Chairman Bruce Buxton called to order the regular meeting of the City of East Gull Lake Planning and Zoning Commission at 6:30 PM on Tuesday, April 25, 2017 at City Hall.

VII. Open Forum

Joe and MJ Minkel addressed the Planning Commission regarding the zoning and use of their property. They are concerned that the proposed golf course will have “shortcuts” that will go through their yard. The design was shown and it was explained that the course will be set up in such a way that it probably won’t be a problem. It was noted that when the plan comes to the Commission, all the traffic patterns will have to be discussed.

Administrator Mason reviewed the inspections that took place during the last month.

G. Zoning Map Discussion Administrator Mason opened discussion regarding the zoning map and possible changes to make. Discussion ensued regarding the duplicity of the current zones. Chair Buxton stated that a Land Use Map showing current usage would be helpful in updating the definitions of each of the districts. It was noted that the Comprehensive Plan can move forward, but the zoning district definitions need to be addressed with a work session before updating the zoning map and going to the public. It was noted that the zoning district definitions should reflect how the City wishes properties to be improved. Chair Buxton noted that it is important to decide the zoning districts before updating the zoning map. Some discussion points for updating the types of districts were as follows:

• Noting PUD and CUP are for all districts

• Combining the Commercial Waterfront and Commercial Districts

• Creating a Resort District that would require a Conditional Use Permit for any improvement.

• Consolidating districts, simplifying definitions ✓ Keep R1, R2, and R3 as they are ✓ Commercial of some type ✓ Public Use ✓ PUD and Resort Overlay

• Removing the Recreation zone

Hearing: Conditional Use Permit (CUP) 2017-19 Applicant: JR & Jane Spalj Legal Description or Property Address: 1100 Green Gables Rd Purpose: Due to the elevations of the lot, City Code section 8.5-5 section 6, Shoreline Residential R-3 requires a 3-foot separation from the groundwater to the floor of the crawlspace. This condition cannot be met without an addition of approximately 554 cubic yards of fill to create the stormwater retention areas and provide top soil to be added to raise the building site. A Conditional Use Permit is required when filling more than 50 cubic yards in an R-3 zone. Staff Report

Application #: 2017-19 - Conditional Use Permit (CUP) Parcel number: 87-347-0100 Applicants: JR & Jane Spalj on property described as Legal description, located at 1100 Green Gables Rd, East Gull Lake, MN 56401. An application was submitted to request a CUP to the City of East Gull Lake. The property is located in the R-3 zoning district and contains 48,057 square feet on the lakeside property west of the road, riparian to Gull Lake (General Development). Directions to property: From City Hall proceed North on Squaw Point Rd ¾ mile to Green Gables Rd, take a right and proceed ¾ of a mile to 1100 Green Gables Rd. A conditional use permit is required based upon the addition and grading of approximately 400 to 500 cubic yards of fill and top soil, based upon city code Section 8.5 – 5 item 3 in the R-3 zone limiting grading and fill outside the shoreland impact zone to 50 cubic yards or less. EGL Comprehensive Plan Policies: 1. Protect the area’s lakes from damage and degradation. 2. Maintain and support the resort community in the City. 3. Preserve and enhance the scenic beauty and natural plant communities of the area. 4. Work to improve recreation opportunities for residents and visitors throughout the City. 5. Strengthen the bond that make the people who live in, work in, and visit East Gull Lake identify with the

community. Staff Findings of Fact: 1. A new 5,293 sq ft home will be built on the site 2. Height of new home is approxamatly 28 feet to the roof peak 3. Concrete Slab is 3.7 feet above the OHW of 1194 feet 4. Setback from OHW is 50 feet to the front of the patio of the home. 5. Site from the road to the lake is 48,057 Sq Ft, total square footage for the lot including across the road is

119,613 Sq Ft based on the Cass County GIS estimate 6. Total Impervious proposed with house, terraces, driveway, and retaining walls, is 11,800 Sq Ft or 24.55%

for the Road to the lake measurement of impervious and 9.8% for the entire property. 7. Based on impervious being over 20%, a stormwater management plan has been prepared with two catch

basins of 2,976 cubic feet and 1,026 cubic feet for a total of 4,002 Cubic Ft to capture a 5 year / 24 hour storm event as projected for a net area of 38,836 sg ft to be estimated at 3,136 cubic Ft of run off volume per 8.5-5 section 7- B-1 of the City Code for the R3 zone.

8. A 2,976 Cubic Ft of storage volume retention area will be created with pervious pavers in the parking area and including the storage within the underground retention area below the surface of the parking area. Another 1,026 Cubic Ft of storage will be created by building the lakeside berm to prevent direct run off into Gull Lake.

9. Elevations currently are about 1,200 ground level on the building site per survey, lake level is 1194. A 3 foot seperation above highest known groundwater per 8.5-5 section 6 table of the City Code is required. A 1,204 top of subfloor height is anticipated in new construction.

10. In terms of truck traffic on the newer road, we anticipate approxamatly 46 loads at 12 yards per load

Planning Commission Direction: The commission can recommend approval of the conditional use permit, recommend denial of the conditional use permit or table the request if additional information is needed. If the recommendation is for approval or denial, findings of fact should be cited. Staff Recommendation: Staff recommends that the Conditional Use Permit be approved based on the findings of fact listed above. We also recommend the following conditions: 1. Silt fencing will be required between the building site and lakeshore as well as sideyard setback areas

where the grading and fill will occur. 2. Maintain in perpituity the Stormwater system installed on the property in 2013 as part of the Green

Gables Road reconstruction project the easement for the City Stormwater control on Green Gables Rd. 3. Create and maintain stormwater plans as presented to the City to retain water from entering the lake

directly or the neighboring properties. 4. Any Sump pump sytems within the property will be discharged into the stormwater management systems

and not into the City Sewer. 5. Existing Storm drains in the Street shall remain in place and the driveway must work around them, If

owners wish to move them, it would be a their expense and built to City Engineers specs. Any damage to the street surface would also be repaired to City Engineers specs.

6. Road should be regularly swept to eliminate excessive dirt that could clog our stormwater system and to maintain the road in good condition for busy summer traffic.
