Chairman Jim Church called the meeting to order at 5:00 p.m
A motion was made by Alli Karrels and seconded by Ed Lukasek to approve the consent agenda
consisting of the minutes of the March 3, 2014 meeting and Police Department's monthly report forFebruary and bills. Motion carried 3-0.
Upon payment of all fees and fines, a motion was made by Ed Lukasek and seconded by Alli Karrels toapprove the following new or renewed bartender's licenses. Motion carried 3-0.

ln previous meetings the subject of street use permits was talked about. Chief Kass was wondering if we
should just have a special use permit instead ofjust a street use permit which could be used for otherrequests. lt would be nice to establish some guidelines or standards and also find out if the City wouldbe liable or not. Chief Kass would like the members to read over the handout and let him know whatquestions they have so he can have more information at next month's meeting. A motion was made byEd Lukasek and seconded by Alli Karrels to table this until next month, Motion carried 3-0.
The committee would like to look at options to our current ordinance which would allow bartendersthat have been issued a citation while working to be able to go back to work earlier than one year.
Maybe there could be some additional training or class they could take to be able to go back to work.Chief Kass had some information for the members to read over as an example. This will be brought back
to the committee at a later date.
An item for future consideration was to have a special meeting in reference to the beer referendum and
issuance of Class "A" beer licenses
A motion was made by Ed Lukasek and seconded by Jim Church to adjourn at 5:15 p.m. Motioncarried 3-0.

Chairman Jim Church called the meetin8 to order at 5:00 p,m
Todd had our current ordinance for Class "A" licenses on the overhead. The yearly charge for thislicense is S100.00 and is prorated. Chief Kass went over some of the guidelines for selling beer in thestores. There does not have to be a separate room, an application is needed for the business, a
bartender's application is needed, and the owner or the licensed bartender has to be in control of the
sale. There will also be compliance checks done, fines and hours were discussed. The Police
Department would conduct training for the business if they are asked to, lf a business would like to be
able to sell by Memorial Day, the applications have to be submitted on or before Monday, April 21,
2014. There were questions asked and answered and the forms will be handed out after this meeting.
An item for future consideration was to change the starting time for the Public Safety Meeting
A motion was made by Ed Lukasek and seconded by Josh Lydon to adjourn at 5:25 p.m. Motioncarried 5-0.

During the month of March the Sparta Police Department responded to 1151 calls for service, issued 155 traffic citations, arrested 7 persons for Operating While Under the Influence and made 160 non-traffic related arrests. Overall activity level was similar with the prior year.

Chief’s Report
Officer Andrew Kuen officially started his Detective position this month. He will be working with Detective Meyers on major cases and drug investigations. During the month of March we conducted Alcohol Compliance Checks on thirteen different establishments and experienced two failures. The American Legion and Scoreboard both failed and were cited for the violation. The locker room project has been framed in and dry walled; we are now awaiting the lockers so the project can be completed. We anticipate the lockers will arrive in May. The Police Commission established a Sergeant Promotional process and interested SPD candidates had until March 31, 2014 to submit a letter of interest and resume. The promotional process is expected to last until May or June. Training
Officer Nelson and Officer Guralski attended WI Association of SWAT Personal training conference. Officer Branigan attended the WI Association of Women Police training conference. Officer Ambrosius and Officer Itnyre attended the Crime Scene Technician trainng conference. Officer Itnyre became an Instructor for Cooper Police Physical Fitness Officer Nelson attended the Tactical Emergency Medicine Training Summit.

The Department recommends denial of an Operator (Bartender) License to Kylee Brooks at this
time. On September 25,2O!3 Ms. Brooks sold alcoholic beveragesto underage personsin
violation of state law and City of sparta municipal code. Ms. Brooks was cited for the violationand the case has not yet been adjudicated. Chapter 12.03(5)B.2(1) allows denial of an operato/slicense based on pending charges when the offense substantially relates to the circumstances ofthe licensed activity.

