SPECIFIC CONDITIONS TO BE ADHERED TO BY THE CONTRACTOR

The tenderer should have valid PAN, Kerala VAT and Service tax registration etc.

A competent supervisor, who is fully conversant and fluent in the local language (for reading, writing and

speaking), should be available at the work site at all times to receive instructions from the Bank/ Architects. All

instructions will be communicated in the local language only. A qualified Resident Supervisor shall be

appointed as Site – In - Charge having diploma and minimum five years’ experience in similar works.

Overnight stay/ washing of cloths/ bathing etc are by the labours are not permitted in the premises. Entry pass

will be issued by the Bank strictly for execution of work only.

Existing passenger lifts and staircases in the building should not be used for transportation of materials/

debris.

Dismantling of flooring and similar works should be done only during night or during holidays without affecting

the functioning of the office.

The work is to be done in the 7th floor of a building in which several offices function. The work will have to be

done without affecting the functioning of the other offices.

Please read the ‘INSTRUCTIONS TO TENDERERS’ thoroughly before submitting the Tenders. Also note to verify the Bank web-

site under ‘Tender Notices’ before the last date and confirm that ‘CORRIGENDA’ to the Tender Notices issued (if any) has been

read and / or complied with.

works or mater ia ls a r i s ing f rom any cause whatsoever .

The success fu l tenderer shou ld take adeq uate cover under Workman 's Compensat ion Ac t and a lso

take Insurance coverage aga ins t th i rd par ty in ju ry , F i re , R io t , C iv i l Commot ion e tc .

4 . Other agenc ies may be work ing in the bu i ld ing dur ing the progress o f the work and cont rac tors

must a l low th is cont rac tor to car ry ou t th is works wi thout any h ind rance. No add i t ion to the

comple t ion t ime wi l l be a l lowed on th is account un less spec ia l de lays caused by o ther agenc ies

can be proved. The Cont rac tor must make we l l a l l holes in the bu i ld ing necessary fo r san i ta ry

and water supp ly works . I f so d i rec ted the genera l bu i ld ing cont rac tor wi l l be requ i red to make

good a l l the ho les and wi l l submi t the i r charges to the f i rms respons ib le .

5 . The quant i t ies se t ou t in the b i l l s o f quant i t ies are approx imate and ind ica t i ve on ly and a l l work

wi l l be pa id fo r on ac tua l measurements taken dur ing the progress o f work and pa id fo r a t the

accepted tender ra tes .

6 . Al l works sha l l be measured net as f in ished and the ra tes quoted by the Cont rac tors sha l l i nc lude

fo r a l l cu t t ings , was te , b reakages , e tc . Tenderer must inc lude in the i r ra tes , Sa les Tax , Serv ice

taxes , Exc ise duty , Oc t ro i , Vat , Labour Wel fa re Fund and any o ther taxes and dut ies lev ied by the

7 . No a l lowances sha l l be made to the Con t rac tors on account o f any c la im, wh ich i s based on the

c i rcumstances tha t the work may be, descr ibed in the cond i t ions o f the cont rac t o r spec i f i ca t ions

on wh ich apparent l y there i s no cor respond ing i tems g iven in the b i l l s of quant i t ies .

8. Errors in the bills of quantities shall be dealt with in the following manner:

IF on check there are differences between the rates given by the contractor in words and figures or in the

amount worked out by him, the following procedure shall be followed:

a. When there is a difference between the rates in figures and in words, the rates which correspond to the

amounts worked out by the contractor, shall be taken as correct.

b. When the contractor does not work out the amount of an item or it does not correspond with the rate written

either in figures or in words, then the rate quoted by the contractors in words shall be taken as correct.

c. When the rate quoted by the contractor in figures and in words tallies but the am ount is not worked out

correctly, the rate quoted by the contractor shall be taken as correct and not the amount.

d. The bills of quantities have been marked "Original" and "Duplicate". If there is any discrepancy in the rates,

units and amounts between the 'original' and 'duplicate' the 'original' will be liable to be taken as correct and

the 'duplicate' corrected accordingly.

progress ive runn ing b i l l s a t 10% of the gross va lue o f each runn ing b i l l p rov ided the to ta l

secur i ty depos i t ie . The ISD p lus re ten t ion money sha l l bo th together does not exceed 5% of

the cont rac t va lue .

