RECREATIONAL APPLICATIONS LIMITED WARRANTY COVERAGE

Yanmar Marine International B.V. (“YANMAR”), provides this Limited Warranty Handbook to help you take full advantage of the YANMAR engine, YANMAR by KANZAKI marine gears, YANMAR SAIL DRIVE marine gears and/or Yanmar Control systems (hereafter “YANMAR Marine Product(s)”) you have purchased. Before installing or using your YANMAR Marine Product(s), please read and understand this handbook and the applicable Operation Manual(s) carefully. If you did not receive an Operation Manual, please contact your YANMAR distributor or dealer to request a copy.

YANMAR warrants that at the time of shipping, new YANMAR Marine Products sold by it and its authorized YANMAR marine distributors meet all applicable specifications and will be free from defects in material and workmanship for the Limited Warranty Period. This Limited Warranty is subject to limitations discussed later in this Warranty Handbook.

THIS LIMITED WARRANTY IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. YANMAR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY, EXCEPT WHERE SUCH DISCLAIMER IS PROHIBITED BY LAW. IF SUCH DISCLAIMER IS PROHIBITED BY LAW, THEN IMPLIED WARRANTIES SHALL BE LIMITED IN DURATION TO THE LIFE OF THE EXPRESS WARRANTY.

YANMAR LIMITED WARRANTYYANMAR warrants to the original retail purchaser that it will make any repairs or replacements necessary to correct defects in material and / or workmanship of YANMAR Marine Products for the Limited Warranty Period. This Limited Warranty gives you certain legal rights. You may have other rights that vary from state to state and country to country. This Limited Warranty covers YANMAR Marine Products operating anywhere in the world where Yanmar approved service is available.



The remaining portion of this Limited Warranty may be transferred to a second retail purchaser provided that YANMAR is notified in writing at the time the second purchaser takes possession. At such time YANMAR may, at its option, require an inspection by an authorized YANMAR service center of any of the YANMAR Marine Products. If any of the YANMAR Marine Products cannot pass that inspection, the transfer of this Limited Warranty may be rejected. The cost of the inspection is born by the purchaser. Transfer of this Limited Warranty will not extend its duration. YANMAR specifically disclaims any express or implied warranties to the second retail purchaser except as provided herein, and disclaims all warranties, express and implied, to any subsequent purchaser.

Limitations

IMPORTANT:

In order to validate your Yanmar Marine Limited Warranty, you must complete and mail to Yanmar the enclosed warranty registration card or submit an online Warranty Registration via the Yanmar Marine website at www.yanmarmarine.com.

This Limited Warranty applies only to Yanmar Marine products and other products manufactured and sold by YANMAR or its authorized distributors. YANMAR specifically disclaims any express or implied warranties for products manufactured by other companies.

If a claimed defect appears to be within the Limited Warranty Period and if the applicable warranty registration has been received by YANMAR, YANMAR may elect to replace or repair any Yanmar Marine Product or part at its option. YANMAR will undertake the repair or replacement without charge for parts or repair labor. Repair labor includes the reasonable cost of labor to remove and reinstall Yanmar Marine Products and non-Yanmar engine components of the vessel in which the Yanmar engine is installed, if necessary to complete the warranty repair or replacement. Recognize that marine diesel Yanmar engines and drives are sophisticated, complex pieces of machinery which can be affected by many variables associated with any given application, and as such, you understand and agree that any repair may require multiple efforts to reach a remedy and that those efforts may require significant time.

Limited Warranty PeriodThis Limited Warranty applies to YANMAR Marine Products sold by YANMAR and delivered to the first retail purchaser on or after July 1, 2004. This Limited Warranty begins on the date of delivery to the original purchaser. In the event the boat containing Yanmar Marine Product(s) is being used as a demonstrator for sale or displayed in boat shows, the Limited Warranty begins when the Yanmar Marine Product attains one hundred (100) hours of use. When requesting warranty service, you must provide proof of the date of delivery. YANMAR will accept a fully completed and signed Delivery Report or a printout from an Internet registration that was completed within (30) days of delivery as proof of the date of delivery.



Unless otherwise provided in writing by YANMAR, the Limited Warranty Period for Yanmar Marine Products is twenty-four (24) months or 2000 hours after date of delivery to the original purchaser or as previously stated, whichever occurs first. An Extended Limited Warranty applies solely to the following Yanmar engine components: cylinder block casting, cylinder head casting, crankshaft forging, camshaft forging, flywheel housing, timing gear case, timing gears and connecting rod forging. These specific parts are warranted against defects in material and workmanship for sixty (60) months or 3000 hours after date of delivery to the original purchaser. This Extended Limited Warranty runs concurrent with the standard Limited Warranty period. Any Yanmar Marine Product or part repaired or replaced under warranty will assume the original Limited Warranty and the remaining Limited Warranty Period or ninety (90) days, whichever occurs last. Other Yanmar engine components that are subject to EPA regulations may have extended warranty periods as required by law. Please refer to your Operation Manual for further information.

COMMERCIAL USE: The Limited Warranty outlined in this Limited Warranty Handbook applies ONLY to Yanmar Marine Products being used solely for recreational purposes and not for any commercial application. For Yanmar Marine Products sold into or used in a Light Duty Commercial application please refer to the Yanmar Warranty Handbook - Light Duty Commercial Applications for any applicable warranty coverage.

Warranty ProceduresIf you believe that a YANMAR Marine Product you purchased fails to perform within applicable specifications or is defective in its materials or workmanship, you must contact an authorized YANMAR distributor or dealer within (30) days of discovering the problem. Your authorized YANMAR distributor or dealer will give you the name, address and telephone number of the service facility where you should take your YANMAR Marine Product(s) for inspection and / or repair. You are responsible for transporting your YANMAR Marine Product(s) to and from the designated service facility. However, your YANMAR distributor or dealer may arrange for the necessary inspection and / or repair to be made on-site, at YANMAR’s sole discretion.

Non-conforming or defective items must be held for inspection by YANMAR or an authorized YANMAR distributor or dealer and, if requested, returned to the Yanmar Marine Regional Headquarters for your area. Any item replaced under this Warranty becomes the property of YANMAR.



THE FOREGOING IS YANMAR’S ONLY OBLIGATION TO YOU AND YOUR EXCLUSIVE REMEDY FOR BREACH OF WARRANTY. FAILURE TO FOLLOW ALL REQUIREMENTS FOR SUBMITTING A CLAIM SHALL WAIVE ALL CLAIMS FOR DAMAGES AND OTHER RELIEF. IN NO EVENT SHALL YANMAR OR ANY AUTHORIZED YANMAR DISTRIBUTOR OR DEALER BE LIABLE FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHICH DAMAGES ENCOMPASS WITHOUT LIMITATION, LOSS OF PROFITS, HAUL-OUT FEES, LAUNCH, TOWING, STORAGE, SLIP FEES, INSURANCE COVERAGE, LOAN PAYMENT, TRANSPORTATION FEES, TELEPHONE CHARGES AND MILEAGE. THE LIMITATIONS IN THIS LIMITED WARRANTY APPLY REGARDLESS OF WHETHER YOUR CLAIMS ARE BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR ANY OTHER THEORY. ANY ACTION ARISING HEREUNDER MUST BE BROUGHT WITHIN (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OR IT SHALL BE BARRED. SOME STATES AND COUNTRIES DO NOT ALLOW CERTAIN LIMITATIONS ON WARRANTIES OR FOR BREACH OF WARRANTIES. LIMITATIONS SET FORTH IN THIS PARAGRAPH SHALL NOT APPLY TO THE EXTENT THAT THEY ARE PROHIBITED BY LAW.

Purchaser’s ResponsibilityThe Purchaser must do the following in order to seek coverage under this Limited Warranty:

• Perform and pay for all regular maintenance in compliance with the time frames specified in the applicable Operation Manual; and

• Maintain records of all service and maintenance performed on the YANMAR Marine Products.

