PUBLIC MEETING – Wednesday, March 11, 2020 at 8:00 p.m. 

 

There will be a Public Meeting of the Mayor and Council of the Borough of Glen Rock

on Wednesday, March 11, 2020 at 8:00 p.m. in the Council Chambers of the Municipal

Building. 

 

Agenda: (May be subject to change)  

 

1. CALL TO ORDER /ROLL CALL 

This meeting is called pursuant to the provisions of the Open Public Meeting Law. This

Meeting was included in a list of meeting notices sent to the Bergen Record and advertised in

said newspaper in January, posted on the bulletin board in the Municipal Building, and has

remained continuously posted as the required notices under the Statue. In addition, a copy

of this notice is and has been available to the public and is on file in the office of the Municipal

Clerk.

In accordance with the New Jersey State Fire & Safety Code I call your attention to the

lighted exit signs. In the event the alarm sounds, move in an orderly manner toward the exit

nearest you and leave the building.

2. FLAG SALUTE/ANNOUNCEMENTS

Eagle Scout Colin Blake led the audience and Council in the flag salute.

A Moment of Silence was recognized in remembrance of Hank Allen, a 60 year resident,

Veteran and volunteer. Communities experiencing issues related to the Coronavirus were

also remembered.

Mayor Morieko stated that on March 2nd there was a house fire and thanked Joanne Perry

of Office of Emergency Management who worked with her to get the family assistance. They

were joined by Council Members Dill, Gilbreath and Martin. Thanked neighboring

communities for their collaboration and assistance.

March 2nd was Read Across America Day, Mayor Morieko along with other dignitaries read

at Byrd School and reminded everyone that the Read A Thon is going on now.

Mayor Morieko and Borough Administrator Lenora Benjamin attended a conference call

today led by Bergen County Health Officer. It was announced that there at 10 confirmed

cases of the Coronavirus in Bergen County, 23 confirmed cases in New Jersey and 1,039

confirmed cases in the United States. There are zero confirmed cases in Glen Rock at this

time. While this is rapidly evolving, Glen Rock as a whole is prepared. The first responders


are prepared and there are engaged in ongoing conversations with County officials, local

officials and OEM. All communications will be handled by the OEM. The most important

things to keep in mind are to wash your hands for at least 20 seconds, avoid handshakes,

contact and self-quarantine if feeling ill. The two most vulnerable groups are anyone over

60 years of age and those with an underlying medical condition. As of 5pm today all Senior

Centers in Bergen County will be closed indefinitely, long term care facilities will not allow

visitors unless patient is in Hospice care. Jury duty will be waived in you fall under one of

the protected classes; elderly, sick or have an underlying medical condition. No training at

the gun range and the Police Academy has been suspended, Bergen Academy and Technical

Schools are closed until further notice. Daily updates are being provided by the County.

Tomorrow night an emergency preparedness meeting has been called for community

stakeholders including the Library, OEM, department heads, representatives from Glen

Courts, leaders of religious communities and the school superintendent will be sending

someone in his absence. The County Health Inspector clarified the protocol for closing

schools for 2 weeks. The first step is that the Health Officer would make a recommendation

to the Superintendent. The Superintendent then must meet with the Mayor to discuss, after

discussion a letter would be forwarded to the Superintendent of the Bergen County School

System then forwarded to the Commissioner of Education at the State level. All updates will

be done be way of a reverse 911 call and all other outlets used to notify residents.

Proclamations

A Proclamation was read by the Mayor and Council honoring Eagle Scout Colin Blake.

WHEREAS, in Boy Scouts, an important step in achieving the Eagle Scout award is presented to the

scout in the form of a challenge: The Scout is asked to demonstrate that he, the Eagle candidate, can,

through a project that he manages, relate to a community and contribute to its needs …both the Scout and

the community become better for the experience; and

WHEREAS, by providing the Glen Rock community with a useful and tangible permanent

improvement…specifically, Colin improved the playground at the Glen Rock Cooperative Nursery

School by removing a dangerous condition and leveling the playground and adding a beloved

sandbox.….Colin demonstrated both the value of his own Scouting experience and his ability to focus and

refine and contribute to others his qualities of enthusiasm, determination and acceptance of responsibility.

