I. CALL TO ORDER PUBLIC MEETING
President Jane Luciano called the April 29, 2019 meeting of the Robbinsville Board of Education to order at 6:05
PM. She read the New Jersey Open Public Meeting Law announcement and led the flag salute.

III. MOTION TO CONVENE IN EXECUTIVE SESSION
On motion of Mrs. DeVito and seconded by Mrs. Temple, the Robbinsville Board of Education voted to enter
Executive Session at 6:07 PM to discuss the topics indicated below.
WHEREAS, while the Sen. Byron M. Baer Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.) requires all
meetings of the Robbinsville Board of Education to be held in public, N.J.S.A. 10:4-12(b) sets forth nine (9) types
of matters that may lawfully be discussed in "Executive Session," without the public being permitted to attend, and
WHEREAS, the Board has determined that one (1) issue is permitted by N.J.S.A. 10:4-12(b) to be discussed
without the public in attendance and shall be discussed during an Executive Session to be held on Monday, April
29, 2019 at 6:00 P.M, and
WHEREAS, the nine (9) exceptions to open public meetings set forth in N.J.S.A. 10:4-12(b) are listed below, and
next to each exception is a box which will be marked when the issues to be privately discussed fall within that
exception, and after each exception is a space where additional information that will disclose as much information
about the discussion as possible without undermining the purpose of the exception shall be written:
1. Any matter which, by express provision of Federal law, State statute or rule of court shall be rendered
confidential or excluded from public discussion.” The nature of the matter, described as specifically as
possible without undermining the need for confidentiality is: Attorney / Client Privilege

rates or investment of public funds where it could adversely affect the public interest if discussion of such

disclosure could impair such protection. Any investigations of violations or possible violations of the law."

party. Any matters falling within the attorney-client privilege, to the extent that confidentiality is required in
order for the attorney to exercise his ethical duties as a lawyer." The parties to and docket numbers of each
item of litigation and/or the parties to each contract discussed are and the nature of the discussion, described as
specifically as possible without undermining the need for confidentiality is:
8. Any matter involving the employment, appointment, termination of employment, terms and conditions of
employment, evaluation of the performance, promotion or disciplining of any specific prospective public
officer or employee or current public officer or employee employed or appointed by the public body, unless all
individual employees or appointees whose rights could be adversely affected request in writing that such
matter or matters be discussed at a public meeting." Subject to the balancing of the public's interest and the
employee's privacy rights under South Jersey Publishing Co. v. New Jersey Expressway Authority, 124 N.J.
478 (1991), the employee(s) and nature of the discussion, described as specifically as possible without
undermining the need for confidentiality are:
9. Any deliberation of a public body occurring after a public hearing that may result in the imposition of a
specific civil penalty upon the responding party or the suspension or loss of a license or permit belonging to
the responding party as a result of an act of omission for which the responding party bears responsibility." The
nature of the matter, described as specifically as possible without undermining the need for confidentiality is:
WHEREAS, the length of the Executive Session is estimated to be sixty (60) minutes after which the public
meeting of the Board shall reconvene and proceed with business where formal action will be taken.
NOW, THEREFORE, BE IT RESOLVED that the Robbinsville Board of Education will go into Executive Session
for only the above stated reasons; and
BE IT FURTHER RESOLVED that the Board hereby declares that its discussion of the aforementioned subject(s)
will be made public at a time when the public's interest in disclosure is greater than any privacy or governmental
interest being protected from disclosure.

V. BOARD PRESIDENT’S REPORT
PRMS Assistant Principal Mike Passafaro introduced Andrew Boanoh to the Board. Andrew was recently
honored at the Mercer County 8th Grade Dialogue event held each spring.