Items Excluded from WarrantyIn addition to the other conditions and limitations set forth in the Limited Warranty, the following items are specifically excluded from any coverage under this Limited Warranty:

• Ordinary wear and tear;

• Cost associated with consumable parts;

• Any YANMAR Marine Product, accessory or part that has been, in YANMAR’s sole judgment, subject to negligence, misuse, accident, improper installation, water intrusion from the exhaust system, improper maintenance, racing or engaging in a contest of speed or endurance, use of non-approved attachments or non-genuine parts, submersion or unreasonable exposure to the environment or serviced by an unauthorized facility;

• Cost of transporting the YANMAR Marine Product, part or the vessel in which such YANMAR Marine Product(s) are installed to and from the service facility designated by YANMAR for warranty repair;

• Consequence of any modification or alteration of a YANMAR Marine Product part from which the serial number has been removed, altered or otherwise tampered with;



• Consequence of any modification or alteration of, or tampering with, a YANMAR engine part identified in the EPA Warranty statement located in the YANMAR Engine Operation Manual;

• Consequence of any modification or alteration of any YANMAR Marine Product, accessory, or part which had an hourmeter or hourmeter’s seal removed, or otherwise tampered with; and

• Consequence of any modification, alteration or removal of, or tampering with, the fuel injection pump high idle adjustment, fuel limits adjustments and/or fuel injection pump seals.

Warranty ModificationsExcept as modified in writing signed by the parties, this Limited Warranty is and shall remain the complete and exclusive agreement between the parties with respect to warranties, superseding all prior agreements, written and oral, and all other communications between the parties relating to warranties. NO PERSON OR ENTITY IS AUTHORIZED TO GIVE ANY OTHER WARRANTY OR TO ASSUME ANY OTHER OBLIGATION ON BEHALF OF YANMAR, EITHER ORALLY OR IN WRITING. Neither original equipment manufacturers, boat builders, YANMAR Marine Product installers, engine or equipment distributors, YANMAR Marine Product or equipment distributors, nor any other person or entity has any authority to make any representation or promise on behalf of YANMAR or to modify the terms or limitations of this Limited Warranty in any way.

Definition of a Light Duty Commercial ApplicationAny engine used in a revenue producing, government service or rental use is considered a non-recreational craft application and is not covered by the Yanmar Recreational Limited Warranty policy. Rental use is defined as a vessel used for pleasure charter, typically sailboats, sailing catamarans, power catamarans and trawlers. For an engine to be considered for a Light Duty Commercial application it must fall within the following guidelines:

• Engine is operated at maximum output for less than 5% of total operation hours.

• Standard operation is at less than 90% of the maximum output RPM.

• Wide open throttle RPM’s, under load, must reach rated speed in any operating condition.



• Load Factor must not exceed 35%.

• Annual operation hours must not exceed 1000 hours.

• An approved application must be on file with the Yanmar Regional Headquarters.

Limited Warranty PeriodThis Limited Warranty applies to YANMAR Marine Products sold by YANMAR and delivered to the first retail purchaser on or after July 1, 2004. IN NO EVENT SHALL YANMAR OR ANY AUTHORIZED YANMAR DISTRIBUTOR OR DEALER BE LIABLE FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHICH DAMAGES ENCOMPASS WITHOUT LIMITATION, LOSS OF PROFITS, HAUL-OUT FEES, LAUNCH, TOWING, STORAGE, SLIP FEES, INSURANCE COVERAGE, LOAN PAYMENT, TRANSPORTATION FEES, TELEPHONE CHARGES AND MILEAGE. THE LIMITATIONS IN THIS LIMITED WARRANTY APPLY REGARDLESS OF WHETHER YOUR CLAIMS ARE BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR ANY OTHER THEORY. ANY ACTION ARISING HEREUNDER MUST BE BROUGHT WITHIN (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OR IT SHALL BE BARRED. SOME STATES AND COUNTRIES DO NOT ALLOW CERTAIN LIMITATIONS ON WARRANTIES OR FOR BREACH OF WARRANTIES. LIMITATIONS SET FORTH IN THIS PARAGRAPH SHALL NOT APPLY TO THE EXTENT THAT THEY ARE PROHIBITED BY LAW.

Purchaser’s ResponsibilityThe Purchaser must do the following in order to seek coverage under this Limited Warranty:

• Perform and pay for all regular maintenance in compliance with the time frames specified in the applicable Operation Manual; and

• Maintain records of all service and maintenance performed on the YANMAR Marine Products.



Items Excluded from WarrantyIn addition to the other conditions and limitations set forth in the Limited Warranty, the following items are specifically excluded from any coverage under this Limited Warranty:

• Ordinary wear and tear;

• Cost associated with consumable parts;

• Any YANMAR Marine Product, accessory or part that has been, in YANMAR’s sole judgment, subject to negligence, misuse, accident, improper installation, water intrusion from the exhaust system, improper maintenance, racing or engaging in a contest of speed or endurance, use of non-approved attachments or non-genuine parts, submersion or unreasonable exposure to the environment or serviced by an unauthorized facility;

• Cost of transporting the YANMAR Marine Product, part or the vessel in which such YANMAR Marine Product(s) are installed to and from the service facility designated by YANMAR for warranty repair;

• Consequence of any modification or alteration of a YANMAR Marine Product part from which the serial number has been removed, altered or otherwise tampered with;

• Consequence of any modification or alteration of, or tampering with, a YANMAR engine part identified in the EPA Warranty statement located in the YANMAR Engine Operation Manual;

• Consequence of any modification or alteration of any YANMAR Marine Product, accessory, or part which had an hourmeter or hourmeter’s seal removed, or otherwise tampered with; and

• Consequence of any modification, alteration or removal of, or tampering with, the fuel injection pump high idle adjustment, fuel limits adjustments and/or fuel injection pump seals.

Warranty ModificationsExcept as modified in writing signed by the parties, this Limited Warranty is and shall remain the complete and exclusive agreement between the parties with respect to warranties, superseding all prior agreements, written and oral, and all other communications between the parties relating to warranties. NO PERSON OR ENTITY IS AUTHORIZED TO GIVE ANY OTHER WARRANTY OR TO ASSUME ANY OTHER OBLIGATION ON BEHALF OF YANMAR, EITHER ORALLY OR IN WRITING. Neither original equipment manufacturers, boat builders, YANMAR Marine Product installers, engine or equipment distributors, YANMAR Marine Product or equipment distributors, nor any other person or entity has any authority to make any representation or promise on behalf of YANMAR or to modify the terms or limitations of this Limited Warranty in any way.

YANMAR garantiza que al momento del envío, los Productos YANMAR Marine nuevos, vendidos en forma directa y a través de distribuidores autorizados de productos YANMAR Marine, cumplen con todas las especificaciones correspondientes y se encuentran libres de defectos en sus materiales y mano de obra durante el Plazo de Garantía Limitada. La presente Garantía está sujeta a restricciones que se detallarán en el cuerpo de este Manual de Garantía.

ESTA GARANTÍA LIMITADA SE OTORGA EN SUBSTITUCIÓN DE CUALQUIER OTRA, YA SEA EXPRESA O IMPLÍCITA. YANMAR DENIEGA ESPECÍFICAMENTE TODA GARANTÍA IMPLÍCITA DE IDONEIDAD PARA UN USO EN PARTICULAR O PARA COMERCIALIZACIÓN, EXCEPTO EN LOS CASOS EN QUE DICHA LIMITACIÓN ESTÉ PROHIBIDA POR LA LEY. GARANTÍA LIMITADA YANMARYANMAR garantiza al comprador minorista original realizar cualquier reparación o reemplazo que resulten necesarios para la corrección de defectos en los materiales y/o la mano de obra de los Productos YANMAR Marine durante el Plazo de la Garantía Limitada. Esta Garantía Limitada le otorga ciertos derechos legales. Usted puede tener otros derechos que varían en los diferentes estados y países. Esta Garantía Limitada cubre los Productos YANMAR Marine en todos los países que cuenten con servicio aprobado Yanmar.


