STANDING RULES AND ORDERS

FOR THE ORDERLY CONDUCT OF THE BUSINESS OF THE

GENERAL LEGISLATIVE COUNCIL

LEEWARD ISLANDS,

1900.

1. The Council shall meet at 11 o'clock in the foienoon^ fexcept when some other hour shall have been, appointed for its meeting.

2. The Chair shall be taken, as Soon as the Coiiacil shall be constituted for the despatch of business, that is to say as soon as bt the least nine Members shall be present and assisting. Iu the event of a sufficient number of members not attending within half an hour after the time appointed for a meeting, such meeting shall sland adjourned to the next day, unless the next day be a Sunday or a public holiday, in which case the Council shall stand adjourn¬ ed to the" following working day,

3. No Member shall quit the Council Chamber during a sitting of the House, whether in Couacil or ia Committee, without leave from the President.

4 The" Council may adjourn any nieeting to such time as it shall think proper; and if at any meeting the Council shall rise without adjournment, such meeting shill standadjourned fo the next day, or, if that be a Sunday or public holiday, then to the following working-day.

5. The Clerk shall at every meeting take minutes, which shall consist of particulars of the proceedings. He shall enter in the minutes the names of all Members present at the assembling of the Council; and in case any other Member shall take his seat subsequently at such meeting or shall leave the House before the rising of the Council, the Clerk shall note the fact at the proper place in the minutes. Before the Council shall proceed to any other bnsiness at any meeting, the minutes of the proceedings of the last preceding meeting, as taken by the Clerk, shall be read by him, amended, if necessary, and confirmed. Provided that the minutes of the last meeting of a Session shall be read and con¬ firmed before the adjournment thereof, except the Council shall otherwise decide. If any Member shall be desirous of making any correction of the minutes, he shall propose such correction, immediately after the minutes are read, and the same shall befortha with admitted or rejected by the Council.

8, Tl e following shall be the order of business in.tne House:

(1) reading and confirmation of minutes;

(2) communications from the Chair;

(3) presentation of petitions and memorials ;

(4) questions of which notice has been given, and answers thereto;

(5) money votes; (Kj bills; (7) rales; (8) other motions ; (9) notices; and

(10) adjournment. Subject as aforesaid, all propositions shall be submitted to the

Council in the order in which they stand in the Order of the Day Book; provided that the Councilmay by specific vo'e determine to iKoceea to any particular business out of tne regulir orde-% and a motion for such vote may be made without notice and shall take

precedence of all other business.

9. Every Member shall speak standing and address his ob¬ servations to tLe President. It two Members rise at the same time to speak, the President will call on ihe Member who first catches his eye. Every Member must confine his observations to the sub¬

ject, under consideration. No Member shall impute improper mo¬ tives to any other Member. All personalities are to be carefully avuided. a Member shall not be intenupted, unless out of order. "When he has finished his observations, he will resume his seat, and am other Member wishing to address the Council will lise. No Member shall speak more than once on the same proposi¬ tion, except in explanation, or to order, or when the Council is in Committee, The Member who originated a proposition mar, however, reply, after all the other Members present sha'l have had on oppoituuity of making their observations, and before the motion is put. A'iy Member deviating from the rules may be im¬ mediately called to order; and if any dispute arises as to whether the Member is or is not in order, such question irhall be decided by the President, whose rulings shall be final upon ail questions of order and piocedure.

10. All piopositions shall be submitted to tin Council by Way of motion, and every motion shall be reduced to writing an! read by the Clerk. E*e y motion, except in Commit'ee, must be seconded, and, if not seconded shall not be debated and shall be considered as lost, anda note of its being lost enterediu the minutes.

11. Any Member may propose any amendment of any pro¬ position ; provided that the amendment be relevant to the propo¬ sition ; and provided that no Membir move more than one amend¬ ment of the same proposition or any amendment substantially identical with an amendment movtd by auo'her Member. Every question of the relevancy or irrelevancy of an amendment or of the identity of one amendment with another shall be decided by the President. Amendments of a proposition shall be put before the original propcs tion and in the inverted order ol their being moved.

