Newsletter 2017-37 September 15, 2017 ROAD BOND AMENDMENT CAMPAIGN IN FULL SWING: CAWV MEMBERS STEP FORWARD TO FUND EFFORTS The committee to promote passage of the “Roads to Prosperity” road bond amendment has made much progress in the past two weeks. To date, CAWV members and others have contributed and pledged over $250,000 with another $50,000 expected to be pledged in the next few days. The statewide radio campaign began Thursday with ads targeting the projects that are slated in each region of the state. TV ads, also targeted to local markets, begin next week. Newspaper ads will appear as more money is raised. Members have received a mailing today from CAWV’s Highway/Heavy Division leadership encouraging everyone to contribute to the campaign. “Response from our membership has been great,” said CAWV Senior Vice President Roger “Thomas, Kelly Paving, Inc. “Our members have contributed over $200,000 which will help educate voters on what the bond does and, more importantly, does not do raise taxes. However, like any other campaign, getting the word out is essential. I hope all members will contribute to the campaign, Time is short. Committee on Finance is meeting Monday and legislators will get an update on the WV Division of Highways’ plan for the highway construction and maintenance program after passage of the highway funding bills this past special session from Transportation Secretary Tom Smith. Legislators will probably want to talk about the “Roads to Prosperity,” the $1.6 billion road bond amendment that will be voted on October 7. The Joint Government Accountability, Transparency and Efficiency Committee will discuss the actions and activities of the School Building Authority Monday at 8:00 a.m. Monday. This is a follow up on the committee’s August discussion on the use of construction management on school construction projects (See this week’s Building Bulletin for more details). The Joint Commission on Economic Development will feature Commerce Secretary Wood Thrasher. The Select Committee on Infrastructure will meet Sunday but at press time there is no agenda posted. A full report on next week’s legislative interim meetings and how the discussion will affect CAWV members will be in next week’s Newsletter. SITE OF 2018 CAWV MIDYEAR MEETING ESCAPES MAJOR DAMAGE FROM IRM The site of the CAWV Midyear Meeting is the JW Marriott Marco Island, Marco Island, Florida, on February 1 –7, 2018. Hurricane Irma hit Marco Island on Sunday, September 10, causing wide spread power outages, downed trees and flooding. The JW Marriott reported that the resort sustained only minor damage and will reopen on Monday, October 2. The hotel will be back to normal and ready to welcome CAWV members in February. Registration materials will be available next week and will be sent via email to all members. The CAWV Program Committee is putting together an excellent mix of business, sporting and social activities to make the 2018 meeting an unforgettable event. Convention forms must be returned by October 31 for Early Bird Registration. Rooms reserved after October 31 will be on an availability only basis. February is one of the most popular months for Marco Island tourism and members are encouraged to make their convention and airline reservations as soon as possible. CONGRESS ASKS ABOUT STREAMLINING PERMITTING The AGC submitted testimony to the House Small Business Committee at a hearing entitled “Expediting Economic Growth: How Streamlining Federal Permitting Can Cut Red Tape for Small Businesses.” The AGC took the opportunity to urge Congress to implement reforms to the federal environmental review and permitting process. Time and money is wasted on redoing project analyses and reviews and on collecting duplicate information from permit applicants. The AGC included its flow chart of environmental permits to illustrate some of the regulatory hurdles that contractors must overcome. Additionally, the AGC recommended that Congress require a nationwide merger of the National Environmental Policy Act (NEPA) and the Clean Water Act Section 404 permitting processes, with the U.S. Army Corps of Engineers issuing a 404 permit at the end of the NEPA process based on the information generated by NEPA. The monitoring, mitigation and other environmental planning work performed during the NEPA process, and included the final Environmental Impact Statement / Record of Decision, must satisfy federal environmental permitting requirements unless there is a material change in the project. Further, AGC urged Congress to consider a reasonable and measured approach to citizen suit reform to prevent

