SPECIFIC CONDITIONS TO BE ADHERED TO BY THE CONTRACTOR
The tenderer should have valid PAN, GST registration etc for Kerala state as
applicable.
A competent Engineer and Supervisor who is fully conversant and fluent in the local language (for reading, writing
and speaking), should be available at the work site at all times to receive instructions from the Bank/ Architects. All
instructions will be communicated in the local language only. A qualified Resident Supervisor shall be appointed as Site
– In - Charge having diploma and minimum five years’ experience in similar works.
Overnight stay/ washing of clothes/ bathing etc. by the labours are not permitted in the premises. Entry pass will be issued by the Bank strictly for execution of work only.
Please read the ‘ INSTRUCTIONS TO TENDERERS’ thoroughly before submitting the Tenders.
A lso note to ver ify the Bank web-s ite under ‘Tender Notices ’ before the last date and confirm
that ‘CORRIGENDA’ to the Tender Notices issued ( if any) has been read and / or complied
with.

1. Sealed Tenders for the above work will be received by the Assis tant Gen eral M anager, (P & E),
S tate Bank of India, Premises Department, Local Head Office, P.B No.2704, Poojapura,
Thiruvananthapuram up to 3.00 p.m on 27/11/2017. The tenders will be opened on the same day
at 3.30 p.m. In the presence of the tenderer or their r epresentatives, who are expected to be
present at the time of opening of the tenders.

a. The tenders must be submitted in sealed covers and should be addressed to the Assis tant
General M anager (P & E), S tate Bank of India, Premises Department, Local Head O ffice, P.B
No.2704, Poojapura, Thiruvananthapuram in or iginal and duplicate. The name of the tenderer
and the name of the work being noted on the cover.
b. If the tender is made by an indiv idual, it shall be s igned with his full name and his address
shall be given, if it is made by a member of the firm who shall also s ign his name, and the
name and address of each member of the firm shall be s igned by a duly author ised Officer,
who shall produce with his tender, satis factory ev idence of his author isation. Su ch tender ing
firm may be required before the agreement is executed to furnish ev idence of its corporate
ex is tence .
(c ) Every tenderer is expected, before quoting his rates to inspect the s ite of the proposed work, to
ascertain availability of space for s tor ing mater ials , water, power and other fac ilities. The rate
quoted shall be firm till the completion of the entire work.
3. B idders have to attend the pre-bid meeting in which images of sample work s tations will be
displayed for due observations of certain specific a tions in BOQ.

a. Every tenderer must enc lose with his tender, earnest money deposit by a crossed draft for a
sum of Rs.84053/- (Rupees: Eighty four thousand f if ty three only) made out in favour of
State Bank of India, Thiruvananthapuram. Tenders not accompanying EM D, will be rejected.
The Earnest M oney Deposit will be refunded to the unsuccessful tenderer after intimation is
sent on rejection of the tender or at the expiry of S ix months from the date of tender
whichever is ear lier . The earnest money will not carry any interes t.
b. The Earnest M oney Deposit will be retained in the case of successful tenderer and will not
carry any interest and will be dealt with as prov ided in the conditions of contract. In case the
L1 tenderer backs out, their EM D will be forefi tted .
c . The tenderer whose tender is accepted shall execute an agreement in the s tandard format
acceptable to the bank with Assis tant General M anager (P & E), S tate Bank of India, Premises
Department, Local Head Office, P.B No.2704, Poojapura, Thiruvananthapuram within 15 days
of acceptance of tender.
5. The tenderer shall peruse carefully the tender notice, conditions of contract, bills of quantities,
relative drawings, outline specifications and general conditions etc ., before pr ic ing in the
quantities. A ll these documents shall be returned with the tender duly s igned in every page in
token of acceptance of the conditions .

6. The State Bank of India does not bind itself to accept the lowest or any tender and reserves the
r ight to reject any tender or all the tenders at any s tage if required. Conditional tenders will be
rejected .
7. The state Bank of India, reserves the r ight of alter ing and/or amending the drawings and scope
of work by additi ons or altera tions or omiss ions withou t ass igning any reason therefor e.
8. The Contractor shall give a lis t of his relatives work ing with the bank along with their
des igna tions and addresses.
9. No Employee of the bank is allowed to work as a contractor for a per iod of two years of hi s
retirement from bank serv ice, without the prev ious permiss ion of the bank. This contract is liable
to be cancelled if either the contractor or any of his employees is found at any time to be such a
person who had not obtained the permiss ion of the bank as aforesaid before submiss ion of the
tender or engagemen t in the contractor 's serv ice.

1. I/We, the unders igned do hereby tender and undertake to perform, prov ide, execute an d do all
the works, mater ials , matters and things descr ibed or mentioned in the Tender Notice, Conditions
of Contract, B ill of Quantities and drawings (hereinafter called tender documents) which have
been produced to and carefully examined by me/us in s tr i c t accordance with and under and
subject to the terms prov is ions and conditions set for th or mentioned in the said Tender
Documents at the rates given and as s tated in the B ill of Quanti ties .
2. I/We, also undertake to do all extra or var ied works which may be ordered as part of this contract
upon the terms prov ided for in the conditi ons of tender and agreement.
3. I/We, fur ther undertake and agree to execute at my/our cost, the agreement and to s ign the
tender documents within fifteen days after the acceptan ce of my/our tender and that in the event
of my/our failure to execute the agreement within fifteen days, this tender shall be considered as
having been rejected, EM D will be for feited or abandoned and you may, thereupon at such time
or times, in such manner and on such terms as you may think fit, arrange for any other person or
persons to carry out the works herein before mentioned. I/We, agree to be liable to all damages,
losses, costs , charges and expenses ar is ing from any or by reason of such failure a nd
arrangemen t.
4. I/We hereby undertake to complete the whole work required within 60 days from the date of
commencement of work and agree to pay the penalty as specified in the conditions of contract.
5. I/We hereby undertake and agree to abide by this ten der until 24 weeks from the date of this
tender.

1. The Contractors are required to examine carefully all the Drawings for the above work, conditions
of contract. Form of Agreement and Specifications before pr ic ing in the bill of quantities set out
below:
2. The rates quoted by the Contractors in the following B ill of Quantities shall inc lude for setting out
the works, for supply ing all mater ials inc luding GST and any other taxes as applicable and labour
and equipment necessary for completing the work in the best workmanlike manner, for main taining
the same, all in accordance with the prov is ions of the specifications and conditions of contract,
for the erection and removal on completion of the work, all unnecessary scaffolding, shed, water
tanks, c lerk of works office, with fittings, latr ines for the workman etc ., for all the fenc ing required
to enclose the s ite to prevent work people trespassing boards, mats, c lothes, etc ., to exc lude dir t
and dust, for carting away all debr is and rubbish, by removing paint s tains, c leaning floors,
windows, etc ., for leav ing the premises in a c lean and satis factory s tate on completion and for
work ing in conjunction with the general building contract.
3. While the works are in course of construction and until the Employer take over same, the works
and all mater ials or plants used or to be used in constructing the same, remain at the Contractors
r isk and shall not be entitled to any compensation for injury to or loss or destruction of such
works or mater ials ar is ing from any cause whatsoever .
The successful tenderer should take adequate cover under Workman's Compensation Act and also
take Insurance coverage against third party injury , Fire, Riot, Civ il Commotion etc .
4. Other agencies may be work ing in the building dur ing the progress of the work and contractors
must allow this contractor to carry out this works without any hindrance. No addition to the
completion time will be allowed on this account unless special delays caused by other agencies
can be proved.
5. The quantities set out in the bills of quantities are ap prox imate and indicative only and all work
will be paid for on actual measurements taken dur ing the progress of work and paid for at the
accepted tender rates.
6. All works shall be measured net as finished and the rates quoted by the Contractors shall inc lu de
for all cuttings, waste, breakages, etc . Tenderer must inc lude in their rates, GST, Labour Welfare
Fund and any other taxes and duties lev ied by the Central Government or any State Government
or Local Author ity , if applicable. The rates quoted shall b e firm till the completion of the entire
work and no var iation of rates will be enterta ined.
The var ious s tatutory tax deductions implemented by the s tate and central government from time
to time shall also be affec ted in the respective running bills .
7. No allowances shall be made to the Contractors on account of any c laim, which is based on the
c ircumstances that the work may be, descr ibed in the conditions of the contract or specifications
on which apparen tly there is no corresponding items given in the bi lls of quanti ti es.
8. Errors in the bills of quantities shall be dealt with in the following manner:

IF on check there are differences between the rates given by the contractor in words and figures or in the
amount worked out by him, the following procedure shall be followed:
a. When there is a difference between the rates in figures and in words, the rates which correspond to the
amounts worked out by the contractor, shall be taken as correct.
b. When the contractor does not work out the amount of an item or it does not correspond with the rate wr i tten
either in figures or in words, then the rate quoted by the contractors in words shall be taken as correct.
c . When the rate quoted by the contractor in figures and in words tallies but the amount is not worked out
correctly , the rate quoted by the contractor shall be taken as correct and not the amount.
d. The bills of quantities have been marked "Original" and "Duplicate". If there is any discrepancy in the rates,
units and amounts between the 'or iginal' and 'duplicate' the 'or iginal' will be liable to be taken as correct and
the 'duplicate' corrected accordingly.

a. All prov is ional sums, prov is ional items and contingencies inc luded in the following bills of
quantities shall be deducted in whole or in part, if not expand ed under orders in wr iting from
the Architec ts .
b. The tenderer should deposit along with the tender a sum of Rs. 88,400/- as Earnest M oney
Deposit. The Earnest M oney Deposit will be made a part of secur ity deposit, if the tenderor is
L1 and work order has been issued to them. The Earnest M oney Deposit will not carry any
interes t.
c . The successful tenderer to whom the contract is awarded will have to deposit as initial
secur ity deposit a fur ther sum to make up 2% of the value of the accepted tender inc luding the
Earnest M oney Deposit. The initial Secur ity Deposit will have to be made within 14 days of
intimation to him of the acceptance of his tender, failing which the Employer at his discretion
may revoke the letter of acceptance and for feit the Earnest M on ey Deposit furnished along with
the tender.
Apart from the initial deposit made as above, retention money shall be deducted from
progress ive running bills at 10% of the gross value of each running bill prov ided the total
secur ity deposit ie. The ISD plus retention money shall both together does not exceed 5% of
the contract value.
The 50% of the Total Secur ity Deposit is refunded to the contractor without interest on
completion , subject to the follow ing :
I. Issue of Vir tua l completion certific a te by the A rchitec t/ Premises Engineer
II . Contractor 's removal of his mater ials , equipment, labour force, temporary sheds/stones,
etc . from the s ite (excepting for a small presence required) if any for the defect liability
per iod and approved by the Bank.
The remaining 50% of the amount will be refunded to the contractor without interest within
fifteen days after the end of defects liability per iod, prov ided he has satis factor ily carr ied out
all the works and attended to all defects in accordance with the conditions of the contract,
inc luding s ite c learance.
The retention money will bear no interes t whatsoever , until the date of their release.