The 50% of the re ten t ion amount i s re funded to the cont rac tor wi thout in te res t on comple t ion ,

sub jec t to the fo l lowing:

f i f teen days a f te r the end o f de fec ts l i ab i l i t y per iod , p rov ided he has sa t i s fac tor i l y car r ied out

a l l the works and a t tended to a l l de fec ts in accordance wi th the cond i t ions o f the cont rac t ,

inc lud ing s i te c learance.

The re ten t ion money wi l l bear no in te res t whatsoever , un t i l the date o f the i r re lease.

13 . The Cont rac tor shou ld comply to the prov is ions o f any lega l enac tment re la t ing to the works and

to the regu la t ions any bye - laws o f any loca l au thor i ty and or any water o r l i gh t ing companies wi th

whose sys tem the s t ruc ture i s p roposed to be connec ted and sha l l be fore mak ing any var ia t ion

f rom the drawings or spec i f i ca t ions tha t they may be necess i ta ted by conforming, g ive to the

15 . The Cont rac tor sha l l keep cons tant l y on the works a competent and q ua l i f i ed res ident eng ineer

and any d i rec t ion or exp lanat ion g iven by the Arch i tec ts or the i r representa t i ves to such Res ident

Eng ineer sha l l be he ld to have been g iven to the Cont rac tor .

16 . Every work wi l l be inspec ted by the Employer and the Arch i tec ts be fo re i t i s covered up and the

employer and the Arch i tec ts reserve the r igh t to uncover any work a t the Cont rac tor 's expenses , i f

found necessary .

17 . The Cont rac tor sha l l ma in ta in comple te records o f labour hours and any over t ime hours o f a l l

work peop le engage d by them in connec t ion wi th the work fo r the inspec t ion o f the employer .

18 . The employer wi l l endeavour to make ava i lab le water and power to the cont rac tors . The cos t o f

ex tend ing water and power supp ly f rom the po in t where supp ly is made ava i lab le , mak ing

connec t ion wi th the ex is t ing supp ly , f i x ing meters , e tc . i s to be borne by the Tenderer . Charges

fo r water and power consumed by the Cont rac tor wi l l be payab le by the Cont rac tor . The Tenderer

sha l l i n fo rm the employer a t the t ime o f tender ing , the requ i rement o f water and power fo r

cons t ruc t ion purposes . I f so d i rec ted water and power sha l l be had f rom the sources ava i lab le

wi th the genera l bu i ld ing , cont rac tor and the charges fo r consumpt ion pa id to the genera l bui ld ing

cont rac tor .

19. Time is the essenc e o f t he Cont rac t . The employer reserves the r igh t t o te rminate the cont rac t , i f

the work fa l l s beh ind schedu le by four weeks a t any t ime. A l l the works sha l l be comple ted wi th in

45 days f rom the 3 r d day o f da te o f wo rk order . The cont rac tor sha l l fu rn i sh a long wi th the tender ,

a programme char t fo r the comple t ion o f the work a long one week f rom the date o f i ssue o f work

order and sha l l s t r i c t l y adhere to i t .

20 . A pena l ty o f 0 .5% of the contac t amount wi l l be lev ied fo r every week o f non -comple t ion beyond

the schedu le o f comple t ion , sub jec t to a max imum of 5% of the accepted cont rac t va lue .

21 . The Cont rac tor sha l l t ake adequate cover under workmen 's compensat ion ac t and a lso take

insurance cover aga ins t th i rd par ty in ju ry , f i re , r io t , c i v i l commot ion e tc . Th e copy o f the po l i cy

(A l l r i sk po l i cy and cover under Workmen Compensat ion Ac t shou ld be submi t ted to t he

Employer ) .