THEREFORE, it is the finding of this Mayor and Council that Colin Blake’s substantial accomplishment

will continue to sustain his development as a Scout and as a leader, and will also support his community

with equal commitment; and

THEREFORE, for all that he has done for the Borough, the Mayor and the Borough Council of Glen

Rock, offer our congratulations and declare that, for the time period 12.01 am to 11.59 pm on his

birthday, Saturday, July 19, 2020, the name of the Borough will be changed to Colin Blake Rock, NJ

07452.

A Proclamation honoring Bagel Gourmet was read by the Mayor and Council.

WHEREAS, in 1986 Joe Marrara opened a bagel shop on Rock Road that quickly became a hub of the

community where residents came, not only to eat delicious food, but to talk and connect,

WHEREAS, Joe employed hundreds of Glen Rock teens, and with help from Rob “Coach” Wilson

mentored and encouraged these employees to become entrepreneurs themselves,

WHEREAS, despite extensive damage caused by a fire in December 2005, Bagel Gourmet came back

better than ever to serve the residents of Glen Rock,

WHEREAS, Joe and Coach have been baking in the pre-dawn hours every day, sometimes as early as

2:30am, to be ready to serve Glen Rockers on their way to work and to school,

WHEREAS, Bagel Gourmet has baked 7,500,000 bagels in the 34 years it has been open and has become

part of the fabric of our town,

THEREFORE, the Mayor and Council would like to formally thank Joe Marrara, Rob Wilson and all the

Bagel Gourmet staff for bringing joy, delicious bagels and a sense of community to our mornings.

WHEREAS, New Jersey women of every race, class and ethnic background have made historic

contributions to the growth and strength of our nation, state, and Borough in countless recorded and

unrecorded ways; and

WHEREAS, women have played and continue to play a critical economic, cultural and social role

in every sphere of life by constituting a significant portion of the labor force working inside and

outside of the home; and

WHEREAS, women have played a unique role throughout history by providing the majority of the

volunteer labor force of our Nation; and

philanthropic, and cultural institutions in our Nation; and

industrial labor, civil rights and peace movements, which create a more fair and just society for all;

and

WHEREAS, women have served our country courageously in the military; and

undervalued, in the literature, teaching and study of American History;

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of Glen Rock herby join

the national celebration of Women’s History Month to recognize and reflect upon the

accomplishments of women; and

BE IT FURTHER RESOLVED that the Mayor and Council of Glen Rock honor and recognize

the Girls on the Run, the League of Women Voters of Glen Rock, and Glen Rock Women in

Community Service for their distinguished service to our community.

Elaine Cunningham, 197 Harding Road – Questioned if there is a new architecture plan for

lesser units for the 261 Rock Road project and if the hearing scheduled for March 20th is still

going to take place. Would like to have any updates to be posted on the website.

Borough Attorney Suarez responded that the hearing is still on for March 20th and there are

no changes to the proposed project at this time and clarified that if the plans are approved

at the hearing there can be an amendment as long as all parties agree.

WHEREAS, the Mayor and Council of the Borough of Glen Rock want to formalize the

procedure for Glen Rock based non-profit agencies to hold events in the Borough of Glen

Rock, on Borough property; and


WHEREAS, the requirements for such agencies include providing insurance of $1,000,000

of general liability coverage, to the Borough of Glen Rock, naming the Borough as

additionally insured, and providing the Borough with a hold harmless agreement; and

WHEREAS, if such agency uses a third-party vendor to coordinate an event such vendor

will be required to provide insurance of $1,000,000 of general liability coverage, to the

Borough of Glen Rock, naming the Borough as additionally insured, and providing the

Borough with a hold harmless agreement, and obtain hold harmless agreements from each

sub-vendor participant, forwarded to the Borough of Glen Rock for filing; and

WHEREAS, should such agency require the use of Glen Rock Police Services and/or Glen

Rock Department of Public Works Services, the agency will be responsible for reimbursing

the Borough of Glen Rock twenty-five percent (25%) of such cost as estimated by the Chief

of Police and the Director of Public Works.

NOW THEREFORE IT BE RESOLVED that the Borough of Glen Rock include this

resolution, along with the application of use of Borough property to any agency who

proposes to hold events on Borough property, clearly outlining the requirements of

insurance, hold-harmless and reimbursable expenses for Police and DPW expenses.

