RECOMMENDATION: It is recommended that the Governing Board adopt the proposed Fiscal Year 2020-2021 Expenditures Budget as attached. BACKGROUND:

In accordance with A.R.S. 15-905, the governing board of each district shall prepare and furnish to the superintendent of public instruction and the county school superintendent a proposed budget no later than July 5 of each year and public hearing for adoption, no later than July 15. Finance developed the fiscal year 2020-2021 budget, considering Arizona’s 2020 commitment and information provided to the Governing Board throughout the year. The proposed budget reflects the tentative approval of the M&O Budget granted by the Board on March 3, 2020 and the Capital Budget granted by the Board on April 7, 2020. The call for a public hearing and publication of the proposed budget was approved at the June 9, 2020 Governing Board meeting. The proposed 2020-2021 Expenditure Budget will be presented for adoption.

The survey was administered the last two weeks of May, and gathered feedback from students, staff, parents, and community members.

It is recommended that the Governing Board approve the annual renewal of the Maricopa County Community College District (MCCCD) Intergovernmental Agreement (IGA) for Dual Enrollment Programs held at high schools for the 2020-2021 school year:

BACKGROUND:

Each year the MCCCD provides site-specific instructions in courses that afford SUSD students the opportunity for college credit in addition to their graduation requirements. MCCC agrees to pay School District $1,000 per annualized Full-Time Student Equivalent (“FTSE”) and an additional $300 per annualized FTSE for ongoing use of computer labs and occupational and science lab equipment and supplies (pending full funding of dual enrollment in the fiscal year 2020/2021 budget). The purpose of those payments is to compensate School District for the reasonable cost of instructional services, facilities, and materials used in the MCCCD courses covered by this Agreement. MCCC will calculate annualized FTSE by dividing the total number of student credit hours, as of the official count day as specified in applicable state law, by 30. If State aid to community colleges for dual enrollment be reduced or eliminated, stipend amounts will necessarily be re-negotiated. There is no cost to the District for this IGA.

Approval of Renewal of Intergovernmental Agreement (IGA) between SUSD and Joint Technical Education District (“Pima County JTED”)

RECOMMENDATION:

It is recommended that the Governing Board approve the renewal of the Intergovernmental Agreement (IGA) between SUSD and Joint Technical Education District (“Pima County JTED”) for the purpose of establishing and joining the Arizona CTE Curriculum Consortium for the 2020-2021 fiscal year and renewing automatically each fiscal year.

BACKGROUND:

The purpose of this Agreement is to designate Consortium Member as a member of the Arizona CTE Curriculum Consortium and memorialize Consortium Member’s agreement to comply with conditions and restrictions imposed by Pima County JTED and the Consortium concerning use of the CTE Instructional Materials. Agreement shall be effective upon the approval by both the Governing Board of Pima County JTED and the Governing Board (or other governing body or authorized person, if applicable) of Consortium Member and shall continue in effect continuously thereafter, renewing automatically each fiscal year for a total of five (5) years. Pursuant to ARS §38-511, either party may, within three (3) years after the execution of the agreement may cancel it. The Agreement may be terminated by either party when either party receives written notice of the cancellation unless the notice specifies a later time. Approval of Extension of Term of Intergovernmental Agreement (“IGA”) between SUSD and Maricopa County Head Start Preschool Program


RECOMMENDATION:

It is recommended that the Governing Board approve a three-year extension of the term of Intergovernmental Agreement (“IGA”) between SUSD and Maricopa County Head Start for publicly funded preschool programs for the 2020-2021, 2021-2022 and 2022-2023 school years. The IGA may be extended for two (2) additional three (3) year terms. This approval will be the first of the additional three (3) year terms

BACKGROUND:

Scottsdale Unified School District (“SUSD”) does not currently provide any Head Start programs. However, this IGA allows SUSD and Head Start to provide services to preschool children, including children with disabilities as defined in A.R.S. §15-761, ages three years old to kindergarten-eligible five-year-old’s, in compliance with Federal and Arizona State laws and regulations, District policy, and the Improving Head Start for School Readiness Act of 2007. The Board approved this IGA for renewal on October 18, 2016, effective from August 1, 2016 through June 30, 2019. On August 6, 2019, the Board approved extending the IGA from July 1, 2019 through June 30, 2020. Pursuant to Section 1, Paragraph J, (p. 5) of the IGA, the parties may extend the agreement for two (2) additional three (3)-year terms. There is no cost to the District.

