Title I

GENERAL PROVISIONS

Art. 1 University identification: (1) The official name is Constanta Maritime University (CMU). CMU was established

based on the GD no. 113/1990 of February 6, 1990, published in the Romanian Official

Journal no. 68 of April 16, 1992.

(2) CMU headquarters is Romania, Constanta, 104, Mircea cel Bătrân Street, zip code

900663. The e-mail address is www.cmu-edu.eu.

(3) CMU is a legal, non-profit entity, of public interest, independent of ideologies,

religions and political doctrines, attached to the tradition of free thinking, academic freedom,

recognition of human rights and fundamental freedoms and the rule of law.

(4) CMU is a university accredited with a "degree of trust".

(5) CMU Day is celebrated annually on February 6.

(6) CMU is a member of the academic consortium with Polytechnics University of

Bucharest under contract no. nr.2618/23.05.2011 and the documents attached to the contract,

present and future additions respectively.

(6) the following are pending for registration with OSIM (State Office for Inventions

and Trademarks), and they are the property of CMU and may be used only according to the

law provisions.

a) the official name;

b) the emblem, logo, flag and ceremonial attire (coat and toque), badge;

c) institution abbreviation.

Art.2. CMU operates under the constitution, the legal provisions for higher education and

other legal regulations in Romania and the European Union.

In the process of achieving the educational and research objectives, the following

principles are to be applied:

a) academic autonomy;

b) freedom of research, teaching and knowledge transfer;

c) accountability;

d) quality assurance;

e) compliance with equity;

f) managerial and financial efficiency;

g) management of financial resources and heritage of the University, subject to their

destination;

h) transparency;

i) respect of the rights and freedoms of the members of the academic community;

j) partnership with economic and social actors;

k) independence of ideologies, religions and political doctrines;

l) student-centered education;

m) the freedom to edit scientific publications.

Art.3. The mission of CMU is to provide advanced study programs at all levels of

undergraduate and postgraduate training for:

- training specialists for shipping operations and conducting research in related

scientific fields, with an emphasis on the recognition of competition as a factor of progress

and quality management as a tool for continuous improvement of educational process and

research;

- promoting education and research in accordance with the requirements of a

knowledge-based society through initial training, continuing education and integration in the

circuit of universal values;

- providing contribution to the local, regional and national academic community

through involvement in social, economic and cultural activities.

Art.4. In carrying out its mission CMU provides:

a) strategic and efficient management of human and material resources;

b) assuming the principle of quality in the entire university activity;

c) training, development and dissemination of social values;

d) creation of favorable conditions for scientific development and promotion young

people with high intellectual performances;

e) a gradual increase in the research component within the entire CMU activity,

reflected in the development of specialized research structures, by increasing research within

the faculties and the research centers, the presence of more active reseearch competition for

funding through grants, contracts and research programs, both domestically and at a

European level;

f) general skills training, specialized and cross-compatible with the stage of society

modernization;

g) develop partnerships with other universities in order to develop joint majors and

developing undergraduate and postgraduate curricula;

h) establishing bilateral protocols with universities and companies in the marine

world to ensure exchange of students and teachers and the exchange of experience in the

maritime sector;

i) developing relationships with alumni;

j) transparent institutional management;

k) strengthening the academic community spirit;

l) promotion of scientific, cultural and ethical regional community, nationally and

internationally.

Art.5. (1) CMU has its own heritage, and manages it according to the law.

(2) The property is rightfully owned and managed by the university according to the

law. University ownership of the goods is exercised in compliance with the law.

(3) The goods obtained as revenues are de jure the private property of the university.

(4) the University owns the management rights on public or private property,

acquired under the law.

Art.6. (1) CMU operates as an institution financed from funds allocated from the state budget

derived from fees and amounts charged for university and scientific benefits, interests,

donations, sponsorships and other sources mobilized by law, such as contributions from other

ministries, loans or foreign aid. The income from sources other than the university budget is

managed entirely within the legal provisions.

(2) All UMC funding resources are proper incomes.

ORGANIZATIONAL STRUCTURE

Art.7. The organizational structure of CMU is approved by the Senate and is given by CMU

Organization Chart. (Appendix 1)

Art.8. The organizational structure complies with the principle of hierarchical authority,

represented by the organizational structures and functions of the organization chart.

Art.9. The organizational structure is Shown in Annex 1 of this Regulation and is part of it.

Art. 10. The organization of the teaching process and research is presented in Chapter VII of

CMU Charter, VII and IX.

Art. 11. The main component of the organizational structure of university education and

research is to develop and manage programs of study in one or more areas of study, develops

employment position lists, according to the law and draws up orders by departments to cover

all the needs of the teaching staff.

Art. 12. The organization includes organizational structures established as administrative

divisions, services, offices and departments under the law.

CMU MANAGEMENT SYSTEM

Art. 13. CMU management structures are the Senate and the Administrative Board, the

Faculty Councils, and the Council for doctoral studies and the departments’ Councils.

Art. 14. (1) The University Senate is the academic community and is the highest decision-

making, deliberative body in the university.

(2) The University Senate is made up of 75% of the representatives of tenure

teachers and 25% of student representatives. The members of the university senate are 28, 3

representatives from each department of the university and 7 students.

(3) The representatives of the faculty senate are elected by universal, direct and

secret vote of all CMU tenure teachers.

(4) The students representatives in the Senate are elected by universal, direct and

secret vote of all students enrolled in CMUstudy programs.

Art. 15. The duties of the university senate are:

a) to ensure academic freedom and university autonomy;

b) to develop and adopt the University Charter, after debating with the university

community;

c) to approve the strategic plan for institutional development and operational plans,

upon Rector’s proposal;

d) to approve upon Rector’s proposal and in compliance with the current legislation,

the structure, organization and operation of the university;

e) to approve the budget and budget execution;

f) to develop and approve the quality code and the code of ethics and university

professional conduct;

g) to adopt the university code of student rights and obligations, under the law;

h) to sign the management contract with the Rector;

i) to approve the financial transactions ceiling that may be decided upon by the

Rector and the ceiling for financial transactions that can be decided upon with the approval of

the Board;

j) to monitor the activity of the Rector and the Administrative Board by means of

specialized committees;

k) to validate public competitions for the positions of the Board;

l) to approve of the results of competitions for employing teaching and research staff

and regularly evaluate human resources;

m) to approve, upon Rector’s proposal, of the staff sanctioning for poor professional

performances, based on its own methodology and legislation;

n) to approve, upon proposal of the Administrative Board, of the regulations and

methodology regarding:

1) the admission, organization, unfolding and completion of graduate and

postgraduate programs;

2) the conferring of titles and the filling of teaching and research positions;

3) the conferring of memberships in the academic community;

4) the fees charged and exemption or reduction of payment cases;

5) the recognition and equivalence of academic studies attended by students

domestically and abroad;

6) the periodic evaluation of performance results for teaching and research activities

within the university;

7) the quantification in conventional hours of the various activities under the teaching

quota in accordance with the law;

8) the organization and operation of academic structures;

9) other aspects pertaining to the professional and scientific activity;

a) in case of Rector’s dismissal by the minister, the University Senate designates a

university rector who is representing the university and becomes budget manager in

accordance with the law, and completes the procedures for election of a new rector;

b) approves the establishment, organization, division, merger and dissolution of their

own teaching and research structures;

c) approves the ways in which they can run national and international cooperative

activities;

d) approves the establishment on its own or by association of companies,

foundations or associations and the granting, by contract, of the right to use the asset

management and property;

e) approves annually, at least 3 months prior to the beginning of the academic year,

the academic year structure, the regulation of student activities and educational activities

specific to the timing of academic study semesters;

f) approve the curriculum of the study programs;

g) approve the cancellation by the rector of certificates or diplomas, when it turns

out that they were obtained by fraudulent means or by violating the Code of University Ethics

and Deontology;

h) approve annually the undergraduate study programs offered by CMU and double

majors, according to the law;

i) approves, in the accredited or provisionally approved areas for M.D. studies, the

promoted study programs;

j) determines the number and composition of the committee appointed to coordinate

the elections for the structures and positions of management;

k) approves, under special circumstances, upon the suggestion of the Ph.D.

coordinators and the availability of funds, the extension by 1-2 years of the three year-

doctoral study program;

l) approves the teaching and research positions and the number of positions for

research and auxiliary staff;

m) may decide upon the increase, by regulation, of the minimum weekly teaching

assignments in compliance with quality assurance standards without exceeding the maximum

quota prescribed by the law;

n) approves a reduction of up to 30% of the teaching quota for those who fill a

leading position within the university or are in charge of guidance and control issues within

the pertaining ministry;

o) approves of supporting teaching and research activities in other higher education

or research institutions by staff holding positions within the university;

p) approves the granting of the sabbatical year, according to the law;

q) establishes the study parties and their size, in compliance with quality standards,

according to the law;

r) determines disciplinary sanctions applicable by law;

s) approves the analysis committees appointed by the Rector in order to investigate

the disciplinary violations committed by members of the academic community;

t) delegates to the Board the power to determine the execution times of legal

vacations for each teacher according to the law;

u) may decide upon the recognition of the credits for education and vocational

training obtained in post-secondary education, as units of transferable study for the B.A.

degree according to the law;

v) determines the salaries of teachers and research staff according to the law.

w) approves the establishment of institutes, experimental stations, centers and

research and development laboratories;

x) upholds the principle of transparency and uploads the decisions made during the

meetings of the University Senate on the university website.

Art. 16. The Specialized Committees operational by means of CMU Senate are:

a) The Education Committee;

b) The Academic Ethics Board;

c) The Committee for Evaluation And Quality Assurance;

d) The Committee for Social Issues and Students.

Art. 17. The operational status of the University Senate between sessions is provided by the

Standing Bureau of the Senate. The Standing Bureau of the Senate shall consist of: President,

Vice President, an appointed member of the student community and a representative of one

of the specialized committees, being a teacher, in order to comply with proportionality.

Art. 18. (1) CMU Administrative Board provides management of the university and enforces

the strategic decisions of the university senate.

(2) CMU Board consists of a rector, vice-rectors, deans, the managing director and

student representative.

(3) the UMC Board is headed by the Rector.

