A RESOLUTION OF THE MANATEE COUNTY BOARD OF COMMISSIONERS AUTHORIZING THE SIGNING AND SUBMISSION OF AN ANNUAL GRANT APPLICATION AND SUPPORTING DOCUMENTS AND ASSURANCES TO THE FLORIDA DEPARTMENT OF TRANSPORTATION, THE ACCEPTANCE OF A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE EXPENDITURE OF CAPITAL/OPERATING ASSISTANCE GRANT FUNDS PURSUANT TO A GRANT AWARD.

WHEREAS, the Manatee County Board of County Commiss ioners/Manatee County Area T ransit (MCAT) has the authority to apply for and accept grants and make purchases and/or expend fund s pursuant to grant awards made by the Florida Department of Transportati on as authori zed by Chapter 34 1, Florida Statutes and/or by the Federal Transit Admini stration (FT A) Act of 1964, as amended; and

WHEREAS, the Florida Department of Transportation (FOOT) has the authority to admini ster FT A Section 53 10 Program funding as the Designated Recipient for the Sarasota/Bradenton urbani zed area (UZA) as established by MAP-2 1.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MANATEE COUNTY, FLORIDA:

1. This resolution applies to Federal Program(s) under U.S.C. Section(s) 53 10 Formula Grants for the Enhanced Mobility of Seni ors and Indi viduals with Disabiliti es.

2. The Chairperson or in their absence, the Vice Chairperson, is hereby authori zed to sign the application and accept the grant award, and sign a JPA for both capital and operating assistance funding; and upon JPA executi on, staff is authori zed to proceed with expenditure of capi tal/operating grant fund s pursuant to a grant award, and approved for FFY 201 8 Secti on 53 10 fundin g, unless specificall y rescinded.

3. The BOARD authori zes the Transit Division Manager to sign any and all ass urances, reimbursement in voices, warranti es, certifications, and o ther documents which may be req uired in connection with the application or subsequent agreements.

are already underway and aggressively incorporated into programming for the MPO Transportat ion

Improvement Program (TIP) to meet infrastructure needs and enhance accessibility system-wide.

Barriers to Coordination Based on a review of plans, policies, and programs; existing staffing, facilities, and vehicle inventory;

available private transportation providers; and existing funding and public input the following barriers to

coordination of transportation services in Manatee County were identified :

• Limited FCTO funding remains an issue and local human service agencies are decreasing

transportation service levels and providing less transportation for their clients. In addition,

uncertainty about the TO Trust Fund and local funding constraints create barriers to provid ing

more transportation services in the "coordinated system." However, Manatee County/MCAT

continues to explore options to increase operating revenue, including an enhanced fare structure.

• While Manatee County encourages redevelopment within the urban core and MCAT's fixed-route

system improvements are being implemented to improve services along the "core network," new

development and population growth continues in the eastern, unincorporated portion of the

county where limited or no transit service is available. The lack of transportation options on the

east side of the county is both a need and a barrier to coordination and accessing services in the

urban core. In addition, when trips are provided to the east (Myakka City and Duette), the

Handy Bus vehicle and operator are occupied for the entire day, thereby reducing MCAT's

system capacity. Coord ination with other agencies providing transportation service in the eastern

port ion of the county must improve to enhance transportation options and reduce redundancy.

• Transit supportive policies and new land development regulations are in development now that

will encourage TOO patterns and redevelopment with in the more urbanized area where MCAT

operates its "core network" service . The more recent development patterns in more remote

areas create disproportionate growth on the east side of the county, thereby creating barriers to

providing coordinated transportation services . Recently, MCAT reviewed and modified services

to increase fixed -route service frequency within the "core urban areas" to better accommodate

mobility in these more populated and developed areas. While this optimization of service

improves urban area service levels, rural area needs continue to grow.

• Ongoing technology improvements are needed to enhance coordination and improve

communication among "coordinated system" providers . In addition, ongoing Handy Bus

scheduling software improvements improve efficiency by effectively assigning trips to nearby

operators when cancellations are received .

• The lack of wheelcha ir accessible vehicles and affordable transportation options by private

providers limit mobility among TO populations. While some additional for-profit providers are

available within Manatee County, the cost of those services and limited capacity to transport

wheelchairs make it difficult to coordinate transportation services and provide additional mobility

options to TO passengers . Therefore, all wheelchair service demands fall on MCAT. MCAT's

MCAT I Transportation Disadvantaged Service Plan 43

travel training program could help TD passengers feel more comfortable using the fixed-route

system when it is within proximity.

• Ongoing improvements to bus stop infrastructure assist with removing barriers for TD passengers.

MCAT offers conditional eligibility to qualifying ADA and TD applicants that are unable to use the

fixed-route system at various bus stops due to accessibility issues. Over 350 bus stop

improvements have been completed over the last three years. Continued transit infrastructure

improvements within the county should increase the number of ADA and TO eligible passengers

that use the fixed-route system. This could also be determined through annual recertification of

TD passengers to determine the need remains relevant. As a result of transition ing passengers

from paratransit to fixed -route service, additional trips would be available on the Handy Bus.

• The service coordination between SCAT and MCAT continues to assist passengers of public transit

with ease of use and seamless fare payment, consistent with the 2060 Florida Transportation Plan

implementation strategy. The strategy is to facilitate and deploy effective systems across

jurisdictions, including development of statewide electronic payment systems for transit fares.