22 . The employer wi l l have the r igh t to o rder the omiss ion o f any i tem or i tems inc luded in the B i l l s o f

Quant i t ies and the cont rac tor sha l l n o t be ent i t l ed to payment o f any k i nd on account o f such i t em

or i tems. I f the employer cons iders i t des i rab le , the cont rac tor sha l l have the i tems or i tems as

omi t ted executed by o ther f i rm or f i rms .

23 . The tenderer sha l l fu rn i sh wi th h is tender , a l i s t o f sub-cont rac tors who wi l l be respons ib le to the

main cont rac tor fo r spec ia l i sed jobs inc lud ing supp ly o f mater ia ls and serv ices .

28 . The works are to be car r ied out wi thout d is tu rb ing the day - to -day func t ion ing o f the Branch. The

cont rac tor has to take due care on the secur i ty o f Bank p roper t ies . Some t ime he may need to

car ry ou t the works dur ing the n igh t hours and hence the cont rac tor has to take care wh i le

quot ing the ra te in the tender cons ider ing these fac ts . The cont rac tor wi l l c la im noth ing ex t ra in

order o r o therwise in law, i f the cont rac tors commi t any defau l t o r b reach o f te rms and condi t ions

o f th is Agreement and/or the Genera l Cond i t ions o f the cont rac t and/or the work order o r fo i l i n

the due per fo rmanc e thereof wi th in the t ime f i xed by the cont rac t (wh ich i s the essence o f the

Cont rac t ) and do not comple te the ent i re work on the s t ipu la ted due date , the Sta te Bank o f Ind ia ,

sha l l be ent i t led to recover f rom the cont rac tors and the cont rac tors hereby agr ee to be bound to

pay the Sta te Bank o f Ind ia , as by way o f compensat ion or l i quida ted damages an amount

ca lcu la ted a t the ra te o f 1/2% of contract amount per week sub jec t to a max imum of 5% of the

contract amount . The de lay beyond the s t ipu la ted date in r espec t o f the i tem which i s no t

comple ted or f in ished and de l i vered comple te ly to the Sta te Bank o f Ind ia on the s t ipu la ted da te

7 . The Plans , Agreements and Documents above ment ioned sha l l fo rm the bas is o f th is cont rac t and

the dec is ion o f the sa id A rch i tec ts fo r the t ime be ing , as ment ioned in the cond i t ions o f cont rac t ,

taken wi th the approva l o f the Employer , in re ference to a l l the mat te rs o f d ispute as to the

mater ia l , workmansh ip or account and as to the in tended in terpre ta t ion o f the Clauses o f th is

agreement o r any o ther document a t tached sha l l be f ina l and b ind ing on both the par t ies and may

the Employer and not re fer red to in the spec i f i ca t ion or (d ) by reason o f au thor ised ex t ra and

add i t ions or (e ) by reason o f any combinat ion o f workmen or s t r i kes or lock -out a f fec t ing any o f

the bu i ld ing t rades or ( f ) f rom o ther causes wh ich the Employer may cons ider a re beyond the

cont ro l o f the cont rac tor , the Employer a t the comple t ion o f the t ime a l lowed fo r the cont rac t sha l l

make fa i r and reasonab le ex tens ion o f t ime fo r comple t ion in respec t there fore . In the event o f

the Employer fa i l i ng to g ive possession o f the s i te upon the day spec i f ied above the t ime o f

o f the Employer to proceed wi th the works and on h is do ing so tha t i t w i l l be ground o f

cons idera t ion by the Employer fo r an ex tens ion o f t ime as above prov ide . The dec is ion o f the

they are be ing obta ined, and the Cont rac tor sha l l g ive every fac i l i ty to the Sta te Bank o f Ind ia or

the i r representa t i ves necessary fo r inspec t ion and examinat ion and tes t o f the mater ia ls and

Any damage (dur ing cons t ruc t ions) to any par t o f the work fo r any reasons due to ra in , s to rm or

neg lec t o f cont rac tor sha l l be rec t i f i ed by the cont rac tor in an approve d manner a t no ex t ra cos t .

