As you know, summer is a very popular home improvement season. Our Property Modifi cation Committee (PMC), formerly the Architectural Review Committee (ARC), has received many requests for approval and we’re working diligently to expedite these for you. In some instances, when we drive by a property to review a request, we have found that the work is already being done prior to the approval being processed. Please be sure you have received our fi nal approval before beginning the work. Also, we have discovered that several homeowners are having work done without submitting a request. In order to maintain standardization in our neighborhood and, per our Bylaws, you must submit a request and receive approval, prior to doing most outside improvements. There are many different categories included, so be sure to read the PMC guidelines to help determine if a request and approval will be required. Both the Request for Home Improvement Modifi cation form and the Home Improvement Guidelines can be downloaded at www.eldoradohomeowners.org. You can also request these be mailed to you by calling 972.943.2877. Also, each of you should have received a copy of the revised PMC Guidelines in the mail, so please take the time to review them. I often get questions on how the Eldorado Homeowners Association enforces the Property Modifi cation Guidelines and the covenants listed in the Declaration of Covenants and Restrictions. The association Board of Directors has adopted a Fining Policy to enforce compliance with the association’s governing documents. Part of the policy specifi es the timeline followed for violation notifi cation along with timeframes homeowners have to cure the violation. Summary of Notifi cation Process: First Notice – Sent 1st class mail, references violation and a statement that violation must be cured no later than 10 days from the date of the notice. Second Notice – If the owner fails to correct the violation within the initial 10 day compliance period a second notice is sent containing a description of the violation, the amount of the proposed fi ne and a statement that violation must be cured no later than 10 days from the date of the notice. (See reference to Texas Property Code below which supersedes portions of this policy) Notice of Fine Application - If the owner fails to correct the violation within the second 10 day compliance period a notice is sent containing a statement that a fi ne for non-compliance is applied against the owner’s account. There is no limit to the aggregate amount of fi nes which may be imposed.

In addition to the association’s policy there are further rights afforded to homeowners under the Texas Property Code. Section 209.006(a) of the Property Code states, “Before a property owners association may suspend an owner’s right to use a common area, fi le a suit against an owner other than a suit to collect a regular or special assessment or foreclose under an association’s lien, charge an owner for property damage, or levy a fi ne for a violation of the restrictions or bylaws or rules of the association, the association or its agent must give written notice to the owner by certifi ed mail, return receipt requested” This notice must inform the owner they are entitled to a “reasonable period to cure the violation”. Also the owner may request a hearing with the Board of Directors on or before the 30th day after the owner receives the notice. As you can see there are several steps the association must follow to enforce the covenants. Do not necessarily assume inaction by a non-compliant owner means inaction by the association. Your management company performs compliance inspections bi-weekly and adheres to the policy and regulations stated above. I am happy to report that the great majority of covenant violations are corrected after the fi rst notice. You live in a community where homeowners take great pride in the care and maintenance of their homes. Did you know that trees are the longest living organisms on earth? Trees are one of the world’s most valuable natural assets. They produce oxygen, without which the living planet cannot exist. They provide unparalleled building materials. And they have great character and eye-appeal throughout the seasons. One of the most talked about assets of our own neighborhood are our mature trees. That’s why we need to preserve and maintain our trees. Even though trees may be private property, their size and character make them part of the community as well. Think of tree care as an investment. A healthy tree increases in value with age—paying big dividends, increasing property values, beautifying our surroundings, purifying our air, and saving energy by providing cooling shade from summer’s heat and protection from winter’s wind. To function well in the landscape, trees require some maintenance. Much can be done with corrective pruning and mulching. Here are some techniques used by professional arborists for tree maintenance. Cleaning is the removal of dead, dying, diseased, crowded, weakly attached, and low-vigor branches from the crown of a tree. Thinning is the selective removal of branches to increase light penetration and air movement through the crown. Thinning opens the foliage of a tree, reduces weight on heavy limbs, and helps retain the tree’s natural shape.

Pruning is necessary to maintain a mature tree in a healthy, safe, and attractive condition. Do not leave too much of a “stub” when removing a branch. The problem is, once this stub dies off, it creates a perfect entry point for insects and disease pathogens. Also, efforts should be made not to create wounds on tree trunks with lawn mowers and other machinery. Destructive fungi are opportunists! El Dorado’s trees are a major draw for potential buyers, if you are having problems with trees on your property please consult an arborist for advice. Remember you must get approval from the PMC prior to removing trees from your property.