Goals, Objectives, and Strategies Goals, objectives, and strategies were developed us ing the results of the needs and barriers to

coordination assessments and input from the public outreach efforts. The goals of the TDSP primarily

focus on funding and efficiency; coordination; service effectiveness; and accessibil ity. Each goal is

supported by objectives essential for goal completion . Strategies are the actions that need to occur to

complete the objective and achieve the overall goal. The following goals, objectives, and strategies have

been adopted to gu ide the provision of ADA and TD services over the next five years .

Goall: Efficiently and effectively serve the mobility needs of the Transportation Disadvantaged

population in Manatee County, within the available funding constraints.

Objective 1.1: Match appropriate transportation services with the identified and most critical

needs of the TD population .

Objective 1.2: Maximize the use of the fixed -route system as an alternative to door-to-door

paratransit service.

Objective 1.3: Explore opportunities to provide incentives and encourage ADA and TD

passengers to transition to the fixed-route system .

Objective 1.3: Continue to manage, operate, and maintain transportation services in a cost

effective manner.

Objective 1.4: Maximize revenue generation through various sources.


Implementation Actions

• Continue to emphasize the availability and reduced cost of fixed-route services to benefit local

agencies and schools .

• Continue with development of a fixed-route Bus Pass program for TD populations to access

regular medical care.

• Finalize the new combined ADA/TD application process with income-based eligibility (not to

exceed 200% of the Department of Health and Human Services federal poverty level

guidelines) and criteria for annual TD recertification.

• Implement the discounted TD Bus Pass program and IVR software system.

• Require the use of fixed-route service for all TD non-sponsored trips having an origin and

destination within the fixed-route service area and a person who is capable of using the

system .

• Continue to work with Trapeze Systems for upgrades and improvements to intake/dispatch

and management systems for paratransit service.

• Continue to increase revenue through on-board fixed-route advertising, promoting the

voluntary dollar option on vehicle registration renewals, fuel tax refunds, etc.

• Annually review the availability of other transportation providers in Manatee County that may

meet existing needs and gaps in TD transportation services.

• Disseminate Meals on Wheels transportation service information to residents inquiring about

transit services on the east side of the county and passengers with trips that do not qualify

under the TD program.

• Continue to implement multi-loading such as grouping trips to major attractors.

• Utilize off-peak capacity to serve more TD medical trips.

• Encourage TD passengers to schedule non-life sustaining trips during off-peak days/hours

when the Handy Bus system provides fewer trips has additional capacity.

• Complete functional in-person assessments on off-peak days of the week to maximize service

efficiency.

• Continue to request funding for additional Handy Bus operator positions to incrementally

meet growing ridership demand for Handy Bus TD services.

• Increase fixed-route weekday service frequencies to 30 minutes on the Cortez Road corridor.

• Update the Ride Guide and create a separate brochure describing the differences in the ADA

and TD transportation programs.

• Conduct regular travel training workshops and share training approaches with organizations

that serve persons with disabilities.

• Develop incentives, including discounted bus passes, to encourage ADA and TD passengers to

transition to the fixed-route system.


• Increase the use of "feeder" paratransit service to maximize use of the fixed-route system .

• Recertify ADA eligible applicants in areas where "feeder" paratransit service is offered to

determine applicability of eligibility considering access to feeder bus service .

Goal 2: Efficiently and effectively coordinate existing and planned transit service for the

Transportation Disadvantaged population in Manatee County and out-of-county.

Objective 2.1: Continue to coordinate inter-county ADA and TO services with surrounding

counties, with special attention to SCAT Plus service.

Objective 2.2: Explore opportunities to expand the number of agencies that have signed

coordination agreements with the CTC.


• Continue in-person assessment screening for new applicants for Handy Bus service .

• Continue to coordinate with large nursing home facilities to group TO trips to grocery stores

and other destinations.

• Review operating and financial information on a monthly basis for completion of the annual

AOR and Service Plan updates.

• Monitor transportat ion services provided by social service agencies and churches and identify

additional opportun ities for coordination and/or vehicle sharing.

• Continue to offer annual training sessions for coordination contractors on reporting data for

the AOR.

• Notify Coordination Contractors of available TO, FOOT, and Rural Transit Assistance Program

training opportunities.

• Continue to offer technical assistance to agencies in completing and reviewing their

applications for veh icles through the Section 5310 program offered annually by USDOT.

• Continue regularly-scheduled meetings with SCAT to review opportunities for coordination of

transportation services, especial ly for Bill Young/Bay Pines VA passengers.

• Contact at least three human services agencies each year to discuss potential coordination

contract agreements .

• Continue to cross-train operators on all modes to facilitate daily service delivery.

Goal 3: Provide safe, reliable, timely, and courteous transportation services.

Objective 3.1: Continue state-of-the-art Fleet Maintenance "best practices" so the paratransit

fleet continues to provide quality service .


Objective 3.2: Continue ongoing driver training.

Objective 3.3: Maximize customer safety and comfort and continue to conduct "quality of

service" and customer satisfaction surveys.

Objective 3.4: Increase avenues for customers to access information on the coordinated

transportation system.


• Continue to effectively respond to customer service issues and declining address specific

operating performance measures.

• Continue the aggressive vehicle replacement program for paratransit vehicles and equipment

to maintain an updated fleet and equipment using FTA Section 5310 program fund ing.

• Continue to acquire new and upgraded paratransit software and equipment to improve

customer service and operating efficiency.

• Continue active and ongoing implementation of the System Safety Program Plan and Transit

Asset Management program .

