PREFACE

I, the Chairman of the Committee of Parliament appointed to advise theChairman of Rajya Sabha and Speaker of Lok Sabha on the changes that areconsidered desirable in the structure of pay, allowances, leave and pensionarybenefits to the officers and all categories of staff of Rajya Sabha andLok Sabha Secretariats in the context of decisions of the Government of Indiaon the recommendations of the Fifth Central Pay Commission, having beenauthorised by the Committee tosubmit the First Report on their behalf herebypresent this Report.

2. The present Committee was appointed by the Speaker in consultationwith the Chairman Rajya Sabha on 20th November, 1998. The Committeeconcluded their deliberations in regard to the scales of pay applicable to theemployees of Rajya Sabha and Lok Sabha Secretariats and finalised theirreport at their sitting held on 23rd April, 1999.

3. The Committee will be presenting another report on matters otherthan pay scales.

4. The Committee appreciate the work initiated by the earlierParliamentary Pay Committee constituted during the term of 11th Lok Sabha.

5. The Committee also wish to place on record their thanks to all thosewho helped them in their work.

INTRODUCTORY

1.1 In the context of the decisions of the Government of India on the/

recommendations of the Fifth Central Pay Commission, the Speaker,Lok Sabha in consultation with the Chairman, Rajya Sabha, constituted aParliamentary Pay Committee during the term of the l Ith Lok Sabha toadvise the Chairman, Rajya Sabha and the Speaker, Lok Sabha on thechanges that are considered desirable in the structure of scales of pay,allowances, leave and pensionary benefits to officers and all categoriesof employees of both the Rajya Sabha and Lok Sabha Secretariats. TheMembers of the Committee were :-

1. Chairman, Estimates Committee Chairman(Shri Rup Chand Pal)

2. Chairman, Public Accounts Committee Member(Dr. Murli Manohar Joshi)

3. Minister of Finance Member(Shri P. Chidambaram)

4. Minister of Parliamentary Affairs Member(Shri Srikant Jena)

5. Member of RajyaSabha Member(Shri Pranab Mukherjee)

6. Member of Rajya Sabha Member(Shri Ram Gopal Yadav)

Both the Secretaries-General of Rajya Sabha and Lok Sabha wereassociated with the Committee. In this regard Rajya Sabha ParliamentaryBulletin Part-II (Para No. 36504) and Lok Sabha Bulletin-Part II (ParaNo. 1513) dated 20th October, 1997 were issued.

1.2 The Parliamentary Pay Committee constituted during theII th Lok Sabha held only one sitting i.e., on 17th November, 1997 andrecommended that the decisions and orders of Government of India in thecontext of implementation of the recommendations of the Fifth CentralPay Commission relating to revised pay scales, allowances, leave andpensionary benefits may be provisionally made applicable, as arsinterim

1.4 The Committee at their first sitting decided the following futurecourse of work:-

(a) Staff members/Associations of both the Secretariats be givenanother opportunity to give representations/memoranda onadditional points, if any.

(b) The Secretariats may then process/scrutinise the representations/memoranda received from the staff members/Associations andcirculate the same with their comments to the Members of theCommittee in advance before the next sitting of the Committee.

(c) The next sittings of the Committee be held on 8th and 9th January,1999 to hear the views of the employees from various Services inboth the Secretariats.

(d) The Chairman may finalise the list of employees/Associationsetc. who may be asked to appear before the Committee forpersonal hearing at the sittings to be held on 8th and 9th January,1999 ..

1.5 In response to the Circulars mentioned above, a total number of293 memoranda/representations were received from Officers and Staff ofboth the Secretariats-60 from Rajya Sabha Secretariat and 233 fromLok Sabha Secretariat including identical ones. All these documents wereduly circulated to the Committee.