(4) The Board shall:

a) implement academic autonomy and ensures conditions for the exercise of

academic freedom;

b) proposes to the Academic Senate strategies and policies on areas of interest for

the university;

c) proposes to the Academic Senate the establishment, organization, division, merger

and dissolution of their teaching and research structures;

d) conceives and submits to the Senate the regulations and methodological

guidelines regarding:

1) the admission, organization, unfolding and completion of graduate and post-

graduate programs;

2) conferring titles and occupying teaching and research positions;

3) confer membership of the academic community;

4) fees to be charged and exemption or reduction of payment thereof;

5) recognition and equivalence of academic studies domestically or abroad;

6) the periodic evaluation of the results and performance indicators of teaching and

research in the university;

7) the quantification in conventional hours of the various activities under the

teaching quota in accordance with the law;

8) the organization and functioning of academic structures;

9) other aspects of professional and scientific activity;

e) considers and submits proposals to the Senate for new study programs and makes

proposals to the Senate for the termination of those study programs that are no longer within

the framework of the university or that are academically and financially inefficient;

f) proposes to the Senate the establishment of companies, foundations or

associations, and providing, by contract, the right to use the asset management and property;

g) proposes to the Senate, up to the month June of each year, the structure of the

academic year, the regulation on professional student activity and the timetable for

educational activities specific to the academic study semesters;

h) considers and submits for approval to the Academic Senate the curriculum of the

academic study programs;

i) analyzes and annually submits to the senate the undergraduate study programs

offered by CMU and the double majors offers;

j) reviews annually and submits for approval to the University Senate the curricula

promoted in approved areas or provisionally approved for MD studies;

k) in special cases, upon the proposal of the Ph.D. coordinator and within the limits

of available funds, proposes to the Senate for approval, an extension of 1-2 years of the

doctoral study program;

l) proposes to the Senate the study units and their size in compliance with quality

standards;

m) considers and submits for approval to the Senate the employment list for teaching

and research positions and the number of posts for research and auxiliary staff;

n) approves the proposals of organizing contests for teaching and research positions;

o) submits for approval to the university senate approaches that may be effective in

national and international cooperative activities;

p) proposes to the Senate the approval of teaching and research activities in other

higher education or research institutions by staff holding permanent positions with the

university;

q) submits proposals to the Senate to grant the sabbatical year;

r) determines periods of time for legal vacations for each teacher according to the

law;

s) prepares and submits to the university senate the sanctioning methodology for

poor professional performances of the teaching staff;

t) endorses the proposals made by the Rector regarding the repeated complete

medical examination of employees;

u) sets in operational terms the institutional budget and approves the annual balance

and the budget execution;

v) determines the number of vice-deans for each faculty based on the number of

departments and the size of its academic community;

w) develops the university code of student rights and obligations, in compliance with

the Code of Student Rights and Obligations;

x) organizes the contest for filling the position of managing director;

y) proposes for approval to the Senate the structure and composition of the

Academic Ethics Board;

z) proposes to the Senate the raising, by regulation, of the minimum weekly teaching

quota in compliance with quality assurance standards;

aa) proposes to the Senate the recognition of credits for education and vocational

training obtained in post-secondary education, as units of transferable study for the B.A.

level;

bb) at the end of each year, approves the Rector’s report on the amount of overhead

costs for research grants and how the money was directed;

cc) organizes the contest for the position of managing director;

dd) approves the requests for unpaid leaves of tenure teaching staff who on their own

initiative wish to specialize or to participate in scientific research in the country or abroad.

(5) the Board meetings are chaired by the Rector as President of the Board.

(6) The Board of Directors may make decisions in the presence of at least two thirds

of its members.

(7) The Board of Directors shall meet at least once a month or whenever necessary,

upon request of the Rector or 1/3 of its members.

(8) The Board of Directors may attend meetings without voting rights, as guests of

the Rector.

Art. 19. (1) The Faculty Council is the decision-making, deliberative body of the faculty.

(2) The Faculty Council is composed of 75% of the representatives of tenure

teachers and 25% student representatives.

(3) teacher representatives are elected by universal, direct and secret ballot of all

tenure staff of the faculty. Teaching and research staff representatives can be members of the

faculty as long as they hold the status of permanent emplyoee of the faculty.

(4) student representatives are elected by universal, direct and secret vote of all

students enrolled in study programs of the faculty. Student representatives can be members of

the faculty council as long as they preserve the status held at the time of their election.

Art. 20. The Faculty Council shall:

a) develop and adopt policies, strategies in areas of interest for the faculty;

b) approve, upon the dean’s proposal, the structure, organization and functioning of

the faculty;

c) approve the study programs managed by the faculty;

d) approve proposals for new study programs and makes proposals to the Board for

the termination of those study programs that are no longer within the university framework

or that are academically and financially inefficient;

e) review annually and submits for approval to the Board the promoted curricula in

the accredited areas or provisionally approved for master’s degree;

f) consider and submit to the Board the curriculum of the study programs;

g) control the activity of the dean, vice-dean and heads of departments and approve

the annual general status of faculty, quality assurance and academic ethics for the faculty and

university departments;

h) propose to the administrative board the establishment, organization, division,

merger or dissolution of departments;

i) validate the results of the elections made in the university departments;

j) approve the possibility that the students complete two years of study in a single

year, according to the law;

k) approve the employment lists for the teaching and research staff of the university

departments and submits them to the Administrative Board;

l) decide upon the proposal of the head of department, increasing the teaching quota

for the teaching staff who do not perform scientific research or their equivalent and, in

exceptional cases, reducing the minimum educational standard and supplementing it with

scientific research, under the provisions of the law;

m) approve the proposals of the departments to set up contests for filling teaching

and research positions;

n) approve the hiring of specialists with recognized scientific value in the field,

inventions, innovations, awards, scientific publications in the country or abroad, as professors

or invited associate professors;

o) approve the examination boards of appeals, in support of graduation exams and

dissertations;

p) endorse at least two candidates for the selection contest for the position of dean of

the faculty, according to the law;

q) establish disciplinary sanctions provided in Art. 312 para. (2) lit. a) and b) of Law

no. 1/2011.

Art. 21. (1) The Council for Doctoral Studies is the coordinating body regulating the activity

of CMU doctoral schools and is organized and operated in accordance with the Code of

Doctoral Studies.

(2) The Operation Regulation of the IOSUD consortium is the Regulation on the

organization of doctoral studies at the Polytechnics University of Bucharest, according to the

constitution of CMU Consortium with PUB.

(3) CMU Ph.D. coordinators operate within the Doctoral School of the Faculty of

Mechanical Engineering and Mechatronics.

Art. 22. The Department Council is a deliberative body elected by universal direct and secret

suffrage of the teaching and research staff permanent employees of that department and

assists the head of department in carrying out the management and running this forum.

Art. 23. CMU managing positions are Rector, vice-rectors, president of the Black Sea

University Foundation, managing director, deans, vice-deans and heads of department.

Art. 24. (1) The Rector is the legal representative of CMU in relations with third parties and

achieves executive management of the university.

(2) The Rector is appointed by the university community by universal, direct and secret ballot

of all teaching and research staff, employed with an employment contract for an indefinite

period, the university and student representatives of the University Senate and Faculty

Boards.

Art. 25. (1) The Rector shall:

a) carry out management and operational management of the university;

b) lead CMU board;

c) convene the senate;

d) propose to the university senate the structure and operating rules of CMU;

e) organize by public contest the selection of faculty deans and issue decisions for

their appointment;

f) organize educational competitions;

g) propose to university senate the annual draft budget and the budget

implementation report;

h) be responsible for the proper management of assets and proper financial

management of CMU;

i) allocate university resources, priority given to most performant departments and

structures;

j) propose to the university senate, based on internal evaluation, the reorganization

or abolition of inefficient departments, research centers or institutes, without prejudice to

students;

k) sign the official papers, documents, financial and accounting documents,

diplomas signed and issued by CMU;

l) issue decisions about student registration system;

m) issue decisions on hiring, modification, enforcement, and termination of

employment of CMU employees;

n) cancel, upon approval of the university senate, certificates or diplomas when it

turns out that they have been obtained by fraudulent means or by violating the University

Code of Ethics and Deontology;

o) approve auxiliary staff and non-teaching duties set out in the job-description;

p) pursue the vacancy competitions, in compliance with quality standards of

academic ethics and law;

q) approve the structure and composition of the academic ethics and deontology

proposed by the Board and approved by the senate;

r) propose to the Administrative Board the repetition of the full medical examination

by employees in cases of psycho-behavioral professional unsuitability;

s) be responsible for the application of the internal Regulation code of ethics and

academic ethics and for the other CMU internal regulations;

t) chair the competition commission for appointment of the Managing Director and

appoint him on the job, according to the law;

u) present, to the university senate, the report on the mission and strategic objectives;

v) perform other duties stipulated by the senate, under the management contract and

applicable law.

(2) By dint of accountability, the Rector shall:

a) present to the university senate in the month of March of each year, the report on

the university status;

b) make public his decisions and those of the Board;

c) make public the affidavit, the annual supply of university education in accordance

with the law.

(3) The Rector may be dismissed by the university senate when noticing at least one

of the following deviations thereof:

a) failure to meet the management performance indicators assumed by contract and

does not meet other obligations specified in the management contract signed with the senate;

b) violation of academic ethics laws and regulations;

c) prejudice the interests of CMU;

d) is in one of the situations of incompatibility provided by law for the position of

rector;

(4) The Rector may be revoked by the pertaining minister under the law, after

consultation with the academic senate.

Art. 26. (1) The Vice-rector is a member of CMU university community, appointed by the

president in consultation with the academic senate and exercise the powers and duties

established by the rector after the expressed written consent for the executive support of

his/her management plan.

