PROPOSAL REQUIREMENTS CHECKLIST

The following checklist should be used to ensure a complete proposal. Submissions should be limited to no more than twelve (12) pages (except for resumes, company brochures, title page, table of contents, Proposal Form).

All proposals shall contain, at a minimum, the following information (in envelope No. 1):

This RFP document is not intended to limit Proponents' submissions, but rather to provide a framework for Dufferin County to evaluate each proposal and determine which most closely addresses our needs. The lowest proposed cost proposal will not necessarily be accepted.

Proponents are encouraged to provide any additional information or innovative approaches not specifically outlined in this Proposal.

It is at the Steering Committee's discretion whether or not to consider submissions from applicants having applications or having clients with current or previous (1-5 years) planning applications within the County or local municipalities.

Fee Structure

Proponents will fully describe their fee structure. The cost estimate should include GST as a separate line item. Also include a list of disbursements and an estimate of their total cost. Alternatively, disbursements may be paid as a percentage of the total fee, in which case the percentage must be identified. One (1) copy of the fee proposal shall be included in envelope No. 2.

1.0 BACKGROUND

Dufferin County is located in south-central western Ontario, and is comprised of 8 local municipalities. Commonly referred to as the headwaters area of Ontario, it provides the source of 5 major river systems in the Province, the Credit, Humber, Grand, Saugeen and Nottawasaga. Dufferin County offers historic towns, scenic rolling rural areas, and a strong agricultural community.

The Corporation of the County of Dufferin is the upper tier level of municipal government for eight local municipalities including;

Town of Mono Town of Orangeville Town of Shelburne Township of Amaranth Township of East Garafraxa Township of East Luther Grand Valley Township of Melancthon Township of Mulmur

Dufferin County is required to undertake a Growth Management Planning Study to address land needs and develop an approach to meeting the conformity standard of the Province's Growth Plan for the Greater Golden Horseshoe, 2006 and other applicable provincial policies, or, in

some cases, setting alternative standards which reflect the local growth and development opportunities available.

1.1 Places to Grow: Growth Plan for the Greater Golden Horseshoe

On June 16, 2006, the Government of Ontario released the Growth Plan for the Greater Golden Horseshoe, 2006. The Plan was prepared under the Places to Grow Act, 2005 and guides decisions related to transportation, infrastructure planning, land-use planning, urban form, housing, natural heritage and resource protection in ways that promote economic prosperity. The Growth Plan builds on other government initiatives including the Greenbelt Plan and the Provincial Policy Statement, 2005. Dufferin County is located within the Greater Golden Horseshoe Growth Plan Area.

The guiding principles of the Growth Plan include;

Build compact, vibrant and complete communities. Plan and manage growth to support a strong and competitive economy. Protect, conserve, enhance and wisely use the valuable natural resources of land, air and water for current and future generations. Optimize the use of existing and new infrastructure to support growth in a compact efficient form. Provide for different approaches to managing growth that recognize the diversity of communities in the GGH. Promote collaboration among all sectors- government, private and non-profit and residents to achieve this vision.

The Growth Plan promotes intensification of the existing built-up-area, with a focus on urban growth centres, intensification corridors, major transit station areas, brownfield sites and greyfields. Dufferin County does not contain 'Urban Growth Centres' as designated by the Growth Plan.

Policy 5.4.2.2 of the Growth Plan states that where planning is conducted by an upper-tier municipality, the upper-tier municipality, in consultation with the lower-tier municipalities, will - allocate the growth forecasts provided in Schedule 3 to the lower-tier municipalities.

The Growth Plan requires all municipalities to develop and implement, through their official plans and other documents, a strategy and policies to phase in and achieve intensification and the intensification target.

The Growth Plan requires that by the year 2015, and for each year thereafter, a minimum of 40 percent of all residential development occurring annually within each upper- and single-tier municipality will be within the built-up-area. For outer ring municipalities, such as Dufferin County, the Minister of Public lnfrastructure Renewal may review and permit an alternative minimum intensification target.

The Plan also requires that the designated Greenfield area of each upper- or smgle-tier municipality will be planned to achieve a minimum density target that is not less than 50 residents and jobs combined per hectare (2.2.7.2). For outer ring municipalities that do not have an urban growth centre, such as Dufferin County, the Minister of Public lnfrastructure Renewal may review and permit an alternative density target.

The Plan also states that settlement area boundary expansions of small cities and towns within the outer ring will plan to maintain or move towards a minimum of one full-time job per 3 residents within or in the immediate vicinity of the small city or town (2.2.8.2(i)).