MANUAL DE GARANTÍA LIMITADA - Fines Recreativos
El resto de esta Garantía puede ser transferible a un segundo comprador minorista, siempre y cuando se notifique a YANMAR por escrito en el momento en que el segundo comprador entre en posesión del bien. En ese momento YANMAR puede, a su elección, solicitar una inspección de cualquiera de los Productos YANMAR Marine a cargo de un centro de servicio autorizado YANMAR. Si alguno de los Productos YANMAR Marine no aprobara esta inspección, YANMAR puede rechazar la transferencia de la Garantía. El comprador se hará cargo del costo de la inspección. La transferencia de la Garantía no extenderá su periodo de validez normal. YANMAR deniega específicamente toda garantía expresa o implícita otorgada al segundo comprador minorista, a excepción de lo provisto en la presente, y deniega toda garantía, expresa o implícita, que se otorgue a cualquier comprador subsiguiente.
Restricciones

IMPORTANTE:Para poder validar su Garantía Yanmar, debe completar y devolver por correo la tarjeta de registro de garantía adjunta o completar el registro en línea de la Garantía en el sitio Web de Yanmar Marine en www.yanmarmarine.com.

Esta Garantía Limitada es válida únicamente para los productos Yanmar Marine y otros productos fabricados y comercializados por YANMAR o sus distribuidores autorizados. YANMAR deniega específicamente toda garantía expresa o implícita de productos fabricados por otras empresas.

En caso de presentarse un defecto durante el Plazo de Garantía, y siempre que la Garantía haya sido debidamente registrada, YANMAR puede elegir, a su entera discreción, reemplazar o reparar cualquier pieza o Producto Yanmar Marine. YANMAR realizará la reparación o reemplazo sin cargo alguno por las piezas o la mano de obra de la reparación. En caso de ser necesario y para el debido cumplimiento de la garantía de reparación o reemplazo, la mano de obra cubierta incluye el costo razonable de la mano de obra requerida para retirar y reinstalar Productos Yanmar Marine y componentes del motor de la nave que no sean Yanmar en los que se encuentre instalado el motor. El propietario final deberá estar consciente de que los motores y las transmisiones Yanmar son partes de una maquinaria muy sofisticada y compleja que puede verse afectada por diversas variables relacionadas con cualquier función y, en consecuencia, el propietario final entiende y está de acuerdo en que cualquier reparación podría requerir de múltiples esfuerzos para lograr una solución y que éstos pueden implicar una importante cantidad de tiempo.

Plazo de la Garantía LimitadaEsta Garantía es válida para los Productos YANMAR Marine vendidos por YANMAR y se otorga al primer comprador minorista a partir o después del 1ero de julio de 2004. Esta Garantía entra en vigencia el día de la entrega al comprador original. En caso de que la embarcación con Productos Yanmar Marine se utilice como demostración para su venta o participe en exhibiciones de barcos, la Garantía Limitada entra en vigencia cuando el Producto Yanmar Marine alcance las cien (100) horas de uso. Al solicitar un servicio cubierto por la garantía, el propietario deberá proporcionar un comprobante de la fecha en que le fue entregado el equipo. YANMAR aceptará un Reporte de Entrega debidamente completado y firmado o bien un comprobante impreso del registro de la garantía a través de Internet obtenido dentro de los treinta (30) días posteriores a la entrega del equipo.




A menos que YANMAR exprese lo contrario por escrito, el plazo de garantía para los Productos Yanmar Marine es de veinticuatro (24) meses o 2000 horas posteriores a la fecha de entrega al comprador original o según se haya establecido con anterioridad, lo que suceda primero. Una Garantía Limitada Extendida se aplica exclusivamente a los siguientes componentes de motor de Yanmar: pieza fundida del bloque de cilindros, pieza fundida de la cabeza de cilindros, forjadura del cigüeñal, árbol de levas, cárter del volante, caja del engranaje de distribución, engranajes de distribución y bielas. Estas partes específicas están garantizadas contra defectos en el material y la mano de obra durante sesenta (60) meses o 3000 horas después de la fecha de entrega al comprador original. Esta Garantía Extendida rige simultáneamente con el período de la Garantía estándar. Todo Producto Yanmar Marine o pieza que se repare o reemplace bajo la garantía, quedará cubierto por la Garantía original y por el Plazo restante de la Garantía o noventa (90) días, lo que suceda último. Otros componentes Yanmar del motor que estén sujetos a las normas de la Agencia de Protección del Medio Ambiente (EPA, por sus siglas en inglés) pueden contar con plazos de garantía más largos, según lo establezca la ley. USO COMERCIAL: La Garantía Limitada descrita en este manual se aplica SÓLO a aquellos Productos Yanmar Marine que se utilicen exclusivamente con fines recreativos y no con fines comerciales. En el caso de Productos Yanmar Marine que se venden o utilizan con usos de Trabajo Liviano Comercial, consulte el Manual de Garantía Yanmar - Usos de Trabajo Liviano Comercial para encontrar la cobertura correspondiente de la garantía.

Procedimientos de la GarantíaSi considera que algún Producto YANMAR Marine que adquirió no funciona conforme a las especificaciones correspondientes, o que sus materiales o fabricación son defectuosos, contacte a un distribuidor o concesionario YANMAR autorizado dentro de los treinta (30) días después de descubrir el problema. El distribuidor o concesionario autorizado YANMAR le proporcionará el nombre, domicilio y número telefónico del centro de servicio al que deberá llevar su(s) Producto(s) YANMAR Marine para inspección y/o reparación. Usted es el responsable del transporte del Producto YANMAR Marine hasta y desde el centro de servicio asignado. No obstante, su distribuidor o concesionario YANMAR puede hacer los arreglos necesarios para que la inspección y/o reparación requerida se realicen en el lugar donde se encuentre el equipo en cuestión; esto último queda a la total discreción de YANMAR.

Los elementos que no cumplan con las especificaciones o que tengan defectos quedan sujetos para su inspección por parte de YANMAR o por un distribuidor o concesionario autorizado de YANMAR y, si así fuera requerido, deberá ser devuelto al Centro Regional Yanmar Marine de su localidad. Cualquier elemento que sea reemplazado bajo esta Garantía se convierte en propiedad de YANMAR.




LO ANTERIORMENTE EXPUESTO CONSTITUYE LA ÚNICA OBLIGACIÓN DE YANMAR PARA CON USTED Y SU ÚNICO RECURSO EN CASO DE INCUMPLIMIENTO DE LA GARANTÍA. ANTE EL INCUMPLIMIENTO DE LOS REQUISITOS PARA PRESENTAR UN RECLAMO DE GARANTÍA, SE ANULARÁN TODOS LOS RECLAMOS POSTERIORES POR DAÑOS Y REDENCIONES. EN NINGÚN CASO SERÁN RESPONSABILIDAD DE YANMAR O DE CUALQUIERA DE SUS DISTRIBUIDORES O CONCESIONARIOS AUTORIZADOS LOS DAÑOS FORTUITOS, ESPECIALES O RESULTANTES QUE PUDIERAN PRODUCIRSE, LOS CUALES INCLUYEN SIN LIMITACIÓN ALGUNA, PÉRDIDA DE GANANCIAS, GASTOS DE TRANSPORTE FUERA DE Y HACIA EL AGUA, REMOLQUE, ALMACENAMIENTO, CUOTAS DE AMARRE, COBERTURA DE SEGUROS, PAGO DE PRÉSTAMOS, CUOTAS POR TRANSPORTE, CARGOS TELEFÓNICOS Y DISTANCIA RECORRIDA. LAS RESTRICCIONES DE ESTA GARANTÍA LIMITADA SON VÁLIDAS INDEPENDIENTEMENTE DE SI SUS RECLAMACIONES SE ENCUENTRAN FUNDAMENTADAS EN EL INCUMPLIMIENTO DEL CONTRATO, DAÑOS Y PERJUICIOS (INCLUYENDO NEGLIGENCIA Y RESPONSABILIDAD ABSOLUTA) O CUALQUIER OTRA HIPÓTESIS. CUALQUIER ACCIÓN LEGAL QUE SURJA DE LO ESTIPULADO DEBERÁ PRESENTARSE EN UN PLAZO NO MAYOR A UN (1) AÑO A PARTIR DE QUE OCURRA EL MOTIVO DE DICHA ACCIÓN, INVALIDANDO POR ELLO CUALQUIER ACCIÓN INTENTADA FUERA DE TÉRMINO. CIERTAS RESTRICCIONES EN LAS GARANTÍAS O LOS REQUISITOS DESCRITOS PARA EL INCUMPLIMIENTO DE GARANTÍAS NO ESTÁN PERMITIDAS EN ALGUNOS ESTADOS Y PAÍSES. LAS LIMITACIONES ESTABLECIDAS EN ESTE PÁRRAFO NO APLICARÁN EN LOS LUGARES EN QUE ESTÉN PROHIBIDAS POR LA LEY.

