Havendo necessidade de regular agestão de pesticidas no País, de forma agarantir a saúde pública e a qualidade doambiente, ao abrigo do disposto no artigo 9da Lei n.º 20/97 de 1 de Outubro - Lei doAmbiente, e no uso das competênciasatribuídas pela alínea f) do n.º 1 do artigo204 da Constituição da República, oConselho de Ministros determina:
Artigo 1. É aprovado o Regulamentosobre a Gestão de Pesticidas, em anexo aopresente Decreto e que dele faz parteintegrante.
Art. 2. São incluídas na lista dasactividades sujeitas ao licenciamentoambiental e previstas no Anexo I doRegulamento sobre Avaliação do ImpactoAmbiental, aprovado pelo Decreto n.º45/2004, de 29 de Setembro, a produção depesticidas, a reembalagem de pesticidas compropósitos comerciais, a comercialização earmazenagem de pesticidas agrários e osutilizados na saúde pública contra vectores,de doenças, assim como a eliminação depesticidas e de embalagens de pesticidas.
Art. 3. É revogada toda a legislação quecontrarie o presente Decreto.
Art. 4. O presente Decreto entra emvigor 90 dias após a sua publicação.

As there is a need to regulate themanagement of pesticides in the country,to guarantee public health andenvironmental quality, under the provision ofarticle 9 of Law 20/97 of 1 October, theEnvironment Law, and using the powersgranted by clause f) of paragraph 1 ofarticle 204 of the Constitution of theRepublic, the Council of Ministersdetermines:
Article 1. the Pesticides ManagementRegulations, as attached to this Decree, arehereby approved and constitute an integralpart thereof.
Art. 2. Included in the list of activitiessubject to environmental licensing andcontained in Annex I of the EnvironmentalImpact Assessment Regulations, approvedby Decree 45/2004 of 29 September, arethe production of pesticides, the repackingof pesticides for commercial purposes, thetrading and storage of agriculturalpesticides and those used in public healthagainst disease vectors, as well as theelimination of pesticides and of pesticidepackages.
Art. 3. All legislation contradicting thisDecree is revoked.
Art. 4. This Decree enters into force 90days after its publication.

CAPÍTULO IDisposições gerais
Artigo 1Definições
Para efeitos do presente Regulamentoconsidera-se:
1. Ambiente - o meio em que oHomem e outros seres vivem e interagementre si e com o próprio meio, e inclui:
a) O ar, a luz, a terra e a água;b) Os ecossistemas, a biodiversidade
e as relações ecológicas;c) Toda a matéria orgânica e
inorgânica;d) Todas as condições socioculturais e
económicas que afectam a vidadas comunidades.
2. Agroquímicos - incluem todos ospesticidas e fertilizantes.
3. Apreensão - confiscação de umproduto a favor do Estado no local em que seencontra ou num outro local incluindo aapreensão a favor do Estado ou com fins dedestruição.
4. Associações de Defesa doAmbiente - pessoas colectivas que têmcomo objecto a protecção, a conservação e avalorização dos componentes ambientais.Estas associações podem ter âmbitointernacional, nacional, regional ou local.
5. Autorização de Uso Experimental dePesticidas - licença para o uso de umpesticida com carácter temporário e comobjectivos de testagem.
6. Autorização de Utilização deEmergência - licença concedida em regimeespecial e com carácter excepcional, para ouso de pesticidas registados ou nãoregistados, considerados eficazes no controlode uma situação de emergência causada poruma praga ou doença nas culturas, bemcomo por vectores de doenças humanas eanimais.
7. CAT - Comité de AconselhamentoTécnico sobre Agroquímicos.

CHAPTER IGeneral Provisions
Article 1Definitions
For the purpose of these Regulationsthe following definitions apply:
1. Environment - the environment, inwhich humans and other beings live andinteract among themselves and with theenvironment itself, including:
a) air, light, land and water;b) eco-systems, bio-diversity and
ecological relationships;c) all organic and inorganic matter;d) all socio-cultural and economic
conditions which affect the livesof communities.
2. Agrochemicals - include allpesticides and fertilizers.
3. Seizure - confiscation of a product forthe benefit of the State at its actual locationor at another location, including seizure forthe benefit of the State or with the purpose ofdestruction.
4. Environmental Associations -collective persons which have theprotection, conservation and valorisation ofenvironmental elements as their purpose.These associations may be international ornational, regional or local.
5. Authorisation for ExperimentalPesticides Use - licence for the temporaryuse of a pesticide and for testing purposes.
6. Authorisation for Emergency Use- licence granted in a special regime andwith an exceptional character, for the useof registered or unregistered pesticides,considered effective for the control of anemergency caused by a pest or diseaseaffecting crops, as well as by human andanimal disease vectors.

9. Comercialização - a colocação depesticidas no mercado a título oneroso.
10. Concentração Letal 50% (CL 50) -Inalatória - a concentração de umasubstância na atmosfera capaz de provocar amorte de 50% dos animais tratados após aexposição mínima de uma hora.
11. Data de expiração do prazo -data a partir da qual um pesticida não pode serusado.
12. DNGA - Direcção Nacional deGestão Ambiental.
13. DNSP - Direcção Nacional de SaúdePública.
14. DNSA - Direcção Nacional dosServiços Agrários.
15. DNSV - Direcção Nacional dosServiços Veterinários.
16. Doação - Inclui qualquerdisponibilização de um pesticida a terceiros, atítulo gratuito.
17. Dose letal 50% (DL 50) - doseúnica, expressa em miligramas de substânciapor quilo de peso corpóreo, que podeprovocar a morte em 50% dos animais emexperiências durante catorze dias. Esta seráconsiderada dérmica se a experiência for porcontacto com a pele intacta por um período devinte e quatro horas durante catorze dias, eserá oral se as experiências forem deadministração oral.
18. DPA - Direcção Provincial deAgricultura.
19. Eliminação - qualquer operaçãocom vista à reciclagem, neutralização,destruição ou isolamento de pesticidas,embalagens usadas e materiaiscontaminados.
20. Embalagem - todo o recipientedestinado a acondicionar directamente assubstâncias activas, produtos formulados depesticidas ou seus derivados, incluindo oinvólucro externo destinado a proteger osrecipientes de pesticidas contra possíveisquebras, deformações e outros acidentesdurante o manuseamento e/ou transporte.
21. Emergência - eclosão de doençasou pragas que afectam drasticamente aprodução agrícola nacional e/ou da região,ou afectam a saúde humana.
8. CATERP - Technical AssessmentCommittee for Pesticides Registration.
9. Trading - placing of pesticides onthe market against payment.
10. Lethal Concentration 50 (LC50) - via Inhalation - the concentrationof a substance in the air sufficient to causethe death of 50% of the treated animalsafter a minimum exposure of one hour.
11. Use-by date - the date fromwhich a pesticide shall not be used.
12. DNGA - National Directorate ofEnvironmental Management.
13. DNSP - National Directorate ofPublic Health.
14. DNSA - National Directorate ofAgricultural Services.
15. DNSV - National Directorate ofVeterinary Services.
16. Donation - includes any free offer ofa pesticide to third parties.
17. Lethal dose 50 (LD 50) - asingle dose, expressed in milligrams ofsubstance per kilogram of body weight,which can cause the death of 50% of thetest animals during fourteen days. This willbe considered dermic if the test is viacontact with an intact skin for a period oftwenty-four hours during fourteen days,and will be oral if the test is via ingestion.
18. DPA - Provincial Directorate ofAgriculture.
19. Elimination - any operation aimed atthe recycling, neutralization, destruction orisolation of pesticides, used packages andcontaminated materials.
20. Packaging - all containers usedfor directly packing the active substances,formulated products of pesticides or theirby-products, including the externalwrapping used to protect the pesticidecontainers against possible leakages,deformations and other accidents duringhandling and/or transportation.
21. Emergency - emergence ofdiseases or pests that seriously affectnational and/or regional agriculturalproduction, or affect human health.

28. MIC - Ministério da Indústria eComércio.
29. MICOA - Ministério para aCoordenação da Acção Ambiental.
30. MINAG - Ministério da Agricultura.31. MISAU - Ministério da Saúde.32. MITRAB - Ministério do Trabalho.33. Número de lote - número que
deve constar no rótulo, indicando o número/série de produção para efeitos deidentificação.
34. OMS - Organização Mundial daSaúde.
35. Perigo - o potencial para degradara qualidade do ambiente, danificarpropriedades e prejudicar a saúde e a vidade pessoas, animais e plantas.
36. Pesticida - qualquer substância oumistura de substâncias destinada àprevenção, destruição ou controlo dequalquer peste, incluindo vectores dedoenças humanas e animais, espéciesindesejáveis e maléficas de plantas ouanimais com efeitos perniciosos sobre aprodução ou que de algum modo interferemna produção, processamento, armazenagem,transporte e colocação no mercado dealimentos, produtos agrícolas, madeira ouprodutos madeireiros, rações para animaisou substâncias que possam seradministradas em animais para o controlo deinsectos ou outras pestes. O termo incluisubstâncias destinadas ao uso comoreguladoras do crescimento de plantas, esubstâncias aplicadas em produtos agrícolas
22. Service company - entityproviding pesticide application services.
23. FAO - United Nations Food andAgriculture Organization.
24. IIAM - Agricultural InvestigationInstitute of Mozambique.
25. Importation - the introduction ofpesticides from abroad into the nationalterritory.
26. INNOQ - National Standardizationand Quality Institute.
27. Maximum Residue Limit (MRL)- the maximum concentration of pesticideresidues, legally accepted in a food product forhuman or animal consumption.
28. MIC - Ministry of Industry andTrade.
29. MICOA - Ministry for theCoordination of Environmental Affairs.

shall be printed on the label, indicating theproduction number/series for identificationpurposes.
34. WHO - World Health Organisation.35. Hazard - the potential to degrade
the environmental quality, damageproperty and prejudice the health and lives ofpeople, animals and plants.
36. Pesticide - any substance ormixture of substances to be used for theprevention, destruction or control of anypest, including human and animal diseasevectors, unwanted and harmful plant oranimal species with pernicious effects onproduction, or that in some way interfere inthe production, processing, storage,transport and placing on the market offood, agricultural produce, timber or timberproducts, animal feed or substances thatmay be administered to animals to controlinsects or other pests. The term includessubstances to be used as plant growthregulators and substances applied toagricultural produce before or afterharvesting to protect them againstdeterioration during storage transport.

37. Pesticidas banidos - os pesticidascujo uso tenha sido totalmente proibidoatravés de um instrumento legal, com vista àprotecção da saúde humana, animal e doambiente. O termo inclui pesticidas cujo usoinicial tenha sido recusado, ou que tenhasido retirado pela indústria do uso nomercado nacional ou do processo deapreciação para aprovação doméstica, e emrelação aos quais haja evidências de que taisacções tenham sido tomadas com vista àprotecção da saúde humana e do ambiente.
38. Pesticidas obsoletos - pesticidasque tenham sofrido qualquer modificação nasua composição físico-química, provocandoalterações relativas à eficácia ou toxicidadeda substância activa. Também sãoconsiderados pesticidas obsoletos ospesticidas desconhecidos (ex. perda dorótulo apropriado), os que não apresentemas datas de manufacturação e/ou expiraçãodo prazo ou os que se encontram fora doprazo de validade, constituindo risco para asaúde humana, animal e para a qualidade doambiente.
39. Pesticidas para uso doméstico -pesticidas usados para o combate de pragasdomésticas e para jardins domésticos.
40. Pesticidas severamenterestringidos - pesticidas cujo uso é proibidocom vista à protecção da saúde humana e doambiente, podendo no entanto ser usadosexcepcionalmente em circunstâncias e casosespecificamente determinados porinstrumentos legais.
41. Poluição - a deposição no ambientede substancias ou resíduos,independentemente da sua forma, bemcomo a emissão de luz, som e outras formas deenergia, de tal modo e em quantidade tal que oafecta negativamente.
42. Processo de registo - conjunto deprocedimentos através dos quais oRegistador aprova a doação, comercializaçãoe uso de um pesticida com base numaavaliação completa de dados científicos ecomprovativos de que o produto é eficazpara os objectivos pretendidos e não coloca