• Measure and analyze performance standards as a basis for evaluating quality assurance.

• Continue to apply for Section 5310 program and discretionary grant funds for new and

replacement vehicles.

• Continue to train operators to communicate pertinent traffic information or delays to

Dispatch who can then relay this information to all MCAT operators and implement real -time

camera feeds for quality assurance reviews, incident investigations, and operating efficiency.

• Utilize the IVR system to communicate real -time arrival information to Handy Bus passengers.

• Continue to facilitate improved communication between MCAT and SCAT operators and

supervisors.

• Meet or exceed the 95 percent on-time performance goa l set for CTC service delivery.

• Meet quarterly with the dialysis centers to provide education on the operations process and

how delays affect the overall system performance.

• Schedule dialysis center trip pick-ups for 30 minutes after the customer's appointment time

to reduce the number of customers that are not ready when the veh icle arrives .

• Utilize the new IVR system with a five minute call ahead courtesy call to reduce the number

of customers that are not ready or "No-Show" for their scheduled trip and improve Handy

Bus customer service .

• Evaluate Manatee County Comprehensive Plan Mass Transit Sub-Element Policy 5.6.2.1 and

the projected level of 16.03 annual passenger miles per elderly and disabled person for

paratransit services . Revise pol icy if necessary.


Goal 4: Encourage land use development patterns that support transit services for the provision of a

more cost-effective and efficient transportation system.

Objective 4.1: Improve local knowledge of the benefits of transit-friendly land uses.


• Continue the multi-d isciplined development review process to include the consideration of

impacts on the multi modal transportation system and infrastructure.

• Continue to work with other county departments to ensure land development regulations

that encourage transit patronage through TOO.

• Continue to support land development regulations that require construction of supporting

infrastructure for passenger amenities as part of the approval process for new development.

Goal 5: Improve pedestrian accessibility to multimodal transportation options in Manatee County.

Objective 5.1: Provide opportunities for ADA and TO passengers to safely access multimodal

transportation options.

Objective 5.2: Continue to provide and improve ADA compliant infrastructure and amenities at

bus stops for riders using the fixed -route service .


• Maximize the effect ive transfer of ADA and TO passengers to the fixed -route system through

the use of functional assessments, travel tra ining, paratransit " feeder" service, and

discounted bus passes, to make the fixed-route service acc~ssible and affordable to more

people.

• Continue to ensure a 100 percent accessible f leet.

• Continue to improve each bus stop with ADA accessibility features and passenger seating.

• Continue to ensure that new bus stops are accessible to persons with disabilities and meet

ADA Accessibility Guidelines (ADAAG) compliance requirements.

• Continue to implement consistent on-street display signage (i .e., route schedule information)

with larger lettering to accommodate persons with visual impairments in correlation with

recent branding activities.

• Continue to develop new ADA compl iant bus stop infrastructure and plans for new transit

service corridors along programmed roadway projects in the scop ing and design review

processes.


• Continue to implement a passenger seating program for the placement of benches and

shelters at all bus stops and enhance seating at mixed-land use attractors and major

employment centers, including grocery stores, retail locations, and medical faci lities.

• Continue to install ADA compliant bus stop infrastructure with connections to the sidewalk,

when a sidewalk is already present.

Implementation Schedule Manatee County's Five-Year implementation Plan was derived from the goals, objectives, and

implementation actions presented in the previous section. As shown in Table 15, the implementation

schedule is organized by the focus areas, including funding and efficiency; coordination; service

effectiveness; and accessibility. The plan includes the strategies/improvements to be implemented,

timeframe for completion, responsible party(s), estimated costs, and an area to indicate and track

progress and outcomes for submittal with the TDSP annual updates.

STATE OF FLORIDA COMMISSION FOR THE TRANSPORTATION DISADVANTAGED

MEMORANDUM OF AGREEMENT

This Memorandum of Agreement is between the COMMISSION FOR THE TRANSPORTATION DISADVANTAGED, hereby referred to as the "Commission," and Manatee County Board of County Commissioners. 1108 26th Avenue E. Bradenton, Florida. 34208, the COMMUNITY TRANSPORTATION COORDINATOR, designated pursuant to Chapter 427, F.S., to serve the transportation disadvantaged for the community that includes the entire area of Manatee County(ies), and hereafter referred to as the "Coordinator."

This Agreement is made in consideration of the mutual benefits to both parties; said consideration acknowledged hereto by the parties as good and valuable consideration.

The Parties Agree:

I. The Coordinator Shall:

A. Become and remain totally apprised of all of the Transportation Disadvantaged resources available or planned in their designated service area. This knowledge will be used to plan, coordinate, and implement the most cost effective transportation disadvantaged transit system possible under the economic and other conditions that exist in the designated service area.

B. Plan and work with Community Transportation Coordinators in adjacent and other areas of the state to coordinate the provision of community trips that might be handled at a lower overall cost to the community by another Coordinator. This includes honoring any Commission-approved statewide certification program that allows for intercounty transportation opportunities.

C. Arrange for all services in accordance with Chapter 427, Florida Statutes, and Rule 41-2, FAC, and as further required by the Commission and the local Coordinating Board approved Transportation Disadvantaged Service Plan.

D. Retum any acquired profits or surplus funds originating through the course of business as the Coordinator that are beyond the amounts(s) specifically identified and approved in the accompanying Transportation Disadvantaged Service Plan. Such profits or funds shall be returned to the Coordinator's transportation system or to any subsequent Coordinator, as a total transportation system subsidy, to be applied to the immediate following operational year. The Coordinator will include similar language in all coordination contracts to assure that transportation disadvantaged related revenues are put back into transportation disadvantaged services.

