It was agreed in terms of Section 50A(4) of the Local Government (Scotland) Act 1973, that the public be excluded from the meeting for the following items on the grounds that the business involved the likely disclosure of exempt information as defined in paragraph I of Part I of Schedule 7A of the Act. DISESTABLISHMENT OF LANARKSHIRE COMMUNITY JUSTICE AUTHORITY (LCJA) 2. There was submitted a report dated 1 April 2016 by the Personnel Adviser to LCJA (1) providing (a) information on the Scottish Ministers Single Proposed National Severance Scheme which will apply to employees of the LCJA who will be impacted by the disestablishment of the authority on 31 March 2017, and (b) an update on the timescales for action provided by the Scottish Government for the acceptance and implementation of the Scheme; (2) detailing the background relative thereto; (3) setting out the current position together with an overview of the impact of the Scottish Government proposals, and (4) recommending that the CJA consider and accept the Scottish Government's proposed Scheme for the CJA employees, with a view to widening employee choice with regard to early release and to ensure parity with other CJA employees. Decided: (1) that the Community Justice Authority accept the Scottish Government's proposed Scheme for CJA employees, and (2) that authority be delegated to the Personnel Adviser to the CJA to commence negotiations with the employees concerned.

2. The Minute of the meeting of Lanarkshire Community Justice Authority held on 11 March 2016 wassubmitted and noted.

CHIEF OFFICER UPDATE

3. There was submitted a report dated 10 June 2016 by the Chief Officer (1) providing an update onlocal and national developments relevant to the Community Justice Authority; (2) advising (a) that thefirst issue of the Scottish Government's newsletter regarding the new model for Community Justicewas issued in April 2016, as detailed within the Appendix to the report, and (b) that developmentshighlighted in the newsletter included information about the transition event held on 18 April at COSLAand attended by CJAs and local justice partners, information about transitional funding and an updatethat the closing date for applications for the Chair of Community Justice Scotland being 15 April; (3)indicating (a) that an Electronic Monitoring in Scotland Working Group had been established toexplore opportunities around the future use of electronic monitoring and to report to the CabinetSecretary, and (b) that local events were being held to provide the Scottish Government officials andthe Working Group members with an opportunity to engage with key stakeholders eg. Criminal JusticeSocial Work, Third Sector and Sheriffs on the future policy direction at an early stage in itsdevelopment; (4) confirming (a) that, on behalf of the Scottish Government and the Scottish Prison

Service, the CJA had facilitated a half day information session during May, designed to inform partneragencies of the progress on the Womens Custodial Estate and to contribute to a discussion regardingthe future, and (b) that the future of Custodial Estate was one of the recommendations from theCommission of Women Offenders and should be seen in the wider context of the full list ofrecommendations contained in Dame Angiolini's report, as detailed in the Scottish Government'sannual progress report appended to this report.

Tony McNulty spoke to the report following which the Board agreed that the report be noted.

RESILIANCE PLANNING − LANARKSHIRE CJA AND TRANSITIONS

There was submitted a report dated 10 June 2016 by the Chief Officer (1) seeking approval for theResilience Plan and Dis−establishment Plan, as contained with the Appendix to the report, in relationto the design of Community Justice and Transition to the new arrangements, and (2) advising (a) thatthe Resilience Plan focuses on the ability of the CJA to meet its statutory obligations until 31 March2017, including facilitating the transition to the new model and to ensure that the rights of CJA staffwere being looked after, and (b) that the Dis−establishment Plan lists the activities required to beundertaken between now and 31 March 2017 in order that the CJA is successfully dis−established andmeets all statutory obligations, including audit requirements.

Tony McNulty was heard in further explanation of the report.

Decided: that the Resilience Plan and Dis−establishment Plan, as contained within the Appendixto the report, be approved and noted.

PLANNING AND DEVELOPMENT ADVISER UPDATE

There was submitted a report dated 10 June 2016 by the Planning and Development Adviser (1)providing an update on Lanarkshire CJA Draft Annual Report and Lanarkshire CJA PerformanceFramework; (2) advising (a) that Lanarkshire CJA had requested information from partners forinclusion in the Annual Report for the period April 2015 to March 2016 with a deadline of 31 May2016, and (b) that a draft of the Annual Report would be issued during July for the purposes ofconsulting with the Board and partners and thereafter submitted to the Board in September forapproval and onward transmission to the Scottish Government by the due timescales; (3) indicatingthat the performance framework contained data provided by partners which reflected the offender'sjourney through Justice Services and progress against agreed objectives, as detailed within theAppendix to the report, and (4) summarising the key points from local performance.

Roberta Reid spoke to the report following which the Board agreed that the report be noted.

FINANCE UPDATE

6. There was submitted a report dated 10 June 2016 by the Financial Adviser to the CJA on theperformance of the Section 27 Budget and the Administrative Budget for 2015/16 (1) informing theBoard (a) that this was the fourth Section 27 Budget Monitoring Report presented for the financialyear 2015/16; (b) that although the final outturn was not yet available, it was anticipated that thespend would exceed the grant allocation, and (c) that the final outturn would be presented to theBoard in 2017, once the accounts had been laid before Parliament; (2) advising that during the lastquarter of the financial year, an additional allocation of £17,720 had been agreed with the ScottishGovernment in respect of the pension fund deficit and an increase in employers contribution to thepension scheme, resulting in the administration grant being increased to £236,780, and (3) reportingthat as at 31 March 2016, the final position was an underspend of £553.