Shou ld the work be suspended by reason of ra in , s t r i ke , lockouts or any o ther cause, the

cont rac tor sha l l take a l l p recaut ions necessary fo r the pro tec t ion o f work and a t h is own expenses

sha l l make good any damage ar is ing f rom any of these causes .

The cont rac tor sha l l cover up and pro tec t f rom damage, f rom any cause, a l l new work and supp ly

a l l temporary /doors , p ro tec t ion to windows, and any o ther requ is i te p ro tec t ion fo r the execut ion o f

the work whether by h imse l f o r spec ia l t radesmen or sub -cont rac tor and any damage caused must

be made good by the cont rac tor a t h is own expenses .

12. REMOVAL OF IMPROPER WORK.

The Employer shal l dur ing the progress o f the work have power to order in wr i t ing f rom t ime to

t ime the remova l f rom the work wi th in such reasonab le t ime or t imes as may be spec i f ied in the

order o f any mater ia ls wh ich in the op in ion o f the Employer /Arch i tec ts are not in accordance wi th

spec i f i ca t ion or ins t ruc t ions , the subs t i tu t ion of p roper re -execut ion of any work execut ed wi th

Mater ia ls o r workmanships not in accordance wi th the drawings and spec i f i ca t ions or ins t ruc t ions .

In case the cont rac tor re fuses to comply wi th the order the Employer sha l l have the power to

employ and pay o ther agenc ies to car ry ou t the work and a l l expenses consequent thereon or

inc identa l there to as cer t i f i ed by the Employer/Arch i tec ts sha l l be borne by the cont rac tor o r may

be deduc ted f rom any money due to or tha t may become due to the cont rac tor . No cer t i f ica te ,

wh ich may be g iven by the Ar ch i tec ts , sha l l re l ieve the cont rac tor f rom h is l i ab i l i t y in respec t o f

unsound work or bad mater ia ls .

13. SITE ENGINEER.

The te rm 'S i te Eng ineer ' sha l l mean the person appo in ted and pa id by the Employer to

super in tend the work . The cont rac tor sha l l a f fo rd the S i te Eng ineer every fac i l i t y and

ass is tance fo r examin ing the works and mater ia ls . The Si te Eng ineer sha l l have no power to

revoke, a l te r , en large or re lax any requ i rements o f the cont rac tor o r to sanc t ion any day work ,

add i t ions , a l te ra t ions , dev ia t i ons or omiss ions or any ex t ra work whatsoever , except in so far

as such author i ty may be spec ia l l y confer red by a wr i t ten order o f the Employer .

ins t ruc t ions on ly f rom the Arch i tec ts /Employer .

14. OFFICE ACCOMMODATION FOR THE SITE ENGINEER.

The cont rac tor sha l l p rov ide , e rec t and main ta in a t h is cos t a separa te s imple water t igh t o f f i ce

accommodat ion fo r the S i te Eng ineer . Th is accommodat ion sha l l be we l l l i gh ted and vent i la ted

and prov ided wi th windows, door wi th a lock .

The Si te Eng ineer 's Of f ice sha l l be a min imum of 150 sq . f t . and sha l l have a desk , cha i r , d rawers

fo r keep ing drawings , a cupboard hav ing proper l ock and tack board for d isp lay ing drawings . The

accommodat ion sha l l be demol ished when d i rec ted.

15. CONTRACTOR'S EMPLOYEES

The cont rac tor sha l l employ techn ica l l y qua l i f i ed and competent superv isors fo r the work who

sha l l be ava i lab le (by tu rn) th roughout the work ing hours to rece ive and comply wi th ins t ruc t ions

o f the Employer /Arch i tec ts . The cont rac tor sha l l engage a t leas t one exper ienced Eng ineer as

S i te - in -charge fo r execut ion o f the work . The cont rac tor sha l l employ in connec t ion wi th the work

persons hav ing the appropr ia te sk i l l o r ab i l i t y to per fo rm the job e f f i c ien t l y .

