3. Under sections 14(2) and 15(a) of the Act, that part of theDepartment of Public Works known as GovernmentInformation and Communication Technology which includesPortfolio, Program and Project Assurance; Strategy; PublicSector Development; Capability Development; QueenslandGovernment Enterprise Architecture; Government-IndustryLiaison; Telecommunications, Broadband and DigitalEconomy; and Shared Service Policy is established as agovernment entity and declared to be part of the Departmentof Public Works.

Declaration

4. Under sections 14(2) and 15(c) of the Act, the governmententity established under Part 3 is added to and declared tobe part of the Department of the Premier and Cabinet.

DECLARATION NOTICE (No 01) 2011Short title

1. This notice may be cited as the Limits for Disaster Management Waste Declaration Notice (No 01) 2011.Notice of declaration [s.28 of the Act]

2. Notice is hereby given that the Chief Executive declares that waste is disaster management waste:

A. if it is waste generated as a result of flooding during the period between 10 January and 15 January 2011; AND

B. it is waste arising from the following local government areas:a. Ipswich City Council;b. Lockyer Valley Regional Council; andc. Brisbane City Council.

C. For Brisbane City Council, the waste is only disaster management waste if it has been generated in one of the listed flood-affected suburbs of:a. St Lucia;b. West End;c. Rocklea;d. Oxley;e. Graceville; orf. Sherwood

3. For all local government areas listed in B, the waste is disaster management waste if it has been generated as a result of reconstruction activity as a result of the flooding.

4. The limits take effect from 1 December 2011.5. The limits cease to have effect on 1 March 2012. 6. This Limits for Disaster Management Waste Declaration

2. Notice is hereby given that the Chief Executive declares that

waste is disaster management waste:A. if it is waste generated:

a. as a result of Tropical Cyclone Yasi during the period 2 and 3 February 2011 in the local government area of the Shire of Hinchinbrook; OR

b. by subsequent flooding events as a consequence of Cyclone Yasi that affected the Shire of Hinchinbrook during the period 2 February to 20 March 2011; AND

B. it is waste for which Hinchinbrook Shire Council has approved a Waste Disposal Fee Waiver via form EH404; AND

C. the waste is only taken to either of the Warrens Hill or Halifax Transfer Stations located in the Shire of Hinchinbrook; OR

D. if it is waste generated as a result of Tropical Cyclone Yasi in the local government area of Cassowary Coast Region during the period 2 and 3 February 2011.

3. The limits take effect from 1 December 2011.4. The limits cease to have effect on 1 March 2012. 5. The Limits for Disaster Management Waste Declaration

EXEMPT WASTE DECLARATION NOTICE (No 01) 2011Short title

1. This notice may be cited as the Exempt Waste Declaration Notice (No 01) 2011.Notice of declaration [s.34 of the Act]

2. Notice is hereby given that the Chief Executive declares that waste is exempt waste where each of the following apply:

A. the waste has been generated as a result of the ordinary day-to-day use of domestic premises that are located within the Hope Island Resort Principal Body Corporate zone;

B. the premises are rated by Gold Coast City Council as either residential category 1, category 2 or category 7A-7H;

C. the conditions provided in section 3 of this notice are met.

3. The waste for premises identified in section 2 is exempt waste where the following conditions apply:

D. the waste is collected as part of a weekly kerbside domestic waste collection service;

E. all premises must be provided with a recycling collection service of the same frequency as that provided by Gold Coast City Council to residential rated properties by 30 May 2011;

F. all new premises must be provided with a recycling service of the same frequency as that provided by Gold Coast City Council to residential rated properties;

G. the name of the waste collection contractor and the registration number of the vehicles that are to collect the waste are notified to the Department of Environment and Resource Management by the Hope Island Resort Principal Body Corporate;

H. the waste, this notice, and any letter of notification referenced in item G above are presented at the J.J.Richards & Sons Pty Ltd waste transfer facility located at 40 Quarry Road, Stapylton, or the waste management facility trading as Ti Tree Bioenergy located at Champions Way, Willowbank;

I. changes to the arrangements under subsections G and H are allowable subject to notification to the General Manager, Waste Reform, Department of Environment and Resource Management by the Hope Island Resort Principal Body Corporate at least three days before the day of collection.

