*Owner/Operator of The Arena Family Entertainment Center 1994-2000

*Owner and manager of commercial property that houses eleven

tenants. Each tenant has handicap access in accordance with the Federal ADA Laws. 1978-present

*1 have been disabled since 1981 and confined to a wheelchair since 2003. This physical challenge, combined my knowledge of commercial property laws, gives me a clear understanding of the Disabled Community of our city.

I am very interested in serving the City of Pittsfield through the Zoning Board of Appeals. Please accept this letter and my resume for your consideration of this appointment.

With the growth and potential of Pittsfield expanding, there is a need to preserve some aspects of our City, while being open to new opportunities. Maintaining our natural resources, while encouraging economic growth happens on many levels in City government, and I hope to be a conscientious participant in this process. Over the past year, I have been involved with the TDI in Morningside through my employer, Berkshire Children and Families. There have been thoughtful and passionate conversations that have peaked my interest further in contributing to the City through that planning process.

Submitted herewith for your consideration is a request for authorization for the Pittsfield Municipal Airport Commission to retain the services of Anderson & Kreiger, LLP and to pay for such services from the City Treasury in regards to the lease review of Lyon Aviation, Inc., the Fixed Based Operator (FBO) at Pittsfield Municipal Airport.

Enclosed, is the Statement of Qualifications of the finn of Anderson & Kreiger, LLP for legal representation in reviewing long-tenn leases and potential new leases to FBOs at the Pittsfield Municipal Airport. The finn will provide special expertise in airport law of the Federal Aviation Administration Grant Assurances including, regulations and policies, of which are required to adhere to special, unique lease tenns and conditions to ensure Airport compliance.

Also enclosed, is the "Proposed Budget for Pittsfield Municipal Airport Lyon Lease Matter," for the estimated budget of review of existing lease of Lyon Aviation, Inc. and all amendments, drafting of new lease documents and potential negotiation of new lease for the Fixed Based Operator.

Also enclosed, is the unsigned, Legal Services Agreement for "Outside Special Counsel for Review and Development of Leases of Airport Land," from Anderson & Kreiger, LLP.

This letter will confirm that the Pittsfield Municipal Airport Commission ("Commission") and the City of Pittsfield ("City") have retained Anderson & Kreiger LLP ("A&K") as special counsel to represent the Commission and the City in connection with review of certain existing lease agreements and development of new leases of Airport land as may be needed, together with legal advice concerning lease compliance with federal and state law. The attached budget represents the hours and fees that A&K anticipates will cover the outlined tasks.

A&K will submit and the PMAC a!,'J'ees to pay monthly bills for work on this project based on the attached budget.

Each monthly bill will provide a detailed daily accounting of all time spent on this project by each timekeeper. The PMAC agrees to reimburse A&K for our reasonable out-of-pocket expenses associated with this project (including travel), charged at actual cost without mark-up. These costs will also be itemized and billed monthly.

We expect that based on our current engagement with the Commission for review of solar projects and contracts at the Airport, that outside Airport counsel have already been designated as special municipal employees. Such designation by the City Council is necessary under Chapter 268A, the Massachusetts Ethics Act, for contractors or consultants engaged to perfonn a limited scope of work for the City or any of its departments or affiliated entities. If Airport Counsel has already been so designated, please send me a copy of the Council action for our records. If not, please arrange for the designation to be adopted by thc Council.

ANDERSON & KREIGER LLP

Anderson & Kreiger LLP is pleased to submit this Statement of Qualifications for legal representation in reviewing long-tenn leases and potential new leases to Fixed Based Operators (FBOs) at the PMA. Anderson & Kreiger has nationally recognized expertise in the representation of public airport owners and operators in a diverse array of significant legal matters. Airports that are federally obligated under Federal Aviation Administration grant assurances and related law, regulations and policies, are required to adhere to special lease terms and conditions. Negotiations with FBOs can be fraught with complications not ordinarily encountered in other kinds of public leasing arrangements. We are prepared to provide the special expertise in airport law necessary to assist Pittsfield in its relationship with its FBOs.