The Plan requires that where planning is not conducted by an upper-tier government (such is the case in Dufferin County), the affected lower-tier municipalities and the upper-tier municipality will work together to implement the following policies found under Section 5.4.2.2;

Allocate the growth forecasts provided in Schedule 3 to the lower-tier municipalities. ldentify intensification targets for lower-tier municipalities, to achieve the intensification target and density targets for urban growth centres where applicable. Identify density targets for the designated Greenfield areas of the lower-tier municipalities, to achieve the density target for designated Greenfield areas. Provide policy direction on matters that cross municipal boundaries.

The Minister can provide an alternative minimum intensification target, and designated greenfield area density target, if justification can be provided which warrants revised targets.

Other Growth Plan policies requiring coordination at the upper-tier level include: Application of policy 2.2.8 on 'settlement area boundary expansions'

* Consideration of employment land conversions under policy 2.2.6.5 Development of a housing strategy 3.2.6.6, including affordable housing

The Places to Grow Act, 2005 requires that all decisions under the Planning Act or Condominium Act conform to the policies of the Growth Plan as of June 16, 2006. Additionally, the council of a municipality or a municipal planning authority that has jurisdiction in an area to which a growth plan applies shall amend its official plan to conform to the growth plan. Any amendments required to conform to the growth plan shall be adopted before the third anniversary of the date on which the growth plan comes into effect (i.e. by June 16, 2009).

1.2 Planning in the County of Dufferin

The County of Dufferin is one of two upper-tier municipalities in the Greater Golden Horseshoe Plan Area that do not have an upper-tier planning function nor a County Official Plan. Each of the eight area municipalities has its own Official Plan. The Growth Plan for the Greater Golden Horseshoe includes forecasts for the entire County. The County and its eight member municipalities wish to prepare an overall growth management plan in keeping with the intent of the policies of the Growth Plan, while ensuring that growth is managed, and that the sensitive headwaters area of the Province are protected. The goal of the growth management plan is to provide the eight lower-tier municipalities with the information they need to amend their Official Plans and bring them into conformity with the Growth Plan and provide the Minister of Public Infrastructure Renewal with a rationale to consider alternative targets for density and intensification within the County.

1.3 Potential Outcomes

At this time it is intended that this study will conclude with a report to address the issues at the upper-tier level that will help local municipalities bring local official plans into conformity with the

Growth Plan for the Greater Golden Horseshoe, 2006. The growth management plan may include suggested policy language for lower-tier municipalities to use when preparing their Official Plan Amendments. It is assumed that any such implementing amendments would follow the statutory requirements after the growth study is completed. The project Steering Committee will wish to consider any alternative approaches put forward by the planning consultant to work with the Ministry of Public Infrastructure Renewal and Ministry of Municipal Affairs and Housing to see that the provincial interests and those of the municipalities of the County of Dufferin are met.

1.4 Proiect Management

This study will be directed by a Steering Committee comprised of the eight local Chief Administrative OfficerslClerk-Administrators (or their designates), the County C.A.O. and representatives from MPlR and MMAH.

The members of the Steering Committee will be responsible for providing regular updates on the progress of the study to the individual municipal Councils. MPlR and MMAH will be providing regular updates to other interested and affected Provincial Ministries and agencies throughout the course of the study.

Four public open houses, at two separate occasions (following Phase 1 and Phase 2 of the study) are being held to provide the information on the study to the general public, and commentslconcerns raised during the open house sessions will be responded to in the report.

In addition to the public open houses, a joint Council meeting will be held to advise all of the Councils of the results of the studies, commentslconcerns raised at the open houses, and provide direction on future actions required by individual councils.

2.0 TERMS OF REFERENCE

Dufferin County and its member municipalities propose to undertake a Growth Management Planning Study to address land needs and conformity with the Growth Plan, with consideration of other provincial plans and policies (e.g. Greenbelt Plan, Provincial Policy Statement).

2.1 Methodoloav and Timing

The Study is to be completed primarily by a planning consultant, with input from specialized consultants as necessary, in conjunction with input from Municipal, County and Provincial staff before December 31, 2008. The chosen consultant shall develop the final work plan in consultation with the Steering Committee.

The study is proposed to proceed in two phases, as outlined below.

