Act and RegulationsTheEmployees’SocialSecurityAct1969(Act4)andtheEmployees’Social Security (General) Regulations 1971 are applicable to allindustrieshavingoneormoreemployees.
EmployerEmployeraredividedintotwocategories,namelyprincipalemployer
andimmediateemployer.
Principal Employer
Principalemployersareemployerswhoengageemployeesdirectlyunderacontractofserviceorapprenticeship.Allmattersconcerningservices and payment of wages are managed by the principalemployer.
Immediate Employer
Immediate Employer are employers who engage employees andcarryoutworksunder thesupervisionofprincipal employer.Thisincludesapersonwhohasentereda contract of servicewith anemployeeandtemporarilylendsorleaseouttheserviceofthesaidemployeetoaprincipalemployer.
Responsibility of Employers
Principal and immediate employers who employ one or moreemployees are responsible to register and pay contributions toSOCSO.
The principal employers are also accountable to ensure theregistration and payment of contributions for all employeesemployedbytheimmediateemployer.
The employer is obliged to report all work related accident thatbefallstheirworkerswithin48hoursofnotification.

Registration of New Employer and Employee
NewemployerandemployeemustberegisteredwithSOCSOnotlater than 30 days on which the Act becomes applicable to theindustry.Forthepurposeofregistration,anemployerisrequiredtocompletetheEmployer’sRegistrationForm(Form1)andEmployee’sRegistrationForm(Form2)throughSOCSO’sASSISTPortal.
Cessation of Being An Employer
Any employer who ceases to be an employer (active employerwithout employee, employer temporarily closed and cease ofindustry)shallsubmitanapplicationthroughSOCSO’sASSISTPortalbyuploadingForm 1A togetherwiththerelevantdocumentswithin30daysfromofsuchcessation.
Employee’s Record
Employersshallupdateandkeepa recordofemployeeswith thefollowingdetailsforeachemployee:
• Name• NationalRegistrationIdentityCardnumber• Occupation• Contributiondetails• Monthlywages• Allowances
Theemployee’srecordshallbemaintainedfor7yearsfromlastentrydate.

Employee’s Eligibility
All employee who are employed under a contract of service orapprenticeshipintheprivatesectororcontractual/temporarystaffofFederal/StateGovernmentaswellasFederal/StateStatutoryBodiesneedtoregisterandcontributetoSOCSO.EmployeeswhoareexemptedfromcoverageundertheEmployees’SocialSecurityAct1969are:
• Federal and State Government permanentemployees
• Domesticservants• Self-employed• Soleproprietororownersofpartnership
Note:Witheffectfrom1July2018,thespouse/sofsoleproprietororownersofpartnershipwhoworkwith the saidemployer compulsory to register andcontributetoSOCSO.
Definition of WagesAll remuneration payable in money to an employee is taken aswages for purposes of SOCSO contributions. This includes thefollowingpayments:
i. Salary/wageii. Overtimepaymentsiii. Commissionandservicechargeiv. Payments for leave; such as annual, sick,maternity, rest
day,publicholidaysandetcv. Allowancessuchas incentives, shift, food /meal, costof
living,housingandetc

All the payments mentioned, which are paid to the employeeswhetheraccording tohours,days,weeks,monthsorpiece rated/taskratedareconsideredaswages.
Howeverthefollowingpaymentsarenotconsideredaswages:
i.Paymentsbyanemployertoanystatutoryfundforemployeesii.Travellingclaimsiii.Gratuitypaymentsorpaymentsfordismissalorretrenchmentsiv.Annualbonus

ContributionsEmployers shall pay a monthly contribution for each eligibleemployee according to the rates specified under the Act. Thesecontributionsaredividedintotwocategories:
Contribution of First Category
Foremployeeslessthan60yearsofage,contributionshallbepaidby the employer and employee for protection under EmploymentInjurySchemeandtheInvalidityScheme.
Theratesofcontributionunderthiscategorycomprisesof1.75%employer’sshareand0.5%employee’ssharefromtheemployee’sassumedmonthlywages (referScheduleRatesofContribution inpages33to35)
Note: Contribution for employeeswho have yet to reach the age of 60 yearsshallbeunderthefirstcategoryexcept foremployeeswhohavereachedtheageof55yearsandnocontributionshavebeenpreviouslypaidshallcontributeundersecondcategory.