DESCRIPTION OF FIRM

We have extensive experience in handling a wide variety of legal problems that currently face airport owners.

AIRPORT EXPERIENCE

The airport law team at Anderson & Kreiger is also currently involved in representing a large number of other airport owners in a wide variety of legal matters that call on exactly the specialized expertise in aVlatlOn law, environmental law, real estate law and litigation that we propose to provide to the City. We offer the following illustrative examples:

• We are currently representing Chicago, Seattle and San Jose in connection with the drafting and negotiation of new airline agreements and recently completed such work for the cities of Atlanta, Charlotte, Nashville and Syracuse as well as for the Metropolitan Washington Airport Authority.

• We represented the American Association of Airport Executives ("AAAE") and ACI as well as I 9 individual airport sponsors in a petition for review of a TSA rule that would have placed the burden of staffing exit lanes on airports. Our work included filing a petition for review in the D.C. Circuit Court of Appeals, briefing a motion to stay and supporting AAAE's and ACI's successful lobbying effort to obtain a legislative solution.

• Recently, we advised the San Diego County Regional Airport Authority ("SDCRAA") in responding to a threatened NEP A challenge to a new consolidated rental car facility. Anderson & Kreiger worked with

SDCRAA and the FAA to prepare the response. Ultimately, no challenge was filed.

• We represent the City of Los Angeles in connection with the establishment of new airport rates and charges, and we have handled for the City a major FAA audit; two separate Pt. 161 studies dealing with proposed limitations on the use of noisy aircraft at airports owned by the City; and a variety of other federal regulatory matters arising at the four different airports owned and operated by the City.

We successfully defended the Barnstable Municipal Airport Commission against a 13 count federal lawsuit by an FBO, falsely alleging racketeering, anti-trust, civil rights and tort claims.

We are currently defending a bid protest, including defeat of preliminary injunctions, against the Martha's Vineyard Airport Commission by a long-tenn tenant who failed to submit the most favorable response and offer of rent to the Commission's request for proposals.

We have advised Salt Lake City on the City's airline lease negotiations and FAA audit of airport revenue use, the extension of a light rail system into the Airport and NEP A compliance for its airport redevelopment program.

We have advised a number of different airport proprietors, including Barnstable and Rochester on issues arising from hangar leases, FBO agreements and Minimum Standards, and disputes involving airport fueling rules.

As we have since 1983, we continue to represent the Massachusetts Port Authority, owner and operator of Logan International Airport, in many different kinds of matters, including airport rates and charges; environmental permitting and compliance; airport revenue use; First Amendment issues arising from picketing at Massport-owned facilities, including the

QUALIFICATIONS OF THE TEAM MEMBERS

Anderson & Kreiger proposes to draw upon a team of highly qualified, experienced and committed professionals to meet the City's requirements for outside legal services on airport matters. The team would be supported by other members of the firm on an as-needed basis.

David S, Mackey, our managing partner, joined us in 2013. Prior to joining A&K, Dave was the former Chief Legal Counsel and Interim Chief Executive Officer for Massport, giving Dave enormous insight and practical experience with the special legal, operational and business issues facing major multi-modal ports. Since joining Anderson & Kreiger, Dave has defended the Tulsa Airports Improvement Trust in an Oklahoma breach of contract action, in which the FAA and OIG found that the underlying contract violated federal revenue use rules. He represented airport industry groups and airports in challenging a TSA regulation that would have required airports to assume responsibility for exit lane staffing. Dave defended Massport in a case involving an alleged spill of jet fuel into Boston Harbor, and represented the Martha's Vineyard Airport Commission in litigation over control of the Airport by County government.

Kevin D. Batt, counsel with A&K, is a long term municipal lawyer who has served the Towns of Acton, Concord, Lexington, Dover, and Duxbury as Town Counsel, and provided special counsel services to Attleboro, Cambridge and Barnstable, among other communities. Kevin has provided long term representation to the Martha's Vineyard Airport Commission, including drafting RFPs for lease of aeronautical and non­aeronautical land, litigation over ternunation of

hangar leases and assistance with complex governance issues at the airport. He was a key member of the team in successfully defending the Bamstable Municipal Airport Commission in a major federal lawsuit with one of the airport's FBOs. In addition, he has helped airport and municipal clients host and develop renewable energy projects. Kevin is a graduate of Yale University and Boston University Law School and clerked for Justice Margaret H. Marshall prior to begim1ing practice.

