STANDING ORDERS

OF THE

Court of Annual General Session of the Peace

FOB THE

COUNTY OF LANCASTEB.

I.—The Holding of Sessions.

1.—That in pursuance of the Statute 38th Geo. III., c. 58, s. 8, there shall be holden an Annual General Session of the Peace at the town of Preston, in the said County, on the Thursday next

following the Feast of St. John the Baptist in every year, viz., the 24th day of June—and so many adjournments thereof from time to time as occasion shall require ; one of which adjournments shall be on the Second Thursday in September (or on such other

Thursday in that month as may not interfere with the Assizes), for the general transaction of the County Business, and the considera¬ tion of the County Accounts, which have been produced at the First Annual General Session: and the other adjournments shall be ordinarily on the Thursday prior to the holding of the Quarter Sessions in January and April.

2.—That Special General Sessions may be held by order of three Justices of the Peace complying with the conditions of Statute 38th Geo. HI., c. 58, s. 11.

3.—That the Clerk of the Peace shall give fourteen days'" notice to every acting Justice, of the holding of every Session, and every adjournment thereof, except adjournments from day to

day.

4.— That the Clerk of the Peace, in the Summons for any meeting of the Court, shall insert, in addition to such matters as

may be ordered by the Chairman or any Committee, all subjects* for which Notice of Motion shall have been given according to the rule hereinafter contained.

II.—The Offices and Duties of Chairman and Vice-Chairman.

1.—That the Chairman of the Sessions shall be elected

annually upon the adjournment day of the General Session held in

September.

2.—That upon the death or resignation of the Chairman of the Sessions, a new Chairman shall be elected on the adjournment day which shall happen next after such death or resignation : and the Chairman so elected shall continue in office until the day of the next General Session in September.

8.—That the Chairman of the Sessions shall be ex-offioio a member of every Committee appointed by the Court, excepting the Committees for conducting the affairs of the Lunatic

Asylums.

4.—That a Vice-Chairman shall be elected by the Court

annually, in like manner as the Chairman is elected ; who, in the absence of the Chairman shall have all the powers and exercise all the privileges enjoyed by the Chairman. That upon the death or resignation of the Vice-Chairman, a new Vice-Chairman shall be elected in the same manner as on the death or resignation of the Chairman, and shall continue in office in like manner as the said Chairman.

5.—That if at any Annual General or Adjourned General Session of the Peace the Chairman and Vice-Chairman shall both be absent, the Justices then assembled shall choose one of their number then present to be the Chairman of the Meeting.

III.—Notices of Motion.

1.—That all Notices of Motion shall be sent to the Clerk of the Peace, in writing, twenty-one days before the holding of the Annual General Session, or any Adjournment thereof; and all such notices shall be dated and numbered as received, and entered

in a book to be kept for that purpose in the office of the Clerk of the Peace, which book shall be open to the inspection of every Justice.

2.—That Motions for which such Notices shall have been

given, shall have precedence according to the order in which the Notices were given—matters brought specially before the Court by the Chairman, or on the report of any Committee, excepted.

IV.—The Proceedings on Session Days, General or Adjourned.

1.—That the time for commencing business upon each Session

Day shall be Half-past Eleven o'clock in the forenoon.

2.—-That Minutes of the Proceedings of the Sessions shall be

fairly entered in a book to be kept for that purpose.

3.—That at every Session the business mentioned below shall take precedence of all other business (except the election of Chairman or Vice-Chairman), and be entered on the Agenda Paper in the following order :—

The Beport of the Committee for General Purposes ;

The Report of the General Finance Committee on the County Treasurer's Accounts;

The making and assessing of the General County and other

Rates;

The Report of the Committee of Visitors of the County Lunatic Asylum at Lancaster, in Lonsdale Hundred ;

The Report of the Committee of Visitors of the County Lunatic Asylum at Prestwich, in Salford Hundred ;

The Report of the Committee of Visitors of the County Lunatic Asylum at Rainhill, in West Derby Hundred ;

The Report of the Committee of Visitors of the County Lunatic Asylum at Whittingham, in Amounderness

Hundred;

The Reports of any other Committees ;

The Appointment (in January Session) of the Committee of Visitors of the County Lunatic Asylums at Lancaster, Prestwich, Rainhill, and Whittingham, respectively;

Any subject or matter brought specially before the Court by the Chairman;

The adjourned Motions (if any) of the preceding Session.

