II. OVERVIEW The Growth Management Department (GRM) is reviewing and updating the county’s Comprehensive Plan to ensure consistency with Florida’s Growth Management law and current county policies. Chapter 163.3177, Florida Statutes provides the guidelines for required and optional Comprehensive Plan elements. Solid waste is a required element. The Solid Waste element is designed to provide a broad framework for unincorporated Volusia County’s solid waste program. The solid waste element has undergone an extensive review internally and externally. Professionals in the Planning and Development Services Division, Solid Waste Department, Public Works, and Environmental Management worked closely together to review and comment on the adopted element. The document was also sent to the municipalities, Volusia County Association for Responsible Development (VCARD), and other interested parties who requested to participate in comprehensive plan reviews. No comments were received by VCARD or the municipalities prior to the PLDRC hearing. The proposed changes are outlined below. Historically, the comprehensive plan was formatted in hierarchy to include a single utilities element, with several sub-elements. Sub-elements of the utilities element included sanitary sewer, potable water, solid waste, and drainage. The plan was reformatted over time to create a single hierarchy, with a separate element for each type of utility. When this change was made, the naming convention was not updated to reflect the new hierarchy. This update removes all references to a “sub-element.” The planning horizon for the solid waste element was extended to 2035 to be consistent with the other elements that were recently updated. A new introduction was written by the county’s Solid Waste Director to reflect current practices in the industry. Recycling remains an important part of the element, and policies have been updated to reflect changes to recycling targets over time. Policy 8.1.1.10 was deleted because the closure of the Plymouth Road Landfill was successfully implemented. Policy 8.2.1.6 was deleted because the county plans to focus on maximizing the capacity of the Tomoka Farms Road Landfill instead of searching for a new landfill site. Plans are underway to permit additional capacity that will extend beyond the current planning horizon. The criteria for siting future solid waste transfer stations was modified slightly by removing the requirement to site facilities near concentrations of high volume generators. A requirement was added for the availability of a water supply for fire protection. The criterion for short term storage of hazardous waste at transfer facilities was deleted. Household hazardous waste is accommodated at the Tomoka Farms Road Landfill. The county’s Fire Services and the Environmental Management staff recommended changes to hazardous waste generators. Policy 8.3.2.2 was deleted because the state–mandated small quantity generator program requires inspection of each business directly and does not leave literature with the tenants. Environmental Management staff determined that Policy 8.3.3.3 captures the intent of the program. Policy 8.3.3.4 was

Page 3: PUBLIC HEARING: Commission (PLDRC)

modified to acknowledge the need to notify Fire Rescue staff of hazardous waste violations and to remove the reference to local guidelines. Fire rescue is regulated by the state and federal government and does not require guidelines from the local Environmental Management staff. Policy 8.3.3.5 was deleted because Fire Services is a critical service that is funded through the county’s general fund. “Social media” and “The Internet” were added to policies as additional ways to educate and notify constituents of the county’s household hazardous waste program. III. STAFF RECOMMENDATION Find the amendment consistent with the comprehensive plan and forward the application, case number CPA 21-008, to county council with a recommendation of approval to transmit to the Department of Economic Opportunity for review and the Volusia Growth Management Commission (VGMC) for certification. CHAPTER 8 SOLID WASTE SUB-ELEMENT A. OVERVIEW The purpose of the Solid Waste Sub-element of the Comprehensive Plan is to provide effective and safe disposal of solid waste for the present and anticipated future residents of Volusia County. The requirements of this Sub-element have changed dramatically as a result of the passage of the Solid Waste Management Act in 1988 by the Florida Legislature. The modern era of solid waste and recycling management in Florida began with the Florida Legislature’s passage of the Solid Waste Management Act (SWMA) of 1988, including a 30% recycling goal. In 2008, the Florida Legislature, through the Energy, Climate Change and Economic Security Act of 2008, established a new statewide weight-based recycling goal of 75% by 2020.This law mandated all counties to reduce their solid waste stream by 30 percent by 1994. Counties were required to initiate a recycling program by July 1, 1989, and to meet an extensive list of recycling responsibilities. The Solid Waste Management Act required a Full Cost Accounting Program,The Solid Waste Division adheres to the reporting requirements of the legislation. Chapter 62-708, F.A.C. requires Volusia County to annually calculate the full cost of solid waste management. Chapter 62-716.450, F.A.C. requires Volusia County to submit a solid waste and recycling annual report to the Florida Department of Environmental Protection by April 1 of each year.an annual report to the Legislature and numerous other rule changes that will increase the cost of solid waste disposal in Volusia County through the year 2025. Tipping fees at the landfill increased on October 1, 1989. The Plymouth Avenue landfill closed January 1996 and the West Volusia Transfer Station began operation at that time to properly dispose of material from the County's west side residents and businesses. The Solid Waste Division manages and operates the Tomoka Farms Road Landfill, the West Volusia Transfer Station and maintains the closed Plymouth Avenue Landfill. Tipping fees are authorized by Resolution 2018-179 and may be amended when necessary by the County Council at a duly advertised public hearing. The management of solid waste is important to the health, safety and welfare of all Volusia County residents. The proper management of solid waste is particularly important to the Aquifer Recharge, Sanitary Sewer, and Potable Water Sub-elements of the Comprehensive Plan. Improper disposal of solid and hazardous waste in unauthorized areas can contaminate our drinking water or expose residents to dangerous health risks when toxic chemicals are illegally disposed of in residential neighborhoods. In July 1988June 2020, S2L, Incorporated completed an update to the Tomoka Farms Road Ten (10) Year Development Plan. the consulting firm of Camp Dresser & McKee prepared a Solid Waste Management Plan which presents feasible solid waste disposal alternatives for waste generated in Volusia County from 1990-2010. This report recommends a solid waste disposal plan for the County to follow, and includes short-term (0-5 years) and long-term (5-20 years) costs for implementing the recommended solid waste disposal plan and plans for current and future disposal capacity, stormwater drainage improvements, recycling and alternative energy opportunities, leachate management improvements, and costs for implementation. In May 2020, Neel Schaffer completed the Feasibility Study and Conceptual Design for the West Volusia Transfer Station Expansion and Improvements. This report recommends and plans for entrance and site

