The Bureau of Energy Efficiency (BEE) intends to appoint agencies for capacity building of
local service providers in 12 different clusters as mentioned in the clause 2.1, under the
GEF-UNIDO-BEE project.
The “Request for Proposal (RfP)” applies to all firms having a proven track record in the field
of energy efficiency and market research with required knowledge, expertise, capabilities
and sufficient resources to undertake training of the LSPs in order to be able to provide the
local services in the setting of energy efficiency projects in the clusters and to prepare
bankable DPRs. Detailed information regarding the services required is given in the section
3 - terms of reference (ToR).

2 BACKGROUND INFORMATION
2.1 About the project
Bureau of Energy Efficiency (BEE), a statutory body under Ministry of Power, Government of India, in collaboration with United Nations Industrial Development Organization (UNIDO) is executing a Global Environment Facility (GEF) funded national project “Promoting energy efficiency and renewable energy in selected MSME clusters in India”. Presently the project is being executed in following 12 clusters in 5 varied sectors:

2.2 Project objective
The aim of the project is to develop and promote a market environment for introducing energy efficiencies and enhanced use of renewable energy technologies in process applications in 12 selected energy-intensive MSME clusters in India with expansion to more clusters later. This is to improve the productivity and competitiveness of units, as well as to reduce overall carbon emissions and improve the local environment.

Increasing the level of end-use demand and implementation of EE and RE technologies and practices by MSMEs.
Scaling up of the project to a national level.

3 TERMS OF REFERENCE
3.1 Scope of work
Identification and development of a cluster wise exhaustive list of minimum 30
local service providing firms in consultation with all the local industrial associations
(LSPs may include but not limited to local fabricators, technicians, maintenance
operators, technology providers, biomass suppliers, solar collectors and PV system
suppliers)
Mapping of LSPs based on demand & supply needs of local industries against
available LSPs in each cluster and nearest locations
Assessment of present capacity, strengths, weakness and training needs of LSPs in
all aspects for provide assistance and advice to MSMEs within the sectors for
promotion of EE/RE technologies and maintaining sustainable market linkages
Development of customized training material for five categories (i.e. technology
providers, EE and RE system suppliers, fabricators, maintenance operators,
technicians) of LSPs based on
o Existing skill set
o Education level
o Type of service/technology
o Available EE/RE technologies
o Cluster need and requirements
Organizing 4 one-day training/capacity building workshops (includes class room
sessions and on-field practical application demonstrations) for LSPs in each cluster,
except Sikkim where only 2 workshops will be organized. The motive of the
workshops is to train minimum of 80 participants through four workshops for
better delivery of their jobs and promotion of EE/RE technologies and BOPs. In each
workshop, a minimum of 20 participants are envisaged. Post training, the LSPs
should be able to learn EE/RE technology options and its potential in the cluster,
local industrial needs and also able to prepare bankable DPR
Finalization of two to three major LSPs and provide facilitation in becoming a local
distributors to original EE/RE technology providers in each cluster. Majorly the
facilitation work involves identification of potential LSPs, organizing meetings with
EE/RE technology providers and hand holding support in becoming local
distributers
Development of 10 bankable DPRs for each cluster, based on mapping technology
needs with capacities of local technology suppliers/service providers, applications
to banks in each cluster. Out of 10 DPRs, not more than 2 DPRs should be prepared
on single technology and one DPR for one unit;

3.5 Bidding
To prevent any single agency from taking up more tasks than practically deliverable
within the time-line and thus assure timely delivery, each bidding agency shall be
allowed to undertake work in 3 clusters at most. However each bidding agency is
necessarily required to make financial bids for all 12 clusters.
The financial bids of agencies found technically suitable shall be opened in
alphabetical order sector-wise, cluster-wise and agency-wise. The final selection of
the agency shall be decided on L-1 basis.
Once a particular agency is declared as L-1 for any three clusters, the same agency
shall be stopped from taking further participation in the bid process.
However, if only two agencies are left for bidding in remaining cluster(s), then in
that case all the agencies shall be once again allowed to participate in the bidding
process.
The financial bids of the technically not suitable agencies shall not be opened and
will be returned after completion of the tendering process.

