    5 3. "City university campus" means a campus of the city university of___________________________ ____________________________ _______________

    8 4. "Private college or university" means a not-for-profit two or four___________________________ ____________________________ _______________

    16 located in this state, through an acquisition, merger, consolidation or________________________ ____________________________ ____________________

    17 o ther reo rgani zatio n o f bu sines ses or the acqu isiti on of ass ets of________________________ ____________________________ ____________________

    18 another business, or except as provided in paragraph (d) of subdivision________________________ ____________________________ ____________________

    19 s ix o f t his secti on has not b een t rans ferr ed fr om em ploy ment w ith a________________________ ____________________________ ____________________

    20 related person in this state;________________________ _____

    21 (c) i s not fi lled b y an ind ividu al e mploy ed w ithin the st ate withi n___________________________ ____________________________ _______________

    22 the immediately preceding sixty months by a related person;________________________ ____________________________ _______23 (d) is either a full-time wage-paying job or equivalent to a full-time___________________________ ____________________________ _______________

    24 wage-paying job requiring at least thirty-five hours per week; and________________________ ____________________________ ______________

    26 6. "New business" means a business that satisfies all of the following___________________________ ____________________________ _______________

    30 program;________

    31 (b) the business must not be moving existing jobs into the tax-free NY___________________________ ____________________________ _______________

    33 (c) the bus iness is not sub stan tiall y si milar in o pera tion and i n___________________________ ____________________________ _______________

    34 ownership to a business entity (or entities) taxable, or previously________________________ ____________________________ ____________________

    35 taxable within the last five taxable years, under section one hundred________________________ ____________________________ ____________________

    36 eighty-three, one hundred eighty-four, one hundred eighty-five or one________________________ ____________________________ ____________________

    37 hundred eighty-six of the tax law, article nine-A, thirty-two or thir-________________________ ____________________________ ____________________

    38 ty-three of the tax law, article twenty-three of the tax law or which________________________ ____________________________ ____________________

    39 would have been subject to tax under such article twenty-three (as such________________________ ____________________________ ____________________

    1 8. "Related person" means a "related person" pursuant to subparagraph___________________________ ____________________________ _______________

    2 (c) of paragraph three of subsection (b) of section four hundred sixty-________________________ ____________________________ ____________________

    4 9. "Strategic state asset" means land or a building or group of build-___________________________ ____________________________ _______________

    5 ings owned by the state of New York, that is: (a) closed; (b) vacant; or________________________ ____________________________ ____________________

    6 (c) for which notice of closure has been given pursuant to any statutory________________________ ____________________________ ____________________

    7 notice requirement or which is otherwise authorized to be closed pursu-________________________ ____________________________ ____________________

    8 ant to any chapter of the laws of New York.________________________ ___________________

    9 10. "START-UP NY approval board" or "board" means a board consisting___________________________ ____________________________ _______________10 of three members, one each appointed by the governor, the speaker of the________________________ ____________________________ ____________________

    11 assembly and the temporary president of the senate. Each member of the________________________ ____________________________ ____________________

    12 START-UP NY approval board must have significant expertise and experi-________________________ ____________________________ ____________________

    13 ence in academic based economic development and may not have a personal________________________ ____________________________ ____________________

    14 interest in any project that comes before the board.________________________ ____________________________

    15 11. "Underutilized property" means vacant or abandoned land or space___________________________ ____________________________ _______________

    16 in an existing industrial park, manufacturing facility, a brownfield________________________ ____________________________ ____________________

    17 site as defined in article twenty-seven of the environmental conserva-________________________ ____________________________ ____________________

    18 tion law, or a distressed or abandoned property, which shall be deter-________________________ ____________________________ ____________________

    19 m ined b y factor s inc ludi ng p overty , id entif ied by the coun ty o r th e________________________ ____________________________ ____________________

    20 town, village or city that contains such distressed or abandoned proper-________________________ ____________________________ ____________________

    21 ty, as of the effective date of this article. A college or university________________________ ____________________________ ____________________

    22 shall work with local municipalities or local economic development enti-________________________ ____________________________ ____________________23 ties to identify underutilized properties.________________________ __________________

    24 12. "Eligible land" means land eligible pursuant to section four___________________________ ____________________________ _______________

    25 hundred thirty-two of this article for approval as a tax-free NY area.________________________ ____________________________ __________________