4. The exemption takes effect from 1 December 2011.5. The exemption ceases to have effect on the earlier of the

following:J. on the date the conditions provided in section 3 are not

met; orK. 31 November 2012.

2. Notice is hereby given that the Chief Executive declares that exempt waste is waste that is generated in the Yarrabah Aboriginal Shire Council area, IF -

A. the waste is collected from the Yarrabah Waste Transfer Station located on Lot 207/NR7310, Workshop Road Yarrabah; OR

B. the waste is collected as part of a weekly kerbside waste collection service by the council or a waste contractor, AND

C. the waste is transported in a council vehicle or another vehicle notified under section 5H of this notice; AND

D. the waste is delivered to the Springmount Waste Management Facility located at Lot 13-14 Springmount Rd Arriga, Dimbula, Queensland or another levyable waste disposal site notified under section 4G or 5I of this notice; AND

E. the requirements provided in all sections of this notice are met.

3. To be clear, waste is not exempt if it is generated inside the waste levy zone and transported to the Yarrabah Waste Transfer Station.

4. Yarrabah Aboriginal Shire Council must notify the Department of Environment and Resource Management of –

F. any changes to the waste contractor hired by the council to transport the waste generated in the Yarrabah Aboriginal Shire Council area to a levyable waste disposal site as per section 2D of this notice;

G. any changes to levyable waste disposal site to which the council delivers the waste generated in the Yarrabah Aboriginal Shire Council area.

5. The waste contractor hired by the council to transport the waste generated in the Yarrabah Aboriginal Shire Council area to the levyable waste disposal site specified in section 2D must notify the Department of Environment and Resource Management of:

H. the vehicles and any changes to vehicles that are used to transport that waste;

I. any changes to levyable waste disposal site to which the contractor delivers waste generated in the Yarrabah Aboriginal Shire Council area.

Waste Reduction and Recycling Act 2011EXEMPT WASTE DECLARATION NOTICE (No 05) 2011

Short title1. This notice may be cited as the Exempt Waste Declaration

Notice (No 05) 2011. Notice of declaration [s.34 of the Act]

2. Notice is hereby given that the Chief Executive declares that waste is exempt waste when each of the following apply:

A. the waste is waste that has been donated to a charitable recycling entity but that can not practicably be re-used, recycled or sold;

B. the entity responsible for the waste is an eligible charitable recycling entity;

C. the conditions provided in all sections of this notice are met.

3. To be clear, waste is not exempt if it is generated as a result of the commercial or administrative operations of the charitable recycling entity, for example, office waste.

4. An eligible charitable recycling entity means an entity that meets all of the following conditions:

D. operates on a not-for-profit basis;E. is registered as a charity under the Collections Act

1966;F. is a Deductible Gift Recipient for the purposes of laws

administered by the Australian Taxation Office of the Commonwealth;

G. actively and consistently operates a recycling and re-use program for:

o providing emergency assistance;o otherwise supporting the charitable

purposes of the entity.5. When the waste is presented at a levyable waste disposal site

or transfer station the person delivering the waste must produce one of the following to the site operator:

H. A letter signed by the Chief Executive Officer of the charitable recycling entity stating that the entity and waste are eligible and meet the conditions provided in this notice;

I. Proof of membership of the National Association of Charitable Recycling Organisations.

6. The waste under the Exempt Waste Declaration Notice (No 05) 2011 is exempt from 1 December 2011.

7. The Exempt Waste Declaration Notice (No 05) 2011 ceases to have effect on the earlier of the following:

J. on the date the conditions in this notice are not met; or

K. 31 March 2012.8. The Exempt Waste Declaration Notice (No 05) 2011 is made

on the date this notice is published in the Gazette.ENDNOTES

Waste Reduction and Recycling Act 2011EXEMPT WASTE DECLARATION NOTICE (No 04) 2011Short title

