RASM slates annual meetingThe Realtor® Association of Sarasota and Manatee will hold

the organization’s annual membership meeting on Friday, Sept. 11 at 11:30 a.m. at the RASM North Office, 10910 Technology Terrace, Lakewood Ranch. A delicious luncheon will be served, and registration is now open. Please visit www.MyRASM.com/register to register today!

During the meeting, the election of the 2016 board and officers will be held. Because no additional nominees were received, the board and officers will be elected by voice vote. Linda Formella, this year’s President-Elect, is automatically approved for the president’s post in 2016.

VVisitors and future residents of the

Sarasota-Manatee region normally arrive here for the first time by jet or by automobile. Soaring over our beautiful coastline and landing at the Sarasota-Bradenton International Airport is a typical scenario, introducing first-timers to this incredible place we call home.

Members of the Global Business Council (GBC) of the Realtor® Association of Sarasota and Manatee recently visited Rectrix Aerodrome Center at the airport for a first-hand look at one of the private aviation services available locally.

The firm operates with several Lear jets at both the local airport and at Hyannis, Maine, tailoring flights on luxuriously appointed jets for the discerning travelers. While not everyone can utilize this exclusive service, more and more business owners and corporate travelers are being introduced to this area by Rectrix, Dolphin Aviation and other high-end services. It’s all part of the evolution of our region as a singular choice for world travelers, and signifies just how far we have come from the quiet, virtually unknown area we were only 20 years ago.

The GBC has grown along with this region for the past decade, and is now completing another amazing year of activities, all designed to keep the focus on international real estate and how it positively impacts our region.

Membership in the GBC is only $25 per year, and as you will learn, that is quite a deal! I’m going to be frank. Whether we like it or not, politicians most often listen to the voices that speak the loudest. It’s just human nature. The squeaky wheel gets the grease.

Every group or organization is vying for their ears, so it’s very important we speak collectively on issues of importance to us in the real estate community. We are sending the message because the real estate industry is about to be impacted … most of the time in a negative way.

Florida law presumes that all real estate licensees are engaged as Transaction Brokers. The presumption is not applicable if you have provided a disclosure for single agency or non-representation. Commercial licensees have an additional option of serving as a “designated sales associate” provided certain conditions exist. 2. Is a written disclosure required when serving as a Transaction Broker?

Technically, no written disclosure is required when serving as a Transaction Broker for a principal because of the legal presumption provided in Chapter 475, F.S. However, there are excellent business reasons to give this disclosure, since most principals are not aware of the presumption nor do they necessarily appreciate the concept of limited confidentiality that a Transaction Broker provides.3. At the time I listed a Seller’s property for sale, we agreed I would act as a single agent, and I provided the single agent disclosure. I then received an offer from a buyer whose agent also works for my same broker. Can I still act as a single agent? What do I need to do, if anything?

You no longer can act as a single agent. Prior to submitting the offer to your seller, you must get the seller’s consent to act as a Transaction Broker for this transaction. You really have no choice because in this circumstance Florida law prohibits you from continuing as a single agent. This change is called – transitioning. By signing the Transition to Transaction Disclosure your seller acknowledges that your duties will change, especially as to confidentiality. The best time to provide this disclosure is when you take the listing, but it can also be given as a separate notice prior to the offer being submitted. 4. Are there any other times when I must serve as a Transaction Broker when I have originally agreed to serve my principal as a single agent?

Yes, if your buyer wants to see one of your own listings (or any listed by another agent in your broker’s firm) you are required to give the Transition to Transaction Broker notice to your seller and your buyer, if you started as a single agent for either side. 5. Does Florida law require every buyer or seller to be represented by a real estate licensee?

While it may at times seem like this should be the law, Chapter 475, F.S., provides that a customer is not required to enter into any brokerage relationship with a real estate licensee. In these cases, be sure to provide the Non-Representation Disclosure.

6. When is a licensee required to provide these disclosures?

Single Agents: The disclosure is required before, or at the time of, entering into a listing agreement or any agreement for representation, or before showing the property, whichever occurs first.

Transition to Transaction Broker: A single agent relationship may be changed at any time during the relationship, provided the agent first obtains the principal’s written consent.

Non-Representation: The disclosure must be made before the showing of property.7. Are there circumstances when the agency disclosures do not have to be provided?