10 . Quality of all mater ials and workmanship and shall be firs t c lass, and shall conform to the latest
Indian Standard code of practice, Local PWD and Latest CPWD specifications with up - to-date
correction s lips as the case may be and the ISS in addition to the Architec t specifica t ion .
11 . The Contractor is to prov ide for all the mater ials , labour transport etc ., required for completing
the work as scheduled .
12 . Tenderer are required to make a careful note of the required time of completion for all the works
in this contract to the satis fac t ion of the employer and/or the Architects .
13 . The Contractor should comply to the prov is ions of any leg al enactment relating to the works and
to the regulations any bye- laws of any local author ity and or any water or lighting companies with
whose system the structure is proposed to be connected and shall before making any var iation
from the drawings or spec ifications that they may be necessitated by conforming, give to the
Architects wr itten notice specify ing the var iation proposed to be made and the reason for making
it and apply for instructions thereon. In case the Contractor shall not in due course rev i se such
instructions, he shall proceed with the work conforming to the prov is ions, regulations or byelaws
in question and any var iation so necessitated shall be dealt with according to the agreement. The
Contractor shall give all notices required by the s aid acts , regulations or bye – laws to be given
to any local author ity and pay all fees payable to any such author ity or to any public officer in
respect of the work. The Employer shall however reimburse the amount paid as fees to any such
author ity by the Contractor who shall make his own arrangements for payment of the Octroi and
the amount will not be reimbursed. The Contractor shall also pay sales tax on all mater ials and
other duties, which will not be reimbursed either.
14 . Any var iation from the contr act drawings or bills of quantities will be submitted in wr iting to the
Architects and no work shall be s tar ted or mater ials ordered before wr itten approval is obtained
from the Bank.
15 . The Contractor shall keep constantly on the works a competent and quali fied res ident engineer
and any direction or explanation given by the Architects or their representatives to such Resident
Engineer shall be held to have been given to the Contrac tor .
16 . Every work will be inspected by the Employer and the Architects before i t is covered up and the
employer and the Architects reserve the r ight to uncover any work at the Contractor 's expenses, if
found necessary.
17 . The Contractor shall maintain complete records of labour hours and any overtime hours of all
work people engaged by them in connection with the work for the inspection of the employer.
18 . The employer will endeavour to make available water and power to the contractors. The cost of
extending water and power supply from the point where supply is made available, making
connection with the ex is ting supply , fix ing meters, etc . is to be borne by the Tenderer. Charges
for water and power consumed by the Contractor will be payable by the Contractor. The Tenderer
shall inform the employer at the time of tender ing, the requireme nt of water and power for
construction purposes. If so directed water and power shall be had from the sources available
with the general building, contractor and the charges for consumption paid to the general building
contractor.
19 . Time is the essence of the Contract. The employer reserves the r ight to terminate the contract, if
the work falls behind schedule by four weeks at any time. A ll the works shall be completed within

60 days from the date of work order. The contractor shall furnish along with the tender, a
programme chart for the completion of the work along one week from the date of issue of work
order and shall s tr ic tly adhere to it.
20 . A penalty of 0.5% of the contact amount will be lev ied for every week of non -completion beyond
the schedule of completion, subject to a maximum of 5% of the accepted contract value.
21 . The Contractor shall take adequate cover under workmen's compensation act and also take
insurance cover against third party injury , fire, r iot, c iv il commotion etc . The copy of the p olicy
(A ll r isk policy and cover under Workmen Compensation Act should be submitted to the
Employer) .
22 . The employer will have the r ight to order the omiss ion of any item or items inc luded in the B ills of
Quantities and the contractor shall not be entitled to payment of any k ind on account of such item
or items. If the employer considers it des irable, the contractor shall have the items or items as
omitted executed by other firm or firms.
23 . The tenderer shall furnish with his tender, a lis t of sub -contractors who will be responsible to the
main contrac tor for specialised jobs inc luding supply of mater ials and serv ices.
24 . Site M eetings will be called at regular intervals and the contractor or his senior representative
will be required to be present at such meetings to discuss progress of the work and other matters
inc luding any deviation from the drawings or specifica t ions.
25 . If the Contractor suspends or sublets the work or neglects or fails to proceed with due diligence
in the performance on his part of the con tract as laid down in schedule of rate progress or does
not abide by any one of the condition of contract, the Assis tant General M anager (P & E), S tate
Bank of India, Premises Department, Local Head Office, P,B No.2704,Poojapura,
Thiruvananthapuram will be at liberty to terminate his contract and the work arranged otherwise
at the r isk and cost of the contracto r .
26 . The Tenderer should also inc lude in his rate charges for carting away of all surplus excavated
earth/spo i l , away from the s ite as may be directe d by the Employer withou t c laim to any extra.
27 . The tenderer should take all precautions necessary by way of screening and prov is ion of chutes
etc . to prevent dust nuisance to adjacent buildings and to ensure that no damages occurs due to
fall of constructi on mater ials .
28 . The works are to be carr ied out without dis turbing the day -to-day functioning of the Branch. The
contractor has to take due care on the secur ity of Bank properties. Some time he may need to
carry out the works dur ing the night hours and he nce the contractor has to take care while
quoting the rate in the tender consider ing these facts . The contractor will c laim nothing extra in
this regard.
29 . Further details regarding the drawings can be had from our Consultants M /s. Enarc Consultants ,
Architects and Engineers, M .G. Road, Thr issur – 1 on all work ing days dur ing offic e hours.

ARTICLES OF AGREEM ENT made at this day of ………2017/ between the Assis tant General
M anager (P & E), S tate Bank of India, Premises Department, Local Head Office, P.B No.2704,
Poojapura, Thiruvananthapuram (hereinafter referred to as the EM PLOYER which express ion shall
inc lude his heirs , executors, adminis trators and ass igns) of the one part and in the name and sty le as
mentioned above at (hereinafter referred as the CONTRACTOR which express ion shall inc lude heirs ,
executors, adminis tr a tors and ass igns) of the other part.
WHEREAS the Employer desirous to inter ior furnishing work – RBO-1&2 of State Bank of India,
Construction of Bank’s own building at Kollam and has caused drawings and specifications and
schedule of quantities descr ibing the work to be done to be prepared by M/s. ENA RC C onsultants ,
M .G. Road, Thr issur – 1, Kerala their Architects (hereina fte r referred to ARCHITECTS).
AND WHEREAS the said drawings and specifications and pr iced schedule of quantities have be en
s igned by or on behalf of the parties hereto.
AND WHEREAS the Contractor has agreed to execute upon and subject to the conditions set for
the herein (hereinafter referred to as the said conditions) the work shown upon the said drawings and
descr ibed in the said specifications and the pr iced schedule of quantities at the respective rates
mentioned in the pr iced schedule of quanti ti es attached herewith.
N O W I T I S H E R E BY A G R EED A S F O LLOWS:
1. In consideration of the payments to be made to the Contractor as hereinafter prov ide, he shall
upon and subject to the said conditions execute and complete the works shown upon the said
drawings and such fur ther details drawings, as may be furnished to him, by the said Architects
and descr ibed in the said specific a ti ons and the said pr iced schedule of quanti ti es .
2. The Employer shall pay the Contractor such sums as shall become payable hereunder at the times
and in the manner specified in the said conditi ons.
3. The Term 'Architects ' in the said conditions shall mean the said M /s. ENARC Consultants , M .G.
Road, Thr issur – 1, Kerala. Or in the event of their ceasing to be Architects for the purpose of
this contract, such other person as shall be nominated for that purpose by the Employer, not
being a person to whom the c ontractor shall object for reasons considered to be suffic ient by the
Arbitrator mentioned in the said conditions prov ided always that no person subsequently
appointed to be Architects under the contract shall be entitled to disregard or over -rule any
decis ion or approval or direction given or expressed by the Architects for the time being.
4. The Contractors agree and undertake to duly perform and execute and complete the said work set
for th in the Work Order No. issued by the Architects on behalf of the Emp loyer and the
subsequent amendments, if any, issued from time to time thereto in the manner author ised by and
under the General Conditions of Contract. The said work shall throughout the s tipulated per iod of
the contract be proceed with all due diligence, promptness, care and accuracy and in a workman

like manner to the satis faction of the Architects and would be completed in accordance with the
said specifications, des igns, drawings bill of quantities and instructions on or before due date
mentioned in the said work order, time being the essence of the contract on part of the
contractors. Acquiescence of NO OBJECTION of the State Bank of India, to the completion of
any portion of the work beyond the s tipulated due time shall be without prejudice to the r i ghts of
the State Bank of India, to enforce its r ights and remedies available under this Agreement and the
Conditions of Contract regarding for feiture, damages, penalty or otherwise and shall not
constitu te a waiver of the Corporation 's r ights in that beha lf.
5. Without prejudice to the r ights and remedies of the State Bank of India, against the contractors
under any of the prov is ion of this agreement and General Conditions of Contract of the said work
order or otherwise in law, if the contractors commit any default or breach of terms and conditions
of this Agreement and/or the General Conditions of the contract and/or the work order or foil in
the due performance thereof within the time fixed by the contract (which is the essence of the
Contract) and do not c omplete the entire work on the s tipulated due date, the State Bank of India,
shall be entitled to recover from the contractors and the contractors hereby agree to be bound to
pay the State Bank of India, as by way of compensation or liquidated damages an a mount
calculated at the rate of 1/2% of contract amount per week subject to a maximum of 5% of the
contract amount . The delay beyond the s tipulated date in respect of the item which is not
completed or finished and delivered completely to the State Bank of India on the s tipulated date
as mentioned in the Contract work order and declare that the amount of compensation or
liquidated damages fixed as above represent the genuine, fair and reasonable pre -estimate
thereof consider ing all the facts and c ircumstanc es as the loss and damages that would be likely
suffered by the State Bank of India on account thereof. It is fur ther hereby agreed and confirmed
that the sum payable by the contractor under this prov is ion shall be considered as reasonable
compensation ir respective of whether actual loss or damage has or has not been sustained and
the State Bank of India, would not be required to render any proof in support thereof. It is
specifically agreed and declared that in the event of the contractors not completing the work after
the s tipulated date, the aforesaid prov is ions shall not be deemed to prevent or s top the State
Bank of India, from exerc is ing any other r ights or remedies available to the State Bank of India,
against the Contractors inc luding the completio n of the work departmentally or through any other
contractor or agency or otherwise whomsoever at the r isk and account of contractors and the
State Bank of India, shall be entitled to recover and the contractors shall be bound to pay all
such losses and damages which the State Bank of India, may suffer on account thereof. This is
also without prejudice to all the r ights and remedies available to the State Bank of India, under
the General Conditi ons of Contract.
6. The Contractors shall keep constantly at the work s ite a competent superv isor or such other
competent technical person as may be required to set the work and any direction or explanation
given by the State Bank of India/Architects author ised representative to such person in wr iting
shall be held to have been given to the Contrac tors.
7. The P lans, Agreements and Documents above mentioned shall form the basis of this contract and
the decis ion of the said Architects for the time being, as mentioned in the conditions of contract,
taken with the approval of the Employer, in reference to all the matters of dispute as to the
mater ial, workmanship or account and as to the intended interpretation of the Clauses of this
agreement or any other document attached shall be final and binding on both the parties and m ay
be Rule of Court.
8. The said contract comprises the buildings above mentioned and all subsidiary works connected
therewith the same s ite as may be ordered to be done from time to time by the said Architects for