Responsabilidades del CompradorEl Usuario deberá seguir las siguientes instrucciones para obtener la cobertura de la Garantía Limitada:

• Realice y pague un mantenimiento normal de acuerdo con los períodos programados que se especifican en el Manual de Operaciones pertinente; y

• Conserve la documentación de todas las reparaciones y servicios de mantenimiento realizados a los productos de YANMAR Marine.

Artículos no incluidos en la GarantíaAdemás de las otras condiciones y limitaciones indicadas en la Garantía Limitada, los siguientes artículos están excluidos de la cobertura de esta Garantía Limitada:

• El desgaste por el uso normal;

• Los costos relacionados a partes de consumo;

• Todo Producto YANMAR Marine, accesorio o pieza que, a juicio de YANMAR, haya sido sometido a descuido, uso incorrecto, accidentes, instalación incorrecta, entrada de agua por el sistema de escape, mantenimiento incorrecto, concursos o carreras de velocidad o resistencia, uso de aditamentos no autorizados o piezas no originales, exposición excesiva al medio ambiente o que se le haya dado servicio en un centro no autorizado;

• El costo del transporte del Producto YANMAR Marine, la pieza o la nave en que esté instalado el Producto YANMAR Marine hasta y desde el centro de servicio asignado por YANMAR para su reparación bajo garantía;

• Lo resultante de cualquier modificación o alteración de un Producto YANMAR Marine al que se le haya quitado, alterado o de alguna forma manipulado el número de serie;


• Lo resultante de cualquier modificación, alteración o violación de una de las partes del motor identificada en la declaración de Garantía de la EPA que se encuentre en el Manual de Uso del motor YANMAR;

• Lo resultante de cualquier modificación o alteración de cualquier Producto YANMAR Marine, accesorio o pieza equipada con un contador horario o la extracción o manipulación del contador horario;

• Lo resultante de cualquier modificación, alteración, extracción o manipulación del ajuste de la bomba de inyección de combustible, de los ajustes del límite de combustible y/o de los sellos de la bomba de inyección de combustible.

Modificaciones de la GarantíaExcepto cuando se modifique por escrito y se firme por ambas partes, esta Garantía Limitada es y permanecerá como el contrato de garantías completo y exclusivo entre las partes, sustituyendo e invalidando a todo contrato previo celebrado por escrito o verbalmente y cualquier otro tipo de comunicación referente a las garantías entre las partes. NIGUNA OTRA PERSONA O ENTIDAD ESTÁ AUTORIZADA A OTORGAR OTRA GARANTÍA, VERBAL O POR ESCRITO, O ASUMIR CUALQUIER OTRA OBLIGACIÓN, VERBAL O POR ESCRITO EN REPRESENTACIÓN DE YANMAR. Ningún otro fabricante de equipos originales, constructores de botes, instaladores de Productos YANMAR Marine, distribuidores de motores o equipos, distribuidores de Productos YANMAR Marine o equipos ni ninguna otra persona o entidad tienen facultad alguna para hacer declaraciones o promesas en nombre o en representación de YANMAR o de modificar los términos y limitaciones de esta Garantía.

(en lo sucesivo, “YANMAR”) proporciona este Manual de Garantía Limitada para ayudarle a beneficiarse al máximo del motor YANMAR, el equipo naval YANMAR de KANZAKI, el equipo naval YANMAR SAIL DRIVE y/o los sistemas de Control Yanmar (en lo sucesivo, los “Producto(s) YANMAR Marine”) que ha adquirido. Antes de instalar o utilizar su(s) Producto(s) YANMAR Marine, lea detenidamente este manual y los Manuales de uso correspondientes. Si no recibió un Manual de uso, contacte a su distribuidor o concesionario YANMAR para solicitar una copia.

YANMAR garantiza que al momento del envío, los Productos YANMAR Marine nuevos, vendidos en forma directa y a través de distribuidores autorizados de productos YANMAR Marine, cumplen con todas las especificaciones correspondientes y no poseen defectos en sus materiales y mano de obra durante el Plazo de la Garantía Limitada. La presente Garantía Limitada está sujeta a restricciones que se detallarán en el cuerpo del presente Manual de garantía.

LA PRESENTE GARANTÍA LIMITADA REEMPLAZA A CUALQUIER OTRA, YA SEA EXPRESA O IMPLÍCITA. YANMAR ESPECÍFICAMENTE QUEDA EXENTA DE OTORGAR CUALQUIER GARANTÍA IMPLÍCITA DE IDONEIDAD PARA UN USO PARTICULAR O COMERCIALIZACIÓN, SALVO DISPOSICIÓN LEGAL EN CONTRARIO. EN EL CASO DE QUE DICHA EXENCIÓN ESTÉ PROHIBIDA POR LA LEY, LA DURACIÓN DE LAS GARANTÍAS IMPLÍCITAS SE LIMITARÁ AL PLAZO CUBIERTO POR LA GARANTÍA EXPRESA.

GARANTÍA LIMITADA YANMARYANMAR garantiza al comprador minorista original realizar cualquier reparación o reemplazo que resulten necesarios para la corrección de defectos en los materiales o de mano de obra en los Productos YANMAR Marine durante el Plazo de la Garantía Limitada. La presente Garantía Limitada otorga ciertos derechos. Puede tener otros derechos que varían en los diferentes estados y países. La presente Garantía Limitada cubre los Productos YANMAR Marine en todos los países que cuenten con servicio aprobado Yanmar.


MANUAL SOBRE GARANTÍAS LIMITADAS: Usos comerciales en trabajos livianos

El resto de la presente Garantía Limitada puede cederse a un segundo comprador minorista, siempre y cuando se notifique a YANMAR por escrito en el momento en que el segundo comprador adquiera efectivamente el bien. En ese momento, YANMAR puede, a su elección, solicitar una inspección de cualquiera de los Productos YANMAR Marine, realizada por un centro de servicio autorizado YANMAR. Si alguno de los Productos YANMAR Marine no aprobara esta inspección, YANMAR puede rechazar la cesión de la Garantía Limitada. El comprador se hará cargo del costo de la inspección. La cesión de la Garantía Limitada no prorrogará su plazo. YANMAR queda específicamente exenta de otorgar cualquier garantía, expresa o implícita, al segundo comprador minorista, salvo disposición en contrario en el presente documento, y queda exenta, asimismo, de otorgar cualquier garantía, expresa o implícita, a cualquier comprador posterior.

Restricciones

IMPORTANTE:

Para poder validar su Garantía Limitada de Yanmar Marine, debe completar y enviar por correo a Yanmar la tarjeta de registro de garantía adjunta o completar el registro en línea de la Garantía en el sitio Web de Yanmar Marine en www.yanmarmarine.com.

La presente Garantía Limitada es válida únicamente para los productos Yanmar Marine y otros productos fabricados y comercializados por YANMAR o sus distribuidores autorizados. YANMAR queda exenta específicamente de otorgar cualquier garantía, expresa o implícita, de productos fabricados por otras empresas.

En caso de ser necesario y para el debido cumplimiento de la garantía de reparación o reemplazo, la mano de obra cubierta incluye el costo razonable de la mano de obra requerida para retirar y volver a instalar los Productos Yanmar Marine y los componentes del motor de la nave que no sean Yanmar en los que se encuentre instalado el motor. El propietario final deberá saber que los motores y equipos Yanmar forman parte de una maquinaria muy sofisticada y compleja que puede verse afectada por diversas variables relacionadas con cualquier función y, en consecuencia, el propietario final entiende y acepta que cualquier reparación podría requerir múltiples esfuerzos para lograr una solución y que éstos pueden insumir bastante tiempo.