3.6 Pre-bid meeting
A pre-bid meeting shall be organized on 11th March, 2017 at 1100 hrs at BEE office for the
interested agencies/bidders to discuss and clarify any concerns which bidders may have
with the documents required, scope of work and other details of the requirement of work.

3.7 Terms of payment
BEE shall process the payment after the receipt of the invoice at the each stage. The
payment process might take some extra time. However, work shall not be affected due to
payment related process.

4 ELIGIBILITY CRITERIA FOR BIDDING AGENCY
The agency interested in the above work must fulfil the following eligibility criteria for
participation in the bidding process:
Must be a firm/company registered/incorporated in India.
Must be reputed agency/organizations with credible background with at least 4 years
of experience in field of energy efficiency and capacity building training in MSME
clusters similar to Brass, Ceramic, Dairy, Foundry and Hand tools sector.
Agency must have carried out at least 50 detailed energy audits in above sectors and
should have sufficient experience in preparation of high quality detailed project
reports, case studies & visual dissemination training material in above sector.
Should have been profitable over last three financial years with minimum annual
turnover of INR 5 Crore (or its equivalent in foreign currency) from EE consulting or
energy auditing in last three (3) financial years i.e. FY 2013-14, FY 2014-15 and FY
2015-16.
The agency must have at least 2 sector experts having experience of more than 10
years in carrying out detailed energy auditing, providing training and implementation
of EE technologies & techniques.
Consultant/agency may form consortium with other firm (not more than one firm) in
the form of joint venture. It should be clearly indicated whether the RfP is submitted
as Joint Venture or otherwise and a copy of MOU in this regard, prepared on a stamp
paper of requisite value, must be submitted. It may be noted that lead partner’s share
cannot be less than 50% and the share of other partner shall not be less than 20%.
BEE will communicate only with the lead partner.
Agency should not have been debarred/ blacklisted by any of the government
organizations/agencies. Further the agency or the partner firm (in case of consortium)
should not be involved in any major litigation that may have an impact of affecting or
compromising the delivery of services as required under this contract.
Agency should have at least 10 nos. of professional manpower on pay-role and out of
which at least two professional should be Accredited Energy Auditor and four
professional should be Certified Energy Auditor/Manager. A photocopy of the
certificates of BEE Accredited Energy Auditor and Certified Energy Auditor/Manager
should be enclosed as proof.

5 GENERAL TERMS AND CONDITION
5.1 Cost of RfP
The agency shall bear all costs associated with the preparation and submission of its RfP. BEE will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the tendering process.
5.2 Contents of the RfP
The agency is expected to examine all instructions, forms, terms & conditions and scope of work in the RfP document. Failure to furnish all information required or submission of an RfP document not substantially responsive to the RfP in every respect will be at the agency’s risk and may result in the rejection of the proposal.
5.3 Language of RfP
The technical proposal and financial bids submitted by the agency and all correspondence and documents relating to this assignment exchanged by agency and BEE shall be written in English language, provided that any printed literature furnished by the agency may be written in another language so long the same is accompanied by an English translation in which case, for purposes of interpretation, the English translation shall govern.
5.4 Amendment of RfP
At any time prior to the last date for receipt of bids, BEE, may, for any reason, whether at its own initiative or in response to a clarification requested by a prospective agency, modify the RfP document by an amendment. In order to provide prospective agency reasonable time in which to take the amendment into account in preparing their bids, BEE may, at their discretion, extend the last date for the receipt of bids and/or make other changes in the requirements set out in the invitation for proposals.
All future information regarding amendments and/or clarifications shall be uploaded on the BEE website (www.beeindia.gov.in) only.
5.5 Power of attorney
The "Consultant" as used in this RfP shall mean the one who has signed the RfP document forms. The Consultant should be the duly Authorized Representative of the agency/organization, for which a certificate of authority will be submitted. All certificates and documents (including any clarifications sought and any subsequent correspondences) received hereby, shall, as far as possible, be furnished and signed by the Authorized Representative.
The power or authorization, or any other document consisting of adequate proof of the ability of the signatory to bind the Consultant shall be annexed to the bid. BEE may reject outright any proposal not supported by adequate proof of the signatory’s authority.