the time being with the approved of the Emp loyer even though such works may not be shown in
the drawings of descr ibed in the said specific a tions or the pr iced schedule of quanti t ies .
9. The Employer through the Architects , reserve to himself the r ights of alter ing, the drawings and
nature of work and of adding to or omitting any item of work or of hav ing portions of the same
carr ied out departmentally or otherwise and such alterations or var iations shall be carr ied out
withou t prejudice to this contract.
Prov ided that the Contractor shall not be enti tled to c laim any compensation other than the
admiss ible rates prov ided for in the contract or otherwise mutually agreed upon for such
additi ons, altera tions, notifica t ion , var iations , omiss ions etc .
10 . The said conditions shall be read and construed as form ing part of this agreement and the parties
will respectively abide by and submit themselves to the conditions and stipulations and perform
the agreemen ts on their parts respective ly in such conditi ons contained .
11 . All disputes ar is ing out or in any way conn ected with this agreement shall be deemed to have
ar isen in Thiruvananthapuram and only the Courts in Thiruvananthapuram shall have jur isdic tion
to determine the same.
12 . The several parts of this contract have been read to us and fully understood by us.

Except where prov ided for in the descr iption of the indiv idual items in the schedule of quantities
and in the specifications and conditions laid down hereinafter and in the Drawings, the work shall be
carr ied out as per s tandard specifications and under the direction of the Employer/Architect/Engineer -
in-Charge and S ite Engineer.
1. INTRODUC TION
In construing these conditions, the specifications, the schedule of quantities, tender and
agreement, the following words shall have the meaning herein ass igned to them except where the
subject or context otherwise requires:
a. Employer :
The term Employer shall denote State Bank of India, and any of its employees or
representa tiv es, author is ed on their behalf.
b. Architects :
The term Architects s hall mean M /s. ENARC Consultants , M .G. Road, Thr issur – 1, Kerala or in
the event of his /their ceasing to be the Architects for the purpose of this Contract such other
person/s as the Employer shall nominate for the purpose.
c . Contrac tor :
The term, Contrac to r shall mean
(Name and address of the Contractor) and his /their heirs , legal representatives, ass igns and
successors.
d. Site : Kollam
e. Drawings :
The work is to be carr ied out in accordance with drawings, specifications, the schedule of
quantities and any fur ther drawings, which may be supplied, or any other instruction, which
may be given by the Employer dur ing the execution of the work.
A ll drawings relating to work given to the Contractor together with a copy of schedule of
quantities are to be kept at s ite and the Employer/Architects shall be given access to such
drawings or schedule of quanti t ies whenever necessary.
In case any detailed Drawings are necessary contractor shall prepare such detailed drawings
and/or dimensional sketches therefore and have it confirmed by the Employer/Architects pr ior
to tak ing up such work.

The contractor shall ask in wr iting for all c lar ification on matters occurr ing anywhere in
drawings, specifications and schedule of quantities or to additional instructions at least 10
days ahead from the time when it is required for implementation so that the Employer may be
able to give decis ion thereon.
f. "The Works" shall mean the work or works to be executed or done under this contract.
g. "Act of Insolvency" shall mean any ac t as such as defined by the pres idency Towns Insolvency
Act or in Prov inc ial Insolvency Act or any amending statu tes .
h. "The Schedule of Quantities" shall mean the schedule of quantities as specified and forming
part of this contract.
i. "Pr iced Schedule of Quantities" shall mean the schedule of quantities duly pr iced with the
accepted quoted rates of the contractor.
2. SC OPE
The work consis ts of Construction of Employer 's proposed Internal Partitions, Furnishing and
False ceiling etc , in accordance with the "d rawings" and "Schedule of Quantities". The Inter ior
decoration, furniture works etc . are within the scope of this tender. It inc ludes furnishing all
mater ials , labour, tools and equipment and management necessary for and inc idental to the
construction and completion of the work. A ll work dur ing its progress and upon completion, shall
conform to the lines, elevations and grades as shown on the drawings furnished by the
Employer/Architects . Should any detail essential for effic ient completion of the work be omitted
from the drawings and specifications it shall be the responsibility of the contractor to inform the
Employer/Architects and to furnish and install such detail with Employer 's /Architect' concurrence,
so that upon completion of the proposed work the same will be acceptable and ready for use.
Employer/Architects may in their absolute discretion issue fur ther drawings and/or wr itten
instructions, details , directions and explanations, which are, hereafter collectively referred to as
"The Employer 's /A rch i tec t's instruc tions" in regard to : -
a. The var iation or modification of the design quality or quantity of works or the addition or
omiss ion or substi tu t ion of any work.
b. Any discrepancy in the drawings or between the schedule of quantities and/or drawin gs
and/or specifica tions.
c . The removal from the s ite of any defective mater ial brought thereon by the contractor and
the substi tu t ion of any other mater ial thereof.
d. The demoliti on removal and/or re-execution of any work executed by the contractor/s .
e. The dismissal from the work of any persons employed thereupon .
f. The opening up for inspection of any work covered up.
g. The rectification and making good of any defects under c lauses hereinafter mentioned and
those ar is ing dur ing the maintenance per iod (retenti on per iod).

The contractor shall for thwith comply with and duly execute any work comprised in such
Employer 's /Architect's instructions, prov ided always that verbal instructions, directions and
explanations given to the contractor 's or his representative u pon the works by the
Employer/Architects shall in involv ing a var iation be confirmed in wr iting to the contractor/s within
seven days. No works, for which rates are not specifically mentioned in the pr iced schedule of
quantities, shall be taken up without wr itten permiss ion of the Employer/Architects . The employer
in consultation with the Architects as prov ided in Clause "var iation" shall fix rates of items not
mentioned in the pr iced schedule of quanti ti es.
The contractor shall set up a field laboratory with necessary equipments for day to day testing of
mater ials like grading of coarse and fine aggrega tes , s ilt conten t and bulk age of sand etc .
Regarding all factory made products for which ISI marked products are available, only products
bear ing ISI mark ing shall be used in the work.
3. TENDERER SHA LL VISIT THE SITE.
Intending tenderer shall v is it the s ite and make himself thoroughly acquainted with the local s ite
condition, nature and requirements of the works, fac ilities of transport condition, effecti ve labour
and mater ials , access and storage for mater ials and removal of rubbish. The tenderer shall
prov ide in their tender for cost of carr iage, freight and other charges as also for any special
difficulties and inc luding police restr ic tion for transpor t etc ., for proper execution of work as
indicated in the drawings. The successful tenderer will not be entitled to any c laim of
compensation for difficulties faced or losses incurred on account of any s ite condition which
ex is ted before the commencement o f the work or which in the opinion of the Employer/Architects
m ight be deemed to have reasonably been inferred to be so ex is ting before commencement of
work.
4. TENDERS
The entire set of tender paper inc luding drawings issued to the tenderer should be submi tted fully
pr iced and also s igned on the last page together with initials on every page. Initial/s ignature will
indicate the acceptance of the tender papers by the tenderer. (A lso see para 15 of General Rules
and Instructions for guidance of tenderer. )
The schedule of quanti t ies shall be filled in as follows: -
a. The "Rate" column to be legibly filled in ink in both English figures and English words.
b. Amount column to be filled in for each item and the amount for each sub head as detailed in
the "Schedule of Quanti ties "
c . All corrections are to be initi a ted.
d. The "Rate Column" for alterna t ive items shall be filled up.
e. The "Amount" column for alternative items of which the quantities are not mentioned shall
not be filled up.
No modifications, wr itings or corrections can be made in the tender papers by the tenderer, but
may at his option offer his comments or modifications in a separate sheet of paper attached to the
tender papers.

The Employer reserves the r ight to reject the lowest or any tender and also t o discharge any or
all of the tenders for each section or to split up and dis tr ibute any item of work with out ass igning
any reason at any s tage.
The tenderer should note that the tender is s tr ic tly on the item rate basis and their attention is
drawn to the fact that the rates for each and every item should be correct, workable and self -
supporting. If called upon by the Employer/Architects detailed analys is of any or all the rates
shall be submitted. The Employer/Architects shall not be bound to recognis e the contractor 's
analys is .
The works will be paid for as "measured work" on the basis of actual work done and not as "lump
sum" contract.
A ll items of work decided in the schedule of quantities are to be deemed and paid as complete
works in all respects and details inc luding preparatory and finishing works involved, directly ,
related to and reasonably detectable from the drawings, specifications and schedule of quantities
and no fur ther extra charges will be allowed in this connection. In the case of l ump sum charges
in the tender in respect of any item of works, the payment of such items of work will be made for
the actual work done on the basis of lump sum charges as will be assessed to be payable by the
Employer/Archi tec ts .
The Employer has power to add/to omit any work as shown in drawings or descr ibed in
specifications or inc luded in schedule of quantities and intimate the same in wr iting but no
addition, omiss ion or var iation shall be made by the contractor without author isation from the
Employer. No var iation shall v itiate the contract.
The tenderer shall note that his tender shall remain open for consideration for a per iod of 6
months from the date of opening of the tender.
5. A GREEMENT
The successful contractor may be required to s ign agreement as may be drawn up to suit local
conditi ons and shall pay for all s tamps and legal expenses, inc iden ta l thereto .
6. GOVERNMENT A ND LOC A L RULES
The contractor shall conform to the prov is ions of all local Bye - laws and Acts relating to the work
and to the Regulations etc . of the Government and Local Author ities and of any company with
whose system the structure is proposed to be connected. The contractor shall give all notices
required by said Act. Rules, Regulations, and Bye - laws etc . and pay all fees payable to such
author ity /author ities for execution of the work involved. The cost, if any, shall be deemed to have
been inc luded in his quoted rates, tak ing into account all liabilities for licenses, fees for footpath
encroachment and restorations etc . and shall indemnify the Employer against such liabilities and
shall defend all actions ar is ing from such c laims or liabil i ti es .
7 . TA XES A ND DUTIES/FIRM RA TES