37. Banned pesticides - pesticideswhose use has been totally prohibited by alegal instrument, in order to protect human,animal and environmental health. The termincludes pesticides whose initial use hasbeen refused or which have beenwithdrawn by the industry from thedomestic market or from the appraisalprocess for domestic approval, andregarding which there is evidence that suchactions have been taken having in view theprotection of human and environmentalhealth.
38. Obsolete pesticides - pesticidesthat have suffered any modification of theirphysical-chemical composition, causingchanges regarding the efficacy or toxicity ofthe active substance. Unknown pesticides(e.g., loss of the appropriate label), thosethat do not present the manufacturing and/or use-by dates or those that have passedthe use-by date, being a risk to human andanimal health and to environmental qualityare also considered obsolete pesticides.
39. Pesticides for domestic use -pesticides used to combat domestic pestsand for domestic gardens.
40. Severely restricted pesticides -pesticides whose use is prohibited in orderto protect human and environmentalhealth; they can however be usedexceptionally in circumstances and casesspecifically determined by legalinstruments.
41. Pollution - the deposit in theenvironment of substances or residues,irrespective of their form, as well as theemission of light, sound and other forms ofenergy, in such a way and in such quantitythat the environment is negatively affected.
42. Registration process - a set ofprocedures through which the Registrarapproves the donation, trading and use of apesticide based on a full assessment ofscientific data and evidence that theproduct is effective for the intendedobjectives and does not pose a risk to

43. Produção - o fabrico de umproduto técnico, substância activa,formulação, ou reformulação de umpesticida.
44. Produto - qualquer ingredienteactivo de um pesticida e outroscomponentes, na forma em que é embalado evendido.
45. Produto formulado - produtotécnico ou a substância activa depois desubmetida a operações destinadas a facilitar asua aplicação e a sua acção, com a adição ounão de adjuvantes e inertes.
46. Produto técnico - produtoconstituído pela substância activa e pelasimpurezas resultantes do respectivoprocesso industrial de produção.
47. Publicidade - qualquer matéria ,sinal ou informação oral, escrita ouelectrónica que tenha como objectivopromover a venda, o uso, ou chamaratenção para um determinado pesticida. Paraefeitos deste Regulamento, o termo"propaganda" tem o mesmo significado.
48. Registador - Ministério quesuperintende a agricultura, através daDirecção Nacional dos Serviços Agrários.
49. Registo definitivo de pesticidas -a aprovação oficial definitiva dada a umpesticida para ser usado sob condiçõesespecíficas e a definição das condições da suadoação, comercialização e utilização.
50. Registo provisório de pesticidas- a aprovação oficial provisória dada a umpesticida para ser usado sob condiçõesespecíficas e a definição das condições dasua doação, comercialização e utilização.
51. Registo para uso experimentalde um pesticida - a aprovação oficial dada a umpesticida para ser usado para ensaios com ofim de registo definitivo.
52. Registo para uso de emergência deum pesticida - a aprovação oficial dada a umpesticida para ser usado durante umasituação de surto ou de uma praga.
53. Reembalagem - o processo detransferência de um pesticida da embalagemoriginal para outra.
54. Resíduo de pesticidas - qualquerpesticida contido em alimentos ou rações deanimais resultante do uso de pesticidas.

43. Production - the manufacture of atechnical product, active substance, pesticideformulation or reformulation.
44. Product - any active ingredient ofa pesticide and other components, in theform in which it is packed and sold.
45. Formulated product - thetechnical product or the active substanceafter having been submitted to operationsaimed at facilitating its application and itseffects, with the addition or not ofadjuvants and inert substances.
46. Technical product - a productcomprising an active substance andimpurities resulting from the respectiveindustrial production process.
47. Advertising - any oral, written orelectronic matter, sign or information, withthe objective to promote the sale, the use,or call the attention to a certain pesticide.For the purpose of these Regulations, theterm "propaganda" has the same meaning.
48. Registrar - The Ministrysupervising agriculture, through theNational Directorate of AgriculturalServices.
49. Permanent registration ofpesticides - the definitive official approvalgiven to a pesticide to be used underspecific conditions and the definition of theconditions of its donation, trading and use.
50. Temporary registration ofpesticides - the temporary officialapproval given to a pesticide to be usedunder specific conditions and the definitionof the conditions of its donation, tradingand use.
51. Registration for experimentaluse of a pesticide - the official approvalgiven to a pesticide to be used for trialswith a view to its permanent registration.
52. Registration for emergency useof a pesticide - the official approval givento a pesticide to be used during anoutbreak of epidemics or a pest.
53. Repackaging - the process oftransferring a pesticide from the originalpackage to another one.
54. Residual pesticide - anypesticide present in food or animal feedresulting from the use of pesticides.

55. Risco - a probabilidade deocorrência de um perigo e a severidadedesse perigo decorrente da exposição apesticidas.
56. Rótulo - informação impressa,pintada, gravada ou aplicada sobre qualquertipo de embalagem de pesticidas, incluindo otexto que, por falta de espaço disponível,seja fornecido em folheto separado ou não eque acompanha sempre a embalagem.
57. RRCA - Repartição de Registo eControlo de Agroquímicos.
58. Substância activa - substanciaquímica ou biológica (microrganismos ouvírus) que exerce uma acção geral ouespecífica contra organismos nocivos aosvegetais, animais ou produtos vegetais.
59. Toxicidade - a propriedadefisiológica ou biológica que determina acapacidade de um químico prejudicar, ouferir um organismo vivo por meios nãomecânicos.
60. Titular de registo - pessoa ouentidade a favor da qual foi concedido oregisto oficial de um pesticida para um fimespecífico.
61. Título ou certificado de Registo -documento oficial emitido pelo Registadorautorizando a importação, exportação,doação, comercialização ou utilização de umpesticida.
62. Transporte - o processo dedeslocação de pesticidas, por meiosmotorizados ou outros, do local de produçãoao local de armazenagem assim como adeslocação de pesticidas no âmbito doprocesso de importação, exportação,transito, doação e comercialização.
Artigo 2Objectivo e Âmbito de Aplicação
1. O presente Regulamento têm porobjectivo assegurar que todos os processosque envolvem o trabalho ou manuseamento depesticidas se realizem sem prejuízo da saúdepública, animal e ambiental.
2. O presente Regulamento aplica-se aoregisto, produção, doação, comercialização,importação, exportação, embalagem,armazenamento, transporte, manuseamento,utilização e eliminação de pesticidas e

56. Label - printed, painted, engravedinformation or information attached to anytype of pesticide package, including the textwhich, for lack of available space, issupplied in a pamphlet, separate or not,and which always accompanies thepackage.
57. RRCA - Agrochemicals Registrationand Control Department.
58. Active substance - chemical orbiological substance (micro-organism orvirus), which exerts a general or specificaction against organisms that are harmful toplants, animals or plant products.
59. Toxicity - the physiological orbiological property that determines thecapacity of a chemical to prejudice or injurea live organism through non-mechanicalmeans.
60. Registration holder - a person orentity for the benefit of whom the officialregistration of a pesticide for a specificpurpose was granted.
61. Registration title or certificate -official document issued by the Registrarauthorizing the importation, exportation,donation, trading or use of a pesticide.
62. Transport - the process ofpesticides transfer, by motorized or othermeans, from the production site to thestorage site, as well as the transfer ofpesticides in the scope of the importation,exportation, transit, donation and tradingprocess.
Article 2Objective and Scope of Application
1. The objective of these Regulations is toensure that all processes that involveworking with or handling pesticides areexecuted without prejudice to public,animal and environmental health.
2. These Regulations apply to theregistration, production, donation, trading,importation, exportation, packing, storage,transport, handling, use and elimination ofpesticides and adjuvants, by individual or

CAPÍTULO IICompetências Institucionais
Artigo 3Registador
O Registador, através da Repartição deRegisto e Controlo de Agroquímicos (RRCA),é responsável pela emissão de licenças eoutras autorizações, ao abrigo do presenteRegulamento.
Artigo 4Competências do Registador
1. Compete ao Registador:a) Presidir o Comité de Avaliação
Técnica do Registo de Pesticidase garantir que todos osprocedimentos para o registo depesticidas sejam devidamenteseguidos;
b) Validar as decisões do Comité deAvaliação Técnica do Registo dePesticidas (CATERP);
c) Propor ao Ministério quesuperintende a agricultura obanimento do uso de pesticidas;
d) Propor a actualização e o reforçodas medidas regulamentaresrelativas à gestão de pesticidas,de forma a assegurar umapermanente salvaguarda dasaúde humana e animal e daqualidade do ambiente;
e) Propor a ratificação de convençõese outras normas internacionaisaplicáveis à gestão sustentávelde pesticidas com vista àprotecção da saúde humana e doambiente e assegurar a suaimplementação;

CHAPTER IIInstitutional Powers
Article 3Registrar
The Registrar, through theAgrochemicals Registration and ControlDepartment (RRCA), is responsible for theissue of licences and other permits, underthese Regulations.
Article 4Powers of the Registrar
1. It is incumbent on the Registrar:a) To chair the Technical
Assessment Committee forPesticides Registration (CATERP)and guarantee that allprocedures for the registrationof pesticides are properlyfollowed;
b) To validate the decisions of theTechnical AssessmentCommittee for PesticidesRegistration;
c) To propose the banning of the useof pesticides to the Ministrysupervising agriculture;
d) To propose the updating andstrengthening of the regulatorymeasures regarding pesticidesmanagement, to ensure thepermanent protection of humanand animal health and ofenvironmental quality;
e) To propose the ratification ofconventions and otherinternational standardsapplicable to sustainablepesticides management in orderto protect human health andenvironmental quality andensure their implementation;

f) Através da DNS A, emitirautorizações e licença ao abrigodo presente Regulamento;
g) Através da DNS A, inspeccionar,fiscalizar e controlar todas asactividades relacionadas com aprodução, exportação,importação, transporte, uso,doação, comercialização,manuseamento e gestão depesticidas.
2. O Registador pode delegar as suasfunções.
Artigo 5Comité de Avaliação Técnica do Registo
de Pesticidas
1. É criado o Comité de AvaliaçãoTécnica do Registo de Pesticidas,abreviadamente designado CATERP.
2. Os membros do CATERP sãoseleccionados de acordo com os seusconhecimentos técnicos e mérito profissional emmatéria de gestão de pesticidas.
3. Dentre os membros do CATERPincluem-se:

2. The members of the CATERP areselected in accordance with their technicalknowledge and professional merits in thefield of pesticides management.
3 The CATERP comprises, amongothers, the following members:
a) The Registrar, who chairs theCATERP with a casting vote incase of a tie;
b) The Head of the DSV;c) The Head of the RRCA, with the
right to vote, and the RRCAtechnicians;
d) A representative of the IIAM;e) A representative of MISAU, to be
indicated by the DNSP;f) A representative of MICOA, to be
indicated by the DNGA.4. In the assessment of pesticide
registration requests, the CATERP canrequest technical and legal assistance fromother entities.
5. The decisions of the CATERP aretaken by vote, having each member onevote.
6. The minutes of the CATERP sessionsare taken by a RRCA technician.
7. The Minister supervising agriculture iscompetent to approve the rules andregulations of the CATERP.

Artigo 7Comité de Aconselhamento Técnico

1. É criado o Comité de AconselhamentoTécnico sobre Agroquímicos (CAT), com amissão de aconselhar o Ministro quesuperintende a agricultura sobre matériasgerais relacionadas com â gestão depesticidas no país, incluindo recomendaçõessobre a imposição de restrições ebanimentos de agroquímicos.
2. O CAT tem também aresponsabilidade de aconselhar o Ministroque superintende a agricultura sobreaspectos legais, incluindo aspectos relativosà implementação da legislação, e àratificação de convenções internacionais.
3. O CAT integra:a) O Ministro que superintende a
agricultura, o qual exerce asfunções de presidente;

1. The Technical Advisory Committeefor Agrochemicals (CAT) is created with themission to counsel the Minister supervisingagriculture about general subjects relatedto the management of pesticides in thecountry, including recommendations for theimposition of restrictions and banning ofagrochemicals.
2. The CAT also has the responsibilityto counsel the Minister supervisingagriculture about legal aspects, includingaspects concerning the implementation oflegislation and the ratification ofinternational conventions.
3. The CAT comprises:a) The Minister supervising
agriculture, who performs thefunction of chairman;
b) The National Director ofAgricultural Services;
c) The National Director ofVeterinary Services;

Artigo 8Obrigação de Registo de Pesticidas
1. A produção, doação, comercialização,importação e utilização de qualquersubstância com acção pesticida emMoçambique está sujeita a um registoprévio.
2. O registo é efectuado com base numpedido a ser submetido por empresasdevidamente inscritas na DNSA.
3. As empresas que registam pesticidasficam igualmente inscritas na DNSA comoimportadoras de pesticidas.