5.6 Force Majeure
Force Majeure shall mean and be limited to the following: a) War/hostilities b) Riot or Civil commotion c) Earthquake, flood, tempest, lightening or other natural physical disaster. d) Restrictions imposed by the Government or other statutory bodies which prevents or
delays the execution of the Contract by bidder.
In the event of any force majeure cause, the bidder or the BEE shall not be liable for delays in performing their obligations under this order and the completion dates may be extended, for a period not exceeding the period of delay attributable to the causes of force majeure. Neither BEE nor bidder shall be liable to pay extra costs provided it is mutually established that force majeure conditions did actually exist.
5.7 Indemnity
The Bidder shall at all times, indemnify and keep indemnified BEE and its officers/ employees, from and against all/any claims whatsoever, arising as a consequence of, or in the course of execution of the work (including but not limited to property loss and damage, personal accident, injury or death of or to property or person of the agency or any JV partner or subcontractor, and/or the servants or agents of the ENERGY AUDIT FIRMS, or any other JV partner or any sub-contractor and/or of the Bureau of Energy Efficiency).
5.8 Confidentiality
BEE shall hold the copyrights over any of the data collected or compiled during the course of the work. The agency/agencies selected for the work will have to maintain the confidentiality of the information compiled. In no case the agency/agencies would be allowed to use the data or share the information with anyone else without written permission by BEE.
5.9 Copyright
BEE will hold the copyrights over any of the data collected, documents, DPRs, reports, training materials etc. prepared under or as a part of this assignment.
5.10 Disqualification
BEE at its sole discretion and at any time during the process of bidding may disqualify any bidder from the tendering process if the bidder has –
Submitted the proposal after the schedule date and time.
Firms not meeting eligibility criteria.
Made misleading or false representations in the forms, statements and attachments submitted in proof of the eligibility requirements.

If found to have a record of poor performance such as abandoning works, not properly completing the contract, inordinately delaying completion, being involved in litigation or financial failures, etc.
Failed to provide clarifications related thereto, when sought.
5.11 Termination of contract
Bureau has its rights under the conditions of this RfP to terminate the contract of the agency at any time. The contract may also be terminated if the agency’s performance or competence fails to meet the standards required for the assignment.
5.12 Others
BEE reserves the right to cancel the RfP process at any time/stage or relax/amend/withdraw any of the terms and conditions relating to scope of work, deliverables, time-line, eligibility criteria etc. without giving any reason whatsoever. No enquiry, after submission of the quotation, shall be entertained.
5.13 Disclaimer
BEE and/or its officers, employees disclaim all liability from any loss or damage, whether foreseeable or not, suffered by any person acting on or refraining from acting because of any information including statements, information, forecasts, estimates or projections contained in this document or conduct ancillary to it whether or not the loss or damage arises in connection with any omission, negligence, default, lack of care or misrepresentation on the part of BEE and/or any of its officers, employees. Except where otherwise specified in the contract, the decision of BEE shall be final, conclusive and binding on all the agencies upon all questions relating to the meaning of the RfP specifications, scope of work, terms & conditions etc. herein before mentioned or thing whatsoever in any way arising or relating to the contract, specifications, terms & conditions, orders, or otherwise concerning the works or the execution or failure to execute the same, whether arising, during the progress of the work or after the completion or abandonment thereof. Further, BEE shall not be responsible for non-receipt / non-delivery of the proposals due to any reason whatsoever.