The rates quoted shall be firm till completion of work and no escalation shall be considered.
8. PROVISIONA L SUMS (P.S.)
A ll prov is ional sums descr ibed in the schedule of quantities as P.S. shall be exc lus ively allotted
to the purchase of mater ials and not for any handling and fix ing to be done by the Contractor.
Such costs of handling and fix ing with profit ( inc luding transport charges if required) shall be
separately inc luded in the contract pr ice as descr ibed in the schedule of quantities. The disposal
of the amounts covered under this head will be absolutely at the disc retion of the Employer.
Contractor is to make payments for these mater ials to the suppliers on certificate or order issued
by the Employer/Archi tec ts and realise them through his bills from the Employer.
9. QUA NTITY OF W ORK TO BE EXEC UTED
The quantities shown in the schedule of quantities are intended to cover the entire new structure
indicated in the drawings but the Employer reserves the r ight to execute only a part or the whole
or any excess thereo f withou t ass igning any reason therefo re .
10 . OTHER PERSONS ENGA GED BY THE EMPLOYER
The employer reserves the r ight to execute any part of the work inc luded in this contract or any
work, which is not inc luded in this contract, or any work, which is not inc luded in this contract by
other Agency or persons and contr actor, shall allow all reasonable fac ilities and use of his
scaffold ing for the execution of such work.

R E T E N TI ON M ON EY:
The retention percentage ( i.e., deduction from inter im bill) shall be 10% of the gross value of eac h in te r im b i l l
sanctioned for payment by the Employer.
The maximum amount of retention money shall be the balance amount of the Total Secur ity Deposit. i.e the ISD
plus retention money shall both together does not exceed 5 % of the contract value.
The 50% of the retention amount is refunded to the contractor without interest on completion,
subject to the follow ing :

I. Issue of Vir tua l completion certific a te by the Architec t/Pr emis es Engineer
II . Contractor 's removal of his mater ials , equipment, labour force, temporary
sheds/stones, etc . from the s ite (excepting for a small presence required) if any for the
defect liabil i ty per iod and approved by the Bank.
The remaining 50% of the amount will be refunded to the contractor without interest within fifteen
days after the end of defects liability per iod, prov ided he has satis factor ily carr ied out all the
works and attended to all defects in accordance with the conditions of the contract, inc luding s ite
c learance.
The retention money will bear no interes t whatsoever , until the date of their release.
12 . C ONTRA C TOR TO PROVIDE EVERYTHING NEC ESSA RY
The contractor shall prov ide everything necessary for the proper execution of the work according
to the intent and meaning of the drawings, schedule of quantities and specifications taken
together whether the same may or may not be particular ly shown or descr ibed therein prov ided
that the same can reasonably be inferred there from and if the contractor finds any discrepancies
therein he shall immediately and in wr iting refer the same to the Employer/Architects whose
decis ion shall be final and binding. The contractor shall prov ide hims elf for ground and fresh
water for carry ing out of the works at his own cost. The Employer shall on no account be
responsible for the expenses incurred by the contractor for hired ground or water obtained from
elsewhere.
The rates quoted against indiv idual items will be inc lus ive of everything necessary to complete
the said items of work within the contemplation of the contract, and beyond the unit pr ice no extra
payment will be allowed for inc idental or contingent work, labour and/or mater ials inc lus ive of all
taxes and duties whatsoever except for specific items, if any, s tipula ted in the tender documents.
The contractor shall supply , fix and maintain at his own cost, for the execution of any work, all
tools , tack les, machiner ies and equipments and all the necessary centr ing, scaffolding, s taging,
plank ing, timber ing, s trutting, shor ing, pumping, fenc ing, boarding, watching and lighting by night
as well as by day required not only for the proper execution and protection of the said work but
also for the protection of the public and safety of any adjacent roads, s treets , walls , houses,
buildings, all other erections, matters and things and the contractor shall take down and remove
any or all such centr ing, scaffolding, plank ing, timber ing, s trutting, s horting etc . as occasion shall
be required or when ordered to do so, and shall fully reinstate and make good all matters and
things dis turbed dur ing the execution of works to the satis fac t ion of the Employer/Archi tec ts .
The Contractor shall at all times g ive access to workers employed by the Employer or any men
employed on the buildings and to prov ide such parties with proper suffic ient and if required,
special scaffolding, hois ts and ladders and prov ide them with water and lighting and leave or
make any holes, grooves etc . in any work, where directed by the employer as may be required to
enable such workmen to lay or fix pipes, electr ical wir ing, special fittings etc . The quoted rates
of the tenderer shall accordingly inc lude all these above -men tioned contingen t works.

T I M E O F C O M PLETI ON , EX T ENSI ON O F T I M E & PR O G R ES S C HA R T
1. TIME OF C OMPLETION: 60 days from the date of work order.
The entire work is to be completed in all respects within the s tipulated per iod. The work shall be
deemed to be commenced immediately from the date of acceptance letter or date of handing over
of s ite, whichever is ear lier . Time is the essence of the contract and shall be s tr ic tly observed by
the Contrac tor.
The work shall not be considered as complete until the Employer/Architects have certified in
wr iting that this has been completed and the defects Liability Per iod shall commence from the
date of such certific a te.
2. EXTENSION OF TIME :
If in the opinion of the Employer/Architects the works be delayed (a) by reason of any
exceptionally inc lement weather, or (b) by reason of instruction from the Employer in
consequence of proceedings taken or threatened by or disputes, with adjoining or neighbour ing
owners or (c) by the works, or delay, of other contractors or tradesmen engaged for nominated by
the Employer and not referred to in the specification or (d) by reason of author ised extra and
additions or (e) by reason of any combination of workmen or s tr ikes or lock -out affecting any of
the building trades or ( f) from other causes which the Employer may consider are beyond the
control of the contractor, the Employer at the completion of the time allowed for the contract shall
make fair and reasonable extension of time for completion i n respect therefore. In the event of
the Employer failing to give possession of the s ite upon the day specified above the time of
completion shall be extended suitably .
In case of such str ikes or lockouts, as are referred to above, the contractor shall, immediately
give the Employer, wr itten notice thereof. Nevertheless, the contractor shall use his best
endeavours to prevent delay, and shall do all that may be reasonably required, to the satis faction
of the Employer to proceed with the works and on his doing so that it will be ground of
consideration by the Employer for an extension of time as above prov ide. The decis ion of the
Employer as to the per iod to be allowed for an extension of time for completion hereunder (which
decis ion shall be final and binding on the contractor) shall be promulgated at the conclus ion of
such str ike or lock -out and the Employer shall then, in the event of an extension being granted,
determine and declare the final completion date. The prov is ion in c lause 15 with respect to
payment of liquidated damages shall, in such case, be read and construed as if the extended date
fixed by the Employer were substitu ted for and the damage shall be deducted accordingly .
A ll drawings maintained on the s ite are or to be carefully mounted o n boards of appropr iate s ize
and covered with a cost of approved varnish. They are to be protected from ravages of term ites,
ants , and other insects.
The contractor shall prov ide at his own cost all -ar tific ial light required for the work and to enable
other contractors and sub-contrac tors to complete the work within the specified time.
The Contractor shall not fix or place any placards or advertisement of any descr iption or permit
the same to be fixed or placed in or upon any boarding gantry , building s t ructure other than those
approved by the Employer.

3. PROTEC TIVE MEA SURES:
The Contractor from the time of being placed in possession of the s ite must make suitable
arrangements for watching, lighting and protecting the work, the s ite and surrounding prop erty by
day, by night, on Sundays and other holidays. Contractor shall indemnify the Employer against
any possible damage to the building roads, or member of the public in course of execution of the
work.
No photograph of s ite or of the work or any part thereof shall be taken, published or otherwise
c irculated withou t the pr ior approval of the State Bank of India.
4. TOOLS:
Theodolite, levels , pr ismatic compass, chain, s teel and metallic tapes and all other surveying
instruments found necessary on the works shall be prov ided by the Contractor for the due
performance of this Contrac to r as instruc ted by the S ite Engineer.
A ll measur ing tapes shall be of s teel and suitable scaffolding and ladders that may be required
for safely tak ing measurements and shall be supplied by the Contrac tor.
The master ies and the superv isors on the works shall carry with them always an one metre or two
metre s teel tape a measur ing tape of 30 metres, a spir it level, a plumb and a square and shall
check on the work to see that the work is being done according to the drawing and specifications.
The S ite Engineer will use any or all measur ing instruments or tools belonging to the Contractors
as he chooses for checking the works executed or being executed on the contract.
The Contractor should cover in his rates for making prov is ions for all reasonable fac ilities for the
use of his scaffold ing, tools and plant etc . by sub -contrac t or for their work.
5. NOTIC E A ND PA TENTS OF A PPROPRIA TE A UTHORITY A ND OW NERS :
The Contractor shall conform to the prov is ions of any Acts of the Legis lature relating to the work,
and to the Regulation and Bye-Laws of any author ities, and/or any water, lighting and other
companies, and/or author ities with whose systems and structures were proposed to have
connection and shall before making any var iations from the drawings or specification that may be
associated to so conform, give the Employer/Architects wr itten notices specify ing the var iations
proposed to be made and the reasons for making them and apply for ins truction thereon. The
Employer/Archi tec ts on receipt of such intima tion shall give a decis ion within a reasonable time.
The Contractor/shall arrange to give all notices required for by the said Acts, Regulations or Bye -
Laws to be given to any author ity , and to pay to such author ity or to any public officer all fees
that may be proper ly chargeable in respect of the work and ledge the receipts with the Employer.
The Contractor shall indemnify the Employer against all c laims in respect of patent r ights ,
royalties, and damages to buildings, roads or member of public in course of execution of work and
shall defend all actions ar is ing from such c laims and shall keep the Employer saved harmless and
indemni fied in all respects from such actions, costs and expenses .
6. C LEA RING SITE A ND SETTING OUT W ORKS