    26 13. "Sponsoring campus, university or college" means a university or___________________________ ____________________________ _______________

    27 college that has received approval to sponsor a tax-free NY area pursu-________________________ ____________________________ ____________________

    28 ant to section four hundred thirty-five of this article.________________________ ____________________________ ____

    29 432. Eligibility criteria for universities and colleges. 1. State___________________________ ____________________________ _______________

    30 university campuses, community colleges and city university campuses.________________________ ____________________________ ____________________

    31 (a) Subject to the limitations in paragraph (c) of this subdivision, the________________________ ____________________________ ____________________

    32 f ollow ing will con stit ute the elig ible lan d of a s tate univ ersit y________________________ ____________________________ ____________________

    33 campus, community college, or city university campus:________________________ ____________________________ _

    34 (i) a ny v acant space i n any b uilding l ocated o n a campus of a state___________________________ ____________________________ _______________

    35 university campus, community college or city university campus;________________________ ____________________________ ___________

    36 (ii) any vacant land on a campus of a state university campus, commu-___________________________ ____________________________ _______________

    37 nity college or city university campus;________________________ _______________

    38 (iii) for a state university campus or community college, a total of___________________________ ____________________________ _______________

    39 two hundred thousand square feet of vacant land or vacant building space________________________ ____________________________ ____________________

    40 that, except as provided under paragraph (b) of this subdivision, is________________________ ____________________________ ____________________

    41 located within one mile of a campus of the state university campus or________________________ ____________________________ ____________________

    42 community college; provided that this subparagraph shall not apply to a________________________ ____________________________ ____________________

    43 state university campus or community college located in Nassau county,________________________ ____________________________ ____________________

    44 Suffolk county or Westchester county; and________________________ _________________

    45 (iv) a New York state incubator as the term is used in subdivision___________________________ ____________________________ _______________

    46 four of section four hundred thirty-three of this article with a bona________________________ ____________________________ ____________________

    47 fide affiliation to the state university campus, community college or________________________ ____________________________ ____________________

    48 city university campus, with approval of the commissioner. In order for________________________ ____________________________ ____________________

    49 there to be a bona fide affiliation of a New York state incubator with a________________________ ____________________________ ____________________50 state university campus, community college or city university campus,________________________ ____________________________ ____________________

    51 the incubator and the state university campus, community college or city________________________ ____________________________ ____________________

    52 university campus must have a partnership to provide assistance and________________________ ____________________________ ____________________

    53 physical space to eligible businesses, as the term is used in section________________________ ____________________________ ____________________

    54 sixteen-v of the urban development corporation act; the incubator and________________________ ____________________________ ____________________

    55 the state university campus, community college or city university campus________________________ ____________________________ ____________________

    56 must directly work towards the goals of jointly creating jobs and incu-________________________ ____________________________ ____________________

    1 bating new startup businesses; and the mission and activities of the________________________ ____________________________ ____________________

    2 incubator must align with or further the academic mission of the state________________________ ____________________________ ____________________

    3 university campus, community college or city university campus.________________________ ____________________________ ___________

    4 (b) A state uni vers ity campu s or comm unit y col lege whic h qua lifie s___________________________ ____________________________ _______________

    5 under subparagraph (iii) of paragraph (a) of this subdivision may apply________________________ ____________________________ ____________________

    6 to the commissioner for a determination that identified vacant land or________________________ ____________________________ ____________________

    7 identified vacant space in a building that is located more than one mile________________________ ____________________________ ____________________

    8 from its campus, and is not located in Nassau county, Suffolk county,________________________ ____________________________ ____________________

    9 Westchester county or New York city, is eligible land for purposes of________________________ ____________________________ ____________________10 this program. The commissioner shall give consideration to factors________________________ ____________________________ ____________________

    11 including rural, suburban and urban geographic considerations and may________________________ ____________________________ ____________________

    12 qualify the identified land or space in a building as eligible land if________________________ ____________________________ ____________________

    13 the commissioner, in consultation with the chancellor or his or her________________________ ____________________________ ____________________

    14 designee, determines that the state university campus or community________________________ ____________________________ ____________________

    15 college has shown that the use of the land or space will be consistent________________________ ____________________________ ____________________

    16 w ith t he r equir ement s of t his p rog ram a nd the plan sub mitt ed b y th e________________________ ____________________________ ____________________

    17 state university campus or community college pursuant to section four________________________ ____________________________ ____________________

