1 Response to Bar Council of India Resolution dated 22.12.2019 The undersigned advocates distance themselves from the statements made by the Bar Council of India (BCI) in its Resolution dated 22.12.2019 with regard to the Citizenship (Amendment) Act, 2019 and the ongoing democratic protests against it. The BCI is the statutory body that governs all advocates in India and is mandated to safeguard the credibility of the legal profession. The BCI ought not to release statements that give the impression that it is doing so on behalf of all advocates as the Resolution does not represent the views of the Bar and certainly not the undersigned advocates. While the individual office bearers of the BCI are free to express their opinions in their personal capacity, the use of the BCI's platform to express the personal views of some is a disservice to the principles that the BCI stands for. It is also clear that the Resolution does not speak for all advocates as various statements have been released by sections of the Bar condemning not only the disparate impact of the Citizenship (Amendment) Act, 2019 on minorities but also the excesses of the police forces. A protest march was also conducted by advocates outside Jamia Millia Islamia University on 21.12.2019 against the Citizenship (Amendment) Act, 2019 as well as the brutal attacks against students by the Delhi police. It is also extremely distressing to note that in its Resolution, the BCI has referred to the lakhs of citizens of this country who are exercising their democratic right to protest, out of sheer anguish, as the "illiterate ignorant mass". It does not befit the stature of the BCI for such statements to be made. It has been mentioned in the Resolution that damage to public property and violence against the police are serious issues. While there is no dispute with regard to this, the deaths of more than 25 people including minors (as on 24.12.2019), the use of excessive and disproportionate force against protestors, minors being detained and beaten, and the widespread use of arbitrary internet shutdowns are also grave issues. These are issues that legal education and ethics have equipped, and indeed encouraged, us to work on. We hope that the BCI and State Bar Councils across the country lend their support to advocates working to address these issues. The Resolution also states that "the bar expresses solidarity with our police and armed forces". Aside from the fact that it must be emphasized again that the BCI has not spoken for the Bar, it is amiss that the BCI, a body which is supposed to stand up for the Bar, did not deem it fit to express solidarity with advocates such as Mr. Mohd. Shoaib who has been detained in Lucknow or the hundreds of advocates fighting across the country to uphold the rights of citizens as recognised by the Constitution.

The undersigned advocates distance themselves from the statements made by the Bar Council of India (BCI) in its Resolution dated 22.12.2019 with regard to the Citizenship (Amendment) Act, 2019 and the ongoing democratic protests against it. The Advocates Act, 1961 envisages certain duties that the BCI must fulfill. These include laying down standards of professionalism and ensuring the highest degree of legal education in the country. Respectfully, the BCI's role is to ensure that law and procedure take the proper course, and not to embolden impediments to justice, especially by State entities. Excessive and unnecessary deference to the State is unbecoming of the BCI's standing. When allegations of grave abuse of State power are involved, it is not for the BCI to pass judgment either way. The Bar plays an essential role in the preservation of the Rule of Law, which is the essence of democracy, and a basic tenet of our Constitution. The legal fraternity, which fosters both the judiciary and practicing advocates, is indispensable to the balance of powers under the Constitution. It is incumbent upon us as members of this fraternity to not take a partisan approach in the present circumstances. It is our responsibility to ensure that the Constitution's principles and ideals are upheld even during difficult times. Essential to this is protecting the rights of minorities, and the rights of those exercising their Fundamental Right to dissent. As advocates, our allegiance is to uphold the values of the Constitution and any violation of the same cannot go unaddressed. The BCI's Resolution also calls for advocates to convince people around them to not protest as the matter relating to the constitutionality of the Citizenship (Amendment) Act, 2019 is pending before the Hon’ble Supreme Court. The pendency of the challenge before the Hon'ble Supreme Court does not, in any manner, take away from the right of citizens to exercise their democratic and constitutional right to protest - either against the Act itself or against State excesses relating to the Act. We strongly deprecate the Resolution dated 22.12.2019 and trust that the BCI will stand for the rights of members of the Bar in the future and join us in ensuring that the freedoms envisioned by the Constitution are upheld. We urge the BCI to perform its statutory duties in a non-partisan manner and to refrain from expressing opinions that may prove detrimental to the people's faith in the justice system.
