"AN ORDER RECONSTITUTING THE WATER RESOURCE MANAGEMENT TASK FORCE OF DAVAO CITY, AMENDING EXECUTIVE ORDER NO. 37, SERIES OF 2012"

WHEREAS, the Water Resource Management and Protection Code of Davao City was passed as an Ordinance No. 117-01, Series of 2001 on February 21, 2001;

WHEREAS, Executive Order No. 37, Series of 2012, created and constituted the Water Resource Management Task Force of Davao City on October 9, 2012;

WHEREAS, said the said Task Force has identified and declared certain areas within the territorial boundaries of Davao City as water resource areas and there is a need to protect and conserve said areas against all forms of prohibited acts and activities;

WHEREAS, the City Government of Davao, enacted City Ordinance No. 0546-13, Series of 2013 entitled AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE (CZO) OF THE CITY OF DAVAO AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENTS THEREOF AND FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT THEREWITH, NOW OTHERWISE KNOWN AS THE "COMPREHENSIVE ZONING ORDINANCE OF DAVAO CITY FOR 2013-2022", INCORPORATING AS INTEGRAL PART THEREOF VOLUME I (COMPREHENSIVE LAND USE PLAN) AND VOLUME III (SECTORAL STUDIES) OF THE COMPREHENSIVE LAND USE PLAN OF DAVAO CITY FOR 2013-2022.

WHEREAS, the City Ordinance No. 0546-13, Series of 2013 entitled "COMPREHENSIVE ZONING ORDINANCE OF DAVAO CITY FOR 2013-2022" has already been published on December 16, 2014 and took effect 15 days after its date of publication;

WHEREAS, Article IV of the City Ordinance No. 0546-13, Series of 2013 provides that in the General Zones, areas identified by the Water Resource Management Task Force as water resource areas is zoned as Water Resource Zone;

WHEREAS, Article IV, Section 7.1 states the definition of the Water Resource Zone (WRZ):

"Those areas on top of identified location of principal source of drinking water of Davao City containing huge volume of water available for appropriation where Davao City Water District has existing planned/proposed production wells with 350 meter buffer areas provision (Fig. 2.10)"

WHEREAS, Article IV, Section 7.8.1. states the following are Special Requirements for development in Water Resource Zone (WRZ):

" No Preliminary Approval and Locational Clearance (PALC), Development Permit (DP) and Building Permit ( BP) shall be issued without clearances from Water Resource Management Council (Task Force), Davao City Water District (DCWD), DENR-Mines and Geo-Science Bureau (MGB) and City Planning Development Office (CPDO),and from DENR-Environmental Management Bureau."

WHEREAS, in view of the effectivity of City Ordinance No. 0546-13, Series of 2013, there is a need to reconstitute the Water Resource Management Task Force to give effect to the provisions of Section 7 of the said ordinance;

NOW, THEREFORE, I, RODRIGO R. DUTERTE, City Mayor of Davao, by virtue of the powers vested in me by law, do hereby reconstitute the Davao City Water Resource Management Task Force.

SECTION 1. COMPOSITION. The Davao City Water Resource Management Task Force shall composed of the following:

SECTION 2. FUNCTIONS. The Task Force shall meet at least once a month on a regular basis but may convene as often as it is deemed necessary, and shall carry out the following functions:

1. To promote inter-institutional cooperation and coordination among various agencies, both national and local, which are concerned with water protection, conservation and development in the City of Davao;

2. To develop and monitor program implementation in the City of Davao; 3. To collect data on the implementation, operation and maintenance relative

hereto; 4. To ensure that development plan in the water resource areas are strictly

implemented.

SECTION 3. FUNDING. The budgetary requirements for the Davao City Water Resource Management Task Force shall be chargeable against the appropriations of the City Mayor's Office. Incidental expenses in its operations thereof, may however be charged from any available funds of the City as may be determined by the City Mayor.