CHAPTER IIIRegistration of Pesticides
Article 8Obligation of Pesticide Registration
1. In Mozambique the production,donation, trading, importation and use ofany substance with a pesticide action issubject to prior registration.
2. The registration is done on the basis ofa request to be submitted by companies dulyregistered with the DNSA.
3. The companies that registerpesticides are also registered with theDNSA as pesticides importer.

Artigo 9Tipos de Registo
1. O registo de pesticidas pode serdefinitivo, provisório, para uso experimentalou para utilização de emergência.
2. O registo definitivo de pesticidas sópode ocorrer quando todos os requisitosprevistos nos artigos 10 e 11 do presenteRegulamento sejam satisfatoriamenteobservados.
3. O registo provisório é conferido peloMinistro que superintende a agricultura aprodutos cuja utilização anual não sejaeconomicamente viável para o seu registodefinitivo, desde que não haja alternativos e/ou que a actividade para a qual se propõeusar o justifique.
4. O registo para uso experimental éefectuado para os produtos não registados edestinados a ensaios.
5. O registo para uso de emergênciaestá reservado a produtos consideradoseficazes pelo Ministério que superintende aagricultura para o controlo duma situação deemergência derivada dum surto ou praga.Cabe ao Ministro que superintende aagricultura aprovar este registo.
Artigo 10Procedimentos para o registo de
pesticidas
1. O registo de pesticidas só poderá serefectuado a favor de empresas ouinstituições, devidamente estabelecidas noPaís e autorizadas pelos ministérios detutela, e que assumam a inteiraresponsabilidade técnica e ambiental dautilização dos pesticidas por ela registados.
2. Antes de submeter o pedido deregisto de um pesticida, o requerente deveinscrever-se na DNSA, através da submissãode um requerimento para o efeito aoDirector Nacional dos Serviços Agrários,acompanhado da fotocópia autenticada dalicença e/ou alvará da empresa ou
Article 9Types of Registration
1. The registration of pesticides can bepermanent, temporary, for experimentaluse or for emergency use.
2. A permanent registration ofpesticides can only occur when allrequirements laid down in articles 10 and11 of these Regulations have beensatisfactorily observed.
3. A temporary registration is grantedby the Minister supervising agriculture forproducts whose annual use is noteconomically viable for its permanentregistration, provided that there are noalternatives and/or that the activity forwhich they are intended to be used justifysuch registration.
4. A registration for experimental useis done for unregistered products meant fortrials.
5. A registration for emergency use isreserved for products considered effectiveby the Ministry supervising agriculture forthe control of an emergency resulting fromthe outbreak of epidemics or a plague. It isincumbent on the Minister supervisingagriculture to approve this registration.
Article 10Procedures for the registration of
pesticides
1. The registration of pesticides canonly be done for the benefit of companiesor institutions, which are duly established inthe country and authorized by thesupervising ministries, and which assumefull technical and environmentalresponsibility for the use of the registeredpesticides.
2. Before submitting the pesticideregistration request, the applicant shallregister with the DNSA, through thesubmission of an application to this end tothe National Director of AgriculturalServices, together with a certified

5. O registo de pesticidas está sujeito aopagamento de uma taxa indicada no Anexo Ido presente Regulamento, a qual varia deacordo com a toxicidade do pesticida.
Artigo 11Constituição e Organização do Processo
de Registo
1. O Processo de Registo de umpesticida a ser submetido, em quadruplicado, àDNSA é instruído através de:
a) Uma ficha de registo devidamentepreenchida;
b) A documentação de suporte;c) O projecto de rótulo.
2. O requerente é obrigado â actualizaro processo de registo do pesticida sempreque haja alterações significativas dos dadostécnico-científicos que estiveram na base doregisto desse pesticida, fundamentalmente osrelativos ao impacto do produto no âmbitotoxicológico, ambiental e biológico.
3. A DNSA pode solicitar a apresentação deamostras dos produtos e embalagens.
4. Qualquer alteração na composição de umpesticida, na quantidade dos ingredientes ou notipo de formulação, impõe a realização de umnovo registo.
5. O processo de registo de um pesticidadeve ser concluído num prazo não superior a120 dias, devendo o requerente sernotificado quando seja necessário tempoadicional para a sua conclusão.
6. Os Ministros que superintendem asáreas de agricultura, ambiente e saúdeaprovam os requisitos para cada

Article 11Constitution and Organization of the
Registration Process
1. The pesticide Registration Process tobe submitted, in quadruplicate, to theDNSA is prepared by:
a) a properly filled in registrationform;
b) supporting documents;c) the draft label.
2. The applicant is obliged to updatethe pesticide registration process wheneverthere are significant changes in thetechnical-scientific data that found theregistration of that pesticide, fundamentallythose regarding the toxicological,environmental and biological impact of theproduct.
3. The DNSA can request thepresentation of samples of the products andpackages.
4. Any change in the composition of apesticide, in the quantity of the ingredientsor in the type of formulation, necessarilyimplies a new registration.
5. Any pesticide registration processshall be concluded within 120 days, and theapplicant shall be notified when additionaltime is necessary for its conclusion.
6. The Ministers supervising the areasof agriculture, environment and health arecompetent to approve the requirements for

Artigo 12Rótulos
1. A aprovação do registo de umpesticida está sujeita à apresentação dorótulo final, o qual identifica o produto, otitular do registo, providências, advertênciase precauções, bem como directrizes de uso eprocedimentos pára os primeiros socorros.
2. Todas as embalagens de pesticidasdevem ter um rótulo, aprovado peloRegistador.
3. Os rótulos das embalagens externasdevem estar de acordo com as regrasinternacionalmente estabelecidas sobrerotulagem de pesticidas no transporte.
4. Todas as unidades constantes nosrótulos devem ser expressas no sistemamétrico.
5. Qualquer alteração das informaçõesconstantes dos rótulos deve ser previamenteautorizada pela DNSA, mediante opagamento da taxa definida no Anexo I dopresente Regulamento.
6. As especificações do rótulo sobre assubstâncias activas devem coincidir com ascontidas no pesticida e obedecer aos padrõesinternacionais.
7. Toda informação requerida no rótulodeve estar redigida na língua Portuguesa,podendo igualmente constar a mesmainformação em outras línguas.
8. No momento da entrada dospesticidas para o território nacional, estesdevem apresentar o rótulo aprovado no acto doregisto.
9. Nos casos de importações deemergência, os pesticidas podem serimportados com rótulos não aprovadas,desde que autorizados pejo Registador, quedeve definir as condições para tal.
10. A rotulagem de pesticidasimportados no território nacional é permitidaquando aprovadas pelo Registador emediante condições estipuladas por este,devendo a empresa importadora justificar asrazões que levam a tal acto.
11. Todas as embalagens de sementestratadas com pesticidas devem conter no seu

Article 12Labels
1. The approval of the registration of apesticide is subject to the presentation ofthe final label, which identifies the product,the holder of the registration, preventivemeasures, warnings and precautions, aswell as directions for use and first-aidprocedures.
2. All pesticide packages shall have alabel, approved by the Registrar.
3. The labels of the outer packagesshall be in accordance with theinternationally established rules for thelabelling of pesticides during transport.
4. All units used on the labels shall beexpressed in the metric system.
5. Any change of the information given onthe labels shall be previously authorized bythe DNSA, against the payment of a fee as perAnnex I of these Regulations.
6. The specifications of the label aboutthe active substances shall be the same asthose contained in the pesticide and shallmeet international standards.
7. All information required for the labelshall be written in Portuguese, but thesame information can also be provided inother languages.
8. At the time of the pesticidesentering the national territory, they shallcarry the label approved at the act ofregistration.
9. In cases of emergency imports, thepesticides can be imported with non-approved labels, provided that they areauthorized by the Registrar, which shalldefine the conditions for these cases.
10. The labelling of imported pesticideswithin the country is allowed whenapproved by the Registrar and in theconditions stipulated by this entity, but theimporter company shall justify the reasonsbehind this act.
11. All seed packages treated withpesticides shall include information on itslabel that the seed was treated withpesticides, mentioning the name of the

2. A DNSA deve ter disponível osexemplares do processo de registo paraconsulta e avaliação dos membros daCATERP, devendo comunicar-lhes aexistência de novos processos de registo depesticidas.
Artigo 14Critérios para Avaliação do Processo de
Registo de Pesticidas
1. O CATERP avalia os processos deregisto de pesticidas, com base em dadostécnicos e assumindo que os pesticidas serãousados de acordo com as recomendaçõesdos respectivos rótulos e a situação real doPaís,
2. O CATERP não aprova o registo deum pesticida se:
a) O pesticida não for efectivamenteeficiente para o uso pretendido;
b) O pesticida tiver efeitosinaceitáveis para organismos quese pretende proteger;
c) O uso normal e recomendado dopesticida tiver o potencial deafectar negativamente a saúdehumana e/ou animal;
d) O pesticida causar um impactonegativo inaceitável para o meioambiente, especialmente acontaminação de solos e águas,

Article 13Assessment of the Registration Process
1. The verification of the conformity ofthe documents for the pesticide registrationprocess is carried out by the DNSA and incase a shortage of data is established in acertain process, it shall notify the applicant toprovide the lacking data.
2. The DNSA shall have copies of theregistration process readily available forconsultation and assessment by theCATERP members, whom it should informabout the existence of new pesticideregistration processes.
Article 14Criteria for the Assessment of the
Pesticide Registration Process
1. The CATERP assesses the pesticidesregistration processes on the basis oftechnical data and on the assumption thatthe pesticides will be used in accordancewith the recommendations of the respectivelabels and the real situation of the country,
2. The CATERP does not approve theregistration of a pesticide if:
a) The pesticide is in effect notefficient for the intended use;
b) The pesticide has unacceptableeffects on organisms that areintended to be protected;
c) The normal and recommendeduse of the pesticide has thepotential to affect negativelyhuman and/or animal health;
d) The pesticide causes anunacceptable negative impacton the environment, particularlysoil and water contamination, or

ou afectar organismos nãovisados;
e) Os resíduos de pesticidas nosalimentos e no ambiente nãopuderem ser analisados pormétodos convencionais;
f) As propriedades físico-químicas dopesticida não forem aceitáveispara o uso pretendido e para oseu armazenamento;
g) O nível de resíduos de pesticidasnos alimentos estiver acima doNível Máximo de Resíduos depesticidas permitido;
h) As características físico - químicas,toxicológicas, eco toxicológicasnão estiverem dentro dospadrões internacionalmenteaceites e definidos pela FAO eOMS;
g) O pedido de registo não estiverconforme o estipulado pelopresente Regulamento e osprocedimentos de registos;
h) Houver um registo do mesmoproduto;
i) Se o pesticida não estiver registadono País de origem.
3. São igualmente recusados os pedidos deregisto de pesticidas que estejam na lista dosprodutos banidos por convençõesinternacionais das quais o País seja parte.
4. Os Ministros que superintendem asáreas de agricultura, ambiente e saúdeaprovam os critérios de avaliação depesticidas.
Artigo 15Validade do Registo de Pesticida
1. O registo definitivo de um pesticida éválido por 5 anos renováveis por igualperíodo. A renovação de um registo estásujeito a um pedido e ao pagamento da taxacorrespondente constante do Anexo 1 dopresente Regulamento.
2. A validade do registo provisório é de 1ano não renovável.
3. O registo para uso de emergência só éválido durante o período de emergência emreferência e é definido pelo Ministro quesuperintende a agricultura.

f) The physical-chemical propertiesof the pesticide are notacceptable to its intended useand to its storage;
g) The level of pesticide residues infood exceeds the allowedMaximum Residue Level (MRL)of pesticides;
h) The physical-chemical,toxicological andecotoxicological characteristicsare not within the internationallyaccepted standards defined bythe FAO and WHO;
i) The registration request does notconform to the provisions ofthese Regulations and theregistration procedures;
j) There is already a registration ofthe same product;
k) The pesticide is not registered inthe country of origin.
3. Requests for the registration ofpesticides that are included in the list ofproducts banned by internationalconventions to which the country is a partyare also refused.
4. The Ministers supervising the areas ofagriculture, environment and health arecompetent to approve the pesticidesassessment criteria.
Article 15Validity of Pesticide Registrations
1. The permanent registration of apesticide is valid for 5 years, renewable foran equal period. The renewal of aregistration is subject to a request and tothe payment of a corresponding fee as perAnnex 1 of these Regulations.
2. The validity of a temporaryregistration is for 1 year non-renewable.
3. A registration for emergency use isonly valid during the emergency period in

6. Terminado o prazo de validade doregisto de um pesticida, o titular do registopoderá solicitar a sua renovação num prazonão superior a 2 meses, mediante opagamento de uma multa equivalente a 50% dovalor da taxa de renovação.
7. Dois meses após o término do prazode validade do registo de um pesticida, ecaso o seu titular não submeta o pedido derenovação, o referido registo serádefinitivamente cancelado. Para que omesmo produto volte a ser usado emMoçambique, este carecerá de um novoregisto suje to ao pagamento da taxacorrespondente e constante do Anexo 1.
8. Expirada a validade do registoenquanto não tenha sido requerida eefectuada a sua renovação, acomercialização dos "stocks" existentes podemanter-se até que a validade dos pesticidasem causa não tenha expirado, ficandoresponsabilizadas as empresas titulares defazer um arrolamento dos "stocks" einformar o Registador sobre estimativa doprazo de término dos referidos "stocks".
9. Durante o período de validade de umregisto, a empresa titular obriga-se aopagamento de unia taxa anual estipulada noAnexo 1 do presente Regulamento, devendo amesma ser paga em Janeiro de cada ano a quedisser respeito.
Artigo 16Revogação de Registo
1. Por razões de carácter técnico-científico o Registador pode revogar o títulode registo, ouvido o CATERP, devendoqualquer doação ou comercialização depesticidas ser interrompida a partir da dataestipulada pelo Registador.