1. This notice may be cited as the Exempt Waste Declaration Notice (No 04) 2011. Notice of declaration [s.34 of the Act]

2. Notice is hereby given that the Chief Executive declares that exempt waste is waste -

A. from the Cooktown Waste Transfer Station located on MacMillan Road Cooktown; IF

B. the waste is transported in a vehicle with any of the following registration numbers: 403 LPX; 914 HUK or 142 IXY or another vehicle notified under section 5 of this notice; AND

C. the waste is delivered to the Woree / Portsmith Transfer Station Springmount Waste Management Facility located at Springmount Rd Arriga, Dimbula, Queensland or another levyable waste disposal site notified under section 4 of this notice; AND

D. the requirements provided in all sections of this notice are met.

3. Despite section 2, waste is not exempt if it is generated inside the waste levy zone and transported to the Cooktown Waste Transfer Station.

4. Cook Shire Council must notify the Department of Environment and Resource Management of –

E. any changes to the waste contractor transporting the waste from Cooktown Waste Transfer Station to a levyable waste disposal site as per section 2C of this notice;

F. any changes to levyable waste disposal site to which the waste from Cooktown Waste Transfer Station is delivered.

5. The waste contractor transporting the waste from Cooktown Waste Transfer Station must notify the Department of Environment and Resource Management if a vehicle - other than the vehicles specified in 2B – is used to transport the waste.

6. Notification under sections 4 and 5 of this notice must be prior to the change taking effect and be made in writing and to the General Manager at [email protected] or PO Box 2454 GPO Brisbane Q 4001.


8. The requirement to notify under sections 4 and 5 take effect on the day the Exempt Waste Declaration Notice (No 04) 2011 is published.

9. The Exempt Waste Declaration Notice (No 04) 2011 ceases to have effect on the earlier of the following: upon failure to notify under sections 4 and 5 without a reasonable excuse; or on the day this declaration is revoked.

Short title1. This notice may be cited as the Correction of Exempt Waste

Declaration Notice (No 01) 2011.Correction of notice [s.24AA of the Acts Interpretation Act 1954 and s.34 of the Waste Reduction and Recycling Act 2011]

2.(1) The Exempt Waste Declaration Notice (No 01) 2011 published in the Gazette on 5 December 2011 at pages 667-668 is corrected as set out in subsection (2).

(2) In Part E of the notice-omit ‘all premises must be provided with a recycling collection

service of the same frequency as that provided by Gold Coast City Council to residential rated properties by 30 May 2011’,

insert ‘all premises must be provided with a recycling collection service of the same frequency as that provided by Gold Coast City Council to residential rated properties by 30 May 2012’.

Acquisition of Land Act 1967TAKING OF EASEMENT NOTICE (No 51) 2011

Short title1. This notice may be cited as the Taking of Easement Notice

(No 51) 2011.Easements taken [ss.6 and 9(7) of the Act]

2. The Easements described in Schedule 2 are taken by Brisbane City Council for purposes incidental to road (batter bank) and vest in Brisbane City Council on and from 9 December 2011.Rights and obligations

