Dutch legislation: Waterwet: Surface Waters Pollution Act (2009)

– No discharge allowed without a permit (general rule)– You request for permission to discharge wastewater.(permit)

• The assessment of the factory and the sewage system with regard to the Best Available Techniques (BAT) – BAT is described in the IPPC-

documentation.• The assessment of the residual

emissions with the Immission Test.

How is this reflected to EMO?

– Emo is no IPPC company.

– There is still the obligation to have a permit

AMvB Guidelines

• General guidelines for a group of companies with the same discharges to the environment or a specific sort of wastewater discharge.

• Examples for the discharge of wastewater are:– Handling and storage of solids.– Domestic wastewater– Rainwater– Small heat discharges from cooling systems

Why general guidelines?

About 130 companies in the Netherlands for which the handling and storage of solids is the core business.

AMvB

To regulate a group with the same wastewater discharges we need requirements with give the room to operate a business but also protect the environment.

Therefore the AMvB consists of 2 types of regulations:

– Discharge requirements for the wastewater.

– Good-housekeeping.

Conclusion

Why should we do it?• Less bureaucratise than a normal permit.• Uniform guidelines. • BAT is defined, no discussion.

Potential risk.• No immediate control.• Less local considerations.• No citizen participation.
