Revisions adding Face Covering (Mask) Requirements to: Regulation GBGB-R, Staff Personal Security & Safety and Exhibit GBGB-E; Regulation JICA-RB, Student Dress; and Regulation KI-RB, Visitors to Schools

BACKGROUND:

The Governing Board reviewed the above regulations and exhibit at its meeting on August 18, 2020. At that time, the Governing Board requested one addition, to Regulation JICA-RB, Student Dress. The Board requested the addition of language to JICA-RB, explaining how students/families may request a reasonable accommodation to the face covering requirement. Further, the Governing Board directed Administration to bring back the regulations and exhibit as an information discussion item, for review of the final language. The only changes to the previously recommended revisions are to Regulation JICA-RB, as requested by the Governing Board at the August 18, 2020 meeting. Administration has added the following recommended language to JICA-RB: Families/Students who need a reasonable accommodation for the face covering requirement should contact your school Administrator or School Nurse.

COVID-19 Liability Coverage Endorsement

RECOMMENDATION: It is recommended that the Governing Board authorize the District to Purchase additional COVID-19 Liability Coverage for $150,000. Self-Insurance Trust Board approved on 8-20-2020 at the Self-Insurance Trust Board Meeting. BACKGROUND:

On August 4, 2020, the Arizona Risk Retention Trust Board approved a COVID-19 Liability Coverage Endorsement. If purchased, this endorsement will provide liability insurance in the case of a COVID-19 claim. If agreed upon prior to Sept. 15, 2020, the coverage will be retroactive to July 1, 2020. The coverage includes up to $1 million per each occurrence, including defense costs and indemnity payment, with a limit of $2 million per annual aggregate per District. The maximum annual aggregate for all District, including defense costs and indemnity is $25 million. The deductibles are as follows per occurrence.

$0 if the District has a signed Waiver, Release, and Assumption of Risk Form

$10,000 if the District has a signed Acknowledgment and Disclosure Form

$20,000 if there is no Waiver or Acknowledgement form.

The District must follow condition for the coverage to apply under this Endorsement.

The District must utilize a parent/guardian Acknowledgement and Disclosure Form or Waiver, Release, and Assumption of Risk Form relating to the COVID-19 virus, in a form approved by the Trust, for all on-site students.

The District makes a good faith effort to implement a reopening plan that incorporates applicable guide-lines issued by the Arizona Department of Education (ADE) for K-12 District, and Centers for Disease Control and Prevention (CDC) for community College Districts.

Except as modified by the Endorsement, this coverage is subject to all provisions, exclusions, defini-tions, terms, and conditions of the Appendix to which this Endorsement is attached.

RECOMMENDATION:

It is recommended that the Governing Board approve an amendment to the Kairos agreement, allowing the District to maintain employee benefits in the case of furlough due to COVID-19, if the District chooses to do so. Self-Insurance Trust Board approved on 8-20-2020 at the Self-Insurance Trust Board Meeting. BACKGROUND:

Under the current Kairos agreement, if employees were to be furloughed due to COVID-19, the employee would have to be termed and sent to COBRA to continue medical coverage. The agreement does not define furlough or the length of furlough, that is a District decision. In addition, the District is not recommending furloughing employees and has been working to find meaningful employment for all employees. This amendment would allow the District to continue medical coverage for furloughed employees due to COVID-19, if at some point this year a decision was made to furlough employees. Any decision to furlough employees would be an Action item for the Governing Board and would at that time define the furlough, the continuation of medical coverage, and if the District were to continue to pay medical coverage or not.

RECOMMENDATION:

It is recommended that the Governing Board authorize the District to apply for the Enrollment Stabilization Grant through the State of Arizona.

BACKGROUND: On June 24, 2020, Governor Ducey announced that he would help schools through the COVID-19 pandemic with additional funding. The Enrollment Stabilization Grant Program is offered to school districts within Arizona to help offset the cost of the COVID-19 pandemic. School districts will receive a one-time formula award based on the greater of 105% of the schools 2020-2021 40th-day weighted Average Daily Membership or 98% of actual 2019-2020 weighted Average Daily Membership. The amount awarded based off Average Daily Membership is used to offset COVID-19 related expenses incurred between March 1, 2020 and December 4, 2020. Applications must be submitted by September 4, 2020. Final award amounts we be announced after the 40th-day of instruction for the school district.

