JUDICIAL AFFIDAVIT OFWITNESS CHESKA SELAN

I, Cheska Selan of legal age, married, and living at Block 10, Lot 12, Phase 12, Star Subdivision, Oton, Iloilo , witness in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Meliton Tubongsapa with address at Banga Law Office, St. Martin Building, Jaro, Iloilo City. The examination is being held at the same address. I am answering his questions fully conscious that I do so under oath and may face criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of witness Cheska Selan is being offered to prove that the respondent repeatedly abused the petitioner verbally and emotionally causing mental and emotional anguish;

The witness’s testimony is also offered to prove the legal basis for violation of Section 5 (a) of R.A. 9262, otherwise known as Anti-Violence Against Women and their Children Act.

1. Q. Please state your name and other personal circumstances for the record.A. Cheska Selan, resident of Block 10, Lot 12, Phase 12, Star Subdivision, Oton,

Iloilo

2. Q. How are you related to the petitioner in this case? A. I am her neighbor. She is living right beside my house.

3. Q. Do you know a certain Ricardo Reyes? A. Yes sir.

4. Q. How did you happen to know him? A. He is my neighbor. And husband of Debbie Reyes.

5. Q. How long have you been living in your present residence? A. Five years Sir.

6. Q. Have you heard or seen any unusual happening at the residence of Ricardo and Debbie Reyes?

A. Yes sir, I have heard that Ricardo is often shouting at Debbie but oftentimes I could not hear the response of Debbie.

7. Q. How often do you hear this shouting? A. Almost every morning and night.

8. Q. What do you usually hear? A. Things like Ricardo is calling Debbie a bitch. One day I have heard him shouting

at Debbie telling her that he is not the father of Debbie’s child in her womb.

9. Q. Since when did you started to hear the shouting at their residence? A. The moment they learned that Debbie is pregnant.

10. Q. How did you learn that Debbie is pregnant. A. Debbie told me that she is. She was very happy that time when she told me that.

She said that Ricardo will be very happy for that news. But it was the opposite, that was the start that Im hearing Ricardo shouting at Debbie.

11. Q. In the morning of September 30, 2013.What had you heard?

A. I have heard that Ricardo is again shouting at Debbie. I did not mind for a while for I often heard that. But when I’ve heard Debbie crying for help, I immediately went out.

12. Q. What did you see after that? A. I saw Ricardo carrying Debbie while Debbie is full of blood. They both ride on a

vehicle.