misuse of environmental laws. These lawsuits can take years to resolve and, in far too many cases, litigation impedes projects that are vital to the renovation and improvement of our nation’s infrastructure. The AGC will continue to advocate in Congress and with the Administration for practical regulatory reform and additional infrastructure funding. WVDOH TO DISCUSS DEVELOPMENT OF NEW DBE GOALS AT 2017 MINORITY BUSINESS EXPO Members are invited to attend the 4th Annual Minority Business Expo on Wednesday, October 25, 10 am-6 pm at the Charleston Civic Center. SBA COMMITTEE MEETS ON PROJECT DELIVERY METHODS The committee of the School Building Authority of West Virginia met Friday, September 8, to continue its discussion on the best use of construction management on school construction projects. After the meeting, state schools Superintendent Dr. Steve Paine said, “I think we’re getting closer to a resolution, but there are still a lot of unanswered questions in my mind.” Dr. Paine is the chairman of a committee formed to review the practice of hiring construction management firms to help manage construction and renovation projects funded by the SBA. The committee met for a second time Friday. Dr. Paine said the committee would schedule a third meeting before it makes any recommendations. During Friday’s two-hour meeting, the committee heard about the issue from contractors, architects and current and former construction managers who have been involved with building schools. “The issue, as you probably know, is what’s the value of a construction manager?...” Dr. Paine said after the meeting. “That role seems to have affected the role of architects and contractors – they all seem not be satisfied with each other. And we’re just trying to get at the issues that exist.” Winfield Strock, former CAWV President and former construction manager, told the committee about the history of the SBA’s use of construction managers. Strock said it started in the late 1980s, when the SBA and the state Regional Jail and Correctional Facility Authority were formed. There was a concern that with the increase in projects, the work would go to out-of-state companies and workers. Construction managers were part of an effort to make sure West Virginia got its fair share of the work being done, he said. “I never heard any conversation saying that these projects were too complex and would require construction managers because of the complexity of the projects,” Strock said. “The concept of the construction managers was brought about because of these circumstances regarding the volume [of work], bonding issues and the potential for out-of-state contracts to come in and take a lot of the work.” Speaking at the meeting included CAWV members Rick Milhoan, Project and Construction Services, Inc.; Adam Krason, ZMM Architects and Engineers; and CAWV Executive Director Mike Clowser. Other engineering and architect firms made comments as well. The Joint Government Accountability, Transparency and Efficiency Committee will meet Monday, September 18, at 8:00 a.m. to continue its discussion of the issue. This committee met during last month’s legislative interims and continues its discussion at the September interims. LEWIS COUNTY BOE BUILDING & ROBERT L. GRAVITY NEVER FORGETS

Start with a good foundation Proper ladder setup will help prevent slips and falls. Place the base on a firm, solid surface. Avoid slippery, wet or soft surfaces. If you must put the ladder on a soft surface, place a board under the ladder’s feet to provide firm footing. Make sure the top of the ladder has firm support as well. Never lean a ladder against a window pane or other unstable surface. If you’re using a straight or extension ladder, the angle of the ladder is the next critical safety factor. A straight or extension ladder should be placed 1 foot away from the surface it rests against for every 4 feet of ladder height. For example, if the ladder is 4 feet high, the bottom of the ladder should be 1 foot away from the support surface. If you use a ladder to access a roof or platform, make sure the ladder extends at least 3 feet over the roof or platform edge. Be sure to securely fasten straight and extension ladders to the upper support. If you have angled the ladder properly and still have doubts about its stability, have someone hold the ladder before climbing up. If you’re using a step ladder, be sure to open it completely before you climb. If you have to use a step ladder near a doorway, lock or barricade the door and post signs so no one will open it and knock you off the ladder.