improvements, stormwater management, customer convenience center expansion and transfer building expansion to fully service growth on the west side of Volusia County. This These plans meet the requirements of Section 163.3177 (6) (c), Florida Statutes and the Solid Waste Management Act of 1988 and the Florida Legislature, through the Energy, Climate Change and Economic Security Act of 2008 which establishes minimum requirements for the content of the Solid Waste Sub-element. The adopted components of the Solid Waste Sub-element include the Overview, the Goals, Objectives and Policies. Three reports The Solid Waste Management Plan andTen Year Development Planthe Feasibility Study and Conceptual Design for the West Volusia Transfer Station Expansion and Improvements and a hazardous waste report prepared by Volusia County Growth Management Division, and a recycling marketing study by the consulting firm of Dyer, Riddle, Mills and Precourt are printed separately as support documents for this Sub-element. This Comprehensive Plan and these support documents provide for the proper management and disposal of solid and hazardous waste through the year 2025 to provide in excess 100-years of disposal capacity. Excerpt from 163.3177 Required and optional elements of comprehensive plan; studies and

surveys.

(c) A general sanitary sewer, solid waste, drainage, potable water, and natural groundwater aquifer

recharge element correlated to principles and guidelines for future land use, indicating ways to provide

for future potable water, drainage, sanitary sewer, solid waste, and aquifer recharge protection

requirements for the area. The element may be a detailed engineering plan including a topographic map

depicting areas of prime groundwater recharge.

1. Each local government shall address in the data and analyses required by this section those facilities

that provide service within the local government’s jurisdiction. Local governments that provide facilities

to serve areas within other local government jurisdictions shall also address those facilities in the data

and analyses required by this section, using data from the comprehensive plan for those areas for the

purpose of projecting facility needs as required in this subsection. For shared facilities, each local

government shall indicate the proportional capacity of the systems allocated to serve its jurisdiction.

2. The element shall describe the problems and needs and the general facilities that will be required

for solution of the problems and needs, including correcting existing facility deficiencies. The element

shall address coordinating the extension of, or increase in the capacity of, facilities to meet future needs

while maximizing the use of existing facilities and discouraging urban sprawl; conserving potable water

resources; and protecting the functions of natural groundwater recharge areas and natural drainage

features.

3. Within 18 months after the governing board approves an updated regional water supply plan, the

element must incorporate the alternative water supply project or projects selected by the local

government from those identified in the regional water supply plan pursuant to s. 373.709(2)(a) or

proposed by the local government under s. 373.709(8)(b). If a local government is located within two

water management districts, the local government shall adopt its comprehensive plan amendment within

18 months after the later updated regional water supply plan. The element must identify such alternative

water supply projects and traditional water supply projects and conservation and reuse necessary to

meet the water needs identified in s. 373.709(2)(a) within the local government’s jurisdiction and include

a work plan, covering at least a 10-year planning period, for building public, private, and regional water

supply facilities, including development of alternative water supplies, which are identified in the

element as necessary to serve existing and new development. The work plan shall be updated, at a

minimum, every 5 years within 18 months after the governing board of a water management district

approves an updated regional water supply plan. Local governments, public and private utilities, regional

water supply authorities, special districts, and water management districts are encouraged to

Page 22: PUBLIC HEARING: Commission (PLDRC)

cooperatively plan for the development of multijurisdictional water supply facilities that are sufficient

to meet projected demands for established planning periods, including the development of alternative

water sources to supplement traditional sources of groundwater and surface water supplies.

4. A local government that does not own, operate, or maintain its own water supply facilities,

including, but not limited to, wells, treatment facilities, and distribution infrastructure, and is served

by a public water utility with a permitted allocation of greater than 300 million gallons per day is not

required to amend its comprehensive plan in response to an updated regional water supply plan or to

maintain a work plan if any such local government’s usage of water constitutes less than 1 percent of

the public water utility’s total permitted allocation. However, any such local government is required to

cooperate with, and provide relevant data to, any local government or utility provider that provides

service within its jurisdiction, and to keep its general sanitary sewer, solid waste, potable water, and

natural groundwater aquifer recharge element updated in accordance with s. 163.3191.
