3. Design-Build Team Organization & Qualifications

Design-Build Team Members:

The management structure and organization shall define how the Respondent will organize the

execution of the project and include the make-up of the team, the leadership of the team, the

accountability of the team leader and the lines of authority.

Our Design-Build Team has been assembled to designate KEYAH as the prime contracting entity

and Rogers/AEA Architects as a design subcontractor. The Star Charter School will be contract-

ing with KEYAH on this project with each firm providing the necessary documentation, such li-

censes and insurance and additionally, KEYAH will provide the payment and performance

bonds. The individual authorized to negotiate and contractually obligate KEYAH with the Star

Charter School in connection with this solicitation is Harry Y Singer, President of KEYAH.

The Design-Build Team offers extensive architectural, engineering and construction experience

where each firm has successfully designed, managed, and/or constructed projects of the same

magnitude or larger than the proposed project. AEA has been a leading designer and installer

of wind, solar and many other sustainable projects in Northern Arizona for many years. AEA has

experience with working within the guidelines of the Stimulus Recovery Act and KEYAH has

worked project with Davis-Bacon Act. Mark Rogers Architect has extensive architectural expe-

rience with over the 35 years of design experience with educational buildings, commercial

buildings, restaurants, tenant improvements and pre-engineered metal buildings. KEYAH and

Mark Rogers, AIA Architect, have previously worked on design-build projects with budget and

schedule constraints and have managed to satisfactorily complete the projects within budget

and on schedule.

Our proposed firms and key individuals to be assigned to this project are listed below and again

on the attached team organization chart. Note: All project correspondences will go through

KEYAH.

The next five pages are examples of design-build projects KEYAH completed

satisfactorily. Majority of the projects were either restrained by budget and/or time

and KEYAH managed to complete them successfully. Other examples of the four

used modular buildings we renovated are not included in the following five pages.

Design/Build the Havasu Landing Market: Havasu Lake, CA. Complete.

Statement of Qualifications Selection. GMP: $1,500,000. Date April 2008 to April 2009.

Design/Build turnkey 15,000SF new grocery store with parking lot, loading dock, interior

finishes, underground utilities, and grocery store equipment. This project had a budget

and schedule constraint and KEYAH performed to open a new Tribal Grocery Store. Co-

ordination with Owner was vital since the Owner had separate contracts with store

equipment, mechanical, electrical backup system, and security. Harry Singer, Project

Design-Build 5,700SF Urgent Care/Medical Records Building, Winslow, AZ - Complete

Statement of Qualifications. Contract Amount: $1,810,133. Date: Jun 2005 to Dec 2007

Design-Build 5,700SF Urgent Care/Medical Records Building. Design and construct a new 60’x80’

medical building adjoining to an operating Indian Hospital in Winslow, AZ. Design and construct

new parking with curb and gutter and entry road. Design and construction included demolition,

traffic control, foundation, underground utilities, footings, wood flooring system, tie-into existing hos-

pital with medical gases, HVAC, electrical, fire sprinklers, fire alarm system, nurse call system, interior

finishes, metal roofing, wood trusses, cabinetry, doors & windows, and 7 exam rooms. The new

medical building is operating. The contract was extended to renovate areas of the old building

after offices vacated their space to into the new facility. The renovated areas were the Old Medi-

cal Records area into a new Pharmacy and the Old Pharmacy area was converted into a new

consultation/patient registration area. The project also included expanding the existing parking lot

with 200 new parking spaces with lighting and signage. The project had a schedule constraint and

completed on time. Project designers were Stroh-Rogers Architect. Harry Singer, Project Manager;

Leo Tunney, Project Superintendent (day-to-day operations).

Design-Build 2,240SF Dilkon Dental Clinic.

Demolish the old existing structure including the flooring system and completely re-

constructed the building including exterior walls, roof, floor, and building interior

equipped the new Dental Clinic with 7 new dental stations.