E. Accomplish this Project by:

1. Developing a Transportation Disadvantaged Service Plan for approval by the local Coordinating Board and the Commission. Coordinators who are newly designated to a particular service area shall submit a local Coordinating Board approved Transportation Disadvantaged Service Plan, within 120 calendar days following the execution of the Coordinator's initial memorandum of agreement with the Commission, for approval by the Commission. All subsequent Transportation Disadvantaged Service Plans shall be submitted and approved with the corresponding memorandum of agreement. The approved Transportation Disadvantaged Service Plan will be implemented and monitored to provide for community-wide transportation services for purchase by non-sponsored transportation disadvantaged persons, contracting social service agencies, and other entities that use local, state, or federal government funds for the purchase of transportation for the transportation disadvantaged.

2. Maximizing the use of available public school transportation resources and public fixed route or fixed schedule transit services and assuring that private or public transit, paratransit operators, and school boards have been afforded a fair opportunity to participate to the maximum extent feasible in the planning process and in the development of the provisions of the Transportation Disadvantaged Service Plan for the transportation disadvantaged.

3. Providing or arranging 24-hour, 7 -day per week transportation disadvantaged service as required in the designated service area by any Federal, State or Local Government agency sponsoring such services. The provision of said services shall be furnished in accordance with the prior notification requirements identified in the local Coordinating Board and Commission approved Transportation Disadvantaged Service Plan.

4. Complying with all local, state, and federal laws and regulations that app!y to the provision of transportation disadvantaged services.

5. Submitting to the Commission an Annual Operating Report detailing demographic, operational, and financial data regarding coordination activities in the designated service area. The report shall be prepared on forms provided by the Commission and according to the instructions of said forms.

F. Comply with Audit and Record Keeping Requirements by:

1. Utilizing the Commission recognized Chart of Accounts defined in the Transportation Accounting Consortium Model Uniform Accounting System for Rural and Specialized Transportation Providers (uniform accounting system) for all transportation disadvantaged accounting and reporting purposes. Community Transportation Coordinators with existing and equivalent accounting systems are not required to adopt the Chart of Accounts in lieu of their existing Chart of Accounts but shall prepare all reports, invoices, and fiscal documents relating to the transportation disadvantaged functions and activities using the chart of accounts and accounting definitions as outlined in the above referenced manual.

2. Assuming the responsibility of invoicing for any transportation services arranged, unless otherwise stipulated by a purchase of service contract or coordination contract.

3. Maintaining and filing with the Commission, local Coordinating Board, and all purchasing agencies/entities such progress, fiscal, inventory, and other reports as those entities may require during the period of this Agreement.

4. Providing copies of finance and compliance audits to the Commission and local Coordinating Board as requested by the Commission or local Coordinating Board.

G. Retain all financial records, supporting documents, statistical records, and any other documents pertinent to this Agreement for a period of five (5) years after termination of this Agreement. If an audit has been initiated and audit findings have not been resolved at the end of five (5) years, the records shall be retained until resolution of the audit findings. The Coordinator shall assure that these records shall be subject to inspection, review, or audit at all reasonable times by persons duly authorized by the Commission or this Agreement. They shall have full access to and the right to examine any of the said records and documents during the retention period.

H. Comply with Safety Requirements by:

1. Complying with Section 341.061, F.S., and Rule 14-90, FAC, concerning System Safety; or complying with Chapter 234.051, F.S., regarding school bus safety requirements for those services provided through a school board; and

2. Assuring compliance with local, state, and federal laws, and Commission policies relating to drug testing. Conduct drug and alcohol testing for safety sensitive job positions within the coordinated system regarding pre-employment, randomization, post-accident, and reasonable suspicion as required by the Federal Highway Administration and the Federal Transit Administration.

I. Comply with Commission insurance requirements by maintaining at least minimum liability insurance coverage in the amount of $200,000 for any one person and $300,000 per occurrence at all times during the existence of this Agreement for all transportation services purchased or provided for the transportation disadvantaged through the Community Transportation Coordinator. Upon the execution of this Agreement, the Coordinator shall add the Commission as an additional named Insured to all insurance policies covering vehicles transporting the transportation disadvantaged. In the event of any cancellation or changes in the limits of liability in the insurance policy, the insurance agent or broker shall notify the Commission. The Coordinator shall insure that contracting transportation operators and coordination contractors also maintain the same minimum liability insurance, or an equal governmental insurance program. Insurance coverage in excess of $1 million per occurrence must be approved by the Commission and the local Coordinating Board before inclusion in the Transportation Disadvantaged Service Plan or in the justification of rates and fare structures. Such coverage may be provided by a self-insurance program established and operating under the laws of the State of Florida and written verification of insurance protection in accordance with Section 768.28, Florida Statutes, shall be provided to the Commission upon request.

J. Safeguard information by not using or disclosing any information concerning a user of services under this Agreement for any purpose not in conformity with the local, state and federal regulations (45 CFR, Part 205.50), except upon order of a court, written consent of the recipient, or his/her responsible parent or guardian when authorized by law.