FOR THE PURPOSES of constructing or building and thereafter forever to use and maintain such slopes, footings, foundations, filling, soil embankments, batter banks and associated walling as may from time to time be determined by the Council in its absolute discretion as necessary (hereinafter referred to as “the Support”) to ensure the continued support of the adjoining Road or Road/s as proposed and the land immediately contiguous to the land described in the Schedule hereto (which land is hereinafter referred to as “the Said Land”) with the full, free and uninterrupted right and liberty at all times by day and by night and from time to time to enter upon and to go, pass and repass over, along and under the Easement Area and the Said Land or any part or parts thereof with or without engineers, surveyors, servants, agents, licensees, contractors, subcontractors, workmen and others authorised by the Council and with or without equipment and other vehicles and things laden or unladen and to dig into, sink shafts in, erect scaffolding upon and to open and break up the soil of the Easement Area and/or the Said Land or any part or parts thereof as well the subsurface as the surface thereof and to bring and place in and upon the Easement Area and the Said Land or any part or parts thereof and remove such materials, machinery, equipment, tools and other articles and to do such other incidental works and things in the premises as the Council shall in its discretion think fit TOGETHER WITH full, free and uninterrupted access to the Easement Area and the Said Land for the purposes of inspecting, altering, reconstructing and/or repairing the Support AND ALSO the full and free right at all times and from time to time to the uninterrupted flow of rain water and drainage of all kinds inclusive of stormwater run off flowing in concentration either intermittently or occasionally (all of which is hereinafter called “stormwater drainage”) over and along the surface of the Said Land without(1) any obstruction, interruption, impeding, hampering or interference, diversion, scouring, change or alteration in or to the flow or escape of stormwater drainage or its or their natural outlet (if any) or (2) any ponding of waters or(3) any interference or obstruction to the Support caused by or consequent upon (a) any use to which the Said Land may be put or (b) the erection, raising, making, placing or suffering to stand

or to remain of any building, fence, wall, structure (whether of the class just mentioned or not) paving or vegetation (except grass, vegetation or landscaping which is to be properly maintained at all times) or thing whatsoever upon the Said Land or

(c) any alteration in level or gradient of the Said Land or any change to the surface of the Said Land or to the natural or artificial features of the Said Land which contain or assist in containing the flow of stormwater drainage over the Said Land

other than as is or are permitted in writing by the Council or the Permanent Head for the time being of Brisbane Infrastructure Division of the Council and only on such terms and conditions as the Council or the Permanent Head may impose or stipulate in the event of such permission being granted with power for the Council and its contractors, agents and servants (but without prejudice to any other powers or remedies for the Council) at the cost to the owner or owners, registered proprietor or registered proprietors or occupier or occupiers from time to time and for the time being of the Said Land or any of them

(i) to demolish, remove or otherwise dispose of any building, fence, wall, structure (whether of the class just mentioned or not) paving or vegetation (except grass which is to be kept properly mown) or thing whatsoever at any time on or in the Said Land in contravention of the foregoing provisions and

(ii) to perform any works necessary for restoring or reinstating the Said Land (including the grass thereon) and the natural or artificial features containing or assisting in the Support and/or in containing or assisting in the flow of stormwater drainage over the Said Land to their former state and condition and also

(iii) to alter, grade, pave, prepare, grass, fertilize, prune, remove vegetation or mow the surface of the Said Land or place, install, establish or construct and keep any earthworks and any other works whatsoever (whether of the class just mentioned or not) thereon or therein for the purpose of the exercise of the rights hereinbefore given or incidental thereto or for the purpose of forming the surface of the Said Land in such a way as to contain the flow of stormwater drainage or for the purpose of rectifying or alleviating any scouring of the Said Land due to the flow of stormwater drainage thereover.

SCHEDULE 1DEFINITIONS

1. In this Easement: 1.1 “Acts” means the Electricity Act 1994, Electrical

Safety Act 2002 and Government Owned Corporations Act 1993 and any amendments to them or any Acts superseding those Acts.

1.2 “Date of this Easement” means the date of the gazette resumption notice.

1.3 “Easement” means the rights obtained from the Owner by QETC including but not limited to the terms and conditions contained in this Schedule.

1.4 “Easement Land” means that portion of the Owner’s land over which this Easement is obtained.

1.5 “Electricity Works” means such works, apparatus, structures and things as QETC may in its absolute discretion consider appropriate as a means of conveying or transmitting electricity, telecommunications and other electromagnetic energy in all its forms, including conductors, cables, towers, aerials, poles, foundations, ground anchorages, supports and other associated or appurtenant works. The expression includes the Electricity Works existing on the Easement Land at the Date of this Easement or constructed on it after that date, and where the context permits it includes a reference to any part of the Electricity Works.

1.6 “Lessee” has the same meaning as in the Land Act 1994.