Climb with care When you climb, always face the ladder and grip the rungs of the ladder to climb, not the side rails. Never get on or off a ladder from the side unless it has been secured to prevent movement. Never climb with equipment in your hands. Use your pockets, equipment belt, or a tool pouch and raise heavy objects with a hand line. If you forget something, always climb down the ladder to retrieve it yourself; don’t have someone toss it up to you. And never ask someone to climb up your ladder to give you supplies. It is dangerous to exceed the weight limits that a specific ladder can handle. When you descend a ladder, practice the same safety rules. Face the ladder, keep your body square and hold on to the rungs. Lastly, step off at the bottom rung of the ladder. Never jump off of a ladder. Before you start to haul a ladder around, evaluate the area where you’ll be working. Ladders can be heavy and unwieldy. You can strike another person or object, or hit electrical power lines. Make the ladder as compact as possible before transporting it. Carry it horizontally while tilting it higher in front and lower in back. If the ladder is particularly long and heavy, get a co-worker to help you carry it. Ladder safety may seem simple, but injuries occur every year. Below are some ladder safety dos and don’ts:

Use the right ladder for the job. Read all warning labels carefully and follow directions before you climb. Wear clean, dry, slip-resistant shoes and use ladders with slip resistant feet. Don’t stand any higher than the third rung from the top of the ladder. Don’t lean too far or overreach. Reposition the ladder closer to the work instead. Don’t use a ladder as a bridge or scaffold. Don’t put a ladder on a box, barrel or other object to gain additional height. Don’t use a damaged or unsafe ladder.

FUNDING BILLS RESULT IN INCREASED HIGHWAY FUND REVENUES

Bills to increase funding for the state Road Fund passed during the June special session of the West Virginia Legislature are paying dividends for the West Virginia Division of Highways. Increases in the wholesale gas tax, DMV fees and privilege tax on vehicles went into effect July 1. For the first two months of Fiscal Year 2018, the road fund collected $142.8 million, up $17.2 million, or 13.73%, over the same period last year. Registration fees are up although privilege tax revenue is down. Since privilege taxes have always kept up with inflation, these revenues should increase in the coming months. Governor Jim Justice proposed the revenue fees during his state of the state address in February. The Senate passed the measures during the regular 60-day session but it took two special sessions for the House to finally approve the bills. The bills will generate an additional $140 million annually for the highway and bridge construction and maintenance. A breakdown of revenues for the first two months is below: State highway revenues for July and August are $142.8 million, which is up from the $125.6 million for the same period in 2016. Motor Fuel tax collection from July through August this year is $80.1 million, up $8.3 million from last year’s $71.9 million collection. Registration fees this year are $26.4 million compared to $16.2 million last year. The Privilege Tax on vehicles has collected $36 million this quarter versus $37.1 million last year. WVDOH RECORD SETTING SEPTEMBER LETTING The September 12, 2017 WVDOH Highway Letting apparently set a record for dollar volume of bids received. Secretary of Transportation Tom Smith called it the largest single bid letting in the history of the highway department. The letting included approximately 30 projects to be paid for with GARVEE bonds. The letting totaled over $261 million with GARVEE projects accounting for approximately $240 million of the total. The legislature passed legislation this year that expanded the department’s capacity for GARVEE bonds from $200 to $500 million. The letting and use of GARVEE bonds was reportedly the administration’s first wave of projects intended to shore up the state’s highways and bridges while also helping create jobs and jumpstart the economy. The letting included a large number of bridge and paving projects as well as bridge painting and slide repair jobs. Secretary Smith told MetroNews Talkline host Hoppy Kerchival that West Virginia based contractors were low bidders on nearly every project adding, “we know how to structure these things in a way that give our contractors great opportunities and they stepped up in the biggest sort of way this past Tuesday and we look for that to continue (with road bond projects)”. Future waves of large highway lettings will be funded by another round of GARVEE bonds and by the West Virginia Parkways Authority utilizing its own bonding and tolls to fund projects in ten specific counties in southern West Virginia.

The biggest wave of projects, however, depend on the successful passage of the road bond amendment on October 7, 2017, as it authorizes the sale of $1.6 billion in road bonds. The legislature has already passed legislation containing fee increases that provide monies to repay the bonds.
