A.01 - MODIFICATION OF APPROVED PROJECTS : GENERAL PRINCIPLES

The selection process for operations to be financed by the Atlantic Area Programme is set out in the Programme Technical Assessment Guidelines (August 2008). The selection criteria have been approved by the Monitoring Committee (MC). These criteria are rigorously defined and made available to applicants in each call for projects. Approval decision process are taken by the MC taking due account of the project rankings against the selection criteria. In order to avoid misrepresentation of financing decisions, operations should be implemented in accordance with the terms and conditions set out in the subsidy contract. Projects should conform to the main characteristics and work plan set out in the grant application, as the selection criteria were applied to the information provided by applicants in the application. Thus, as a general rule, project objectives, working plans, partnership composition and budgetary lines should not be modified. However there will be occasions where there are new circumstances surrounding projects which differ from those against which the selection criteria were applied and subsequent approval was granted by the MC. Sound physical and financial management therefore, sometimes demands appropriate modifications in the interests of achieving work plans which are coherent with the principle of maximising public benefits from the projects. The dynamics of the project and its implementation, and management contingencies often require adaptive measures to ensure compliance with contractual obligations and the Programme rules. This guide aims to present the modalities / procedures for submitting requests for amendment of the Subsidy Contract.

GENERAL PRINCIPLES GOVERNING FOR AMENDMENT OF THE PROJECT

- Changes are allowed in exceptional circumstances.

- Modifications that compromise the positioning of the concerned operations against the selection criteria that informed the basis of the corresponding financing decisions will not be accepted. Only modifications which would have had no impact on the financing decision will be considered.

- ONLY the Lead Partner may submit to the JTS a project revision proposals.

- At the Lead Partner request, the electronic form for project modifications will be made available via the Platform for Collaborative Communication (PCC), within the section specific to the project in the directory "Project Revision" / "Blank Form".

- All the requests for modification are done through this electronic form.

- all the modifications must be authorized, prior to their implementation, by the Managing Authority/Joint technical Secretariat or the Monitoring Committee, according to the Rules and procedures concerning project modifications and the revision of financing decisions.

- The request for modification must be sent to the JTS, by the Lead Partner via the Platform for Collaborative Communication (PCC) within the section specific to the project in the directory "Project Revision" / "Revision Claim".

- After being analysed by the JTS, and eventually corrected, the project modification request will be submitted to the Monitoring Committee (MC), accordingly to decision rules, for information or approval. After closing the MC consultation by written procedure (which have the duration of one week in the case of simple information or two weeks when a formal decision is required), the JTS communicate to partnership the decision trough the PCC.

- In the cases where the project modification has implications in some article of the subsidy contract, it will be prepared an addenda which shall be signed by both counterparts (the Lead Partner and the Managing Authority)

TYPES OF POSSIBLE MODIFICATIONS The table below summarizes the types of possible project modifications during the implementation period.

Modifications that can be requested Type of modifications

Administrative Modifications Regarding modifications: . Identification of the persons mentioned as legal representative, contact person or financial responsible. . The working and documents languages adopted. This kind of modifications may be proposed trough execution report forms, with the exception of the denomination, the legal statute and region of the beneficiaries. Alterations to the denomination, the legal statute and the region of origin of the beneficiaries may have implications on the contractual framing or require the revision of contractual documentation. This kind of administrative amendment requires the consideration of a modification procedure via the project modification form addressed to the JTS. The change of legal representative or partner organizations for the lead organization must be accompanied by relevant documentary evidences. Documents to be attached in certain circumstances (section 8): - Order appointing a new legal representative. -Document justifying a modification of the entity denomination, their legal statute or their located region. -Addenda to the subsidy contract in case of modification of the entity denomination. Note: All annexes shall be attached in PDF format within the section 8 of the project modification form.