Mina S. Makarions, a senior associate, focuses his practice on public sector clients, including airports. He has been practicing since 2009. Mina has advised several airport clients on regulatory, security and constitutional issues, including Massport, Detroit, and San Francisco and assisted in preparing an amicus brief on behalf of ACI on airport security issues. Mina worked extensively on tax matters for the City. He is a graduate of Harvard College and Harvard Law School.

Christina S. Marshall, a junior associate, helps clients with litigation, public law, and environmental matters. She began practicing law in 2013. Christina has successfully defended the City of San Francisco in a Part 13 proceeding and has assisted airports on PFC collection matters. She has also advised multiple airport clients on potential litigation arising out of Metroplex flight track changes, as well as various regulatory, constitutional, and security issues. Christina received her undergraduate and law degrees from Boston College and clerked for the Superior Courts of Rhode Island and Massachusetts.

FEE AND COST STRUCTURE

Anderson & Kreiger's experience and approach to the delivery of services make it possible for us to deliver the highest quality legal services efficiently and cost-effectively. We are well aware that our clients, especially when they come from the public sector, engage counsel for favorable results at a reasonable cost. It is always our goal to control costs by using the most effective combination of lawyers to staff each

The regular hourly rates currently charged to public airport owners by the team members designated in this proposal are laid out below:

These rates reflect substantial discounts from our standard hourly rates. We would be pleased to discuss billing alternatives with the City.

Expenses

We would propose to bill, in addition to our legal fees, for necessary out-of-pocket expenses and disbursements, such as lravel and document reproduction. All of these items would be charged at cost. We are equipped with state-af­the-art communications technology, and strive to minimize the use of fax machines and ovemight couriers through the electronic transmission of information.

Billing

Anderson & Kreiger will plan to submit monthly statements accompanied by computer printouts detailing the time charges and disbursements covered by the bill, in a form acceptable to the City.

This Budget assumes that a combination of more senior and junior attorneys would be able to complete the tasks outlined above. The most unpredictable is the third task. On the one hand, Airport and City officials may be able to negotiate most of the items in dispute in a proposed lease without much legal help, and be able to reduce or eliminate this legal task. On the other hand, if considerable iterations of draft leases and protracted negotiations with an opposing counsel are required, time on this task could expand. We trust that the City would help us etTectively manage our time and provide additional compensation ifnecessary in this circumstance.

This budget also does not include legal assistance ifpublic procurement of new lease proposals is required, nor if litigation arises in the course of this engagement. A&K would continue to work with the City to address these needs, subject to appropriate amendments to this Budget.

The City of Pittsfield, through the Pittsfield Police Department, is responsible for conducting background investigations and checks for applicants for several types of Commonwealth and Municipal licenses and permits. Among them are Soliciting and Canvassing Permits, Vendor's Licenses, Fortune Teller's Licenses, and any other permit or license requiring a certification of character, or lack of certain criminal convictions.

Historically, PPD has completed these background checks by running a computer based National Crime Information Center (NCIC) records check. Beginning in 2010, under the CORI Reform Act, the Commonwealth began moving municipalities toward fingerprint based background checks, rather than the traditional computer based model. While they advocated for a move to fingerprint based checks, they did not require it. Prior requests by PPD to explore fingerprint based background checks were rejected.

Last year, the Commonwealth updated our Criminal Justice Information System regulations and prohibited the use of computer based NCIC checks for the purpose of Civil background checks. With this change, the Department's ability to process background checks for license and permits was ham-strung. We have been informed that requiring applicants to submit their own records with their applications is also prohibited by law.