The Contractor shall set out the works and shall be responsible for the true and perfect setting
out of the work and for the correctness of the positions, levels , dimensions and alignment of all
parts thereof. If at anytime, any error shall appear dur ing the progress of any part of the work,
the contractor shall at his own expenses rectify such error, if called upon to the satis faction of
the Employer. The Contractor shall fur ther set out the works to the alternativ e positions at the
s ite until one is finally approved and the rates quoted in his tender should inc lude for this and no
extra on this account will be enterta ined .
7. DA TUM
The average ground level will be considered as the crown of the nearest road, which s hould be
taken as "Datum" which is however, subject to final confirmation by the Employer/Architects . A ll
levels shown in the drawings are to be str ic tly adhered to.
8. BENC HES
The Contractor is to construct and maintain proper benches of all the main wall s , in order that the
lines and levels may be accurately checked at all times.
9. C ONTRA C TOR IMMEDIA TELY TO REMOVE A LL OFFENSIVE MA TTERS
A ll soil, filth or other matters of any offens ive nature taken out of any trench, sewer, drain,
cesspool or other place s hall not be deposited on the surface but shall be at once carted away by
the contractor to place prov ided by him.
The contractor shall keep the foundations and works free from water and shall prov ide and
maintain at his own expenses electr ically or other power dr iven pumps and other plant to the
satis faction of the Employer for the purpose, until the building is handed over to the Employer.
The contractor shall arrange for the disposal of the water so accumulated to the satis faction of
the Employer and the local author ity and no c laims will be entertained after wards if he does not
inc lude in his rates for the purpose.
10 . A C C ESS
Any author ised representative of the Employer shall at all reasonable times have free access to
the works and/or to the workshops, factor ies or other places where mater ials are having prepared
or constructed or the work and also to any place where the mater ials are lay ing or from where
they are being obtained, and the Contractor shall give every fac ility to the State Bank of India or
their representatives necessary for inspection and examination and test of the mater ials and
workmanship. Except the representatives of the Employer no person shall be allowed at any time
withou t the wr itten permiss ion of the Employer.
11 . MA TERIA LS, W ORKM A NSHIP, SA MPLES, TESTING OF MA TERIA LS
A ll the works specified and prov ided for in the specifications or which may be required to be done
in order to perform and complete any part thereof shall be executed in the best and most
workmanlike manner with mater ials of the best and approved quality of the respective k inds in
accordance with the particulars contained in and implied by the specifications and as represented
by the drawings or according to such other additional particulars, and instructions as may fr om
time to time be given by the Employer/Architects dur ing the execution of the work, and to his
entire satis fac t ion.

If required by the Employer/Architects the contractor shall have to carry out tests on mater ials
and workmanship in approved mater ials testing laborator ies or as prescr ibed by the
Employer/Architects at his own cost to prove that the mater ials etc . under test conform to the
relevant I.S . s tandards or as specified in the specifications. The necessary charges for
preparation or mould ( in cas e of concrete cube) transporting, testing etc . shall have to be borne
by the Contrac tor. No extra payment on this account should in any case be enterta ined.
A ll the mater ials (except where otherwise descr ibed) s tores and equipment required for the full
performance of the work under the contract must be prov ided through normal channels and must
inc lude charge for import duties, sales - tax, Octroi and other charges and must be the best of their
k ind available and the Contractor/s must be entirely responsible for the proper and effic ient
carry ing out of the work. The work must be done in the best workmanlike manner. Samples of all
mater ials to be used must be submitted to the Employer/Architects when so directed by the
Engineer/Architects and wr itten approva l from Employer/Architects must be obtained pr ior to
placement of order.
Dur ing the inc lement weather the Contractor shall suspend concreting and plaster ing for such
time as the Employer/Architects may direct and shall protect from injury all work when in course
of execution .
Any damage (dur ing constructions) to any part of the work for any reasons due to rain, s torm or
neglect of contractor shall be rectified by the contractor in an approved manner at no extra cost.
Should the work be suspended by reason of rain, s tr ike, lockouts or any other cause, the
contractor shall take all precautions necessary for the protection of work and at his own expenses
shall make good any damage ar is ing from any of these causes.
The contractor shall cover up and protect from damage, from any cause, all new work and supply
all temporary/doors, protection to windows, and any other requis ite protection for the execution of
the work whether by himself or special tradesmen or sub -contractor and any damage caused must
be made good by the contractor at his own expenses.
12 . REMOVA L OF IMPROPER W ORK.
The Employer shall dur ing the progress of the work have power to order in wr iting from time to
time the removal from the work within such reasonable time or times as may be specified in the
order of any mater ials which in the opinion of the Employer/Architects are not in accordance with
specification or instructions, the substitution of proper re -execution of any work executed with
M ater ials or workmanships not in accordance with the draw ings and specifications or instructions.
In case the contractor refuses to comply with the order the Employer shall have the power to
employ and pay other agencies to carry out the work and all expenses consequent thereon or
inc idental there to as certified by the Employer/Architects shall be borne by the contractor or may
be deducted from any money due to or that may become due to the contractor. No certificate,
which may be given by the Architects , shall relieve the contractor from his liability in resp ect of
unsound work or bad mater ials .
13 . C ONTRA C TOR'S EMPLOYEES

The contractor shall employ technically qualified and competent superv isors for the work who
shall be available (by turn) throughout the work ing hours to receive and comply with instructions
of the Employer/Architects . The contractor shall engage at least one exper ienced Engineer as
S ite- in-charge for execution of the work. The contractor shall employ in connection with the work
persons having the appropr ia te sk ill or ability to perform the job effic ien tly .
The contractor shall employ local labourers on the work as far as possible.
No labourer below the age of s ix teen years and who is not an Indian National shall be employed
on the work.
Any labourer supplied by the contractor to be enga ged on the work on day -work basis either
wholly or partly under the direct order or control of the Employer or his representative shall be
deemed to be a person employed by the contractor .
The contractor shall comply with the prov is ions of all labour legis lation inc luding the requirements
of
a. The Payment of Wages Act
b. Employer 's liabili ty Act
c . Workmen's Compensation Act
d. Contrac t Labour (Regula tion & Aboliti on) Act 1970 and Central Rules 1971
e. Apprentic es Act 1961
f. Any other Act or enactmen t relating there to and rules framed there under from time to time.
The Contractor shall keep the Employer saved harmless and indemnified against c laims if any of
the workmen and all costs and expenses as may be incurred by the Employer in connection with
any c laim that may be made by any workmen. The contractor shall comply at his own cost with
the order of requirement of any Health Officer of the State or any local author ity or of the
Employer regarding the maintenance of proper environmental sanitation of the area whe re the
contractor 's labourers are housed or accommodated, for the prevention of small pox. Cholera,
plague, typhoid, malar ia and other contagious diseases. The contractor shall prov ide, maintain
and keep in good sanitary condition adequate sanitary accomm odation and prov ide fac ilities for
pure dr ink ing water at all times for the use of men engaged on the works duly making / prov iding
suitable sheds for the use of labour (separately for M en and Women) for their meals and rest, and
shall remove and c lear away the same on completion of the works. Adequate precautions shall be
taken by the contractor to prevent nuisance of any k ind on the works or the lands adjoining the
same.
The contractor shall arrange to prov ide firs t-aid treatment to the labourers engaged on the works.
He shall within 24 hours of the occurrence of any acc ident at or about the s ite or in connection
with execution of the works, report such acc ident to the Employer and also the competent
author i ty where such report is required by law.

14 . DISMISSA L OF W ORKMEN.
The contractor shall on the request of the Employer immediately dismiss from works any person
employed thereon by him, who may in the opinion of the Employer be unsuitable or in competent
or who may misconduct himself. Such discharg es shall not be the basis of any c laim for
compensation or damages against the Employer or any of their officer or employee.
15 . A SSIGNMENT.
The whole of the works inc luded in the contract shall be executed by the contractor and the
contractor shall not directly or indirectly transfer, ass ign or under let the contract or any part,
share or interest therein not, shall take a new partner, without wr itten consent of the Employer
and no subletting shall relive the contractor from the full and entire responsibil ity of the contract
or from active super intendenc e of the work dur ing their progress.
16 . DA MA GE TO PERSONS A ND PROPERTY INSURA NC E ETC .
The contractor shall be responsible for all injury to the work or workmen to persons, animals or
things and for all dam ages to the s tructural and/or decorative part of property which may ar ise
from the operations or neglect of himself or of any sub -contractor or of any of his or a sub-
contractor 's employees, whether such injury or damage ar ise from carelessness, acc ident o r any
other cause whatsoever in any way connected with the carry ing out of this contract. The c lause
shall be held to inc lude inter -alia, any damage to buildings whether immediately adjacent or
otherwise, and any damage to roads, s treets , footpaths or way s as well as damages caused to the
buildings and the works forming the subject of this contract by rain, wind or other inc lemency of
the weather. The contractor shall indemnify the Employer and hold harmless in respect of all and
any expenses ar is ing from any such injury or damages to persons or property as aforesaid and
also in respect of any c laim made in respect of injury or damage under any acts of compensation
or damage consequen t upon such c laim.
The Contractor shall reinstate all damage of every so rt mentioned in this c lause, so as to deliver
the whole of the contract works complete and perfect in every respect and so as to make good or
otherwise satis fy all c laims for damages to the property or third parties. M inimum amount of third
part insurance should be Rs. 1 Lakh pre acc ident and number of acc ident should be infini ty .
The contractor shall affect the insurance necessary and indemnify the Employer entirely from all
responsibility in this respect. The insurance must be placed with a company app roved by the
Employer and must be effected jointly in the name of the contractor and the Employer and the
policy lodged with the latter . The scope of insurance is to inc lude damage or loss to the contract
itself till this is made over in a complete s tate. Insurance is compulsory and must be affected
from the very initial s tage. The contractor shall also be responsible for any thing, which may be
exc luded from damage to any property ar is ing out of inc idents, negligence or defective carry ing
out of this contract.