5. A request for the renewal of apesticide registration shall be submitted tothe DNSA before the expiry of the term ofthe respective registration.
6. After the expiry of the validity termof a pesticide registration, the registrationholder may has a term of 2 month torequest its renewal, against the payment ofa fine equivalent to 50% of the value of therenewal fee.
7. Two months after the expiry of thevalidity term of a pesticide registration, andin case its holder does not submit a renewalrequest, that registration will bepermanently cancelled. The same productcan only be used again in Mozambiquethrough a new registration subject to thepayment of a corresponding fee, as perAnnex 1.
8. In case the validity of a registrationhas expired while its renewal has not beenrequested and accomplished, the trading ofthe existing stocks can continue for as longas the validity of the pesticides in questionhas not expired, while the companiesowning them are held responsible formaking an inventory of the stocks andinform the Registrar about the estimatedtime to finish them.
9. During the validity period of aregistration, the holding company is obliged topay an annual fee as stipulated in Annex 1 ofthese Regulations, which should be paid inJanuary of each respective year.
Article 16Cancellation of a Registration
1. The Registrar can cancel aregistration title for technical-scientificreasons, after consulting the CATERP, inwhich case any donation or trading ofpesticides shall be interrupted from thedate stipulated by the Registrar.

3. A decisão de revogação do registe écomunicada ao titular do registo, por cartado Registador contendo os fundamentos dadecisão.
4. O titular do registo afectado peladecisão de revogação pode, no prazo de 30dias a contar da data da recepção do avisode revogação, opor-se ao mesmo, devendosubmeter a exposição dos motivos emquadruplicado à DNS A que as envia aosmembros da CATERP para a tomada de umadecisão final.
5. Não concordando com a decisão final doCATERP, o titular do registo pode recorrer aoMinistro que superintende a agricultura.
6. O recurso submetido ao Ministro quesuperintende a agricultura não tem efeitossuspensivos sobre a decisão de revogação.
7. A revogação do registo de pesticidaspode também ser solicitada pelo titular doregisto.

Artigo 17Publicação da lista dos pesticidas
registados
1. A lista dos pesticidas registados épublicada pela DNS A quinze dias após aavaliação dos pedidos de registo de pesticidadevendo conter:
a) A marca comercial;b) A substância activa e o seu teor;c) O nome do titular de registo;d) A validade do registo;e) O número de registo;f) A categoria dos pesticidas;g) A respectiva classe toxicológica,
2. A DNSA deve enviar a lista dospesticidas registados às Alfândegas, à DNGA,à DNSP, à DNSV e ao IIAM, bem comodisponibilizar a lista a todos os interessados.
2. The non-payment of the annual feementioned in paragraph 9 of article 15 ofthese Regulations is a reason for thecancellation of the registration in question.
3. The decision to cancel a registrationis communicated to the registration holderin a letter from the Registrar, enunciatingthe reasons of the decision.
4. The registration holder affected bythe cancellation decision may, within 30days from the date of reception of thecancellation notice, lodge a protest againstit by submitting an exposition of themotives in quadruplicate to the DNSA,which will forward it to the members of theCATERP for taking a final decision.
5. If he disagrees with the finaldecision of the CATERP, the registrationholder can appeal to the Ministersupervising agriculture.
6. The appeal lodged with the Ministersupervising agriculture does not havesuspensive effects on the cancellationdecision.
7. The cancellation of the registrationof pesticides can also be requested by theregistration holder.
8. In the case of cancellation, theregistration title shall be returned to theRegistrar within 30 days after thecancellation decision has been taken.
Article 17Publication of the registered pesticides
list
1. The list of registered pesticides ispublished by the DNSA fifteen days afterthe assessment of the pesticide registrationrequests and shall include:
a) The trademark;b) The active substance and its
contents;c) The name of the registration
holder;d) The validity of the registration;e) The registration number;f) The category of the pesticides;g) The respective toxicological class,

Artigo 18Transferência da titularidade do registo
1. A pedido do titular do registo, atitularidade pode ser transferida para outraentidade, desde que esta manifesteexpressamente a sua aceitação e apresenteuma carta do fabricante do produtoformulado aceitando a transferência doregisto e reconhecendo o novo titular como seurepresentante em Moçambique.
2. A transferência do registo de umtitular para outro não afecta a validade doregisto.
3. A transferência da titularidade de umregisto está sujeita ao pagamento da taxaindicada no Anexo 1 do presenteRegulamento.
4. O pedido mencionado no n.º 1 dopresente artigo, deve ser acompanhado docertificado original, bem como da propostado novo rótulo do pesticida em causa.
Artigo 19Alargamento do espectro de utilização
1. O pedido de alargamento do espectrode utilização de um produto já registadodeve ser solicitado ao Registador, com aindicação de todos os dados a seremalterados, e incluindo os comprovativostécnicos.
2. O requerente deve ainda apresentarum novo projecto de rótulo contendo asalterações referidas.
3. O alargamento do espectro deutilização de um pesticida está sujeito aopagamento da taxa indicada no Anexo I dopresente Regulamento.
Artigo 20Alteração do nome comercial

Article 18Transfer of the registration ownership
1. At the request of the registrationholder, ownership can be transferred toanother entity, provided that the latterexpresses explicitly his acceptance andpresents a letter from the manufacturer ofthe formulated product accepting thetransfer of the registration and recognizingthe new holder as his representative inMozambique.
2. The transfer of the registration fromone holder to another one does not affectits validity.
3. A transfer of the ownership of aregistration is subject to the payment of a feeas per Annex 1 of these Regulations.
4. The request mentioned in paragraph1 of this article shall be accompanied by theoriginal certificate, as well as the proposalfor a new label of the pesticide in question.
Article 19Broadening of the application spectrum
1. The request to broaden theapplication spectrum of an alreadyregistered product shall be addressed to theRegistrar, with an indication of all data tobe changed and including the technicalconfirmatory data.
2. The applicant shall also present a newdraft label containing the intended changes.
3. A broadening of the applicationspectrum of a pesticide is subject to thepayment of a fee as per Annex I of theseRegulations.
Article 20Change of the trade name

1. É permitida a alteração do nomecomercial de um pesticida.
2. Para os efeitos no número anterior, otitular de registo deve comunicar à DNSA,indicando os motivos da alteração eapresentando um novo projecto de rótulocom o novo nome comercial.
3. O Registador reserva-se o direito derecusar a referida alteração.
4. A alteração do nome comercial de umpesticida está sujeita ao pagamento da taxadefinida no Anexo I do presenteRegulamento.
CAPÍTULO IVAutorizações
SECÇÃO IProdução de Pesticidas
Artigo 21Autorização para a produção de
pesticidas
1. A produção de um pesticida, incluindoa sua formulação e reformulação, éautorizada pelo Registador, mediante umpedido para esse efeito submetido pelosinteressados e ouvido o CATERP. Estaautorização está sujeita ao pagamento deuma taxa definida no Anexo 1 do presenteRegulamento.
2. O pedido deve ser acompanhado dalicença ambiental, assim como de quaisqueroutras licenças e autorizações legalmenteexigidas, e efectuar o pagamento da taxadefinida no Anexo I.
3. É proibida a produção no territórionacional de pesticidas incluídos no Anexo Ada Convenção de Estocolmo sobre PoluentesOrgânicos Persistentes, bem como dospesticidas banidos por qualquer convençãoou" tratado internacional de que Moçambiqueseja parte.
4. A validade da autorização deprodução de pesticidas é de cinco anosrenováveis.
5. A produção de um pesticida estásujeita ao pagamento de uma taxa anual,definida no Anexo I do presenteRegulamento.

CHAPTER IVAuthorizations
SECTION IProduction of Pesticides
Article 21Authorisation for the production of
pesticides
1. The production of a pesticide,including its formulation and reformulation,is authorized by the Registrar, through arequest for this purpose submitted by theinterested parties and after consulting theCATERP. This authorisation is subject to thepayment of a fee as per Annex 1 of theseRegulations.
2. The request shall be accompaniedby an environmental licence, as well as anylegally required other licences and permits,and make the payment of the fee defined inAnnex I.
3. The production in national territory ofpesticides included in Annex A of theStockholm Convention on PersistentOrganic Pollutants is prohibited, as well asthe production of pesticides banned by anyinternational convention or treaty to whichMozambique is a party.
4. The validity of the pesticidesproduction authorisation is of five yearsrenewable.
5. The production of a pesticide issubject to the payment of an annual fee, asper Annex I of these Regulations.

SECÇÃO IIImportação de Pesticidas
Artigo 22Inscrição de importadores de pesticidas
1. A empresa que pretenda importarpesticidas deve solicitar a sua inscrição comoimportador de pesticidas à DNSA, devendopara o efeito submeter um requerimento aoRegistador, anexando ao mesmo uma cópiaautenticada do alvará ou licença deactividade e uma cópia do certificado deimportador emitidos pelo Ministério daIndústria e Comércio, bem como ocurriculum vitae da pessoa responsável pelagestão dos pesticidas na empresa em causa.
2. No acto da avaliação do pedido, oRegistador pode deslocar-se aoestabelecimento do proponente com o intuito deverificar as condições nele existentes,nomeadamente condições de armazenagem,capacidade e qualificações do pessoalexistente na empresa e as condições demanuseamento.
3. O Certificado de Inscrição deImportador de Pesticidas a favor dorequerente é emitido após a avaliação dopedido e caso não se constate nenhumairregularidade;
4. Anualmente o Importador devesubmeter à DNSA cópia do certificado deimportador actualizado, emitido peloMinistério da Indústria e Comércio, a qualdeve ser entregue até ao mês de Março doano correspondente, estando sujeito aopagamento da multa definida no Anexo 2quando a entrega for feita durante o mês deAbril, data a partir da qual são canceladas asinscrições das empresas importadoras depesticidas que não tenham submetido ocertificado de importador até então.
5. O Certificado de Inscrição deImportador de Pesticidas é válido por 1 anorenovável por igual período.
Artigo 23Autorização para importação de
pesticidas1. A importação de pesticidas, qualquer
que seja a sua quantidade e finalidade., estásujeita a uma autorização de importaçãoemitida pelo Registador.
SECTION IIImportation of Pesticides
Article 22Registration of pesticide importers
1. A company, which intends to importpesticides shall request its registration aspesticide importer with the DNSA and shallsubmit to this end an application to theRegistrar, together with a certifiedphotocopy of the importation permit orlicence and a copy of the importercertificate issued by the Ministry of Industryand Trade, as well as the curriculum vitaeof the person in charge of pesticidemanagement in the company in question.
2. During the assessment of therequest, the Registrar may visit theestablishment of the proponent in order toverify the there existing conditions, namelyregarding storage and capacity and thequalifications of the personnel existing inthe company and the handling conditions.
3. The Pesticide Importer RegistrationCertificate in the name of the applicant isissued after the assessment of the requestand if no irregularity is established;
4. The Importer shall annually submit acopy of the updated importer certificate tothe DNSA, issued by the Ministry ofIndustry and Trade, which shall be handedin until the month of March of thecorresponding year. Its submission duringthe month of April implies the payment of afine as per Annex 2, while from this datethe registration of pesticides importingcompanies, that until then have notsubmitted the importer certificate, iscancelled.
5. The Registration Certificate of thePesticides Importer is valid for 1 year,renewable for an equal period.
Article 23Authorization for the importation of
pesticides
1. The importation of pesticides, inwhatever amount and for whateverpurpose, is subject to an import permitissued by the Registrar.

