    Creating a work group consisting of the Managing Director of the Milwaukee County Transit

    System (MCTS), the Sheriff’s Office and the Guardian Angels to work out an operational agreement whereby the Guardian Angels will receive training from the Sheriff’s Department and

    have the ability to act as a community liaison on MCTS Transit buses.

    WHEREAS, the Guardian Angels are exploring the possibility of re-establishing a Guardian Angel chapter in Milwaukee, and

    WHEREAS, Guardian Angels in other cities across the county have been used as an

    additional safety and security liaison to law enforcement officials, and WHEREAS, recent budgetary constraints for both the transit system and the Sheriff’s

    Department has limited the ability of both organizations to provide security or Sheriff personnel on transit vehicles, and

    WHEREAS, the Guardian Angels would provide passengers with additional piece-of-

    mind that an additional security presence is available and would act as a deterrent to unruly or unlawful behavior on transit vehicles, and

    WHEREAS, as a measure to provide additional security on MCTS transit buses, the

    guardian angels can be trained by the Milwaukee County Sheriff’s Department on policies and procedures for providing security on transit buses, now, therefore;

    BE IT RESOLVED, that the Milwaukee County Board of Supervisors hereby directs the

    Milwaukee County Sheriff and the Managing Director of MCTS to meet with representatives of the Guardian Angels to see if an agreement can be worked out whereby the Guardian Angels are allowed access to Milwaukee County buses free of charge while in uniform; and to have training of safety and security policies and procedures provided by the Milwaukee County Sheriff, and

    BE IT FURTHER RESOLVED, that the Managing Director of MCTS and the Sheriff

    will report back their findings to the Committee of Transportation, Public Works and Transit and the Committee on Judiciary, Safety, and General Services, and

    BE IT FURTHER RESOLVED, that if the workgroup agrees to terms allowing the

    Guardian Angels access to monitor transit vehicles, review of such terms will be performed by the Department of Administration Risk Management and Corporation Counsel before implementation, and

    BE IT FURTHER RESOLVED, that upon proper departmental approvals, the agreement

    will be returned to the Committee of Transportation, Public Works and Transit and the Committee on Judiciary, Safety, and General Services for final approval and implementation.

    require State purchasers of goods and services to purchase from Work Centers that employ people primarily with disabilities and demonstrate their ability to do the job; and WHEREAS, State Use Laws are based on a Federal Law known as the Javitts-Wagner-O’Day Act (JWOD) which similarly requires Federal purchasers to set-aside Federal contracts with Work Centers qualified, able and willing to perform the service or provide the good; and WHEREAS, unemployment among people with disabilities is in excess of 70% across the State of Wisconsin; and WHEREAS, a majority of these individuals with chronic disability rely on long-term care services that are funded in part by Milwaukee County; and WHEREAS, Milwaukee County wishes to promote the employment of people with disabilities through the purchase of goods and services provided substantially by people with disabilities; and WHEREAS, Community Rehabilitation Facilities are Work Centers and are able to provide employment of people with disabilities and perhaps supply the County with goods and services of certain kinds; and WHEREAS, Work Centers would not replace or “privatize” services already being provided by Milwaukee County employees, but would offer Work Centers an opportunity to competitively bid on certain goods and services that are currently secured from the private sector; and WHEREAS, the formation of a County Work Group to study the benefits of a possible County Use Ordinance would be helpful to policymakers in deciding whether or not to implement such a program and, if so, how it should be structured; now, therefore, BE IT RESOLVED, that the Milwaukee County Board of Supervisors hereby authorizes a Work Group to study the possible structure and implementation of a County Use Ordinance that would encourage the use of Work Centers that primarily employ people with disabilities to provide certain goods and services that are currently being provided by the private sector; and BE IT FURTHER RESOLVED, that the Work Group shall be comprised of the following individuals or their designees: Director, Department of Administrative Services (Chair), DAS-Purchasing Administrator, Director, DAS-Office for Persons with Disabilities, Corporation Counsel, Director, Department of Health and Human Services, Director, Transportation and Public Works and a representative from the County Board Research staff; and BE IT FURTHER RESOLVED, that the Work Group shall provide a written report to the appropriate County Board Committee(s) outlining its findings and recommendations for consideration during the March 2008 meeting cycle.

WHEREAS, the Milwaukee County Courthouse campus consists of the Courthouse, the Community Correctional Center, the Criminal Justice Facility, Medical Examiner Facility and the Safety Building; and WHEREAS, these facilities are interdependent with Children’s Court, Child Detention and the House of Corrections; and WHEREAS, most of these facilities were build a long time ago and were either not built for the current use, or the needs of the department or functional area have changed; and WHEREAS, an evaluation of the type of function and the facility in which it is housed needs to be done to better understand the future requirements for each department; and WHEREAS, greater efficiency may be achieved by centralizing some functions that are currently scattered throughout the County; and WHEREAS, greater savings may be achieved by retrofitting or relocating to facilities that take advantage of improved energy saving materials; and WHEREAS, involving stakeholders will assure that all aspects of each operation are adequately reviewed; now, therefore, BE IT RESOLVED, that the Milwaukee County Board of Supervisors hereby authorizes the creation of the Courthouse campus workgroup represented by the Director of Economic Development, Director of Administration, Director of Facilities Management, Director of Architecture and Engineering, Chief Judge, Sheriff, District Attorney, Superintendent of the House of Corrections, Clerk of Courts, County Clerk and County Board staff; and BE IT FURTHER RESOLVED, that the workgroup will examine facility costs such as deferred maintenance, useful remaining life, annual operating costs, annual maintenance costs, square feet required by each department, square feet available, net space surplus or deficit; and BE IT FURTHER RESOLVED, that the workgroup will review various departmental needs such as, but not limited to, customer service, functional workflow, centralization, public and employee safety needs and combined efforts of other service areas; and