4.—That no memorial or petition, except such as relates to a matter actually before the Court, be received until the Motions of which due notice has been given are disposed of; after which the memorial or petition may be presented by any Justice, who shall be at liberty to state the substance thereof; but the reading and consideration thereof shall be postponed until some subsequent Court, when such memorial or petition may be read and determined upon, if previous notice of any motion relating thereto shall have been duly given. Provided that memorials or petitions relating to any matter actually before the Court may be presented at the time of such matter being discussed, when the Justice presenting the memorial or petition shall be at liberty to state the substance thereof; and such memorial or petition may, upon motion made and seconded, be read by the Clerk of the Peace and considered along with the matter to which it relates; but not so as to authorise the founding upon it of any resolution that could not otherwise have been regularly moved.

5.—That no Proceeding or Resolution of the Court shall be altered or rescinded, otherwise than by a motion, of which previous notice shall be given and inserted in the summons sent to each Justice of the County.

6.—That no proceedings shall be taken with the view of pro¬ moting a Bill in Parliament for any purpose connected with the duties of County Magistrates, or relating to the interests of the

County or any part thereof, until a Motion, of which due notice shall have been given, has been submitted to and adopted by the Court, embodying the object or objects of the proposed Bill.

7.—That no Notice of Motion shall be inserted in the Agenda Paper which has not been committed to writing, and transmitted or delivered to the Clerk of the Peace, and been by him iucluded in the Summons sent to each Justice previous to any Annual General or General Adjourned Session.

8.—That no Original Resolution or Amendment shall be put from the Chan-, unless the same shall be reduced to writing and seconded.

9.—That in case of any division, the names of the Justices

voting shall, upon the request of any two Justices present, be taken down in writing, and entered on the Proceedings of the Court.

10.—That whenever Amendments are made on Original Propositions, no second Amendment on an Original Question can be taken into consideration until the first Amendment is disposed of.

11.—That if a first Amendment be carried, it displaces the

Original Question, and becomes itself the question for considera¬

tion, whereupon any further Amendment may be moved.

12.—That if the first Amendment be negatived, then a second

may be moved to the Original Question under consideration; but

only one Amendment can be submitted to the Court for discussion at one time.

13.—That whenever the numbers for and against any Resolution or Amendment shall be equal, the Resolution or Amendment shall be considered as negatived.

14.—That after a Resolution or Amendment has been moved and seconded, the same shall not be withdrawn without leave of the Court.

15.—That the mover of every Original Resolution, but not of any Amendment, shall have a right to reply ; immediately after which the Question shall be put from the Chair; but that no other Justice be allowed to speak more than once on the same

Question, unless permission be given to explain, or the attention of the Chair be called to a point o,f order.

V.—The Committees of the Court.

1.— That at the first meeting of every Committee the first business shall be to choose a Chairman, and, if the Committee think proper, a Deputy Chairman ; and in the absence of the Chairman the Deputy Chairman shall preside ; and in the absence of both, a Chairman for that particular occasion shall be appointed.

2.—That (except as to Committees regulated by Act of Parliament, or when otherwise expressly ordered by the Court), three shall have power to act, and the majority present shall decide.

3.—That every Committee is authorised to take up all references by the Court to the preceding Committee which may not have been fully discharged.

4.—That all Committees to be appointed by the Court (except the Committee for General Purposes, and the General Finance Committee), shall cease and determine upon the bringing up of their Reports, unless specially ordered otherwise.

5.—That the several Committees of Visiting Justices be requested, before going out of office, to prepare a list of persons recommended by them to the Annual General Session as their successors. And that no motion for adding to such Visiting

Justices any new name not so recommended be allowed, unless the usual twenty-one days' notice of such motion shall have been

given.

1. GENERAL PURPOSES COMMITTEE.

1.—That a Committee for General Purposes shall be appointed at each Adjourned Court in September, and shall consist of the Chairman of the General Sessions, and six other Justices, and be a Standing Committee, to transact all business of a general character not specially referred to one or other of the Committees of the Court, with power from time to time to report to the Court.