It is recommended that the Governing Board adopt the 2020/2021 Resolution appointing Maricopa County Superintendent of Schools as the Chief Disbursing Office for all garnishment of wages made upon any employee of the District. This is in accordance with the Arizona Revised Statute 12-1602.

This resolution allows the Maricopa County School Superintendent’s office to process garnishments for our District as needed.

Adoption of Resolution Authorizing Issuance and Sale of Tax Anticipation Notes

RECOMMENDATION: It is recommended that the Governing Board, if deemed advisable, adopt the Resolution authorizing the issuance and Sale of Tax Anticipation Notes (TANS) by the District. BACKGROUND:

The District is requesting the authorization and Sale of Tax Anticipation Notes (TANS) to offset large Capital and M&O pre-paid expenditures. The purpose of this authorization is to reduce interest costs associated with negative cash flow. Large M&O prepays, and Capital expenditures take place early in the Fiscal Year prior to the District’s receipt of property tax revenue. The District will not exceed the lessor of $15,000,000 in Tax Anticipation Notes, if need. All documents have been approved by Gust Rosenfeld. BACKGROUND: At each school site we have a fiber backbone consisting of OM1 fiber that connects equipment in our Main Distribution Frame (MDF) to the equipment in Intermediate Distribution Frames (IDF) located in the outlying buildings on the campus. The SUSD Local Area Network backbone currently has connection speeds of 1Gbps. This proposal will install new fiber (six strands) and new optical interfaces between the MDF and IDF’s in our school buildings that will allow for speeds of 10Gbps between buildings. Our plan is to begin work on this project for the Middle School, Desert Canyon ES and Yavapai sites in July of 2020, complete as much of the work as possible prior to the start of the school year, with completion during the fall semester. We have filed a Form 471 with the Universal Service Administrative Co., who administers the E-rate program. Upon approval, they will fund 50% of eligible parts and services up to the amount in the column titled “Anticipated E-rate Funding”.

This purchase was procured by posting a 470 to the USAC’s E-rate site and to AZ Purchasing. The district received responses from CDW, ENS, Kearney, Logicalis and Vector. A committee was formed for the review of the responses. The committee determined the most advantageous solution for SUSD was provided was through CDW, Mohave ESC 151-CDWG-1002 contract, National IPA/TCPN Agreement #R160201. RECOMMENDATION: It is recommended that the Governing Board approve the multiple vendor award of RFP No. 21010 for Kitchen & Cafeteria Equipment Parts & Repair to Arrowhead, American Refrigeration, Byassee and Andrews Refrigeration for fiscal year 2020-2021 and authorize four (4) additional one-year renewals. Estimated expenditures budgeted for the upcoming fiscal year are $120,000.

BACKGROUND: The purpose of the Request for Proposal is to seek proposals from qualified vendors for Kitchen & Cafeteria Equipment Parts & Repair. The Nutrition Service Department operates 30 kitchens in the District. Each kitchen stores up to a week’s worth of food in freezers and refrigerators. It is not uncommon for these units to malfunction during District closures when staff is unavailable to make repairs. Unfortunately, when this occurs, the Department can lose food inventory which can cost thousands of dollars. Awarded vendors will be called to make these emergency repairs, as well as any repair that District personnel are unable to perform. On May 5, 2020 the RFP solicitation was released. Proposals were sent to thirty-four (34) prospective vendors, on May 22, 2020 at 1:00 p.m proposals were received from eight (8) firms. On June 2, 2020 copies of the proposal were made available to each member of the Evaluation Committee for review and evaluation. All responses met the criteria set forth in the Request for Proposal and were presented to the Committee for review, evaluation and recommendation. For this procurement, the Evaluation Committee consisted of Patti Bilbrey, Director Nutrition Services, Brian Cassidy, Facilities Services, and Aimee Morgan, Fiscal Support Coordinator. It is the recommendation of the evaluation committee to issue a multiple vendor award to Kitchen & Cafeteria Equipment Parts & Repair to Arrowhead, American Refrigeration, Byassee and Andrews Refrigeration. This contract shall be valid for fiscal year 2020-2021 with an option to renew for four (4) additional one-year terms not to exceed a total of five (5). The award is contingent upon the availability of funds for each fiscal year and overall satisfaction with the services provided. For this procurement, it was necessary to compare different price, quality and contractual factors, to conduct discussions with the offerors and to award a contract in which price alone was not the determining factor. Therefore, competitive sealed bidding was not practicable or advantageous to the District and the competitive sealed proposal method was used. BACKGROUND:

