The sale of tickets on City sidewalks and from vehicles parked on City streets is prohibited,

except that tickets may be sold from the buses operating on the franchise routes. The

location and method of ticket sales at the airports are subject to Port Authority approval.

DOT reserves the right to disapprove the method or location of ticket sales.

Section VI – Proposal Evaluation and Contract Award Procedures 2. Evaluation Criteria Paragraph 3 is hereby amended to read as follows:

3. The amount of service proposed as follows:

a. Equipment (Section V, A, 5.a.1)

b. Vehicle maintenance, including fueling, cleaning, preventive maintenance, repair,

and storage services and facilities (Section V, A, 5.b.2)

c. Safety related services (Section V, A, 5.c.3)

d. Service Schedule (Section V, A, 5.e.5)

e. Ancillary services (Section V, A, 5.f.6)

Answers to Written Questions: Routes, Schedules, and Equipment Question: Can you describe the “Environmental and Land Use Review” process? Do you know what the typical expense would be for the review? Answer: The City of New York (the “City”) has determined that the routes and schedule of service described in the RFP do not require environmental or land use review because they are substantially the same as under the current franchise. Substantial changes to the route or significant increases in the schedule of service could require environmental review. In addition, changes to the route could be subject to the Uniform Land Use Review Procedure (“ULURP”). Proposers are advised to consult with a land use attorney if they are considering proposing routes different from those described in the RFP or substantially more frequent service than under the current franchise. Question: What is the annual mileage?

Answer: The Department of Transportation (“DOT”) does not have that information. Question: What emission technology is DOT looking to be used to service the contract?

Answer: This is addressed in RFP Section III – Scope of Services, Equipment and Vehicle Standards. The specific type of emission technology will be one of the factors considered in the evaluation of proposals. Question: How many vehicles must have wheel chair lifts and must be ADA compliant? Answer: All vehicles must be compliant with the Americans with Disabilities Act, as stated in RFP Section III – Scope of Services, Equipment and Vehicle Standards. Tickets, Fares and Compensation Question: The RFP refers to existing and proposed maximum fare levels for the services. Can you outline the procedures for establishing these fares, and the process for future adjustments? Answer: The maximum one-way fares under the current franchise are listed in the RFP:

Route MQ-1: $12.00 Route MQ-2: $15.00 Route Q-53: $13.00

In accordance with the Authorizing Resolution, the RFP sets a “uniform maximum fare” of $18 per ride. In addition, the RFP suggests maximum one-way fares for each route as follows:

Route MQ-1: $14.50 Route MQ-2: $18.00 Route Q-53: $15.00

These are suggested maximum one-way fares, and proposers may propose to charge different fares as long as they do not exceed the uniform maximum fare of $18 per ride. As stated in the RFP, each proposer should propose a fare structure based on its knowledge of the market and competing services providing transportation to the airports. The proposed fare structure may include reduced fares for special populations and other reduced fares. The uniform maximum fare will be incorporated into the franchise contract between DOT and the selected proposer and will be subject to the approval of the Franchise and Concession Review Committee (“FCRC”). Subsequent changes to the uniform maximum fare will be subject to the approval of DOT and the FCRC. Changes to any other aspect of the fares or fare structure shall be subject to the prior written approval of DOT.

Question: In Section IV – Revenue and Compensation, the RFP indicates tickets can’t be sold from “Vehicles parked on city streets”. Does this include bus drivers selling tickets from their bus? Answer: See amendment to Section IV (above). Question: Does “Gross Revenue” include advertising revenue? Answer: Yes. See pp. 11-12 of the RFP.

Question: Can we get a more detailed breakdown of ridership – such as weekly, monthly, time of day, etc.? Answer: See attached.

Question: Do you know how many “Commuter Books” were sold by the current bus company? Answer: DOT does not have this information.

Question: The current franchisee has a “Grand Central Terminal Office.” Would that be available to the new franchisee? Answer: The existing franchisee rents the current ticketing space. That lease/ arrangement is not under the jurisdiction of the City of New York.

Question: Is there an assumable location for ticket sales? Answer: The selected franchisee will be responsible for determining how and where tickets will be sold. DOT reserves the right to disapprove the method or location of ticket sales.

Question: What is the current percent of passenger revenue and advertising revenue paid to the City as franchise fee?

Answer: The current percentage paid to NYC/DOT is 2% of gross revenues from fares, interior advertising and any other source and 5% of exterior advertising revenue. General Question: Will the City consider awarding to multiple franchisees to serve different sections of the routes?

Answer: No.

Question: The RFP refers to the subject franchise as 'non-exclusive'; can you provide information on any other authorized services between Manhattan and the airports?

Answer: In accordance with the Authorizing Resolution, the RFP refers to a ”non-exclusive franchise.” DOT has no current plans to award more than one franchise along the routes described in the RFP. Other transportation providers between Manhattan and the airports include the MTA New York City Transit’s subways and buses, the Port Authority of New York and New Jersey’s AirTrain, various shuttle services licensed by PANYNJ, taxis and limousines. None of the above is under the jurisdiction of DOT.

Additional Information: A copy of the attendance sheet from the Pre-proposal Conference held on April 12, 2010, is attached. DOT intends to issue an additional addendum containing answers to questions asked at and after the Pre-Proposal conference. Except as modified herein, all terms and conditions of the RFP are unchanged and remain in full force and effect. Attachment