2.—That all Officers and other persons who are entrusted with money, the property of the County, be required to find

security for the due administration thereof, in such sums as shall be determined from time to time by the General Finance Committee ; and that a Register be kept of the names of the

Officers, and of their Sureties, together with the amount of the

Security, and be submitted yearly to the General Purposes Committee, who shall take such measures in relation thereto as the circumstances may require.

3.—That it be an instruction to the Committee for General

Purposes, to cause to be laid before them at the opening of

every new Committee, yearly, a List of the several persons holding Appointments or Collectorships under this Court, and

giving Security in respect thereof, with the names of their several

Sureties, to the intent that the same may be then considered, and such order taken therein as to any accounts outstanding, and also of new Security or otherwise, as the existing circumstances may require.

2.—DISTRICT FINANCE COMMITTEES.

1.—That District Finance Committees be annually appointed at the Midsummer Quarter Sessions held at Lancaster, and at the

adjournments thereof held at Preston, Manchester, and Liverpool,

each Committee consisting of twelve Magistrates to examine into the Receipts and Expenditure of the several districts of the

County attached to each Quarter Session ; and to transact any other matters and business relative to the County Accounts which the Courts of Quarter Sessions may from time to time direct.

2.—That the before-mentioned Committees do respectively meet quarterly, and oftener, if necessary, for the purpose of

examining and allowing the Accounts, and giving orders on the

County Treasurer for payment of all Bills examined and allowed, and which are within their proper jurisdiction ; and also for the

purpose of preparing and submitting to the respective Courts of Quarter Sessions estimates of the probable expenses which will have to be provided for in each district for the ensuing quarter.

3. GENERAL FINANCE COMMITTEE.

1.—That at the Adjournment of every Annual General Session held in September, a General Finance Committee for the whole County be appointed, and that such General Committee do meet from time to time, so as to have the County Expenditure constantly under review. And that they do meet at Preston previous to the holding of the Annual General Session in June, every year, for the purpose of examining, auditing, and settling the Accounts of the County Treasurer, and all other Accounts relative to the County at large ; and of preparing and submitting to the Annual General Session Estimates of the probable expenses which will have to be provided for in the year ensuing ; and that for these purposes they be empowered to call to their aid the services of an accountant.

2.—That such General Finance Committee do consist of two Magistrates from each District Finance Committee, and that they have full power to require the attendance of all Officers of the County, with their Books and Papers ; and that such Committee do report on the Receipts and Expenditure of the County Rates,

for General Purposes, Lunatic Asylums, Constabulary, County and Hundred Bridges, &c, and on every other special matter, to the Court of Annual General Session.

4. CONSTABULARY COMMITTEE.

1.—That at the Court held be adjournment in September in

every year a Constabulary Committee be appointed to examine the Chief Constable's Accounts, and to afford him upon his application, authority in matters of detail and expense, and to audit and order

payment of such Accounts when so examined. That such Com¬ mittee be authorized to exercise an efficient control over both the

ordinary and extraordinary Expenses incurred from time to time

by the Chief Constable and by the Constables under his orders in the execution of their respective duties.

2.—That such Committee do consist of one Magistrate from each Police District of the County, with the addition of eight other

Magistrates resident in the neighbourhood of the Head Quarters of the Police Staff, and that they be requested to report from time to time to this Court.

3.—That not later than the 14th day of July in each year, all intended Applications for additional Constables for the ensuing year, be sent from the Magistrates of the various Petty Sessional

Divisions, to the Clerk of the Peace, for the consideration of the

Constabulary Committee, whose duty it shall be to examine and

report to the Court on the apparent necessity of the proposed additions.

4.—That any Application that Magistrates in their respective Petty Sessional Divisions may think necessary, from time to

time, under exceptional or urgent circumstances, to make, for additional Constables, be sent to the Clerk of the Peace, and that it shall be the duty of the Constabulary Committee to investigate and report to the Court what special circumstances, if any, appear

to them to require the immediate appointment of additional Constables, and the number required.

5.—That it shall be the duty of the Constabulary Committee to consider and report to the Adjourned Annual Session, in

September, what additional men, if any, including such as may be

reported to be required, under the preceding Standing Order No.

4, it will be necessary to appoint for the Police Service during the

ensuing year.