K. Protect Civil Rights by:

1. Complying with state and federal laws including but not limited to laws regarding discrimination on the basis of sex, race, religion, age, disability, sexual orientation, or national origin. The Coordinator gives this assurance in consideration of and for the purpose of obtaining federal grants, loans, contracts (except contracts of insurance or guaranty), property, discounts, or other federal financial assistance to programs or activities receiving or benefiting from federal financial assistance and agreeing to complete a Civil Rights Compliance Questionnaire if so requested by the Commission.

2. Agreeing that compliance with this assurance constitutes a condition of continued receipt of or benefit from federal financial assistance, and that it is binding upon the Coordinator, its successors, subcontractors, transferee, and assignees for the period during which such assistance is provided. Assure that all operators, subcontractors, subgrantee, or others with whom the Coordinator arranges to provide services or benefrts to participants or employees in connection with any of its programs and activities are not discriminating against those participants or employees in violation of the above statutes. regulations, guidelines, and standards. In the event of failure to comply, the Coordinator agrees that the Commission may, at its discretion, seek a court order requiring compliance with the terms of this assurance or seek other appropriate judicial or administrative relief, to include assistance being terminated and further assistance being denied.

L. To the extent allowed by Section 768.28, Florida Statutes, and only to the monetary and other limitations contained therein, indemnify and hold harmless the Commission and all of the Commission's members, officers, agents, and employees; purchasing agency/entity officers, agents, and employees; and the local, state, and federal governments from any claim, loss, damage, cost, charge or expense arising out of any act, action, neglect or omission by the Coordinator during the performance of this Agreement, whether direct or indirect, and whether to any person or property to which the Commission or said parties may be subject, except that neither the Coordinator nor any of its sub-contractors will be liable under this section for damages arising out of injury or damage to persons or property directly caused or resulting from the sole negligence of the Commission or any of its members, officers, agents or employees; purchasing agency/entity, officers, agents, and employees; and local, state, or federal governments. Nothing herein is intended to serve as a waiver of sovereign immunity by any agency/entity or Coordinator to which sovereign immunity may be applicable. Nothing herein shall be construed as consent by a state agency/entity or political subdivision of the State of Florida or the federal government to be sued by third parties in any matter arising out of any Agreement or contract. Notwithstanding the foregoing, pursuant to Section 768.28, Florida Statutes, no agency or subdivision of the state shall be required to indemnify, insure, or assume any liability for the Commission's negligence.

M. Comply with standards and performance requirements of the Commission, the local Coordinating Board approved Transportation Disadvantaged Service Plan, and any purchase of service contracting agencies/entities. Failure to meet the requirements or obligations set forth in this MOA, and performance requirements established and monitored by the local Coordinating Board in the approved Transportation Disadvantaged Service Plan, shall be due cause for non-payment of reimbursement invoices until such deficiencies have been addressed or corrected to the satisfaction of the Commission.

N. Comply with subcontracting requirements by executing or negotiating contracts for transportation services with Transportation Operators and Coordination Contractors, and assuring that the conditions of such contracts are maintained. The requirements of Part 1, Paragraph E.5. through M are to be included in all contracts, subcontracts, coordination contracts, and assignments made by the Coordinator for services under this Agreement. Said contracts, subcontracts, coordination contracts, and assignments will be reviewed and approved annually by the Coordinator and local Coordinating Board for conformance with the requirements of this Agreement.

0 . Comply with the following requirements concerning drivers and vehicles:

1. Drivers for paratransit services, including coordination contractors, shall be required to announce and identify themselves by name and company in a manner that is conducive to communications with the specific passenger, upon pickup of each rider, group of riders, or representative, guardian, or associate of the rider, except in situations where the driver regularly transports the rider on a recurring basis. Each driver must have photo identification that is in view of the passenger. Name patches, inscriptions or badges that affix to driver clothing are acceptable. For transit services, the driver photo identification shall be in a conspicuous location in the vehicle.

2. The paratransit driver shall provide the passenger with boarding assistance, if necessary or requested, to the seating portion of the vehicle. The boarding assistance shall include opening the vehicle door, fastening the seat belt or utilization of wheelchair securement devices, storage of mobility assistive devices, and closing the vehicle door. In certain paratransit service categories, the driver may also be required to open and close doors to buildings, except in situations in which assistance in opening/closing building doors would not be safe for passengers remaining on the vehicle. Assisted access must be in a dignified manner. Drivers may not assist wheelchair up or down more than one step, unless it can be performed safely as determined by the passenger, guardian, and driver.

3. All vehicles shall be equipped with two-way communications in good working order and be audible to the driver at all times to the base.

4. All vehicles providing service within the coordinated system, shall have working air conditioners and heaters in each vehicle. Vehicles that do not have a working air conditioner or heater will be scheduled for repair or replacement as soon as possible.

P. Comply with other requirements as follows:

1. Transport an escort of a passenger and dependent children as locally negotiated and identified in the local Transportation Disadvantaged Service Plan.

2. Determine locally in the Transportation Disadvantaged Service Plan, the use, responsibility, and cost of child restraint devices.

3. Transport with the passenger at no additional charge, passenger property that can be carried by the passenger and/or driver in one trip and can be safely stowed on the vehicle. Additional requirements may be negotiated for carrying and loading rider property beyond this amount. Passenger property does not include wheelchairs, child seats, stretchers, secured oxygen, personal assistive devices, or intravenous devices.

4. Provide shelter, security, and safety of passengers at vehicle transfer points.

5. Post a local or other toll-free number for complaints or grievances inside each vehicle. The local complaint process shall be outlined as a section in the local Transportation Disadvantaged Service Plan including advising the dissatisfied person about the Commission's Ombudsman Program as a step within the process as approved by the local Coordinating Board.