RESOLUTION APPROVING FINAL CERTIFICATION OF LENGTH OF SERVICE

AWARD PROGRAM (LOSAP) LISTS FOR 2019 FOR GLEN ROCK VOLUNTEER

AMBULANCE CORPS MEMBERS AND GLEN ROCK VOLUNTEER FIRE

DEPARTMENT MEMBERS

WHEREAS, the Mayor and Council are in receipt of a certified list of credits for LOSAP

from Bruce D. Rigg, Local Plan Administrator, a requirement under the law establishing

LOSAP for qualified ambulance and fire volunteers of Glen Rock, and

WHEREAS, there are twenty-one (21) members of the volunteer ambulance corps and

sixteen (16) members of the volunteer fire department, for a total of thirty-seven (37) that

qualify for this benefit for the year of 2019, at an amount of $1,492.03 per qualified

participant, for a total investment of $55,205.10.

NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of Glen Rock, that the

attached certified list for the year 2019 is hereby approved and instructs the Borough Clerk

to forward a copy of the approved resolution to the Local Plan Administrator as required in

LOSAP regulations and post such list in the municipal building for a period of 30 days.

9. Resolution for Poison Prevention Week




NATIONAL POISON PREVENTION WEEK

WHEREAS, Congress designated the third full week of March to be National

Poison Prevention Week in 1961, and since then this week has helped to raise

national awareness of the dangers of potentially poisonous medicines, household

chemicals, and other substances; and

WHEREAS, each year the Nation’s poison control centers answer more than 2.6

million calls; and

WHEREAS, 93 percent of poisonings occur in people’s homes and 45 percent of

poisoning exposures involve children under age 6; and

WHEREAS, the people of Glen Rock, NJ recognize the importance of coming

together as a community to educate ourselves on poison prevention and pledge our

commitment to ensuring the safety of ourselves, our families, and our community.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the

Borough of Glen Rock, hereby proclaim March 15-21 to be National Poison

Prevention Week in Glen Rock and encourage all to join in this observance.

5. Resolution Supporting Challenge to EPA’s repeal of Clean Power Plan

A Resolution in support of joining a coalition of local governments in support of the legal

challenge to the U.S. Environmental Protection Agency’s Actions Repealing the Clean

Power Plan and Issuing the Affordable Clean Energy Rule

WHEREAS, in October of 2015, the U.S. Environmental Protection Agency (EPA) issued the

final Clean Power Plan Rule (CPP), and represents the broadest federal action to date aimed at

reducing Green House Gas (GHG) Emissions; and

WHEREAS, in September 2019, the EPA repealed the CPP and replaced it with the Affordable

Clean Energy (ACE) Rule; and

WHEREAS, the ACE Rule would fail to achieve meaningful reductions in greenhouse gas

emissions; and

WHEREAS, the U.S. Supreme Court ruled in Massachusetts vs. EPA (2007) that greenhouse

gases are “air pollutants” as defined by the Clean Air Act and the EPA has the authority to

regulate them; and

WHEREAS, power plants are the single largest stationary source of greenhouse gas emissions in

the country; and

WHEREAS, numerous scientific bodies, including the U.S. Global Change Research Program,

American Association for the Advancement of Science, and the Intergovernmental Panel on

Climate Change have recognized that greenhouse gas pollution created by the burning of fossil

fuels is contributing to global warming.

BE IT RESOLVED by the Council of the Borough of Glen Rock, New Jersey, that Glen Rock

hereby joins a coalition of national local government organizations as amici curiae in support of

the -legal challenge to the EPA’s repeal of the CPP and issuance of the ACE Rule by the

adoption of this Resolution.

WHEREAS, the Mayor and Council of the Borough of Glen Rock recognize the need to

amend Chapter 101, Section 11 of the Borough Ordinance as follows:

Now, therefore, be it ordained as follows:

SECTION 1.

Chapter 101, Section 11 of the Borough Code of the Borough of Glen Rock is amended

and supplemented as follows:

A. The following is a fee schedule for basic automobile, motorcycles, motorized bikes,

towing services and heavy-duty recovery.

