Objectives and Tasks of the Report

Objective of the Report is to demonstrate compliance of land acquisition and compensation processes to

Operational Policy (OP) 4.12 of the World Bank (WB), RPF (prepared in 2009) and RAP (prepared in

2011) due to lack of RAP covering period from 2012 to 2015

The Project Description

Background of Fergana Valley Water Resources Management Project

Fergana Valley Water Resources Management Project was initiated by Ministry of Agriculture and Water

Resources of Uzbekistan with funding from the WB.

The Project is designed to increase the agricultural production and decrease the damage to the infrastructure

as a result of waterlogging, as well as improvement of I&D systems and strengthening of WUAs and water

institutions.

As stated in final FS (September 2008), the main Project objectives include:

(a) Promotion of the sustainable irrigated farming, employment growth and generating income of

the farm enterprises in Fergana Valley (FV) by improvement of I&D systems and the overall

water resources management;

(b) Lowering damage to the infrastructure regardless of its proprietary form, improvement of

environmental and health conditions by combating the waterlogging. This, in turn, will lead to

rising of living standards;

(c) Introduction of joint operation of irrigation systems on the base of WUAs, the advanced

techniques of farming and irrigation, and activities contributing to cost-effectiveness of farming

in the Project area;

(d) Strengthening of institutional capacity of the water organizations and organizations responsible

for I&D

Enhancement of operating efficiency of the water sector, i.e. maximizing performance per unit of water

use, can be achieved by improvement of I&D systems (both on-farm and inter-farm), better WT control,

provision of support to the agricultural producers and local self-governing bodies.

General improvement of the water resources management sphere can be seen (based on water balance

analysis) by growth in volume and reliability of flow in the Syr Darya River basin. Fulfillment of the Project

tasks will also contribute to implementation of Country Assistance Strategy in terms of increase in

agricultural production, provision of employment and income, rising of living standards and improvement

of environmental condition.

The Project Area

The Project area is located in the central part of FV and covers most of Bagdad, Rishtan and Altiaryk

districts of Fergana oblast (FO). The total Project area is about 67 000 ha of which 48 000 ha are cultivated.

The total population in this area is 554 000 people.

Income of the most population, in many ways, depends on agriculture. FV has a high population density as

compared to the other parts of a country.

Agriculture is a basic source of income for the local population. The main crop grown in this area is cotton

which ensures a profit from export for the government. Other crops are wheat, rice, potatoes, fruits, grapes,

melons, oil crops and vegetables.

The main sources of surface water in FV are the Naryn, Kara Darya and Syr Darya Rivers, the latter is

formed as a result of confluence of the first two rivers. Besides, there are numerous rivers and mountain

sais flowing down to the Valley north, east and south.

Irrigation network in the Project area has three main canals: South Fergana Canal (SFC), Big Fergana Canal

(BFC) and Big Andijan Canal (BAC).

Drainage system has two main collectors – Achikkul and North-Bagdad which collects the drainage flow

formed in the Project area, and transports it to the Syr Darya. There are also many vertical drainage wells

which are used mainly north of BFC and in west of the Project area.

Territorially and administratively, the Project area covers most of Bagdad district (except territory very

south and east), half of north end of Rishtan district and middle territory of Altiaryk district, as well as

Bagdad, Rishtan and Altiaryk towns (Fig. 1). Survey area is limited north – North Bagdad Collector and

Central Kyzyltepa; west and east – by borders of Bagdad and Altiaryk districts; south – Burgandi massif of

Kyrgyzstan.

According to Statistics Department of Fergana oblast as of 1 January 2014 there were 562.4 thousand people

in the Project districts that up to 17.8 thousand people greater than in 2011. Share of urban and rural

population in the Project districts practically did not change as compared with 2011, staying at the same

level: 35.5% rural and 64.5% urban.

Population density has, naturally, increased from 471.7 people/ km2 in 2011 to 487.6 people/ km2 in 20131.

In 2011, there were 1089 members in 21 WUAs of 3 districts, of which 881 farm enterprises (FE) and 208

others, including dekhkan farms (DF), kitchen gardens, etc. Results of the baseline study show that 19 207

ha are under cotton, 18 001 ha are under wheat, and remaining 19 010 ha are under other crops.