The Employer shall be at liberty and is hereby empowered to deduct the amount the amount of
any damages, compensations, costs , charges and expenses ar is ing or occurr ing from or in
respect of any such c laim or damages from any sums due or to become to the contractor .
17 . INSURA NC E
Unless otherwise instructed the contractor shall insure the works and keep them insured until the
v ir tual completion of the contract against loss or damage by fire and/or earthquake, flood. The
insurance must be placed with a company approved by the Employer, in the joint names of the
Employer and the contractor for such amount and for any fur ther sum if called to do so by the
Employer, the premium of such fur ther sum being allowed to the contractor as an author ised
extra.
The contractor shall deposit the policy and receipt for premiums paid with the Employer after
s tar ting the work unless otherwise instructed. In default of the contractor insur ing as prov ided
above, the Employer on his behalf may so insure and may deduct the premiums paid from any
money due, or which may become due to the contractor. The contractor shall as soon as the
c laim under the policy is settled or the work reinstated by the Insurance Company should they
elect to do so, proceed with due diligence w ith the completion of the works in the same manner as
though the fire has not occurred and in all respects under the conditions of the contract. The
contractor in case of rebinding or reinstatement after fire shall be entitled to extension of time for
completion as the Employer may deem fit.
18 . A C C OUNTS REC EIPTS & VOUC HERS
The contractor shall, upon the request of the Employer furnish them with all the invoices,
accounts, receipts and other Vouchers that they may require in connection with the works under
this contract. If the contractor shall use mater ials less than what he is required under the
contract, the value of the difference in the quantity of the mater ials he was required to use and
that he actually used shall be deducted from his dues. The deci s ion of the Employer shall be
final and binding on the Contractor as to the amount of mater ials the Contractor is required to use
for any work under this contract.
Before tak ing any measurement of any work, the S ite Engineer or a subordinate deputed by hi m
shall give reasonable notice to the Contractor. If the Contractor fails to attend at the
measurements after such notice or fails to counters ign or to record the difference within a week
from the date of measurement in the manner required by the S ite Eng ineer then in any such event
the measurements taken by the S ite Engineer or by the subordinate deputed by him as the case
may be is final and binding on the Contractor and the Contractor shall have no r ight to dispute the
same.
19 . VA RIA TION / DEVIA TION
The Contractor may when author ised and shall, when directed in wr iting by the Employer add and
or omit, or vary the works shown in the drawings or descr ibed in the specifications or inc luded in
the pr iced schedule of quantities. The Contractor on his own acc ord shall make no addition,
omiss ion or var iation without such author isation or direction. A verbal author isation or direction
by the Employer shall when confirmed correctly by the Contractor in wr iting within 3 days shall be
deemed to have been given in wr iting .

Valuation of variat ions
No c laim for an extra shall be allowed unless it shall have been executed under the
author ity of the Architect/Consultant with the concurrence of the SBI as herein mentioned.
Any such extra is herein referred to as autho r ized extra and shall be made in accordance
with the follow ing prov is ions.
a) i) The net rates or pr ices in the contract shall determine the valuation of
the extra work where such extra work is of s im ilar character and executed
under s im ilar conditi ons as the work pr iced herein.
ii) Rates for all items, wherever poss ible should be der ived out of the
rates given in the pr iced BOQ.
b) The net pr ices of the or iginal tender shall determine the value of the items
omitted, prov ided if omiss ions do not vary the conditions under which any remaining
items of works are carr ied out, otherwise the pr ices for the same shall be valued
under sub c lause (c) hereunder.
c) Where the extra works are not of s im ilar character and/or executed under s i m ilar
conditions as aforesaid or where the omiss ions vary the conditions under which any
remaining items or works are carr ied out, then the contractor shall within 7 days of
the receipt of the letter of acceptance inform the Architect/Consultant of the rate
which he intends to charge for such items of work, duly supported by analys is of the
rate or rates c laimed and the Architect/Consultant shall fix such rate or pr ices as in
the c ircumstances in his opinion are reasonable and proper, based on the market
rate.
d) Where extra work cannot be proper ly measured or valued the contractor shall be
allowed day work pr ices at the net rates s tated in the tender of the BOQ or, if not,
so s tated then in accordance with the local day work rates and wages for the
dis tr ic t; prov ided that in either case, vouchers specify ing the daily time (and if
required by the Architect/Consultant) the workman’s name and mater ials employed
be delivered for ver ifications to the Architect/Consultant at or before the end of the
week follow i ng that in which the work has been executed.
e) It is fur ther c lar ified that for all such author ized extra items where rates cannot
be der ived from the tender, the contractor shall submit rates duly supported by rate
analys is worked on the “market rate basis” for mater ial, labour, hire/running charges
of equipment and wastages etc plus 15% towards establishment charges,
contractor ’ s overheads and profi t. Such items shall not be eligib le for escalation .

20 . PREPA RA TION OF BUILDING W ORKS FOR OC C UPA TION A ND USE ON C OMPLETION
The whole of the work will be thoroughly inspected by the Contractor and defic ienc ies and defects
put r ight. On completion of such inspection the Contractor shall inform the Employer the he has
completed the work and it is ready or inspection .
On completion the contractor shall c lean all windows and doors inc luding the c leaning and oiling,
if necessary, of all hardware, ins ide and outs ide, all floors, s taircases, and every part of the
building. He will leave the entire building neat and c lean and ready for immediate occupation and
to the satis fac t ion of the State Bank of India.
21 . C LEA RING SITE ON C OMPLETION
On completion of the works the Contractor shall c lear away and remove from the s ite all
constructional plant, surplus mater ials , rubbish and temporary works of every k ind and leave the
whole of the s ite and the works c lean and in a workmanlike condition to the satis faction of the
Employer/Archi tec ts .
22 . DEFEC TS A FTER C OMPLETION
The Contractor shall make good at his own cost and to the satis faction of the Employer all
defects , settlements or other faults , which may appear within 12 months after completion of the
work. In default the Employer may employ and pay other persons to amend and make good such
damages, losses and expenses consequent thereon or inc idental thereto shall be made good and
borne by the Contractor and such damages, loss and expenses shall be recoverable from him by
the Employer or may be deducted by the Employer, in lieu of such amending and making good by
the Contractor, deduct from any money due to the Contractor a sum equivalent to the cost of
amending such work.
23 . C ONC EA LED W ORK
The Contractor shall give due notice to the Employer/Architects whenever any work is to be
bur ied in the earth, concrete or in the bodies of walls or otherwise becoming inaccessible later
on, in order that the work may be inspected and correct dimensions taken before such bur ial, in
default where of the same shall, at the option of the Employer/Architects be either opened up for
measurement at the Contractor 's expense or no payment may be made for such mater ials . Should
any dispute or differences ar ise after the execution of any work as to measurements etc . or other
matters which can not be conveniently tested or checked, the notes of the Employer/Architects
shall be accepted as correct and binding on the Contrac tor.
24 . ESC A LA TION
The rate quoted shall be firm throughout the tenure of the contract ( inc luding extension of time, if
any, granted) and will not be subject to any fluctu ation due to increase in cost of mater ials ,
labour, GST, Income tax , other taxes etc .

25 . IDLE LA BOUR
Whatever the reasons may be, no c laim for idle labour, additional establishment cost of hire and
labour charges of tools and plants would be enterta ined u nder any c ircumstances .
26 . SUSPENSION
If the Contractor except on account of any legal restraint upon the Employer preventing the
continuance of the work or in the opinion of the Employer shall neglect or fail to proceed with due
diligence in the performanc e of his part of the contract or if he shall more than once make
default, the Employer shall have the power to give notice in wr iting to the Contractor requir ing the
work be proceeded within a reasonable manner and with reasonable despatch, such notices
purport to be a notice under this c lause.
A fter such notice shall have been given the Contractor shall not be at liberty to remove from the
s ite of the works or from any ground contiguous thereto any plant or mater ials to subsis t from the
date of such notic e being given until the notice shall have been complied with. If the Contractor
shall fail for 7 (seven) days after such notice has been given to proceed with the works as therein
prescr ibed the Employer may proceed as prov ided in Clause 44 (Termination o f contract by
Employer) .
27 . TERMINA TION OF C ONTRA C T BY EMPLOYER
If the Contractor being a company go into liquidation whether voluntary or compulsory or being a
firm shall be dissolved or being an indiv idual shall be adjudicated insolvent or shall make a n
ass ignment or a composition for the benefit of the greater part, in number of amount of his
creditors , or if the Offic ial Ass ignee in insolvency, shall repudiate the contract, or if a Receiver of
the Contractor 's firm appointed by the court shall be unab le, within fourteen days after notice to
him requir ing him to do so, to show to the reasonable satis faction of the Employer that is able to
carry out and fulfil the contract, and if so required by the Employer to give reasonable secur ity
therefore, or if the Contractor shall suffer execution to be issued, or shall suffer any payment
under this contract to be attached by or on behalf of and of the creditors of the contractor, or
shall ass ign, charge or encumber this contract or any payments due or which may become due to
the contractor, there under, or shall neglect or fail to observe and perform all or any of the acts
matters of things by this contract, to be observed and performed by the Contractor within three
c lear days after the notice shall have been g iven to the Contractor manner hereinafter mentioned
requir ing the Contractor to observe or perform the same or shall be use improper mater ials or
workmanship in carry ing on the works, or shall in the opinion of the employer not exerc ise such
due diligence and make such due progress as would enable the work to be completed within due
time agreed upon, and shall fail to proceed to the satis faction of the Employer after three c lear
days notice requir ing the Contractor so to do shall have been given to the Contractor as
hereinafter mentioned, or shall abandon the contract, then and in any of the said cases, the State
Bank of India may notwithstanding prev ious waiver determine the contract by a notice in wr iting to
the effect as hereinafter mentioned, but without thereby affecting the powers of the Employer of
the obligations and liabilities of the Contractor the whole of which shall continue in force as fully
as if the contract, had not been so determined and as if the works subsequently executed had
been executed by or on behalf of the contractor (without thereby creating any trust in favour of
the contractor) fur ther the Employer or his agent, or servants, may enter upon and take
possession of the work and all plants , tools , scaffolding, sheds, machinery, s team and other

power, utensil and mater ials ly ing upon premises or the adjoining lands or roads and sell the
same as his own property or may employ the same by means of his own servants and workmen in
carry ing on and completing the works or by employ ing any oth er contractors or other persons or
person to complete the works, and the contractors shall not in any way interrupt or do any act,
matter of thing to prevent or hinder such other contractors or other persons or person employed
from completing and finishing or us ing the mater ials and plants for the works when the works
shall be complete, or as soon thereafter as conveniently may be, the employer shall give notice in
wr iting to the contractor to remove his surplus mater ials and plants and should the contracto r fail
to do so within a per iod of 14 days after receipt by him the employer may sell the same by public
Auction and shall give credit to the contractor for the amount so realised, Any expenses or
losses incurred by the employer in getting the works carr i ed out, by, other contractors shall be
adjusted against the amount payable to the contractor by way of selling his tools and plants or
due on account of work carr ied out by the contractor pr ior engaging other contractors or against
the Secur ity Deposit.