1.7 “Owner” means the Registered Proprietor or the Lessee, as applicable, together with its successors, successors in title and assigns. Where the term appears


in Clauses 3, 4, 5, 6 and 8 it includes the servants, agents, employees, workmen and contractors of the Owner and other persons authorised by the Owner to use or enter upon the Easement Land.

1.8 “QETC” means the Queensland Electricity Transmission Corporation Limited, together with its successors and assigns and others authorised by it. Where the context permits, the term includes the servants, agents, employees, workmen, linesmen, contractors of QETC and other persons authorised by QETC to exercise its rights under this Easement.

1.9 “Registered Proprietor” has the same meaning as in the Land Title Act 1994.

1.10 “Structure” means any building, improvement, plant, equipment, fixture, fitting, pole, cable, wire, pipe, tower, apparatus or chattel or of any kind whether on, over, in, under, across or through the Easement Land and includes by way of example but is not limited to any dwelling (including any extension or overhang of eaves or guttering), swimming pool, shed, retaining or other wall and lighting.

QETC’S RIGHTS2. The QETC is acquiring this Easement to permit QETC the

right to: 2.1 convey and transmit electricity, telecommunications

and other electromagnetic energy in all its forms on, from, over, under and through the Easement Land by Electricity Works;

2.2 enter upon and traverse the Easement Land, with vehicles, plant and equipment, if necessary, to exercise its rights under this Easement;

2.3 construct Electricity Works on, over, under or through the Easement Land;

2.4 inspect, maintain, repair or replace the Electricity Works;

2.5 clear the Easement Land of trees, undergrowth or vegetation or any obstruction including soil in the manner and by the means QETC considers appropriate;

2.6 construct and maintain on the Easement Land such tracks, roads, gates, fences and other structures and works as QETC considers necessary;

2.7 enter upon and traverse the Easement Land for the purposes of preventing or rectifying any infringement by the Owner of QETC’s rights under this Easement by the Owner; and

the QETC may in connection with its use and enjoyment of this Easement, exercise such of its rights, powers, discretion and functions under the Acts, or any other Act or at law as it sees fit.

QETC’S OBLIGATIONS TO THE OWNER3. QETC will, in exercising its rights pursuant to this

Easement: 3.1 cause as little inconvenience to the Owner as possible;

and 3.2 act reasonably.

QETC WILL COMPLY WITH SAFETY LAWS4. 4.1 QETC will comply with all laws regarding the exercise

of its rights under this Easement and the safety of persons to use the Easement Land.

4.2 QETC will not be liable for: 4.2.1 the negligent acts or omissions of the Owner;

or 4.2.2 the acts or omissions of the Owner that are a

breach of this Easement or of the law.THINGS THE OWNER MUST NOT DO

5. The Owner must not: 5.1 interfere with, damage or place at risk the Electricity

Works or plant, equipment, tools or material of QETC on or near the Easement Land;

5.2 interfere with or obstruct QETC in the exercise or enjoyment of its rights and powers under this Easement; or

5.3 grow sugarcane within ten (10) metres of any tower, base or pole upon the Easement Land.

THINGS THE OWNER MAY ONLY DO IF QETC CONSENTS

6. The Owner must not, or consent to allow another party to, after the Date of this Easement, without first obtaining the written consent of QETC:

6.1 erect or place any Structure or make any additions or alterations to any Structure on the Easement Land;

6.2 erect any fence that is higher than three (3) metres on the Easement Land;

6.3 place fill or other substance or carry out any works or do anything whatsoever on the Easement Land which would reduce the clearance from ground level of the conductors or transmission lines below the minimum statutory clearance required from time to time for the voltage class of the transmission line on the Easement Land;

6.4 cause or allow, except in the case of force majeure, the inundation of those parts of the Easement Land where any Electricity Works are erected or located or are proposed to be erected or located;

6.5 lay any metal conduit or pipe within five (5) metres of the base of any tower, pole, foundation, ground anchorage or other means of support on the Easement Land;

6.6 do any act or thing which jeopardises the foundations, ground anchorages, supports, the towers or poles, including (without limitation) excavate or remove any soil, sand or gravel within a distance of twenty (20) metres from the base of any tower, pole, foundation, ground anchorage or support on the Easement Land;

