    Re: Application for Stakeholder and Interested Party status related to Case 09-T-0049and others concerning Galloo Island power production and transmission projects

    Dear Commissioners:I am writing to you to request Stakeholder and Interested Party status under Article VII of thePublic Service Law related to the applications by Upstate NY Power Corporation for theproposed Galloo Island power production and transmission projects in Jefferson and OswegoCounties, and any other separate proceedings related to this matter.I am the duly elected State Senator representing the communities affected by this project. Mypredecessor, Senator Darrel Aubertine, along with other state representatives from the region,was previously recognized as a Stakeholder and Interested Party to these proceedings.Since assuming office in January 2011, I have had opportunity to discuss this project withrepresentatives of Upstate NY Power Corp., the New York Power Authority, communityresidents, and state, county and local representatives from the affected areas.

    I\aI have listened to their concerns, and shared with them my position relative to wind powergeneration, and this project, in particular. I am not a champion of unrestricted wind powerdevelopment, especially when it impacts environmentally, culturally or historically sensitivoaareas and communities. I believe projects of this type deserve a full and complete review, withample opportunity for local community and public input, and full consideration of the impacts ofthese projects on property owners and area residents.As a result of these discussions, I was pleased that the developer has agreed to a subaquatic routeto transmit power generated by the Galloo Island facility. This is the preference of most affectedcommunities, and my preference as well.

    Additionally, I have raised concerns with the developer and other interested parties over the costof energy produced by this project. I believe it is not in the best interest of New York ratepayersto approve a Power Purchase Agreement that includes artificially set rates that are inconsistentwith the current electricity market for power produced from other projects and sources.I have made clear that these factors, along with a continuing concern for the project's immediateand long-term impact on communities that are directly and tangentially involved in theconstruction and operation of the Galloo Island facilities, must be considered crucial to my andthe affected communities' support for this project.While the Galloo Island project holds potential for job creation, stabilizing the local tax base,financial benefits to local communities, and helps ensure continued adequate electricitygeneration for our region and the entire state, the Commission and other regulating authoritiesmust continue to carefully consider the other impacts on our region, as well.I look forward to continuing to be closely involved as this application moves through therocess, and thank you for your attention to this request.