2. Ao pedido de autorização deimportação de pesticidas, deve ser anexada afactura pró-forma correspondente àimportação que se pretenda efectuar.
3. Os dados constantes no pedidomencionado no n.º 2 do presente artigodevem ser compatíveis com os dados doregisto do pesticida em causa e com arespectiva factura pró-forma.
4. No acto da avaliação do pedido deimportação, o Registador pode solicitarinformações adicionais sobre o destinatáriofinal do pesticida.
5. Só podem obter a autorização deimportação de pesticidas os titulares doregisto de pesticidas ou seus representanteslegais, e ainda as entidades a quem tenhasido concedida uma autorização de utilização deemergência ou de uso experimental.
6. A emissão da autorização deimportação de um pesticida está sujeita aopagamento da taxa definida no Anexo I.
7. A autorização de importação de umpesticida só pode ser usada para aimportação pretendida e tem validade de 3meses, podendo o Registador prorrogar estavalidade por um período não superior a 3meses.
8. Num prazo não superior a 15 diasapós a importação de pesticidas, oImportador fica obrigado a comunicar aDNSA a quantidade de produto importado, osrespectivos números de lote, datas defabrico e expiração do prazo.
9. Os pesticidas importados só podementrar no território nacional quando àchegada tenham no mínimo um ano e meio devalidade. Os casos excepcionais devemser expressamente autorizados peloRegistador, estando sujeitos ao pagamento deuma multa definida no Anexo 2 de presenteRegulamento.
10. A importação acima de 200 litros ouquilos de pesticidas da classe I, 400 litros ouquilos de pesticidas da classe II e 750 litrosou quilos de pesticidas da classe III deve seracompanhada de um certificado de análiseenviado à DNSA conjuntamente com acomunicação referida no ponto 8 do presenteartigo.

7. A pesticide import permit can onlybe used for the intended importation andhas a validity of 3 months, which can beextended by the Registrar for anotherperiod up to 3 months.
8. Within 15 days after the importationof pesticides, the Importer has theobligation to inform the DNSA about thequantity of imported product, therespective lot numbers, the manufacturingdates and the use-by date.
9. Imported pesticides can only enterinto the country when on arrival they haveat least a year and a half of validity.Exceptional cases shall be explicitlyauthorized by the Registrar and are subject tothe payment of a fine as per Annex 2 of theseRegulations.
10. An importation of more than 200litres or kilograms of Class I pesticides, 400litres or kilograms of Class II pesticides and750 litres or kilograms of Class IIIpesticides shall be accompanied by ananalysis certificate sent to the DNSAtogether with the information referred to inparagraph 8 of this article.
11. The importation of productsbanned under international conventions orprotocols to which Mozambique is a party isprohibited.

SECÇÃO IIIExportação e trânsito de pesticidas
Artigo 25Autorização para exportação de
pesticidas
1. Sem prejuízo da demais legislação, aentidade que pretenda exportar pesticidas,deve solicitar à DNSA a sua inscrição comoexportador de pesticidas através de umpedido acompanhado da cópia do cartão deExportador emitido pelo MIC.
2. A exportação de pesticidas carece deuma autorização prévia emitida peloRegistador.
3. No acto do pedido de exportação, orequerente deve anexar a carta doimportador, confirmando ter solicitado oreferido pesticida, e a factura pró-forma domesmo.
4. A autorização de exportação emitidapelo Registador é parte da Declaração deExportação.
Artigo 26Autorização para o trânsito de pesticidas
1. Os pesticidas em trânsito peloterritório nacional estão sujeitos aautorização prévia concedida pelo

SECTION IIIExportation and transit of
pesticidesArticle 25
Authorisation for the exportation ofpesticides
1. Without prejudice to otherlegislation, an entity which intends toexport pesticides shall submit a request tothe DNSA for its registration as pesticidesexporter, attaching a copy of the ExporterCard issued by the MIC.
2. The exportation of pesticides issubject to a previous authorisation issuedby the Registrar.
3. When submitting an exportationrequest, the applicant shall attach a letterfrom the importer, confirming that he hasrequested this pesticide, and the respectivepro forma invoice.
4. The export permit issued by theRegistrar is part of the Export Declaration.
Article 26Authorisation for the transit of
pesticides
1. Pesticides in transit through thecountry are subject to previousauthorisation granted by the Registrar,

Moçambique, pela tramitação doprocesso de trânsito, quandoaplicável.
3. O pedido mencionado no n.º 2 dopresente artigo deve ser acompanhado dedocumento emitido pela autoridade decontrolo dê pesticidas do país importador,confirmando que a importação em referênciaestá aprovada, bem como de carta doimportador indicando a empresa local comoseu representante para a actividade emcausa.
4. O trânsito de pesticidas deverespeitar as disposições de todas asconvenções, protocolos e/ou padrões de queMoçambique seja parte, e as normastécnicas internacionais de segurança notransporte de pesticidas por terra, por arepor mar.
5. São condições para o trânsito depesticidas as seguintes:
a) Que os pesticidas estejamdevidamente embalados erotulados de modo que. não hajarupturas;
b) Que as embalagens de pesticidascontenham informações sobre asmedidas de segurança.
6. Quando as informações indicadas naalínea a) e b) do número anterior estejamredigidas em língua diferente do Português,

The request mentioned in paragraph2 of this article shall be accompanied by adocument issued by the pesticides controlauthority of the importing country,confirming that the importation in questionhas been approved, as well as by a letterfrom the importer indicating the localcompany as its representative for thisactivity.
4. The transit of pesticides shallrespect the provisions of all conventions,protocols and/or standards to whichMozambique is a party, and theinternational technical safety standards forthe transport of pesticides by land, by airand by sea.
5 Pesticides in transit are subject to thefollowing conditions:
a) The pesticides shall be dulypacked and labelled so thatthere are no ruptures;
b) The pesticide packages shallcontain information about safetymeasures.
6. If the information indicated inclauses a) and b) of the previous paragraphis written in a language other than

Autorização para a doação de pesticidas
1. A doação de pesticidas carece deautorização do Registador, nos termos dopresente Regulamento,
2. Os interessados em doar pesticidasdevem solicitar a devida autorização emcarta dirigida ao Registador, na qual devemser indicadas as quantidades a doar, assimcomo os destinatários e usos previstos.
3. À carta mencionada no númeroanterior deve ser anexada a factura pró-forma ou cotação da compra.
4. No despacho da autorização, oRegistador, ouvido o CATERP, menciona ascondições em que a doação deve ocorrer.
5. Só podem ser doados pesticidasregistados e adquiridos no País, comexcepção das situações de emergência.
6. A aceitação de doações de pesticidassó pode ocorrer quando o Registador, ouvidaa DNGA e a DNSP, determine que taisdoações não acarretam riscos de acumulaçãonem desencorajam o uso de alternativas aospesticidas ou de pesticidas menos nocivospara a saúde pública e animal e para o meioambiente.
Artigo 28Autorização para a comercialização de
pesticidas
1. Todos os estabelecimentos comerciaisque pretendam vender pesticidas agrários eos utilizados na saúde pública contravectores de doenças, devem ser autorizadospelo Ministério da Indústria e Comércio,depois de obtido o parecer prévio e favorávelda DNS A, da DNSP e da DNGA e de

Article 27Authorisation for the donation of
pesticides
1. A donation of pesticides is subject toauthorisation by the Registrar, under theterms of these Regulations,
2. The parties interested in donatingpesticides shall request an authorisation ina letter addressed to the Registrar, in whichthe quantities to be donated, as well as theexpected receivers and applications shall beindicated.
3. The pro forma invoice or purchasequotation shall be attached to the lettermentioned in the previous paragraph.
4. Having consulted the CATERP, theRegistrar shall mention in the authorisationthe conditions under which the donationshall occur.
5. Only pesticides that are registeredand acquired in the country can bedonated, with the exception of emergencycases.
6. The acceptance of pesticidedonations can only occur when theRegistrar, having consulted the DNGA andthe DNSP, determines that such donationsneither carry accumulation risks, nordiscourage the use of alternatives to thesepesticides or of pesticides that are lessharmful to public and animal health and tothe environment.
Article 28Authorisation for the trading of
pesticides
1. All commercial establishments thatintend to sell agricultural pesticides andthose used in public health against diseasevectors shall be authorized by the Ministryof Industry and Trade, after having

4. Os estabelecimentos quecomercializam pesticidas e outros produtosdevem dispor de condições apropriadas dearmazenamento, nos termos do presenteRegulamento, e manter os pesticidas emlocal separado especialmente em relação aosalimentos humanos e animais.
5. Os pesticidas da Classe I só podemser vendidos a operadores ou utilizadores depesticidas reconhecidos e aprovados pelaDNSA, nos termos do artigo 30 do presenteRegulamento.
6. Todos os estabelecimentos comerciaisde venda de pesticidas agrários e osutilizados na saúde pública contra vectoresde doenças, em funcionamento na data daentrada em vigor do presente Regulamento,são sujeitos a uma auditoria ambiental nostermos e para os efeitos legais.
7. O comércio de pesticidas só épermitido a pessoas maiores de idade e quenão apresentem sinais de problemas desaúde.
8. As instituições do Estado quepretendam adquirir pesticidas devemcoordenar com a DNSA na avaliação daescolha do pesticida em causa.
SECÇÃO VTransporte de pesticidas
Artigo 29Condições para o transporte de
pesticidas1. Os pesticidas devem ser
transportados de forma separada de outrosprodutos, em especial de alimentos humanos ouanimais.

3. The companies or commercialestablishments that sell agriculturalpesticides and those used in public healthagainst disease vectors shall be registeredwith the DNSA and have a technician withbasic knowledge about the handling ofpesticides.
4. The establishments that tradepesticides and other products shall haveappropriate storage conditions, under theterms of these Regulations, and keep thepesticides in a separate location,particularly with respect to human andanimal food.
5. Class I pesticides can only be sold topesticide operators or users that arerecognized and approved by the DNSA,under the terms of article 30 of theseRegulations.
6. All commercial establishmentsselling agricultural pesticides and thoseused in public health against diseasevectors, operational on the date of theseRegulations entering into force, are subject toan environmental audit under the law and forlegal purposes.
7. Only adults and people without anyhealth problems are allowed to participate inthe trading of pesticides.

3. A DNSA pode submeter o aplicadorem causa a um teste com vista a aferir assuas capacidades técnicas.
4. A aplicação de pesticidas está vedadaa mulheres grávidas ou que estejam aamamentar e a menores.
Artigo 31Obrigações das empresas privadas
fomentadoras
1. As empresas privadas fomentadoresde culturas agrícolas são obrigadas aassegurar que os agricultores envolvidos naprodução de culturas cumpram as regras desegurança no manuseamento de pesticidas,bem como a fornecer a todos os aplicadoresde pesticidas equipamento de protecçãopessoal apropriado ao pesticida a serutilizado.

3. The DNSA can submit the applier inquestion to a test in order to measure histechnical capabilities.
4. The application of pesticides isprohibited for pregnant or breastfeedingwomen and for minors.
Article 31Obligations of the private crop
promotion companies
1. The private crop promotioncompanies are obliged to ensure that thefarmers involved in the production of cropsfollow the safety rules for pesticidehandling, as well as to provide all pesticideappliers with personal protection equipmentappropriate for the pesticide to be used.
2. The companies referred to in theprevious paragraph shall ensure the use ofprotection equipment and explain to theusers the risks and hazards of the use ofpesticides without adequate personalprotection equipment, and shall alsoorganise half-yearly training actions,informing the DNSA about these.