6.7 grow sugar cane on the Easement Land except: 6.7.1 where the Owner is a holder of a valid cane

supply contract under the Sugar Industry Act 1999 as at the Date of this Easement; and

6.7.2 the Owner grows sugar cane in accordance with clause 5.3 above;

6.8 plant or grow upon the Easement Land trees whose size or height would in any way interfere with the statutory clearance that may exist from time to time; or

6.9 reside in or permit anyone to reside in or occupy any Structure, caravan, or other accommodation (including temporary accommodation) which may be located on the Easement Land,

and QETC will not unreasonably withhold its consent but in granting any consent may impose reasonable conditions.

OWNER MAY USE EASEMENT7. The Owner may use the Easement Land for any lawful purpose

not inconsistent with the terms of this Easement.THINGS QETC MAY DO IF THE OWNER IS IN BREACH

8. 8.1 In the event of any breach by the Owner of the terms of Clauses 5 and 6, QETC may in its absolute discretion give notice to the Owner to rectify the breach which may include the demolition or removal of all, or any part of, a Structure; and

8.2 If after 30 days, the Owner has not rectified the breach, then QETC may rectify the breach which may include:

8.2.1 the demolition and/or removal of a Structure or any part thereof upon the Easement Land; or

8.2.2 mitigation or remedial work to restore the safety of the Electricity Works

without liability to the Owner for reinstatement, restitution, damages, compensation or otherwise.

8.3 Notwithstanding anything contained in Clauses 8.1 or 8.2, in the case of an emergency, QETC may enter the Easement Land to remedy a defect, eliminate an actual or potential danger or remove a Structure or any part thereof that is affecting, or may affect, the safety of Electricity Works or continuity of supply without


giving notice. 8.4 If QETC acts under clause 8.3, it must give the notice,

if not already given, mentioned in clause 8.1 as soon as practicable.

8.5 Any costs incurred by QETC in relation to either Clauses 8.2 or 8.3, or both, may be recovered from the Owner.

INDEMNITY9. QETC indemnifies the Owner against all actions, suits,QETC indemnifies the Owner against all actions, suits,

proceedings, demands, costs, losses, damages and expenses arising out of or in respect of any act or omission of QETC in the use or attempted use of the Easement Land by QETC, except where such actions, suits, proceedings, claims, demands, costs, losses, damages or expenses arise as a result of any negligent act or omission of the Owner, breach of this Easement or of the law.

PUBLIC RISK10. QETC will effect and keep current a public risk insurance policy

in respect of this Easement and the use by QETC of the Easement Land for an amount which QETC considers appropriate to the public liability risk involved but in any event not less than FIFTY MILLION DOLLARS ($50,000,000.00).

SCHEDULE 1Easement Terms

1. Grant of EasementThe Owner hereby grants to the Mackay Regional Council (the “Council”) the full and free right and liberty of using the Easement Area for drainage purposes and to exercise all powers, authorities and discretions vested in it by law for the passage or conveyance of storm water.

2. Council’s Rights The Council has the right at all reasonable times, with or without

vehicles, machinery, plant and equipment and materials, to enter upon the Easement Area to pass and repass along the same at all times for the purposes of using and repairing the Works and in so doing the Council’s Employees may:

(1) remove and replace the Works with new Works; (2) change the size and number of any pipes forming part of the

Works; (3) extend, deepen, widen, repair, renew, mow, cleanse, add to,

inspect and maintain the Works including altering, replacing, relaying or changing the size, shape or type;

(4) dig into, sink shafts into and open and break up the soil of the Easement Area;

(5) remove and dispose of soil created as a consequence of the Council exercising its rights under this Easement;

(6) do such other Works and things on or under the Easement Area as are incidental to the exercise of the Council’s rights under this Easement;

(7) take down any fencing or structure erected on the Easement Area.