In 2013, there were already 2016 members in 25 WUAs of the Project districts, including 915 farm

enterprises cultivating main crops (cotton and wheat), 981 other farms (orchards, stock-raising, etc.) and

120 rural and mahallya citizens meetings (tomorka).

The total service area of all WUAs in the Project districts is 74 135 ha, being increased up to 17 916 ha as

compared with the baseline data for 2011. Increase in WUA members (up to 927 members as compared

with 2011) and service area is attributed to inclusion of 3 WUAs («Kyzyltepa tongi», «O.Musulmonkulov»

and «Yangiobod movy osmoni») to works on WUA development, as well as engagement of the other farm

enterprises which previously were not WUA members.

Of total irrigated area, 66.2 % of cultivated land accounts for the farmers, 16.3 % dekhkans and 17.6 %

mahallya. All Project construction and rehabilitation works were executed in the farmers’ lands. These

lands are publicly owned. There were no works in plots belonging to dekhkan farms, including in tomorka.

Thus, the Project negative impact on crops and plants did not guaranteedly affect dekhkan farms in the

three Project districts.

RAP and LAAP prepared under the Project

Two documents related to resettlement were prepared under the Project: Resettlement Action Plan (RAP)

and Land Acquisition Action Plan (LAAP). One of the first segments of this Project was construction of

open collectors. Initial Resettlement Action Plan was prepared in 2008 by Consultant on Social Assessment

in close cooperation with the PIU. In 2011, at the beginning of the Project, RAP was revised by the PIU

and prepared according to the detail design and optimization of farm enterprises with clarification of

Affected People (AP). Consequently, number of AP remained the same (37), of which 31 farm enterprises,

4 dekhkan farms, one college and one school. LAAP provides the guidelines and methodology of land

acquisition and compensation as provided by the WB Resettlement Policy and applicable domestic

legislation.

LAAP (2011) was approved by the WB. All subsequent calculations of land acquisition and compensation

were made based on methodologies described in this document. Under other segments of the Project, large-

scale works on repair and restoration of I&D systems are being executed which are described in more detail

in the next sections.

Assumed consequences

Components of the Project and types of work which have caused land acquisition

This section describes all works under the Project and description of approach applied for calculation of

compensation. The Project firstly addresses an improvement of I&D systems infrastructure, most of which

is on the balance of government organizations and in public ownership. The Project does not provide for

any investment at the concrete farms level. Project includes the following components:

Component A: Improvement of I&D systems. This component is directed to resolve the problem

of high water table (WT) by financing the physical improvement of I&D systems,

as well as installation of the vertical drainage wells.

Component B: Institutional and agricultural development support comprising institutional

strengthening of the public and private agencies involved in the water sector

management, I&D systems maintenance and agricultural production in the Project

area. Component will finance the trainings and study tours, establish demonstration

plots and furnish them with field equipment, laboratories, computers, office

equipment, etc., as well as the Consultants.

Component C: Project Management and Audit, M&A including operating cost of the Project

Management, Consultancy Services on Audit and M&A, and preparation of future

projects.

Component A is the largest by value and the only one relevant to the WB Operation Policy on Involuntary

Resettlement 4.12.

Main works under Component A, and their potential linkage with OP 4.12 of the WB are presented in Table

1. Data on total number of AP for the period under review (2011-2014) are presented in Table 6.

As above Table shows, implementation of the Project did not necessitate a physical resettlement, however

crops were subjected to possible negative impact.

Major impact took place during construction and rehabilitation of: (i) interfarm, on-farm and interdistrict

I&D systems, (ii) cutoff drain and (iii) SHD. Works on the remaining Project components, which constitute

the majority, were associated neither with permanent, nor with temporary impact on SHD farm land or

available crops.

Damages to SHD farmers resulting from the Project works were calculated by methods described in LAAP.