We've reviewed the Provisional Operator (Bartender) License Application submitted by KellyHansen and recommend denial based on the following:
Applicant is a felony offender and has been convicted of several crimes within the last 5years that include drug related offenses, fraudulent activities and reslsting/obstructingauthoritles. The most recent arrests occurred in December ZO11 and are well within the 5year time frame established by the ordinance.
The recommendation is supported by Sparta City Ordinance 12.03(S)C.4 which regulates theissuing of provisional licenses. we feel Ms. Hansen's recent criminal activity may subject thosewishing to purchase alcoholic beverages to unintended risk and potentially create an atmospherewhere she could conduct additional criminal acts.

Chapter 335. INTOXICATING LIQUOR AND FERMENTEDMALT BEVERAGES
Articie I. Licensing
5 335-8. Revocation and suspension oflicenses.A. Procedure, Except as hereinafter provided, the provisions of 5 i25.12, Wis. Stats., shall be
applicable to proceedings for the revocation or suspension of all licenses or permits
granted under this article. Revocation or suspension proceedings may be instituted by theTown Board upon its own motion by adoption of a resolution, subject to any additionalrequirements under 5 rz5.rz, Wis. Stats., for both suspension and revocation proceedings.
B, Purpose. The purpose of this section is to administratively interpret those portions of theGrand Chute Code relating to alcohol beverage violations and to establish a system forsuspension and revocation,
C. Point schedule.
(r) The scheme of denrerit points is listed according to the type of alcohol beverageviolation. This demerit point system is used to identifo habirually troublesome license
holders who have repeatedly violated state statutes and the Grand Chute Town
ordinances for the purpose of recommending suspension or revocation of theiralcohol beverage license.
(z) Establishments in violation of state statute or Town ordinance will be scheduled tomeet with the Licensing Conrmittee at a time set by the Town Clerk. Below is a list ofviolations for which demerit points will be assessed. Demerit points may be reduced as
shown on the schedule if the license holder has had no violations for three years prior
to the offense and has met the with the Licensing Committee as indicated above.
Failure oFthe license holder to meet with the Licensing Committee will result in a

D. Calculation of violations. In determining the accumulative demerit points against a licenseewlthin rz months or 18 months, the Town shall use the date each violation was committedas the basis for a determination if there has been a conviction. lf the violations are
committed concurrently, the highest point violation shall be assessed.
E, Suspension and revocation of license.
O lf the demerit points accumulated from the date of a violation which results in aconviction meet or exceed 50 points in a twelve-month period, the agent or officer willbe required to meet with the Licensing Committee. The accumulation of points shall
result in suspension or revocation of the license in accordance with the followingschedule, subject to the exception that for violations under 5S 125.07(1)(a) and tz5.o4(5)(a)r, Wis. Stats., such violations may be counted only if the licensee has committedanother violation under 5 rz5.o7(r)(a), Wis. Stats., within 12 months of the presentviolatlon, in which case all violations committed within one year of a prior violationmay also be considered:

(z) When a license is revoked pursuant to this article, the revocation shall be recorded by
the Clerk and no other license issued under Ch. 125, Wis. Stats., may be granted within12 months of lhe date of revocation to the person whose license was rcvoked. No partof the fee for any license so revoked may be refunded.
F. Upon determination by the Town Board, after hearing, that the license is subject tosuspension or revocation, the Clerk shall give nofice of such suspension or revocation tothe person whose license is suspended or revoked. Such suspension or revocation shall
take effect 30 days from the date said notice is given to the licensee. Suclr notice may be
given in person or mailed by cenified nrail to the address of the addressee shown on thelicensee's application. Notice by mail shall be deemed effective three days from the date ofmailing. lf the suspension or revocation is appealed to the Circuit Court by seruice ofnotice of appeal on the Town in accordance with 5 rz5.rz(z)(d), Wis. Stats,, on or before 3odays from the effective date of notlce of suspension or revocation, tlre revocation orsuspension shall be stayed pendirrg a decision by the Circuit Court on the appeal unless theBoard finds that public health, safety, or welfare imperatively require emergency actionand incorporates a finding to that elfect in its order. lf the Circuit Court affirms thesuspensiorr or revocation, the period of suspension or revocation shall then take effect