(1) Light Duty (Up to 10,000 lbs.) Hook up $150.00 per hour;

(2) Medium Duty (10,001-16,000 lbs.) $250.00 per hour;


(3) Heavy Duty (16,001 and above) $500.00 per hour;

(4) Decoupling Fee (If tow is not performed) ½ of basic rate;

B. The following is the rate for road service.

(1) Cars (Light) $125.00 per hour plus parts;

(2) Trucks (Medium/Heavy) $175.00 per hour plus parts;

C. The following is the rate for on-hook mileage.

(1) Light Duty $6.00/per loaded miles;

I. After the first hour, all hourly billable rates will be charged in half hour increments.

Charges for all trucks/recovery equipment are inclusive of the operator. There cannot be

SECTION 2.

All other parts, portions and provisions of Chapter 101, Section 11 of the Borough of

Glen Rock Code, be and the same, are hereby ratified and confirmed, except where inconsistent

with the terms hereof. In the event of any such inconsistency, the terms of this Ordinance shall

be deemed to govern.

SECTION 3.

The terms of this Ordinance are hereby declared to be severable; should any part, portion

or provision hereof be declared invalid or unconstitutional, said finding shall not affect any other

part, portion or provision thereof.

SECTION 4.


This Ordinance shall take effect immediately upon final passage and publication

according to law.

Chapter 216, Section 39, Schedule XI: Traffic Control, is amended as follows:

The following portions are deleted:

Ackerman Avenue Trucks exceeding four tons, right turn from south on

Ackerman Avenue to West on Rock Road.

Broad Street Trucks exceeding five tons, southbound turn out of any

commercial or residential property.

Lincoln Avenue Vehicles exceeding a registered gross weight and its load of

15 tons gross vehicle weight rating (GVWR), as specified

in

N.J.S.A. 39:3-10.11, as amended, no left turns from

Lincoln Avenue on Van Winkle Avenue.

Rock Road Improper access to angle parking: Angled parking along

The southerly curb line of Rock Road between Jean Baker

Wunder Way and Main Street may only be accessed by

Eastbound traffic along Rock Road.

SECTION 2.

All other parts, portions and provisions of Chapter 216 of the Borough of Glen Rock

Code, be and the same, are hereby ratified and confirmed, except where inconsistent with the

terms thereof. In the event of any such inconsistency, the terms of this Ordinance shall be

deemed to govern.

6. Announcements

Mayor Morieko stated that the NJ Department of Health has a 24 hour hotline and the

phone number is 1-800-222-1222. Simple actions can help the spread of viruses. These

actions including avoid close contact with people who are sick, avoid touching your eyes,

nose and mouth with unwashed hands, wash hands for at least 20 seconds with soap and

water if not available use a hand sanitizer that contains at least 60% alcohol, if you are

sick stay home and keep children home when they are sick to reduce the spread, cough or

sneeze into a tissue then throw in trash, clean and disinfect frequently touched objects and

surfaces.

Council Member Kreibich explained that the DEAL contract has run halfway through its

18 month period. Our supplier Direct Energy sent a letter to the Borough last month

stating our rate will be increasing, this increase will be imposed on by all suppliers. Due to

the rate increase the Borough is now negotiating with Direct Energy if the negotiations fail

the plan will end next month in April and all customers will be switched back

automatically to PSE&G. Information on PSE&G rates is available on the PSE&G and

BPU websites. More information will be shared as it becomes available.

Council Member Gilbreath stated invitations to the Census will be mailed between March

12th and 20th to households. Responding can be done online, by telephone or by mail,

please respond by April. The Census is important because it assists in obtaining Federal

funding and in 2010 NJ lost a seat in The House of Representatives due to a lower census.

Cautioned residents about scams and advised that The Census Bureau u will never ask for

your social security number, never ask for money, donations and bank or credit card

information. If you respond to the Census by the end of April no one will come to your

door. There is a job fair at the Library tomorrow from 6pm-8pm, the hourly rate is $19-

21, and applicants need to be 18 years old, representatives for Census Bureau will be

there.

Council Member Barchetto reminded residents that parking permits are on sale through

March 15th, please purchase online. The option to purchase in person is available if

unable to complete online. The senior St. Patrick’s Day Luncheon scheduled for March

18th is cancelled and will contact all those who signed up to reschedule for a later date.

Council Member Unzaga stated Borough 101, an informative presentation on our form of

government will will be held on April 15th at Borough Hall at 7pm in Council Chambers,

everyone is welcomed to attend.