(2) The number of CMU vice-rectors is three;

Art. 27. The Vice-Rector for International Relations and institutional development

(1) Managerial Duties

a) represents the university in relations with partners outside the university;

b) applies the Rector’s decisions;

c) applies the decisions of the Senate and applies the national laws within the

university;

d) promotes the image of the institution, developing partnerships with other

institutions and business entities nationally and internationally;

e) the development and modernization of equipment and work environment for all

community members;

f) management of university property;

g) coordination of international relations of the university;

h) coordination of external mobility of teachers and students;

i) international coordination of the university;

j) development programs / projects in partnership with socio-economic environment,

including the EU funded projects;

k) development of human resources for education and research;

l) coordinating competitions for promotion of teachers;

m) coordinating current management of the financial resources of the University;

n) coordinate the management of capital investment;

o) coordination of hiring non-teaching staff;

p) coordination of procurement;

q) coordination of economic contracts with third parties;

r) institutional coordination and approval of contracts;

s) coordinating data management and institutional financial indicators;

t) economic and financial advising for institutional reports;

u) development of IT system for financial and economic activity;

v) economic and financial performance management;

x) implementation of the internal control system;

y) coordinating the organization and functioning of the hostels, canteens and other

student services;

z) coordinate the system of private study scholarships;

w) coordinating the organizations and student associations;

(2) Responsibilities for the teaching activity

a) coordinating the organization of the university entrance examination;

b) coordination of individual performance evaluation of teachers, auxiliary staff and

non-teaching personnel of the faculty;

c) coordinating the transmission of data on the numbers of students enrolled in

university programs within the university, regularly reported to the ministry;

d) coordinating the organization of the graduation exam, the diploma exam, the

dissertation;

e) coordinating the transfer of students from one specialization to another, from one

school to another within the university and from / to the faculties of other universities in

accordance with the law;

f) submitting to the Administrative Board the proposal on the number of sets of

teaching groups and subgroups according to the law;

g) coordination of the activity committee on the recognition or equivalence of

studies and setting the alternate exams, in accordance with the Regulation on Students'

Professional Activity under the European Credit Transfer System (ECTS);

h) coordination of quality assurance in university education processes;

i) coordinate the educational process and the work of the Faculty Council on matters

arising from a hand-on control or from analyses conducted in the departments and

departments;

j) coordination of contests for teaching positions based on strategy development and

financial possibilities of the faculty, following department-level analyses, in compliance with

the Regulation on job assignation for the teaching staff;

k) securing employment for tenure consultant university professors and assistant

professors who have met the legal limit for retirement;

l) coordinating the drafting of emplyment lists for departments;

m) approving requests for departure abroad for the teaching, research, teaching and

non-teaching auxiliary staff of the university;

(3) Responsibilities of scientific activity

a) coordination of quantifying the annual results of scientific research;

b) coordination of activities that aim at increasing the effectiveness of quality

management teaching, research and administrative activity

c) coordination of promotion activity of national, European, etc.. research -

development - innovation, cooperative teaching programs, etc. and monitoring these projects;

d) the management of membership activities and international bodies and

organizations.

Art. 28. The Vice-Rector for Education:

(1) Managerial Duties

a) represents the university in dealing with external partners of university and pre-

university education;

b) applies the Rector’s decisions;

c) applies the Decisions of the Senate and the national legislation applicable to the

university;

d) coordinates the orientation-monitoring study programs, curricula and syllabi for

undergraduate programs full-term attendance and low-term attendance, master programs,

lifelong vocational education graduate programs;

e) operational planning and coordination of the educational process;

f) organizes and develops education policies on educational materials and technical

support;

g) coordinates professional student competitions;

h) manages student work and social issues;

i) coordinates the professional guidance and information for students;

j) coordinates cultural, and artistic activities and sports;

k) organize the preparation of employment lists for teaching and research staff and

monitors their performance;

l) coordinates the promotion, development and evaluation of teaching and research

and administrative staff and monitors their performance;

m) coordinates the activity of doctoral studies, admissions, exams, completion of

studies;

n) coordinates the development of IT and communication infrastructure and tracks

its performance;

o) coordinates the cooperation with university graduates;

p) approves the participation of community members in various committees

(baccalaureate, expertise, etc.).

q) coordinates all activities related to promoting the image of Constanta Maritime

University to attract candidates for admission yearly and provides all the necessary conditions

to lawfully conduct these contests;

r) organizes tutoring in mathematics of candidates for the entrance exam;

s) develops relations of cooperation and collaboration with socio-economic

environment for professional orientation of students and university graduates with a view to

the labor market insertion;

2) Responsibilites on education

a) coordinates the organization of the university entrance exam;

b) is responsible for compliance with Regulation on students' professional activity

under the European Credit Transfer System (ECTS);

c) organizes individual performance evaluation of teachers, teachers' assistants and

non-teaching staff of the university;

d) is responsible for the facts and accuracy of data on the numbers of students

enrolled in university programs within the university, regularly reported to the ministry;

e) coordinates the organization of the graduation exam, diploma exam, dissertation;

f) approves, or endorses the transfer of students from one specialization to another,

from one school to another within the university and from / to the faculties of other

universities in accordance with the law;

g) certifies by signature the curricula and the employment lists approved by the

Faculty Council;

h) requires the Senate to grant approval for committees for the graduation exam

proposed by the Faculty Council;

i) coordinates the activity of the committees for recognition or equivalence of studies

and sets alternate exams, in compliance with the Regulation for students' professional activity

under the European Credit Transfer System (ECTS);

j) coordinates quality assurance in university education processes;

k) follows the requirements related to student assessment system;

l) monitors the process of education and proposes for analysis to the Faculty Council

problems arising from the hand-on control or department level analyses;

m) forwards for approval to the Faculty Council the competitions for assignation of

teaching positions based on the strategy development and financial possibilities of the faculty

as shown by department level analyses, in compliance with the Regulation on job assignment

for teaching staff and after the approval of the Administrative Board;

n) monitors and responds to the requirements relating to competitions for teaching

positions;

o) forwards for approval to the Faculty Council the proposals made by departments

for consultants and academics and securing as tenures the assisstant professors and

professors who have met the legal limit for retirement;

p) coordinates the preparation of Self-Reports for study programs;

q) coordinates the preparation / adaptation of curricula and posting on the university

website;

r) coordinates the preparation of the employment lists of the departments;

s) coordinates the organization of exams and exam-planning for each teacher;

t) coordinates the establishment and planning of exams for students in case of

transfer, repetition, and so on;

u) proposes to the Faculty Council the list of teachers - year and group coordinators;

v) coordinates the preparation of the university timetable;

w) proposes to the Faculty Council the list of students receiving scholarships or

other forms of support;

x) periodically reviews the professional results obtained by students and informs the

Senate about these results;

y) coordinates the productive practical training / technology for students;

z) organizes and is responsible for the cooperation with economic operators on

practical training and the year and degree student projects;

aa) coordinates and checks how Student Scholarships Regulation applies;

bb) coordinates and is responsible for annual reports of the university (research,

quality etc.).

cc) organizes the participation in activities that promote the university image and

recruitment of candidates (open days, advertising visits to high schools, billboards advertising

the opening of the academic year, the Student Guide, the University Guide, the faculty

leaflets, posters etc.).

Art. 29. The Vice-Rector for research activity and scientific innovation

(1) Managerial Duties

a) represents the university in relations with partners outside the university;

b) applies the Rector’s decisions;

c) applies the Decisions of the Senate and the national legislation applicable to the

university;

d) promptly notifies the Department research staff on all information sent by the

Senate, information on research projects, grants, various programs and so on;

e) coordinates the research and innovation partnership with universities abroad and

in the country;

f) transmits to the departments and university research centers the Senate decisions

on the organization of conferences, scientific symposia, scientific sessions, and so on;

g) organizes annual scientific session for university students;

h) organizes for university students travels to conferences and scientific sessions

organized by other universities;

(2) Responsibilites for education

a) is responsible for compliance with the Regulation on CMU Department for

Scientific Research Activity;

b) organizes the evaluation of individual performance for teachers, auxiliary staff

and non-teaching staff of the faculty in terms of scientific work carried out;

c) organizes an annual compilation of the results of scientific research for teachers;

d) organizes and is responsible for solving rhe cases of financial support for teachers

in order to participate in international conferences and publish articles in international

journals provided teacher participation was conditioned by the payment of money;

s) is responsible for the facts and accuracy on prioritizing and ranking of

universities, transmitted via electronic platforms during the specific periodsof time;

f) coordinates the quality assurance scientific research on faculties and departments;

g) monitors the meeting of intended requirements on teacher evaluation system

based on scientific research;

h) coordinates the preparation of self-reports for study programs of scientific

research in the university;

i) coordinates the uploading and posting on the university website of the results of

scientific research and organization of scientific meetings for teachers and students;

j) organizes university annual reports on scientific research;

k) coordinates the organization of summer schools of the university;

(3) Responsibilites for scientific activity

a) is responsible for quality management in research;

b) develops research strategy at a university level aimed at its proper

implementation;

c) mobilizes university teachers and researchers to attract funding through grants and

research contract nationally and internationally;

d) approves the quantification of the annual results of scientific research;

e) is responsible for strengthening the scientific research activities;

f) aims at increasing the effectiveness of quality management in teaching, research

and administrative activities

g) coordinate university research centers;

h) organizes conferences / scientific sessions for teachers and students;

i) coordinates the preparation of the Annual Report on scientific research (relative to

quality indicators) with a view to conveying its annual reports;

j) coordinates the publishing and promotion of university journals;

k) promotes national, European, etc.. research, development and innovation,

collaborative teaching, etc. and monitoring;

l) maintains affiliations with national and international bodies and organizations;

Art. 30. The Dean represents the faculty in university bodies and has the following general

responsibilities:

(1) Managerial Duties

a) represents the faculty in relationships with external partners;

b) applies the Rector’s decisions;

c) applies the Decisions of the Senate and the national legislation at a faculty level;

d) applies the decisions of the University Senate, the Administrative Board, of the

Rector, of the Faculty Council;

e) presides the meetings of the Faculty Council;

f) appoints and determines the duties of the Dean;

g) is responsible for selecting, hiring, periodic evaluation, training, motivation and

termination of contractual relations of faculty staff according to the law;

h) is responsible for the a proper competition of vacancies, in compliance with

quality standards of academic ethics and law;

i) approves the job-description for the auxiliary staff and non-teaching personnel,

according to the law;

j) signs documents, diplomas and certificates issued by the faculty, under the law,

being accountable for them;

k) proposes and implements disciplinary sanctions established by the faculty council

or board of ethics and academic ethics by law;

l) decides on the cancellation of the results of an examination or other type of

evaluation if they were obtained by fraud or violation of the code of ethics and academic

ethics;

m) presents to the Faculty Council, in February of each year, an annual report on the

university status;

n) submits annually and whenever necessary reports to the Administrative Board;

o) requires from the heads of departments a presentation to the faculty council of the

annual reports prior to them having been discussed by the members of the department;

p) makes public his/her decisions and the decisions of the Faculty Council;

q) is responsible for the accuracy and legality of the data included in the school

documents, study documents, the documents underlying the calculation and the granting of

personnel emoluments (payrolls, hourly statements, the attendace of teachers and employees

of the faculty);

r) coordinates and pursues the implementation of study programs of the certain

Faculty;

s) transmits to NAUTICA Publishing House, at the beginning of each year, the

faculty editorial plan (draws up annually a list of existing or required educational materials

and curricula);

t) coordinates the development of the Strategy and Operational Plan;

u) organizes the faculty presentation site supervising the ongoing updating thereof;

v) in case of reasoned absence from college delegates its powers to the deputy dean;

x) monitors the performance of duties of the faculty secretariat;

y) establishes by written decision the job description with the duties impliedand the

level of competence for the Vice Dean;

z) holds general and partial elections in the faculty;

w) organizes the participation in activities that promote the image of the faculty and

recruits candidates (open days, advertising visits in high schools, billboards, advertising the

opening of the academic year, the Student Guide, the University Guide, the faculty leaflets,

posters etc.). ;

aa) promptly notifies all faculty personnel on the information sent from the rectory,

information on research projects, grants, etc. various programs.

bb) coordinates partnerships with universities abroad and in the country;

cc) sends the Faculty Council decisions to departments and research centers;

dd) ensures the proper functioning of the committees of the Faculty Council;

ee) ensures the proper functioning of the Faculty Council;

ff) at the beginning and end of the mandate receives and delivers to the Dean by

protocol the dean’s office documents.