Definición de uso comercial para trabajos livianosTodo motor utilizado para la producción de ingresos, servicios gubernamentales o arrendamiento se considera un uso náutico sin fines recreativos y no lo cubre la póliza de Garantía Limitada para los fines recreativos de Yanmar. Por arrendamiento se entiende una nave utilizada para fletamentos como embarcación de recreo, generalmente veleros, catamaranes a vela, catamaranes a motor y pesqueros de arrastre. Para considerar que un equipo tiene un uso comercial para trabajo liviano debe cumplir con las siguientes pautas:

• El equipo debe operar en sus niveles máximos durante un horario menor al 5% del horario completo de funcionamiento.

• El funcionamiento normal debe ser menor al 90% del nivel máximo de RPM.

• Siempre que se encuentre en funcionamiento, la aceleración máxima con carga debe alcanzar la velocidad estipulada.



• El factor de carga no debe exceder el 35%.

• La cantidad de horas de funcionamiento por año no debe ser mayor a 1000.

• Una solicitud aprobada debe obrar en los registros de las oficinas locales de Yanmar.

Plazo de la Garantía LimitadaLa presente Garantía Limitada es válida para los Productos YANMAR Marine vendidos por YANMAR y se otorga al primer comprador minorista a partir del 1 de julio de 2004. La presente Garantía Limitada entra en vigencia el día de la entrega al comprador original. En caso de que la embarcación con Productos Yanmar Marine se utilice como demostración para su venta o participe en exhibiciones de barcos, la Garantía Limitada entra en vigencia cuando el Producto Yanmar Marine alcance las 100 (cien) horas de uso. Al solicitar un servicio cubierto por la garantía, el propietario deberá proporcionar un comprobante de la fecha en que le fue entregado el equipo. YANMAR aceptará un Informe de entrega debidamente completado y firmado, o bien, un comprobante impreso del registro de la garantía a través de Internet obtenido dentro de los 30 (treinta) días posteriores a la entrega del equipo.

Salvo expresión en contrario por escrito de YANMAR, el plazo de Garantía Limitada en usos comerciales para trabajo liviano (LDC, por sus siglas en inglés) de los Productos Yanmar Marine será de (consulte la tabla a continuación):

Todo Producto YANMAR Marine o pieza que se repare o reemplace durante el plazo de la garantía, quedará cubierto por la Garantía Limitada original y por el Plazo restante de la Garantía Limitada o 90 (noventa) días, lo que ocurra después. Procedimientos de la garantíaSi considera que algún Producto YANMAR Marine que adquirió no funciona conforme a las especificaciones correspondientes, o que sus materiales o fabricación son defectuosos, contacte a un distribuidor o concesionario YANMAR autorizado dentro de los 30 (treinta) días posteriores a la detección del problema. El distribuidor o concesionario autorizado YANMAR le proporcionará el nombre, domicilio y número telefónico del centro de servicio al que deberá llevar su(s) Producto(s) YANMAR Marine para inspección o reparación. El propietario debe transportar el Producto YANMAR Marine hasta y desde el centro de servicio asignado. No obstante, su distribuidor o concesionario YANMAR puede hacer los arreglos necesarios para que la inspección y/o reparación requerida se realice en el lugar donde se encuentre el equipo en cuestión; esto último queda a total criterio de YANMAR.

Los elementos que no cumplan con las especificaciones o que tengan defectos quedan sujetos a inspección por parte de YANMAR o de un distribuidor o concesionario autorizado de YANMAR y, si así fuera requerido, deberá ser devuelto al Centro regional Yanmar Marine de su localidad. Cualquier elemento reemplazado en virtud de la presente Garantía se convierte en propiedad de YANMAR.

LO ANTERIORMENTE EXPUESTO CONSTITUYE LA ÚNICA OBLIGACIÓN DE YANMAR PARA CON EL PROPIETARIO Y SU ÚNICO RECURSO EN CASO DE INCUMPLIMIENTO DE LA GARANTÍA. EL INCUMPLIMIENTO DE LOS REQUISITOS PARA PRESENTAR UN RECLAMO DE GARANTÍA ANULARÁ TODOS LOS RECLAMOS POSTERIORES POR DAÑOS Y PERJUICIOS Y DEMÁS RESARCIMIENTOS. EN NINGÚN CASO SERÁN RESPONSABILIDAD DE YANMAR NI DE CUALQUIERA DE SUS DISTRIBUIDORES O CONCESIONARIOS AUTORIZADOS LOS DAÑOS FORTUITOS, ESPECIALES O EMERGENTES QUE PUDIERAN PRODUCIRSE, LOS CUALES INCLUYEN, ENTRE OTROS, LUCRO CESANTE, GASTOS DE TRANSPORTE MARÍTIMO, REMOLQUE, ALMACENAMIENTO, CUOTAS DE AMARRE, COBERTURA DE SEGUROS, PAGO DE PRÉSTAMOS, CUOTAS POR TRANSPORTE, CARGOS TELEFÓNICOS Y DISTANCIA RECORRIDA. LAS RESTRICCIONES DE LA PRESENTE GARANTÍA LIMITADA SON VÁLIDAS INDEPENDIENTEMENTE DE QUE LAS RECLAMACIONES SE ENCUENTREN FUNDAMENTADAS EN EL INCUMPLIMIENTO DEL CONTRATO, DAÑOS Y PERJUICIOS (INCLUSO NEGLIGENCIA Y RESPONSABILIDAD ABSOLUTA) O CUALQUIER OTRA HIPÓTESIS. CUALQUIER ACCIÓN LEGAL QUE SURJA DE LO ESTIPULADO DEBERÁ PRESENTARSE EN UN PLAZO MÁXIMO DE 1 (UN) AÑO A PARTIR DE QUE OCURRA EL MOTIVO DE DICHA ACCIÓN, O ÉSTA PRESCRIBIRÁ. CIERTAS RESTRICCIONES EN LAS GARANTÍAS O LOS REQUISITOS DESCRITOS POR INCUMPLIMIENTO DE GARANTÍAS NO ESTÁN PERMITIDAS EN ALGUNOS ESTADOS Y PAÍSES. LAS LIMITACIONES ESTABLECIDAS EN ESTE PÁRRAFO NO REGIRÁN CUANDO ESTÉN PROHIBIDAS POR LEY.

Responsabilidad del compradorEl comprador deberá adoptar las siguientes medidas a fin de obtener la cobertura de la presente Garantía Limitada:

• Realizar un mantenimiento a su cargo de manera periódica dentro de los plazos especificados en el Manual de uso correspondiente; y

• Llevar un registro de los servicios y mantenimientos realizados a los Productos YANMAR Marine.



Aspectos no incluidos en la GarantíaAdemás de las restantes condiciones y restricciones establecidas en la Garantía Limitada, los siguientes aspectos se excluyen de la presente Garantía Limitada:

• El desgaste por el uso normal;

• Los costos relacionados a partes de consumo;

• Todo Producto YANMAR Marine, accesorio o pieza que, a juicio de YANMAR, haya sido sometido a negligencia, uso incorrecto, accidentes, instalación incorrecta, filtración de agua por el sistema de escape, mantenimiento incorrecto, concursos o carreras de velocidad o resistencia, uso de accesorios no autorizados o piezas no legítimas, inmersión en agua o exposición excesiva a condiciones climáticas adversas o que se lo haya reparado en un centro no autorizado;

• El costo del transporte del Producto YANMAR Marine, la pieza o la nave en que esté instalado el/los Producto(s) Yanmar Marine hasta y desde el centro de servicio asignado por YANMAR para su reparación durante el plazo cubierto por la garantía;

• Lo resultante de cualquier modificación o alteración de un Producto YANMAR Marine al que se le haya retirado, modificado o de alguna forma manipulado el número de serie;

• Lo resultante de cualquier modificación, alteración o intrusión en una de las partes del motor identificada en la declaración de Garantía de la EPA que se encuentre en el Manual de uso del motor YANMAR;

• Lo resultante de cualquier modificación o alteración de cualquier Producto YANMAR Marine, accesorio o pieza equipada con un contador horario o la extracción o manipulación del contador horario; y

• Lo resultante de cualquier modificación, alteración, extracción o manipulación del ajuste de la bomba de inyección de combustible, de los ajustes del límite de combustible o de los sellos de la bomba de inyección de combustible.