5. PARLIAMENTARY COMMITTEE.

1.—That a Committee be appointed to watch all Bills that

may be introduced into Parliament connected with the duties of

County Magistrates or relating to the interests of the County or

any portion thereof, which Committee shall be authorized in case of necessity to send a Deputation to wait on Government or other

parties for the purpose of suggesting such alterations as may be deemed expedient, and of opposing all Clauses which may be considered to be injurious to the general interests of the County.

2.—That such Committee be also directed to give its attention to all Parliamentary Committees of Enquiry and Royal Commissions on matters relating to County business.

6. MILITIA STOREHOUSE COMMITTEE.

1.—That a Committee be appointed to take into con¬ sideration every application respecting any Militia Storehouse provided or hereafter to be provided, and that such Committee do

report thereon before any grant of money be made by this Court for the purpose of any such storehouse.

2.—That such Committee shall have power, nevertheless, to authorize any necessary ordinary repairs and expenses relating to the Militia Storehouses, so far as the same shall be warranted by law, and to regulate and superintend all matters and things relating to the said Storehouses.

7. REFORMATORY AND INDUSTRIAL SCHOOLS COMMITTEE.

That a Committee be appointed and empowered from time to time to enter into agreements with the Directors or

Managers of any Reformatory or Industrial School or Schools, certified by the Secretary of State, for the reception and keeping in such school or schools from time to time of juveniles from the said County of Lancaster, sentenced to be detained in a

Reformatory or Industrial School, in consideration of such

periodical payments as may be agreed upon with such Directors or

Managers.

8. COUNTY ANALYST COMMITTEE.

That a Committee consisting of the Chairman and Vice- Chairman of the Court of Annual General Session, the Chairmen of the respective Courts of General Quarter Sessions and the General Finance Committee be appointed annually, for the purpose of

carrying into effect the provisions of "The Sale of Food and Drugs Act, 1875," and the Acts amending the same within the County Palatine of Lancaster.

9. COUNTY RATE COMMITTEE.

That a Committee be appointed from time to time to prepare a basis or standard for fair and equal County Rates, under the

provisions of the 15 and 16 Victoria, chapter 81, and that for this

purpose one Justice be selected from the Justices usually acting in each Petty Sessional Division.

10. COUNTY HIGHWAY COMMITTEE.

That a Committee be appointed annually for the purpose of carrying into effect the provisions of '' The Highway and Locomotives (Amendment) Act, 1878," within the County of Lancaster.

11. SPECIAL COMMITTEE ON PENSIONS TO ASYLUM

OFFICIALS.

1.—That a Committee be appointed by the Court, consisting of two Members from each of the Visiting Committees of the

Asylums, whose duty it shall be to consider every proposal for

granting a pension to any Superintendent, Chaplain, Clerk, Steward, or Clerk and Steward of any Asylum, and that the Report of the Committee thereupon shall be communicated to the Com¬ mittee of Visitors of the Asylum to which it relates before any such pension is finally determined.

2.—That instructions be issued to the Committees of Visitors of the several County Asylums requesting them to refer the pro¬ posals mentioned in the preceding paragraph to the Special Committee so appointed.

3.—That such Special Committee be appointed annually at the Session held by adjournment in December, and be a Standing Committee of the Court.

4.—That in all cases of existing appointments at the County Lunatic Asylums, when it is proposed to grant a Pension including the value of emoluments other than the salary—

The value of the lodgings, rations, and other allowances

enjoyed by a Superintendent shall be fixed at the sum of £220 per arjnum.

The value of similar allowances enjoyed by a Chaplain shall be fixed at the sum of £75 per annum.

The value of similar allowances enjoyed by a Matron or other officer or servant shall be fixed at a sum not exceeding in any case the sum of £50 per annum.

Provided that, where a special arrangement exists between a Committee of Visitors and an Officer, such Committee may, if

they think fit, add to the value so fixed as aforesaid such further sum as in their opinion adequately represents the value of such

special arrangement.

5.—That in all cases of future appointments at any of the

Asylums—

The Pension of the Superintendent and the Chaplain shall be based upon the salary alone, and no account shall be taken of the value of the lodgings, rations, or other allowances enjoyed by such Superintendent or Chaplain.