The Governing Board previously discussed Policy BDG at the June 9, 2020 Governing Board meeting, when it was presented for a first read. During the June 9, 2020 meeting, Board members discussed adding a statement that the District will complete the evaluation before offering a contract to the General Counsel for the following school year. That statement has been added to the proposed changes to the policy. In addition, in consultation with Superintendent Dr. Kriekard, incoming Superintendent Dr. Menzel, and Human Resources, we have proposed adding a date by which the General Counsel evaluation will be completed, April 15, to align with the District’s target timeline for issuing Cabinet and Administrator contracts. We are presenting the revisions for the Board’s consideration and possible approval as a second read, pursuant to Governing Board Policy BGB, Policy Adoption (requiring at least two readings of policy changes, unless waived).

SCHOOL ATTORNEY

The Governing Board may choose to hire a General Counsel for the District. The

General Counsel is expected to represent, advise, and assist the District's

administration on a daily basis, in accordance with the Arizona Supreme Court Rules of

Professional Conduct, including but not limited to Ethical Rule 1.13, Organization as

Client. Rule 42, Rules of the Supreme Court. As the attorney for the District, the

General Counsel may communicate directly with the Governing Board, individual

members of the Governing Board, and employees of the District.

The Governing Board and Superintendent will work together to develop a search and

hiring process for the General Counsel position when needed. Compensation and

purpose should be determined at the time of employment.

The Superintendent shall evaluate the performance of the General Counsel annually,

after receiving input from the Governing Board and General Counsel.

● The evaluation process shall include an informal mid-year review and year-end

review. At the year-end review, the Superintendent shall complete an evaluation utilizing

the Board approved evaluation instrument (Exhibit BDG-EA), with input from the

Governing Board members.

● The evaluation instrument may include a limited number (no more than five (5))

annual operational goals that are aligned to the District’s strategic plan and annual

goals; the Superintendent shall consult with the Board and General Counsel regarding

the annual goals and to establish tools to measure objectives to be included in the

evaluation instrument. Annual goals shall be determined between August 1 and

September 30 each year.

● The Board and Superintendent may hold an executive session to discuss the

General Counsel's performance reviews. The General Counsel shall have the

opportunity to participate in all or part of the executive session(s) to allow for discussion.

● The General Counsel may submit a response to the evaluation.

● The Governing Board shall not issue an employment contract to the General

Counsel for the following school year before the annual evaluation has been completed.

The evaluation shall be completed on or before April 15 each year.

The Superintendent or Board members may confer with the District's General Counsel.

The Superintendent, General Counsel and the President of the Board shall be

designated as the representatives of the District who may confer with outside counsel.

Only the Superintendent, General Counsel, or Board President may authorize Board

members or staff to contact outside legal counsel regarding District matters. The District

will not be responsible for fees that accrue because of unauthorized individual Board

member or staff consultation with outside legal counsel.

The Governing Board retains the authority to terminate the employment of General

Counsel, in compliance with applicable state laws, Board Policy and the General

Counsel's employment contract.