Formula for calculation of compensation is given below (Resolution of the Cabinet of Ministers No.146 `

2011):

Extent of farming loss in case of permanent land acquisition is identified under the following formula:

Fl = [(CI х AI)+(CRF х ARF) + (CI х AIL х 0.1)+

(CRF х ARFL х 0.1) + (CHP х AHP)] х CL х IC + NP, where:

Fl - farming loss in case of seizure of agricultural land for permanent use, thousand UZS;

CI - cost of irrigation and reclamation of equivalent new land instead of seized 1 ha of irrigated

agricultural land (excluding irrigated layland) is accepted according to Clause 31 of this Regulation,

thousand UZS;

CRF - cost of irrigation and reclamation of equivalent new land instead of seized 1 ha of rain-fed

field and non-irrigated perennial plantings, is accepted according to Clause 32 of this Regulation, thousand

UZS;

CHP - cost of irrigation and reclamation of equivalent new land instead of seized 1 ha of hayfield

and pasture is accepted according to Clause 34 of this Regulation, thousand UZS;

AI - area of seized irrigated agricultural land (excluding irrigated layland), ha;

ARF - area of seized rain-fed field and non-irrigated perennial plantings, ha;

AIL - area of seized irrigated layland, ha;

ARFL - area of seized rain-fed layland, ha;

AHP - area of seized hayfield and pasture, ha;

CL - coefficient considering location of seized plot is accepted according to Clause 36 of this

Regulation;

IC - indexation coefficient of farming loss is accepted according to Clause 48 of this Regulation;

NP - net profit from seized plot for the last four years is identified according to Clause 35 of this

Regulation, thousand UZS.

Sum of net profit from seized plot for period of four years is additionally added to farming loss required

for loss recovery during the design, irrigation and land reclamation, their amelioration and other crop-

engineering works.

Net profit per 1 ha for one year in case of activity on irrigated land with similar ball-bonitet is identified by

division of average annual profit in the farm for the last 3 years to area of irrigated land.

Where there is irrigated land with several ball-bonitet is identified average net profit attributable to 1 ha of

irrigated land with identified ball-bonitet.

For this purpose, total ball-bonitet/ha of the farm is identified under the formula:

BS = (S1 х B1) + (S2 х B2) +… = (Sn х Bn), where:

S1, S2 and Sn - area of plot with appropriate ball-bonitet, ha;

B1, B2 and Bn - ball-bonitet of respective plots

Net profit of the farm attributable to 1 ball-bonitet/ha is identified under the formula:

NP.bs = NP / BS, where:

NP - average annual net profit of farm, thousand UZS;

Average annual net profit per 1 ha of seized plot is identified under the formula:

NP = NP.bs х Bn х Sn

Net profit additionally added to farming loss is identified by multiplication of average annual margin of

profit per 1 ha of seized plot by 4 (number of years) and seized area.

Information on the total number of persons were effected during the period of the project (2011-

2014) mentioned in Table 6.

The total number of persons affected by the project amounted to 513 farm enterprises, of which

373 farms have received full compensation for the loss of crops during the rehabilitation and

construction works. 36 farmers will receive compensation after submission of correct banking

details and 104 farmers were not harmed, as the work was carried out before planting and after

harvest of crop.

Changes of requisites of 36 farms have occurred as a result of optimization of farm enterprises.

Payments to these farms were taken into account in the final Decree of Khokim of Fergana region,

and will be paid after the issuing of this Decree.

Detailed description of the land acquisition and compensation mechanism mentioned in the

Section 4 of this report. Methods of calculating of compensation for the losses that farmers have

suffered in connection with the implementation of project activity is fully consistent with the

method described in the document Land Acquisition Activities under the Project and with using

the calculation formula provided above.

It should be noted that certain compensation payments to farmers were made during the

construction work. It is against the rules, but that farmers treat this with understanding, without

complaints about delays in the payment of compensation. Reasons for the delay of payments

described below.

During the preparation of project, PIU have conducted several workshops for the farmers of each

district, where was provided explanations on subject how the acquisition of lands will be carry out,

how compensation payments will be determined, and how farmers might use the complaint

mechanism.

Detailed the mechanism of complains is described in Section 6 of this report.

Calculation of land acquisition and compensation of crop loss owing to rehabilitation and

construction works on the cutoff drains is described in detail in LAAP (2011). Calculation tables

based on which compensation was identified are included in the resolutions of Fergana oblast

Khakim (Annex 6). All resolutions are included in Annex 7. All compensations for crop loss to

persons whose land was allotted in 2011-2014 are paid within the range of 93-100%. The rest of

payments for the previous years and 2015 were not made due to delay in reallocation of funds set

aside for this item in the Project FS.

