Re: Letter of Intent – Special Use Permit Applications 4398 Buford Highway, Norcross, GA 30071 (the “Project”) Gwinnett County Tax Parcel: 6259 042 (the “Property”)

Chairman and Commissioners,

Habib & Habib Holding, LLC (the “Applicant” and the “Property Owner”) is submitting these Special Use Permit Applications (the “Applications”) to Gwinnett County, GA (the “County”) for consideration of combining previously approved Special Use Permit approvals by the County Board of Commissioners associated with cases SUP2003-00030, SUP2010-00033 & SUP2010-00034 to permit Automotive Sales, Automotive Service, Automotive Repairs, and/or light bodywork (i.e. minor dents and scratches), as a primary use and open to the general public for business on the Property. The Applicant and Property Owner have owned the Property since 2017. The Property is completely developed with an operable business performing Automotive Sales and Automotive Repairs to its own fleet of pre-owned automobiles. The Property was previously developed and operating as an Automotive Sales and Automotive Services facility many years before the presence of the adjacent residential townhouses that is located to the rear and could appear to be a random spot zoning along the Buford Highway corridor that is heavily dominated with the automotive and industrial uses for several miles both north and south of the Property.

The Applicant and Property Owner is specifically requesting changes to Condition 1C of SUP2010-00033 & Condition 1C of SUP2010-00034 that will permit the uses of Automotive Service and Automotive Repairs to the general public and to be allowed as a primary use of the Property along with core business use of Automotive Sales, which the Property is currently permitted to do. We are not requesting a change to any other conditions associated with SUP2010-00033 & SUP2010-00034 other than the specific change of condition referenced in this Application. Under the previous approval from the County, the applicant at the time may have had a different business model than the Applicant and Property Owner. The Applicant and Property Owner is the operator of Atlanta Best Used Cars, which is the largest used car dealership located on the Buford Highway corridor in the County having several properties as part of their business on Buford Highway located in the County, City of Norcross, and the City of Peachtree Corners. This proposed combined of the Application will simply “clean up” the existing conditions associated with the Property and provide for uses that Applicant and Property Owner needs to continue it track record of success in the County selling pre-owned automobiles.

We believe this request will not change or harm the existing area as automotive service is already an allowed use on the Property. There are numerous other automotive sales and service facilities located within a stones thrown of this Property, and the Buford Highway corridor from the City of Duluth heading south to the DeKalb County line is already heavily dominated with automotive uses both permitting sales and services related functions of their core automotive businesses.