(2) Responsibilities for education

a) is responsible for compliance with the Regulation on students' professional

activity under the European Credit Transfer System (ECTS);

b) organizes the evaluation of individual performance for teachers, auxiliary staff

and non-teaching personnel of the faculty;

c) is responsible for the facts and accuracy of data on the numbers of students

enrolled in university programs of the faculty regularly reported to the ministry;

d) coordinates the organization of the entrance examination;

e) coordinates the organization of the graduation exam;

f) approves, or endorses the transfer of students from one specialization to another,

from one school to another within the university and from / to the faculties of other

universities in accordance with the law;

g) certifies by signature the and the employment lists approved by the Faculty

Council;

h) refers to the Senate for approval a proposal of the Faculty Council on the number

of series of lectures, groups and subgroups according to the law;

i) requires the Senate’s approval of the committee for the graduation exam proposed

by the Faculty Council;

j) coordinates the activity of the recognition or equivalence studies and sets the

exams, in compliance with the Regulation on students' professional activity under the

European Credit Transfer System (ECTS);

k) coordinates the process of quality assurance in university education;

l) aims to fulfill the requirements of the student assessment system;

m) monitors the process of education and proposes the Faculty Council to analyze

problems arising from the hand-on or department level analyses;

n) forwards for approval to the Faculty Council the contest for teaching positions

based on the development strategy and the financial possibilities of the faculty as shown by

the department level analyses, in accordance with the Regulation for occupying teaching

positions;

o) organizes the contests for teaching positions;

p) provides for the legal contests for teaching and non-teaching positions;

q) forwards for approval to the Faculty Council the proposals from departments for

consultants and academics to be maintained as tenure lecturers or professors irrespective of

their having met the legal limit for retirement;

r) coordinates the preparation of self-reports for study programs;

s) coordinates the preparation / adaptation of curricula and the posting on the faculty

website;

t) coordinates the preparation of the employment lists of the departments;

u) coordinates the organization of exams and exams for teachers planning faculty;

v) coordinates the establishment and planning exams, the equivalence records for

students who are in the procedure of transfer, repetition, and so on;

w) proposes to the Faculty Council the list of teachers - year and group coordinators

and monitors their activity collaborating with them;

x) coordinates the preparation of the faculty timetable;

y) proposes to the Faculty Council the list of students being granted scholarships or

other forms of financial support;

z) periodically reviews the professional results obtained by students and informs the

Council on the results;

aa) organizes the productive practice / technology specialist students;

bb) organizes and is responsible for its cooperation with operators on practice and

projects of the year and degree students;

cc) monitors and verifies the implementation of student scholarships regulation;

dd) organizes the annual reports of faculty (research, quality etc.).

ee) forwards for approval to the Faculty Council the members of the admissions

committee for the graduation exam and the Board committees;

3) Responsibilites for scientific activity

a) approves annually the quantifying results of scientific research;

b) provides the connection between faculty and libraries to achieve book deposits

and subscriptions to professional publications;

c) organizes conferences / scientific sessions of teachers and students;

d) coordinates the preparation of the Annual Report on scientific research per faculty

(relative to quality indicators) with a view to conveying its annual reports;

e) develops the research strategy aimed at faculty and its implementation;

f) mobilizes teachers and faculty researchers to attract funding through grants and

contract research nationally and internationally;

g) The dean may delegate some tasks, by decision, to the Vice Dean.

Art. 31. Article 31. (1) The Managing Director shall conduct the administrative structure and

is administratively responsible for a sound economic and financial management of CMU.

(2) The post of Managing Director is filled by competition organized by the

University Board. The chairman of the competition committee is the Rector. The validation

contest is performed by the University Senate and the appointment is done by the Rector.

(3) The securing of the administrative office by the Managing Director is based on

written agreement in support of the executive management plan proposed by the new rector.

(4) Duties and responsibilities of Managing Director

a) leads the administrative structure and is held accountant for the economic-

financial management of CMU;

b) under the control of the vice-rector for International Relations and institutional

development, coordinates the administrative acitivity and is involved in the financial accounts

of all structural units of the University;

c) coordinates logistics training for paperwork that will be submitted for approval to

the Senate continuously ensuring the legality and effectiveness thereof;

d) under the control of the vice -rector for International Relations and Institutional

Development, coordinates the activities of real estate management and material and technical

supplies of the University;

e) prepares the administrative decisions made by the Rector in accordance with the

legal regulations;

f) is responsible for the quality and clarity of the MedCTS statistical reports and of

nother bodies, in compliance with the law;

g) coordinates the accounting service in the fields of patrimony, payroll, equipment,

investments, RC, RK, consolidations, and so on;

h) is responsible for public procurement, investment, real estate property

management and maintenance;

i) is responsible for setting up and proper usage of the university patrimony and its

proper annual inventory;

j) participates in the development and implementation of the budget with the

accounting officer;

k) carries out the decisions of competence, controls the execution of these decisions,

evaluates their performance and reports to the Rector and vice-rector on international

relations and institutional development;

l) is responsible for the administrative management of the university, monitors and

coordinates the heads of the administrative departments;

m) participates in the strategic management of the university, attends Board

meetings;

n) prepares the budget, assisting the vice-rector with international relations and

institutional development in budget analyses, executions, reports and budget forecasts;

o) ensures rational use and complete security of all locations thereof;

p) manages student issues in their administrative matters;

q) manages hostels and canteens to provide quality services to students;

r) plans and implements evaluation systems and control of administrative work;

s) coordinates the organization services, payrolls, strategy and development,

statistics and forecasts;

t) ensures and monitors the implementation of the administrative policies of the

University in areas such as finance, budget, personnel management, property management

and administrative management of continuing education, international relations and research;

u) maintains a balanced attitude, respecting the professional competence of the

subordinate service chiefs, always taking into account their ideas and opinions;

v) is subordinate and accountable to the Rector and the Senate for its activity;

w) may receive other tasks that I delegate rector;

x) implements the decisions taken by the academic authorities of the University on

its fields of competence;

y) controls the execution of all administrative decisions below him;

(5) The Managing Director reports to the Rector and the Senate of CMU and

collaborates with the Vice-rector for international relations and institutional development, the

other vice-rectors, deans, heads of departments, all academic and administrative structures of

the University.

Art. 32. (1) The Black Sea University Foundation Chairman leads the Board of Directors of

the Foundation and is a teacher of CMU. The chairman was a member of the CMU Senate at

the time the Foundation was established

(2) Black Sea University Foundation is a non-profit NGO, a Romanian legal person,

private, apolitical and independent, established by Government Ordinance no. 26/2000 on

associations and foundations, approved by Law 246/2005, republished, subsequently

amended and supplemented.

(3) The purpose of the Black Sea Foundation is to contribute to the preparation,

training, schooling, training and specialization of Romanian seaging personnel, by organizing

study programs, courses and trainings, scientific and technical expertise, including the

granting of scholarships in Romania and abroad in areas promoted by the Foundation.

(4) The responsibilities of the Foundation chairman are those inscribed in the of the

Charter of the Black Sea Foundation.

Art. 33. (1) The head of department provides operational management of the department.

(2) The head of department shall be elected by universal, direct and secret vote by all

teaching and research staff holding a permanent position in the department.

(3) The head of department is validated by the faculty council by a simple majority.

(4) The head of department shall:

a) provide cover positions on the department employment list according to the

department functions and is held responsible for their carrying out corresponding tasks;

b) contribute to the development and implementation of curricula;

c) coordinate the research department;

d) be responsible for quality management and financial management of the funds

raised for the department;

e) is responsible for selecting, hiring, periodic evaluation, training, motivation and

termination of contractual relations of the staff employed by the department, according to the

law;

f) ensure a periodic self assessment of the department in order to classify the latter

according to the law;

g) be responsible for the proper competition for vacancies, in compliance with

quality standards of academic ethics and law;

h) propose to the faculty council to increase the standard of the teaching staff not

engaged in scientific research or their equivalent and, in exceptional cases, reducing the

standard teaching quota and supplementing it with scientific research, according to the law;

i) participate in establishing general skills, specialized and related cross curricula in

subjects coordinated by the department.

THE ADMINISTRATIVE ORGANIZATION OF CMU

Art. 34. (1) For the education and research activity, CMU comprises the faculties,

departments, research centers that facilitate the creation and transfer of knowledge.

(2) To provide support services to meet the objectives of the strategic plans and

operational programs CMU comprises the central office, library, publishing, printing, local

office-Lake Siutghiol CMU, University Sports Complex and technical-administrative

services .

(3) The establishment, operation, dismantling and tasks of the structures listed in

paragraph. 2 are governed by the Regulation on Organization and Operation proposed by

the Management Board and approved by the Senate of CMU.

Art. 35. (1) The Faculty is the functional unit that develops and manages research programs in

one or more areas of study, develops employment lists, according to the law and draws up

order forms to the departments to fully cover all of them;

(2) The Faculty is set up, organized and dissolved in accordance with the law;

(3) the Faculty Council is the deliberative, decision-making body;

(4) The Faculty is represented by the Dean of Faculty who is responsible for its

management;

(5) Evidence of students and their professional situation lies with the secretariats

operating within each faculty.

Art. 36. (1) CMU is made up of two faculties: the Faculty of Navigation and Naval Transport

and the Faculty of Naval Electromechanics;

(2) the Faculty of Navigation and Naval Transport is made up of 3 teaching

departments: the Department of Shipping, the Department of Transport Management and the

Department of Fundamental Sciences and Humanities.

(3) the Faculty of Naval Electromechanics is made up of four teaching Departments:

the Department of General Sciences Engineering, the Department of Electronics and

Telecommunications, the Department of Engineering Sciences in electrical, the Department

of Engineering in Mechanics and Environment.

Art. 37. (1) The Education Department is a functional unit involved in the production,

transmission and use of knowledge in one or more specialty areas.

(2) In terms of administration, the department is subordinate to a single faculty, but

it serves teaching purposes for subjects needed for all bachelor and master programs in which

these subjects are studied, regardless of the attendance form as well as for other state higher

education institutions, upon request.

(3) The department is set up, organized, gets divided, merges or is disbanded by

decision of the University Senate, upon proposal of the pertaining faculty council.