3. Owner’s Obligations The Owner must not without prior written consent of the

Council: (1) construct or allow to be constructed upon the Easement

Area any buildings or structures; (2) permit the Easement Area to be used in such a way as to

obstruct or interfere with the Works and/or the proper and effective use of the Works by the Council;

(3) install or have installed any concrete or bitumen paths or driveways on the Easement Area or gardens or landscaping using brick, concrete or other permanent materials;

(4) alter the surface level of the Easement Area; (5) obstruct, interrupt, impede, impair, or interfere with or divert

the flow of storm water drainage along the Easement Area and will not change or alter anything done by the Council in terms hereof.

4. Property in Works4.1 The Works remain the property of the Council despite being fixed

to the Easement Area. 4.2 The Council is solely responsible for the maintenance of the

Works. 5. General Notices

(1) Any notice under this Easement must be in writing; and(2) Either party may serve a notice to the other party by:

(a) giving it to that party personally;(b) posting it to the last known address of that party;(c) sending it to the party’s facsimile number.

(3) When served by post a Notice will be deemed to have been received on the second business day after posting and when sent by facsimile will be deemed to have been received at the time at which transmission confirmation is received by the Sender.

6. Construction and interpretation 1.1 Definitions

(1) “Council” means the Council and its successors and assigns;

(2) “Council’s Employees” means each of the Council’s employees, contractors or other persons authorised by the Council;

(3) “Owner” means the Owner and includes;(a) the executors, administrators and assigns of the Owner

and each of them;(b) the registered owner for the time being of the Easement

Area and the land of which it forms part from time to time.

(4) “Easement Area” includes any part of the Easement Area;

(5) “Work” means: (a) open earth drains, pipes or mains for the purpose of

conveying storm water under or over the Easement Area together with all other usual and necessary fittings and attachments; and

(b) works for the protection and/or support of each of those things.

1.1 ConstructionReference to:(1) a person includes:

(a) a corporation and governmental body; and(b) the legal representative, successors and assigns of that

person;(2) a right includes a remedy, authority or power;(3) a gender includes all genders;(4) the singular includes the plural and the plural includes the

singular;(5) any Act includes all amendments or substitutions for that Act

ADOPTION OF ADMINISTRATIVE AMENDMENT NO. 01.2011 TO THE HERVEY BAY CITY PLANNING SCHEME 2006

Notice is given pursuant to section 117 of the SustainablePlanning Act 2009 , that on 7 December 2011, the Fraser CoastRegional Council adopted an administrative amendment to theHervey Bay City Planning Scheme 2006.

The planning scheme amendment will have effect on and from9 December 2011.

The purpose of the administrative amendment is to correct afactual matter within the Detached Dwelling Code of the HerveyBay City Planning Scheme 2006, and also the Amenity andAesthetics policy titled ‘Amenity and Aesthetics Considerationsfor Development (Amenity and Aesthetic Impact of ParticularBuilding Work) Council Policy’ (A & A) to exclude decks, patios,pergolas, verandahs and gazebos from being included in thecalculation of the total use area of Class 10a buildings, whichwas initially intended to regulate the size of car ports and sheds.

The general effect of the amendment will provide greater certaintyabout Council’s intention to regulate the size of sheds andcarports, but not patios, decks and the like whilst also reducingthe number of unintentional concurrence agency referrals.

THE CITY OF LOGAN

Note 1 The reference rate of $137,149 is a rate determined by the Tribunal and is the annual base salary payable to Members of the Queensland Legislative Assembly on and from 1 August 2011.

Note 2 The monetary amounts shown are per annum figures. If an elected representative only serves for part of a calendar year they are only entitled to a pro-rata payment to reflect the portion of the year served.

Note 3 Mayors, Deputy Mayors or Councillors over 75 years of age may qualify for additional remuneration in lieu of contributions foregone because of taxation laws which prevent Local Governments from making voluntary superannuation contributions for Councillors over that age. Local Governments may make submissions to the Tribunal for approval to vary the remuneration of any Councillors over 75 to reflect the level of voluntary superannuation contributions which would otherwise have been paid.

Note 4 Where 'A' appears this indicates that the Local Government was affected by amalgamation on 15 March 2008.