1. There shall be maintained in a readily accessible place firs t aid app liances inc luding adequate
supply of s ter ilis ed dress ings and cotton wool.
2. An injured person shall be taken to a public hospital without loss of time, in cases where the
injury necessita tes hospita l is a tion .
3. Suitable and strong scaffolds should be prov ide d for workmen for all works that cannot safely be
done from ground.
4. No portable s ingle ladder shall be over 8 meters in length. The width between the s ide rails shall
not be less than 30 cm. (c lear) and the dis tance between two adjacent rungs shall not b e more
than 30cm. When a ladder is used an extra mazdoor shall be engaged for holding the ladder.
5. The excavation mater ial shall not be placed within 1.5 meters of the edge of the trench or half of
the depth of trenches whichever is more. A ll trenches an d excavations shall be prov ided with
necessary fenc ing and lighting.
6. Providing suitable fenc ing prov ides every opening in the floor of a building or in a work ing
platform with suitable means to prevent the fall of persons or mater ials or railing whose min imum
height shall be one metre.
7. No floor, roof or other part of the s tructure shall be so over loaded with debr is or mater ials as to
render it unsafe.
8. Workers employed on mix ing and handling mater ial such as asphalt, cement mortar or concrete
and lime mor tar shall be prov ided with protective footwear and rubber hand -glov es.
9. Those engaged in welding works shall be prov ided with welder 's protective eye -shields and

( i) No paint containing lead or lead products shall be used except in the form of pa ste or
readymade paint.
( ii) Suitable facemasks should be supplied for use by the workers when the paint is applied in the
form of spray or surface having lead paint dry rubbed and scrapped.
11 . The Contractor to the painters shall supply overalls and adequa te fac ilities shall be prov ided to
enable the work ing painters to wash dur ing the per iod of cessation of work.
12 . Hoisting machines and tack le used in the works, inc luding their attachments, anchorage and
supports shall be in perfect conditi on .

13 . The ropes used in hois ting or lower ing mater ial or as a means of suspension shall be of durable
quality and adequa te s trength and free from defects .
14 . Working platforms, gangways and stairways shall be so constructed that they do not sag unduly

shall either be c losed (or) suitably protected. A ll the Bank stationery, records and furniture are
to be covered suitably to avoid the dust depositi on dur ing demolition ( or) white washing.
16 . No electr ic cable or apparatus, which is liable to be a source of danger or a cable or apparatus
used by the operator, shall remain electr ica l ly charged.
17 . All necessary personal safety equipment as considered adequate by the Engineer sh ould be kept
available for the use of persons employed in the s ite and maintained in a condition suitable for
immediate use.

1. The var ious works descr ibed in the B ills of Quantities and in the drawings shall be executed in
s tr ic t accordance with the specifications and drawings to the entire satis faction of the Architects
and the State Bank of India. The quality of mater ials and workmanship shall be of high quality
and shall conform to the relevant I.S . Specifications wherever applicable. The successful
tenderer will be required to produce for Architects approval samples of all mater ials and
procurement shall be arranged only after specific approval. Samples of finished work shall also
be shown for Architects approval wherever directed and finished work shall conform str ic tly to the
approved samples. The decis ion of the Architects in this matter will be final.
2. The tenderer shall ensure that the place of work is kept neat and tidy dur ing the progress of work
and also c lean at the end of each day 's work. The contractor shall also ensure that the s ite is
c leared of all rubbish, and other unwanted mater ials and han ded over in a neat and satis factory
conditi ons as may be directed by State Bank of India/Archi tec ts .
3. The tenderer shall take maximum precaution in protecting persons, things and properties
belonging to the State Bank of India, Public and also their own du r ing the progress of work. The
tenderer will be solely responsible for any damage caused dur ing the progress of work and the
successful tenderer shall indemnify the State Bank of India by suitable guarantee/insurance cover
from any c laims on any account due to damages caused dur ing their work.
4. Pre-measuremen ts to be recorded for all the dismantl ing items before s tar ting of work.
5. Site meetings will be held regular ly once in a week. The contractor or their author ised
representative would be present for the meeting to take instruction and carry out the same for
execution.
6. The contractor should maintain measurement books in which he should record measurements of
work done from time to time and checked by the Architect/S ite Engineer. There should be no
corrections or over wr iting in the measurements .
7. A Site Order Book and Hindrance Regis ter should be maintained at the s ite, which should contain
the instructions issued at s ite by the Bank Engineers/Architects and nature of hindrance with date
of occurrence.
8. A tentative programme is attached to this tender. The Contractor on s tar ting the work shall
herewith furnish to the Architects a programme for carry ing out the work s tage by s tage with in
the s tipulated time. A graph or chart on indiv idual work shall be maintained showing the progress
week by week. The contractors shall submit to the Architect a weekly progress report s tating the
number of sk illed and unskilled labourers employed on the works, work ing hours done, quantity of
cement used, place, type and quanti ty of work done dur ing the per iod.
State Bank of India's representative as well as the representative of the Architects shall carry out
the superv is ion at s ite. The work progress shall be rev iewed in per iodic s ite meetings or any
other interval to be decided by the State Bank of India and the architects . The Architects shall
prepare the BAR chart and PERT chart jointly and the contractors and the State Bank of India

approval shall be obtained, for the same. A fter approval the contractor shall fait hfully adhere to
the schedule and where deviations take place, the contractor shall take remedial action to
compensate for the delays in completion of the project.

1. The Tenderer is required to inspect the s ite of the work and ascertain for himself s ite conditions,
fac ilities available and other aspects before quoting for the work. The tenderer is also required,
before quoting, to carefully peruse the tender documents, the tenderer drawings and connected
details so as to understand c lear ly the scope and intent of the tender. Any c laims by the

successful tenderer at a later date on account of his failure to comply with the above instructions
will not be entertained .
2. The tenderer should note that the furniture and connected works are to be carr ied out and
installed in the ex is ting building. The tenderer should note that he should execute his part of the
work without causing any damage to any component of the building or serv ices. Any damage so
caused shall be made good at the cost and r isk of the successful tenderer .
3. The tenderer should note that the tender drawings and other documents descr ibing each item of
the schedule are only indicative in nature and cannot be taken as complete in detail and finishes.
Being tender for furniture works which calls for workmanship and finish inc luding use of good
quality mater ials of high s tandard, it is expected that the tenderer should understand the intent of
the tender drawings and specifications and prov ide for mater ials , workmanship, finishes and
accessor ies appropr iately so as to deliv er the product of high s tandards in keeping with the
function for which the furniture is being specified. No c laim from the contractor at a later date
will be entertained for his failure to understand this condition. The decis ion of State Bank of
India / Architect in respect of the quality of mater ials , type of construction, workmanship, finish,
etc ., shall be final and the contractor 's c laim for not prov iding in his tender for such mater ials ,
construction , workmanship and finish cannot be enterta ined.
4. State Bank of India/Architect reserve the r ight to ins is t on selection of mater ials , workmanship,
detailing and finishes, which they consider, are appropr iate, and suitable for the intended use.
The contractor is not eligib le for c laims to extra on this a ccount.
5. State Bank of India / Architect reserve the r ight to ins is t on proto - type to be made for each item
of work for approval before s tar ting the full fledged manufac tur e of each type of furniture .
6. State Bank of India / Architect reserves the r ight to suggest or make modification at the proto -
type stage which the contractor shall comply with.
7. State Bank of India/Architect will require the contractor to produce samples of all mater ials ,
accessor ies/finishes pr ior to procurement / manufacture. Failur e to comply with these
instructions can result in rejection of the work.
8. Furniture item shall be guaranteed for a per iod of one year from State Bank of India's
acceptance, cover ing mater ials , workmanship and finish. Any defects or shr inkage, warping or
other forms of deter ioration shall be made good by the contractor at his own cost within the
guarantee per iod, immediately on being informed of such defects . Failure to comply will entail
S tate Bank of India to unilaterally dec ide on getting the repair do ne through other agency at the
cost and r isk of the furniture contractor.
9. The contractor should use only the best mater ials . Teakwood or other timber specified shall be of
the best quality , free of defects of any k ind. A ll plywood, partic leboard, venee r, laminate etc .,
shall comply with respective I.S . s tandard. If required by State Bank of India /Architect, the

contractor will be required to arrange for testing products and produce test certificate from
recognised test houses to establish the quality of mater ials at his own cost. Any defective
mater ials not meeting with the s tandard shall be replaced at the contractor 's own cost.
10 . Samples of all the following mater ials and required for the work shall be got approved by State
Bank of India / Architec t.

10a. one sample of each item of the B ill of Quantities shall be made firs t and got approved before
proceeding with the remaining quantum of items and work.
11 . The dimensions of furniture prov ided in the schedule as well as in drawing are likely to vary
s lightly according to the s ize of space available in the respective rooms where they are to be
prov ided or placed. State Bank of India / Architects has the r ig ht to s lightly modify the dimensions
of furniture items to suit the s ite.
12 . The quoted rates shall inc lude for all mater ials , labour, scaffolding, furniture fittings, accessor ies
of matching type with the main furniture, transport to s ite, all taxes and dut ies (Central, S tate and
Local Taxes) and fix ing in their respectiv e places of the Buildings complete.
13 . Non-compliance of any of the above special conditions will entail summary rejection/dispensing
with the contract at any s tage of progress of work.
14 . Wherever decorative plywood is specified it must be ensured that the plywood shall be of
matching veneer and grains and of uniform colour. S tate Bank of India / Architects shall have
r ight to reject if the above specifications is not adhered to. Wherever polis hing is specified it
shall be of high quality of melamine finish, sprayed or hand applied, to high c lass/matt finish as
directed. M elamine shall be carr ied out in s tr ic t accordance with the manufacturer 's
specifications. If, at the time of handing over a ny scratches or deter ioration of the finish is
observed, State Bank of India /Architects shall have r ights to ins is t application of another coat
without extra cost. A ll hardware shall be of high quality brass ox idised finish conforming to IS
specifications. Samples of hardware fittings shall be shown to State Bank of India / Architects in
advance and approval obtained before procurement. Rate should inc lude cost of keeping the
works insured as well as other requiremen ts specified in the tender.
15 . In all cases measurement will be made on net items in complete shape as manufactured, supplied
and installed. Wherever areas are furnished in Sqm for items such as carpet, curtains, etc .
payment will be made on actual area laid to suit the shape and s ize of the r oom. The tenderer
should note that all cutting wastage, s titching, jointing and several special features such as
pleats , over laps, hem, etc . shall be absorbed by them within the quoted s im ilar items. The
tenderer should make sure that they should protect their mater ials and hand them over in good
shape satis factory to State Bank of India/Architects . A t the time of handing over any damages,