1.6 The Second, Third and Fourth sittings of the Committee were heldon 8th January, 1999 (two sessions) and 9th January, 1999 to hear the viewsofthe Officers and Staff in person on the structure oftheir scales of pay etc.A total number of 134 Officers and Staff belonging to various categoriesappeared before the Committee and gave evidence/presented their cases forbetter pay scales, improvement in conditions of service, better promotionalopportunities, removing of anomalies within the Secretariat and 'between theSecretariats. The Committee heard the views of the Officers Forum ofRajya Sabha and representatives of Lok Sabha Employees Association intheir Fifth sitting held on 25th January, 1999. The salient points made bythe Officers/Staff in those sittings were circulated to the Members of theCommittee.

1.7 Meanwhile, Shri Madan Lal Khurana ceased to be a Member ofthe Committee as he relinquished the Office of Minister of ParliamentaryAffairs. In his place Shri P.R. Kumaramangalam was nominated to theCommittee w.e.f. 21st February, 1999 on his assumption of the charge ofthe Office of Minister of Parliamentary Affairs.

STATUS OF RAJYA SABHA AND LOK ·SABHA SECRETARIATS

2.1 As early as in January, 1926, the Presiding Officers Conference adopteda resolution proposing the creation of a separate Office for the Central LegislativeAssembly, independent of and unconnected with the Government. On 22ndSeptember 1928 Pandit Motilal Nehru moved a resolution in the CentralLegislative Assembly to the effect that a separate Assembly Department beconstituted. The resolution was adopted unanimously. The Secretary of State forIndia, having accorded his approval (with certain modifications) to the schemeas embodied in the resolution, a separate self-contained department known asthe 'Legislative Assembly Department' was created on 10th January, 1929 inthe portfolio of the Governor-General with the Speaker of the LegislativeAssembly as its de facto Head.

2.2. The recruitment and conditions of service of the employees of theLegislative Assembly Department were to be governed by separate Rulescalled 'The Legislative Assembly Department (Conditions of Service) Rules,1929 made by the Secretary of State in Council on 7th August, 1929. Officersand staff of the Legislative Assembly Department thereafter began to beappointed in accordance with those Rules with the approval of the President(Speaker) of the Assembly. The position and authority of the Speaker in thematter of recruitment, terms and conditions of service of the Officers andstaff of the Central Assembly Department (and its successor Secretariat)have ever since been recognised by statutory Rules and conventions andfinally by the Constitution of India.

2.3 Under the provisions of the Indian Independence Act, 1947, thelegislative functions of the Central Legislature were taken over by theConstituent Assembly of India. There was, however, no change in thenomenclature of the Legislative Assembly Department. With the cominginto force of the Constitution and creation of a provisional Parliament on26th January, 1950 the name of the Department was changed to 'ParliamentSecretariat. '

2.4 Article 98 of the Constitution of India reads:

"98. (1) Each House of Parliament shall have a separate secretarialstaff: Provided that nothing in this clause shall be construed aspreventing the creation of posts common to both Houses ofParliament.

2.8 (i) In regard to 'Pay', the relevant provisions in the Lok SabhaSecretariat (Recruitment and Conditions of Service) Rules are as follows:

"8. Pay, Leave, Pension and Age of Compulsory Retirement-Subject to the provisions of Rule 11-

(a) The payor scale of pay attached to each of the posts in theSecretariat shall be as set out against it in the Second Schedule;

* * *(c) The Speaker may, from time to time, by general or special order,

after consultation with the Ministry of Finance, amend anyprovision in the Second, Schedules.

* * *10. Relaxation in exceptional cases-Where the Speaker is satisfied

that the operation of any rule or provision in the matter of theconditions of service of an officer causes undue hardship in anyparticular case, the Speaker may, after consultation with theMinistry of Finance, by order dispense with, or relax therequirements of, that rule or provision to such extent and subjectto such conditions as may be considered necessary for dealingwith the case in a just and equitable manner.