4. As empresas ou outras entidades quedesejem aplicar pesticidas como serviços aterceiros devem ter pessoal treinado portécnicos qualificados e aprovados pela DNSA.
5. As empresas ou outras entidadesaplicadoras de pesticidas devem empregarpessoas maiores de idade que estejamsuficientemente preparadas para garantir umtrabalho com a máxima segurança. Estasempresas não devem usar, nos serviços deaplicação de pesticidas, pessoas com i jadesuperior a sessenta anos, mulheres grávidas ouque estejam a amamentar.
6. O pedido de autorização paraaplicação de pesticidas deve seracompanhado da lista nominal e atestadosmédicos do pessoal a utilizar.
7. As empresas de prestação de serviçosde aplicação de pesticidas, devem submeterdurante os meses de Junho e Dezembro aoRegistador os atestados médicosactualizados dos seus trabalhadores.
8. A autorização de aplicador depesticidas tem validade de 2 anosrenováveis.
9. Às empresas ou outras entidadesaplicadoras de pesticidas assumem toda a

1. Without prejudice to other applicablelegislation, the pesticide application servicecompanies shall have a pesticide applicationpermit issued by the Registrar, after havingreceived a favourable opinion of the DNGAand the DNSP, and pay a fee as per Annex I ofthese Regulations.

3. Individuals who intend to providepesticide application services shall have apermit issued by the Registrar.
4. Companies or other entities thatintend to apply pesticides as services tothird parties shall have workers who aretrained by qualified technicians andapproved by the DNSA.
5. The companies or other entitiesapplying pesticides shall employ adults whoare sufficiently trained to guarantee workwith maximum safety. In the pesticideapplication service these companies shallnot make use of people older than 60 years orof pregnant or breastfeeding women.
6. The authorisation request forpesticides application shall be accompanied bya list and health certificates of thepersonnel to be used.
7. During the months of June andDecember the pesticide application servicecompanies shall submit updated healthcertificates of their workers to theRegistrar.
8. The pesticide application permit has avalidity of 2 years renewable.
9. Companies or other pesticideapplication entities assume fullresponsibility for the workers involved inthis activity.

1. Os pesticidas considerados peloRegistador como sendo eficazes para ocontrolo dum surto ou praga, numa situaçãode emergência, podem ser utilizados combase num registo para uso de emergênciaconcedido pelo Ministro que superintende aagricultura.
2. O registo referido no número 1 dopresente artigo tem a validade do período daemergência em referência.
3. Cabe ao Ministro que superintende aagricultura, sob proposta da DNSA,determinar as circunstâncias que constituemsituações de emergência no âmbito dopresente Regulamento e indicar as condiçõestécnicas e o prazo para a utilização dospesticidas.
4. Na determinação das circunstânciasque constituem situações de emergência oRegistador deve observar os princípios erequisitos gerais previstos no presenteRegulamento, particularmente os destinadosa proteger a saúde humana e a qualidade doambiente.
5. É proibida a comercialização depesticidas registados para uso deemergência.
6. Os pesticidas abrangidos por umregisto de emergência só podem seraplicados por técnicos dos Ministérios quesuperintendem a agricultura ou saúde ou porpessoal por estes indicado.
Artigo 34Uso experimental de pesticidas
1. A importação de pesticidas destinadosà experimentação para fins de registo está

2. The registration referred to inparagraph 1 of this article has a validitycorresponding to the emergency period inreference.
3. It is incumbent on the Ministersupervising agriculture to determine, on theproposal of the DNSA, the circumstancesconsidered emergencies in the scope ofthese Regulations and indicate the technicalconditions and term for the use of thepesticides.
4. In the determination of thecircumstances that constitute emergencies, theRegistrar shall observe the generalprinciples and requirements laid down inthese Regulations, particularly those aimed atthe protection of human health andenvironmental quality.
5. The trading of registered pesticides foremergency use is prohibited.
6. Pesticides covered by an emergencyregistration can only be applied bytechnicians of the ministries supervisingagriculture or health or by personnelindicated by these ministries.
Article 34Experimental application of pesticides
1. The importation of pesticides forexperimental use is subject to registration

Artigo 35Ensaio experimental de pesticidas com
fins de registo
1. O ensaio de pesticidas com objectivo deregisto é realizado pelo IIAM ou porinstituição de investigação do MISAU, e écusteado totalmente pelo requerente.
2. O ensaio mencionado no númeroanterior deve obedecer ao protocoloconstante do pedido de registo para usoexperimental de pesticidas elaborado pelainstituição que irá conduzir o mesmo.
3. A DNSA pode acompanhar esteensaio, devendo as despesas inerentes aeste acompanhamento ser por ela custeadas.
4. Quando um ensaio for interrompido, otitular da autorização para uso' experimentalde pesticidas deve comunicar tal facto aoRegistador, especificando as razoes queconduziram a tal decisão.
5. A instituição responsável pelarealização do ensaio de pesticidas com finsde registo deve assegurar que todas asinformações relevantes sejam anotadas norelatório do ensaio, incluindo os erroscometidos, observações climáticas edesenvolvimento vegetativo, bem comotodos os outros factores que possaminfluenciar os resultados ou sustentar a suainterpretação.

Article 35Experimental test of pesticides for the
purpose of registration
1. The testing of pesticides for thepurpose of registration is done by the IIAMor by an investigation institution of MISAU,and the cost is entirely borne by theapplicant.
2. The test mentioned in the previousparagraph shall follow the protocoldescribed in the request for registration ofpesticides for experimental use prepared by theinstitution that will carry out the test.
3. The DNSA can monitor this test, atits own cost.
4. When a test is interrupted, theholder of the permit for pesticides forexperimental use shall communicate thisfact to the Registrar, specifying the reasonsthat led to that decision.
5. The institution responsible forcarrying out the pesticide test for thepurpose of registration shall ensure that allrelevant information is noted down in thetest report, including committed errors,climatic observations and vegetativedevelopment, as well as all other factors

Artigo 36Armazém de pesticidas
1. Sem prejuízo da demais legislaçãoaplicável, a construção, adaptação oualteração de armazéns de pesticidas carecede autorização emitida pelo Registador,ouvida a DNGA.
2. O requerente deve solicitar, nostermos legais, uma licença ambiental antes daconstrução ou adaptação de qualquerarmazém de pesticidas.
3. O início da utilização do armazémconstruído ou adaptado só pode ter lugarapós a aprovação, pelo Registador, do acto devistoria, realizado conjuntamente com a DNGAe com a DNSP e o pagamento da respectivataxa de vistoria definida no Anexo I do presenteRegulamento.
4. Os armazéns de pesticidas emfuncionamento na data da entrada em vigordo presente Regulamento, são sujeitos auma auditoria ambiental a ser efectuada peloMICOA nos termos e para os efeitos legais.
5. Os trabalhadores de armazéns depesticidas devem ser submetidosanualmente a exames médicos e terematestados de saúde indicando que estãoaptos pira manusear pesticidas, devendoestes ser enviados à DNSA.
6. Os Ministérios que superintendem, asáreas da agricultura, ambiente e saúde,ouvido o INNOQ, definem as características,dos armazéns de pesticidas, os

Article 36Pesticides warehouse
1. Without prejudice to other applicablelegislation, the construction, adaptation orchange of pesticides warehouses is subject toan authorisation issued by the Registrar, afterhaving consulted the DNGA.
2. The applicant shall request, inaccordance with the legal terms, anenvironmental licence before theconstruction or adaptation of any pesticideswarehouse.
3. The built or adapted warehouse canonly be used after approval, by theRegistrar, of the inspection, carried outtogether by the DNGA and the DNSP andthe payment of the respective inspectionfee defined in Annex I of these Regulations.
4. The pesticides warehouses inoperation on the date of these Regulationsentering into force are subject to anenvironmental audit to be made by MICOAunder the law and for legal purposes.
5. The workers of pesticideswarehouses shall be submitted annually to aphysical examination and shall carry a healthcertificate indicating that they are fit forhandling pesticides, which shall be sent to theDNSA.

3. Os pesticidas devem igualmente seraplicados de modo a não prejudicarem asculturas, animais, consumidores dosprodutos vegetais e animais, organismos nãovisados, bem como minimizar o risco para oaplicador, para a população em geral e para omeio ambiente.
4. É proibido a aplicação de pesticidaspor menores de idade e por mulheresgrávidas ou que estejam a amamentar.
SECÇÃO IIProdução, embalagem e
reembalagem de pesticidasArtigo 38
Condições para a Produção de pesticidas
1. Sem prejuízo da demais legislaçãoaplicável, os estabelecimentos destinados àprodução de pesticidas só podem iniciar assuas actividades após a obtenção dodespacho final do auto de vistoria emitido peloRegistador.
2. A equipa de vistoria é liderada pelaDNSA e integra membros da DNSP e daDNGA.
3. A equipa de vistoria pode aindaintegrar membros de outras instituições e/ouorganizações.
4. Qualquer alteração que possa pôr emcausa a segurança dos estabelecimentos deprodução de pesticidas deve ser autorizada

3. The pesticides shall also be appliedin such a way that they do not prejudicecrops, animals, consumers of plant andanimal products, non-targeted organisms,and also to minimize risks to the applicant, tothe population in general and to theenvironment.
4 The application of pesticides byminors and by pregnant and breastfeedingwomen is prohibited.
SECTION IIProduction, packing and repacking
of pesticidesArticle 38
Conditions for the production ofpesticides
1. Without prejudice to other applicablelegislation, the pesticide productionestablishments can only start their activitiesafter having obtained the final decisionabout the inspection certificate issued bythe Registrar.
2. The inspection team is led by theDNSA and includes members of the DNSPand the DNGA.
3. The inspection team can also includemembers of other institutions and/ororganisations.
4. Any change that may endanger thesafety of the pesticide production

Artigo 39Embalagens de pesticidas
1. A doação e comercialização depesticidas no País só podem ser feitas emembalagens aprovadas pelo Registador noacto do registo do pesticida em causa.
2. Os pesticidas devem ser embalados nolocal da sua produção.
3. As embalagens devem ser fechadas eseladas na origem, de modo a serem abertascom segurança, e os respectivos selosirremediavelmente destruídos assim que aembalagem seja aberta pela primeira vez.
4. Qualquer alteração da embalagemdeve ser previamente autorizada peloRegistador.
5. As embalagens devem obedecer aosseguintes requisitos:
a) Devem ser concebidas eproduzidas de modo a impedirqualquer derrame do seuconteúdo;
b) Os materiais de que asembalagens são feitas e ossistemas de oclusão não devemser atacados pelo seu conteúdonem ser susceptíveis de com elesformar combinações nocivas ouperigosas;
c) As embalagens e os sistemas deoclusão devem, em todas as suaspartes, ser sólidos e resistentes,de modo a excluir qualquerafrouxamento e estar

Article 39Packing of pesticides
1. The donation and trading ofpesticides in the country can only be donein packages approved by the Registrar atthe time of the registration of the pesticide inquestion.
2. Pesticides shall be packed on theproduction site.
3. Packages shall be closed and sealedat source, to be opened with safety, andthe respective seals irremediably destroyedwhen the package is opened for the firsttime.
4. Any change to the packages shall bepreviously authorized by the Registrar.
5. The packages shall comply with thefollowing requirements:
a) They shall be designed andproduced so as to impede anyspilling of their content;
b) The materials of which thepackages are made and theclosing systems shall neither beattacked by their content nor besusceptible to form noxious orhazardous compounds withthem;
c) All parts of the packages andclosing systems shall be solidand resistant, so as to excludeany slackening and be strictly in

Artigo 40Reembalagem de pesticidas

2. A reembalagem com propósitoscomerciais está sujeita a uma autorização e aopagamento de uma taxa definida noAnexo 1 do presente Regulamento. Nopedido de autorização deve constar a licençaambiental.
3. Os locais de reembalagem depesticidas só podem entrar emfuncionamento após a sua aprovação, a qualserá baseada numa vistoria efectuada pelaDNSA em colaboração com a DNGA e DNSP.
4. As embalagens de pesticidas usadasna reembalagem devem respeitar todos osrequisitos estabelecidos no artigo 39 dopresente Regulamento.
5. A validade da autorização dereembalagem de pesticidas é de 5 anosrenováveis.
6. Antes de terminada a validade daautorização de reembalagem e caso seja doseu interesse, os interessados devemsolicitar a sua renovação por carta dirigidaao Registador.
7. As empresas reembaladoras depesticidas estão sujeitas ao pagamento deuma taxa anual definida no Anexo 1 dopresente Regulamento. Esta taxa deve serpaga cm Janeiro de cada ano.
8. O não pagamento da taxa referida nonúmero anterior do presente artigo implica arevogação da autorização de reembalagem.
9. Os Ministros que superintendem asáreas da agricultura, ambiente e saúde,ouvido o INNOQ, definem as característicasdos locais de reembalagem de pesticidascom fins comerciais, os procedimentos e ascondições de reembalagem, as regras

Article 40Repacking of pesticides
1. Only registered pesticides can berepacked in Mozambique.