Phase 1: Background Study, Alternative Growth Projections, Growth Management Strategy Options

2.1 .I Backaround Studv

The local municipal planners have completed a detailed inventory of current, available, and possible growth opportunities to meet the intent of the Growth Plan, 2006. The local

municipalities have compiled a GIS map of all Official Plan land use schedules for the County (Orangeville mapping to be in Autocad format). It is expected that the consultant will review, analyze and synthesize the inventory and mapping done to date of:

i. Current population and jobs in the County ii. Existing designated Greenfield areas, including an inventory of registered and

draft approved plans of subdivision, their expected densities, and implications for overall density for the designated greenfield area.

iii. Land availability inside existing built-up areas (i.e. lands inside PIR's draft built boundary), and the opportunities for intensification, both for people and jobs.

iv. Growth potential in rural areas (e.g. inventory of lots of records, severance potential).

v. Designated employment lands and their capacity. vi. Current and planned servicing capacity.

Review mapping of built up areas within settlement areas (as per Proposed Final Built Boundary for the Greater Golden Horseshoe, 2006 -Technical Paper).

Prepare mapping of existing density benchmarks for built up areas and designated greenfield areas.

Utilizing existing available data, provide a schematic overview of servicing systems, servicing capacities, roads, highways, wetlands, valley systems, stream assimilative capacity etc.

2.1.2 Alternative Scenarios for Implementation of the Growth Plan

In consultation with the Steering Committee, prepare three alternative scenarios for implementation of the Growth Plan in Dufferin County, including policy 5.4.2.2: the allocation of schedule 3 Growth Plan forecasts for population and employment to the lower-tiers; intensification capacity; designated greenfield area target; and development of a housing strategy. Scenarios should identify general locations for growth, including population and employment forecasts for lower-tiers based on schedule 3 of the Growth Plan, required infrastructure, intensification rates for lower-tiers and designated greenfield area densities, as well as housing mix and employment options. Identify development, redevelopment, and intensification opportunities. Provide rationale for alternative intensification andlor density targets, if necessary.

2.1.3 Growth Management Stratesv Options

Analysis of three alternative growth scenarios with related maps and graphics. Develop criteria to evaluate options and select preferred option. In consultation with the Steering Committee, develop a consultation plan which may include public open houses or public meetings. Preparation of Information Report to Councils for their review and comment.

Preparation for Public Open House@) with one meeting for the central portion of the County (Shelburne) and one meeting for the southern portion of the County (Orangeville) to present the findings of Phase 1, including the alternative growth projections, and Growth Management Strategy Options. Preparation of a Phase One Findings Report that includes responses to comments raised during the public open house(s) and by any individual Councils.

Phase Two: Selecting and Refining the Preferred Scenario, pol icy plan recommendations

2.2.1 Selectina and Refininq the Preferred Growth Scenario - Evaluate and select preferred option based on analysis of each scenario against criteria identified in phase one and input received from the public, councils and province.

For the preferred option, address the following policy areas to ensure conformity of lower-tier official plans with the Growth Plan:

o Population and employment allocations to lower-tiers to achieve the Growth Plan's schedule 3 forecast of 80,000 residents and 27,000 jobs county-wide by 2031.

o Intensification targets for lower-tiers to implement the Growth Plan's county-wide 40% intensification target or justification for an alternative target as permitted in the Growth Plan for outer-ring municipalities.

o Greenfield density targets to achieve the Growth Plan's county-wide 50 people & jobs per hectare target or justification for an alternative target.

o Application of policy 2.2.8 on 'settlement area boundary expansions' o Consideration of employment land conversions under policy 2.2.6.5 o Development of a housing strategy 3.2.6.6, including affordable housing

Identify policy direction related to centres, nodes, corridors, built areas, greenfields, and complete communities.

Preparation of a report containing recommendations with respect to Dufferin growth management opportunities, options analysis and the preferred option.

Preparation of Information Report to Councils for their review and comment

Preparation for Public Open House@) with one meeting for the central portion of the County (Shelburne) and one meeting for the southern portion of the County (Orangeville) to present the findings of Phase 2, including the alternative growth scenarios, and Growth Management Strategy Options. Provide public participants with an overview of the expected future work to be completed by individual municipalities following the completion of the study.

2.2.2 Policv Plan Recommendations

Prepare draft policies and mapping recommendations, to implement the preferred growth scenario through the lower tier Official Plans.

Preparation of a Draft Final Report including the work completed in Phases 1 and 2 and responses to comments raised during the open house(s).

Prepare presentation meeting to present final findings to the local municipal Councils in a Joint Council setting. Each member municipality will determine their Council endorsement process for the final report.