11. Conditions of service of officers on deputation to the Secretariat-Subject to such conditions and to such extent as may be determinedby the Speaker, after consultation with the Ministry of Finance,an officer while on deputation to the Secretariat, may be permittedto retain any terms and conditions of service to which he may beentitled immediately before his deputation to the Secretariat. "

(ii) Similar provisions in the Rajya Sabha Secretariat (Recruitment andConditions of Service) Rules, 1957 are reproduced below:-

"8. Pay, Leave, Pension and Age of Compulsory Retirement-Subjectto the provisions of rules 11and 12-

(a) the payor scale of pay attached to each of the posts specified incolumn 1of the Second Schedule shall be as set out against itincolumn 3 of that Schedule.

* * *(d) the Chairman may, from time to time, by general or specialorder;

after consultation with the Ministry of Finance, amend anyprovision in the Second, Schedules.

unreasonably withhold its consent rather than the Speaker doingit himself. In fact, the specified provision of any consultation isunnecessary. It is to be presumed that the Speaker will befunctioning according to the previous practice and conventionand will not be using his power or discretion in an arbitrary oroppressive manner. If this fundamental is borne in mind, there isno scope for any discussion about the phraseology. "

2.10 Matters regulating service conditions may form the subject matterof discussion with the Ministry of Finance in terms of the relevant provisionsof the R & CS Rules and if a final settlement at Secretary-General's level isnot reached, the matter is placed before the Chairman/Speaker, who recordshis opinion. As a rule, when the Chairman/Speaker is satisfied that certainconditions of service are necessary, his opinion prevails. It is, of course, alwaysopen to the Minister of Finance to request the Chairman/Speaker to reconsiderhis decision. In actual practice, such cases have been very rare and theexperience of operation of the Rules during the last 43 years has shown thatgenerally no major points of difference arose between the Secretariats andthe Ministry of Finance.

2.11 Posts in the Secretariats of Rajya Sabha and Lok Sabha areexcluded from the purview of UPSC under the provisions of UPSC(Exemption from Consultation) Regulations, 1958. The AdministrativeTribunalAct 1985 is also not applicable to persons appointed in the secretarialstrength of the Secretariats. In 1948, while considering the recommendationsof the Selection Board regarding appointments to secretarial and seniornon-secretarial posts, Speaker "Mavalankar observed-

"Every officer; subordinate or otherwise, serving in the Secretariatof the Legislature must be in a position to carry outhis dutieswithout fear or favour of the Executive Government, and obviouslythis cannot be done if persons in the employ of the LegislatureSecretariat have to look upon such bodies as Selection Board,consisting of the officers and nominees of the ExecutiveGovernment, for their chances and career in the Secretariat ofthe Legislature. Even in the old regime when the ExecutiveGovernment was not responsible to the Legislature and the entirepower vested technically in the Governor-General, it was a well-established convention that the presiding authority (the Speaker)was the sole judge and controller in respect of appointments,promotions etc., in the Legislative Assembly Department. "

by qualified, competent and devoted officers and is organised and conductedproperly and smoothly, under his own overall responsibility. Seniorfunctionaries at the level of Additional Secretary/Joint Secretary look afterthe work of the Service/Division of the Secretariat under their control. Theirduties are not rigid and do not fall in water tight compartments. Their dutiesare, in fact, flexible and may be added to or changed under the orders of theSecretary -General.

2:1.1 In. 1974, on\..~h~,~e.co,~!p<~ndations of the Parli~mentar~ PayCommittee, (both the Secretanats were; restructured on functIonal basis mtodifferent Services. Later, w.e.f 1st June, 1981, some of the Services were re-organised in Lok Sabha Secretariat. Presently there are 9 distinct Services onfunctional basis which cater to the specific needs of the House. The functionsof each Service are supplementary to the other and their Officers and Staffare not freely interchangeable owing to nature of duties of each Serviceswhich are quite specific and distinct. These Services are:

1. The Legislative, Financial Committee, Executive and Administrative .Service. (LAFEAS)

2. The Library, Research, Reference, Documentation and InformationService. (LARRDIS)

3. The Verbatim Reporting, Private Secretaries and StenographersService.

4. The Simultaneous Interpretation Service.

5. The Printing and Publications Service.

6. The Editorial and Translation Service.

7. The Watch & Ward, Door Keeping and Sanitation Service.

8. The Clerks, Typists, Record Sorters and Daftaries Service.

9. The Messengers Service.--- .2.18 In Rajya Sabha Secretariat some of the Services were re-organisedwith effect from 13th June, 1980. At present there are 10 services formed onfunctional basis which are:

