Thank you to all who attended the Installation of Officers and Directors! What a wonderful venue and event! Over the past year, I have been asked several times why I chose to run for President. There are two very compelling reasons why I want to serve: I deeply care

about our profession and our Association, and I truly believe in giving back through service to others. To move forward, you often need to reflect and look back. Ethics Case Interpretations related to Article 1

Case #1-3: Net Listing (Originally Case #7-3. Revised May, 1988. Transferred to Article 1 November, 1994.)

Client A called REALTOR® B to list a small commercial property, explaining that he wanted to net at least $170,000 from its sale. He inquired about the brokerage commission and other selling costs. REALTOR® B’s response was: “You have indicated that $170,000 net to you from the sale will be satisfactory. Suppose we just leave it at that and take all of the selling costs from the proceeds of the sale above $170,000.” Client A agreed. The property was sold to Buyer C for $220,000. After settlement, in which it was apparent that $50,000 would go to REALTOR® B as commission, Client A and Buyer C both complained to the Board of REALTORS® about REALTOR® B’s conduct in the matter, and a hearing was scheduled before the Board’s Professional Standards Committee. REALTOR® B’s defense was that he had performed the service that Client A engaged him for precisely in conformance with their agreement. Buyer C had considered the property a good buy at $220,000 and was happy with the transaction until he learned the amount of the commission. The Hearing Panel found REALTOR® B in violation of Article 1 of the Code. The panel concluded that REALTOR® B had departed completely from his obligation to render a professional service in fidelity to his client’s interest; that he had, in fact, been a speculator in his client’s property; and that he had not dealt honestly with either party to the transaction. all pertinent facts relating to the transaction.

MLS Statistics

Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing

Service and in conjunction with Florida REALTORS reflect the following for August 2021/2020. The

Residential closed sales of single-family detached homes totaled 309 units for August 2021. This

compares to a total of 340 units in August 2020. The median price of single-family detached homes sold

by members of the REALTORS Association of Indian River County MLS for August 2021 was $345,000. This compares to a median price of $265,000 for

August 2020. Current active inventory of residential single-family detached homes total 420 for August 2021. This compares to the active inventory of 885

for August 2020.

The Residential closed sales of condominium homes totaled 77 units for August 2021. This compares to a total of 81 units in August 2020. The median price of

condominium homes sold by members of the REALTORS Association of Indian River County MLS for August 2021 was $210,000. This compares to a median price of $156,000 for August 2020. Current

active inventory of condominium homes total 123 for August 2021. This compares to the active inventory

of 424 for August 2020.

Legislative Solution Is the ‘Fastest Path’

to Address the Housing Crisis

Florida REALTORS® recently announced that it is pursuing a

legislative solution as the fastest way to address Florida’s

affordable housing crisis, including new homeownership

opportunities targeted at frontline workers. The decision was

made following highly productive discussions with legislative

leaders indicating strong support to address this crisis.

This legislative relief will take the place of the Housing Funds

for Housing ballot campaign initiated just a few months ago.

Florida REALTORS® will work cooperatively with the

Florida Legislature and other stakeholders to increase

opportunities for Floridians to own their own homes, while

preserving programs for rental assistance. The organization

will also advocate for new funding to support the proposed

frontline worker homeownership program. The goal is to

begin working with the Florida Legislature immediately to

ensure these issues receive attention during the 2022

legislative session, which begins in January.

“Floridians made it known through their broad public support

for the ballot initiative that workforce housing affordability

must be a top priority, and this has opened the door for

positive discussions in the Capitol. The legislative leadership

has committed to working with us to find significant,

immediate solutions to Florida’s workforce housing crisis,”

says Florida REALTORS® President Cheryl Lambert. “This

crisis cannot wait. Every day, we hear about workers who are

bearing the brunt of the pandemic who can’t afford a home.

This approach will help bring homeownership within reach of

Floridians much faster.”

Florida REALTORS®/ Updates FR/Bar Contract & Riders

Revisions to the Florida REALTORS®/Florida Bar Contract for Sale and Purchase (FR/Bar) – both the AS IS and the Residential – have recently been approved and contain numerous changes. In addition, seven Riders have been updated and three new Riders were created. The update gives members time to familiarize themselves with the changes and goes into effect on Monday, November 1, 2021. Please see News & Alerts for more information.

MLS Fees will be billed and mailed on Wednesday, September 1, 2021. Payments will be due by Friday, October 1, 2021. If Broker wishes to remove/deactivate any user(s) within the office, it must be done in writing with Brokers authorization. Please see News & Alerts in Matrix for more information. A $100.00 late fee will be assessed Monday, October 4, 2021 at 8:30 AM on all outstanding balances, No exceptions.

MLS Approved Exception

‘Self-Report False Information in Sold Data (07/21) If sold data is entered incorrectly, the listing agent may "self-report" correction(s) needing to be made to the MLS Coordinator ([email protected]) and as a result, a Letter of Warning will not be recorded.’ Please Note: If you are aware of incorrect sold information inputted into the MLS, please contact the listing office to allow the listing office to be aware to give the listing agent the opportunity to self-report. If the listing office has been contacted and a self-report is not made within a timely manner, a Letter of Warning will be submitted to the listing agent for false information in the required fields.

Approved Changes to the MLS Rules & Regulations

RAIRC’s Board of Directors approved to include ‘of the seller(s) signature’ to Sections 1 and 9.3 of the MLS Rules & Regulations. Section 1 - Listings of properties which are subject to a real estate broker’s license within Indian River County taken by Participants on an exclusive right to sell listing form must be delivered to the Multiple Listing Service within 1 business day, excluding weekends and holidays, after all necessary signatures of the seller(s) have been obtained. Dates of the broker’s signature will no longer be accepted during paperwork request as the final dated signature. Remember, ALL signatures MUST be dated.

Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.
