant of environmental clearance for expansion of its existing unit by M/s Sharu Special Alloys Pvt. Ltd. at Village Gobindgarh, adjoining Phase-VII, Ludhiana.

The industry has applied for obtaining Environmental Clearance

for expansion of its existing unit by installing a steel rolling mill of capacity 10 MT/hr.

and 2 no. induction furnaces of capacity 8 T/heat each.

The application of the project proponent was placed in the 30th meeting

of State Expert Appraisal Committee held on 10/10/2009. The Committee observed

that the proposed site of the industry is located in the industrial zone as per proposals

of Master Plan (2007-2021) of Ludhiana, as such, public consultation is not required in

this case and decided to categorize the project into Category B-1, with certain Terms

of Reference for Rapid Environmental Impact Assessment Study of the proposed

project. The Committee decided to recommend the case to SEIAA for approval of

TORs, fixed by SEAC with exemption from public hearing/public consultation.

Accordingly, the TOR were issued vide letter no. 353732 dated

4.11.2009 to the industry for its project proposal, after approval of Member Secretary

of SEIAA.

Thereafter, Ministry of Environment and Forests vide Office

Memorandum dated 13th January, 2010 declared Ludhiana City as critically polluted

area. Furthermore, as per amendment made by the MoEF in its notification dated

14.9.2006 on 1/12/2009, such type of project are now covered under category 3(a)

and General Condition is applicable for this category. Accordingly, Punjab Pollution

Control Board was requested by the committee vide letter no.19406 dated 22/4/2010

to intimate as to whether the project site falls within the critically polluted area or not

in light of the boundaries defined by the MoEF vide office memorandum dated

15/3/2010, within 7 days positively, so that the guidelines issued by the MoEF may be

connection with letter dated 22/4/2010.

The case of the industry was considered by the SEAC in its 44th meeting held on

26.3.2011 and was of the opinion that though moratorium had been lifted by the

MoEF vide Office Memorandum dated 15.2.2011, but it did not explicitly speak that

Ludhiana ceased to be critical polluted area.The Committee authorized the

Chairperson of the SEAC to seek clarification from MoEF regarding the above issue and

further decided that the case may be placed in the meeting of SEAC as soon as the

clarification is received from the MoEF/SEIAA.

Accordingly, a letter has been written to MoEF by the Chairperson of the

SEAC vide no. SEAC/Gen/2011/1958 dated 31.3.2011 for seeking the aforesaid

clarification. The reply is awaited from the MoEF.

The matter regarding critically polluted area of Ludhiana is similar to

item no 45.10 ,as such, uniform appropriate decision may be taken in addition to

industry specific observations.

Item no.45.13 Application for Environmental Clearance under EIA Notification for carrying out expansion in the existing unit by installing 2 no. induction furnaces of 8 Ton/heat capacity each by M/s Khurana Steels Ltd. at Vill. Dhandari Khurd, adjoining Phase-VII, Focal Point, Ludhiana.

The industry has applied for obtaining environmental clearance for

obtaining environmental clearance as required under EIA Notification dated 14/9/2006

for carrying out expansion of its existing unit by installing 2 no. induction furnaces of 8

Ton/heat capacity each located in the revenue estate of Village Dhandari Khurd,

adjoining Phase-VII, Focal Point, Ludhiana.

The application of the project proponent was placed in the 35th meeting of

State Expert Appraisal Committee held on 9/1/2010. The Committee was satisfied with

the clarification given during the discussion and decided to categorize the project into

Category B-1, with certain Terms of Reference for Rapid Environmental Impact

Assessment Study of the proposed project and for conducting public consultation as

per the provisions of EIA Notification dated 14.9.2006. Accordingly, the TOR were

issued vide letter no. 2838 dated 25.1.2010 to the industry for its project proposal and

approved of Member Secretary, SEIAA.

Thereafter, Ministry of Environment and Forests vide Office

Memorandum dated 13th January, 2010 declared Ludhiana City as critically polluted

area. Furthermore, as per amendment made by the MoEF in its notification dated

14.9.2006 on 1/12/2009, such type of project are now covered under category 3(a)

and General Condition is applicable for this category. Accordingly, Punjab Pollution

Control Board was requested by the committee vide letter no.19404 dated 22/4/2010

to intimate as to whether the project site falls within the critically polluted area or not

in light of the boundaries defined by the MoEF vide office memorandum dated

15/3/2010, within 7 days positively, so that the guidelines issued by the MoEF may be

complied with.

Item no. 45.14 Application for Environmental Clearance for the replacement of existing induction furnace of capacity 4.5 T/heat with 2 no. induction furnaces of capacity 8 T/heat each and installation of a steel rolling mills of M/s Sudershan Forge Pvt. Ltd., Industrial Area-C, Kanganwal Road, VPO Jugiana, GT Road, Ludhiana.

The industry has applied for environmental clearance for the

replacement of existing induction furnace of capacity 4.5 T/heat with 2 no. induction

furnaces of capacity 8 T/heat each for the manufacture of steel ingots @ 60,000 TPA

(total) including existing capacity. The industry has also proposed to manufacture TMT

bars, angles, round etc. @ 60,000 TPA.

The application of the project proponent was placed in the 30th meeting

of State Expert Appraisal Committee held on 10/10/2009. The Committee observed

that in view of the present scenario of Ludhiana city the project should not be

exempted from the public hearing. The committee decided that the industry should

get the public hearing conducted through Punjab Pollution Control Board and decided

to categorize the project into Category B-1, with certain Terms of Reference for Rapid

Environmental Impact Assessment Study of the proposed project.

Accordingly, the TOR were issued vide letter no. 35738 dated 4.11.2009

to the industry for its project proposal. Subsequently, the industry vide its letter dated

28/12/2009 represented to the committee that the site of the industrial plant is

located in the declared industrial area, as such, the industry is not required to conduct

public consultation. The industry has submitted a copy of the notification dated

17/12/1994 issued by department of Industries, Punjab vide which the land area

measuring as 370.17 acres falling in the jurisdiction of village Kanganwal has been

declared as Industrial Area "C".

Thereafter, the industry was requested vide letter no.3431 dated

29/1/2010 to get the ambient air quality monitoring for one month period (twice a

week 24 hourly at uniform intervals) from the NABL/MoEF accredited lab for all

pollutants mentioned in the notification no. GSR 826(E) dated 16/11/2009.