QUARTERLY COMMUNITY PAY−BACK ORDER − SOUTH LANARKSHIRE COUNCIL

7. There was submitted a report dated May 2016 by the Operations Manager, Unpaid Work Service,South Lanarkshire Council, updating the Board on the work carried out by Community Payback inSouth Lanarkshire (1) advising that during the period from 1 January to 31 March 2016, there hadbeen a total of 200 Community Pay−Back Orders and 24,726 hours of Community Pay−Back duringthe period; (2) indicating that 109 new referrals to unpaid work had been received through theCouncil's on−line referral system during that period; (3) providing a summary of the number of projectsundertaken, and (4) highlighting comments of appreciation which had been received from a number ofgroups and individuals thanking the Service for its excellent work.

Thereon, Santosh Dade spoke to the report following which the report was noted.

QUARTERLY COMMUNITY PAY−BACK ORDER − NORTH LANARKSHIRE COUNCIL

8. There was submitted a report dated 10 June 2016 by the Service Manager, Restorative Justice,updating the Board on the work carried out by Community Pay−Back in North Lanarkshire (1) advisingthat during the period from 1 January to 31 March 2016, a total of 3,601 placements were available formale and female service users subject to an unpaid work order; (2) indicating that a total of 27,996hours of environmental work on Community Pay−Back projects through North Lanarkshirecommunities were carried out; (3) providing a summary of the number of projects undertaken, and (4)highlighting comments of appreciation which had been received from a number of groups andindividuals thanking the Service for its excellent work.

Thereon the Board noted the report.

4. There was submitted a report dated 9 September 2016 by the Chief Officer seeking approval of thedraft Information Management Plan in relation to the redesign of Community Justice and transition tothe new arrangements, as detailed within the Appendix to the report.

PLANNING AND DEVELOPMENT ADVISER UPDATE

There was submitted a report dated 9 September 2016 by the Planning and Development Adviserproviding (1) an update on the Draft Lanarkshire CJA Annual Report 2015/16, as detailed within theAppendix to the report, and (2) details thereon.

Thereon, Roberta Reid spoke to the report.

FINAL CJA REPORT 2016/17

There was submitted a report dated 9 September 2016 by the Planning and Development Adviseradvising (1) that the Scottish Government had requested that CJAs submit a short final report whichidentifies good practice, lessons learned, examples of shared services, effective partnership inrelation to delivering Community Justice outcomes and effective transition to the new model forCommunity Justice; (2) that the deadline for providing the report was the end of January 2017, andthat the report would provide an update from 1 April to 1 December 2016 only, and (3) that theconviction rate data would not be available until approximately May 2017, therefore it would not bepossible to provide information on that topic although partial information through the localperformance framework and key indicators would be provided.

FINANCE UPDATE

7. There was submitted a report dated 9 September 2016 by the Financial Adviser to the CJA on theperformance of the Section 27 Budget and the Administrative Budget for 2016/17 (1) informing theBoard (a) that this was the first Section 27 Budget Monitoring Report presented for the financial year2016/17, and (b) that as of 30 June 2016 a break even position was forecast to 31 March 2017, asdetailed in the Appendix to the report, and (2) advising (a) that, in respect of the AdministrationBudget, this was the first Administration Budget Monitoring Report presented to the CJA Board for thefinancial year 2016/17, as detailed in Appendix B of the report, and (b) that at 30 June 2016, anoverspend of £1,779 was reported, however, it was forecast that the budget would break even by31 March 2017.

ADDITIONAL ALLOCATION FOR COMMUNITY SENTENCES

8. There was submitted a report dated 9 September 2016 by South Lanarkshire Council (1) advising ofthe additional allocation of £595,105 for the community sentences during 2016/17; (2) detailing thebackground relative thereto, and (3) setting out a summary of how these funds would be utilised.

9. With reference to the preceding paragraph, there was submitted a report dated 9 September 2016 byNorth Lanarkshire Council advising of the same allocation of funding and setting out a summary ofhow these funds would be utilised.

QUARTERLY COMMUNITY PAY−BACK ORDER − SOUTH LANARKSHIRE COUNCIL

10. There was submitted a report dated 9 September 2016 by the Operations Manager, SouthLanarkshire Council, updating the Board on the work carried out by Community Pay−back in SouthLanarkshire (1) advising that during the period from 1 April to 30 June 2016 there had been a total of183 Community Pay−back Orders and 23,246 hours of Community Pay−back during the period; (2)indicating that 109 new referrals to unpaid work had been received through the Council's onlinereferral system during that period; (3) providing a summary of the number of projects undertaken, and(4) highlighting comments of appreciation which had been received from a number of groups andindividuals thanking the service for its excellent work.

11. There was submitted a report dated 9 June 2016 by the Service Manager, Restorative Justice, NorthLanarkshire Council updating the Board on the work carried out by Community Pay−back in NorthLanarkshire (1) advising that during the period from 1 April to 30 June 2016 a total of 7,222placements were available for male and female service users subject to an Unpaid Work Order; (2)indicating that a total of 26,977 hours of environmental work on Community Pay−back projects throughNorth Lanarkshire communities were carried out; (3) providing a summary of the number of projectsundertaken, and (4) highlighting comments of appreciation which had been received from a number ofgroups and individuals thanking the service for its excellent work.