    18 hundred thirty-five of this article. In addition, two hundred thousand________________________ ____________________________ ____________________

    19 square feet of vacant land or vacant building space affiliated with or________________________ ____________________________ ____________________

    20 in partnership with Maritime College shall be eligible under this para-________________________ ____________________________ ____________________

    21 graph. The aggregate amount of qualified land or space under this para-________________________ ____________________________ ____________________

    22 graph and subparagraph (iii) of paragraph (a) of this subdivision may________________________ ____________________________ ____________________23 n ot e xcee d tw o hu ndre d th ousan d s quare fe et fo r a state univ ersit y________________________ ____________________________ ____________________

    24 campus or community college.________________________ ____

    25 (c) The provisions of paragraphs (a) and (b) of this subdivision shall___________________________ ____________________________ _______________

    26 apply only to:______________

    27 (i) a state university campus other than the following: (A) any empire___________________________ ____________________________ _______________

    28 state college campus except for the empire state college campus in Sara-________________________ ____________________________ ____________________

    29 toga Springs, (B) any property of downstate medical center located in________________________ ____________________________ ____________________

    30 N assau co unty, Suf folk cou nty, Wes tches ter coun ty o r Ne w Yor k cit y________________________ ____________________________ ____________________

    31 e xcept for pro perty af filia ted with dow nsta te m edica l c enter tha t________________________ ____________________________ ____________________

    32 constitutes a New York state incubator as the term is used in subdivi-________________________ ____________________________ ____________________

    33 sion four of section four hundred thirty-three of this article, and (C)________________________ ____________________________ ____________________

    34 any property of the college of optometry or maritime college located in________________________ ____________________________ ____________________

    35 Nassau county, Suffolk county, Westchester county or New York city.________________________ ____________________________ _______________

    36 (ii) a community college, except that for a community college whose___________________________ ____________________________ _______________

    37 main campus is in New York city, paragraphs (a) and (b) of this subdivi-________________________ ____________________________ ____________________

    38 sion shall not apply to property of such community college in Nassau________________________ ____________________________ ____________________

    39 county, Suffolk county, Westchester county or New York city.________________________ ____________________________ ________

    40 (iii) a total of five city university campuses, one each in the___________________________ ____________________________ _______________

    41 boroughs of Manhattan, Brooklyn, Bronx, Queens and Staten Island, which________________________ ____________________________ ____________________

    42 will be designated by the board of trustees of the city university of________________________ ____________________________ ____________________

    43 New York. The campus designated in each borough must be located in an________________________ ____________________________ ____________________

    44 economically distressed community. The commissioner shall establish a________________________ ____________________________ ____________________

    45 list of economically distressed communities for the purpose of this________________________ ____________________________ ____________________

    46 designation, based on criteria indicative of economic distress, includ-________________________ ____________________________ ____________________

    47 ing poverty rates, numbers of persons receiving public assistance, unem-________________________ ____________________________ ____________________

    48 ployment rates, and such other indicators as the commissioner deems________________________ ____________________________ ____________________

    49 appropriate to be in need of economic assistance. In addition, para-________________________ ____________________________ ____________________50 graphs (a) and (b) of this subdivision shall apply to property of the________________________ ____________________________ ____________________

    51 city university located outside of Nassau county, Suffolk county, West-________________________ ____________________________ ____________________

    52 chester county and New York city.________________________ _________

    53 (d) The eligible land of a state university campus, community college,___________________________ ____________________________ _______________

    54 or city university campus will also include eligible land designated________________________ ____________________________ ____________________

    55 under paragraph (c) of subdivision two of this section.________________________ ____________________________ ___

    2 Subject to the limitations in paragraph (c) of this subdivision, the________________________ ____________________________ ____________________

    4 university:___________

    5 (i) any vaca nt s pace in a ny b ui ldin g loc ated on a camp us o f a p rivat e___________________________ ____________________________ _______________

    6 university or college other than a campus which is located in Nassau________________________ ____________________________ ____________________

    7 county, Suffolk county, Westchester county or New York city;________________________ ____________________________ ________

    8 (ii) an y va cant lan d on a cam pus of a priv ate univer sity or colleg e___________________________ ____________________________ _______________

    9 other than a campus which is located in Nassau county, Suffolk county,________________________ ____________________________ ____________________10 Westchester county or New York city;________________________ ____________