The Pension of a Matron and of all other Officers and servants shall be calculated upon the salary, and, if thought fit, upon the value of the rations and other allowances (except lodgings) enjoyed by the Matron or other Officer or servant, such value to be estimated on the same principle as is recommended to be adopted in the cases of existing Matrons and other Officers.

6.—That, whenever a Pension is granted by a Committee of

Visitors, a special report thereupon be presented'to the Court as a

subject of consideration before the motion for confirmation is made.

VI.—The Election of Officers.

1.—That whenever a vacancy shall happen in any office in the

appointment of the general body of the Justices, the same shall be notified to the Court by the Clerk of the Peace at the next Annual General Session or Adjournment thereof; and the Court shall have full power to make alterations in the duties and salaries of the officers upon the recommendation of the General Finance Committee or otherwise. The Clerk of the Peace shall also, immediately on a vacancy occurring, communicate with the General Finance Committee, and with the Committee specially charged to examine Testimonials and to report on the eligibility of Candidates for such vacant appointment; and if it shall appear that by reason of the period at which the vacancy occurred the instructions of the

Court thereon cannot be taken without causing delay detrimental to the County service, then, and in such case, the Clerk of the Peace shall have authority, under the direction of the General Finance Committee, to advertise for Candidates, notifying in the advertisement the recommendation of the General Finance Com¬ mittee as to salary, &c.

2.—That it be an instruction to the General Finance Com¬ mittee, on a vacancy occurring in any office in the appointment of the Justices of this County, to examine and report their opinion whether any and what alteration should be made in the duties and

salary of such office.

3.—That it be an instruction to the General Finance Com¬ mittee, on a vacancy occurring in the office of County Treasurer, County Auditor, County Surveyor or Bridgemaster, to examine the Testimonials and enquire into the qualifications of Candidates, and to report, with such remarks as they may think fit, the name or names of the Candidate or Candidates (not exceeding Five in

number) in their opinion most eligible for the vacant appointment.

4.—That it be an instruction to the County Constabulary Committee on any vacancy occurring in the office of Chief Constable, to examine the Testimonials and enquire into the Qualifications of Candidates, and to report, with such remarks as they may think fit, the name or names of the Candidate or Candi¬ dates (not exceeding Five in number) in their opinion most eligible for the vacant appointment.

5.—That all Testimonials, &c, of Candidates, be forwarded to the respective Committees, specially directed to enquire into the Qualifications of Candidates for the several appointments Twenty- one days as least before the day of Election.

6.—That printed copies of the Report of Committees, on the eligibility of Candidates, be sent by post to the Justices in whom the several appointments are vested, Seven days at least before the day of Election.

7.—That in all cases where Testimonials shall be required of the Candidates, the same shall be deposited with the Clerk of the Peace for the inspection of the Justices, Seven days at least before the day of election.

8.—That the Regulations for the Election of persons holding offices in the appointment of the Justices, when acting for the

County at large, shall be as follows :—

I.—The Election shall take place at the Court of Annual General Session, in Preston ;

II.—That in case of there being more than one Candidate, the Election shall be made by an absolute majority of the Justices voting ;

III.—In case of more than two candidates, if the first voting shall not produce an absolute mnjority, the Candidate lowest on the poll shall be struck off the list, and a fresh

voting shall take place—and so on till an absolute

majority of the Justices voting shall be obtained.

IV.—That the voting shall take place either viva voce or by ballot, as a majority of the Justices present shall decide.

V.—That in case of a final equality of Votes for two or more

Candidates, then the Election shall be declared void, and a day forthwith fixed for a new election.

VII.—The Clerk of the Peace.

1.—The Clerk of the Peace shall with the assistance of the

Deputy Clerks of the Peace, perform all the duties which are by law required to be performed by a Clerk of the Peace of a County.

2.—The Clerk of the Peace shall, with the assistance of the

Deputy Clerks, act as the clerk to the undermentioned standing Committees of the County, viz.—

The Clerk of the Peace shall also act as Clerk to any other Committee which may from time to time be appointed by the Courts of Annual General or General Quarter Sessions for the transaction of any special business.

3.—The Office of the Clerk of the Peace shall be at Preston, in the County of Lancaster, and unless prevented by sickness or other unavoidable cause the Clerk of the Peace or one of the

Deputy Clerks of the Peace shall be in daily attendance at the said office.