Originally, it was foreseen to implement the temporary and permanent land acquisition related to

construction and rehabilitation which is of immense complexity and requires different kinds of

heavy equipment. It was expected that use of such equipment within the boundaries of existing

farm enterprises would lead to inevitable but minimum damaging of crops. Such impact was,

mainly, connected with construction of SHD which assumed installation of the close drains that

would lead to land improvement in the considerable part of the Project area.

During execution of construction works prior to sowing or when there were crops on the fields

these works’ impact on affected farms was supposed to be high. Though land above the drainage

will be leveled and can be used for agricultural purposes, construction of SHD thereby should have

to mean to the affected farmers temporary land acquisition and lost profits for one season.

However, after a number consultations held by close drains PIU with the officials of district water

organizations and the leaders of mahallya committees, it was decided to execute the Project works

which would require the temporary land acquisition during off-season by adjusting Construction

Work Plan to the work of the farm enterprises.

Decision on starting of the Project works was taken following immediate information on

completion of harvesting received from the farmers and collected by the PIU officials on the

ground.

Such approach has excluded a crop loss related to the temporary land acquisition. It was achieved

by planning of construction and rehabilitation works in the period when there was no crops in the

field, or the contractors in conjunction with the PIU had informed the farmers beforehand about

upcoming works and did not begin those works until the farmers fully took in the harvest from the

Project plot.

In cases of land acquisition, the farm enterprises during the Project construction and rehabilitation

of the interfarm, on-farm and interdistrict I&D systems, the rules, guidelines and mechanisms

described in LAAP of 2011 were applied. Among them were: land acquisition procedure with due

regard to briefing of the land users about the planned Project works, calculation of compensation

for damage and work MRJ.

The Project was implemented in line with the guidelines described in LAAP:

a. Construction or rehabilitation of I&D systems which might cause resettlement is

unacceptable; damage of houses and infrastructure must be avoided during construction

and rehabilitation;

b. During design, permanent land acquisition should be minimized;

c. Temporary negative impact on land should be minimized by careful execution of

construction/rehabilitation; additional measures on informing farmers should be taken to

minimize damage of crops;

d. It is essential to use best efforts to minimize construction and repair works and prevent

an impact on the dekhkan plots (located both within and beyond villages). If it is

impossible to avoid works in dekhkan farms beyond settlements, damage to the fields,

crops and plantings should be compensated;

e. Size of compensation to the farmers and the dekhkans for damage to crops and

plantings will be identified on the basis of retail market prices;

f. Compensation to the farmers should have a wide coverage; whereby, amongst the other

stakeholders, WUAs might be engaged;

g. Farmers also should have the opportunity to claim and take action aimed at getting

compensation;

h. Implementation of LAAP will be internally monitored by the PIU, and externally

monitored by an independent expert group consisting of three members.

The last clause of the mentioned guidelines established that «Compensation will be fully provided

to affected parties before commencement of any construction or rehabilitation works». However,

according to existing national regulations, compensations to the farmers are paid based on

corresponding Resolution of Fergana oblast Khakim, which has to be prepared within 3-4 months.

It is quite difficult to prepare Plan of Project works to be executed in the course of a year in

advance, wherefore, there were delays in compensation payment to the farmers prior to start of the

construction works.

Taking into account large area where the Project works were executed, and manpower restriction

in the PIU, it was not possible to conduct an ongoing monitoring. As a rule, payments are made in

a lump sum within 14-20 days after issuance of Resolution of Khakim and depending on the

number of APs.

Compensation payments were made during construction works, which had been accepted

understandingly by the farmers, there were no complaints concerning delays in payment.

1 Land acquisition and compensation

Land acquisition and calculation of compensation payment are made in line with LAAP (Section

5) and Land Code of Uzbekistan (1998), and Resolution of the Cabinet of Ministers (RCM) No.

246 of 1992, which were used as core documents during preparation of LAAP (2011). Stepwise

scheme of measures for land acquisition and compensation is presented below.

For commencement of land acquisition procedure the PIU in Rishtan sends a letter to Land

Cadaster of Fergana oblast (FO) to carry out works on land acquisition. The PIU submits the work

papers with data on collectors where the Project works will be executed.

