TERMS OF REFERENCE FOR THE IMPLEMENTATION OF SKILLS PROGRAMMES FOR THE NORTHERN CAPE, LIMPOPO, KWA-ZULU NATAL, NORTH WEST, MPUMALANGA, FREE STATE, GAUTENG PROVINCIAL
DEPARTMENT OF EDUCATION
1. INTRODUCTION
The Education Training and Development Practices Sector Education and Training Authority (ETDP SETA) is a public entity established in terms of Section 9(1) of the Skills Development Act, No 97 of 1998 to advance skills levels in accordance with the National Skills Development Strategy III. The Mandate of the ETDP SETA is to promote and facilitate the development and improvement of the skills profile of the sector’s workforce in order to benefit employers and employees in the ETD sector.
The ETDP SETA reserves the right not to award the BID.
A compulsory Briefing session will be held at the ETDP SETA Head Office, The ETDP SETA Building, 4th Floor Boardroom; 2-4 New Street, South Marshalltown (Ghandi Square), Johannesburg CBD on Wednesday, 28 November 2018 at 11h00. NB: ANY BIDDER WHO ARRIVES 15 MINUTES, (11H15) LATE WILL NOT BE ALLOWED TO PARTAKE IN THE BIDDING PROCESS.
2. PURPOSE AND OBJECTIVES
a. PURPOSE OF THE PROJECT
The ETDP SETA is looking for accredited training providers to facilitate the implementation of Skills Development Programmes in the ETD sector for the Northern Cape, Limpopo, Kwa-Zulu Natal, North West, Mpumalanga, Free State and Gauteng on behalf of the Departments of Education for 2018/19 financial year. The bid covering letter must clearly indicate the Programme/s you would like to train.

On this course, the participants benefit from utilising English grammar in terms of its functions and relevance in the workplace context. 3. PROJECT SCOPE AND REQUIREMENTS
1. The ETDP SETA will evaluate the bid per programme and province. Please submit separate bids per learning programme.
2. The shortlisted providers may be required to make a presentation of the project to the evaluation committee and site visits may be conducted with the shortlisted providers.
3. Bid documentation that do not comply, will be eliminated from the evaluation process. 4. The ETDP SETA reserves the right to adjust the allocation of numbers per programme.
A) ACCREDITATION
1. The Training Provider must be accredited by the relevant quality assurance body to offer the identified learning programmes.
Submit proof of accreditation.
B) FUNCTIONAL RESOURCES
1. The Training Provider must be adequately equipped with necessary physical resources in
province:
1.1. Workshop facilitation rooms 1.2. Resource packs to be given to learners 1.3. Resource Centers
2. The training provider must have the required Human Resource Capacity in the following areas:
2.1. Qualified Facilitators
2.2. Project Management Skills. No changes will be accepted without the prior written
consent of the ETDP SETA.

4. SCOPE OF WORK
A) FACILITATION AND ASSESSMENT
1. Provide Learner support to ensure learners attain the required number of credits within the
expected time frames.
2. Issue Certificates/Statement of Results of the qualification awarded by the relevant ETQA
and organise the graduation ceremony.
B) ADMINISTRATION OF THE SKILLS PROGRAMME
The provider must:
1. Establish and maintain the learner database. 2. Comply with training provider duties as per the signed SLA. 3. Monitor learner progress, resolve problems related to provisioning. 4. Submit reports as per the SLA. 5. Assist the ETDP SETA in conducting induction programmes for learners.
C) PLANNING AND SUPPORT
1. Develop rollout plans with time frames for the structured learning.

6. DURATION OF THE PROJECT
It is expected that the ETDP SETA will enter into a service level agreement (SLA) with the successful
bidders. The duration of the project will be according to the qualification notional hours.
7. EVALUATION CRITERIA
THE ETDP SETA applies the provisions of the PREFERENTIAL PROCUREMENT POLICY FRAMEWORK ACT,
ACT NO 5 OF 2000 and Preferential Procurement Regulations, 2017. The evaluation will be guided by
ETDP SETA procurement policy.
NB: Only one envelope should be submitted for compliance documents and should be in ENVELOPE A

7.1 STAGE 1
Bidders will be evaluated on the submission of the requested mandatory documents.

7.2 STAGE 2
The evaluation of this bid shall include functionality whereby the bids will be evaluated in terms of the
evaluation criteria embodied in the bid documents.
1. The minimum qualifying score for functionality will be 70 points and bids that fail to
achieve the minimum qualifying score will be disqualified.
2. Only bids that achieved the minimum qualifying score for functionality will be
evaluated further in accordance with the 80/20 ( as stated in Evaluation Criteria on
page 6 A and B) preference point systems prescribed in Preferential Procurement
Regulations 5 and 6.
The evaluation criteria for functionality will be as below:

8. BID CONDITIONS
The ETDP SETA Supply Chain Management Policy will apply:
1. ETDP SETA does not bind itself to appoint a bidder with the highest points.
2. ETDP SETA reserve the right to cancel the bid and not award the bid to any of the bidders.
3. Bids which are late, incomplete, unsigned and submitted via facsimile and email will not be
accepted.
4. Bidders with a turnover above R 10 million must submit a valid certified B-BBEE
Verification Certificate from SANAS Accredited Verification Agency in order to be eligible
for empowerment points.
5. An Exempted Micro Enterprise (EME) is only required to submit a sworn affidavit or a
Certificate issued by Companies and Intellectual Property Commission (CIPC) confirming
their annual turnover of R 10 million or less and level of black ownership to claim points.
6. A Qualifying Small Enterprise (QSE), is required to submit a sworn affidavit confirming their
annual total revenue of between R10 million and R50 million and level of black
ownership or a B-BBEE level verification certificate to claim points as prescribed.
7. B-BBEE Certificates obtained from Accountants/ Auditors after 31 December 2016 will no
longer be accepted.
8. Companies who bid as a joint venture must submit a consolidated B-BBEE Verification
certificate prepared for this bid only, from SANAS Accredited Verification Agency in order
to be eligible for empowerment points. Companies who form part of this joint venture
MUST have an accreditation certificate with relevant authority as stated in Mandatory
documents.
9. Failure on the part of a bidder to submit proof of B-BBEE Status level of contributor, sworn
affidavit or a B-BBEE Certificate, together with the bid, will be interpreted to mean that
preference points for B-BBEE status level of contribution are not claimed.
10. Bids submitted are to hold good for a period of 90 days.
11. Deregistered and blacklisted companies including directors/owners/individuals linked to
the company will not be considered. Due diligence will be conducted with successful
bidders to validate submitted information.
12. All suppliers must be registered on the Central Supplier Database. No bid will be awarded
to any supplier by ETDP SETA that is not registered on the Central Supplier.
13. Companies that are in the process of de-registration in the CIPC will not be considered.
14. Service Provider must provide proof of Public Liability Insurance.
15. The successful service provider must sign the penalty and termination clause as part of the
agreement with ETDP SETA.
16. The ETDP SETA reserves the right not to award to the bidder with the highest points to
ensure efficiency and fair distribution of work will be considered by the ETDP SETA.

Bidders must submit technical and financial proposals in two separate envelopes clearly marked “Envelope A-Technical Proposal “and “Envelope B- Financial Proposal”. 10. CLOSING DATE