3. The pesticide repacking sites canonly start functioning after their approval,which will be based on an inspection carriedout by the DNSA in collaboration with theDNGA and the DNSP.
4. The pesticide packages used forrepacking shall fulfil all requirements laiddown in article 39 of these Regulations.
5. The pesticide repackingauthorisation has a validity of 5 yearsrenewable.
6. Before the term of the repackingauthorisation validity and if it is in theirinterest, the interested party shall requestits renewal in a letter addressed to theRegistrar.
7. The pesticide repacking companiesare subject to the payment of an annual feeas per Annex 1 of these Regulations. Thisfee shall be paid in January of each year.
8. The non-payment of the fee referred toin the previous paragraph of this articleimplies the cancellation of the repackingauthorisation.
9. The Ministers supervising the areasof agriculture, environment and health,having consulted the INNOQ, will define thecharacteristics of the pesticide repackingsites for commercial purposes, therepacking procedures and conditions, thetechnical repacking rules and other relatedaspects.

Artigo 42Medidas de segurança para armazéns de
pesticidas1. Os armazéns ou depósitos de
pesticidas devem reunir os seguintesrequisitos:
a) Ser construídos de modo aproteger os pesticidas decondições climáticas adversas e aimpedir a entrada de pessoas nãoautorizadas;
b) Estar situados a uma distânciamínima de 100 metros dehabitações e/ou locais onde sãoproduzidos, consumidos ouarmazenados alimentos, bebidas,medicamentos, rações, ou outrosprodutos que possam entrar emcontacto com pessoas ouanimais. 2. É proibido confeccionar alimentos,comer, beber ou fumar no interior dosarmazéns de pesticidas.
SECTION IIIPesticide storage
Article 41Pesticide storage conditions
The Ministers supervising the areas ofagriculture, environment and health, incoordination with the INNOQ, arecompetent to define the pesticide storageand handling procedures.
Article 42Safety measures for pesticide
warehouses
1. The pesticide warehouses or depotsshall satisfy the following requirements:
a) Be built in such a way as toprotect the pesticides fromadverse climate conditions andto impede the entry ofunauthorized people;
b) Be situated at a minimumdistance of 100 metres fromresidences and/or places wherefood, beverages, medicines,animal feed, or other productsthat may enter into contact withpeople or animals are produced,consumed or stored. When theconstruction of two or morewarehouses is foreseen, theseshall have enough space toallow the passage of fire enginesin case of need.
c) Have appropriate equipment forthe safety and protection ofpeople, products and goods,both under normal conditionsand in cases of emergency.
d) Be supervised and guarded bypeople with knowledge aboutemergency, pesticide handlingand warehouse managementprocedures.
2. It is prohibited to prepare food or toeat, drink or smoke inside pesticidewarehouses.
3. The entry of pesticides intowarehouses shall be done with the use of

SECÇÃO IVComercialização
Artigo 43Condições para a Comercialização de
Pesticidas1. A colocação no mercado de um
pesticida, bem como a publicidade com elerelacionada, só podem ser efectuadas deacordo com os requisitos constantes dopresente Regulamento.
2. A colocação no mercado de produtospesticidas só é permitida em embalagensfechadas e seladas nos termos estabelecidos nopresente Regulamento.
3. Independentemente do tipo ecategoria de uso, os locais de venda e dedepósito de produtos pesticidas devempermitir um adequado isolamentorelativamente a alimentos e medicamentospara uso humano ou animal.
4. Os locais de venda e de depósito deprodutos pesticidas ficam sujeitos àobservância das medidas cautelares julgadasindispensáveis para prevenir todos osperigos decorrentes de contaminação ouderrame dos referidos produtos.
5. Na comercialização dos pesticidasdevem observar-se as seguintes regras:
a) Constar na factura, recibo e/ouvenda a dinheiro de cada venda,o nome do comprador, a marcado produto, o número de lote, asrespectivas quantidades e datasde venda;

SECTION IVTradingArticle 43
Conditions for the Trading of Pesticides
1. The placing on the market of apesticide, as well as related advertising, canonly be done in accordance with therequirements laid down in theseRegulations.
2. The placing on the market ofpesticide products is only allowed in closedand sealed packages under the termsestablished in these Regulations.
3. Irrespective of the type andcategory of their use, the points of sale anddepots of pesticide products shall allowtheir adequate isolation from food andmedicines for human or animal use.
4. The points of sale and depots ofpesticide products are subject to thefulfilment of the precautionary measuresdeemed indispensable to prevent allhazards resulting from the contamination orspilling of these products.
5. The following rules shall be observed inthe trading of pesticides:
a) The buyer’s name, the productbrand, the lot number, therespective sales quantities anddates shall be included in theinvoice, receipt and/or cash saleof each sales transaction;
b) Sales by or to minors, patientsaffected by psychic disorder,blindness, or another obvious

6. A composição, o teor em substânciaactiva, as características físico-químicas e ascaracterísticas da actividade biológica dosprodutos pesticidas têm de apresentarvalores que estejam de acordo com ascondições que fundamentaram o registo doproduto.
7. Expirado o prazo de validade do lotede um pesticida, o mesmo deve serimediatamente retirado do mercado,passando a ser considerado um pesticidaobsoleto.
Artigo 44Requisitos técnicos para as empresas de
comercialização
1. As entidades responsáveis pelacomercialização de pesticidas devem dispor depelo menos um técnico responsável e compreparação adequada para assegurar aobservância das determinações técnicascontidas no presente Regulamento, o qualservirá de interlocutor junto à DNSA.
2. A identidade do técnico acima referidodeve ser comunicada ao Registador pelosproprietários dos estabelecimentoscomerciais.
3. Os comerciantes de pesticidas devemfornecer trimestralmente ao Registador as

6. The composition, active substancecontent, physical-chemical characteristicsand the characteristics of the biologicalactivity of the pesticide products must havevalues that are in accordance with theconditions that founded the product’sregistration.
7. When the period of validity of apesticide lot has expired, it shall bewithdrawn immediately from the marketand be considered an obsolete pesticide.
Article 44Technical requirements for trading
companies
1. The entities responsible for thetrading of pesticides shall have at least onetechnician responsible for and withadequate training to ensure compliancewith the technical provisions contained inthese Regulations, and who will act asinterlocutor vis-à-vis the DNSA.
2. The identity of the technicianreferred to in the previous paragraph shallbe communicated to the Registrar by theowners of the commercial establishments.
3. The pesticide traders shall providequarterly information to the Registrar about

As empresas ou outras entidades quetenham pesticidas obsoletos devemcomunicar imediatamente e por escrito ofacto ao Registador, com conhecimento daDNGA, indicando a localização do produto, amarca comercial, substância activa, data defabrico e expiração do prazo, bem como otipo de embalagem e as razões que levaram àobsolência dos mesmos.
Artigo 46Revalidação de Pesticidas
1. Antes ou logo após a data deexpiração do prazo de um pesticida, estepode ser testado com vista à revalidação doseu estado, devendo a empresa solicitar umaautorização ao Registador para o envio daamostra indicando a quantidade a serenviada, o(s) número(s) de lote(s), as datas defabrico e expiração do prazo.
2. No acto de envio das amostras,devem ser respeitadas todas as convençõesinternacionais de que Moçambique sejaparte.
3. O original do certificado das análisesdeve ser enviado ao Registador comconhecimento da DNGA, para a prorrogação davalidade do pesticida.
4. No certificado de análise deve constara data de recepção do pesticida para análise,o número de lote, data de fabrico eexpiração do prazo, os dados da análise emcausa, bem como a nova validade doproduto.
5. Para o efeito dos números anteriores,o proprietário deve apresentar ao Registador

SECTION VObsolete pesticides
Article 45Use of obsolete pesticides
1. The importation, donation, tradingand application of obsolete pesticides areprohibited.
2. Companies or other entities thathave obsolete pesticides in stock shallcommunicate the fact immediately and inwriting to the Registrar, with a copy to theDNGA, indicating the location of theproduct, the trade mark, active substance,manufacturing and use-by date, as well asthe type of packages and the reasons that ledto their obsolescence.
Article 46Revalidation of pesticides
1. Before or immediately after theexpiration of the use-by date of a pesticide,it may be tested with a view to therevalidation of its condition. To this effectthe company shall submit a request forauthorisation to the Registrar to send asample indicating the quantity to be sent,the lot number(s) and the manufacturingand use-by dates.
2. At the time of sending the samples, allinternational conventions to whichMozambique is a party shall be respected.
3. The first copy of the analysescertificate shall be sent to the Registrar, cc tothe DNGA, for the extension of thepesticide’s validity.
4. The analysis certificate shall includethe date of reception of the pesticide foranalysis, the lot number, the manufacturingdate and the use-by date, the date of theanalysis in question, as well as the newvalidity of the product.
5. For the purpose of the previousparagraphs, the owner shall communicate

7. O Registador reserva-se o direito desolicitar que as análises em causa sejamfeitas num laboratório credenciado ereconhecido pela DNSA e DNGA, sendonestes casos responsável pelo envio erecepção dos resultados das análises ecorrendo as despesas a cargo do proprietário doproduto.
Artigo 47Eliminação de pesticidas obsoletos
1. É proibida a eliminação ou destruição depesticidas obsoletos sem a autorização daDNGA, ouvido o Registador.
2. A DNGA, em coordenação com oRegistador e ouvidos a DNSP e o INNOQ,deve apresentar uma proposta contendo oprazo para a destruição ou eliminação depesticidas obsoletos e observando o dispostona Lei do Ambiente e demais legislação emvigor.
3. Compete à empresa proprietária dopesticida obsoleto custear as despesas dadestruição, incluindo as inerentes àsupervisão por parte da DNGA e doRegistador.
4. A empresa deve apresentar orelatório do processo de destruição à DNGAcom conhecimento do Registador.
5. O processo de destruição depesticidas obsoletos, quando realizadodentro do País, deve ser supervisionado pelaDNGA e DNSA. Caso a eliminação seja feitafora do País, o processo de exportação deveser igualmente supervisionado pela DNGA eDNSA com observância de todos osprocedimentos e regras internacionais.
6. A DNGA e DNSA devemobrigatoriamente coordenar as acções

Article 47Elimination of obsolete pesticides
1. The elimination or destruction ofobsolete pesticides without authorisation ofthe DNGA, after having consulted theRegistrar, is prohibited.
2. The DNGA, in coordination with theRegistrar and having consulted the DNSPand the INNOQ shall present a proposalcontaining the time limit for the destructionor elimination of obsolete pesticides andobserving the provisions of theEnvironment Law and other legislation inforce.
3. It is incumbent on the companyowning the obsolete pesticide to bear thecost of their destruction, including thoseresulting from the supervision on the partof the DNGA and the Registrar.
4. The company shall present adestruction report to the DNGA, with a copy tothe Registrar.
5. The destruction of obsoletepesticides, when done inside the country,shall be supervised by the DNGA and theDNSA. If the elimination is done outside thecountry, the exportation shall also besupervised by the DNGA and the DNSA, inaccordance with all international proceduresand rules.

2. Todas as embalagens de pesticidas,quando vazias, devem ser descontaminadasatravés da tripla lavagem, tomando-se osdevidos cuidados para que não se contaminerios, lagos ou quaisquer cursos de águassuperficiais ou subterrâneos.
3. Após a descontaminação, asembalagens vazias podem ser reutilizadaspelo formulador para o acondicionamento denovos pesticidas.
4. Caso não seja possível a reutilizaçãode embalagens por diversos motivos, elasdevem ser destruídas em moldes aprovadospelo Registador no acto do registo dopesticida.
5. A empresa ou entidade proprietáriadas embalagens deve consultar asautoridades ambientais, sanitárias oumunicipais para informar-se sobre otratamento adequado a observar sobre asembalagens vazias.
6. Devem ser tomadas todas asprecauções necessárias para evitar que aeliminação de embalagens contamine rios,lagos ou quaisquer cursos de águassuperficiais ou subterrâneos.