Contribution of Second Category
Contributions for employees who have reached the age of 60yearscompulsorytocontributeunderthesecondcategoryfortheprotectionunderEmploymentInjuryScheme.
The rate of contribution under this category is 1.25% of theemployee’sassumedmonthlywagessolelybornebytheemployer(referScheduleRatesofContributioninpages33to35).
Note:Employeeswhohavereachedtheageof55yearsandnocontributionshavebeenpreviouslypaidshallcontributeunderthiscategory.
Payment of Contribution
Paymentofcontributioncanbemadethrough:
i. SOCSO’sASSISTPortal(FPX)ii. InternetBankingiii.BankCounters
Note:ForpaymentatBankCounteremployersmustattachtheAcknowledgmentContributionReceived(ACR).

B. Payment through Internet Banking Employers need to be registered and have account at the

Contribution Payment Period
Contributionsshallbepaidnotlaterthanthe15thdayofeachmonth,forthepreviousmonth’scontribution(example:contributionforthemonth of January 2020 shall be paid not later than 15 February2020).
Interest on Late Payment of Contribution
Interestonlatepaymentofcontributionwillbeimposedattherateof6%perannumtobecalculatedonadailybasisforeachdaythecontributionremainsunpaidwithinthestipulatedperiod.

Protection Schemes under Act 4
Under thisAct,SOCSOprovides theEmployment Injury Scheme and Invalidity Scheme. Foreign workers are covered under the Employment Injury Scheme only.
Employment Injury SchemeEmployment Injury Scheme provides protection to an employeeagainstaccidentoranoccupationaldiseasearisingoutofandinthecourseofhisemployment.
Theprotectionunderthisschemecoversthefollowingaccidents:
i. Industrial accidents which occurs while working;
ii. Commuting accident:• onaroutebetweenhisplaceofresidenceorstayandhis
placeofwork• on a journey made for any reason which is directly
connectedtohisemployment• on a journey between his place of work and the place
wherehetakeshismealduringanyauthorizedrecess
Note:An accident that occurs during any stoppage or deviation shall not bedeemedtoariseoutofandinthecourseofhisemployment.
iii. Accident during emergency Accidentthatoccurwhenaworkerisinornearhisworkplace
forthepurposeofrescuing,assistingorprotectingpersonswhoareinjuredorareindangerduringanemergency.

iv. Occupational Disease Diseases that arise from or in the course of employment as
described in the Fifth Schedule of the Employees’ SocialSecurityAct1969.
Amongsttheoccupationaldiseasesinclude:
• Loss of hearing due to continuous excessive noiseexposure;
• Occupational asthma due to work involving constantexposuretotheinhalationofdustorharmfulchemicalandetc.

Medical BenefitEmployees suffering from employment injuries or occupationaldiseasesmayreceivefreemedicaltreatmentatSOCSO’spanelclinicorGovernmentclinic/hospital;ormakeclaimsforreimbursementofmedicaltreatmentcostsatSOCSOoffices.
• Reimbursement Employers or employees can claim for reimbursement of
expensesincurredinrespectofmedicaltreatmentatSOCSO’snon-panelclinic.Applicationcanbemade toSOCSOand thereimbursement issubjecttosuchconditionasdeterminedbytheOrganisationoraccordingtoFeesAct1951.
Temporary Disablement Benefit• Period of Temporary Disablement Temporary Disablement Benefit is paid for the period the
employeeisonmedicalleavecertifiedbyadoctorfornotlessthan4daysincludingthedayofaccident.However,TemporaryDisablementBenefitwillNOTbepaidforthedaysforwhichtheemployeeworksandearnswagesduringthisperiod.
• Rate of Temporary Disablement Benefit ThedailyrateofTemporaryDisablementBenefitis80%ofthe
employee’s averageassumeddailywage.Theminimum rateisRM30.00perdaywhilethemaximumrateisRM105.33perday.
Permanent Disablement BenefitEmployeeswhosufferfrompermanentdisabilityduetoemploymentinjury canapply for this benefit, after the completionpayment ofTemporary Disablement or after reached Maximum MedicalImprovement.
•Rate of Permanent Disablement Benefit ThedailyrateofPermanentDisablementBenefit is90%ofthe
employee’saverageassumeddailywage,subjecttoaminimumofRM30.00perdayoramaximumofRM118.50 perday.