scratches, dents or such defects shall be got rectified as directed without any extra charge by the
tenderer to the satis fac tion of State Bank of India / Architects .
16 . The tenderer should inspect in the office of State Bank of India the s tandard terms and conditions
of agreement and other contract conditions normally adopted by State Bank of India for other
works, which shall govern this contract. Failure in part of the tenderer to familiar ise himself with
State Bank of India's s tandard terms and conditions of procedure will not entail them for any
c laim or representa tion at a later date.
17 . State Bank of India reserves the r ight to accept or reject any tender without ass igning any reason
State Bank of India also reserves the r ight to split the scope of the work to more than one
tenderer at their direction at any s tage. State Bank of India also has the r ight to modify the reafter
the scope of the work. Tenderer shall not have any c laim on account of the above.
18 . The time of completion of the entire work is awarded to one agency shall be 60 days from the 7th
day of work order. In case of splitting of work to more than one a gency, the time of completion
shall be suitably reduced. For delay in completion of work beyond the s tipulated date of
completion, State Bank of India shall levy liquidated damages as per their s tandard conditions of
contract.
THE RATE QUOTED SHALL INCLUDE THE FOLLOWING:
19 . Hardware fittings like hinges, handles, mortice locks, multipurpose locks, aldrops, tower bolts ,
drawer s lides, screws of best quality of approved make etc ., wherever necessary. A ll the door
c losures shall have 14 gauge brushed stainles s s teel top to match the floor ing level.
20 . Providing openings for switches, plug points prov is ion for tak ing wires, cables, conditions ins ide
partiti ons.
21 . Taking necessary wooden frames / GI channel frames of partitions up to roof over false ceiling
and fix ing to it. The measurement for partition will be measured only up to the false ceiling.
22 . Cupboard shall be measured in RM unless otherwis e mentioned as unit in numbers.
23 . Removal and crating away all the debr is from the premises after c leaning the floo rs etc ., with
water and removing all sports of s tains by us ing any approved remover to the satis faction of the
Employer.
24 . Scaffold ing to any height wherever required interna l ly to the floor height in each floor.
25 . Rectific a tion of damage(s) to floor ing, p laster ing etc ., caused dur ing the execution of work.
26 . Unless and until all the s tains on floor, walls , ceilings, glasses etc ., are removed satis factor ily by
the contractor , the work will \not be certifi ed complete.

27 . All the works will be measured for the actual quantity at s ite. Rates shall inc lude all wastages
and hidden mater ials .
28 . Unless otherwise specified all hidden surface shall have sealer finish and other exposed wooden
and decorative veneer surface shall have melamine matt finish of approved sha de.
29 . Rate shall inc lude proper protection of finished and semi finished works such as prov iding
Gypsum cover ing over marble/granite poly thene sheet cover ing over wooden and metal items,
furnitur e etc .
30 . Binding granite / marble to plywood with Industr ial Quality adhesive of extra bonding strength
such as Araldite etc ., and also s tainless s teel angle brackets for fix ing granite for vertical over
hanging surface of the counter.
31 . Wherever plywood veneer, laminate is mentioned, it shall be of the best quality and shall be of
matching grains, specially selected .
32 . Edge polishing of all glass, to be used in counter, low - level partitions etc .
33 . M .S. angle, flat, suspenders, shall be applied with one coat of pr imer and two coats of synthetic
enamel paint.

1. The Tenderer is required to inspect the s ite of the work and ascertain for himself s ite conditions,
fac ilities available and other aspects before quoting for the work. The tenderer is also required,
before quoting, to carefully peruse the tender documents, the tender drawings and connected
details so as to understand c lear ly the scope and intent of the tender. Any c laims by the
successful tenderer at a later date on account of his failure to comply with the above instructions
will not be entertained .
2. The tenderer should note that the furniture and connected works are to be carr ied out and
installed in the ex is ting building. The tenderer should note that he should execute his part of the
work without causing any damage to any component of the building or serv ices. Any damage so
caused shall be made good at the cost and r isk of the successful tenderer/Contractor. The
successful tenderer protect all other items of work of other agencies, such as floor ing, electr ical
work, aluminium windows/doors etc . from any damage and shall be responsible for final c lear ing
of the floor, walls etc . before handing over. No extra is payable toward s this the successful
tenderer shall inc lude this rate all m inor c iv il works such as chasing wall, dr illing hooks etc . and
making good and no extra is payable towards this . Neat house keeping at all shapes of work is
the responsibility of the successful tenderer, who shall also ensure that removal of debr is , wood
shaving, waste mater ial etc . from the s ite at his own cost is organised at regular bas is . The
successful tenderer shall also be responsible for safety and secur ity of all his mater ials and also
for ensur ing fire prevention s teps are taken at all times.
3. The tenderer should note that the tender drawings and other documents descr ibing each item of
the schedule are only indicative in nature and cannot be taken as complete in detail and finishes.
The tender being for furniture works which calls for workmanship and finish inc luding use of good
quality mater ials of high s tandard, the tenderer should understand the intent of the tender
drawings, and specifications and prov ide for mater ials , workmanship, finished and accessor ies
appropr iately so as to deliver the product of high s tandard, the tenderer should understand the

function for which the furniture is specified. No c laim from the Contractor at a later date will be
entertained for his failure to understand this requirement. The decis ion of State Bank of
India/Architect in respect of the quality of mater ials , type of fabr ication/assembling, workmanship,

finish, etc ., shall be final and binding on the contractor. No c laim for not prov iding in his tender
for such mater ials , construction , workmanship and finish can be enterta ined.
4. State Bank of India /Architect reserve the r ight to ins is t on selection of mater ial, workmanship,
detailing and finishes which they consider are appropr iate, and suitable for the intended use for
which the Contractor is not eligib le for any extra c laim on this account.
5. State Bank of India Architect reserve the r ight to ins is t on prototype to be made for each item of
work for approval before s tar ting the full - fl edged manufactur e of each type of furnitu re .
6. State Bank of India/Architect r eserves the r ight to suggest or make modification at the proto -type
stage, which shall be complied withou t any extra cost.
7. State Bank of India/Architect will require the contractor to produce samples of all mater ials ,
accessor ies/finishes pr ior to procurement/manufacture. Failure to comply with these instructions
can result in rejection of the work.
8. Furniture item shall be guaranteed for a per iod of one year from State Bank of India's acceptance
for cover ing mater ials , workmanship and finish. Any defects or shr inkage, warping or other forms
of deter ioration shall be made good by the contractor at his own cost within the guarantee per iod,
immediately on being informed of such defects . Failure to comply will entail S tate Bank of India
to unilaterally dec ide on getting the repair done through other agency at the cost and r isk of the
Contrac tor .
9. The Contractor should use only the best mater ial. Teakwood or other timber specified shall be of
the best quality , free of defects of any k ind. A ll plywood, parti c leboard, veneer, laminate etc .,
shall comply with respective I.S . s tandard. If required by State Bank of India/Architect, the
Contractor shall arrange for testing the products and produce test certificate from recognised test
houses to establish the quality of mater ials at his own cost. Any defective mater ial not meeting
with the s tandard shall be replaced at the Contractor 's own cost.
10 . Tenderer shall indicate the makes of the finish ing mater ials such as:

A long with the tender preferably with samples or catalogues therefore, based on which rates have
been quoted. The tenderer shall be prepared to produce samples if not furnished with the tender
when called for before consideration of the tender fur ther at his own cost and responsibility and
withou t any liabili ty on State Bank of India.
11 . The dimensions of furniture prov ided in the schedule as well as in the drawing are likely to vary
s lightly according to the s ize of space availa ble in the respective rooms where they are to be
prov ided or placed. State Bank of India /Architects have the r ight to s lightly modify the
dimensions of furnitur e items for which no extra c laim shall be entertained .
12 . The quoted rates shall inc lude for all mater ials , labour, furniture fittings, accessor ies of matching
type (Central, S tate and Local Taxes) and fix ing at the specific places in the Building complete.
Rate should inc lude cost of keeping the works insured as well as other requirements specified in
Tender.

13 . Non-compliance of any of the above requirement will entail summary rejection/dispensing with the
contract at any s tage of progress of work.
14 . Wherever decorative plywood is specified it must be ensured that the plywood shall be of
matching veneer and grains and of uniform colour. S tate Bank of India/Architect shall have r ight
to reject if the above specifications is not adhered to. Wherever polishing is specified it shall be
of high quality of melamine finish, sprayed or hand applied, to high c l ass/matt finish as directed.
M elamine finish shall be of approved make such as Asian paints . M elamine finish shall be carr ied
out s tr ic tly in accordance with the manufacture's specifications. If, at the time of handing over
any scratched or deter ioration of the finish is observed, State Bank of India/Architect shall have
the r ight to ins is t on application of another coat without extra cost. A ll hardware shall be of high
quality powder coated aluminium finish conforming to IS specifications. Samples of hardware
fittings shall be shown to State Bank of India/Architect in advance and approval obtained before
procurement. Rates such inc lude fix ing of mortice locks and door c losers of best quality make
doors of cabins, executive rooms etc . bes ides all hardw are fittings. A ll exposed Teakwood
members shall be given melamine finish/white cedar finish wherever necessary. A ll wood work
concealed or covered by other mater ials shall be given approved wood pr imer coating.
15 . In all cases measurement will be made on net items in complete shape as manufactured, supplied
and installed. M easurements for items such as false ceiling, carpet, curtains, etc . shall be taken
for actual area laid to suit the shape and s ize of the room. The tenderer should note that all
cutting wastage, s titching, jointing and several special features such as pleats , over laps, hem,
etc . shall be absorbed by them within the quoted rates and no separate payment will be made for
the same. The tenderer shall have to make sure that they protect the ir mater ials and hand them
over in good shape satis factory to State Bank of India/Architect. A t the time of handing over any
damages, scratches, dents or other such defects shall be got rectified as directed without any
extra charge by the tenderer/Contractor to the satis faction of State Bank of India/Architect.
P lastic sheets till handing over shall protect all carpets.
16 . State Bank of India reserves the r ight to accept or reject any tender without ass igning any
reason. State Bank of India also reserves the r ight to split the scope of the work for award to
more than one tenderer at their discretion. State Bank of India also has the r ight to modify
thereafter the scope of the work. Tenderer/Contractor shall not have any c laim on account of the
above.
17 . The time of completion of the entire work shall be 60 days from the 7th day of the date of work
order. In case of splitting of work to more than one agency, the time of completion shall be
suitably reduced. S tate Bank of India shall levy penalty /liquidated d amages as per the conditions
of contract for delayed progress of work at different s tages/final completion of work as the case
may be.
18 . All rates quoted shall inc lude high quality hardware fittings and specials such as hinges, tower
bolts , mortice locks, door c losers, door handles, drawer pulls , drawer s liding accessor ies, s liding
door gears and specials etc . and no extra cost is payable for these hardware fittings. Samples of
all hardware fittings shall be got approved by State Bank of India /Architect well in time, before
procurement.