    endorsing the WHEDA Tax Credit application for Inner City Redevelopment Corporation (ICRC) to construct 12 duplex townhouses bounded by 5th Street at the West; 2nd Street at the

    East; Townsend Street at the North; and Chambers at the South and providing a grant of $100,000 from the Inclusive Housing Fund.

    WHEREAS, Milwaukee County established the Inclusive Housing fund in the 2006 Capital Budget (WO043) to be used to carryout the affordable housing provision of the Park East Redevelopment Compact (PERC) and $1 million of revenue from Park East land sales was budgeted in 2006; and WHEREAS, Milwaukee County appropriated $1 million in the 2008 Capital Budget for the inclusive Housing Fund (WO043) to be used to assist in developing affordable housing; and WHEREAS, ICRC is proposing to build 12 duplex three bedroom units called Leon H. Sullivan Townhouses on scattered sites within these boundaries and ICRC is applying to Wisconsin Housing and Economic Development Authority (WHEDA) for Federal tax credits for this project (a copy of their project description shall be included in this file) and county support for this project would assist them in securing and complying with the WHEDA requirements; and WHEREAS, Milwaukee County would enhance their application if this resolution was approved prior to completion of final review of their WHEDA application; and WHEREAS, ICRC’ s Sullivan Townhouses are located in a redevelopment area within the Martin Luther King Drive and Brownsville neighborhoods and ICRC has a long history of providing well managed affordable housing; and WHEREAS, the construction of the new townhouses (which is estimated to cost $5.7 million) with WHEDA tax credits (on land provided to them by the City) would expedite the provision of new affordable housing in the City of Milwaukee where there is a need for quality affordable housing; and WHEREAS, the policies for use of the Inclusive Housing fund have not yet been

    developed but this project may meet these requirements when the county adopts policies for this program; and WHEREAS, the approval of a grant from the Inclusive Housing Fund prior to the completion of final review by WHEDA would increase the evaluation points for this project, which improves the likelihood that WHEDA will fund this project; now, therefore, BE IT RESOLVED, that the Milwaukee County Board of Supervisors adopts the following policies for the use of the Inclusive Housing Fund for WHEDA funded rental projects:

    1. Eligible applicants are non-profit developers or agencies who have the capacity and the experience to develop and manage affordable housing.

    2. Eligible projects are new construction or rehabilitation projects that provide affordable housing of at least 50% of the units developed and are rented to persons who meet WHEDA income requirements.

    3. Minimum requests of $100,000 for each project. 4. Eligible activities are project costs related to new construction, rehabilitation, acquisition

    of real property, clearance and demolition, removal of architectural barriers, and other activities necessary for the development of the project.

    5. Disadvantaged Business Enterprise (DBE) participation shall include an agreement from the project developer to meet or exceed County DBE requirements pertaining to construction projects.

    6. The Committee on Economic and Community Development will review each individual request for funding. The Committee may consider the following along with other factors:

    a) Capacity of applicant to develop and maintain the project. b) Cost effectiveness and financial feasibility of project (short and long term). c) Suitability of property management plan. d) Suitability of site and physical configuration of project. e) Amount of Gap funding to be provided. f) Housing, which is supported by the Inclusive Housing Fund, shall remain

    affordable for a minimum of 30 years with a review by the County Board of the affordability requirement at 15 years.

    Successful applicants will be required to sign a development agreement. Policies for other housing developments or changes to these policies will be considered after being reviewed by the Committee on Economic and Community Development; and BE IT FURTHER RESOLVED, that the County Board approves a grant of $100,000 to ICRC’s Leon H. Sullivan Townhouses from the Inclusive Housing Fund for this project, contingent on this project receiving WHEDA funding and ICRC agreeing to comply with any policies adopted by the County Board for use of the Inclusive Housing Fund prior to the date that these funds are actually provided to help fund this project; and BE IT FURTHER RESOLVED, that Milwaukee County endorses the WHEDA tax credit application for ICRC Leon H. Sullivan Townhouses by approving this resolution; and BE IT FURTHER RESOLVED, that the Director of Economic and Community