The cont rac tor sha l l employ loca l labourers on the work as fa r as poss ib le .

No labourer be low the age o f s ix teen years and who is no t an Ind ian Nat iona l sha l l be employed

employed thereon by h im, who may in the op in ion o f the Employer be unsu i tab le or in compet en t

o r who may misconduc t h imse l f . Such d ischarges sha l l no t be the bas is o f any c la im fo r

compensat ion or damages aga ins t the Employer o r any o f the i r o f f i cer o r employee.

17. ASSIGNMENT.

The who le o f the works inc luded in the cont rac t sha l l be executed by the cont rac tor and the

cont rac tor sha l l no t d i rec t l y o r ind i rec t ly t rans fer , ass ign or under let the cont rac t o r any par t ,

share or in te res t there in no t , sha l l take a new par tner , w i thout wr i t ten consent o f the Employer

and no sub le t t ing sha l l re l i ve the c ont rac tor f rom the fu l l and ent i re respons ib i l i t y o f the cont rac t

o r f rom ac t i ve super in tendence o f the work dur ing the i r p rogress .

18. DAMAGE TO PERSONS AND PROPERTY INSURANCE ETC.

The cont rac tor sha l l be respons ib le fo r a l l i n ju ry to the work or workmen to persons , an imals or

th ings and fo r a l l damages to the s t ruc tura l and/or decora t i ve par t o f p roper ty wh ich may ar ise

f rom the opera t ions or neg lec t o f h imse l f o r o f any sub -cont rac tor o r o f any o f h is o r a sub -

cont rac tor 's employees , whether such in ju ry or damage ar ise f rom care lessness , acc ident o r any

o ther cause whatsoever in any way connec ted wi th the car ry ing out o f th is cont rac t . The c lause

sha l l be he ld to inc lude in ter -a l ia , any damage to bu i ld ings whether immedia te ly ad jacent o r

o therwise , and any damage to roads , s t ree ts , foo tpaths or ways as we l l as damages caused to the

bu i ld ings and the works fo rming the sub jec t o f th is cont rac t by ra in , w ind or o ther inc lemency o f

the weather . The cont rac tor sha l l i ndemni fy the Employer and ho ld harmless in r espec t o f a l l and

any expenses ar is ing f rom any such in ju ry or damages to persons or p roper ty as a foresa id and

a lso in respec t o f any c la im made in respec t o f in ju ry or damage under any ac ts o f compensat ion

or damage consequent upon such c la im.

The Employer sha l l be a t l i ber ty and is hereby empowered to deduc t the amount the amount o f

any damages, compensat ions , cos ts , charges and expenses ar is ing or occur r ing f rom or in

respec t o f any such c la i m or damages f rom any sums due or to become to the cont rac tor .

19. INSURANCE

Un less o therwise ins t ruc ted the cont rac tor sha l l i nsure the works and keep them insured unt i l the

v i r tua l comple t ion o f the cont rac t aga ins t loss or damage by f i re and/or ear thquake , f lood. The

insurance must be p laced wi th a company approved by the Employer , in the jo in t names o f the

Employer and the cont rac tor fo r such amount and fo r any fu r ther sum i f ca l led to do so by the

Employer , the premium of such fu r ther sum be ing a l lowed to the cont rac tor as an author ised

ex t ra .

The cont rac tor sha l l depos i t the po l i cy and rece ip t fo r p remiums pa id wi th the Employer a f te r

s ta r t ing the work un less o therwise ins t ruc ted. In de fau l t o f the cont rac tor insur ing as prov ided

above, the Employer o n h is beha l f may so insure and may deduc t t he premiums pa id f rom any

money due, o r wh ich may become due to the cont rac tor . The contrac tor sha l l as soon as the

c la im under the po l i cy i s se t t led or the work re ins ta ted by the Insurance Company shou ld they

e lec t to do so , p roceed wi th due d i l i gence wi th the comple t ion o f the works in the same manner as

though the f i re has not occur red and in a l l respec ts under the cond i t ions o f the cont rac t . The

cont rac tor in case o f reb ind ing or re ins ta tement a f te r f i re sha l l be ent i t led to ex tens ion o f t ime fo r

comple t ion as the Employer may deem f i t .