    11 (iii) any vacant land or vacant space in a building which is not___________________________ ____________________________ _______________

    12 located in Nassau county, Suffolk county, Westchester county or New York________________________ ____________________________ ____________________

    13 c ity; and_________

    14 (iv) a New York state incubator as the term is used in subdivision___________________________ ____________________________ _______________

    15 four of section four hundred thirty-three of this article with a bona________________________ ____________________________ ____________________

    16 fide affiliation to the private university or college, with approval of________________________ ____________________________ ____________________

    17 the commissioner. In order for there to be a bona fide affiliation of a________________________ ____________________________ ____________________

    18 New York state incubator with a private university or college, the incu-________________________ ____________________________ ____________________

    19 bator and the private university or college must have a partnership to________________________ ____________________________ ____________________

    20 provide assistance and physical space to eligible businesses as the term________________________ ____________________________ ____________________

    21 is used in section sixteen-v of the urban development corporation act;________________________ ____________________________ ____________________

    22 the incubator and the private university or college must directly work________________________ ____________________________ ____________________23 towards the goals of jointly creating jobs and incubating new startup________________________ ____________________________ ____________________

    24 businesses; and the mission and activities of the incubator must align________________________ ____________________________ ____________________

    25 w ith o r fu rther the aca demic mis sion of the pri vate uni versi ty o r________________________ ____________________________ ____________________

    26 college.________

    27 (b) Subject to the limitations in paragraph (c) of this subdivision,___________________________ ____________________________ _______________

    28 three million square feet is the maximum aggregate amount of tax-free NY________________________ ____________________________ ____________________

    29 areas of private universities and colleges that may be utilized for this________________________ ____________________________ ____________________

    30 program, which shall be designated in a manner that ensures regional________________________ ____________________________ ____________________

    31 balance and balance among eligible rural, urban and suburban areas in________________________ ____________________________ ____________________

    32 the state. The commissioner shall maintain an accounting of the vacant________________________ ____________________________ ____________________

    33 l and and spac e of pr ivate uni vers ities an d col leges tha t hav e bee n________________________ ____________________________ ____________________

    34 approved as tax-free NY areas and shall stop accepting applications for________________________ ____________________________ ____________________

    35 approval of tax-free NY areas when that maximum amount has been reached.________________________ ____________________________ ____________________

    36 (c) Of the maximum aggregate amount in paragraph (b) of this subdivi-___________________________ ____________________________ _______________

    37 sion, an initial amount of seventy-five thousand square feet shall be________________________ ____________________________ ____________________

    38 designated as tax-free NY areas in each of the following: Nassau county,________________________ ____________________________ ____________________

    39 Suffolk county, Westchester county and the boroughs of Brooklyn, Bronx,________________________ ____________________________ ____________________

    40 Manhattan, Queens and Staten Island. The board may approve the desig-________________________ ____________________________ ____________________

    41 nation of up to an additional seventy-five thousand square feet for any________________________ ____________________________ ____________________

    42 county or borough that reaches the initial seventy-five thousand square________________________ ____________________________ ____________________

    43 foot limit, provided that such additional seventy-five thousand square________________________ ____________________________ ____________________

    44 feet shall not count against the square footage limitations in paragraph________________________ ____________________________ ____________________

    45 (b) of this subdivision. Vacant land and vacant space in a building on________________________ ____________________________ ____________________

    46 the campus of the following shall be eligible for designation under this________________________ ____________________________ ____________________

    47 paragraph:__________

    48 (i) a private university or college which campus is located in Nassau___________________________ ____________________________ _______________

    49 county, Suffolk county, Westchester county or New York city.________________________ ____________________________ ________50 (ii) a state university campus that meets the criteria of clause (B)___________________________ ____________________________ _______________

    51 or (C) of subparagraph (i) of paragraph (c) of subdivision one of this________________________ ____________________________ ____________________

    52 section.________

    53 (iii) a community college whose main campus is in New York city.___________________________ ____________________________ _________

    54 (iv) a city university campus that is not designated under subpara-___________________________ ____________________________ _______________

    55 graph (iii) of paragraph (c) of subdivision one of this section.________________________ ____________________________ ____________

    1 (d) In addition, the board may approve: (i) one application that___________________________ ____________________________ _______________

    2 includes eligible land owned or leased by a city university campus that________________________ ____________________________ ____________________