1. The Legislative, Executive and Administrative Service.

2. The Library, Research, Reference, Documentation and InformationService (LARRDIS).

3. The Verbatim ReportingService.

2.22 Owing to the independent nature of the Secretariats, as enshrined inArticle 98 of the Constitution, the question of revision of pay scales of Officersand Staff of the Secretariats was kept outside of the purview of the First PayCommission in 1946, the Second Central Pay Commission in 1957-59, theThird Central Pay Commission in 1973 and Fourth Central Pay Commissionin 1986. The Fifth Central Pay Commission also excluded the employees ofthe Secretariats from their purview in view of the specific provisions of theConstitution. Till 1973, on the basis of recommendations made by therespective Central Pay Commissions, the pay scales of the Officers and Staffof the Secretariats were also suitably revised under orders issued by theChairman/Speaker after consulting the Ministry of Finance. Thereafter,separate Parliamentary Pay Committees were constituted in the light of therecommendations of the Third and Fourth Central Pay Commission in 1973and 1986 respectively for deciding pay, allowances etc. of the employees ofthe Rajya Sabha and Lok Sabha Secretariats.

3.2 Keeping in view the status of the Secretariats and nature of thefunctions discharged by them, the.Committee laid down the following GeneralPrinciples for determination of scales of pay, career progression etc. of theemployees in Rajya Sabha and Lok Sabha Secretariats:-

(1) There should not be any compromise on the present level of\ qualifications, experience and skill prescribed for the incumbents to the

jobs with a view to maintaining high standards of efficiency inParliamentary Administration.

(2) Some of the factors for determining pay scales to various categories ofposts in the Secretariats could be as follows:-

* Higher educational qualifications, skill, experience etc. prescribedas compared to posts in Government of India.

* Specialised nature of job involving high responsibility.

* Need for putting long hour of duties particularly during the Session.'\ periods.

* Need for time bound disposal of work involving stress and strain.

Arduousness of the job.

Chances of career progression.*** .Adequacy of the pay scales with reference to productivity.

* Need to attract talents at reasonably good levels, to service in theSecretariats.

RECOMMENDATIONS

4.1 Keeping in view the General Principles outlined in the earlierSection, the Committee recommend that the revised pa)' scales with otherchanges as indicated in the Appendix may be adopted for implementationin the different Services in Rajya Sabha and Lok Sabha Secretariats. Asa result of these recommendations, the number of pay scales will reduce.from 22 to 18 and 24 to 19 in Rajya Sabha and Lok Sabha Secretariatsrespectively. 4.2 The Committee recommend that the revised scales of pay aslaid down in the Appendix may come into force with effect from 1stJanuary, 1996.

4.3 The revised pay of the employees in both the Secretariats maybe fixed on the model of the provisions contained in the CCS (RevisedPay) Rules 1997.

I have gone throush the First Report of the Pay

Committee which was appointed by the Chairman: of Rajya

Sabha and me on 2Uh November, J 998 to make

recommendations on the structure of pay, allowances etc. for

the officers and staff of the Rajya Sabha and Lok Sabha

Secretariats. This Report of the Committee pertains to scales of

pay and the Committee will present another report on other

matters.

The Committee have done very useful work and have

considered all necessary aspects objectively and judiciously.

They also had given full opportunity to the staff lind officers

to represent their view-point both in writing and in person to

the Committee. The Committee have had the added advantage

of the Minister of Finance, being a Member of the Committee.

I congratulate the Committeefor the verygood work theX have

done.

I accept the recommendations made in the Report and

direct that these scales of pay may be implemented

immediately.

The Report may be given effect to simultaneously in the

Rajya Sahha and Lok Sabha Secretariats after obtaining

concurrence from Chairman, Rajya Sabha.