Yes. The Statute provides that no disclosure is required in the following circumstances:

a. When an owner is selling new residential units built by the owner (i.e. a developer), and the circumstances reasonably inform the potential Buyer the agent/employee is acting on behalf of the owner only. Factors considered as notice include signage, location of the sales office or identification badges worn by the Agent.

b. Non-residential/commercial transactions.c. Rentals, unless there is an option to purchase 4 or less

residential units.d. A bonafide “open house” or a model home showing.

(You cannot elicit confidential information, execute a contractual offer or an agreement for representation, or negotiate concerning the price, terms or conditions of a potential sale. Confidential matters include a party’s motivation, any financing subjects, or the price acceptable to a party.)

e. Any unanticipated casual conversations between the agent and buyer or seller. (You cannot elicit confidential information, execute a contractual offer or an agreement for representation, or negotiate concerning the price, terms or conditions of a potential sale.)

f. Responding to general factual questions as by a potential buyer or seller concerning the properties that have been advertised for sale.

g. Any communications with a potential buyer or seller so long as they are limited to providing general factual information about the qualifications, background, and services of the agent or the brokerage company.

h. The pace of property sales in Sarasota and Manatee counties in July 2015 continued at a record annual rate, with 1,974 closings, up 23.5 percent over last July’s combined total of 1,600 for the two-county region. If the final five months of the year continue at this pace, 2015 will end with the highest number of sales in the region’s history.

Sales in Sarasota County hit 1,174 in July, only 9 sales below the June total and once again near the all-time record of 1,224 set in April of this year. Manatee County saw total sales of 768 in July, below the June figure of 875, but well above the July 2014 total of 672.

Sales levels in both Sarasota and Manatee counties have been at historically high levels for several months after a record-breaking 2014. Median sale prices have also been trending upwards year-over-year. For Sarasota County, the July 2015 single family median sale prices were at $219,500, down slightly from last month’s figure of $230,000, but up about 9.2 percent over last July’s figure of $201,000. Manatee County was at $250,000, again down slightly from June but up 8.7 percent in over last July. However, for condos, Sarasota County saw median prices drop to $190,000 from last July’s figure of $205,000, while Manatee County was up 18.3 percent over last July at $152,000. Condo prices in Sarasota County have tended to fluctuate month to month more than single family.

“We are now riding a five month wave of positive real estate numbers and there doesn’t appear to be an end in sight,” noted Association President Stafford Starcher. “The health of the current market is sustainable, judging by the recovery of the overall national economy. The Sarasota-Manatee

region is certainly reaping the benefits.”The available inventory in July 2015

in Sarasota County stood at 3,373, down about 13.9 percent from last July, and at 2,616 in Manatee County, down about 4 percent from last July. The lower inventory continues to put upward pressure on asking prices in both counties and puts the market into a strong seller’s mode.

New pending sales, which reflect new contracts written in the two-county area, were up about 3 percent from July 2014, with all categories up over last year. But pending sales dropped from the June figures, which normally happens during the hot summer months as seasonal visitors head north. One interesting note – pending sales only decreased about 5 percent in both counties from June to July, while in recent years there has been a more significant decline. This could reflect greater staying power for the current real estate market.

The two-county area also saw

the month’s supply of inventory remain well below the 6 month level that defines a market in equilibrium between buyers or sellers. The figures now stand at between 3.3 and 3.9 months in both counties for both single family and condos. Median days on market were between 45 and 53 this July, compared to 76 to 88 days last July, a major drop that indicates homes are moving quickly once they are placed on the market.

“Historically, we have seen August sales mirror the July numbers or rise slightly, so I’m looking forward to more good news as we come into late summer and early fall,” said Starcher. “Declining inventory of course remains a concern, but as homeowners look at the overall picture and gain some perspective, we could see more prospective sellers jump off the fence and into this hot market.”

The original town of Bradentown was incorporated in 1903. The city took the name of Dr. Joseph Braden, whose nearby fort-like house was a refuge for early settlers during Seminole Indian attacks. The current city of Bradenton was formed in 1943, when the Florida legislature merged the cities of Manatee (incorporated in 1888) and Bradentown.

Many people feel Bradenton is one of the last “original” areas in the Tampa Bay area. Many of the original landmarks have been preserved either through efforts by organizations or just families holding on to them. Some of the most recognizable are the Manatee Courthouse, Perlots Drugstore, the Pier, the Harden Building and the Dixie Grand Hotel (now the Hampton Inn) where travelers from around the world stayed and a few celebrities including Elvis Presley and Al Capone!