BACKGROUND:

The Governing Board previously discussed Policy GCO at the June 9, 2020 Governing Board meeting, when it was presented for a first read. During the June 9, 2020 meeting, Board members inquired about why the ASBA model policy recommended that the evaluation system for “other administrators” be developed under the leadership of the Superintendent instead of the Governing Board. Pursuant to A.R.S. §15-503(C), the Governing Board is to develop and adopt evaluation systems and avail itself of the advice of administrators in doing so. The ASBA model policy language complies with the statute, in that a governing board establishes the evaluation system by adopting the tool and the ratio of student data to be used. However, to more closely align with A.R.S. § 15-503(C), we have updated this reference and are recommending the policy state that the evaluation system for “other administrators” will be developed under the leadership of the Superintendent, who will make recommendations to the Governing Board for approval of the evaluation system. This aligns more closely with the statute and makes it clearer that that the Governing Board is establishing the evaluation system. We also have made a minor edit requested at the June 9 meeting. The edit is to the following reference to the: “District’s evaluation system as a whole.” This phrase appeared twice in the policy. The phrase “as a whole” has been deleted from the current recommendation. We are presenting the revisions for the Board’s consideration and possible approval as a second read, pursuant to Governing Board Policy BGB, Policy Adoption (requiring at least two readings of policy changes, unless waived).

EVALUATION OF PROFESSIONAL

STAFF MEMBERS

The process and purpose of evaluation for certificated professional staff members is to result in

improvement of the quality of instruction and the strengthening of the abilities of the professional

staff.

Definition of Terms:

In this policy:

A. Certificated teacher means a person who holds a certificate from the State Board

of Education to work in the schools of this state and who is employed under contract in a

position that requires certification, except a psychologist or an administrator devoting at

least fifty percent (50%) of his time to classroom teaching.

B. Inadequacy of classroom performance means the definition of inadequacy of

classroom performance adopted by the Governing Board.

C. Performance classifications means the four (4) performance classifications for

teachers and principals adopted by the Governing Board.

D. Qualified evaluator means a school principal or other person who is trained to

evaluate teachers and who is designated by the Governing Board to evaluate certificated

teachers

Evaluation of Classroom Teachers

and Other Certificated Non-

administrative Staff Members

The District teacher performance evaluation system will do the following:

A. be designed to improve teacher performance and improve student achievement;

B. include the use of quantitative data on the academic progress for all students, which shall

account for between twenty percent (20%) and thirty three percent (33%) of the

evaluation outcomes and

C. include four (4) designated as highly effective, effective, developing and ineffective.

The performance classifications are to be applied to the evaluation instruments in a manner

designed to improve principal and teacher performance.

At least annually, the Governing Board will discuss at a public meeting its aggregate

performance classifications of principals and teachers.

The District will involve its certificated teachers in the development and periodic evaluation of

the teacher performance evaluation system. The following elements will be a part of the

evaluation system:

A. It will meet the requirements prescribed in statute and provide at least one (1)

evaluation of each certificated teacher by a qualified evaluator each school

year.

B. A copy of the evaluation system shall be made available to each teacher in the

District.

C. The District will provide specific training requirements for qualified evaluators.

D. The Superintendent will annually recommend qualified evaluators to the

Board for approval.

E. The Board will designate qualified evaluators

F. The system will include incentives for teachers in the highest performance

classification.

G. The system will include a plan for the appropriate use of quantitative data of

student academic progress in evaluations of all certificated teachers. The plan

may make distinctions between certificated teachers who provide direct

instruction to students and certificated teachers who do not provide direct

instruction to students. The plan may include data for multiple school years and

may limit the use of data for certificated teachers who have taught for less tha

two (2) complete school years.

The Governing Board may waive the requirement of a second classroom observation for a

continuing teacher whose teaching performance based on the first classroom observation places

the teacher in one (1) of the two (2) highest performance classifications for the current school

year, unless the teacher requests a second observation.

Inadequacy of Classroom Performance

A certificated teacher's classroom performance is inadequate if:

A. During the school year, a certificated teacher receives:

1. One rating of “ineffective” during a formal observation by the primary evaluator

on one (1) or more component(s) of classroom performance standards one (1)

through six (6) on the District's formal observation instrument; and/or

2. Three or more ratings of “developing” during a formal observation by the primary

evaluator on one (1) or more component(s) of classroom performance standards

one (1) through six (6) on the District's formal observation instrument; and/or

3. One (1) rating of “ineffective” or three (3) or more ratings of “developing” on the

District’s summative evaluation.