G. Repossession of license or permit. Whenever any license or permit under this afticle shall
be revoked or suspended by the Town Board or action of any court or Subsection C, itshall be the duty of the Clerk to notify the licensee or permit holder of such susPension or
revocation and to take physical possession of the license or permit wherever it may be
found and file it in the Clerk's ofl'ice.

be canceled unless any of the following apply:
(a) The new licensee is related to the former licensee by blood, adoPtion, or marriage.
(b) The new licensee held a business interest in the previous licensed business, real
estate, or equipment.(c) The former licensee retains an interest in the business or equipment used by the
business.

(d) The new licensee's acquisilion of the business did not involve an arm's length
transaction conslsting of an open market sale in which the owner is willing but notobligated to sell and the buyer is willing, not obligated, to buy.
(z) lf any of the above apply, the new licensee shail inherit the demerit points previously
assessed and be subject to all penalties set forth by this article.

restrictions shall subject the special use permit to automatic revocation withoutfurther notice or public hearing.
(1) LICENSE REQUIRED. No person shall hereafter keep, maintain, conduct oroperate any cabaret as defined in sub. (2) without first obtaining a licensetherefor.
(2) DEFINITION. A cabaret is a place to which the general public is admittedand where entertainment, such as music, singing, vaudeville, or dancing, isfurnished to patrons by the management, or where dancing is allowed, with orwiihout special charge therefor, and where alcoholic beverages are sold.
(3) FEES AND EXPIRATION. The fee for such cabaret license shall be $50.00.Such cabaret license shall expire on June 30 after issuance, and the full licensefee shall be charged for any such license issued on or before January 1 . Forlicense issued after January 1, the fee therefor shall be $25.00. A special onenight license may be issued by the Licensing and lnvestigation Committee for$3.00 for each night. Not more than 3 such licenses shall be issued per licenseyear for each location. Such locatior shall comply with all other requirements ofthis section.
(4) APPLICATION. The application for such cabaret license shall be filed inwriting with the City Clerk for presentation to the Council. Such application shallstate the name and address of the applicant, the location of the premises to belicensed, by street address and legal description, the name or names of thelessees of such premises, if any, the name of the manager to be in charge ofsuch cabaret, a descriplion of other business to be conducted upon the licensedpremises, a statement of the length of time the owners and managers of suchproposed cabaret have resided in the City, together with the employment oroccupation for the past 2 years, and the type of license issued for such premisesto sell intoxicating liquor or fermented malt beverages at retail.
(5) INVESTIGATION AND ISSUANCE. Each application submitted inaccordance with sub. (4) shall be immediately transmitted by the City Clerk to theChief of Police who shall, within 5 days, report in writing to the Licensing andlnvestigation Committee, the results of his investigation and his recommendationon such application; and thereafter such application shall be presented for actionby the Council, at the next or any subsequent meeting thereof, upon the report ofthe Committee. Licenses shall be granted to each applicant who shall beapproved by a majority vote of the Council and shall be issued by the Clerk andcontain with particularity a description of the premises licensed and the nameand address of the licensee. The licenses shall be numbered consecutively