6 PROPOSAL
6.1 Preparation of proposal
The agencies are requested to submit technical proposals and financial bids as detailed in
the subsequent clauses.
Technical Proposal:
The technical proposal shall comprise the following components:
RfP Form 1: RfP letter proforma (refer section 7).
RfP Form 2: Prior experience (refer section 7.1.1).
RfP Form 3: Resumes of the members in the proposed team (refer section 7.1.2).
RfP Form 4: Eligibility & other details (refer section 7.2).
RfP Form 5: Capability statement including the proposed team structure etc. (refer
section 7.3).
RfP Form 6: Approach & methodology (refer section 7.4).
RfP Form 7: Time schedule & work-plan (refer section 7.5)
RfP Form 8: Registered Power of Attorney executed by the agency in favour of the
principal officer or the duly authorized representative, certifying him/her as
an authorized signatory for the purpose of this document.
Financial Bids:
Financial offer should only indicate price without any condition or qualification whatsoever
and should include all taxes, duties, fees, levies, and other charges levied by central, state
or other government bodies, as may be applicable in relation to activities proposed to be
carried out. If there would be any increase in the taxes, levies, duties, fee and other charges
during the tenure of the contract, the financial burden of the same shall be borne by the
bidder. The financial offer in respect of the above assignment must be valid for 120 days
from the closing date for submission of proposals. Bidders should express the price of their
services in Indian currency only. It is to be noted that in case of any mismatch between the
numeral value and the value mentioned in words, the value mentioned in words shall be
accepted to be the final quote.
The financial bids must be submitted in the format specified at section 7.6.

6.2 Submission of proposal
The proposal shall be typed and signed by the head or a person duly authorized to bid by
bidder agency. All pages of the offer, except for un-amended printed literature, shall be
initialled by the person or persons signing the offer. The original hard copy of the complete
set of technical proposal & financial bids shall be putted in different sealed envelopes

The technical proposal documents should be submitted in original + three copies and must
be delivered to - Secretary, Bureau of Energy Efficiency, 4th Floor, Sewa Bhawan, Sector -1,
R.K. Puram, New Delhi-110066 latest by 1300 hrs on 28/04/2017. Non-compliance to the
above process will be liable to rejection.
BEE shall not be responsible for non-receipt / non-delivery of the bids due to any reason
whatsoever. Consultants are advised to study the RfP document carefully. Submission of
bids shall be deemed to have been done after careful study and examination of the RfP
document with full understanding of its implications.
6.3 Preliminary scrutiny
Preliminary scrutiny of the proposal will be made to determine whether they are complete,
the documents have been properly signed, and the bids are in order. Proposals not
conforming to such preliminary requirements will be prima facie rejected.
6.4 Evaluation of the proposal Each bidder would be required to comply with the requirements of section 4 and should
agree in-principal with the scope of work mentioned in section 3. The technical evaluation
would be done as per the criteria mentioned below. The agencies shall be ranked in
accordance with these criteria and minimum technically qualifying score shall be 70.

6.5 Selection of the bidder
To assist in the scrutiny, evaluation and comparison of offers, BEE, at its discretion, may ask for any technical clarification/presentation to be submitted by the agency. BEE reserves the right to analyse and alter the evaluation/selection criteria.
The financial bids shall be opened only for technically pre-qualified bidders and such bidders shall be informed, through e-mail or telephone, to attend the opening of financial bids at the BEE office, on the date and time to be informed at a later stage. The process for opening the financial bids shall be as per clause 3.5.
The financial bid should only include a lump sum quote, inclusive of all taxes, for the aforesaid work in the cluster. It is to be noted that in case of any mismatch between the numeral value and the value mentioned in words, the value mentioned in words shall be accepted to be the final quote. The contract will be awarded to the lowest price bidder.
For those bidders whose proposals did not meet the minimum qualifying marks under technical evaluation or were considered non-responsive to the terms of reference, the financial proposals will be returned unopened after completion of the selection process.

On completion of the evaluation of the technical and financial offers, BEE shall issue Letter of Intent (LoI) to the selected bidder.
Upon the acceptance of the LoI by the successful bidders, BEE shall issue work order. Within ten days of receipt of the work order, the selected bidder shall enter into a contract with the BEE in the prescribed format. The selected bidder shall also commence the work within fifteen days from the date of issue work order.
If the bidder, upon selection, fails to enter into a contract, BEE may invite the technically qualifying bidder who has financially ranked next/lower for financial negotiations to award the work. Further BEE may also exclude the former from all future assignments.