After signing a Contract between the PIU and Land Cadaster of FO, Land Cadaster implements

land acquisition procedure with identification of persons to be affected by the Project works.

Contract includes the fixation of size of the temporary and permanent land acquisition, drawing

up of cartographic documents for each land user to show alienation borders. For that, based upon

design drawings submitted by the PIU, officials of Land Cadaster check the plots to be allotted,

meet with the leaders of farm enterprises and jointly measure the plots. At that, each FE leader is

explained the methodology of land acquisition with provision of regulatory documents, namely

RCM No.246 of 2011.

After completion of calculations, the leader of FE holds a general meeting with the members of

FE at which minutes and resolution on «Consent with permanent allotment of calculated plot (ha)

for water supply» are issued. The same minutes make reservations for necessity in modification of

the plot’s plan to stop repayment of land tax for allotted plot (Annex 1).

In accordance with the same Resolution No.246, Oblast Land Cadaster on the basis of bidding

identifies an independent consultant licensed to conduct such types of works for fixing the size of

damage to the land users.

Calculation of land is also made under the scheme described in Resolution No. 246. It must be

noted that as provided by Article 87 of the Land Code, compensation for land allotted for execution

of hydraulic works, land improvement is not envisaged. Nevertheless, in accordance with Loan

Agreement between Government of Uzbekistan and the WB, compensation to the farm enterprises

for prevented damage will be paid.

Comparison of calculation of compensation has shown the compliance with procedure proposed

in LAAP (Table 9-11). Thus, comparison of calculation of compensation given in Annex 1 to the

resolutions of districts and Fergana oblast khakims has shown that information presented in

Resolution is more detailed; mechanism of calculation fully corresponds to the formula proposed

in LAAP.

Calculations of land acquisition and damage size have to be approved by resolutions of district

and oblast khakimiats. All resolutions contain the summary tables with indication of total area of

the farm in ha, size of allotted plot, types of crops, and plot’s ball-bonitet.

Each resolution is supported with package of documents for each farm land to be allotted. Package

of documents consists of above mentioned minutes of meeting of FE, contour map of the whole

plot of FE distinguishing the plot to be allotted and other regulatory documents on FE.

Based upon resolutions of oblast khakim, the PIU makes payment to the land users for sustained

4.1. Compensation for 2012

In 2012, Contract No.19 dated 15.03.2012 in the amount of UZS 112 031 067, Contract No.10

dated 11.06.2012 in the amount of UZS 28 599 788, Contract No.13 dated 11.12.2012 in the

amount of UZS 298 772 226 were signed for alienation of land and identification of damage to

189 land users on 455.07 km drainage and land acquisition equaled to 515.25 ha (Table 2).

According to Resolution of Fergana oblast Khakim No.250 of 13.12.2013, damage size of 189

farm enterprises was UZS 611 791 000 and UZS 512 663 126 were paid to 155 land users.

Of 34 farmers, there was no damage to 10 farm enterprises due to cancellation of part of collectors

during detail design and payment was not made. Damage to the remaining 24 farm enterprises was

covered but due to incorrectly furnished bank accounts money came back.

4.2. Compensation for 2013

In 2013, Contract No. 5 dated 07.10.2013 in the amount of UZS 161 396 578, Contract No. 19 dated

25.11.2013 in the amount of UZS 120 762 220 were signed for land alienation and identification of damage

to 128 land users on 115.8 km drainage and land acquisition equaled to 358 ha.

In accordance with Resolution of Fergana oblast Khakim No.35 of 15.02.2014, damage size to 62 farm

enterprises equaled to UZS 127 215 230 and UZS 126 246 030 were paid to 60 land users.

Damage to the rest 2 farm enterprises was covered but due to incorrectly furnished bank accounts money

came back. In 66 farm enterprises included in Resolution, damage comprised UZS 0.00 due to lack of

income from allocated land because of low land capacity.

4.3. Compensation for 2014

In 2014, contract No. 3 dated 11.03.2014 in the amount of UZS 19 016 351 was signed for land alienation

and identification of damage to 159 land users on 247.96 km drainage and land acquisition equaled to

334.52 ha (Table 4).

According to Resolution of Fergana oblast Khakim No.94 of 15.04.2014, damage size was UZS 375 699

and UZS 235 988 691 were paid to 121 land users. Of remaining 38 land users, there was no damage to 28

land users during construction, and money to 10 land users came back due to incorrectly furnished bank

accounts.