    3 is directly adjacent to such campus; (ii) one application that includes________________________ ____________________________ ____________________

    4 eligible land owned or leased by a state university campus, community________________________ ____________________________ ____________________

    5 college, or private university or college in Nassau county or Suffolk________________________ ____________________________ ____________________

    6 county that is directly adjacent to such campus, university or college;________________________ ____________________________ ____________________

    7 and (iii) one application that includes eligible land owned or leased by________________________ ____________________________ ____________________

    8 a state university campus, community college, or private university or________________________ ____________________________ ____________________

    9 college in Westchester county that is directly adjacent to such campus,________________________ ____________________________ ____________________10 university or college. The board may approve an additional application,________________________ ____________________________ ____________________

    11 for a state university campus, community college, or private university________________________ ____________________________ ____________________

    12 or college in the county not previously approved under subparagraph (ii)________________________ ____________________________ ____________________

    13 of this paragraph in which case it shall also approve a second applica-________________________ ____________________________ ____________________

    14 tion under subparagraph (i) of this paragraph.________________________ ______________________

    15 3. Prohibition. A state university campus, community college or city___________________________ ____________________________ _______________

    16 university campus is prohibited from relocating or eliminating any________________________ ____________________________ ____________________

    17 academic programs, any administrative programs, offices, housing facili-________________________ ____________________________ ____________________

    18 ties, dining facilities, athletic facilities, or any other facility,________________________ ____________________________ ____________________

    19 space or program that actively serves students, faculty or staff in________________________ ____________________________ ____________________

    20 o rder to crea te v acan t la nd o r sp ace to be util ized for the progra m________________________ ____________________________ ____________________

    21 authorized by this article. In addition, nothing in this article shall________________________ ____________________________ ____________________

    22 be deemed to waive or impair any rights or benefits of employees of the________________________ ____________________________ ____________________23 state university of New York, a community college or the city university________________________ ____________________________ ____________________

    13 terminated from the START-UP NY program pursuant to paragraph (b) of________________________ ____________________________ ____________________

    14 subdivision four of section four hundred thirty-six of this article, and________________________ ____________________________ ____________________

    15 subsequently does not relocate outside of the tax-free NY area, a________________________ ____________________________ ____________________

    16 campus, university or college may amend its approved plan to allocate an________________________ ____________________________ ____________________

    17 amount of vacant land or space equal to the amount of space occupied by________________________ ____________________________ ____________________

    18 the business that is terminated. The amendment must be approved pursu-________________________ ____________________________ ____________________

    19 ant to the procedures and requirements set forth in subdivision one or________________________ ____________________________ ____________________

    20 two of this section, whichever is applicable.________________________ _____________________

    21 4. The START-UP NY approval board, by majority vote, shall designate___________________________ ____________________________ _______________

    22 up to twenty strategic state assets as tax-free NY areas. Each shall be________________________ ____________________________ ____________________23 affiliated with a state university campus, city university campus,________________________ ____________________________ ____________________

    24 community college, or private college or university and such designation________________________ ____________________________ ____________________

    25 shall require the support of the affiliated campus, college or universi-________________________ ____________________________ ____________________

    26 ty. Each strategic state asset may not exceed a maximum of two hundred________________________ ____________________________ ____________________

    27 thousand square feet of vacant land or vacant building space designated________________________ ____________________________ ____________________

    28 as a tax-free NY area. Designation of strategic state assets as tax-________________________ ____________________________ ____________________

    29 free NY areas shall not count against any square footage limitations in________________________ ____________________________ ____________________

    30 section four hundred thirty-two of this article.________________________ ________________________

    31 5. The commissioner shall promulgate regulations to effectuate the___________________________ ____________________________ _______________

    36 436. Businesses locating in tax-free NY areas. 1. A campus, univer-___________________________ ____________________________ _______________

    37 sity or college that has sponsored a tax-free NY area (including any________________________ ____________________________ ____________________

    38 strategic state asset affiliated with the campus, university or college)________________________ ____________________________ ____________________

    39 shall solicit and accept applications from businesses to locate in such________________________ ____________________________ ____________________

    40 area that are consistent with the plan of such campus, university or________________________ ____________________________ ____________________

    41 c olleg e or s tra tegic s ta te a sset t hat has bee n ap prove d p ursua nt t o________________________ ____________________________ ____________________

    42 section four hundred thirty-five of this article. Any business that________________________ ____________________________ ____________________