Modifications on partnership composition

Those changes regard the withdraw, the substitution or addition of new partners, including modifications concerning associated partners. Notes: (1) Such change has of course other consequences for the organization's work program and budget allocation. (2) The substitution of a partner means that a partner will be marked as withdraw (maintaining their original order number ) and a new partner (with a new order number) will be included in the partnership. Documents to be attached in certain circumstances (section 8): - Co-financing declaration of a new partner (Note: the lead partner has a specific model). -Document justifying a modification of the entity denomination, their legal statute or their located region. -Disclaimer of eventual resigned partner. - Co-financing declaration of a new external financer. -Addenda to the subsidy contract

Modifications regarding the work plan

These include changes relating to: . Activities of the work plan or action constituting each activity. . Contents of activities or actions. . Inclusion of new activities or actions. . Withdraw of activities or actions. . Partners involved in the activities and the type of responsibility. . Expected results, indicators for monitoring the actions or communications related activities. . Schedule for the implementation of the activities. . The budget of the activities that will also mean a change in the "Budget" section of the form. . Extensions to the conclusion date of the project Note: The participation on meetings/events outside the Atlantic Area shall be identified in the description of the concerned operational activity. WARNING : The Lead Partner must be careful not to propose modifications of the work plan channelling to a change of the nature of the project itself as it was originally selected by the Monitoring Committee.

Changes in the organization and functioning of the partnership

These include changes resulting from changes within the partnership and regarding to: . The internal organization of the partnership or a possible adjustment of its internal organization. . Information regarding the core business activities, skills, transnational experience and added value of partner participation.

Changes on the communication plan These include changes regarding: . The general organization of the communication plan. . Description of certain activities of the communication plan.

Changes on budget These changes can affect all components of the budget, external financers, expenses and resources. Transfers between budget line items are subject to certain rules that will be addressed in a separate section of this guide. The changes requested will not: . Cause an increase in the contribution Community. . Aim for a transfer between budget categories to offset expenditure having been cancelled due to irregularities. Documents to be attached in certain circumstances (section 8): - Co-financing declaration of partners which has change their global budget. (Note: the lead partner has a specific model).

Changes on indicators on results and outputs

These include changes on output indicators and / or results. These changes may be consecutive to changes in the work program.

Changes on the annexes This regards the adding of documents considered as evidence for changes requested

HOW MANY REQUESTS FOR CHANGES MAY BE INTRODUCED TO DURING THE IMPLEMENTATION OF THE PROJECT?

The subsidy contract signed between the Lead Partner and the Managing Authority does not mention a limit on the number of possible changes. It is ESSENTIAL that any request for modification is made before the availability of the execution report form in order so that it can take into account the changes requested and accepted. To avoid multiple requests for changes, you should submit only one request for changes between each period of execution report. To maintain an overview of the project implementation, it is recommended that Lead Partners and all partners to make a point annually on the conditions of implementation of the project and make a global request for changes including all the adjustments that may be necessary. Nevertheless, the principle of PRIOR request should be respected. If a request for changes must be done before the annual review, it is necessary to introduce the request for changes BEFORE the possible implementation of such modification. The process for modification request, in addition to the general principles defined previously, follows a logic of management involving one or more structures of program management. All changes shall be introduced through the application form for modifications. However it is possible to propose administrative modifications trough the project report forms. The table below resume the rules established by the Monitoring Committee (MC) concerning the competencies for decision. However, the MC reserves the right to come back over decisions delegated on the Lead Partner or the Joint Technical Secretariat. In situations where the competency to decide remains on the MC, approval are made by written consultation, on two weeks delay. In situations where by delegation the decision is a competency of the Lead Partner or the Joint Technical Secretariat, an information is formally sent to the MC. No procedure of formal approval is required. However, the MC, may pronounce, in a one week delay, about the project modifications submitted.

Availability of the modification form on the PCC The Lead Partner informs the Joint Technical Secretariat by email that of his wish to make a modification. The Joint Technical Secretariat provides the Lead Partner with the electronic of modification request in the specific field of the PCC. The form is in the section "Project revision" / "Blank Forms."