    Authorizing and directing the Director of the Department of Parks, Recreation and Culture to develop a five-year and a ten-year capital improvements plan for the entire parks system

    including a prioritization of projects and associated costs. WHEREAS, in July 2006, the Milwaukee County Board of Supervisors adopted a resolution (File No. 06-330) directing the Parks Director to prepare a cost estimate of all deferred maintenance within the parks system; and WHEREAS, in September 2006, the Parks Department presented a report (dated September 8, 2006) that provided a report to the Committee on Parks, Energy and Environment listing infrastructure and maintenance/replacement needs; and WHEREAS, the assessment considered Parks buildings, dams, wading and swimming pools, playgrounds, boat launches, park roads, parking lots, multi-purpose trails, services yards, basketball and tennis courts, golf courses, beaches, shoreline and breakwaters and ponds/lagoons; and WHEREAS, repair or replacement of these facilities and infrastructure was estimated to cost over $148 million and is expected to be higher because it does not include costs associated with utilities, bridges, McKinley Marina and inflation; and WHEREAS, the 2008 Adopted Budget appropriates additional tax levy funds for non-bondable parks maintenance projects and additional general obligation bonds for aquatics maintenance than proposed in the County Executive’s 2008 Recommended Budget; and WHEREAS, nevertheless, parks maintenance needs will continue to grow as tax levy and general obligation bond funding becomes more difficult to secure for such projects; and WHEREAS, a comprehensive capital improvements plan that identifies all parks capital needs, prioritizes them and estimates future costs is critical to the future operation of the parks system; and WHEREAS, a five-year and a ten-year plan that provide a short term and long term roadmap for future parks maintenance should be presented to the Committee on Parks, Energy and Environment prior to deliberation of the 2009 budget for Milwaukee County; now, therefore,

    Authorizing and directing the Director of the Department of Parks, Recreation and Culture to develop recommendations on the display of United States flags in Milwaukee County parks.

    WHEREAS, Milwaukee County displays United States flags throughout the parks system as a sign of patriotism and pride; and WHEREAS, when the Parks Department use to employ significantly more park workers, the U.S. flags were routinely hoisted in the morning and lowered in the evening; however, this is no longer the practice in most parks due to a lack of staffing; and WHEREAS, at any given time, a U.S. flag may be displayed in a county park twenty-four hours a day, which violates United States Code Title 4, Chapter 1 that specifies the U.S. flag is to be displayed only from sunrise to sunset on stationary flagstaffs and buildings but may be displayed twenty-four hours a day if properly illuminated during the hours of darkness; and WHEREAS, the Parks Department is undertaking an inventory of all U.S. flags in county parks to determine whether they are hoisted and lowered routinely or flown twenty-four hours a day with proper illumination; and WHEREAS, once the inventory is complete, it is expected that the Parks Director will report back to the County Board with recommendations as to which parks flags should be lit for twenty-four hour display versus those that should be manually hoisted and lowered on a daily basis and the related costs; now, therefore, BE IT RESOLVED, that the Milwaukee County Board of Supervisors hereby authorizes and directs the Director of the Department of Parks, Recreation and Culture to develop

    A RESOLUTION Urging the Wisconsin State Legislature and Governor to approve Senate Bill 367, the Corporate

    Tax Accountability Act, requiring greater reporting by corporations on tax liability and tax reduction methods.

    WHEREAS, Wisconsin State Senate Bill 367, introduced December 21, 2007, would require all publicly traded corporations doing business in Wisconsin, including those traded on foreign stock exchanges, and all corporations for which 50 percent or more of the voting stock is owned directly or indirectly by a publicly traded corporation to submit annual statements to the Department of Revenue; and WHEREAS, the legislation requires that such statements contain certain information regarding the corporation, including name and commercial domicile, total gross income, total business income apportioned to Wisconsin, and total deductions for management services, fees, rents, royalties, interest, and license fees paid to an affiliated entity; and WHEREAS, according to the lead sponsor, the purpose of the legislation is to provide greater transparency of the taxes paid by corporations in Wisconsin as well as techniques used by corporations to reduce their tax burden or avoid paying state income taxes; and WHEREAS, the legislation is also designed to get the information needed to have a well-informed debate over the current tax structure and the fairness or lack thereof of our current tax system and to make certain policies are fostering competition and providing a level playing field for all Wisconsin businesses; and WHEREAS, a December 2007 study by the Institute for Wisconsin’s Future titled An Analysis of Corporate Tax Avoidance showed that approximately two-thirds of the more than 50,000 corporations that filed tax returns with the Wisconsin Department of Revenue in 2004 showed a bottom-line of zero tax dollars; and

    WHEREAS, the proposed legislation would not create any proprietary issues for corporations doing business in Wisconsin because of a two-year lag in making the information public and because most of the filings that would be required under the bill are already required by the Securities and Exchange Commission or other state and federal agencies; now, therefore, BE IT RESOLVED, that the Milwaukee County Board of Supervisors hereby urges the Wisconsin State Legislature and Governor to approve Senate Bill 367, the Corporate Tax Accountability Act, requiring greater reporting by corporations on tax liability and tax reduction methods; and BE IT FURTHER RESOLVED, that the Director of Intergovernmental Relations is hereby authorized and directed to convey the position established by this resolution to the Governor and members of the Wisconsin State Legislature.