What draws people to Eldorado? I’ve found that people love the small feel of Eldorado, the trees, rolling hills and the schools! But, Eldorado is getting older, and just as the HOA has had to deal with replacing and updating due to aging; homeowners are faced with the same problems! I’m constantly asked, “How can I improve the value of my home?” or “I’m thinking of selling in a year or so, what should I do?” I believe that Eldorado will always be a strong attraction for buyers, so it’s important to make your home the “shinny penny in the pot”. There are tons of pre-owned homes on the market and the builders are making incredible deals to help keep their inventory moving. So what should we do? How do I make my home stand out? There are a few areas that are very important and will give you the most back for your investment. It’s time to make those 80’s and 90’s kitchens and bathrooms come into 2007! You can expect a return of about 85% on kitchen and bathroom remodels. In the kitchen it’s time to replace the countertops, sink, backsplashes, appliances and fl ooring. Granite is currently very popular for countertops, but there are many other products on the market now that look just as good and are easier to take care of. Go neutral! A prospective buyer can deal with neutral colors and

work to make it their own. So stick with neutral colors which will never look dated. Popular today may be gone tomorrow! Clean, clean, clean! When your kitchen and bathrooms are squeaky clean, people tend to feel that the rest of the house is maintained the same way. Fresh carpeting can give a home a real lift. Neglected caulk in bathrooms and kitchens turns buyers off and is one of the easiest things to fi x. Remember, you may never get another chance to make a good fi rst impression, so make the fi rst drive up to your home a memorable one. A fresh coat of paint on the front door will say “Welcome”. Just as our homes are aging, so is our landscaping. What a dramatic difference new shrubs can make to your landscape! Now that we have all these great trees, what do we do with them? Keep them trimmed! Proper pruning will allow sunlight to penetrate and keep the grass growing and also strengthen the trees from storm damage as we have seen in the past. Remember to get HOA approval for any major trimming, landscape projects or painting (even if it’s the same color). Lastly, I’ve heard too many people who fi x their homes up to sell and say “Why didn’t I do this sooner?” Enjoy those improvements, who knows, you might just decide that there’s no place like your current home!

Who to Call for City Code Enforcementand Utility Repairs

The Association often receives complaints concerning items which are not covered by the Declaration of Covenants and Restrictions. Many of the reasons for the calls, such as a car which appears to be inoperative for over 30 days or a streetlight is inoperative, etc, are handled by the city or the utility company. We recommend that the homeowner contact the city or utility company directly to assure a contact person, accountability, and getting the job completed in the quickest manner. Your Friends and Neighbors, Your homeowners association board, block captains, and committee members are all volunteers. Read about them in the monthly newsletter. Bill Bennett- Block Captain – Roundrock Trail Bill and Kathy Bennett moved to McKinney from Plano just nine years ago. Bill is originally from East Texas and Kathy grew up in Redding California. Bill and Kathy moved to Eldorado because of the trees and hills and small town fl avor of McKinney. Bill and Kathy have three children with the oldest starting High School next year and the youngest at Valley Creek Elementary. They believe the wonderful faculty, staff, parents and kids at Valley Creek Elementary School has been a great experience and are a huge asset to both Eldorado and McKinney. Bill has served on the Eldorado HOA Board a few years back as well as president of the “Cougar Dads” at Valley Creek Elementary. Kathy has served on the Faubion Band Booster Club board and is a Girl Scout Leader. Suzette Seabury – Block Captain – Hillcrest Court Suzette and her husband Sam moved to Hillcrest Ct. eight years ago from a zero lot line community, Highland on the Creek at White Rock Creek in Dallas, and were delighted to fi nd a zero lot in Eldorado. Both of their children moved to McKinney, so needing to downsize they followed them north. Suzette has a small travel company, and conducts House & Garden tours to Charleston, SC & Savannah, GA, the Chelsea Garden Show in London, and a new adventure, hosting cooking classes in Italy. She just retired from conducting Antique trips to France, but says she’s always ready to help some one plan a trip there.