VI. STUDENT GOVERNMENT REPORT – Kelly Herbert, President, RHS Executive Council
Executive Council President Kelly Herbert reported on the following student matters.
Sports
● Track and Field sent three relay teams to the PENN Relays at the University of Pennsylvania.
● The baseball team’s record is 8-5.
● The softball team has been having a successful season. Olivia Moser recently hit her 100th hit and Chelsea
Manto leads Mercer County with the most hits within the CVC. Devon Witt was also recognized for winning
play of the week for hitting a grand slam to win their game against Steinert.
Clubs
● World Language Honor Society held their induction ceremony this past Thursday, April 25.
● National Honor Society is hosting an induction ceremony for old and new members on May 21st.
● GSA (Gay, Straight, Alliance) hosted a day of silence, which was a day to show awareness for the LGBTQ+
community in the fight against bullying.
Executive Council
● The Executive Council is working on their new senior send off day and hopes to launch the event during
Senior week.
● Prom is just around the corner and Seniors are excited for their night at the Merion and Funplex.
PEI Update
● All RHS students have been busy this year increasing their PEI skills and February and March were no
different!
● In February freshmen learned the importance of positivity portfolios and had time to plan what they would
include in their own portfolio. Sophomores, juniors, and seniors were reminded about “being in the moment”
and were given the chance to practice mindful breathing, eating, and muscle relaxation.
● In March freshmen worked on character strengths and deciding which of their strengths would be most
beneficial on a deserted island. Students in grades 10-12 worked on the “SCARF” model to navigate through
socially threatening situations as they engaged in various role-playing activities with their PEI leaders.
VII. PRMS / SES STUDENT COUNCIL REPORT – Hannah James, RHS Executive Council
Executive Council representative Hannah James reported on recent happenings at Sharon Elementary School and
Pond Road Middle School.

VIII. PUBLIC HEARING: POLICY 5536: RANDOM DRUG TESTING
Members of the public were provided an opportunity to comment and ask questions about the Random Drug
Testing policy. Earlier in the evening an information session was held to provide students and parents with
information about the September 2019 implementation of the RDT. A FAQ has been created and is posted on the
district website to further address and clarify parent concerns.

A. Susan Weintraub – Would have liked an opportunity to ask questions during the RDT forum.
B. Marci Rossi-DeVito – Asked what is involved in the policy adoption process – Mrs. Luciano clarified.
C. Justin Hughes – Since the law mandates that RDT must involve a competitive activity, why are students in
activities such as drama required to participate? American Academy of Pediatrics is not in favor of RDT.
D. Brad Daniels – Just because there is a legal basis for RDT does not make it a good idea. It is a violation of 4th
amendment rights. Will organize opposition.
E. Jody Pineto – Singles out kids who participate in activities and should address all students fairly. This
measure will create additional stress on students.
F. Michelle Carmignani– Policy will be a deterrent but expressed concern about workload for staff.
G. Aaron Hobart – Policy might be a good out for kids to combat peer pressure.
H. Christine Lyons – Exclusionary policy – Did not like the format of the information session – Parents could
not ask questions.
I. Avery Hutchinson – Not in favor of the policy as it is written – Keep playing field level – Asked what $25K
in budget for RDT covers.
J. Leif Breeden – Doesn’t agree with the privilege aspect. Needs more consideration – May be appropriate for
sports but not for other activities.
K. Jessica Leale – It is the parent’s responsibility – not the school’s – to decide how to deal with drug issues.
L. Michelle Carmignani – Asked about various levels of consequence.
M. Carol Ann Blank – Asked district to revisit excluding students from activities as a consequence –
Communicate protocol regarding students required to take medication.
N. Susan Weintraub – If students opt out are they punished?
O. Christine Lyons – Is confidentiality ensured? Should be a way to share questions.
P. Toni – How often will tests occur? What controls are in place to ensure that the same students are not being
tested again and again?
Q. Mayor Fried – The Mayor spoke about the CARE program – 75 individuals within the past year – Addiction
is a disease.
R. Jansee Sadula – If program can deter on child it will be worth it – Does not like privilege contingency.
S. Aaron Hobart – Does testing fall under HIPPA? (BOE Att’y. – FERPA)
T. Elissa Harris – What exactly will be tested? (Dr. Tew – List of prohibited substances on website.)
U. Carol Ann Blank – What are the steps in the policy process?
V. Noushin Kanani – Policy needs parent buy in.
W. Marci Rossi-DeVito – Let students have input.
X. ? – Clarify consequences for 1st – 3
rd offenses
Y. Shannon Gafgen – Agrees with therapeutic approach vs. punitive. Proud of community.
Board members also commented.
Mrs. Luciano – Likes the idea of considering community service as a consequence and expressed concern about
placing additional burden on the SAC.
Mrs. Temple – Asked the administration to consider the logistical aspects of testing large groups of students at a
time.