Constant-attendance AllowanceThisallowanceispaidtoanemployeewhoissufferingfromtotalpermanent disablement (100%) and certified by Medical Board/SpecialMedicalBoard/AppellateMedicalBoard.Theallowance isfixedatRM500 permonth.
Facilities For Physical/Vocational Rehabilitation/ Return To Work (RTW)Thesefacilitiesaregiventoeligibleemployeesintheformof:i. Physical rehabilitation that includes:
• Physiotherapy• Occupationaltherapy• Reconstructivesurgery• Supplyofprosthetic,orthoticandotherequipments• Supply of orthopaedic equipment such as wheelchairs,
crutches, hearing aids, spectacles, special shoes andothers.
ii. Vocational rehabilitation that includes: Training in courses such as electrical, sewing,mobile phone
repairandothers.
Allexpenses incurred for theabove rehabilitation facilitieswillbebornebySOCSObasedonstipulatedrates,termsandconditions.
Dependants’ BenefitIf an employee dies as a result of an employment injury, hisdependantsareentitledtothisbenefit.
• Rate of Daily Benefit to be Paid Dailyrateis90%oftheaverageassumeddailywagesubjecttoaminimumofRM30.00perdayandamaximumofRM118.50perday.

Invalidity Scheme
An InsuredPersonshallbeconsideredassufferingfrominvaliditybyreasonofspecificmorbidconditionofpermanentnatureeitherincurable or is not likely to be cured and no longer capable ofearning,byworkcorrespondingtohisstrengthandphysicalability,atleast1/3ofthecustomaryearningsofasoundInsuredPerson.
Theschemeprovides24-hourcoverage toemployeewhosuffersfrom invalidity or death due to any cause and not related to hisemployment.
BenefitsundertheInvalidityScheme
Invalidity PensionInvalidityPensionis:
• Payable to the eligible insured persons who have beencertifiedinvalidbytheMedicalBoardorAppellateMedicalBoard.
• Payablefromthedateofaninvalidityapplicationisreceivedorfromtheemployee’sresignationdateifhe/sheresignsaftertheinvalidityapplicationisreceivedbyOrganisation.

• Notattained60yearsofageatthetimeinvalidityapplicationisreceived;or
• Intheeventthattheemployeeexceeded60yearsofageatthetimetheinvalidityapplicationisreceived,he/shemustshowevidenceof:
i) A morbid condition that has set in before attaining60yearsofageandhasnotbeengainfullyemployedsincethen.
ii) Certified invalid by the Medical Board or AppellateMedicalBoard.
ii) Fulfillsthequalifyingcontributionconditionseitherfullorreducedqualifyingperiod.
Invalidity Pension Rate
TherateofInvalidityPensioneligibleforpaymentshallbefrom50%to65%oftheemployee’sassumedaveragemonthlywages,subjectto aminimum pension ofRM475 permonth and amaximum ofRM2,567.50permonth.
Invalidity GrantInvalidityGrantispayabletotheeligibleInsuredPersonswhohavebeen certified invalid by theMedical Board orAppellate MedicalBoardbutnoteligible for InvalidityPensiondue to failure to fulfillanyqualifyingsubjecttominimum12monthscontributions.
The amount for Invalidity Grant is equivalent to the contributionspaid by employee and employer under Invalidity Scheme withinterest.Itisaone-timelumpsumpayment.