When the debate upon a motion U concluded, the Coun¬ cil shall proceed to vote thereon, and the Clerk shall collect the votes by calling over ilie names of all the Members present in' alphabetical order, with the exception of the President whose vote shall be taken last; and every Member shall upon hiB name being called, give his vote by saying

" Aye" or ' No ;" and after

having taken the voles, the Clerk shall declare the result and record in the minutes the vote of each Member /or or against tha question. No member shall hi allowed to vote on any matter in which he may have a direct personal pecuniary inteiest.

Any member may protest against any decision of the Council, provided he give notiee'vof bis intention to make such protest immediately after such decision shall have been made, and that such protest be delivered to the Clerk of the Council within one month after &uch decision. Such proiest shall contain merely the reasons for protesting. No counter protest shall be admitted. It shall be competent for the Council to order any passage in

any protest which may be justly offensive to be expunged.

13 Every proposition once submitted to the Council shall be

disposed of, before any other question shall be entertained ; but this rule shad not exclude amendments or motions for adjourn¬ ing the consideration of any subject or for the adjournment of the

House, which may be moved at any time and shall be immedi itely decided upon; provided that, if, in the course of a debate, a motion that the Council or the debate be adjourned be put and

negatived no further motion for adjournment shall be made in the course of the same debate without the leave of the President first obtained.

14. Every bill intended for submission to the Council shall be fail ly prinleol or written, and a copy thereof furnished to Mem¬ bers not less than 48 hours before its intrcduclion.

15. No bill shall be introduced, until 'eave for its introduc¬ tion shall have been applied for and granted. No notice of an in¬ tention to apply for leave to introduce a bill need be given. If leave to introduce a bill be granted, the bill may be introduced, and its provisions explained, either immediately or at any time within the next six months. When introduced, a bill shall be read & first time by the Clerk without question or debate.

1G Every bill shall be read three times prev'ously to its

being parsed, and no bill shall be advanced more than one stage .at any one sitting,unless the Standing Rules and Orders thai] have been formally suspended for the purpose.

17. If the question of the seeond reading of a bill be answer¬ ed in the affiimative, the bill shall st-.nid referred to a Committee o the whole House, where it shall be ead and, if so resolved, amended, clause by clause, first the clauses being taken in order, then the schedules, if any, in order, next the preamble, if any, a d

lastly the title; and such reading in Committee shall be deemed to be a reading of the bill.

thereupon the CKrk shall lay the bill before the Governor.

19. W hen a bill is ordered to be read a first or third time, the Clerk, unless the Council dissent, may read only the title of the bill; when the bill shall be considered as read.

20. No private bill which may directly affect the interests of individuals shall be passed, until after due notice of the samf sha'l have been given, in such manner as the House may direct, to all

persons concerned, nor unless its preamble shall be proved.

21. The Government shall not propose any vote or resolution

having for its object to charge any part of the revenues aiising within the Leeward Islands without givingi one day's previous notice thereof.

of 23. The President, or, in his absence, the Member appointed by the Governor to preside or in the absence of such Member the

senior official Member present, shall be Chairman of Committees.

24. No petition relating to any scrutiny or controverted election shall be received after the third meeting of the Council

subsequent to the returned Member taking his seat; and in no case in which the Council shall entertain a petition against the return of a Member shall such Member be permitted to vote on any sub¬

ject connected with such petition or in the scrutiny of the votes taken thereon.

25. No Member of the Council shall be permitted to appear at the bar thereof as Counsel in any matter to be deliberated by the Council.

26. No communication to the Council, except communica1 tions made by the Governor, shall be received, unless it be in the form of a petition or a memorial, duly signed by the person or persons from whom it emanates ; and every such petition or mem¬ orial must be presented by some Member, who shall be responsi¬ ble for its being couched in respectful terms. On the presentation of any petition or memorial the Member presenting the same may without previous notice move that it be ordered to lie on the table.

27. All papers laid before the Council shall he deposited with the Clerk, who shall be responsible for the safe custody there¬ of ; and all such papers shall be ready to be produced before the Council, whenever required by any Member, and shall be at all times open to the inspection and perusal of Members.

28. The Clerk shall prepare for the Governor's assent all bills and acts and put the marginal notes thereto and keep an index of the records of the Council,

29. The Standing Rules and Orders of the Council shall be signed by the President or Member appointed by the Governor to

preside, or by the senior official Member present and, when con¬ firmed by the Governor, shall be recorded by the Clerk and print* ed, and a copy delivered to each Member.

30. The Standing Rules and Orders, or any of them, may ait any time be suspended by the vote of the majority of members present
