WA’s tenancy and residential parks laws are changing to support victims of family and domestic violence (FDV) and help them leave abusive relationships. Senior Policy Officer Trish Blake from the Department of Mines, Industry Regulation and Safety will explain these important changes to the Residential Tenancies Act and the Residential Parks (long-stay tenants) Act which are set to come into effect in late 2018.

The amendments aim to:• Give FDV victims better choices, including whether to stay in a rental home

by excluding the perpetrator or moving to safer accommodation by removing themselves from the tenancy agreement.

• It is hoped the law change removes tenancy-related barriers to leaving a violent relationship.

Part of that is derived from making a return on rent paid, the balance is about ensuring that the money stays in the investor’s pocket. There are laws around ensuring tenants live in properties that are safe and have basic utilities. For this reason, property inspections become an essential part of ensuring we keep property owners informed of the current condition of their investment property and allow them the opportunity to stay ahead and plan for any maintenance that might be coming up. By providing the tenant a safe home, we assist in minimising the risk of the owner facing litigation around unsafe premises and tenant injury.

Trish Blake is a Senior Policy Officer with Consumer Protection at the Department of Mines, Industry Regulation and Safety (DMIRS). For the past 10 years, Trish has had primary responsibility for the review of, and amendments to, the Residential Tenancies Act 1987. Most recently, Trish is the officer responsible for the review of the interaction between family violence restraining orders and the Residential Tenancies Act; this review has led to the drafting of the Residential Tenancies Legislation Amendment (Family Violence) Bill 2018 that is currently before Parliament.

Trish has a law degree and is admitted to practice in Western Australia. She also has a degree with Honours in Social Work and a Post Graduate qualification in Public Policy. Prior to working for Consumer Protection, Trish spent many years working in community legal centres in WA.

STRATA TITLE REFORMSEAN MACFARLANE

Sean Macfarlane is the Senior Lawyer in the Strata Reform team at Landgate. Sean was admitted to practice in 1992 and joined Landgate in 2005. At Landgate, Sean was Director of the International Services Branch that delivered land titling reform consulting services to foreign governments. Sean specialises in strata and property law and has been dedicated to the strata reforms (Strata Titles Amendment Bill and Community Titles Bill) for more than five and a half years.

Dr Anne Purcell is a dispute resolution specialist focusing on the psychology of communication and conflict, especially with high-conflict or difficult personalities. She writes, trains and speaks internationally on alternatives to traditional dispute management and litigation processes

Dr Purcell holds a PhD in Developmental Psycholinguistics and a Masters of Education, Human Development and Psychology from Harvard University and The University of Queensland.

She was a finalist for Mediator of the Year in the 2017 and 2018 in the Australasian Law Awards.

Her main area of interest is on blending multi-disciplinary approaches with science to inform practice and educate practitioners about better ways to manage disputes.

Amy Sanderson has more than 20 years’ experience within the real estate industry across sales, property investment management, team performance, training and consulting all over Australia and New Zealand, and she knows how real estate agents think and feel.

Amy is a licensed real estate agent and business agent, and a qualified trainer and business consultant and is able to leverage her own experience with that of her clients to provide insightful and practical advice on how individuals and businesses can radically improve their performance.

Amy‘s personal property management experience has ranged from small rent rolls; starting with zero properties under management to over 500 in under four years, through to one of the largest in the country where she was overseeing a team of more than 30 people and close to 3,000 properties. She is therefore able to assist property managers and business owners right across the full spectrum of property management operations.

Amy specialises in personal productivity and the leveraging of systems and technology to boost property management performance.