Mr. Heilman – The Board / Committee has taken a year to explore implementation of the policy. It has been well
thought out.
Mr. Young – Concerned about 3rd
strike but the policy will be worth it if it saves lives.
Mrs. DeVito – The purpose of the public comment was for feedback. Reminded the Board and members of the
public that a policy is already in place in the event that any member of the student body is suspected of being under
the influence.
Mr. Galluccio – Supports BOE move in this direction but advocated for additional research.
Mrs. Ciaccio – In her job as a social worker Mrs. Ciaccio indicated that in 90% of drug related cases, the
individuals began drug use in high school. Likes considering community service as a consequence.
Mrs. Luciano – Completely behind policy.
IX. REVIEW POLICY & REGULATION 5536: FIRST READING (Attachments #1 & #2)
On motion of Mr. Young and seconded by Mrs. DeVito, the Robbinsville Board of Education voted 7-0 to review
Policy and Regulation 5536, Random Drug Testing, at the level of first reading. Mr. Halm and Mr. Veisz were
absent.
Board members engaged in a discussion about the Random Drug Testing policy. After listening to comments from
the public, several members indicated that they would like to have additional conversation about the consequences
although most agreed that implementation of the policy will be beneficial to students over all.
X. SUPERINTENDENT’S AND SCHOOL BUSINESS ADMINISTRATOR’S REPORT: FINAL BUDGET
PRESENTATION
Dr. Foster and Ms. Brooks provided the final 2019-2020 budget presentation to the Board of Education and
members of the public.
XI. PUBLIC COMMENT ON 2019-2020 BUDGET
A. AVERY HUTCHINSON – Well articulated presentation. Took issue with how the budget was developed
and noted that the Board’s role regarding overall budget approval vs. line item management are the greatest
risks in future years.
B. DARREN MCCOOL – Urged the Board to pass a resolution requiring administration to conduct a formal
presentation to provide a full accounting after the second quarter each year. Commitment to create a Strategic
Plan will be helpful with budget planning.
C. AARON HOBART – Asked a few clarifying questions regarding the budget. Indicated his support for the
budget.
D. JUSTIN HUGHES – Asked a budget clarifying question.
XII. ADOPT 2019-2020 ANNUAL BUDGET
First: Mrs. DeVito
Second: Mr. Galluccio
Vote: 7-0 (Mr. Halm and Mr. Veisz were absent.)
Whereas the Robbinsville Board of Education adopted a tentative budget on Tuesday, April 2, 2019, was submitted
to the Mercer County Executive Superintendent of Schools for approval, and whereas the proposed budget was

advertised in the legal section of the Trenton Times on April 23, 2019, and whereas the proposed budget was
presented to the public during a hearing held in the Robbinsville High School on April 29, 2019, and whereas the
total amount of the 2019 - 2020 budget is as follows:

Be it resolved that the Robbinsville Board of Education adopt the 2019 – 2020 Annual School Budget as detailed
above. Be it further resolved that the following amount to be raised by the local tax levy for the General Fund is
$37,959,184 and Debt Service Fund is $5,401,619 for a total tax levy of $43,360,803.
XIII. APPROVE MAXIMUM EXPENDITURE FOR 2019-2020 TRAVEL
On motion of Mr. Young and seconded by Mrs. DeVito, the Robbinsville Board of Education voted 7-0 to approve
the maximum expenditure for travel for the 2019 – 2020 school year for all staff and board members is
$130,000.00 in accordance with N.J.A.C. 6A:23B-1.2(b). The Robbinsville Board of Education also approves that
an annual school year threshold of $1,500.00 per staff member be established for regular business travel where
prior Board approval shall not be required unless this annual threshold for a staff member is exceeded in a given
school year. The Robbinsville Board of Education also certifies that as of April 29, 2019 the district has expended
$49,768.96 for approved travel for staff and Board members for the 2018– 2019 school year. Mr. Halm and Mr.
Veisz were absent.