(4) The department may include doctoral schools, research centers, graduate schools,

laboratories, counseling centers and other components that facilitate the creation and transfer

of knowledge.

(5) The department is headed by a Director assisted by a council.

(6) the organisation and operation of the department are established by regulations

approved by the University Senate.

(7) As the University develops, new structures for education and research can be

created, such as: colleges, majors, departments, human resources lifelong training centers,

unincorporated research and development units and other entities for educational and

research activities.

(8) The responsibilites of the departments are:

a) to develop curricula and research plans;

b) to prepare the department payroll;

c) to organize scientific seesions;

d) to evaluate the scientific work of teachers in the department;

e) to suggest organizing competitions for vacant teaching positions and propose teh

members of the contest boards under the Rules for occupying teaching positions;

f) to propose the extension of the teaching activity for people of retirement age;

g) to propose competitions for vacant teaching positions;

h) to submit specializations for bachelor, master and doctoral studies

i) to organize accreditation of bachelor, master and doctoral studies

j) to submit the cessation of the activity of teaching and research staff;

k)to submit the annual publishing plan for courses and other teaching materials;

l) is responsible for quality learning process in the subjects belonging to the

department.

Art. 38. (1) CMU scientific research centers are:

a) the Research Center for Naval Mechanical Engineering;

b) the Research Center for Naval Electrical Engineering;

c) the Training and Research Center "Hydro-meteorological Hazards."

(2) the research centers and laboratories consist of collective teams that are brought

up upon proposal from the departments, the Faculty Council and the University Senate. They

bring together teachers, researchers and students and perform mainly scientific activities;

(3) CMU scientific research centers are institutionally accredited by the University

Senate and nationally by CNCSIS. They may apply for international recognition.

Art. 39. 1) Administrative management consists of the following units: departments, units,

services and offices.

(2) They are subordinated to the Rector, the Managing Director, or the vice-rectors

according to the Organizational Chart of CMU.

Art. 40. (1) The International Relations Office is a division of CMU designed to perform the

internationalization policy of the University and to promote the image of CMU as an

education, science institution in Romania and abroad.

(2) The main activities of the International Relations Office are:

a) preparation of official correspondence related to the initial establishment of

contacts with foreign universities;

b) developing information materials / advertising Romanian and foreign languages to

promote the image of the University;

c) solving traveling abroad formalities of teaching or administrative staff (including

information on visas);

d) providing presentation materials of the university, when traveling for business of

teaching staff and students at a foreign university abroad;

e) search for partners for various international programs;

f) organization of seminars and conferences. the specificity of this office, but also

helping to organize any scientific events, visits, delegations to the University;

g) organizing the program for foreign guests (accommodation, meals, visits);

h) the publication in the media of the activities held in the University;

i) disseminating information on the timing of actions, calls for proposals at national

and European level;

(3) the International Relations Office reports directly to the Vice-Rector for

International Relations and Institutional Development.

Art. 41. (1) the Bureau for Community Programs is a division of CMU for the

implementation and coordination of programs funded by the European Commission in the

field of education and training in the "Lifelong Learning Programme 2007 - 2013 (LLP)"

("Lifelong Learning Programme).

(2) implementation in CMUof Erasmus sectoral program aims to achieve

international cooperation strategies in the faculty, by student exchanges organized in practical

training and study mobilities. These activities allow students to conduct practice for at least 3

months on board vessels from another country participating in the Erasmus program, or for an

integrated study period of 3 to 12 months in another university, a participating partner in the

LLP- ERASMUS programme.

(3) the Bureau for Community Programs is responsible for the academic,

administrative and coordinating mobility of students and teachers 'outgoing' and 'incoming' the

LLP-ERASMUS Programme:

a) management of agreements with higher education institutions in the EU, in the

framework of European cooperation;

b) acquisition, consultation and prompt dissemination of information on these

programs to the deans’s offices, departments and the interested public;

c) gathering and processing info from the faculties or from own archive and regularly

reporting to the National Agency for Community Programmes in the Field of Education and

Vocational Training (ANPCDEFP) and other national and European authorities;

d) editing material for image promotion of the Bureau, the Department and the

University;

e) administrative formalities for travel within the European Union, the European

cooperation projects and programs, students and teaching and non-teaching staff of the

University;

f) providing detailed, customized information to mobility beneficiaries;

(4) The activities of the Bureau for Community Programs are:

a) Mobility of students;

b) Student Placements (internships);

c) Mobility of teaching staff;

d) Training of teachers and non-teaching staff;

e) Multi-annual projects;

(5) the Bureau for Community Programs reports directly to the Vice-Rector for

International Relations and Institutional Development.

(6)) the Bureau for Community Programs is headed by a head of office who shall:

a) inform and advise potential beneficiaries and project promoters on the current

educational community programs and disseminate information on these programs;

b) repare and submit for approval to the academic Senate of the Rules for

organization of selection processes for community programs;

c) organizing selection processes for Socrates and Leonardo da Vinci mobilities

within the institution, activity regulated by the European Union;

d) organizing and monitoring the performance of the mobility for students and

teachers participating in Community programs, the principles of the European Quality Charter

for Mobility and of Constanta Maritime University;

e) management of financial contracts concluded with the National Agency for

Community Programmes in the Field of Education and Vocational Training (ANPCDEFP) to

conduct student and teacher mobility;

f) identification of centralized projects funded by the European Community

programs, compiling a database suitable to be published on its website, regularly updated;

g) advising beneficiaries or potential beneficiaries of mobility grants;

h) reporting the progress of projects funded by EU programs by the Ministry of

Education, Research, Youth and Sports, the National Agency for Community Programmes in

the Field of Education and Vocational Training (ANPCDEFP), the European Commission and

the other institutions;

i) providing technical approval of project proposals involving Constanta Maritime

University;

j) organizing institution database with partners and their details;

k) organizing information events on community programs.

Art. 42. (1) The Research Department is an organizational structure of CMU designed to

fundamental and applied research activity, with results expressed in the publications, articles,

books, handbooks, patents, prototypes;

(2) The Research Department has the following responsibilities:

a) implementation of University strategy on research;

b) financial records of research contracts concluded between CMU and various

ministries and companies;

c) evidence of research units and their research results;

d) records of the results of research;

e) collaboration with major donors;

f) dissemination of calendar and documentation necessary for internal accreditation of

research units in various levels of hierarchy;

g) disseminate all information concerning competitions for projects, grants, contracts

and so on;

h) management of research programs;

i) cooperation between administrative departments of the university, involved in the

projects;

j) monitoring the performance of projects and operational information of university

management on the progress of each project, in cases where management decisions require

university decisions or upon its request;

(3) the Research Department is headed by the Head of Research department and

reports directly to the Vice-Rector for scientific research and innovation;

(4) the Head of Research shall:

a) participate in research and development plans, objectives, actions on scientific

research of the Research Department;

b) submit for approval to the Faculty Council the annual plan for research and

development of the Department;

c) review and approve the carrying out of scientific research and pursue performance

criteria;

d) be responsible for preparing the annual report on scientific research of the

Department of Research;

e) inform the department members on new programs and research directions;

f) announces changes in the legislative or program management procedures,

difficulties in project implementation;

g) propose measures to improve the coverage of professional research level;

h) organize and coordinate the scientific events, publishing educational materials,

scientific journals of the university;

i) approve internal and international cooperative actions with a scientific purpose;

Art. 43. Article 43. (1) The Department for IMO Promotion and Training is a division of

CMU specifically designed to ensure performance of IMO courses for students from all

maritime majors: full-term attendace, short-term attendance, monitoring and guiding students

for practical training on board.

(2) The Department for IMO Promotion and Training has human resources,

performant facilities and logistics, able to support this form of education, in accordance with

quality standards in force.

(3) The curriculum includes training programs whose main components are: a

compact period of training, regular meetings with students for mandatory activities specified

in the curriculum (seminars, workshops, tutorials), organization of exams sessions, the

sessions of arrears, organizing entrance exams.

(4) The Department for IMO Promotion and Training shall:

a) organize the registration / admission of students for each course, checking the

conditions to be met for attendance, and practical applications etc.

b) organize a database for students at all levels of full or short-term education

performing practical training or voyages; based on this state of fact open sessions of exams

are held;

c) develop and implement the quality management program within The Department

for IMO Promotion and Training;

d) ensure continuous training of the professor, tutors and administrative staff involved

in management activities at The Department for IMO Promotion and Training;

e) provide students with adequate material, administrative facilities, educational

facilities, simulators, laboratories, computer network with Internet access, libraries.

(5) The Department for IMO Promotion and Training reports directly to the Vice-

restor for IMO International Relations and Institutional Development.

(6) The Department for IMO Promotion and Training is headed by a Head of

Department who shall:

a) keep track of students work during the IMO course (catalogs, summary, statistical

summaries etc.).

b) develop self-reports of activity undertaken by the Department;

c) establish appropriate member functions of training, to be submitted for approval to

the university Senate;

d) review and approve the conditions of teachers for teaching IMO courses after

proposals forwarded by the teaching departments;

e) verify conditions and approve the files of instructors who teach IMO courses

f) ensures the programmed educational process and support material distribution, if

any;

g) collaborate with other departments in the country or abroad providing IMO courses

for upgrading specific methodologies;

h) organizes programming courses and exams in conducting training sessions for

IMO students.

Art. 44. (1) The Secretariat Department is a division of CMU in accordance with the law,

nr.1/2011 National Education Act, the law on education official documents, the Charter of

CMU, CMU rules and regulations. The Secretariat Department is headed by the Chief

Secretary of the University;

(1.1.) The University Chief Secretary coordinates, directs and controls all activities of

the secretariat of the faculties of the University and has the following functions:

a) coordinates the secretariat activity of the University, faculty and teaching

departments;

b) represents the university in relation to MECTS and other institutions in the

secretarial field;

c) verifies and ensures the compliance with legal provisions in the secretariat activity;

d) provides the Board and the University Senate with documents and data necessary

to make decisions / judgments;

e) coordinates the registration of documents received and sent by the university;

f) coordinates the receipt and distribution of mail;

g) disseminates the agenda and materials to be debated by the Board;

h) prepares and signs the minutes of the Board meetings;

i) disseminates the agenda and materials to be debated by the University Senate and

University Senate Bureau;

j) prepares and signs jointly with the Secretary of the Senate, the minutes of meetings

of the University Senate and the Senate Bureau;

k) draws up in consultation with the Secretary of the Senate the Senate decisions,

rulings and decisions issued by the Rector;

l) records and keeps track of judgments and decisions made by the Senate and the

Rector, following their distribution to the recipients;

m) verifies the preparation of study documents, signs them and submits them for

signature to the Rector, being acountable for the completion and issuing of diplomas;

n) monitors and is held responsible for the way the legal provisions are applicable to

the system of education;

o) is responsible for the regulatory compliance of GD sites in terms of schooling;

p) checking GD sites regarding schooling under the law;

q) gives information to the public, students on the issuing of graduation papers;

r) correlates data on the number of students on specialties and forms of education,

teachers, educational spaces for statistical statements required by the Rector, the Ministry of

Education, Youth and Sports and the National Institute of Statistics, or other non-

governmental bodies;

s) establishes the responsibilities of subordinate employees;

t) centralizes all information received from the faculty secretariats on curricula,

employment lists and structure of the academic year;

u) performs any other duties established by the Rector and the President of the

Senate, as well as those of other regulations of the University.