Approve Metrics for Performance Goals for the SUSD General Counsel for the 2020-2021 School Year

RECOMMENDATION:

It is recommended that the Governing Board approve the metrics for the General Counsel’s performance goals for the 2020-21 school year, as follows:

1. Update Governing Board Policy Manual for compliance, and to align Governing Board Policies with District Core Purpose, Values, Business Definition, Strategic Anchors and Thematic Goal. The current proposed focus will be on Covid-19-related policies, employee evaluations, and diversity, equity, and inclusion. These areas align with the District’s Thematic Goal of enhancing a culture of learning, because they center on equity, inclusion, accountability, and staff and student safety. Objectives and Key Results:

Updated policies, approved by the Governing Board, in the areas identified above.

2. Lead efforts to promote compliance and reduce liability to the District, with particular focus in the areas of Special Education and Human Resources, including investigations and evaluations. This goal aligns with the Strategic Anchor of accountability, the Core Purpose of ensuring all individual learners reach their full potential, Core Values of being responsive, growth-minded, and student-focused, and the Business Definition of “we educate.” Objectives and Key Results:

Identify measures, such as complaints, hearings, and findings, that the District can use to measure how we are performing as a District in these areas.

3. Contract management: Improve the process for contract review and approval requests by

developing workflows, possibly adding software, and educating employees how to use the

process. This goal aligns with the Core Value of being responsive and student-focused, and

the Strategic Anchor of accountability.

Objectives and Key Results:

Establish baseline data showing length of time between contract submission and approvals, for the purpose of improving efficiency.

Determine whether a contract management software will assist with efficiency. If so, procure the software and train employees on how to use it.

Develop contract management workflows, and train employees on the processes.

BACKGROUND:

Policy BDG, School Attorney, as revised by the Governing Board at its public meeting dated June 23, 2020, states the General Counsel performance goals shall be determined by June 30 each year. At its June 23, 2020 meeting, the Board approved postponing the deadline for establishment of the 2020-21 performance goals until August 4, 2020. This postponement was to allow the District’s new Superintendent, Dr. Scott Menzel, to meet with the General Counsel to develop goals. Dr. Menzel met with the General Counsel to develop the goals proposed above, and it is recommended the Board approve the 2020-21 General Counsel performance goals, as presented. On August 4, 2020, the Governing Board approved the 2020-21 performance goals of the General Counsel. During the August 4, 2020 meeting, the Board requested an Action item for the September 1, 2020 Board meeting, to review and approve metrics associated with the approved goals.

It is recommended that the Governing Board approve the primary goals for the SUSD Superintendent for the 2020-21 school year, as follows:

1. Support a culture of high expectations for all students and staff in order to ensure each student is able to reach his/her full potential during and following the COVID Pandemic environment.

2. Initiate the process of long-range planning by December 31, 2020 to develop Scottsdale Unified

into the most impactful district in the country.

3. Identify and address financial challenges and opportunities to support the core purpose and direction of Scottsdale Unified School District.

BACKGROUND:

As part of the contract with McPherson and Jacobson, Dr. Steve Joel facilitated a workshop with the Governing Board and superintendent to discuss initial goals for the first year on August 13, 2020. This conversation included identifying a range of suggestions from the Governing Board members for possible goals. These were then distilled down to three broad goals as recommended above. Pursuant to Board Policy CBI, the superintendent will provide a copy of the evaluation instrument for his performance no later than November 10th each year. Additionally, pursuant to section 3.D. of the Superintendent’s Contract, the Governing Board will meet with the superintendent by October 31, 2020 to develop a performance-based pay plan. Specific objectives and key results will be developed and provided to the board for consideration no later than 10/30/2020 for final approval.

Approve Return to Learn Hybrid Plan

RECOMMENDATION:

The Return to Learn sub-committee will present a recommendation to Scottsdale Unified School District Governing Board Members to consider a phased approach to reopening beginning September 8th for prioritized groups of students if the Arizona Department of Health Services metrics supports a return to in-person learning within a hybrid model.

BACKGROUND:

The Governing Board voted on August 18, 2020 to use the Arizona Department of Public Health (AzDHS) metrics as the framing for when SUSD students can begin to return to learn in person. By adopting the AzDHS metrics and committing to identifying hybrid options and/or a phased in approach to returning to in-person instruction, the Governing Board signaled that they are committed to both using data to inform decisions to ensure the health, safety, and wellbeing of our students and staff as well as recognizing that we need to proceed with in person instruction as soon as the metrics allow us to move in that direction. Maricopa County Department of Public Health updates their data dashboard weekly. The data can be viewed at the county, city, school district and zip code level. SUSD has chosen to use zip code data because that is the best data available to capture our currently enrolled students. The fifteen zip codes each contain at least 1% of our total population and represent 92.5% of our total enrollment. The metrics now support our ability to consider a phased approach for returning to learn within a hybrid framework, which will be presented to board members for their consideration.