In addition, the DCJIS has created the Commonwealth of Massachusetts Model Municipal Civil

Fingerprinting Policy for Occupational Licensing, which you may use either as your municipality policy or

Department of Criminal Justice Information Services Model Municipal Civil Fingerprinting Policy

for Municipal Licensing Applicants

Applicability This policy is applicable to the civil fingerprinting process for the state and national criminal history screening of applicants for the following municipal licenses:

Authority This policy is promulgated in accordance with 28 CFR 20.33(a)(3), Public Law 92-544, M.G.L. c. 6, § 172B Y, , and <insert local bylaw or ordinance authorizing fingerprint-based state and national criminal history screening>.

The civil fingerprinting process for municipal licensing applicants is also subject to the "Massachusetts Department of Criminal Justice Information Services Policies and Procedures for Civil Fingerprinting for Municipal Licensing Applicants."

Schedule of Fingerprint Collection Licensing applicants may appear at <insert city/town name> Police Department, located at <insert police department address>, for fingerprint collection on the following days <insert days fingerprint collection is available> between the following hours <insert hours available for fingerprint collection>.

Verification of Identification Before being fingerprinted, all licensing applicants are required to present government-issued identification. Consent All licensing applicants must consent to the collection and submission of their fingerprints for the purposes of conducting state and national criminal history screening by completing the "Civil Fingerprinting Consent Form". Consent forms will be retained for at least one year but for no longer than three years.

Fingerprinting fees include federal, state, and local fees. Before being fingerprinted, all licensing applicants must pay the statutory fingerprint fee of thirty dollars ($30.00) with a money order or bank check payable to the "Commonwealth of Massachusetts." In addition to a signature, the money order or bank check shall include the name of the applicant hand-printed in block letters.

During the challenge stage, the fingerprint-based state and national criminal history record information shall be stored in a secure location and access to the information shall be restricted to authorized personnel.

Handling of Fingerprint-Based State and National Criminal History Information Fingerprint-based state and national criminal history record information will only be handled and reviewed by authorized personnel in a secure area, out of the view of the public and of all other unauthorized individuals.

Destruction of Fingerprint-Based State and National Criminal History Information When fingerprint-based state and national criminal history information is no longer needed, it shall be destroyed by the licensing authority by burning, shredding, or other method, rendering the information unreadable.

Correcting Fingerprint-Based State and Nation Criminal History Information All licensing applicants have the right to challenge the information contained within a fingerprint-based state or national criminal history record response. In order to change, correct, or update criminal history record in question, the licensing applicant must follow the procedures listed below:

If, after reviewing his/her identification record, the subject thereof believes that it is incorrect or incomplete in any respect and wishes changes, corrections or updating of the alleged deficiency, he/she should make application directly to the agency which contributed the questioned information. The subject of a record may also direct his/her challenge as to the accuracy or completeness of any entry on his/her FBI record to the FBI, Criminal Justice Information Services (CJIS) Division, AnN: SCU, Mod. D-2, 1000 Custer Hollow Road, Clarksburg, WV 26306. The FBI will then forward the challenge to the agency which submitted the data requesting that agency to verify or correct the challenged entry. Upon the receipt of an official communication directly from the agency which contributed the original information, the FBI CJIS Division will make any changes necessary in accordance with the information supplied by that agency.

Each applicant will also be provided with a copy of the "FBI Procedure for Changing, Correcting or Updating a Record."

requests installation of left turn signals at the intersection of Center Street and Columbus Avenue for both northbound and southbound traffic.

Residents traveling this route, especially those in the senior housing complexes in the area, must sometimes wait through several traffic light cycles in order to make turns onto Columbus Avenue. Having a designated time for only left turns will allow those turns to be made safely and will alleviate traffic congestion.

Section 17e. (a) Notwithstanding section 17 or any other general or special law to the contrary, the city

council, the transportation commissioner of the city of Boston, the board of selectmen. park commissioners. a

traffic commission or traffic director of a city or town that accepts this section in the manner provided in section

4 of chapter 4 may, in the interests of public safety and without further authority, establish a speed limit of 25

miles per hour on any roadway inside a thickly settled or business district in the city or town on any way that is

not a state highway.

(b) Upon establishing a speed limit under this section, the city or town shall notify the department. The

operation of a motor yehicle at a speed in excess of a speed limit established under this section shall be a

violation of section 17.