6. Provide out-of-service-area trips, when determined locally and approved by the local Coordinating Board, except in instances where local ordinances prohibit such trips.

7. Keep interior of all vehicles free from dirt, grime, oil, trash, tom upholstery, damaged or broken seats, protruding metal or other objects or materials which could soil items placed in the vehicle or provide discomfort for the passenger.

8. Determine locally by the local Coordinating Board and provide in the local Transportation Disadvantaged Service Plan the billing requirements of the Community Transportation Coordinator. All bills shall be paid to subcontractors within 7 calendar days after receipt of said payment by the Coordinator, in accordance with Section 287.0585, Florida Statutes.

9. Maintain or have access to a passenger/trip database on each rider being transported within the system.

10. Provide each rider and escort, child, or personal care attendant adequate seating for paratransit services. No more passengers than the registered passenger seating capacity shall be scheduled or transported in a vehicle at any time. For transit services provided by transit vehicles, adequate seating or standing space will be provided to each rider and escort, child, or personal care attendant, and no more passengers than the registered passenger seating or standing capacity shall be scheduled or transported in a vehicle at any time.

11. First Aid shall be determined locally and provided in the local Transportation Disadvantaged Service Plan.

12. Cardiopulmonary Resuscitation shall be determined locally and provided in the local Transportation Disadvantaged Service Plan.

II. The Commission Shall:

A. Recognize the Coordinator as the entity described in Section 427.011(5), Florida Statutes, and Rule 41-2.002(4), F.A.C.

B. Attempt to insure that all entities with transportation disadvantaged funds will purchase transportation disadvantaged services through the Coordinator's system.

Ill. The Coordinator and the Commission Further Agree:

A. Nothing in this Agreement shall require the Commission to observe or enforce compliance with any provision thereof, perform any other act or do any other thing in contravention of any applicable state law. If any of the provisions of this Agreement is found by a court of law to violate any applicable state law, the purchasing agency/entity will at once notify the Commission in writing in order that appropriate changes and modifications may be made by the Commission and the Coordinator to the end that the Coordinator may proceed as soon as possible with the provision of transportation services.

B. If any part or provision of this Agreement is held invalid, the remainder of this Agreement shall be binding on the parties hereto.

C, Termination Conditions:

1. Termination at Will - This Agreement may be terminated by either party upon no less than thirty (30) days notice, without cause. Said notice shall be delivered by certified mail, return receipt required , or in person with proof of delivery.

2. Termination for Breach - Unless the Coordinator's breach is waived by the Commission in writing, the Commission may, by written notice to the Coordinator, terminate this Agreement upon no less than twenty-four (24) hours notice. Said notice shall be delivered by certified mail, return receipt requested, or in person with proof of delivery. Waiver by the Commission of breach of any provision of this Agreement shall not be deemed to be a waiver of any other breach and shall not be construed to be a modification of the terms of this Agreement, and shall not act as a waiver or estoppel to enforcement of any provision of this Agreement. The provisions herein do not limit the Commission's right to remedies at law ·or to damages.

D. This agreement .will expire unless an extension is granted to the Coordinator in writing by the Commission, in accordance with Chapter 287, Florida Statutes.

E. Renegotiations or Modifications of this Agreement shall only be valid when they have been reduced to writing, duly approved by the Commission, and signed by both parties hereto.

The Manatee County Board of County Commissioners (BoCC) is a loca l government entity and serves as the Community Transportation Coordinator (CTC) for Manatee County. The Manatee County Transit Division is under the jurisd iction of the BoCC, and the Transit Divis ion Manager reports to the Manatee County Publ ic Works Department Deputy Director for Field Operations. Under the direction of the Publ ic Works Department, the Transit Division is responsible for carrying out CTC day-to-day activities. The Transit Division has served in this role since ~990, with the most recent Memorandum of Agreement (MOA) signed by the BoCC and the Florida Commission for t he Transportation Disadvantaged (FCTD) in September 20~6 . In addit ion to its CTC responsibilit ies, Manatee County also serves as the fixed -route publ ic transportat ion service provider for Manatee County. In that role, the County directly operates all of the Americans with Disabilities Act (ADA) complementary transportation service requ ired for fixed -route operators . As the designated rec ipient of FTA Section 5307/5339 funding, the County supports fixed-route and demand response public transportation services throughout the County, inclusive of Title VI communities, persons with disabil ities, the elderly, and services for veterans to Veterans hospitals in Manatee, Pinellas, and Hillsborough Counties.

The Manatee County Transit Division strives to improve the qua lity of life for County residents and visitors by providing, in a cost efficient manner, a read ily-accessible, intermodal means of mobility, and by providing alternative means of transportation that minimizes the impacts of traffic congestion on major roads in Manatee County. The Transit Divis ion's objectives are to mainta in and improve the ava ilability and efficiency of service, upgrade passenger service and amenities, properly mainta in transit facil ities and equipment though ongoing preventative maintenance programs, offer advanced technology, marketing, transportation planning coord ination, and ensure adequate fund ing and public involvement opportunit ies.

Operations funding for the Manatee County Transit Division's transportation programs include local tax revenues, state, and federal fund ing sources including the state Transportation Disadvantaged program, FTA Section 5307, the County general fund, and fare box collections. Of the different sources of funding, the largest share of operations fund ing comes from the County general fund .