The Chief Secretary reports to the university Rector.

(1.2) The University Secretariat is in charge of the following structures:

a) the Rector’s Office;

b) Deanships;

c) Secretaries of University faculties;

d) Office for Graduation Documents;

e) Office for Archives;

f) Registry.

(1.3) The Rector's Office has the following main tasks:

a) provides the secretariat for the Rector and vice-rectors;

b) provides the interface between the rector, vice-rectors and other departments

in the University and other universities and institutions;

c) manages correspondence addressed to the institution;

d) records documents received and sent by the institution;

e) planning and organizing of hearings;

f) checks documents for information, to be displayed on bulletin boards or sent

electronically over the Internet.

(1.4) the Rector's office has the rank of Bureau and is led by a Head of the Office in

charge of Cabinet subordinated activities.

(2) The Deanships have as main tasks:

a) to cooperate with services, secretariats and departments of the University to

address various requests from the students / M.D. students or employee of the University;

b) to centralizes all information received from the secretariats faculty on curricula,

employment lists and structure of the academic year for the faculty in question;

c) to prepare the exam schedule of the exam sessions based on information received

from teachers and students head of groups, thus managing areas of university education;

d) to organize and pursue the teaching, examination sessions / seminars and sessions

for graduation papers / dissertations;

e) to prepare and sign together with the deans, the faculty minutes of the Council and

Faculty Council Office meetings;

f) to prepare, in collaboration with the deans of the Faculty Council and Office the

rulings and decisions issued by the Faculty Council Deans;

g) to advise and check all the work of the secretariat of the faculty, in accordance

with the Regulations of the University;

h) to check files of transfer students and those enrolled, coming from other faculties;

i) to verify documents for information, to be displayed on the notice board of the

faculty or sent electronically over the Internet;

j) to timely respond to requests to University Chief Secretary with a view to drawing

up statistical statements on the number of students, teaching staff, etc. required by the Rector

and the Senate President;

k) to verify the files of graduates and prepare the database for the issuing of

diplomas;

l) to cooperate with services, secretariats and departments of the University to

address various requests from the student / M.D.students or other employee of the University;

m) to support the Human Resources department in order to obtain documents for the

teachers working part-time and for an hourly quota;

n) to perform any other duties established by the chief secretary of the University,

the Vice Dean and the Dean of Faculty, the Rector and the President of the Senate, as

provided for by other regulations of the University;

o) the secretariats of faculties / departments prepare tables with the names of

students / graduates / master’s degree students / students to receive papers of graduation,

according to their majors, specializations and forms of education no later than one month

after graduation or after one moth from registration, the tables concerned shall bear the

signature of the Dean of the faculty / the head of department and the secretary thereof. The

tables and files shall be submitted to the Office of graduation documents within one month

after completion of studies concerned.

(3) The faculty secretariates have as main tasks:

a) participation in organizing the entrance exam - bachelor, master, PhD;

b) participation in organizing the graduation exam – B.A. degree, dissertation,

doctoral, postgraduate courses;

c) keep a record of students from years of study assigned by the chief secretary of

the university;

d) management of the application University Management System for creating and

maintaining the structure of academic - schooling structure of the University;

e) ensuring the communication interface with the company The Red Point of Iasi if

special problems or system failure may arise;

f) is directly responsible for the preparation and management of the database

electronically, which contains personal and academic situation of the student / master /

students enrolled during the study years that it manages;

g) to ensure registration of student / master entries in the school register with their

personal data, the subjects of each curriculum, the competitive admission conditions, the

various conditions of registration (transfer, re-registration);

h) receiving and registering applications from students / master students / learners

and forwards them to be solved to the chief secretary of the university and the Faculty Dean;

i) displays on the electronic bulletin board for the school year it manages all

documents necessary to inform students / master students / course students;

j) prepares catalogs of grades, centralized transcripts of grades and grade records;

k) verifies the financial situation of the student / master students / course students

(tuition fee, exam fees, etc.). before the entry exam in collaboration with Accounting;

l) cheking of records for scholarships;

m) performs any other duties established by the chief secretary of the University, the

Dean and the Vice Dean of the Faculty, the Rector and the President of the University, as

provided for by other regulations of the University.

(3.1.) The Faculty Secretariats are subordinate to the chief secretary of the

university.

(4) The Office for Graduation Documents manages official papers, fills in and issues

documents of higher education studies, documentente State officials giving their holders

rights and obligations under the Education Act.

(4.1.) The study documents are of the following types:

a) bachelor's degree, diploma, engineering degree, master's degree, Postgraduate

Diploma, Diploma of post graduate academic studies;

b)-related transcripts of diplomas;

c) transcripts, upon request, for graduates who have stood and promoted the

graduation exam (exam certificate) which were not accompanied by transcripts;

d) transcripts for graduates without examination / graduation;

e) Certificates for university long / short term studies for graduates without the

graduation examination;

f) Diploma Supplement;

g) Translation - documents issued under the letterhead and signed by the Rector

bearing the university seal and certificate of authenticity of the education institution for their

equivalence abroad.

(4.2.) The Office for Graduation Documents is subordinate to the chief secretary of

the university.

(5) The Archive Bureau is a division of CMU in accordance with the law which

shall:

a) set up the University Archives, the inventory for documents, organize archival

storage, and document security;

b) Develop and update the archive schedule;

c) Select and dispose of documents.

(5.1.) The Archive Bureau reports to the Chief Secretary.

(6) The Registry is a division of CMU which shall:

a) record, sort, forward correspondence;

b) perform registration of documents accounts.

The Registry is subordinate to the Chief Secretary.

Art. 45.

(1) Department of STS (Short-term studies) is an organizational structure of CMU

designed for management activities within the programs of short-term learning system.

(2) Department of STS is an institutional department, subordinate to the Rector of

the university.

(3) Department of STS shall:

a) support faculties in organizing and promoting the entrance examination for the

STS form of education through the media and so on;

b) develop and implement the quality management program in STS;

c) ensure continuous training of the professor, tutors and administrative staff

involved in the management of STS activities;

d) develop and provide procedures for initiating, approving, monitoring and

evaluation of programs of study at STA;

e) together with the faculty, shall develop self-reports to obtain accreditation for STS

specializations;

f) The Department shall annually report on the state of STS and STS studies

programs;

g) ensure the electronic platform of virtual education and shall support material

distribution;

h) collaborate with other departments in the country or abroad for an ongoing

upgrade of STS specific methodologies;

i) provide students with adequate material: administrative facilities, educational

facilities, simulators, laboratories, computer network with Internet access, libraries.

(4) The Departamant of STS is headed by a Head of Department appointed by the

president and approved by the University Senate.

(5) The Head of STS Department holds the teaching position of senior lecturer or

professor and shall:

a) initiate, develop and ensure management of programs;

b) ensure access to all students enrolled in a study program as STS to specific

support services: assistance with registration, financial facilities, educational assistance,

delivering educational resources, access to means of communication, appropriate tutorial

support, proper examination, insurance of records on results and professional counseling;

c) provide an adequate operative solution to complaints and requests of students

enrolled in STS;

d) provide adequate and accurate information to students on study programs on offer

and the type of graduation diplomas, registration requirements and services, tuition fees and

additional costs, education and communications technologies used examination procedures;

e) ensure communication infrastructure between students, teachers and tutors, by

various means: mail, phone, fax, e-mail, Internet, videoconferencing, group discussion

facilitated by information technology and so on;

f) coordinate the development of STS technology courses;

g) develop and promote a clear policy on: delivering educational resources and

providing copyright information technologies and access to, use their own digital libraries, in

partnership or rented, distributing educational materials, the tele-courses, production and use

of multimedia materials;

h) ensure the confidentiality of all databases on student activities;

i) provide continuous updating of databases;

j) ensure a quality management program to maintain STS program objectives up to

the requirements of the accreditation criteria of ARACIS;

k) has the responsibility to inform the Senate and its management on any changes

regarding the activity of the Department;

l) centralizes and check curricula, employment lists, on the methodology proposed

for admission in faculties providing STS courses and forwards them for approval to the

university management;

m) organizes the educational program (tutorials, assisted activities, examinations,

evaluations) in each specialization;

n) strict monitoring for compliance with curriculum;

o) ensuring timely provision and distribution to students of study materials and

guidance.

Art. 46. (1) The Human Resources Office is an organizational structure of CMU designed for

the activity of the university staff and represents the University in relation to MECTS, the

National Institute of Statistics and public authorities for human resources issues. Its work

includes aspects of payroll and human resources.

(2) The Human Resources Office reports to the Managing Director and has the

following duties, powers and responsibilities:

a) coordination of employment of teachers in CMU;

b) coordination and evaluation of activities to promote the academic community of

CMU;

c) coordination of entry recordings in the General Register of Employees;

d) coordination of preparation of employment lists for teaching and non-teaching

staff;

e) coordination of preparation and verification of the conditions of employment

candidates to fill teaching and non-teaching positions;

f) coordination of calculating seniority and wage setting frameworks associated with

activity in an hourly regime;

g) establish the link between all departments of CMU regarding regulations related

to wages (deadlines to provide sick leave papers, the collective attendance sheets etc.)

h) drawing payroll sheets based on the collective presence sheets received from

faculties, departments and services;

i) calculating and implementing payment for sickness, pregnancy and confinement;

j) calculation of leave for teachers and TESA staff;

k) filling in the settlement sheets;

l) working with the bank to carry out debit cards for CMU employees, by law and

conveyance of information to the bank on wage prerogatives for salary cards;

m) drawing up, upon request, certificates of income;

n) centralized money transfers for employer and employee;

o) preparing monthly statements to insurance funds, according to their norms, in

electronic and paper form on the dates set by the law.