Modificaciones de la garantíaExcepto cuando se modifique por escrito y se firme por ambas partes, la presente Garantía Limitada representa y permanece como la totalidad del contrato de garantía completo y exclusivo entre las partes. Asimismo, prevalecerá respecto de todo contrato previo celebrado por escrito o verbalmente y cualquier otro tipo de comunicación referente a las garantías entre las partes. NINGUNA OTRA PERSONA O ENTIDAD ESTÁ AUTORIZADA A OTORGAR OTRA GARANTÍA, VERBAL O POR ESCRITO, NI ASUMIR CUALQUIER OTRA OBLIGACIÓN, VERBAL O POR ESCRITO EN REPRESENTACIÓN DE YANMAR. Ningún otro fabricante de equipos originales, constructores de botes, instaladores de Productos YANMAR Marine, distribuidores de motores o equipos, distribuidores de Productos YANMAR Marine o equipos ni ninguna otra persona o entidad tienen facultad alguna para realizar declaraciones o comprometerse en nombre y representación de YANMAR ni de modificar los términos y limitaciones de la presente Garantía Limitada.

COUVERTURE DE LA GARANTIE LIMITÉE

Yanmar Marine International B.V. (“YANMAR”) fournit le manuel de Garantie Limitée afin de vous aider à tirer le maximum du moteur YANMAR, de la transmission marine YANMAR par KANZAKI, de la transmission marine YANMAR SAIL DRIVE et/ou des systèmes de contrôle Yanmar (ci-après le(s) Produit(s) YANMAR Marine”) achetés. Veuillez lire attentivement et vous assurer de bien comprendre ce manuel d’installation et le(s) Mode(s) d’emploi applicable(s) avant d’installer ou d'utiliser le(s) produit(s) marins YANMAR. Si vous n’avez pas reçu de manuel d’utilisation, veuillez contacter votre distributeur ou revendeur YANMAR pour lui demander une copie.

YANMAR garantit qu’au moment de l’envoi, les nouveaux produits vendus par lui et par les distributeurs autorisés YANMAR Marine, satisfont à toutes les spécifications applicables et seront exempts de tout défaut de matériel et de fabrication pour la durée de la période de garantie limitée. Cette garantie limitée est soumise aux restrictions énoncées plus loin dans ce manuel de garantie.

CETTE GARANTIE LIMITÉE EST FOURNIE EN GUISE ET LIEU DE TOUTE AUTRE GARANTIE, EXPRESSE OU IMPLICITE. YANMAR RENONCE SPÉCIFIQUEMENT À TOUTE GARANTIE IMPLICITE DE CONFORMITÉ À UN EMPLOI OU À UNE QUALITÉ MARCHANDE SPÉCIFIQUE, DANS LES LIMITES AUTORISÉES PAR LA LOI. SI CETTE CLAUSE DE NON-RESPONSABILITÉ EST INTERDITE PAR LA LOI, LES GARANTIES IMPLICITES SERONT AINSI LIMITÉES À LA DURÉE DE LA COUVERTURE DE LA GARANTIE EXPRESSE.

GARANTIE LIMITÉE YANMARYANMAR garantit à l’acheteur qu’elle effectuera toutes les réparations ou remplacements nécessaires pour corriger tout défaut de matériel et/ou de fabrication des produits YANMAR Marine couvrant la période de la garantie limitée. Cette garantie limitée vous donne certains droits reconnus par la loi. Il se peut que vous ayez d’autres droits qui varient selon l’état, la province ou le pays. Cette garantie limitée protège les produits YANMAR Marine qui fonctionnent partout dans le monde où le service agréé par Yanmar est disponible.


MANUEL DE GARANTIE LIMITÉE - Applications Récréatives
Cette garantie limitée peut être transférée à un deuxième acheteur au détail à condition que l’acheteur initial avise YANMAR par écrit au moment où le deuxième acheteur en prend possession. À ce moment-là YANMAR peut, à son gré, requérir une inspection de tout produit YANMAR Marine par un centre de service YANMAR agréé. Si l’un des produits YANMAR Marine ne passe pas cette inspection avec succès, le transfert de cette garantie limitée peut être refusé. Le coût de l’inspection doit être assumé par l’acheteur. Le transfert de la garantie limitée ne prolongera pas la durée de sa couverture. YANMAR renonce spécifiquement à toute garantie expresse ou implicite s’appliquant au deuxième acheteur au détail à l’exception de celle fournie dans la présente, et renonce à toute garantie, expresse ou implicite, pour tout acheteur à venir.
Restrictions

IMPORTANT:

Afin de valider votre garantie limitée Yanmar Marine, vous devez compléter et poster à Yanmar la carte d’enregistrement de garantie jointe ou soumettre l’enregistrement de garantie en ligne sur le site Web de Yanmar Marine à www.yanmarmarine.com.

Cette garantie limitée ne s’applique qu’aux produits Yanmar Marine et aux autres produits fabriqués et vendus par YANMAR ou par ses distributeurs autorisés. YANMAR renonce spécifiquement à toute garantie expresse ou implicite pour tout produit fabriqué par d’autres compagnies.

Si une défectuosité déclarée est apparue durant la période de la garantie limitée et si l’enregistrement de garantie applicable a été reçu par YANMAR, YANMAR peut décider de remplacer ou de réparer tout produit Yanmar Marine à sa discrétion. YANMAR s’engagera à réparer ou à remplacer sans exiger de frais pour les pièces ou la main-d’oeuvre. Le temps de réparation inclut un coût de main d’œuvre raisonnable pour enlever et réinstaller les produits Yanmar Marine et tous les composants auxiliaires du bateau dans lesquels le moteur Yanmar est installé, si nécessaire, pour effectuer le remplacement ou la réparation sous la garantie. Il est important de savoir que les moteurs et propulseurs marins diesels sont des pièces d’équipement sophistiquées et complexes qui peuvent être affectées par de nombreuses variables associées à n’importe quelle application, et, à ce titre, vous comprenez et acceptez que toute réparation peut nécessiter des efforts multiples pour arriver à un remède et que ces efforts peuvent prendre un temps considérable.

Durée de la garantie limitéeCette garantie limitée s’applique aux produits YANMAR Marine vendus par YANMAR et délivrés à l’acheteur au détail initial le ou après le 1er juillet 2004. Cette garantie limitée commence à la date de délivrance par rapport à l’acheteur initial. Dans le cas où le bateau contenant le(s) produit(s) Yanmar Marine est utilisé comme démonstrateur de vente ou qu’il est présenté dans des expositions de bateaux, la garantie limitée commence lorsque le produit Yanmar Marine atteint cent (100) heures d’utilisation. Lorsque vous demandez un service sous la garantie, vous devez fournir la preuve de la date de délivrance du produit. YANMAR acceptera un rapport de délivrance ou une copie papier d’un enregistrement en ligne dûment rempli et signé qui a été rempli dans un délai de trente (30) jours après la délivrance comme preuve de la date de délivrance.