(e) How does your agency ensure that passengers are eligible recipients of 5310-funded transportation service?

The Transit Division administers two programs for eligible recip ients of 5310-funded transportation service. Those two programs include the Transportation Disadvantaged (TD) program for transportation disadvantaged persons and the Americans with Disabilities Act (ADA) program for persons with disabilities. The programs have varying eligibility requ irements and eligibility determinations for both programs are conducted by the Transit Division Paratransit Coordinator based on the corresponding program rules . Separate applications, separate informational and educat ional materials, and separate operating procedures and reporting processes are maintained for each program and Reservationists, Supervisors, and Operators are trained on the specific requ irements of each .

As the governmental authority for Manatee County, the Manatee County BoCC is responsible for provision of a number of publ ic services throughout the County. The County service area is broad and inclusive of a variety of communities, including high-end and low-income residential areas, commercial, industrial, and rural/agricultural areas. The 2016 US Census population estimate for Manatee County was 375,888, and of that population, approximately 29 percent are minority persons.

The Manatee County Transit Division makes a deliberate effort to ensure that a high level of service and quality amenit ies and equipment are directed to minority communities . This is consistent with the Transit Division Title VI Program which was recently updated and submitted to the Federal Transit Administration in 2016. That Title VI program includes specific policies and procedures for ensuring no disproportionate impacts are experienced by minority populations in regards to service orfare changes and outlines a plan for ensuring persons with limited Eng lish proficiency have equal access to County transportation services.

There are 105 approved transit operator positons in the Manatee County Public Works/Transit

Division FY 2017/18 Operating Budget.

Each transit operator is cross-trained to have the capability to work the full array of transit, trolley

and paratransit vehicles and services; and all Operators have a current Florida Commercial Driver's

License (COL) with a Passenger Endorsement.

Service. Service hours for ADA and Agency trips are a complement to fixed route services, and each trip request conforms to the days/hours of fixed route service ava ilability. The paratransit service currently consists of an average oftwenty-two (22) dai ly routes. Trip types include Medical, Dialysis, Life-Susta ining, Casual, Schoo l, Work, Adu lt Day Faci lity, Manasota Lighthouse, Food and Nutrition.

In Fiscal Year (FY) 20~6/~7, the Transit Division provided a total of ~00,923 paratransit trips . The vast majority of these trips are split between ADA and Transportation Disadvantaged (TD) el igible cl ients, with ADA receiving approximately 44 percent of the trips and 28 percent transportation disadvantaged. The remaining 28 percent of trips benefit sponsoring agencies including Vocational Rehabil itation, Agency for Persons with Disabil ities, and Community Care for the Elderly. Manatee County also provides loca l transportat ion funding for area Veterans requiring medical treatment .

In FY 2015/~6, 99% of Transit Division paratransit trips were provided to the elderly and persons with disabi lities . The remaining ~% of trips serve area Veterans requiring me.dical services at area Veterans Administration (VA) Hospitals in St . Petersburg and Tampa . Wh ile some of these Veterans also include the elderly and persons with disabilities, th is service is funded by Manatee County as a public service to assist veterans irrespective of age or disability status in appreciation for their ded icated service to the Country.

Staffing. Al l operators are required to complete a six-week comprehensive training program which includes classroom time and in-field supervised driving t ime. Operator train ing consists of vehic le equipment, customer service, sensitivity, blood -borne pathogens, defensive driving, CPR, driver's manual, and as-needed training throughout the year. In add ition, the Transit Division is proactively implementing an eight-hour annual "refresher" training course for all operator supervisors and operators which covers safety training and ADA policies and procedures . All Operators are required to have a current Florida Commercial Drivers Licenses.

Records. Records on system performance are maintained by the paratransit administrative team with the support of the Paratransit Coord inator, customer service staff, and planning staff. Data is generally tracked using scheduling software and needed information not available through a standard reporting tool is extracted and maintained in separate spreadsheet and database formats. Quality contro l of the data is performed dai ly and activity is summarized in monthly, quarterly, and annual reports, some of which are used in presentations to the Local Coordinating Board and Manatee County BoCC.

As the CTC for Manatee County, an Annual Operating Report (AOR) is prepared by Transit Division staff for submittal and review by the Transportation Disadvantaged Local Coord inating Board (TDLCB) wh ich consists of a number of social service organizations whose clients require trips through the coordinated network of services managed by Manatee County, as well as state fund ing agencies . Those reporting requirements are comprehensive and inclusive of a variety of service and financial data that will be used to support Section 53~0 report ing requirements.

Maintenance. Transit Division vehicles are maintained by the Manatee County Fleet Services Division. Transit f leet maintenance occurs at the same location as the transit operations and administrative center. The Fleet Services Division consists of a highly recognized staff and operation, and has rece ived many awards for their exceptional ability in maintaining the County's vehicle fleet. The vehicle Preventive Maintenance program is designed to be performed on roll ing stock, with the intent of maximizing the lifecycle of the fleet, reducing unscheduled repa irs, and capturing all cost with in the maintenance management system. The PM (Preventative Maintenance) cycle intervals vary between 4,ooo to 6,ooo miles. All PM inspections are scheduled ~,ooo miles ahead of time to al low for a grace period and this approach is effective in preventing interruptions in service .

System Safety Plan. The most recent System Safety Program Plan (SSPP) was certified in January 2017. That Plan complies with Florida Administrative Code (FAC) Rule Chapter 14-90 and the certification verifies that all vehicle safety inspections have been performed according to FAC Rule Chapter 14-90.