B. The certificated teacher receives a performance classification of “ineffective” on the

District’s evaluation system.

C. The certificated teacher receives a performance classification of “developing” on the

District’s evaluation system for two (2) consecutive years.

Preliminary Notice of Inadequate

Classroom Performance

Either the qualified evaluator or another Board designee shall confer with the teacher to make

specific recommendations as to the areas of improvement in the teacher's performance; provide

professional development opportunities for the certificated teacher to improve performance and

follow up with the teacher after a reasonable period of time for the purpose of ascertaining that

the teacher is demonstrating adequate performance. The District’s dismissal or non-renewal

procedures shall provide a certificated teacher with an opportunity to improve inadequate

classroom performance.

The District shall issue a preliminary notice of inadequacy of classroom performance no later

than the second consecutive year that the teacher is designated in one (1) of the two (2) lowest

performance classifications unless the teacher is in the first or second year of employment with

the District or has been reassigned to teach a new subject or grade level for the preceding or

current school year.

Prior approval by the Board is not required for each notice of inadequacy. The Assistant

Superintendent for Human Resources or the Assistant Superintendent for Human Resources'

designee is authorized to issue notices of inadequacy of classroom performance, subject to

approval by the Superintendent. When a notice is issued without prior Board approval, the

Board shall be notified within ten (10) days of such issuance.

A teacher whose evaluation is used as a criterion for establishing compensation and who

disagrees with the evaluation may make a written appeal. The teacher shall have the burden of

proof in the appeal. The appeal shall go to the Superintendent or the Superintendent’s designee.

Evaluation of Principals, other Administrators

and Psychologists

The District shall establish and maintain a system for the evaluation of the performance of

principals, other school administrators, and psychologists. The District will seek advice from

District administrators and psychologists in the development of the performance evaluation

system for each of these employee classifications.

Principal Evaluation

The District’s principal evaluation system shall be:

A. designed to improve principal performance and improve student achievement.

B. include the use of quantitative data on the academic progress for all students, which

shall account for between twenty percent (20%) and thirty-three percent (33%) of the

evaluation outcomes.

C. include four (4) performance classifications, designated as highly effective, effective,

developing and ineffective;

D. describe both of the following:

1. the methods used to evaluate the performance of principals, including the data

used to measure student performance and job effectiveness; and

2. the formula used to determine evaluation outcomes.

The evaluation system for the evaluation of the performance of principals may include the over-

all instructional program, student progress, personnel, curriculum, and facilities. Principals will

be given a review of evaluation procedures prior to beginning the process.

Subject to statutory limitations, the Board shall make available the evaluation and performance

classification pursuant to A.R.S. § 15-503 of each principal in the School District to school

districts and charter schools that are inquiring about the performance of the principal for hiring

purposes.

Evaluation of Other Administrators

The format for the evaluation system for other administrators (other than the Superintendent)

will be developed under the leadership of the Superintendent, focusing on the responsibilities and

outcomes which support the over-all instructional program and needs of the District. The

Superintendent will make recommendations to the Governing Board for approval of

the evaluation system for other administrators. Evaluation procedures, timelines, and methods to

be used for the communication of evaluation results will be reviewed with each employee prior

to beginning the process.

Evaluation of Certificated School Psychologists

The evaluation system for certificated school psychologists shall include the following:

A. Recommendations as to areas of improvement in the performance of the

certificated school psychologist if the performance warrants improvement.

B. After transmittal of an observation or assessment, a Board designee shall confer

with the certificated school psychologist to make specific recommendations as to

areas of improvement in performance.

C. The Board designee shall provide assistance and opportunities for the certificated

school psychologist to improve his performance and shall follow up after a

reasonable period of time for the purpose of ascertaining that adequate

performance is being demonstrated.

D. Appeal procedures for certificated school psychologists who disagree with the

evaluation of their performance, if the evaluation is for use as criteria for

establishing compensation or dismissal.