E. AD HOC SECURITY – Mr. Rich Young
Mr. Young reported on the following matters discussed during the March 19, 2019 meeting of the Security
Committee.
Memorandum of Agreement revisions: The Security Camera policy has been updated so that SROs have
the opportunity to have live access of the security cameras as needed. This updated policy will be
referenced in the MOA.
Attendance and Truancy: Thank you to Ed Vincent and Melyssa Alonso, the attendance policy will now
include steps that will address truancy issues.
Facility Use Policy: The Facilities Use Policy has been updated to reflect the following changes. A
Security fee will be required for all outside organizations beginning in the 2019-2020 school year.
Additionally, language has been added to create graduated consequences for outside community members
who use the spaces and prop open outside doors. This new language will be communicated to
organizations.
Lighting for Hutchinson Road: Chief Nitti conducted research into adding additional street lighting for
Hutchinson Rd. Each additional street light costs between $10,000 – $12,000.00! It would cost
approximately $100,000.00 to illuminate the entire stretch of road.

On motion of Mrs. DeVito and seconded by Mrs. Ciaccio, the Robbinsville Board of Education voted 7-0 to
approve the minutes as indicated. The March 18, 2019 public session minutes were tabled. Mr. Halm and Mr.
Veisz were absent.

XVII. APPROVE MONTHLY RESOLUTIONS
A. PERSONNEL (A.1 – 10)
On motion of Mrs. DeVito and seconded by Mrs. Luciano, the Robbinsville Board of Education upon
recommendation of the Superintendent voted 7-0 to approve personnel resolutions A.1- 10 below and on pages
23 – 26 as indicated. Mr. Halm and Mr. Veisz were absent.
8. APPROVE AUXILIARY PERSONNEL
Motion to approve Tom Brettell to serve as Title IX Coordinator through June 30, 2019.
9. APPROVE JOB DESCRIPTIONS

10. EXTEND SIDEBAR AGREEMENT BETWEEN THE ROBBINSVILLE BOARD OF
EDUCATION AND THE ROBBINSVILLE EDUCATION ASSOCIATION
WHEREAS, the Robbinsville Board of Education (“Board”) and the Robbinsville Education Association
(“Association”) are parties to a collective negotiations agreement (hereinafter “Agreement”); and
WHEREAS, the terms of the Agreement do not provide for a sick leave donation bank; and
WHEREAS, both the Board and the Association wish to extend a one-time sick leave bank for Employee
#5431; and
WHEREAS, Association members wish to voluntarily transfer accumulated sick, vacation, and/or personal
leave to the sick leave bank for use by Employee #5431.
NOW, THEREFORE, in consideration of the foregoing, the Board and the Association agree as follows:
1. Association members shall be permitted to voluntarily donate accrued sick, vacation, and/or personal
days to the Employee’s sick leave bank, up to a maximum of ten (10) days per member, so long as the
Association member maintains a minimum sick leave bank of thirty (30) days. The maximum number
of days permitted in the leave bank is fifteen (15) days. Members’ donations will added to the leave
bank in the order in which they are donated but shall be used one at a time on an as needed basis (If a
member donates ten (10) days to the bank, days shall be left in the members own sick leave bank until
one or more is needed by employee #5431).
2. The leave bank may only be utilized by Employee #5431 for the purposes of leave associated with the
treatment and / or recovery from his / her own personal illness.
3. The sick leave bank expires on June 21, 2019. Any leave days remaining in the leave bank upon its
expiration shall also expire.
4. Employee #5431 shall be compensated 1/185 of his / her annual salary for each day of the leave bank,
irrespective of the salary of the donating member.

5. This Agreement shall be non-precedential and cannot be used by either party in any future dispute for
any purpose whatsoever, including, but not limited to, establishing past practice.

j. Award Contract: Food Service Management Company
BE IT RESOLVED that Robbinsville Board of Education (herein referred to as the Local Education
Agency or LEA) approves Aramark Educational Services (herein referred to as the Food Service
Management Company or FSMC) as its Food Service Management Company for the 2019-2020
school year. (New Contract)
BE IT FURTHER RESOLVED that the Food Service Management Company shall receive, in addition
to the costs of Reimbursable Items, a management fee of $.02173 per and meal equivalent to
compensate the Food Service Management company management costs. These fees shall be billed
monthly as a cost of operation.
BE IT FURTHER RESOLVED that the Food Service Management Company guarantees the Local
Education Agency a minimum profit return of $75,568.25 for the school year 2019-2020. This
guarantee is contingent upon the guarantee terms and requirements as stated below:
GUARANTEE
Conditional Guaranteed Return (Unlimited). Aramark guarantees that the return to the LEA from the
Food Service Program for the school year will be $75,568.25 If the annual operating statement shows
a return less than $75,568.25 Aramark will pay the difference between the actual and the guaranteed
amount. The Guaranteed Return is based on the following conditions and assumptions remaining in
effect for the school year.
CONDITIONS
1. Cash and/or reimbursement levels from State and Federal sponsors do not fall below the levels
estimated in Aramark’s proposed budget.
2. The number of days meals are served during the school year will not be less than:

3. Changes in district policies, practices and serving requirements including but not limited to

5. The selling prices of Menu Pattern Meals and a la carte selections will not be less than those

6. Service will not be interrupted as a result of fire, work stoppage, strike or school closing.
7. The LEA and its representatives including but not limited to, school principals, teachers and LEA
employees shall fully cooperate with Aramark in the implementation of the Food Service Program.
The LEA shall fully cooperate with Aramark to limit the expansion of competitive food sales in
order to maximize the gross receipts and other non-cash sales of the Food Service Program.
8. The following variable District expenses charged to the Food Service budget by the District must
be identified and capped so as not to exceed the following amounts:
Ongoing contract monitoring in the amount of $12,000
Annual Point-Of-Sale System service and system maintenance fees of $2,000
The information in the RFP remains unchanged, capital commitments are used as proposed, and
Aramark has the ability to implement the food service program as set forth in its proposal. In the event
the foregoing conditions are not met during the school year, Aramark’s guarantee obligation shall be
reduced by an amount equivalent to any increased net cost or net loss of revenue attributable to the
changes in such conditions.
k. Award Maintenance Proposal: Broad USA, Inc.
Motion to award a two-year maintenance proposal in the amount of $98,796.00 to Broad USA, Inc. to
service two chillers at Robbinsville High School for the period dating from July 1, 2019 through June

On motion of Mrs. DeVito and seconded by Mrs. Temple, the Robbinsville Board of Education voted
7-0 to accept without modification the Superintendent’s Report on Harassment, Intimidation and
Bullying for the period ending April 29, 2019. Mr. Halm and Mr. Veisz were absent.
XXI. APPROVE INCLUSION OF ADDENDUM ON THE AGENDA
On motion of Mr. Galluccio and seconded by Mr. Heilman, the Robbinsville Board of Education voted 7-0 to
include an addendum to approve a student discipline recommendation on the agenda. Mr. Halm and Mr. Veisz
were absent.
XXII. APPROVE STUDENT DISCIPLINE RECOMMENDATION
Motion: Mr. Heilman
Second: Mrs. DeVito
Vote: 7-0 (Mr. Halm and Mr. Veisz were absent.)
WHEREAS, the Superintendent of Schools has recommended that the discipline of student bearing
identification number 200453 (“the Student”) be amended;
WHEREAS, on April 29, 2019, a formal disciplinary hearing was held before the Board of Education in
accordance with N.J.A.C. 6A:16-7.3;

WHEREAS, at the formal disciplinary hearing, the Board of Education received testimony from the
Robbinsville High School administration and the Student, his/her attorney, and his/her parents;
BE IT RESOLVED that the Board of Education hereby determines that the Student shall not be present on any
of the Board of Education’s school premises before, during, and after the regularly-scheduled school day
through June 30, 2020, unless specifically authorized by the Superintendent;
BE IT FURTHER RESOLVED that the Board of Education hereby determines that the Student shall not be
permitted to participate in any athletic, co-curricular and/or extra-curricular activities sponsored by the Board
of Education, and shall not be present for, or attend, any Board of Education sponsored activities, either on
Board of Education premises or in any school district where the Robbinsville School District is participating in
the activities through June 30, 2020 at the discretion of the administration;
BE IT FURTHER RESOLVED that the recommendation shall be reviewed at every subsequent regular board
meeting to determine whether the recommendation will be continued until the next regular board meeting; and
BE IT FURTHER RESOLVED that home instruction shall continue to be provided to the Student through
June 30, 2020.
XXIII. ADJOURNMENT

adjourn the April 29, 2019 monthly meeting at 10:42PM.