Drug Free Workplace and Drug and Alcohol Program. The current Drug Free Workplace and Drug and Alcohol Program complies with FTA implementing regulations for recipients of federal funding and is administered by the Manatee County Human Resources Department.

Data Collection Methods. Data is collected through paratransit software programs and can be collected upon request, within a two-week period and up to a thirty (30) day time frame, depending on the level of detail. The tools which are utilized to collect this data are exported and then formatted in an Excel spreadsheet or data-specific reporting tools. All data is collected/transmitted via Wi-Fi connection on vehicles including trip manifest documentation, vehicle/trip mileage, trip type, funding source, and communicated to/from dispatch via Mobile Data Terminals.

This request is for $5oo,ooo in operating assistance to support ADA complementary paratransit service provision, support eligible Transportation Disadvantaged (TO) services which are not currently funded through the Florida Commission for the Transportation Disadvantaged (CTD), ma intain the existing level of service to clients by Manatee County Area Transit (MCAT), and provide for mobil ity management through the Handy Bus client elig ibility and certification process.

Over the last two years, the Transit Division has expanded service on the fi xed route bus network and new "feeder" paratransit service was added . In fact, new service was added along US Highway 41. in northern Manatee County and along SR 70 from DeSoto Station to a Walmart near l-75, new MCAT Route 1.2 . Growth in the fixed-route service network has increased the ADA complementary paratransit service area . This grant will help to meet the growing ADA service needs in that larger service area .

Importantly, in December 201.5, Transit Division staff determined that operational resources (buses and bus operators) were at a sustainable capacity limit of approximately 350 trips per weekday, and, consequently, implemented an effort to limit Handy Bus reservat ions to that level. That effort was taken in response to the unsustainable growth in Handy Bus ridersh ip demand wh ich increased by 20 percent between FY 1.3 and FY 1.5 . Average weekday ridersh ip levels rose to over 400 daily trips in October 201.5 and the agency incurred large overtime costs in order to meet demand . To alleviate some of the burden on operators and staff, the Transit Division implemented stricter trip prioritization and TO eligibility procedures in FY 201.6 .

The demand for paratransit services in Manatee County has put a strain on the Transit Division's Handy Bus operation as it continues to grow and the ability to ma intain high customer satisfaction levels has become increasing ly difficult. To alleviate some of the workforce stress and mitigate some ofthe overtime expenses, the Manatee Board of County Commissioners approved the addition of an operator "extra board" in the FY 201.8 budget. The extra board size was based on an analys is of staffing and service levels and was authorized to match only the existing service levels on paratransit and fi xed-route services, with no new added service. Over the last several months, Manatee County Transit Division staff have been working to fill that extra board with qualified operator staff but has yet to fill the full operator roste r board . Consequently, daily pu ll outs still require overtime work. This grant will further assist the Transit Division meet defined service levels for the Handy Bus service, maintain a high level of customer satisfaction, and support efforts to reduce workforce stress.

The program will continue but will not be able to fully meet the number of non-sponsored demand response trip requests. As a result, trip denials may increase and a procedure for prioritizing TD trips will be required . It is antic ipated that prioritizing trips will impact the ability of some Handy Bus clients to complete their needed everyday life-sustaining activities .

13 It will notify FDOT and request assistance if a vehicle would become unserviceable .

15 It will undergo a triennial review and inspection by FDOT to determine compliance with the

baseline requirements. If found not in compliance, it must send a progress report to the local

Exhibit J: Standard Lobbying Certification

The undersigned Manatee County Board of County Commissioners/MCA T certifies, to the best of his

or her knowledge and belief, that:

~ No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned,

to any person for influencing or attempting to influence an officer or employee of an agency,

a Member of Congress, an officer or employee of Congress, or an employee of a Member of

Congress in connection with the awarding of any Federal contract, the making of any Federal

grant, the making of any Federal loan, the entering into of any cooperative agreement, and

the extension, continuation, renewal, amendment, or modification of any Federal contract,

grant, loan, or cooperative agreement.

complete and submit Standard Form--LLL, "Disclosure Form to Report Lobbying," (a copy the

form can be obtained from FDOT's website) in accordance with its instructions [as amended

by "Government wide Guidance for New Restrictions on Lobbying," 61 Fed . Reg . 1413

(1/19/96). Note: Language in paragraph (2) herein has been modified in accordance with

Section 10 of the Lobbying Disclosure Act of 1995 (P.L. 104-65, to be codified at 2 U.S.C. 1601,

et seq.)]

3 The undersigned shall require that the language of this certification be included in the award

documents for all sub-awards at all tiers (including subcontracts, sub-grants, and contracts

under grants, loans, and cooperative agreements) and that all sub-recipients shall certify and

disclose accordingly.

This certification is a material representation of fact upon which reliance was placed when this

transaction was made or entered into. Submission of this certification is a prerequisite for making or

entering into this transaction imposed by 31, U.S .C. § 1352 (as amended by the Lobbying Disclosure Act

of 1995). Any person who fails to file the required certification shall be subject to a civil penalty of not

less than $1o,ooo and not more than $1oo,ooo for each such failure.

NOTE: Pursuant to 31 U.S. C.§ 1352(c)(1)-(2)(A), any person who makes a prohibited expenditure or fails

to file or amend a required certification or disclosure form shall be subject to a civil penalty of not less

than $1o,ooo and not more than $1oo,ooo for each such expenditure or failure.