Sauf des dispositions contraires écrites par YANMAR, la durée de la garantie limitée pour les produits Yanmar Marine est de vingt-quatre (24) mois ou 2 000 heures après la date de délivrance à l’acheteur initial ou comme a été établi ci-dessus, ce qui arrive avant. La garantie limitée prolongée ne s’applique qu’aux composants du moteur Yanmar suivants : distribution du bloc-cylindres, distribution de la culasse, forgeage du vilebrequin, arbre à cames, carter de volant, carter de distribution, pignons de distribution et bielles. Ces pièces spécifiques sont garanties être exemptes de défaut matériel ou de main d’œuvre pour une période de soixante (60) mois ou 3 000 heures après la date de délivrance à l’acheteur initial. Cette garantie limitée prolongée est valide pour la même période que la garantie limitée standard. Toute réparation ou remplacement des pièces ou des produits Yanmar Marine sous la garantie sera effectué compte tenue de la garantie limitée originale et la protection de la garantie limitée restante ou la période de quatre-vingt-dix (90) jours, ce qui arrive après. D’autres composants du moteur qui sont sujets aux réglementations de l’Agence de Protection de l’Environnement (EPA) peuvent avoir des périodes de garantie qui sont prolongées selon la loi. Veuillez-vous référer à votre manuel d’utilisation pour de plus amples informations.
UTILISATION COMMERCIALE : La garantie limitée décrite dans ce livret de garantie limitée s’applique SEULEMENT aux produits Yanmar Marine utilisés seulement à des fins récréatives et n’ayant pas une utilisation commerciale. Procédures de garantieSi vous pensez que le produit YANMAR Marine que vous avez acheté ne fonctionne pas conformément aux spécifications applicables ou si son matériel ou sa fabrication est défectueux, vous devez contacter un distributeur ou un revendeur autorisé YANMAR dans les trente (30) jours après avoir découvert le problème. Votre distributeur ou revendeur autorisé YANMAR vous donnera le nom, l’adresse et le numéro de téléphone d’une installation de service ou vous pouvez faire inspecter et/ou réparer votre(vos) produit(s) YANMAR Marine. Vous êtes responsable de transporter votre(vos) produit(s) YANMAR Marine à partir de et vers l’installation de service désignée. Toutefois, votre distributeur ou revendeur autorisé YANMAR peut faire les arrangements nécessaires pour une inspection et/ou une réparation sur site, à la seule discrétion de YANMAR.

EN AUCUN CAS, YANMAR, TOUT AUTRE DISTRIBUTEUR OU REVENDEUR AUTORISÉ YANMAR NE SERA TENU RESPONSABLE POUR TOUT DOMMAGE CONSÉCUTIF, INDIRECT OU PARTICULIER ; DE TELS DOMMAGES COMPRENANT, SANS RESTRICTION, LA PERTE DE PROFITS, LES FRAIS DE HALAGE, LA MISE À L’EAU, LE REMORQUAGE, L’ENTREPOSAGE, LES FRAIS DE CARÉNAGE, LA COUVERTURE DE L’ASSURANCE, LES PAIEMENTS DE PRÊT, LES FRAIS DE TRANSPORTS, LES FRAIS TÉLÉPHONIQUES ET LES DÉPLACEMENTS. LES RESTRICTIONS DE CETTE GARANTIE LIMITÉE S’APPLIQUENT INDÉPENDAMMENT SI VOS RÉCLAMATIONS SONT BASÉES SUR L’INEXÉCUTION DU CONTRAT, UN DÉLIT (INCLUANT UNE NÉGLIGENCE OU UNE RESPONSABILITÉ OBJECTIVE) OU SUR TOUTE AUTRE THÉORIE. TOUTE ACTION ENTREPRISE EN VERTU DE LA PRÉSENTE DEVRA ÊTRE TRAITÉE DANS UN DÉLAI D’UN (1) AN APRÈS QUE LA CAUSE D’ACTION AIT ÉTÉ ACQUISE OU ELLE SERA NON AVENUE. CERTAINS ÉTATS OU PAYS NE PERMETTENT PAS CERTAINES RESTRICTIONS SUR LES GARANTIES OU POUR VIOLATION DE GARANTIE. LES RESTRICTIONS ÉMISES DANS CE PARAGRAPHE NE PEUVENT PAS S’APPLIQUER DANS LA MESURE OÙ ELLES SONT INTERDITES PAR LA LOI.
Responsabilité de l’acheteurL'acheteur doit suivre les instructions pour solliciter la couverture de cette Garantie Limitée :

• Exécuter et payer tout entretien régulier selon les périodes indiquées dans le Mode d’emploi applicable ; et

• Tenir des registres de tous les services et entretiens apportés sur les produits marins YANMAR.

Articles exclus de la garantieEn plus des autres conditions et restrictions présentées dans la Garantie Limitée, les pièces suivantes ne sont pas comprises dans la couverture de cette Garantie Limitée :

• L’usure normale ;

• Coûts associés au matériel non durable ;

• Tout produit, accessoire ou pièce YANMAR Marine qui a été, selon la seule opinion de YANMAR, sujet à une négligence, une mauvaise utilisation, un accident, une mauvaise installation, un mauvais entretien, une course ou engagé dans un concours de vitesse ou d’endurance, qui a subi l’utilisation de fixations non approuvées ou de pièces non originales, une exposition déraisonnable à l’environnement ou qui a été entretenu par une installation non autorisée ;

• Coût de transport du produit, pièce ou vaisseau YANMAR Marine, dans lequel ledit produit(s) YANMAR Marine est installé à partir de ou vers l’installation de service désignée par YANMAR pour les réparations sous la garantie ;

• Conséquence de toute modification ou altération d’un produit YANMAR Marine ou d’une pièce pour laquelle le numéro de série a été retiré, altéré ou faussé de quelconque façon ;



• Conséquence de toute modification ou altération, ou manipulation d’une pièce du moteur YANMAR identifiée par l’énoncé de garantie de l’EPA situé à l’intérieur du manuel de l’utilisateur du moteur YANMAR;

• Conséquence de toute modification ou altération de tout produit, accessoire ou pièce YANMAR Marine, dont l’horomètre ou le sceau d’un horomètre a été enlevé, ou qui a été altéré ou faussé de quelconque façon;

• Conséquence de toute modification, altération ou enlèvement de, ou altération de l’ajustage du régime réglé de la pompe d’injection de carburant, ajustages des limites de carburant et/ou les sceaux de la pompe d’injection de carburant.

Yanmar Marine International B.V. (« YANMAR ») fournit le manuel de Garantie Limitée afin de vous aider à tirer profit au maximum du moteur YANMAR de la transmission marine YANMAR par KANZAKI, de la transmission marine YANMAR SAIL DRIVE et/ou des systèmes de contrôle Yanmar (ci-après le(s) « Produit(s) YANMAR Marine ») achetés. Avant d’installer ou d’utiliser votre/vos Produit(s) YANMAR Marine, veuillez lire attentivement ce livret et le(s) manuel(s) d’utilisation applicable(s). Si vous n’avez pas reçu de manuel d’utilisation, veuillez contacter votre distributeur ou revendeur YANMAR pour lui demander une copie.

YANMAR garantit qu’au moment de l’envoi, les nouveaux produits vendus par lui et par les distributeurs autorisés YANMAR Marine, satisfont à toutes les spécifications applicables et seront exempts de tout défaut de matériel et de fabrication pour la durée de la période de garantie limitée. Cette garantie limitée est soumise aux restrictions énoncées plus loin dans ce manuel de garantie.

CETTE GARANTIE LIMITÉE EST FOURNIE EN GUISE ET LIEU DE TOUTE AUTRE GARANTIE, EXPRESSE OU IMPLICITE. YANMAR RENONCE SPÉCIFIQUEMENT À TOUTE GARANTIE IMPLICITE DE CONFORMITÉ À UN EMPLOI OU À UNE QUALITÉ MARCHANDE SPÉCIFIQUE, DANS LES LIMITES AUTORISÉES PAR LA LOI. SI CETTE CLAUSE DE NON-RESPONSABILITÉ EST INTERDITE PAR LA LOI, LES GARANTIES IMPLICITES SERONT AINSI LIMITÉES À LA DURÉE DE LA COUVERTURE DE LA GARANTIE EXPRESSE.

GARANTIE LIMITÉE YANMARYANMAR garantit à l’acheteur qu’elle effectuera toutes les réparations ou remplacements nécessaires pour corriger tout défaut de matériel et/ou de fabrication des produits YANMAR Marine couvrant la période de la garantie limitée. Cette garantie limitée vous donne certains droits reconnus par la loi. Il se peut que vous ayez d’autres droits qui varient selon l’état, la province ou le pays. Cette garantie limitée couvre les produits YANMAR Marine et fonctionne partout dans le monde où le service agréé par Yanmar est disponible.