(3) The Human Resources Office is headed by a Head of Office who shall:

a) conduct examinations for the purpose of selection for different jobs;

b) make rules of procedure and various functional regulations and ensures that each

employee be precisely aware of those documents;

c) draw organizational charts for all the departments of CMU;

d) redoes the Organization chart whenever necessary (if there are jobs not covered in

the present organization chart, etc.).

e) conduct wage policy through enhancement of professional performance criteria;

f) determine individual salaries based on legislation and university management

decisions;

g) calculate the amount of labor;

h) manages data on wages and scales of merit, compensation management, awards

and so on;

i) calculate monthly personal expenses;

j) develop recommendations and check the legality of drawing up employment lists;

k) manage the wages paid to the university staff by card policy and is responsible for

monthly reporting to the bank;

l) determine the salary in accordance with the law and prepare salary payrolls for

referents of doctoral committees;

m) records and personnel management conducted in accordance with applicable laws

and requirements to upgrade the system data through: development and use of appropriate

tools and techniques (individual sheets, base sheets, statistics, job descriptions, etc.).

n) verifies compliance with current legislation, the implemention of decisions in

resource management and remuneration;

o) participate in regular assessment with the university management, deans and

heads of department on the adequacy of existing staff to the needs of teaching, scientific and

university services;

p) establish the responsibilities of subordinate employees;

q) do the planning of Human resources quorum;

r) verify member functions and departments draft model rules for staff hourly holder

of CMU;

s) verify the files of candidates to fill vacancies on the employment lists of the

teaching departments and the teaching proposals for the hourly quota;

t) prepare files for retirement (old-age, early retirement, disability) and submit them

to the pension office for the staff of the university community;

u) prepare identity cards for the staff of the university community and to redeem the

expired ones;

v) regularly discuss with the L.P. and P.S.I. Officer (Health and safety and

emergency situations) to detect and implement awareness of all the risks involved in certain

positions and cooperate in this regard with the psychologist contracted by the university for

testing mandatory psychological safety;

w) correct and interpret the results of psychological tests;

x) advise and guide the academic community in their personal problems;

y) collaborate with management staff for good working results;

z) collaborate with the medical staff (and not only) in the case of accidents and for

occupational health medical examinations required;

aa) make a series of statements and reports required by university management,

regarding the staff structure of various categories of age, gender, socio-professional, staff

turnover, absenteeism, the causes thereof, etc..

Art. 47. (1) The Accounting Office is an organizational structure of CMU that, with a well-

trained staff in economic, administrative and professional field, coordinates all financial and

accounting activities of the University and represent the University in relation to the Ministry

of Education, the National Institute of Statistics and public authorities for financial and

accounting matters. Its work includes aspects of management control and financial-

accounting matters.

(2) The Accounting Office reports to the Rector and has the following duties, powers

and responsibilities:

a) preparation of the planned income and expenditure budget;

b) expenditure register on cost centers;

c) accounting for economic phenomena on funding sources;

d) property inventory and difference setting;

e) financial operations of core funding, complementary research contracts, own

revenues (extra income from fees and other income provided, revenue-financed activities,

sponsorships);

f) ensuring cash receipts and release of funds by the central cashier from all funding

sources based on documents approved by the authorizing officer;

g) daily checking account statements and foreign currency activities for all CMU

activities;

h) checking daily cash report;

i) preparing returns for domestic and foreign travel and bank documents to back

rights of travel;

j) verifying that there is consistency between the necessity papers and the attached

documents;

k) drawing up payment orders to pay debts to the state budget, insurance and health

and social work departments and verifying that these amounts concoct with the payroll

surveys;

l) preparation of payment orders to pay debts to suppliers;

m) drawing up checks for cash withdrawals from treasury (salary, travel advances);

n) chronological and systematic accounting of all accounting documents related to

the inputs and outputs of patrimony management and financing;

o) make timely inventory and accounting for differences resulting from inventory;

p) revealing synthetic and analytical investment objectives by funding sources;

q) highlighting of fixed assets and inventory items for places of use;

r) highlighting debtors, creditors, suppliers on funding sources;

s) the preparation of analytical balances of all financial evidence;

t) record of all CMU own revenue based on legal documents;

u) preparation and checking balances of analytical and synthetic accounts;

v) centralization of synthetic and analytical balances from all regional centers;

w) conducting and supervising expenditures by source of funding, namely on budget

articles and paragraphs;

x) conducting and supervising revenue funding sources and integrating them in

institutional contract monitoring and supplementary income and expenditure budgets;

y) works out cash balances statements and conducts score settlement with the State

Treasury.

(3) The Accounting Office is headed by the Chief Accounting Officer who shall:

a) prepare the income and expenditure of CMU, and then submit it to the Senate

debate for validation;

b) prepare and keep under review the balance sheet;

c) monitor the implementation of the budget;

d) be responsible for financial management (salaries, scholarships, Masters,

research, etc.);

e) manage the budgetary and extra budgetary resources and is directly responsible

for their accuracy;

f) provide financial and accounting of post-operative control;

g) establish the responsibilities of subordinate employees;

h) pursue primary documents necessary for accounting operations in compliance

with the law (bills, notes and receiver input, consumption bills, orders, provisions for

payment by cash, etc.).

i) prepare and check balances of analytical and synthetic accounts;

j) coverage of all monthly financial information in the aggregate balance of CMU;

k) conduct and supervise expenditures by source of funding and enrollment tracking

their institutional contract;

l) organize the cashier ensuring control of cash receipts and payments in line with

regulations issued in this regard;

m) prepare and respond to checking balances of synthetic and analytical accounts;

n) provide cover for preventive financial control;

o) notifies the Board of Directors of irregularities in connection with the use of

property;

p) verify the payroll wage and other rights of employees;

q) verify the calculation and transfers to statutory deadlines, obligations to the state

and obligations to third parties;

r) store primary documents and organize keeping their operations in accordance with

the law;

s) make preventive internal financial control, advising on all university expenditure;

t) perform financial inspection of thematic and basic funds in accordance with the

regulations in force at the university level based on the control plan, the chart of accounts for

budgetary institutions and methodological norms of accounts and other legal acts on the

organization and preventive financial control;

u) preparation and drafting of control, finding notes, and presentation notes on

potential deficiencies as a result of regular check-ups carried out;

v) address control weaknesses identified for the treasurer having been checked;

w) monitoring receipt of timely responses to the protocols developed and issued for

management deficiencies, for the information of the Managing Director;

x) chronological and systematic accounting of all accounting documents related to

the inputs and outputs of patrimony management and financing;

y) performing timely inventory and accounting differences resulting from inventory;

z) highlighting synthetic and analytical investment objectives by funding sources;

aa) identification of fixed assets and inventory items for use in places;

bb) highlighting debtors, creditors, suppliers on funding sources;

cc) the preparation of analytical balances all the evidence;

dd) conduct monthly score between technical and operational accounting and

correcting discrepancies;

ee) registration in the accounts systematically and chronologically, input-output

documents related to the hostel-canteen activity;

ff) the registration statement of account of additional funding (grants, repairs,

scholarships, transportation, investment) and account statement for every hostel;

gg) insurance accounting of income and expenses for each hostel;

hh) provide evidence of debtors, creditors, suppliers on funding sources;

ii) coverage of all monthly financial information in the aggregate balance at

university level;

jj) conducting and supervising revenue funding sources and integrating them in the

institutional contract and supplementary income and expenditure budgets.

Art. 48. (1) The Internal Audit Department is a division of CMU operating in accordance

with the provisions of Law no. 672/2002 on public internal audit, as amended and

supplemented by Order no. 38/2003 of the Minister of Public Finance for the approval of the

general performance of the internal audit activity, as further amended and supplemented.

(2) The responsibilties of the Internal Audit Department are:

a) drafting the annual internal audit plan;

b) carrying out the internal audit activity to assess whether financial management

systems and controls are performed in compliance with legality, regularity, economy,

efficiency and effectiveness norms;

c) report periodically on the findings and recommendations resulting from audits;

d) prepare annual reports on the work of internal audit.

(3) The Internal Audit Department is headed by the Head of Internal Audit

Department and is directly subordinate to the Rector;

Art. 49. (1) The Legal Department is a division of CMU which shall:

a) represents CMU based on delegation granted by the institution data management

and defend the rights and interests before courts and other bodies of jurisdiction, and its

relations with other bodies, natural or legal persons.

b) prepare / draw all the specific acts in support, of the institution interests in courts

of any degree

c) exercise remedies against judgments unfounded and illegal.

d) approve, in terms of the legality of legal acts producing legal effects in the

institution is a party.

e) approve, in terms of legality, any measures that are likely to bind the institution or

bear patrimonial prejudice to its rights or the personnel thereof.

f) provide legal assistance to other functional departments of CMU.

g) develop draft contracts in which the institution is a party, ensuring compliance

with legal provisions.

h) approve the following legal acts:

1) public contracts;

2) decisions: hiring and promotion of staff, award merit pay, appointment of

temporary staff management execution functions, granting other rights wage appointment for

procurement evaluation committees;

3) partnership contracts.

(2) The Legal Department is directly subordinate to the university Rector.

Art.50. (1) The Technical Services is a division of CMU headed by the Head of Technical

Service;

(2) The Head of Technical Services reports to the Managing Director and shall:

a) coordinate and guide investment activities;

b) monitor paperwork and compliance with legal rules in investments, repairs,

consolidation, current repairs with third parties and own facilities;

c) provide coordination and guidance of personnel working in CMU;

d) work with utility providers to conclude contracts and monitor their performance;

e) ensure service activities;

f) provide coordination of transport activity for CMU;

g) ensure optimal conditions for learning activities within CMU pertaining to

cleaning, protection and occupational health and prevention regulations and fire.

Art.51. The Procurement Bureau is a division of CMU headed by a Head of Bureau under

Managing Director and shall:

a) consolidation and development of the institution by taking the material and

carrying out the tasks of the line performance procurement plan;

b) compliance with procurement plan;

c) monitoring and equipment purchases according to beneficiaries and funding

sources: faculties, departments, services, other departments;

d) preparing background notes containing proposals on the composition of the

verification documents, evaluation of tenders and tender evaluation committee for

procurement through bidding price on the level of the institution;

e) preparation of documents necessary for the proper functioning of public

procurement (specification, notice, notice of award, the estimation of the procurement

contract);

f) drawing up rules on categories of consumer materials (supplies, sanitary, cleaning,

and so on,) the number of students, area, number of people (teachers, administrative staff,

etc..) and monitoring their compliance.