In 2014, Contract No. 8 dated 04.06.2014 in the amount of UZS 210 485 294 was signed for land alienation

and identification of damage to 75 land users on 130.09 km drainage and land acquisition equaled to 226.57

ha.

According to Resolution of Fergana oblast Khakim No.313 of 25.12.2014, damage size was UZS

494 989 548. Payment under this Resolution was not made due to above mentioned necessity of reallocation

of funds under FS.

Under Resolution of the President of Uzbekistan No.PP-1265 of 19.01.2010, USD 887.3 thousand (UZS

1 997 million in equivalent) were envisaged for land alienation and compensation to the land users.

Considering all contracts, amount equal to USD 1277 thousand (UZS 3 002 million in equivalent) is

required. In January of the current year, the PIU has requested the Inter-Agency Council under the Cabinet

of Ministers to allow to cover deficient amount from «Unallocated Amount». By protocol resolution of

23.09.2015 No. 174 it was allowed to cover deficient funds from «Unallocated Funds».

Aggregate information on the farmers to be compensated for 2012-2014 is presented in Table 5.

4.4. Compensation for 2015

Presently, identification of damage to the land users for 2015 is underway and at the same time bank

accounts of the land users, who could not be compensated previously due to incorrectly furnished bank

accounts, are being clarified.

According to preliminary estimates, damage size in 2015 is UZS 436.35 million. Total damage under the

Project was UZS 1 918 million including UZS 937 803 509 were paid in 2011-2014, UZS 980 473 630 are

due to be paid for till the end of 2015.

2 M&A of land acquisition and compensation payment efficiency

The PIU together with M&A Consultant conducted the monitoring of resettlement. For verification

of compensation payment to the persons whose land was temporarily or permanently allotted due

to the Project works, M&A consultants had series of meetings with the farmers and people who

were compensated in 2011-2014.

The first meeting was organized at the office building of Altiaryk district. Brief overview of

surveyed farmers is presented in Table 4.1.

Compensated farmers were given a talk about, how the calculation and compensation payments

were carried out. Farmers acknowledged the noticeable positive changes in places where the

Project works were executed.

It has been stated that houses and auxiliary buildings began to require less repairs as WT had

significantly lowered and there is no need for annual repair of houses or construction of new

buildings.

Farmers expressed gratitude for additional works not included in the Project, such as construction

of bridges, excavation of small canals.

Grievance Mechanism

Grievance mechanism is established and functioning under the Project. For this purpose, a book

of complaints was introduced at the PIU in Rishtan. It registers all complaints, opinions and

requests received from population of the Project districts both in written and oral (by telephone)

form (Annex 8).

In the accounting period (2012- 2015), 72 citizens requests were registered in the book of

complaints. Most requests were attributed to provision of additional assistance in cleaning of on-

farm collectors (not included into the Project), construction/acceleration of construction of bridges

over the cleaned collectors. One complaint was concerning farmer’s disagreement with the area of

land to be allotted. There were several requests for installation of drip irrigation systems.

M&A consultants in conjunction with the PIU officials investigated a complaint received on 4 July

2015 from «Abdumato Mamarajab ugli» FE in Rishtan district concerning wrong land acquisition.

For redressing of grievance, a recurrent measurement was conducted in the presence of officials

from district office of Uzgiprozem (organization dealing with preparation of land acquisition

documents), the PIU officials in Rishtan and the farmer himself which showed correctness of

measurements.

The PIU officials have come up with response to all requests; the applicants had been notified

about outcomes of requests within one month from the date of request submission. Farmers have

raised a question about land acquisition dates and quantities of wheat to be supplied under the state

order.

It emerged that some farmers were using old quota in supplying wheat, without deduction the land

already allotted for the Project works.

Officials of company dealing with land acquisition and PIU pointed out to the farmers on the need

to reapprove the plan for wheat. However, those farmers did not reapprove the plan and supplied

wheat using old quota that, to some extent, affected a total gain. Therefore, the farmers were

recommended to promptly reapprove the plan, and the PIU officials to intensify efforts on

explanation of land acquisition procedure and associated changes in state order for wheat and

cotton.
