Ander top-werkgewers sluit in Old Mutual, Microsoft, Accen- ture SA en Nestlé. Een van die neigings wat die Top Employers Institute deesdae in sy navorsing opmerk, is dat mensehulpbronbestuur as ’n in- tegrale deel van die maatskappy se strategie gesien word, sê Crous. “Die korrelasie tussen die moeite wat ingesit word om per- soneel se prestasie te verbeter en die resultate wat behaal word, word deesdae noukeurig gemeet. ’n Mens sou dink dit is ’n vanselfsprekende ding om te doen, maar dit is nie.” Sy sê dis juis hierdie deurlo- pende fokus op mense-ontwikke- ling wat die topmaatskappye van die res onderskei. “Wat hulle uitstaande werkge- wers maak, is nie net ’n fokus om die omstandighede te skep wat werknemers hul allerbeste vir die maatskappy kan laat gee nie, maar ook die maatskappy se groeiende toewyding om hierdie beleggings te meet en te kwanti- fiseer.” Navorsing oor top-werkgewers het ook bevind die maatskappy se prestasiemetingstelsel word deesdae deur die leierskap in die maatskappy bestuur, en dat die mensehulpbronafdeling al hoe meer in die hart van die maatskappy se strategie geplaas word. Die drie gebiede waar maat- skappybestuur die meeste be- trokke is, is talentbestuur (96%), loopbaan- en opvolgbeplanning (85%) en prestasiebestuur (81%). “Waar mensehulpbronbestuur voorheen as ’n suiwer admini- stratiewe funksie in ’n maatskap- py beskou is, is dit deesdae ’n sleutelgebied vir die maatskappy se vooruitgang.” Tot 93% van die maatskappye wat vanjaar as voorste werkge- wers aangewys is, gebruik sleu- telaanwysers om prestasie te meet en ook om die sukses van hul talentstrategie te bepaal. AntwoordDit is nie toelaatbaar nie. Dit is nie net onredelik van jou werkgewer nie, dit is ook teen die wet. Art. 20(9) van die Wet op Basiese Diensvoorwaardes bepaal uitdruklik dat ’n werkgewer nie van ’n werknemer mag vereis óf die werkne-mer mag toelaat om in sy jaarlikse ver-lof vir die werkgewer te werk nie.

Jy sal kan weier om in te gaan werk toe en te help om die masjiene te her-stel sonder dat jou werkgewer dissipli-nêr teen jou sal kan optree.

Dit is jou werkgewer se verantwoorde-likheid om alternatiewe reëlings te tref vir ingeval die masjiene breek.

Watter  prosedure  moet werkgewer  volg  met  ontslag?’n Jong vrou het vir my gewerk. Ons het gevind dat sy van die kontant in die kantoor gesteel het en het haar dienoor-eenkomstig aangekla. Die dag van haar verhoor het haar ouers ook opgedaag en gevra dat ons nie ’n formele verhoor moet hou nie omdat sy nog so jonk is en die aangeleentheid baie sleg was vir albei partye.

Ons het toe net met haar en haar ouers gesels en haar dienste beëindig.

Tot ons verbasing het sy die saak na die Kommissie vir Versoening, Bemidde-ling en Arbitrasie (KVBA) verwys. Ons het die saak verloor omdat ons volgens die kommissaris nie ’n verhoor gehou het nie en dus nie die korrekte prose-dure gevolg het nie. Ons moes haar drie maande se salaris betaal.

Ek is baie ontsteld, want sy het ge-steel en op haar en haar ouers se ver-soek het ons nie ’n verhoor gehou nie.

Omdat ons goed wou wees, moet onsnou betaal. Is dit reg? Watter prosedure moes ek gevolg het?

Antwoord Meneer, jy het nou ongelukkig ’n duur prys betaal vir ’n fout wat baie onnodig was en voorkom kon word.

Al is die werknemer skuldigaan ernstige wangedrag soos diefstal, móét die werkgewer seker maak dat hy prosedureel kor-rek optree en voldoen aan die vereistes van die wet. Indien nie, sal die KVBA, soos in jou geval, ’n toekenning teen die werkgewer maak.

Bylae 8 (4)(1) van die Wetop Arbeidsverhoudinge bepaal dat die dissiplinêre proses (die verhoor) nie formeel hoef te wees nie. Daar is eg-ter wel sekere vereistes waaraan vol-doen moet word. Dit is eintlik baie moeilik om wel aan al die vereistes te voldoen, soos om kennis van die ver-hoor te gee, die werknemer en getuies aan te hoor, en die uitspraak en straf te gee, sonder om ’n formele prosedure te volg.

Die bewyslas by die KVBA is ook so-veel makliker as die dissiplinêre proses formeel was, soos dat die nodige doku-mente wat behoorlik voltooi en beteken is, notules van die verhoor asook die getekende ontslagvorm as bewyse be-skikbaar is.

As die werkgewer voldoende bewyse

het teen die werknemer om ’n verhoor te regverdig, moet die klagte teen die werknemer in ’n formaat en taal wat die werknemer verstaan aan hom gegee word in die vorm van ’n kennisgewing van ’n dissiplinêre verhoor.

Die werknemer moet minstens twee werkdae gegee word om hom op die verhoor voor te berei. Die werknemer kan in die verhoor deur ’n kollega of vakbondverteenwoordiger bygestaan en verteenwoordig word.

) Die  volgende  prosedure  moet  in  dieverhoor  gevolg  word:  Die klagtes moet aan die werknemer gestel word op ’n manier wat hy kan verstaan. Hy moet dan daarop skuld beken of ontken. Daarna moet die werkgewer sy saak stel, die nodige bewyse aanvoer en ge-tuies roep indien nodig.

Die werknemer moet dan die kans kry om die werkgewer en sy ge-

tuies te kruisondervra waarnadie werkgewer weer sy eie

getuies kan herondervra.Daarna kry die werkne-

mer kans om sy kant vandie saak te stel. Hy kanook getuies roep om na-

mens hom te getuig. Diewerkgewer sal ook kans

kry om die werknemer ensy getuies te kruisondervra

waarna die werknemer weer sy eiegetuies kan herondervra.

Die voorsittende beampte moet dan ’n objektiewe en regverdige oordeel vel nadat hy albei partye aangehoor het en na die bewyse en getuienis geluister het. As die werknemer skuldig bevind word, moet die voorsittende beampte eers versagtende en verswarende getuie-nis aanhoor en in ag neem voordat hy ’n gepaste straf oplê.

Die skuldigbevinding en straf en die redes daarvoor moet aan die werkne-mer verduidelik word. Dit moet verkies-lik op skrif aan hom gegee word. Die werknemer se reg om te appelleer teen die beslissing moet aan hom gestel word asook sy reg om die saak na die KVBA te verwys.

) Minder  ernstige  oortredings: Ont-hou, daar kan baie ernstige gevalle van wangedrag wees, of ook minder ernstige oortredings. In laasgenoemde geval moet die werkgewer daadwerklik pro-beer om die werknemer te help om sy gedrag te verbeter.

Die werkgewer hoef nie elke keer ’n formele prosedure te volg as ’n reël ge-breek word of ’n standaard nie nage-kom word nie. Die werknemer moet net die kans gegee word om sy kant van die saak te stel teen die aantygings. Met an-der woorde, waar die uiteinde van die saak nie ontslag gaan wees nie, kan die saak deur ’n informele ondersoek ge-hanteer word.