Constant-attendance AllowanceThis allowance is paid to an employee who is suffering frominvalidityandissoseverely incapacitatedastoconstantlyrequirethe personal attendance of another person, certified by MedicalBoard or theAppellate Medical Board. The allowance is fixed atRM500 permonth.
Facilities for Physical /VocationalRehabilitation/ Return To Work (RTW) and DialysisThesefacilitiesareprovidedforeligibleemployeesintheformof:
i. Physicalrehabilitationincludes:• Physiotherapy• Occupationaltherapy• Reconstructivesurgery• Supplyofprosthetic,orthoticandotherequipments• Supply of orthopaedic equipment such as wheelchairs,
crutches, hearing aids, spectacles, special shoes andothers.
ii. Vocationalrehabilitationincludes:• Training in courses such as electrical, sewing, mobile
phonerepairandothers
iii. Dialysisfacilities:• HaemodialysistreatmentatSOCSO’spanelandnon-panel

Survivors’ PensionSurvivors’ Pension is payable to the eligible dependants of anInsured Person who dies irrespective of the cause of death notrelatedtoemployment.
Qualifying Conditions:
• The InsuredPersondiesbeforeattaining60yearsof ageand fulfills thequalifyingconditionseither fullor reducedqualifyingperiod;
• TheInsuredPersonwhoisreceivingInvalidityPensiondiesregardlessofhisage.
Survivors’ Pension Rate
TherateofSurvivor’sPensionisfrom50%to65%oftheaverageassumedmonthlywagesubject toaminimumpensionofRM475permonthandamaximumofRM2,567.50permonth.

Employment Injury Scheme For Foreign Worker
Effective 1 January 2019, employers who hire foreign workers(excluding domestic servants) are required to register theiremployeeswiththisschemeundertheEmployees’SocialSecurityAct1969(Act4).
Registration
Registrationof foreignworkerscanbemadeonlineviatheonlineAutomatedSOCSOIntegratedSystem(ASSIST)portal.
For existing foreign workers in Malaysia who have valid ForeignWorkersCompensationScheme(FWCS),theyhavetoberegisteredwithSOCSObytheiremployersadayaftertheexpirationofFWCS.
Beginning1January2020,allemployersmustregisterwithSOCSOdespitetheirforeignworkersarestillcoveredunderFWCS.
Eligibility Requirements
• Mustpossessvalidpassport;
• MustpossessTemporaryEmploymentVisitPassoravalidemploymentpasswhicheverisapplicable.
The Rate Of Contribution
The rate of contribution is 1.25% of the employee’s assumedmonthlywagessolelybornebytheemployer.

Permanent Disablement Benefit
Permanentdisablementmeanspermanentdisabilitywhichreducestheabilityofanemployeetocarryouttheirwork.Employeeswhosufferfrompermanentdisabilityduetoemploymentinjurycanapplyforthisbenefit.
The daily rate of Permanent Disablement Benefit is 90% of theemployee’s average assumed daily wage. The minimum rate isRM30.00perdaywhilethemaximumisRM118.50perday.Constant-attendance Allowance
Theallowanceispaidtoanemployeewhoisseverelyincapacitatedastoconstantlyrequirethepersonalattendanceofanotherperson.Thismustbe recommendedbyMedicalBoardorSpecialMedicalBoardortheAppellateMedicalBoard.ThisallowanceisRM500permonth.

Introduction
The Employment Insurance System (EIS) was implemented inJanuary2018toprovideretrenchedemployeeswithfinancialandjobsearchassistance.
ActThe2017EmploymentInsuranceSystemAct(Act800)appliestoallenterprisesthatemployoneormoreemployees.
Coverage• All employers in the private sector shall pay a monthly
contributions for all eligible employees according to theratesspecifiedundertheAct.(Exceptforstatutorybodies,localauthorities,civilservants,domesticworkersandtheself-employed).
• Anemployeereferstoapersonwhoisemployedforwagesunder a contract of service or apprenticeship with anemployer,whetherthatcontractisexpressedorimplied,inoralorwritten.
• All employees from the ages of 18 to 60 are required tocontributeexcept foremployeesaged57andabovewhohavenevercontributedbefore.
Contribution RatesTheratesofEIScontributionscomprisesof0.2%employer’sshareand 0.2% employee’s monthly wages (refer Schedule Rates ofContributioninpage51-53).