3.0 MEETINGS AND PUBLIC CONSULTATION

The selected Proponent is required to attend a minimum of four (4) meetings with the project Steering Committee (including one start up meeting). The selected Proponent is also required to attend and facilitate at least four (4) joint Open House meetings - two meetings for the central portion (Shelburne) of the County and two for the southern portion of the County at the conclusion of phases 1 and 2 of the project. Finally, the selected Proponent will be required to present the final findings of this study in a joint Council setting. In addition, the consultant should ensure a number of working meetings with staff of each of the 9 municipalities and any other applicable agencies.

Proposals for this project should briefly describe the Proponent's public consultation approach.

3.1 Administration and Process

The above approach to a growth management strategy needs to be placed within the context of an appropriate project organization. This should include such matters as the establishment of working committee(s), a reporting process, a timeline, circulation and co-ordination, a public consultation process, consultation and co-ordination with municipalities, the Province, and agencies and key milestones and approval targets.

The intent of the growth management planning study would be to consider the above range of elements (consistent with the Province's Growth Plan for the Greater Golden Horseshoe and the Provincial Policy Statement) within an integrated and comprehensive framework.

4.0 PROJECT DELIVERABLES

The following deliverables are required at a minimum;

Develop Fmal Work Plan, including details of consultation opportunities with Councils, public, and Provincial Ministries and agencies. Phase One Findings summary report; Presentationslboardslmaterials for at least four (4) Open Houses; Presentationslboardslmaterials for at least one (I) joint Council Meetings;

All draft documents and graphics will be required in digital form (PDF is acceptable) accompanied by eleven (1 1) colour bound hardcopies. All final documents will be required in digital format, accompanied by twenty (20) colour bound hardcopies. All graphics will be required in digital format (.jpg., CAD, PDF) and be reproducible. The ownership of all data, digital or otherwise, produced through the study , will remain with the municipalities.

5.0 PROJECT SCHEDULE

The successful Proponent shall allow a minimum of two (2) weeks for the review of draft documents and three (3) weeks for the review and acceptance of final documents.

The following is an overview of the categories and weighting for the rated criteria of the RFP:

The Steering Committee intends to follow a Value Based approach to select the consultant for this assignment. Proponents are asked to contact Ms. Dean in writing with any questions or clarifications related to this Request for Proposal prior to 4:30 pm on January I I , 2008. All responses to questions will be made in writing in the form of Addenda by January 17, 2008.

Oral clarifications do NOT form part of the RFP document. Any modifications to the document will be in the form of addenda, which will be issued through the County of Dufferin Treasury Department to all Proponents and distributed prior to the RFP closing date.

The County shall not be responsible for any misunderstanding on the part of the Proponent concerning this RFP or its process.

NOTE: Successful Proponent's will be asked to provide a main contact for their Firm to the Steering Committee upon award.

7.2 Pro~onents Shall Bear Their Own Costs

The Proponent shall bear all costs associated with or incurred in the preparation and presentation of its proposal including, if applicable, costs incurred for interviews.

7.3 Submission of Pro~osa ls

Proposals must be submitted by the following method:

7.3.1 ENVELOPE #I

A Proponent must submit eleven (11) hardcopies of the "technical" proposal - one (1) original copy signed by an authorized representative (marked "Original") and ten (10) additional hardcopies in a sealed package. Proposals are to be marked with the RFP title and number (see RFP cover), with the full legal name and return address of the Proponent, and with the Proposal Submission Deadline and time.

7.3.2 ENVELOPE #2

One (1) hardcopy of a detailed cost assessment is to be submitted in a separate sealed envelope apart from the rest of the proposal. The sealed envelope containing the Cost Estimate shall be clearly marked identically to Envelope #I. Proposals submitted in any other manner may be disqualif~ed. Proposals must be submitted to the address set out on the Proposal Return Label.

7.3.3 Proposals Must Be Submitted On Time at Prescribed Location

Proposals must be submitted by 4:00 pm local time on Friday February 1, 2008 to the County of Dufferin Treasury Department - 51 Zina Street, Orangeville, Ontario, L9W 1E5.

NO ELECTRONIC OR FACSIMILE RESPONSES WILL BE ACCEPTED

The onus unequivocally remains with the Respondent to ensure that couriered bids are delivered to the Treasury Department, by closing time, in accordance with the submission process. Misdirected couriered bids, bids received after the closing dateltimelplace will not be accepted and will be returned unopened. Proposals submitted after this point in time will be deemed late, disqualified and returned to the Proponent.

7.4 Selection of Proponent

The Steering Committee anticipates that a Proponent will be selected within forty five (45) days of the Proposal Submission Deadline. Notice of selection by the Steering Committee to the selected Proponent will be in writing. The selected Proponent will be required to execute an agreement with the County within fifteen (15) days of notice of selection.