MANUEL DE GARANTIE LIMITÉE – Applications commerciales de faible puissance

Cette garantie limitée peut être transférée à un deuxième acheteur au détail à condition que l’acheteur initial avise YANMAR par écrit au moment où le deuxième acheteur en prend possession. Dès lors, YANMAR peut, à son gré, requérir une inspection de tout produit YANMAR Marine par un centre de service YANMAR agréé. Si l’un des produits YANMAR Marine ne passe pas cette inspection avec succès, le transfert de cette garantie limitée peut être refusé. Le coût de l’inspection doit être assumé par l’acheteur. Le transfert de la garantie limitée ne prolongera pas la durée de sa couverture. YANMAR renonce spécifiquement à toute garantie expresse ou implicite s’appliquant au deuxième acheteur au détail à l’exception de celle fournie dans la présente, et renonce à toute garantie, expresse ou implicite, pour tout acheteur à venir.

Restrictions

IMPORTANT :

Afin de valider votre garantie limitée Yanmar Marine, vous devez compléter et poster à Yanmar la carte d’enregistrement de garantie jointe ou remplir la carte d’enregistrement de garantie en ligne sur le site Web de Yanmar Marine sur www.yanmarmarine.com.

Cette garantie limitée ne s’applique qu’aux produits Yanmar Marine et aux autres produits fabriqués et vendus par YANMAR ou par ses distributeurs autorisés. YANMAR renonce spécifiquement à toute garantie expresse ou implicite pour tout produit fabriqué par d’autres compagnies.

Si une défectuosité déclarée est apparue durant la période de la garantie limitée et si l’enregistrement de garantie applicable a été reçu par YANMAR, YANMAR peut décider de remplacer ou de réparer tout produit ou toute pièce Yanmar Marine à sa discrétion. YANMAR s’engage à réparer ou à remplacer les pièces sans exiger de frais ni pour celles-ci ni pour la main-d’œuvre. Le temps de réparation inclut un coût de main d’œuvre raisonnable pour enlever et réinstaller les produits Yanmar Marine et tous les composants auxiliaires du bateau dans lequel le moteur Yanmar est installé, si cela est nécessaire afin d'effectuer le remplacement ou la réparation sous garantie. Il est important de savoir que les moteurs et propulseurs marins diesels sont des pièces d’équipement sophistiquées et complexes qui peuvent être affectées par de nombreuses variables associées à n’importe quelle application, et, à ce titre, vous comprenez et acceptez que toute réparation peut nécessiter des efforts multiples pour arriver à une solution et que ces efforts peuvent prendre un temps considérable.

Définition d’une application commerciale de faible puissanceTout moteur utilisé à titre lucratif, par des services gouvernementaux ou en location est considéré comme une application non-récréationnelle de navigation et n’est pas couvert par la police de garantie limitée récréationnelle de Yanmar. L’utilisation en location se définit par un bateau utilisé pour un affrètement de loisirs, essentiellement des bateaux à voile, des catamarans à voile et à moteur et des chalutiers. Pour qu’un moteur soit considéré comme une application commerciale de faible puissance, il doit inclure les indications suivantes :

• Le moteur fonctionne à plein régime durant moins de 5 % du nombre total d’heures d’utilisation.

• Le fonctionnement standard se fait à moins de 90 % du régime maximum en trs/min.

• Les révolutions par minute à plein régime, en charge, doivent atteindre les vitesses nominales quelques soient les conditions d’utilisation.



• Le facteur de charge ne doit pas dépasser 35 %.

• Le temps de fonctionnement annuel ne doit pas dépasser 1000 heures.

• Une application approuvée doit être enregistrée au siège régional de Yanmar.

Durée de la garantie limitéeCette garantie limitée s’applique aux produits YANMAR Marine vendus par YANMAR et délivrés à l’acheteur au détail initial le ou après le 1er juillet 2004. Cette garantie limitée commence à la date de délivrance par rapport à l’acheteur initial. Dans le cas où le bateau contenant le(s) produit(s) Yanmar Marine est utilisé comme démonstrateur de vente ou qu’il est présenté dans des expositions de bateaux, la garantie limitée commence lorsque le produit Yanmar Marine atteint cent (100) heures d’utilisation. Lorsque vous demandez un service sous garantie, vous devez fournir la preuve de la date de délivrance du produit. YANMAR acceptera comme preuve de la date de livraison, un rapport de livraison entièrement rempli et signé ou une impression d’un enregistrement en ligne qui a été rempli dans le délai de (30) jours après la livraison.

Sauf mentions contraires fournies par écrit par YANMAR, la durée de la garantie limitée des applications commerciales de faible puissance (LDC en anglais) des produits Yanmar marine est (se référer au tableau ci-dessous) :

Toute réparation ou remplacement des pièces ou des produits YANMAR Marine sous la garantie sera effectué compte tenue de la garantie limitée originale et la protection de la garantie limitée restante ou la période de quatre-vingt-dix (90) jours, selon ce qui arrive en dernier. D’autres composants du moteur YANMAR qui sont sujets aux réglementations de l’Agence de Protection de l’Environnement (EPA) peuvent avoir des périodes de garantie qui sont prolongées selon la loi. LES RESTRICTIONS DE CETTE GARANTIE LIMITÉE S’APPLIQUENT INDÉPENDAMMENT SI VOS RÉCLAMATIONS SONT BASÉES SUR L´INEXÉCUTION DU CONTRAT, UN DÉLIT (INCLUANT UNE NÉGLIGENCE OU UNE RESPONSABILITÉ OBJECTIVE) OU SUR TOUTE AUTRE THÉORIE. TOUTE ACTION ENTREPRISE EN VERTU DE LA PRÉSENTE DEVRA ÊTRE TRAITÉE DANS UN DÉLAI D’UN (1) AN APRÈS QUE LA CAUSE D’ACTION AIT ÉTÉ ACQUISE OU ELLE SERA NON AVENUE. Responsabilité de l’acheteurL’acheteur doit faire ce qui suit pour solliciter la couverture de la garantie limitée :

• Réaliser et payer toutes les opérations régulières de maintenance conformément au calendrier spécifié dans le manuel d’utilisation applicable ; et

• Conserver les enregistrements de toutes les opérations d’entretien et de maintenance effectuées sur les produits YANMAR Marine.



Articles exclus de la garantieEn complément des autres conditions et restrictions définies dans la garantie limitée, les articles suivants sont spécifiquement exclus de toute couverture de la garantie limitée :

• L’usure normale ;

• Coûts associés au matériel non durable ;

• Tout produit, accessoire ou pièce YANMAR Marine qui a été, selon la seule opinion de YANMAR, sujet à une négligence, une mauvaise utilisation, un accident, une mauvaise installation, un mauvais entretien, une course ou engagé dans un concours de vitesse ou d’endurance, qui a subit l’utilisation de fixations non approuvées ou de pièces non originales, une exposition déraisonnable à l’environnement ou qui a été entretenu par un service après vente non autorisé.

• Coût de transport du produit, pièce ou vaisseau YANMAR Marine, dans lequel ledit produit(s) YANMAR Marine est installé, à partir du ou vers le service après vente désigné par YANMAR pour les réparations sous garantie ;

• Conséquence de toute modification ou altération d’un produit YANMAR Marine ou d’une pièce pour laquelle le numéro de série a été retiré, altéré ou faussé d’une quelconque façon ;

• Conséquence de toute modification ou altération, ou manipulation d´une pièce du moteur YANMAR identifiée par l’énoncé de garantie de l’EPA situé à l’intérieur du manuel de l’utilisateur du moteur YANMAR ;

• Conséquence de toute modification ou altération de tout produit, accessoire ou pièce YANMAR Marine, dont l’horomètre ou le sceau d’un horomètre a été enlevé, ou qui a été altéré ou faussé d’une quelconque façon ; et

• Conséquence de toute modification, altération ou enlèvement de, ou altération de l’ajustage du régime réglé de la pompe d’injection de carburant, ajustages des limites de carburant et/ou les sceaux de la pompe d’injection de carburant.