Art.52. The Social Service Hostels is a division of CMU headed by a head of office

subordinate to the Mangining Director General. The Head of office is in charge of the

following:

a) social problems of students and management of specific activities;

b) coordinates, directs and controls the activity of educational property managers,

who coordinate the cleaning personnel;

c) ensure cleaning work in school buildings, notify the apparent deficiencies in

sectors and take measures to correct them;

d) coordinate the judicious use of cleaning materials, furniture, and so on;

e) coordinate the obsolescence of furniture, which no longer meets the requirements;

f) ensures the process of alloting rooms in CMU student dormitory considering the

following issues:

1) provision of accommodation in hostels for students and employees of the

university;

2) maintenance and repair of educational facilities and accommodation;

3) provide laundry service, self-laundry service, pest, pest control, sanitation under

contracts with service providers;

g) to prepare plans for security guard positions of CMU -Lake Mamaia, University

Sports Complex;

h) coordinate their own security agents;

i) establish measures to improve security activities;

j) provide organizing dinners for events: PhDs, symposia, foreign delegations;

Art.53. The Department for Prevention and Protection of Labour Health and Safety is a

division of CMU headed by the head of department subordinate to the Rector and shall:

a) be responsible for the application and enforcement of legal rules on PSI and health

and safety and emergency preparedness by sector;

b) liaise with competent control bodies, prepare action plans and proposed timelines

and responsibilities;

c) coordinate, supervise and guide the work contained in the action plans drawn up

by control bodies;

d) perform general introductory briefing for new recruits;

e) prepare documentation in case of accidents at work in CMU;

f) prepare a centralized sheet of all necessary sanitary and protection materials,

based on the applications made by CMU functional departments.

Art.54. (1) The Printing House is a division of CMU whose main task is to provide material

support for printing for all forms of education of the University, printing of magazines, forms

and various papers for all departments within the University.

The Typography is a compartment which is in charge of:

a) editing;

b) printing;

c) commissioning domestic consumption within the university.

(2) The Printing House is headed by a director, who is a teacher of the University

who shall:

a) coordinate, control and direct the printing activity;

b) approve the control reports for authors to perform printing of books;

c) set together with the author and state in writing the deadline for implementation

d) calculate the cost price to achieve multiplication;

e) implement necessary papers for printing work.

Art.55. "NAUTICA" Publishing House of CMU has the following main functions:

a) publishing academic books and other work with didactic purpose;

b) the publication of magazines;

c) editing presentations of Constanta Maritime University;

d) publishing scientific volumes;

e) publishing programs (conferences, student research sessions, sports competitions).

The Publishing House is directly subordinate to the Vice-Rector in charge of

scientific research and innovation.

Art.56. (1) The Library of CMU has the following responsibilities:

a) support of education and research in the university;

b) the provision and development of library services for students, teachers,

researchers, and so on;

c) providing a variety of information resources, traditional or digital;

d) purchase and keep track of publications;

e) indexing and achieve catalogs of books supplied by area.

(2) The Library is subordinated to the vice-rector for research and scientific

innovation that has the following additional functions:

a) policymaker for completing current collections;

b) placing the database in the order of their entry data in the library;

c) organizing the exchange of domestic and international publications;

d) participate in the inventory of publications;

e) establish and implement policies for collections preservation;

f) updating databases (record of publications in library databases representing

electronic catalog);

g) internal alphabetical catalog management;

h) management of collections of publications (Romanian and foreign books or

periodicals) on paper or electronically in the reading room and making them available to

readers;

i) providing information about publications in the library;

j) keeps track of the balance of trade and prepare minutes of receipt for evaluating

publications received by exchange;

k) providing information and references on request to library recipients using

information sources available to the library;

l) guiding users in the retrieval of information;

m) updating the website information on the university library;

n) technical maintenance of the library's online catalog university;

o) ensuring access to database owned or purchased.

Art.57. (1) The Communication Bureau is a division of CMU which operates online public

relations activity within the institution.

(2) The main tasks of the Bureau of communication are:

a) the design of the elementary structure or content of the site www.cmu-edu.eu;

b) ensuring the optimal e-marketing services for university students;

c) constructing the virtual platform for students;

d) participation in stands at fairs, events, exhibitions online presentation service for

education marketing;

e) the maintenance of its services and applications on CMU website;

f) providing online services for students;

g) the technical feasibility of stories, photos, videos from the events of the

university;

h) providing technical support for sound activities;

i) making and mixing messages issued by the university within the university and

outside it;

j) monitoring the reactions of the target audience for the messages issued to promote

the university and proposed management measures to be adopted;

k) making the university advertising materials.

Art.58. (1) CMU establishes the permanent operating commissions on specific issues.

(2) The monitoring and control reports are presented and discussed periodically in

the University Senate, sitting at the base of its resolutions.

(3) The permanent commissions are:

a) The commission for evaluation and quality assurance;

b) The commission for academic ethics and professional conduct;

c) The commission for student carrer guidance;

d) The commission for students social and discipline issues;

e) The commission for education, equivalency of studies.

Art.59. (1) The commission for evaluation and quality assurance is operating in order to

provide quality educational services and research within CMU;

(2) The activity of the commission for evaluation and quality assurance in Constanta

Maritime University is aimed at the coordination of quality study programs and their self-

assessment, the preparation of documentation on quality management, coordination of course

evaluation by students, peer- evaluation of educational activities, plus the necessary steps to

conduct internal audit at the faculty level.

(3) The commission for evaluation and quality assurance is appointed by decision of

the Rector, the main tasks of the committee for evaluation and quality assurance are:

a) developing and reviewing the quality management system documentation;

b) ensuring continued compliance with documentation of the quality management

system and the reference requirements;

c) record the documents prepared on the occasion of self-assessments;

d) annual evaluation activities to ensure educational and research services;

e) regular evaluation of teachers.

The Commission for evaluation and quality assurance is headed by a president of

commission who shall:

a) participate in the development by the rector development strategies and quality

policy;

b) ensure the implementation, operation, certification and surveillance of the quality

management system;

c) establish the duties and responsibilities of committee members;

d) prepare the work program of the Commission for evaluation and quality

assurance;

e) prepare the annual internal audit program;

f) identify nonconformities resulting from internal audit, verify the implementation

of corrective actions and analyze their effectiveness;

g) verify the application and enforcement of all provisions of the laws, regulations

and procedures in force for ensuring the quality of education;

h) prepare annual reports on quality assurance.

The Commission for evaluation and quality assurance reports directly to the Rector.

Art.60. (1) The Commission for academic ethics and professional deontology ensures that

the code of ethics and professional conduct is respected within the university.

(2) The Commission for academic ethics and professional deontology operates under

its own rules adopted by the senate;

(3) The Commission for academic ethics and professional deontology is appointed

by Rector’s decision;

(4) The Ethics Committee shall:

a) analyze and resolve violations of academic ethics, based on complaints received

from members of the academic community, from any person outside the university or self

referral;

b) within 30 days of its establishment, shall satisfy incompatibilities arising from

validation mandates of all members of the management structures or filling management

functions and signals all cases of incompatibility to the university senate;

c) prepare an annual report on the state of compliance with academic ethics and

research ethics to the Rector.

(5) The decisions of the Commission for academic ethics and professional

deontology are approved by the university legal counsellor. Liability for the decisions and

activities of the academic ethics commission pertains to the Rector.

Art.61. The Commission for student carrer guidance

(1) Constanta Maritime University are interested in career counseling for students

and graduates to achieve professional support.

(2) The activity of this committee is to assist CMU students and CMU graduates to

ensure their academic and professional success.

(3) The commission for student carrer guidance is headed by a President of the

commission who shall provide:

a) educational advising services (selection interview preparation, writing a CV,

writing a letter of intent);

b) decision-making for support during their studies;

c) support for applications to attend studies abroad;

d) support for applications in Erasmus programme;

e) information on postgraduate offerings and financing opportunities;

f) organize workshops, job fairs;

g) promotion university educational offer among high school students;

h) submit educational offers in specific actions like: “CAMEX Showroom Mamaia”,

and so on;

i) developing information materials “Student Guide” CMU brochure, leaflets etc.;

j) recruitment and placement of students with a view to provide practical training

onboard ships, special scholarships offered by crewing and profile companies, and so on;

Art.62. (1) The commission for students social and discipline issues operates is to identify

and solve issues related to the students’ education, cultural social and sports issues and all

other issues that concern the integration into university life and student life.

(2) The commission for students social and discipline issues is headed by a President

of the commission who shall:

a) support the integration of students with special emphasis on student life for

obtaining good professional results;

b) notify the student on regulations for scholarships, the accommodation in hostels,

the rules for granting camp tickets;

c) support cultural activities of students by providing logistical support in organizing

cultural events students;

d) support student sports, monitor the sports activity of the university;

e) monitor the social problems of students, identify students with special social

problems;

f) work continually to improve the quality of services offered to students, promoting

ethical sporting and cultural scientific values among students;

g) provide advice during their studies to integrate into society;

h) solve cases of conduct deviation and apply sanctions where appropriate, in

accordance with the Regulation for the professional activity of students.

Art.63. The commission for education, recognition and equivalency of studies operates

permanently in order to observe and adapt to the general rules of recognition and equivalence

of periods of study for students in academic mobility within the country or abroad and to

improve, simplify and increase the transparency of the enrollment in post-graduate studies at

accredited universities in Romania for Romanian citizens, Community or third countries

citizens who have previously partially attended studies.

The commission operates under the Law on ratification of the European Convention

on the General Equivalence of Periods of University Study and the Order of the Ministry of

Education, Youth and Sports 3.223/2012 for approving the Methodology for recognition of

periods of study abroad, published in the Official Gazette, Part I, no. 118, of February 16,

2012.

The Commission is made up of deans and directors of departments and is headed by

the vice-rector for eduaction of CMU.

The responsibilities of the Commission for education, recognition and equivalence

of studies are:

a) the recognition of periods of study attended in a foreign educational institution or

in Romania through the following activities:

1) assessment of education in the recognition file;

2) acknowledging recognition decisions of the periods of study;

3) recognition of appeals from decisions rendered by the Commission.

b) assessing the academic recognition of diplomas according to: type of program of

study, number of transferable credits, content, training, field expertise, professional

qualifications (Diploma Supplement), compared to the Romanian education system in order

to establish the level in the Romanian education. Academic recognition for further studies is

performed in another State other than the one in which the diploma in question was obtained;

c) establishing equivalence sheets of studies that equated subjects, the alternate

exams of the applicant;

d) drawing up a written outcome of the committee activity results for each applicant.

Art.64. Incoming mail addressed to CMU is recorded by the Rector’s Office and apportioned

according to resolutions to the Rector or Vice-Rector of International Relations and

Institutional Development.

Title V

FINAL INSTRUCTIONS

Art.65. The duties of each CMU employee are included in the job descriptions prepared

under the responsibility of the heads department, and are approved by the Rector.

Art.66. The directors, heads of department and office shall take appropriate measures to all

staff of the institution to know and comply with this Regulation..

Art.67. Any amendments to this Regulation shall be approved by the Senate of CMU.