beginning with the number "onen in each year, and such license shall be postedconspicuously in the premises licensed at all times when they shall be in use.
(6) DISCRETION lN THE COUNCIL. The Council may refuse to grant anylicense if such license shall be against the public interest either because of theunsuitability of the location, undesirability or unreliability of the applicant or hismanager, or because of the failure of such applicant or his manager to observethe provisions of this Code in the prior conduct of a cabaret, dance hall, tavern,or other similar place-
(7) LICENSE NOT TRANSFERABLE. No cabaret license shall be transferableas to location or to ownership.
(8) REVOCATION OF LICENSE. The license issued hereunder shall beforfeited or revoked by the Council where the licensee permits disorderly orimmoral conduct on the premises and it shall stand revoked without furtherproceedings upon the conviction of the person holding such license asmaintaining a disorderly, riotous, indecent, or improper house. lf at any time thelicense issued pursuant to this section shall be forfeited or revoked, at least 6months shall elapse before another such license shall be granted on the samepremises or the same license.
(9) CONDTTTONS OF LTCENSE.
(a) Zoninq Area Requlations No cabaret license shall be issued to anyapplicant unless the premises for which license is applied is located inCommercial 1 (C-1) or Commercial 2 (C-2) as defined in this MunicipalCode.
(b) Efficient means shall be employed to prevent the ordinary sounds ofmusic, dancing, singing or entertainment within the cabaret from beingheard on adjoining premises or on the public street. No unusually loudmusic, singing or entertainment or any boisterousness or noisy conduct onthe part of the patrons shall be permitted.
(c) All cabarets shall be well lighted at all times when any patrons shall betherein, and at all times when the same is open to the public.
(d) The opening and closing of cabarets shall be governed by existingopening and closing of Class "B" Combination and Class "8" FermentedMalt Beverages licensed premises.
(e) No prostitute, procurer or vagrant shall be permitted upon thepremises of any cabaret.

(f) No intoxicated person shall remain in any cabaret, and no personbordering on intoxication shall be served any beverage containing alcoholor be permitted to dance in any cabaret.
(g) No entertainment or dancing shall be permitted which shall be vulgar,suggestive, licentious or offensive to public morals and decency.
(h) There shall be in every cabaret premises not less than 2 exit doorsleading to the outside and opening outwardly.
(i) The sale, seryice or consumption of commodities for which licensesare otherwise required shall not be permitted in any c€baret unless theproper license or licenses therefor are obtained for such premises, in thename of the owner or manager of such cabaret.
O Floor Space Requi(ements. No such cabaret licenses shall be issuednor shall any public or private dancing be permitted unless such premisesshall have 200 or more square feet of unobstructed continuous floor spaceavailable for dancing space. The dancing space shall not include the areaenclosed by an imaginary line, 6 feet in front of any bar, and the back barwall, or the area within 3 feet of any part of an exit door, toilet room dooror any exit passageway, or any other space or room which is not usedexclusively by the public. Such open dancing space shall be used fordancing only, and for no other purposes at the time the same is used fordancing.
(k) Compliance Required. Refusal by any person in a cabaret to complywith the reasonable efforts of the proprietor to comply with the provisionsof this section shall be deemed a violation and subject to a penaltyhereunder, as shall refusal of any person to comply with directions of thepolice department, sheriff or deputy sheriff, constable, or any danceinspector in effort to enforce lhe provisions of this seclion in any cabaret.
12.06 PUBLIC AMUSEMENTS AND ENTERTAINMENTS
(1) LICENSE REQUIRED. No person shall conduct a public amusement orentertainment within the City without a license as required hereunder.
(2) PUBLIC AMUSEMENT OR ENTERTAINMENT DEFINED. A publicamusement or recreation is any activity or exhibition to which admission by thepublic is gained upon payment of money or other thing of value. lt includes,without limitation by reason of enumeration, camivals, circuses, exhibitions ofanimals or ficwl, rides, games of chance or skill, public exhibitions, theatricalperformances, shows, concerts, leclures, pool halls, billiard halls, bowling alleys,miniature golf course, golf driving ranges, ice or roller skating rinks and the like.

6. No advertising or signs shall be placed on any fence without priorapproval of the Plan Commission.
(16) VISION TRIANGLES. VISION CLEARANCE. On a comer lot in R, B-2, B-3,
B-4, or M zone nothing shall be erected, placed, or allowed to grow whichmaterially impedes vision between 2-112 and 10' above the centerline grades ofthe intersecting streets in the area bounded by the street lines of such cornerlot and line joining points along such street lines 30'from the point of theintersection.
(17\ Zero lot line housing may be allowed upon compliance with the followingconditions and requirements.
(a) Dwelling must have been constructed after January 1, 2003 and meet allapplicable building code requirements.
(b) Each one-family residence minimum lot size shall be 5,000 square feet.
(c) Each one family lot width shall be at least 45 feet.
(d) All additional applicable district zoning requirements shall be met
