23 description of a vehicle, they've got information,
24 guys doing armed robberies.

to say something other than that they_ just what,
4arbitrarily picked three guys in a vehicle and
. 6 started to surveil them for an hour with a half
7 dozen police units before they trail them to where
8 the robbery we're here on takes p_lace.
9 I understand the things I can't do, but on
10 the other hand there ought to be some rhythm and
11 reason. Judge, I would propose --
12 THE COURT: What is this, the St . Pete unit?
13 MR. MIGLIORE: This is, I don't know, what they
14 call special investigation or career criminal. And
15 what actually happens, Judge, is that Detective
16 Corbet goes to a meeting of robbery detectives and
17 comes back with information that these gentlemen
18 have been doing a bunch of stick-ups over in Tampa.
19 And they have information to describe individuals,
20 black ·male, certain kind of car, et cetera, et
21 cetera. And it's almost that same day or the next
22 day they just bounce into seeing these fellows and
23 take up a lengthy, a lengthy surveillance involving
24 multiple units. It's clear from, it's going to be
25 clear from the way the evidence, that the police

1 threw a whole bunch of effort into this one.
2 THE COURT: It was just happenstance the way it
3 occurred?
4 MR. MIGLIORE: Absolutely. Just happenstance
5 that within a day or two that Detective Corbett
6 relayed this information to the head of this unit
7. that they see these guys. But that is also why they
8 do what they do and put the. effort into it that they
9 did. -
10 . THE COURT: What drew their attention; the
11 description for the other robberies?
12 MR. MIGLIORE: Yes, sir.
13 MR. SWISHER: Well, they were also suspiciously
14 looking for a vehicle in the Home Depot Shopping
15 Center and I think that's as far as they need to go.

Home Depot Shopping Center with a purpose in mind.
18 THE COURT: That certainly makes it a little
19 less onerous as far as the circumstances. I don't
20 know whether uncharged crimes or other crimes, but I
21 think any mention of that that the limited probative
22 value -, I mean the point is that they started
23 following him for purposes of this case.

12 . comfortable in indicating to the Court that I have
13 . been authorized to represent by his office that as
14 to the motion to consoiidate, Mr. Hernandez'
. 15 position is to entrust in the sound discretion of
16 the trial court. He doesn't agree. He doesn't
17 o'ppose your discretion. Judge, I think Ms. Kester
18 wants to argue against hearing the motion for
19 consolidation for lack of sufficient notice. So,
20 I just defer on that for a moment.
21 THE COURT: .All right. When did you file it?
22 MR. MIGLIORE: Judge, I filed it Tuesday . We
23 had some paper work problem. .I thought it was
24 going to be filed Mondáy afternoon. .We have three
25 days until this morning.

17 consolidation by Judge Luce in which he articulated
18 what, if anything, the State can reduce and I
19 requested, I asked Mr. Stedman who is ass_isting me
20 to track it .down last week; could Madame Clerk check
21 on each one of these trials. .There's been a
22 transcript filed. It would have been a ruling by
23 the Court last year. I requested it several weeks
24 ago and did a motion and order as well.
25 THE COURT: What is that regarding?

1 MR. MIGLIORE: The specific terms of the court
2 granting the State's motion to consolidate.
3 THE COURT: What, were there some statements?
4 MR.·MIGLIORE: Right. And we agreed to forgo
5 on the most part of them.· I think there was one or
6 two observations the.Court made about what would
7 nonetheless remain admissible. Mr. Holloway can
. 8 correct me. .
9 7 MR. HOLLOWAY: I took notes on it . Obviously

there was no written order or discussion on
7transcript., Judge Luce granted the State's motion
pver our objection and he indicated though that
certain of the co-defendants statements would be
permitted and he characterized these in so ruling as
15 observations.
16 · In.other words, Mr. Rushing is the alleged
17 driver of the get-away vehicle and he was in that
18 position and .presumably, well, . I don' t know whether
19 he'll testify, but in a post-arrest statement I
20 believe he indicated that the two Williams brothers
21 returned to the car in a hurry. My client was
22 carrying a cash drawer from a register and either or
23 both of the Williams brothers said "Go," and gave
24 him that urgent direction to quickly drive away.
25 And I think Judge Luce said those observa.tions would

THIS CAUSE came before the court for hearing upon the Motions to Dismiss filed byvanous Defendants in this action. The Plaintiff, Jonathan C. Williams appeared by telephonicconnection with the Department of Corrections. After hearing argument, reviewing the lengthypleading file and considering case law, the court finds the pleading is fatally defective.
It is clear that the claims against the judicial officers and prosecutors are barred. Theremaining claims against the various police detectives are rambling assertions which, if taken astrue, do not establish cognizable causes ofaction.
It is therefore ORDERED AND ADJUDGED that this com laint must be and isdismissed with prejudice.

STATEMENT OF THE CASE AND FACTS
The Appellant is a pro se litigant serving a life sentence for armed robbery.
He has filed suit against the City of St. Petersburg, various detectives of the St.
Petersburg Police Department, as well as other entities.
Appellant alleges that on December 10, 1998, some type of constitutional
violation of his rights took place, arising from his arrest. To the best it can be
understood, the Appellant is attacking his stop and detention. The Complaint and
Notice of Claim was filed on January 22, 2009, and served at a subsequent time.

SUMMARY OF ARGUMENT
The Statute of Limitations for a tort action of this type is four years. Florida
Statute §95.11(3). Pursuant to Fla. Stat. §768.28, a Notice of Claim must be filed
within three years for suit against a governmental entity. The Appellant's
Complaint is barred by the Statute of Limitations.

ARGUMENT
The Appellant has filed a Complaint and Notice of Claim dated January 22,
2009. The Complaint is "rambling" as termed by the Circuit Court, which fails to
set out a cause of action. However, this Court need not reach this issue·as the
Statute of Limitations has barred the claim.
Appellant alleges a cause of action of December 10, 1998. Appendix, Tab
A. The Complaint is dated January 22, 2009, over ten years later. The defense
timely moved for a dismissal, asserting the Statute of Limitations had expired.
Appendix, Tab C. Pursuant to Fla. Stat. §95.11(3) and §768.28 this action is
barred.

CONCLUSION
The Appellant's Complaint, which does not state a cause of action, is barred
by the Statute ofLimitations.
