Newsletter 2016-5 February 5, 2016 PREVAILING WAGE REPEAL BILL GOES TO GOVERNOR; VETO AND VETO OVERRIDE EXPECTED The Senate Thursday passed H.B. 4005, the bill eliminating prevailing wage in West Virginia. The House approved the bill earlier, so the bill goes to the Governor for his signature. It is expected he will veto the bill, followed by a legislative override since West Virginia only requires a simple majority to override. The Senate’s 18-16 vote was along party lines and came after two hours of debate for those for and against repeal. Supporters of prevailing wage argued that it provides a living wage for workers, while keeping out-of-state contractors from undercutting West Virginia construction companies. Opponents argued that prevailing artificially inflates the cost of public projects, thus costing taxpayers more money. CAWV members have expressed their own thoughts to their legislators on the bill, both in favor and opposition of full repeal of prevailing wage. Thursday’s action culminates nearly 15 months of study and debate on prevailing wage. The Legislature was poised to eliminate prevailing wage in the 2015 legislative session but a compromise was struck by developing a new method to calculate prevailing wage. WorkForce West Virginia was charged with developing a new methodology to be presented to legislators June 1, 2015. The new method was immediately rejected which resulted in a temporary suspension of prevailing wage requirements. When WorkForce published the new rates effective October 1, 2015 that were very close to previous rates, lawmakers expressed concern that the process was flawed. Legislative leaders have said since October that full repeal would be high on their agenda in the 2016 session. Right-to-work legislation was the top legislative agenda and West Virginia is poised to be the 26 th right-to-work state in the nation. The House Thursday, after five hours of debate, passed S.B. 1, the Workplace Freedom Act. The House passed the bill 54-46 with no Democrats voting against with 10 Republicans joining them. The House Judiciary Committee amended the Senate bill so the bill goes back to the Senate where quick approval is expected. Gov. Tomblin issued a statement that he will veto the bill, which is also expected to be overridden. In closing debate on the bill, House Judiciary Chairman John Shott, R-Mercer, summed up support for right-to-work by saying, “We can’t live in the past, it’s not working; [West Virginia is] going down the tubes fast.” In other legislative action this week, the House Government Organization Committee today amended H.B. 2028 to codify the rule that restores the change order process for construction contracts. The House Judiciary Committee is scheduled to take up the rules bill later today. In other construction contracts issues, S.B. 474 would give the WV Division of Environmental Protection the authority to contract direct, without going through the state Purchasing Division, for construction and reclamation projects. In the West Virginia Department of Transportation’s budget presentation this week to the House and Senate Finance committees, Secretary Paul Mattox told lawmakers the WVDOH has identified $16 billion worth of highway projects planned that he says will never go to construction without additional funding. Senate Finance Committee Chairman Mike Hall, R-Putnam, told committee members, “I will make this commitment. This committee will do something about [WVDOH’s budget problems.] If it goes no further than this committee, so be it. But [this committee] will bring something forward.

For 20 months, West Virginia lead the nation in the highest percentage of construction jobs lost in a year’s period. For the first time in nearly two years, West Virginia ranked 50 out of 51 for construction jobs lost between December 2014 and December 2015. North Dakota (-8.1 percent, -3,000 jobs) lost the highest percent and total number of construction jobs. West Virginia came in second with a decrease of 7.1 percent, equaling 2,300 jobs lost. Forty-four states and the District of Columbia added construction jobs in 2015 while construction employment increased in 39 states and D.C. between November and December amid strong demand for construction in most states, according to analysis of Labor Department data released today by the Associated General Contractors of America. Association officials said that many of the states experiencing construction declines appear to be energy producing states. A total of six states shed construction jobs during the past 12 months including: New Mexico (-3.5 percent, -1,500 jobs), Wyoming (-1.7 percent, -400 jobs), Rhode Island (-0.6 percent, -100 jobs) and Pennsylvania (-0.2 percent, -500 jobs). The Three-Point Rule . . . You Don't Have To Fall

Falling while getting into or out of heavy equipment, a truck or tractor cab, hooking up air and electrical lines, or mounting or dismounting trailers is a sure way to get seriously hurt. An insurance industry study showed that falls from vehicles produced injuries that were almost 25%

worse than other types of injuries.

Even an ankle sprain can play havoc with your ability to use the clutch. Minor injuries can cost you big in terms of lost income and downtime. The biggest single cause of falls from a vehicle is driver error and failure to follow the THREE-POINT rule.

WHAT CAN YOU DO TO AVOID FALLS?

No matter what type of access system your vehicle has available, use the THREE-POINT system to significantly reduce the chance of a slip or fall. The THREE-POINT system means three of your four limbs are in contact with the vehicle at all times—two hands and one foot, or

two feet and one hand.

The THREE-POINT system allows a person to have maximum stability and support, thereby reducing the likelihood of slipping and falling. Be a winner; use the THREE-POINT system.

DO’S:

Wear shoes with good support -- not sandals, bare feet or high heels. Exit and enter facing the cab. Slow down and use extra caution in bad weather. Get a firm grip on rails or handles with your hands.

Look for obstacles on the ground below before exiting.

DON’Ts:

Don’t climb down with something in your free hand. Put it on the vehicle floor and reach up for it when you get down on the ground.

Don’t rush to climb out after a long run. Descend slowly, to avoid straining a muscle. Don’t ever jump out. You may land off balance or on an uneven surface, and fall. Don’t use tires or wheel hubs as a step surface. Don’t use the door frame or door edge as a handhold. Don’t become an injury statistic.