Bradenton is now seeing an insurgence of new growth and development and has become the “happening” place to be for millennials, boomers and everyone in between. With events like the Saturday Main Street Farmers’ Market, the Riverwalk, concerts in the park, music, food and beer festivals, and even a powerboat race and festival there seems to be no end in sight. Bradenton’s economic outlook is bright and businesses are flocking to the area and snatching up most of the turn of the century and mid-century storefronts. The commercial real estate market is on the rise with retail space available from $15 per square foot (PSF) and class A space from $17 PSF, there is a dwindling supply of commercial space for sale and when it does come available it is quickly snapped up by investors.

A popular place in downtown is the Village of the Arts, an eclectic live-work community made up of colorful historic cottages that house everything from award-winning restaurants to specialty shops, studios, healing arts, bakeries and Bradenton’s best art galleries. A stroll through color-filled streets offers a little something for everyone, whether you’re a foodie, a vinyl enthusiast or a quilt lover, with services that range from knife sharpening to yoga. Visitors and residents can enjoy popular art walks the first Friday night and Saturday afternoon of every month, where you’ll be greeted with live music, incredible food and unique indie art spanning every genre.

Bradenton has been home to the Pittsburg Pirates Spring training at McKechnie Field, which is named

after Pittsburgh native, former Bradenton resident and Hall of Fame manager Bill McKechnie. It was originally built in 1923 and has been renovated several times over the years, including major upgrades in 2013, to become one of baseball’s finest facilities. Thousands of fans travel to Bradenton every year to cheer on their favorite players.

Downtown Bradenton is not only a great place to visit, it is a fabulous place to live. My wife and I have called Downtown home for the last four years. We truly take advantage of all it has to offer and we are not alone. Bradenton has eight riverfront condo communities and many prestigious homes along the historic Manatee River.

One of Downtown’s most prestigious neighborhoods is nestled on a point between the Manatee River and Wares Creek, just a short walk from downtown Bradenton. It is the historic neighborhood of Point Pleasant. Its vintage homes tell the story of many of Bradenton’s prominent families of days gone by, those with names such as Green, Rossi, Reasoner and Vanderipe.

Downtown Bradenton still has many opportunities for picking up a great deal on a single family home, historic home or waterfront condo. If a buyer of a residential listing applies for a mortgage loan on or after October 3, 2015, new federal regulations will apply to the loan transaction. This class focuses on what real estate professionals need to know and how to prepare for the upcoming changes in how closings will take place after October3, 2015.

CMA ToolsSept. 24 - 9 to Noon - SouthThis class reviews all of the MFR products and services that can be useful to agents when searching for comparable properties or compiling CMAs. Topics include CMA options in Matrix, Cloud CMA, Realist, IMapp, and Data Coop, along with the Market Conditions Report. This class focuses on CMA products, not CMA techniques.

RealistSept. 24 - 1 to 3 p.m. - SouthThis class provides a comprehensive overview of the Realist tax system. The first half of the class covers the various reports available on a particular property. The second half of the class is devoted to searching in Realist. Topics include the various search forms available, customizing search forms, specifying criteria and generating mailing labels, looking up distressed properties in a given area, and utilizing the various map tools.

School reading program off and runningThe RASM Community

Outreach Committee has started promotion and recruitment for the Reading Mentoring Program, and so far the response from members has been tremendous! More than 100 members have signed up to provide weekly mentoring sessions for kindergarten through third graders, and the school district is scheduling training sessions for the fall for volunteers.

It’s a little known fact that over 50 percent of children in the Sarasota area are receiving free or reduced price lunches – so statistically over half the children you might see each day are living at poverty level, and their education suffers.

RASM members are being asked to contribute time and teaching skills to help children who are struggling to learn to read. We are working to give these youngsters the tools they need to help them educate themselves, and improve their chances of getting a good education and a good job.

If kids cannot read, and miss out on their education, we

could see a lot of bright minds failing to reach their potential.

Along with Sarasota County School District, we are still actively recruiting volunteers from the Realtor® community – including Business Partners, and family members. These volunteers will be asked to spend at least an hour a week during the school year with one or two children, simply reading together. You will be trained how to help the children read, and will have the full support of the Volunteer Coordinator in each school.