4.—An Office with all necessary accommodation for the due performance of his and their duties shall be provided for the Clerk of the Peace and the Deputy Clerks of the Peace, in the County Offices, at Preston.

5.—That, until otherwise ordered, one of the Deputy Clerks of the Peace shall live at Walton-le-Dale, in the said County, and the other of the said Deputy Clerks of the Peace shall live at Southport, in the said County.

6.—That the Clerk of the Peace shall, out of the salary to be paid to him, pay the salaries of the Deputy Clerks and Clerks employed by him, and all ordinary office expenses and dis¬ bursements.

VIII.—The County Solicitor.

1.—That a solicitor be appointed the County Solicitor and be paid by salary.

2.—That in consideration of such salary, the County Solicitor shall transact all legal business, of what nature and kind soever, connected with the County, other than that performed by the Clerk of the Peace, except Parliamentary and litigious business for which the usual professional charges may be made.

IX.—The County Treasurer.

1.—That the County Treasurer's Annual Accounts shall be made up from the first day of June, to the thirty-first day of May, both inclusive.

2.—That no person in the office of the Clerk of the Peace shall be employed, directly or indirectly, by the County Treasurer.

3.—That the County Treasurer do publish an abstract of the

County Accounts, as required by Act of Parliament, in such

newspapers as the Court has directed, or shall direct.

4.—That a salary be paid to the County Treasurer after the rate of £1,000 per annum, out of which he shall defray all ordinary travelling expenses incurred in the execution of his duties ; and that a further sum, not exceeding £560 per annum, be allowed to the County Treasurer for payment of the salaries of his clerks. That the County shall provide a suitable office and all Books and

Stationery.

5.—That the County Treasurer shall be required to find Sureties for the due performance of his duties, to the extent of

£10,000.

6.—That the County Treasurer shall adopt such a system of

Book-keeping as the General Finance Committee shall direct,

7.—That the County Treasurer be required to devote his whole time and attention to the duties of his office.

8.—That the County Treasurer shall, without any increase of

salary, act as Treasurer to every County Establishment, and in

every department of the County Expenditure, whenever called

upon so to do.

9.—That a copy of the Annual Book of Accounts be sent free of charge to the Chairman and also to the Clerk of each Board of Guardians within the County, for the information of the Board and the Ratepayers, when and so often as the said Book is distributed amongst the Magistrates.

10.—That the Printer of the Annual Book of Accounts be authorized to print copies, at his own cost and charge, for sale in addition to the number of copies ordered by the Clerk of the Peace.

Salary.

X.—The County Auditor. +

-That a County Auditor be appointed and be paid by

2.—That the duties of the Auditor shall be to audit the Accounts of all the County Establishments (except those of the County Treasurer), and to examine all accounts payable out of moneys raised by Rates and Orders in every depaitment of the County Expenditure, and all accounts of Fees, Fines, and Penalties, and other receipts in aid of Rates ; that he shall be accommodated in the County Offices, and act under the superin¬ tendence and direction of the General Finance Committee.

3.—That in addition to the above duties, the Auditor shall act as Clerk to the General and District Finance Committees.

4.—That the Auditor shall attend, for the examination of accounts, monthly, quarterly, or as circumstances may require, at each County Establishment, and at the various Petty Sessions,

and shall, as soon as possible, examine all Bills of Costs at

Quarter Sessions previous to payment.

5.—That the Auditor shall from time to time report to the

Visiting Justices of each Establishment, or to the General or District Finance Committees, as the case may be, and shall point out any irregularity of charge or payment, and suggest any alteration which he may think an improvement in the method of

keeping the accounts or economising the funds of the County.

6.—That the Auditor be precluded from undertaking the duties of any office unconnected with the business of the County,, without the express sanction of the General Finance Committee.

XL—The County Analyst.

1.—That the person appointed to be the County Analyst under the provisions of The Sale of Food and Drugs Act, 1875, shall not be employed as an analyst under the said Act for any other

County or for any other Borough or Place not within the County of Lancaster.

2.—That in addition to the duties imposed by the said Act,, the Analyst shall, whenever he is required so to do by any Rural

Sanitary Authority, analyse water used for drinking purposes.

That the Standing Orders of this Court be printed for the use of the Magistrates.