Projects which received an award for construction excellence: RENOVATION OF THE HISTORICAL HUBBELL TRADING POST IN WINSLOW, AZ:

Keyah and Stroh-Rogers Architects were recognized for the Hubbell Trading Post pro-

ject when it received the 2009 Governor’s Heritage Preservation Honor Award for

recognition of excellence in historic and cultural preservation efforts in Arizona. The se-

lection was made by the Arizona Historic Preservation Office for the renovation of the

Hubbell Trading Post in Winslow, AZ. The 5,500SF building built in 1917 was renovated

and made it into a visitor’s center. The project was designed by Stroh-Rogers Archi-

tects, which is Mark F. Rogers and Doug Stroh. KEYAH performed the construction to

4. Design-Build Project Experience and Approach

KEYAH’S project approach and project understanding is shown in the following outline:

I. Understanding of Goals

The goal of this solicitation is to design and build a functional multipurpose building with classrooms

utilizing the $1.2 million budget before July 01, 2011. The goal of the project is to assess, plan,

design and construct in the most sustainable and cost effective in a timely fashion. The funding

associated with this project requires compliance and documentation with all provisions governing

funds on this project. An associated goal is to provide a quality, safe, and professional

construction on a fast-tracked basis.

II. Objectives

a. Our objectives for this SOQ is based on our understanding of the scope contained in the In-

structions to Offerors SQO#001 as prepared by G.V. Enterprises and Addendum #001 dated

11/18/2010.

III. Methods

a. Phase I: Assessment and Planning for Project and Site Conditions

i. Project conditions: Upon contract award and issuance of a Notice-To-Proceed, we will

submit the general conditions requirements as required by the contract documents.

ii. Professional assessments of existing site utilities, project access, conduct a topographic

survey in the development area. Identify any foreseeable problems or delays with the

work and/or materials procurement. Generate a project schedule for the design of the

project—planning for this project will be a prolonged process. Site utilities assessment will

include domestic water, fire line, electrical power, communication lines, LP gas lines, soils

report and wastewater lines. This phase of the project will determine the amount of work

as well as construction costs associated with connecting new utilities and systems to the

existing utilities. The results of this assessment may impact the projected costs and project

schedule. This assessment work will be coordinated with the Owner’s representatives. We

will look forward to the challenges associated with this project and will work the owner’s

representatives to minimize miscommunications. We will need as-builts and other pertinent

data from the owner to begin our discovery and exploration of underground utility lines

and determining the layout.

b. Phase II: Design and Engineering

i. This phase will utilize information from Phase I to generate the following project any of the

following plans: Civil, Site, Grading & Drainage, Underground Utility Plans.

ii. Detailed planning, designing, and interacting with the owner to generate the following

project plans: Architectural, Structural, Plumbing, Mechanical, Building Electrical, Civil

and Site, Communication Systems, Sustainable Systems.

iii. A detailed construction cost estimate that will representative of the final project plans will

be generated during this period, keeping in mind the $1.2 million available for this pro-

ject.

iv. Design reviews and design changes should take place in this phase.

v. At the end of this phase, we should have 100% - approved construction drawings.

a. Phase III: Mobilization, Implementation and Construction

i. Mobilization period will involve mobilizing equipment, personnel, tools, work sheds, setting up

field offices, hooking up temporary utilities, yard/lay-down area setup, and setting temporary

facilities (fence, dumpster, j-john).

ii. Implementation period will involve project planning, materials procurement, project and

contract administration, detailed project schedule, confirm the project costs and revise

estimate if necessary.

iii. The construction phase will begin from the time we start with site clearing and finish up with the

end-user occupying completely functional residential housing units. Expected completion is 12

months from the NTP.

b. Phase III Methods: Project Close-out and Warranty

i. Project walk-through

5. Key Individual Qualifications and Experience

The following are Key Individuals to be assigned to the project with their roles. The personnel listed below available to start and complete this project and give the attention it ensure timely completion within budget:

PRIME PROPOSER: KEYAH CONSTRUCTION: Project Manager is Harry Y. Singer, Construction Manag-er, will be the primary contact for the project contracting concerns and is the person authorized to contractually obligate KEYAH with the Star Charter School. Harry will direct the partnering efforts of the project and oversee the entire Design and Construction process and ensure that the project schedule, cost, quality and safety are being met. He will attend progress meetings and generate project estimates and authorize changes. THE CONSTRUCTOR: KEYAH CONSTRUCTION: General Superintendent is Leo Tunney, General Superin-tendent, Leo has over 20 years of construction experience in all facets of building construction (commercial and residential). Leo will be the onsite contact for the day-to-day operations. He will coordinate vendors, subcontractors, inspectors, and manage any field problems that may arise. Leo has extensive experience with construction supervision work. THE ARCHITECT: ROGERS/AEA ARCHITECTS: Design Manager is Mark F. Rogers, as design manager Mark will work closely with all design consultants and coordinate the entire design process. Mark will attend all design review meetings and if there are changes he will initiate the proper changes to plans. He will be the contact for all design questions and issues. DESIGN CONSULTANT: ROGERS/AEA ARCHITECTS: Sustainable System Manager is Carl C. Ramsey, will closely with Mark Rogers since the two design firms have formed a Joint Venture, which allows the D-B team access to highly qualified individual to explore and access the wind and solar and sustaina-ble concept the Star School has adopted. The resources and knowledge available from these two reputable architects with years of experience can offer suggestions to the school and the D-B Team. AEA, Inc. has two other highly regarded engineers who will be assigned to assist Mr. Ramsey on this project and they are Mr. Wayne Hellwig, LEED-AP and Ms. Catherine Garrison, Registered Architect. The personnel to work on this project as part of our D-B Team is highly regarded and makes our pro-ject team highly capable to handle any challenges and concerns that this project may offer. DESIGN CONSULTANT: Mountain High Engineering, LLC: Electrical Engineer is Frank Patton, Jr. Mr. Patton has worked on numerous projects with AEA, Inc. and has worked with designing electrical ser-vices for sustainable, wind and solar powered facilities. Mr. Patton will be the contact to for the elec-trical design of the project. DESIGN CONSULTANT: Case Engineering, Inc.: Mechanical Engineer is Richard D. Chase. Mr. Chase has worked on numerous projects with AEA, Inc. and has worked with designing mechanical and plumbing systems for sustainable, wind and solar powered facilities. Mr. Chase will be the contact for all Mechanical and Plumbing design of the project. DESIGN CONSULTANT: A.E.C. Consultants, Inc.: Civil Engineer is David Hall. Mr. Hall has worked on number projects with KEYAH on and off the Indian Reservations. Mr. Hall will be the contact for the civil design that includes the earthwork and site planning and underground utilities. SAFETY DIRECTOR: Performance Safety: KEYAH’S Safety Director is Stephen C. Healey. KEYAH takes Construction Safety extremely seriously and has maintained Mr. Healey as the firm’s Safety Director. KEYAH employees are OSHA Safety Card Holders with Mr. Healey at a phone call away if there are any questions. Mr. Healey gives the company annual safety courses to all KEYAH employees and the awareness of safety in the workplace is KEYAH’S upmost concern.

OTHER CONSULTANTS: Various Designers and Engineers. Unfortunately we just don’t have enough pages to list all the members of our project team. Those who will play a vital role on this project are listed on Design-Build Team Members and Organization Structure of this SOQ. We have resumes and qualifications/experience credentials on all of our team members and we cannot fit all the su-perb work these have done in this SOQ. We are more than willing to provide the records on qualifi-cations and experience if requested.

KEYAH has resources available to assign to the project to meet the proposed workload and sched-ule. The following personnel are immediately available to start and complete this project:

Sterling Spencer, (KEYAH), Field Superintendent, Sterling has over 30 years of drywall experience in commercial and residential construction. Sterling will be the superintendent during drywall installa-tion. Terry Singer, (KEYAH), Project Engineer, Terry has over 10 years experience working on earthwork, underground utilities, and building construction, as well as, taking project management courses over the last 2 years. Derrick Lanza, (KEYAH), Building Superintendent, Derrick has over 15 years experience of carpentry work on commercial and residential buildings including work on the Flagstaff Medical Center. Thom Curleyhair, (KEYAH), Thom has worked on earthwork projects for over 30 years. Perry Singer, (KEYAH) Forman, Perry works on all facets of building, earthwork, underground. Perry is an all-around tradesman. Albert Singer, (KEYAH) Operator, Albert is a CDL driver and operator on most heavy equipment. His specialty is grading and earthwork. KEYAH is 100% Navajo-Owned with 100% Navajo workforce. In the eight years we have been in busi-ness we have specifically targeted work on the Indian Reservations and we have realized there are a lot of talented and skilled workers, who want a chance to prove their skills and willing to work. We have had many opportunities to work in various communities and we have discovered some great workers and workforce to draw from on our projects. This project will be no different we will bring our core workers and complement them with the local labor force. In our subcontracts, we have specifically state that local workforce will be given first considerations in hiring. Resumes on the following pages:

6. Budget and Schedule Compliance Experience

Schedule Control KEYAH uses SureTrak Project Manager to establish and track design and construction schedules

on a Critical Path Method. If selected KEYAH will develop a detailed schedule and communi-

cate with the Owner’s Representative, whom we will keep in close contact with our general su-

perintendent for the duration of the project. Harry Y Singer will be monitoring the overall project

schedule. Harry has experience with P3, Primavera Contractor, Expedition and SureTrak comput-

erized scheduling and project management systems. P3 experience was through the Arizona

State University’s School of Construction scheduling courses and during his work with SundtCorp

as a project engineer on multi-million dollar projects.

A detailed construction schedule and timeline will be generated after the final plans are com-

plete. The timeline may vary due to the complexity of the systems to be installed or constructed.

1. Design-Build of a 15,000SF Havasu Landing Market and parking lot. On this project the origi-

nal completion date was 04/01/2009 and we completed the project with a Temporary CofO

on 04/04/2009.

2. Design-Build of the 6,500SF Winslow Urgent Care/Medical Records Building and parking lot.

The project was on a Fast-tracked since the project was in the midst of a fully functioning

hospital. There were restrictions with pedestrians and vehicle traffic in a highly visible area.

We worked closely with the Hospital, who ordered equipment and furnishing to coincide with

our construction schedule and everything worked out very well.

3. To ensure timely completion we will select local subcontractors who have worked well with us

on past projects and that we have a history of quality workmanship. We anticipate that most

of the subcontractors to have work on this project have worked as project team members on

other projects and they are reliable and do whatever it takes to do the job right.

KEYAH has been in the construction business since 2003 and has specialized in commercial

buildings construction, as well as, heavy highway work. We feel we have an excellent under-

standing of the entire project construction process since we have completed numerous

design/build projects. Our understanding is the entire project process allows us to be proac-

tive and stress pre-planning on the budget, schedule, workmanship and safety. The key per-

sonnel to be assigned to this project have been with the company since its beginning.

KEYAH has the bonding capacity to perform projects up to $4 million.

7. Ability of Team to Service the Project

Our project team is committed to delivering a quality project by utilizing local designers, engi-

neers, consultants and subcontractors on our Design-Build Team. With the project being in

close proximity, to many of our D-B Team we do not anticipate any delay issues with servicing

this project. Our D-B Team is available and eager to begin this project.

KEYAH has the Prime Proposer will have the General Superintendent, Mr. Leo Tunney and Pro-

ject Engineer, Terry Singer, readily available to be onsite on short notice and all of our team will

be accessible by telephone at any time. Leo will maintain a constant presence on the Star

School Property once the design and construction are in progress. During the design phase

we will have at least 30-60-90 percent design review meetings and if there is a need for an in-

termediate meeting that can be arranged since most of the key members are within a 30 mi-

nute drive from the site. Once the project begins we will provide the Owner’s Representative

and all team members with a list of contact phone numbers and emails, should there ever be

a need to get a hold of someone immediately. For the warranty period, we will provide the

Owner with O&M Manuals for product and/or system warranties at the completion of the pro-

ject.

Since there is a downturn in the construction industry, KEYAH has staff and resources to assign

to this project. KEYAH projects are attached on the following pages. The situation is similar

with just about everyone on our design-build team. There is a shared commitment with Design

-Build Team that if selected we will make time to ensure that this project moves forward as

quickly as possible.

This is a statement is a confirmation that all Design-Team Member is properly licensed and/or

registered to perform the tasks the will be assigned to do and all have done similar work on

other projects. All of our team members have had other work before this one and we do have

any untested team member.

With regard to financial capability, please see the attached statement from our bonding com-

pany with a $4 million dollar bonding line. KEYAH provides the Surety company with financial

statements on a regular basis, which the Surety uses to establish bonding line. Our insurance

company has also provided a letter of showing our coverage. In addition, we have attached

the reviewed financial statements from December 2009