20. ACCOUNTS RECEIPTS & VOUCHERS

The cont rac tor sha l l , upon the reques t o f the Employer fu rn ish them wi th a l l the invoices ,

accounts , rece ip ts and o ther Vouchers tha t they may re qu i re in connec t ion wi th the works under

th is cont rac t . I f the cont rac tor sha l l use mater ia ls less than what he i s requ i red under the

cont rac t , the va lue o f the d i f fe rence in the quant i ty o f the mater ia ls he was requ i red to use and

tha t he ac tua l l y used s ha l l be deduc ted f rom h is dues . The dec is ion o f the Employer sha l l be

f ina l and b ind ing on the Cont rac tor as to the amount o f mater ia ls the Cont rac tor i s requ i red to use

fo r any work under th is cont rac t .

Before tak ing any measurement o f any work , the S i t e Eng ineer or a subord ina te deputed by h im

sha l l g ive reasonab le not i ce to the Cont rac tor . I f the Cont rac tor fa i l s to a t tend a t the

measurements a f te r such not i ce or fa i l s to counters ign or to record the d i f fe rence wi th in a week

f rom the date o f measureme nt in the manner requ i red by the S i te Eng ineer then in any such event

the measurements taken by the S i te Eng ineer or by the subord ina te deputed by h im as the case

may be i s f ina l and b inding on the Cont rac tor and the Cont rac tor sha l l have no r igh t to d ispu te the

same.

21. VARIATION / DEVIATION

The Cont rac tor may when author ised and sha l l , when d i rec ted in wr i t ing by the Employer add and

or omi t , o r vary the works shown in the drawings or descr ibed in the spec i f i ca t ions or inc luded in

the pr i ced schedu le o f qu ant i t ies . The Cont rac tor on h is own accord sha l l make no add i t ion ,

omiss ion or var ia t ion wi thout such author isa t ion or d i rec t ion . A verbal au thor isa t ion or d i rec t ion

by the Employer sha l l when conf i rmed cor rec t l y by the Cont rac tor in wr i t ing wi th in 3 day s sha l l be

deemed to have been g iven in wr i t ing .

cont rac tor sha l l be a l lowed day work pr i ces a t the net ra tes s ta ted in the t ender or the pr i ced

schedu le o f quant i t ies or , i f no t so s ta ted , then a t ra tes not exceed ing the min imum loca l day

work ra tes and wages fo r the d is t r i c t , no t i f i ed by the concerned author i ty , p rov ided tha t in

e i ther case i f requ i red by the Arch i tec ts , vouch ers , mus ter ro l l s and o ther documents requ i red

fo r p roper ver i f i ca t ion o f the labour employed and the mater ia ls dep loyed on the sa id work and

The Arch i tec ts wi l l dec ide the ques t ion as to whether ex t ra work i s o f such nature tha t i t

cannot be proper ly measured or va lued. The marg in to be a l lowed on ac tua l cos ts to the

cont rac tor towards pro f i ts and over heads sha l l be an appropr ia te percentage not exceed ing

15% .

22. SUBSTITUTION

23. PREPARATION OF BUILDING WORKS FOR OCCUPATION AND USE ON COMPL ETION

The who le o f the work wi l l be thorough ly inspec ted by the Cont rac tor and def i c ienc ies and defec ts

pu t r igh t . On comple t ion o f such inspec t ion the Cont rac tor sha l l i n fo rm the Employer the he has

comple ted the work and i t i s ready or inspec t ion .

On comple t ion the cont rac tor sha l l c lean a l l w indows and doors inc lud ing the c lean ing and o i l ing ,