It is not expected that the Steering Committee is required to enter into an agreement with any of the Proponents.

7.4.1 Failure to Enter into Agreement

In addhon to all of the County's other remedies, if a selected Proponent fails to execute the Agreement or satisfy any other applicable conditions within fifteen (15) days of notice of select~on, the County may, in its sole and absolute discretion and without incurring any liability, rescind the award of contract to the selected Proponent.

7.5 Irrevocable

All proposals will be irrevocable for a period of ninety (90) days from the closing date of the RFP.

7.6 Indemnification

The Successful Respondent shall indemnify and hold harmless the County, its officers, council members, partners, agents and employees from and against all actions, claims, demands,

losses, costs, damages, suits or proceedings whatsoever which may be brought against or made upon the County and against all loss, liability, judgments, claims, suits, demands or expenses which the County may sustain, suffer or be put to resulting from or arising out of the Successful Respondents' failure to exercise reasonable care, skill or diligence or omissions in the performance or rendering of any work or service required hereunder to be performed or rendered by the Successful Respondent, its agents, officials and employees.

7.7 lnsurance

Without restricting the generality of the section on Indemnification, the Successful Respondent shall obtain, maintain, pay for and provide evidence of insurance coverage, taken out with insurance companies licensed to transact business in the Province of Ontario.

7.7.1 Professional Liability lnsurance

A Certificate of lnsurance for Professional Liability lnsurance coverage with a limit of not less than $2 million (2,000,000) per occurrence, subject to an annual aggregate of $2 million (2,000,000), for each member of the firm or partnership who will perform work on behalf of the County prior to commencement of work and at the beginning of each calendar year during the appointment period.

7.7.2 Commercial General Liability lnsurance

Commercial General Liability insurance shall include as an Additional Insured, the County with limits of not less than $2 million ($2,000,000.00) inclusive per occurrence for bodily and personal injury, death and damage to property including loss of use hereof. Evidence of this insurance shall be provided on a "Certificate of lnsurance". The form shall be maintained continuously from either the commencement of the services or the signing of this agreement, whichever is sooner. The policies shall be endorsed to provide the County with not less than 30 days written notice in advance of any cancellation, change or amendment restricting coverage.

Only the Successful Respondent(s) shall be required to provide a Certificate of lnsurance - within 10 working days, after notification of award and prior to the issuance of a purchase order or signed agreement.

7.8 Municipal Freedom of lnformation and Protection of Privacy Act (MFIPPA)

In accordance with the Municipal Freedom of lnformation and Protection of Privacy Act, this is to advise that the personal information Respondents provide is being collected under authority of the Municipal Act and will be used exclusively in the selection process. All proposals submitted become the property of the County. Because of MFIPPA, Respondents are reminded to identify in their proposal material any specific scientific, technical, commercial, proprietary, or similar confidential information, the disclosure of which could cause them injury. Complete proposals are not to be identified as confidential. The County of Dufferin reserves the right to discuss any and all proposals, to request additional information from proponents and to accept or reject any and all proposals.

7.9 Conflict of Interest

In addition to the other information and representations made by each Proponent in their proposal, each Proponent must declare whether it has an actual or potential Conflict of lnterest. Include a statement that clearly identifies work that has been completed with respect to other active or dormant clients within the County of Dufferin over the past 5 years.

APPENDIX I: EXISTING STUDIES AVAILABLE TO THE CONSULTANT

1.0 SUPPORTING STUDIES

a. Planning Studies

The local planners have completed a detailed inventory of current growth conditions and potential growth opportunities within the local municipalities. This information will be made available to the selected Proponent. A digital compilation of the local Official Plan land use schedules has been prepared in GIs format (with the exception of Orangeville which will be provided in Autocad format). This information is being made available for the purposes of this project only, and is not to be used for any other purposes. The chosen consultant will be required to enter into one or more Electronic Intellectual Property End User License Agreement regarding the use of this information.

Individual Official Plans may be available online or through contacting the local area municipality directly.

The following digital mapping will be provided to the successful Proponent:

Compilation of municipal Official Plan land-use schedules (except Orangeville) in ARCGIS 8.3 Personal Geodatabase format;

Town of Orangeville Official Plan Land Use Schedule(s) in Autocad 2006 format,

b. Engineerina Studies

At this point it is not anticipated that any original engineering studies will need to be done as part of this study. The Proponent will be required to review existing engineering studies.