Save the file of the modification form on your computer

The modification form is in a zipped executable file which the name’s structure is: AA_«Project Acronym »_REV_«Nº».exe Click on the zipped file and select “extract”

You obtain the implementation report form at project / operation scale. The name’s structure is: AA_«Project Acronym »_REV_«Nº».accdr Note : The execution report and payment claim forms run under Microsoft Access 2007. B.02 - MODIFICATION ON BASIC INFORMATION AMENDMENT CLAIM CONTEXTUALISATION

Declaration of the Lead Partner regarding this request for modifications The Lead Partner, must prepare a document which support the modification request. The standard document is available via the function “Print revision proposal”/" Print amendment claim declaration". This document must be signed by the representative having the capacity to commit the Lead Partner organization or having the responsibility of the management of the project. The signed document must be scanned and attached in PDF format in section 1 of this form of modification request. If the signatory has a digital signature it can also be used.

How to attach a document? - Just double click in "Annex", a dialog box appears, click "Add" to access your documents and select the document to be attached - Select document clicking “OK”.

Recommendations for the digitization of the documents: To optimize the process of data transfer, the digitization of documents must be based on the following parameters: - PDF file; - Level resolutions as low as possible; - Scanning in black and white.

B.03 - MODIFICATIONS REGARDING THE PARTNERSHIP COMPOSITION

You can report in the section the changes related to the organizations that comprise the partnership: - Modifications on administrative information (phone, address, ...); - Change of the person's legal representative. In this case you must provide all documents proving this situation and attach them in the Section 8 "Annexes" in PDF; - Modification on the contact person or financial responsible. In this case you must provide all documents proving this situation and attach them in the Section 8 "Annexes" in PDF; Withdraw a partner. This is a major change of the project, which must be previously discussed with the JTS as well as the National Correspondent. The formalization of this withdraw is done by clicking on "Withdraw partner”. The mention of this withdraw will stay visible in all documents, including the execution reports mentioning as a partner "withdrawn."

The request for modifications follows the same structure as the application form that is to say an organization by activity and divided into actions. By default, the initial information (as presented in the application, or later approved changes) are displayed. The changes for modifications of the work plan are important elements of the project, prior contacts with the JTS are highly recommended before introducing this type of modification request. How to formalize the modification of the work plan? You must choose the activity you want to edit and click on "Modify activity data", then choose the actions related to this activity that you would like also modify and click on "Modify action". Then you input the text and the information about the items that are modified in the activity or the action.

For the withdrawn of an activity or action, prior contacts with the JTS are highly recommended before introducing a modification request. You must choose the activity you want to withdraw and click on "Withdraw Activity", then choose the actions related to this activity that you would like also withdraw and click on "Withdraw action".

B.07 - MODIFICATIONS ON BUDGET

The modifications on the budget may be the result of: - Changes related to the work program, as the partnership - Changes in costs (increase / decrease), - Distribution of spending along the project implementing period with a possible influence on the annual breakdown thereof. WARNING It is impossible to register and so certify for a report of expenses that was not originally planned. Therefore, you must make the change BEFORE the commitment of such expenditure (refer Section A.01 of this guide on the general principles governing applications for modification of the project. The budgetary modifications may include: - External financiers (removal / addition of a financier) - Project resources - Expenditure

Modification on an external financers - Withdraw a financier, click on "Delete financier”, you should then adjust the section" Financial resources" accordingly, to register the withdraw of financing was provided by the this external financier. - Addition of a new financier, click on "Add a new financier”. You must have previously defined the financier in Section 2 "Composition of the partnership" by considering this as a financier associated partner. Change in project expenses Expenditures are presented in the same manner as in the approved application. Per partner per year, activity and budget headers. How to display and control the level of budgetary modifications during the implementation period of the project? The budget modifications are sensitive elements of the project.