Article 48Elimination of non-obsolete pesticides
The elimination of non-obsoletepesticides shall be done in accordance withthe criteria defined by the DNGA, incoordination with the Registrar and theDNSP.
Article 49Elimination of empty packages
1. Empty pesticide packages shall not bereused for packing any type of human oranimal food or water.
2. All empty pesticide packages shallbe disinfected through triple washing,taking due care to avoid the contaminationof rivers, lakes or any surface orunderground water courses.
3. After disinfection, empty packagescan be reused by the formulator for packingnew pesticides.
4. In case the reuse of packages is notpossible for various reasons, they shall bedestroyed in ways approved by theRegistrar at the time of registration of thepesticide.
5. The company or entity owning thepackages shall consult the environmentalhealth or municipal authorities to inquireabout adequate treatment to be given toempty packages.
6. All necessary precautions shall betaken to avoid that the disposal of packagescontaminates rivers, lakes or any surface orunderground water courses.

2. Os Ministros que superintendem asáreas da agricultura, ambiente e saúdedefinem os critérios para a classificaçãotoxicológica dos pesticidas, que devemrespeitar os padrões internacionais definidospela FAO e OMS.Artigo 52Limite máximo de resíduo j de pesticidas
1. Os agricultores devem respeitar osintervalos de segurança referidos nosrótulos, relativos ao período entre a últimaaplicação de um pesticida e a colheita doproduto.
2. Os valores do Limite Máximo deResíduos (LMR) de um pesticida em produtosalimentares são estabelecidos pelo ComitéNacional do codex alimentarius.

1. As empresas ou entidades que empregam pessoas no processo dearmazenamento, comercialização,transporte, aplicação e eliminação depesticidas devem assegurar a formaçãocontínua e actualizada do seu pessoal,incluindo regras para o combate a incêndios,intoxicações, primeiros socorros,derramamentos e outros perigos.

Article 52Maximum Residue Limit of pesticides
1. The farmers shall respect the safetyintervals indicated on the labels, withrespect to the period between the lastapplication of a pesticide and the product’sharvest.
2. The values of the Maximum ResidueLimit (MRL) of a pesticide for food productsare defined by the National Committee ofthe codex alimentarius.
CHAPTER VIITechnical training,
dissemination and advertisingArticle 53
Technical training on pesticidemanagement
1. The companies or entities employingpeople for pesticide storage, trading,transport, application and elimination shallensure continuing and updated training oftheir staff, including rules for combatingfires, intoxication, first-aid, spills and otherhazards.

Artigo 54Divulgação de informações sobre

1. O Registador deve publicar a lista detodos os pesticidas registados no País, assimcomo a lista dos pesticidas proibidos,banidos ou de uso restrito, até 15 dias apósa aprovação dos pedidos de registo peloCATERP.
2. Cabe ainda ao Registador, emparceria com outras instituições, incluindo osórgãos de comunicação social públicos eprivados e as organizações da sociedadecivil, ambientais ou outras, disseminarregularmente toda a informação necessáriapara o conhecimento e consciencialização dopúblico sobre o uso de pesticidas e sobre asnormas aplicáveis no País.
3. As Alfândegas devem enviar à DNSA,trimestralmente, a lista dos pesticidasimportados no período em causa, a qualdeve conter os seguintes dados:
a) Marca comercial do produto;b) Substância activa e teor;c) Quantidade importada por
embalagens e volume;d) Tipo e tamanho de embalagens;e) Preço FOB;f) Nome do importador;g) Data de chegada;h) Posto de entrada.
Artigo 55Publicidade de Pesticidas
1. Todo o material de publicidaderelativo a pesticidas registados, incluindo osrótulos, deve conter informações verdadeiras enão deve incluir frases, expressões oupalavras susceptíveis de enganar o utilizador eo público em geral, tais como: "o maisefectivo" ou "controlo máximo", "não tóxico","inócuo", "inofensivo".
2. The companies are responsible forthe training of their staff, while the DNSA,in coordination with the DNGA and theDNSP, are responsible for the preparationand administration of these courses.
3. The DNSA may delegate this activity toanother institution.
Article 54Dissemination of information about
pesticides
1. The Registrar shall publish a list ofall pesticides that are registered in thecountry, as well as a list of prohibited,banned or restricted pesticides, until 15days after the approval by the CATERP ofrequests for registration.
2. It is also incumbent on theRegistrar, in partnership with otherinstitutions, including the public and privatemedia and civil society, environmental orother organisations, to disseminateregularly all necessary information for thecognisance and awareness-raising of thepublic about the use of pesticides and theapplicable standards in the country.
3. The Customs shall send a quarterlylist to the DNSA of the pesticides importedin the period in question, which shallcontain the following data:
a) Trademark of the product;b) Active substance and content;c) Imported quantity, per package
and by volume;d) Type and size of packages;e) FOB price;f) Name of the importer;g) Date of arrival;h) Entry point.
Article 55Advertising of Pesticides
1. All advertising material with respectto registered pesticides, including theirlabels, shall contain true information andshall not include sentences, expressions orwords that are liable to mislead the userand the public in general, such as: "themost effective" or "maximum control ","non-toxic", "innocuous", "harmless".

2. A publicidade sobre pesticidas podeser proibida ou suspensa pelo Registador,sempre que se constate que contrarie asnormas em vigor ou a informação contida norótulo aprovado.
3. As referências de ordem técnica sobreas qualidades biológicas e físico-químicas dospesticidas devem ter um fundamento técnicoem conformidade com o disposto nopresente Regulamento, não sendo permitidasafirmações sobre a superioridade de unspesticidas em relação a quaisquer outros.
4. É proibida a publicidade de pesticidasnão registados.
5. A publicidade de pesticidas deve seraprovada pelo Registador medianteapresentação de um pedido, acompanhadodo material em forma digital e impressa emediante o pagamento de uma taxa definida noAnexo 1 do presente Regulamento.
6. É obrigatória a inclusão em todos osmateriais de propaganda da inscrição: "Antes deusar, leia o rótulo".
CAPÍTULO VIIIInspecção e fiscalização
Artigo 56Competências
1. Sem prejuízo das competênciasatribuídas a outras instituições, osinspectores e fiscais credenciados pela DNSAavaliam e controlam o cumprimento dasnormas definidas no presente Regulamentorelativas à importação, armazenamento,aplicação, produção, comercialização,eliminação, manuseamento e controlo dequalidade de pesticidas.
2. A DNSA pode solicitar que, naavaliação e controlo, seja integrado pessoal deoutras instituições ou entidades.
3. Os inspectores e fiscais credenciadospela DNSA têm livre acesso a todos osestabelecimentos ou locais de produção,armazenamento, comercialização, eliminação eaplicação de pesticidas.
2. Advertising of pesticides may beprohibited or discontinued by the Registrar,whenever it is established that it violatesexisting norms or information contained in theapproved label.
3. Technical references to the biologicaland physical-chemical qualities of thepesticides shall have a technical foundationin conformity with the provisions of theseRegulations, while assertions about thesuperiority of certain pesticides in relation toany others are not allowed.
4. The advertising of unregisteredpesticides is prohibited.
5. The advertising of pesticides shall beapproved by the Registrar through thesubmission of a request, together withelectronic and printed material and throughthe payment of a fee as per Annex 1 ofthese Regulations.
6. The inclusion of the phrase "Readthe label before use" in all registrationadvertising material is obligatory.
CHAPTER VIIIInspection and Control
Article 56Powers
1. Without prejudice to the powersgranted to other institutions, the inspectorsand controllers certified by the DNSAassess and control the fulfilment of thestandards defined in these Regulations withrespect to pesticide importation, storage,application, production, trading,elimination, handling and quality control.
2. The DNSA may request the inclusion ofstaff from other institutions or entities in theassessment and control activities.
3. The inspectors and controllerscertified by the DNSA have free access toall pesticide production, storage, trading,elimination and application establishments orsites.
4. The persons in charge of theestablishments dealing with pesticides shallgrant access to the inspectors andcontrollers, provide all requestedinformation without omissions, not withholdfacts, as well as implement therecommendations given by them.

2. O Auto de Notícia deve indicar asconstatações e indicar o tratamento legalreservado a cada irregularidade, de acordocom o anexo 2 do presente Regulamento.
3. Todas as recomendações estipuladaspelos inspectores ou fiscais no Auto deNotícia devem ser rigorosamentecumpridas.
4. Os inspectores ou fiscais deveuproduzir um relatório pormenorizado quedeve ser enviado à DNSA.
CAPÍTULO IXTaxas, infracções e penalidades
Artigo 58Taxas
1. As taxas a cobrar pelos serviçosprestados ao abrigo do presenteRegulamento constam no Anexo I dopresente Regulamento.
2. Os valores pagos pelos requerentespara a obtenção de licenças ou autorizações noâmbito do presente Regulamento não sãoreembolsáveis, mesmo em caso de recusado pedido.
3. O pagamento das taxas é efectuadojunto da DNSA, em conformidade com osprocedimentos definidos.
4. Os valores das taxas sãoactualizados pelos Ministros quesuperintendem as áreas da agricultura edas finanças.

Article 57Procedures
1. At the end of each inspection orcontrol activity, a respective report shall bedrawn up.
2. The Report shall indicate the findingsand indicate the legal treatment of eachirregularity, in accordance with Annex 2 ofthese Regulations.
3. All recommendations formulated bythe inspectors or controllers in the reportshall be strictly adhered to.
4. The inspectors or controllers shallproduce a detailed report to be sent to theDNSA.
CHAPTER IXFees, transgressions and
penaltiesArticle 58
Fees
1. Annex I of these Regulationsstipulates the fees to be collected for theservices provided under these Regulations.
2. The amounts paid by the applicantsfor acquiring licences or permits in the scopeof these Regulations cannot be paid back,even in the case of refusal of the request.
3. The payment of the fees is done tothe DNSA, in conformity with the definedprocedures.
4. The amounts of the fees are updated bythe Ministers supervising the areas ofagriculture and of finance.

Artigo 60Infracções e Penalizações
1. As violações do disposto no presenteRegulamento constituem infracçõesadministrativas puníveis de acordo com oAnexo 2 e que podem resultar naapreensão, confisco, multa, abertura deprocesso-crime contra a saúde pública oucombinação entre estas.
2. Sem prejuízo das demais medidasaplicáveis, cabe ao proprietário a remoçãoe/ou destruição de pesticidas em situaçãoirregular e pesticidas obsoletos, nos termosestabelecidos no presente Regulamento,bem como a compensação ambiental, casose aplique.
3. O Estado goza do direito de regressorelativamente a qualquer despesa em quetenha incorrido resultante da apreensão,remoção e/ou destruição de pesticidas não

Article 60Transgressions and penalizations
1. The violation of the provisions ofthese Regulations constitute administrativetransgressions punishable in accordancewith Annex 2 and which can result in theseizure, confiscation, penalization,institution of proceedings for crimes againstpublic health or a combination of these.
2. Without prejudice to other applicablemeasures, it is incumbent on the owner toremove and/or destroy pesticides in anirregular situation and obsolete pesticides,under the terms established in theseRegulations, as well as environmentalcompensation, if applicable.
3. The State has the right of recoverywith respect to any expense incurred as aresult of the seizure, removal and/ordestruction of unregistered or obsoletepesticides or pesticides used in an irregularway.

Artigo 61Pagamento de Multas
1. O prazo para o pagamento voluntárioda multa é de 15 dias contados a partir dadata de notificação. Findo este prazo, é feita asua cobrança coerciva, sendo o valoracrescido em 50%.
2. A entidade emissora da multa deveremeter à DNSA uma informação sobre ospagamentos referidos no número anterior dopresente artigo, juntando à mesma cópias detoda a documentação de suporte.
Artigo 62Destino do valor das multas
O valor das multas Cobradas pelasinfracções ao presente Regulamento tem oseguinte destino:
a) 40% para os cofres do Estado;b) 60% para o Ministério que

1. The time limit for the voluntarypayment of fines is 15 days from the dateof notification. In case this limit isexceeded, their compulsory collection willbe done, with a 50% increase of theamount.
2. The entity imposing the fine shallsend information to the DNSA about thepayments referred to in the previousparagraph of this article, together withcopies of all supporting documents.

The fines collected for transgressions ofthese Regulations have the followingdestination:
